Abstract: Differences between contract laws of Member States are often said to impose costs on and deter cross-border trade; and, that in order to increase cross-border trade, these contract laws ought to be harmonized. This article considers whether there is a need for harmonization; and if so, what form it ought to take. The discipline of psychology is relied on to answer two underlying questions: how do actors think about these differences when they decide to contract? How does the form of harmonization influence such decisions? Insights from cognitive and social psychology are identified and applied to find out how actors think and what motivates them to make the decisions they do. These insights lead us to question whether actors think about differences between contract laws. This is a point which, in turn, questions the need for harmonization. Furthermore, if a great many actors prefer the status quo, this strongly suggests that harmonization by way of optional rules may not achieve the desired result. Résumé: Il est souvent dit que les différences entre le droit des contrats des États Membres imposent des coûts supplémentaires et découragent le commerce transfrontalier ; que, afin d’augmenter le commerce transfrontalier, ces droits devraient être harmonisés. Cet article s’interroge sur le besoin d’harmonisation et, dans l’affirmative, sur la forme qu’elle devrait prendre. Une approche comportementale est adoptée pour répondre à deux questions fondamentales : comment est-ce que les acteurs envisagent ces différences quand ils décident de s’engager par voie de contrat ? Comment le mode d’harmonisation influe sur de telles décisions ? Les perspectives de disciplines telles que la psychologie cognitive et sociale sont identifiées et appliquées pour découvrir comment les acteurs pensent et ce qui motive les décisions qu’ils prennent. Ces perspectives de la psychologie nous mènent à douter que les acteurs pensent aux différences entre les droits nationaux des contrats. Une telle conclusion remet, à son tour, en cause la nécessité d’une harmonisation. En outre, si un grand nombre d’acteurs préfèrent le statu quo, cela suggère fortement que l’harmonisation, par le biais de règles facultatives, peut ne pas aboutir au résultat visé.

Si le concept de « contrat psychologique » est désormais largement répandu dans la littérature, les instruments de sa mesure font encore défaut. Rousseau a proposé en 1990 le Psychological Contract Index (PCI), qu’elle a actualisé en 1998-2000. Cet article vise à adapter cet outil en France et à le compléter en testant deux mesures de la réalisation du contrat psychologique : une mesure directe et une mesure soustractive. Il pose aussi le problème de la mesure de la réciprocité propre au contrat psychologique et s’appuie sur le modèle de Morrison et Robinson pour tester une relation modératrice entre les scores de réalisation de l’entreprise et ceux de l’employé. Les résultats d’une enquête menée auprès de 217 cadres français confirment partiellement les hypothèses de l’auteure. Ils montrent que la structure factorielle du PCI manque de stabilité et doit faire l’objet de nouvelles recherches quant à sa validité : 14 facteurs sont identifiés au lieu des sept avancés par Rousseau dans le PCI. Conformément aux hypothèses posées, c’est la mesure directe de la réalisation du contrat qui démontre la meilleure validité. En outre, l’auteur valide le rôle modérateur de la réalisation du contrat psychologique par le salarié.

La pandémie et le manque de main-d’œuvre qui affecte les entreprises et les organisations ne sont pas sans impact sur le milieu de travail. Ces deux conjonctures perturbent l’organisation du travail et l’attribution de tâches aux employés. De la même façon, les bouleversements engendrés par les fusions, défusions et réformes qui surviennent chaque décennie dans le réseau de la santé et des services sociaux du Québec entraînent leurs lots de changements. Chacun d’entre eux amène les gestionnaires, mais aussi les employés, à s’adapter. Au cœur de ces perturbations, le contrat psychologique (CP) se voit mis à l’épreuve alors qu’il émane de la relation d’emploi. Il se voit à risque de rupture alors qu’une telle rupture entraîne des coûts pour une organisation. Il est donc à propos de se demander : les pratiques de gestion peuvent-elles minimiser l’impact des bouleversements organisationnels sur le contrat psychologique? Par le recours à une méthode mixte (mixed method), l’étude présentée ici a permis de constater les effets favorables et défavorables de certaines pratiques de gestion liées à l’organisation du travail et aux pratiques d’attribution de tâches sur le contrat psychologique lors d’un bouleversement organisationnel. Offrant des bases à de nouvelles recherches sur les pratiques de gestion tout comme sur le contrat psychologique, les résultats permettent à des gestionnaires de prendre conscience de leur impact sur le contrat psychologique, et d’identifier des pratiques de gestion de l’organisation du travail et de tâches favorables au contrat psychologique afin d’en tirer profit dans le contexte actuel.

The goal of this research is to clarify, through comparative quantitative analysis, the effects of psychological contract violation on individual organizational commitment in a federal (Canadian), public organization and a private firm, both located in Quebec, in light of individual, organizational, and situational characteristics. In simplifying the results presented in the following pages, let us keep in mind that the significant difference between the public organization and the private firm concerning psychological contract violation is low (p <_ 0,05). The results of multivariate regressions suggest that violation of the psychological contract explains an important part of the variance of organizational commitment (affective and moral), just as much as they suggest that individual variables such as certain career anchors, career orientation, and locus of control exercise the most influence on organizational commitment.

La carrière organisationnelle, bureaucratique ou traditionnelle (Condomines, 2015) correspond à une succession de fonctions ou d’emplois occupés par un salarié dans une entreprise (Hughes, 1937 ; Wilensky, 1961). Elle s’inscrit dans le cadre d’une relation d’emploi à long terme et implique des dimensions affectives et subjectives que l’on exprime à travers la notion de contrat psychologique (Taskin, Dietrich, 2016, p. 201). Ce contrat psychologique est à la fois volontaire, subjectif, dynamique et informel (Hiltrop, 1996). Il peut s’appréhender comme un accord implicite entre le salarié et son entreprise (Argyris, 1960, p. 96), une relation de réciprocité (Levinson, Price, Munden, Mandl, Solley, 1962, pp. 130-131) ou des croyances individuelles et collectives partagées concernant la relation d’emploi (Rousseau, 2014, p. 14 ; Rousseau, Wade-Benzoni, 1994). Le contrat psychologique a une influence sur les attitudes et les comportements des collaborateurs (McLean Parks, Kidder, Gallagher, 1998).

The approaches to design of individual program of professional development of Pedagogue-psychologist that were developed within the framework of the pilot site for approbation and introduction of the professional standard "Pedagogue-psychologist” in Cheboksary of the Chuvash Republic in 2015-2017 are outlined. Attention is drawn to the important role of territorial methodological services accompanying the professional development of psychology teachers in ensuring their transfer to "effective contracts". AbstractIn matters of the mind, the opposition between what is mind-made or inside and natural or outside the mind is bound to misfire. Lindquist et al. build their analysis on a strong contrast between naturalism, which they reject, and psychologism, which they endorse. We challenge this opposition and indicate how adopting psychologism to combat a naturalistic view of emotional mind/brain areas is self-defeating. We briefly develop the alternative view of emotions as mental organs.

In this paper we examine how groups develop normative contracts based on beliefs about the obligations other members of the group must fulfil in order to achieve group goals. The role played by perceived leadership – task- or relationship-oriented – was analyzed in relation to the development of relational normative contract and group performance. The study sample comprised 72 participants (24 groups of 3 members). A member of each team received training to be a group leader (task- or relationship-oriented leader). All groups worked on a simulation program: a complex decision-making managerial task. Group regulatory variables and group processes were evaluated during the simulation. Results showed that task-oriented leaders effected higher group efficacy and positivism among members of the group. In contrast, relationship-oriented leaders effected greater cohesion between the group's members. The final group performance is explained from the perspective of group efficacy and the relational normative contract.

E-businesses and online transaction have become a norm in today’s society. One of the industries that use e-businesses extensively is tourism business and buying online flight ticket is the most common feature of today’s way of travelling. In online booking of flight ticket transaction, the standard terms and standard form contracts are generally used to legalize the transactions and consumers have to agree to all the standard terms prior to payment and finalizing the transaction. Unfair contract terms are terms which may unfairly exclude or limit liabilities in a contract and such terms are legal and binding if agreed and accepted by the contractual parties. It is observed that the application of unfair contract terms is not knowingly or conscientiously accepted by one or some contractual parties as they are normally inserted as standard terms in standard form contracts. It is perceived that with the current practices of standard terms and standard form contracts in online booking of flight tickets, consumers might be a prey of unfair contract terms. This normally occurs when consumers or purchaser agreed to all terms of the airlines operators/companies without properly or vigilantly reading the whole agreements. This paper analyse the principles, application and effect of unfair contract terms in online booking of flight tickets agreements. For the purpose of discussion in this paper, references are only made to online terms and contract used by airlines companies incorporated in Malaysia.

The contrast sensitivity function of the human visual system, measured with sinusoidal luminance gratings, has an inverted U shape with a peak around 2–4 c/deg. Above threshold, it is thought that luminance gratings of equal physical contrasts but of distinguishably different spatial frequencies are all perceived as having similar contrasts, a phenomenon that has been termed contrast constancy. However, when suprathreshold contrast matches were measured for pairs of luminance gratings whose spatial frequencies were indistinguishable, the matching curves were not flat and followed a similar inverted U shape form as the contrast sensitivity function at threshold. It was therefore suggested that contrast constancy may only be revealed when matching the contrasts of clearly distinguishable spatial frequencies. Here, observers matched the perceived contrasts of suprathreshold luminance gratings of similar but visibly different spatial frequencies between 0.25 and 16 c/deg. The results show that, much like the contrast sensitivity function at threshold, observers are more sensitive to intermediate spatial frequencies (1–6 c/deg) than they are to either higher or to lower spatial frequencies. This tuning is evident when matching reference contrasts of 30–80%, implying a significant role in everyday vision. To demonstrate that these results were not due to local adaptation, the experiment was repeated with shorter stimulus duration, producing the same results. The extent of departure from contrast constancy found in the present study is compared to previously reported suprathreshold measurements. The results are also discussed with consideration to limitations with display apparatus such as monitor blur.

La recherche étudie l’impact des changements apportés dans trois systèmes de GRH sur la variation de l’engagement affectif des employés d’un établissement de santé au Québec entre 1999 et 2002. La problématique de la recherche se base sur la théorie du contrat psychologique de Rousseau (1995), selon laquelle les changements organisationnels modifient les paramètres de la relation d’emploi, lesquels permettent d’améliorer les conditions de travail et le contrat psychologique de l’employé. À l’aide de deux échantillons comparables de 80 répondants, les résultats révèlent que les employés sont plus autonomes et peuvent davantage participer aux processus décisionnels, que les procédures sont plus impartiales et que la perception de plafonnement de carrière est moins élevée dans l’échantillon de 2002 comparativement à celui de 1999. Ces améliorations dans la gestion des ressources humaines sont accompagnées d’une faible augmentation du niveau d’engagement affectif en 2002.

PURPOSE The major purpose of the current study was to evaluate the psychologic and neuropsychologic functioning of patients undergoing treatment with autologous bone marrow transplantation (ABMT). PATIENTS AND METHODS Fifty-four patients with hematologic disorders or breast cancer completed a battery of psychologic and neuropsychologic tests before ABMT, at mid-treatment (1 to 3 days following bone marrow reinfusion), and predischarge (within 1 to 2 days before discharge from the hospital). RESULTS Analysis of pretransplant data showed significantly higher scores on the State-Trait Anxiety Inventory (STAI) and Profile of Mood States (POMS) for patients with hematologic disorders as compared with patients with breast cancer. However, no baseline differences on neuropsychologic measures were found when patients were divided into groups based on prior exposure to cranial radiation and/or intrathecal chemotherapy. Serial evaluations at pretransplant, following return of bone marrow, and at predischarge were available for 34 patients. For the psychologic data, patients with hematologic disorders tended to be more distressed than breast cancer patients at baseline, but became less distressed over time. By contrast, breast cancer patients were relatively less distressed at baseline, demonstrated a significant increase in distress midtreatment, and returned to baseline levels at predischarge assessment. Scores on neuropsychologic measures that assessed higher order cognitive functioning generally worsened over time. CONCLUSION The results suggest a differential response on psychologic measures when comparing patients with hematologic disorders with those with breast cancer. However, both groups demonstrated a general decline in performance on neuropsychologic measures over the course of treatment.

Abstract (sommario):
Barbara Held’s article (2020) challenges the “for/about prepositional divide” (p. 349), which is presumed by critical and Indigenous psychologies, at two empirical and epistemological levels. I argue that Held’s critique can be further strengthened empirically, with reference to Lev Vygotsky’s analysis of the relation between spontaneous and scientific concepts, and epistemologically, with reference to Evald Ilyenkov’s treatment of concepts in contrast to mere notions.

The SEPT Older People’s Psychology Service serves a population of approximately 120,000 older people and is delivered from five bases in South Essex, each staffed by one Clinical Psychologist and one Assistant Psychologist. The Assistant Psychologists are employed on a 12-month fixed-term contract. Every six weeks the Assistants meet for a reflective practice group facilitated by a designated qualified Clinical Psychologist in the team. The group is two hours long and involves one of the Assistants presenting a case study upon which the group reflects. Case presentations have included discussions of neuropsychological assessments and therapeutic work on both an individual and group basis. This is followed by a discussion of a journal article or book chapter relevant to the delivery of psychological services to older people.

We have studied the effect of varying stimulus contrast on the modulatory effects exerted on V1 receptive fields by surrounding portions of the visual field. We used standard extracellular techniques to record unit activity in striate cortex of paralysed, opiate-anaesthetised macaque monkeys. We measured the orientation and direction tuning of neurons at several contrasts, with and without the presence of a surrounding stimulus that itself evoked minimal responses from the neuron. At both high and low stimulus contrasts, surround stimuli modulated responses to centre stimuli when the orientation and direction of the centre and surround were in the appropriate (though not necessarily matched) relationship. At low contrasts, we observed more profound suppression and facilitation. However, this did not simply reflect release from response saturation. At low contrasts, a greater range of surround orientations could modulate neuronal responses. This sometimes resulted in identical surround stimuli being suppressive when pairs with high-contrast centre stimuli, but facilitative when paired with low-contrast centre stimuli. Further evidence against response saturation at high contrasts was the frequent anisotropy in the suppression, ie suppression was direction-selective at high contrast, but nondirectional at low contrasts. Such contrast-dependent effects were also revealed by measurements of contrast response functions in the presence of the surround. We sometimes observed not only a decrease in the response to high-contrast stimuli and a lower slope of the response-versus-contrast curve but also an increase in responsiveness to low-contrast centre stimuli in the presence of nominally suppressive surround stimuli. Contextual effects in striate cortex thus depend importantly on the relative contrasts of centre and surround stimuli.

La pandémie du COVID-19 qui s’est abattue sur les EHPAD en France a profondément bousculé les pratiques de ces professionnels de santé. Cette recherche qualitative, à caractère longitudinal, se propose de relever la dynamique d’évolution des termes du contrat psychologique des acteurs d’un EHPAD non lucratif. Les résultats des 33 entretiens réalisés avant et après l’avènement de la crise sanitaire permettent de comprendre comment les salariés ajustent leurs critères individuels confrontés à de nouveaux impératifs organisationnels engendrés par le contexte sanitaire. Nous nous appuyons à cet effet sur les cadres conceptuels d’adaptation et de régulation sociale, dans le cadre d’une triangulation méthodologique, afin de déterminer l’influence de ces critères individuels et d’autres critères organisationnels sur le processus d’adaptation et de restructuration du contenu du contrat psychologique des acteurs évoluant dans cet établissement.

À l'ère qu'ils nomment anthropocène, les scientifiques envisagent sérieusement l'effondrement imminent de notre civilisation à l'issue d'un crash global – qui pourrait prendre plusieurs années – affectant les dimensions écologique, sociétale et humaine. Cette conception objectivée du réel dans lequel nous vivons est le résultat d'une succession de travaux scientifique remontant, au moins, à la fin des années 1960 qui n'ont cessés d'avertir la société des effets négatifs et prévisibles d'une surconsommation des ressources planétaires, d'une fragilisation des liens sociétaux entre les êtres humains et des mises sous contrainte psychologique des leurs cerveaux.Un parallélisme apparaît entre l'origine de cette prise de conscience et celle des modélisations pour comprendre les systèmes naturels et humains à l'aide de la théorie des systèmes, pensée relationnelle des phénomènes observés intégrant ces derniers dans leur contexte avant de les étudier.Aujourd'hui, confronté aux effets d'une crise mondialisée, le fonctionnement global des sociétés humaines repose encore sur l'exploitation de la biocapacité planétaire et la stratification des classes sociales. La pensée systémique est l'une des méthodes capable de modéliser leur fonctionnement de manière à pouvoir les transformer en profondeur.

The goal of this study was to examine changes in newcomers’ psychological contract over time. Based on schema theory and the post-violation model of the psychological contract, we theorized that psychological contract fulfillment is strengthening the psychological contract over time, while changes in the psychological contract are most likely to occur in a situation of low employer and employee fulfillment. In a sample of newcomers in a Brazilian public organization, we tested how the fulfillment of both employer and employee obligations explain the change in the psychological contract. The results support the hypotheses, and we found that the highest level of change in psychological contracts occurred when the fulfilments of the obligations of both parties were low. We discuss the implications for theory on the change in psychological contracts.

The paper aims to research data on the psychological contract which in our country are almost unknown; provide suggestions emphasizing the importance of psychological contracts and fill the managerial and legal gaps faced by Kosovar organizations due to lack of information on psychological contracts. The paper is focused on determining the importance and role of psychological contracts in the formation of positive organizational relationships and maintaining the desired level of work, positive attitudes towards the work of employees in the business sector, etc. The paper provides knowledge and guidance to organizations on how to manage psychological contracts and pave the way for practical research of these contracts to local businesses. The paper presents a contribution to answering a number of questions on the economic value of the psychological contract between employees and management in Kosovo organizations based on the literature reviewed.Also, based on the studies conducted, our conceptual research emphasizes the importance of psychological contract in organizational behavior and the benefits that psychological contract brings to organizations. The paper itself represents originality and value for researchers, organizations in Kosovo and for later studies of the field.

Recently the business environment has changed greatly. Banks must increase operational efficiency and service quality to build competitive advantages. The priority for upgrading service quality is to improve employees' work attitude. Staff of banks were selected as subjects to explore the influences of achievement motivation, psychological contracts, and work attitudes. Results were: 1) Achievement motivation significantly influences psychological contract. 2) Psychological contract significantly influences work attitude. 3) Achievement motivation significantly influences work attitude. 4) Achievement motivation significantly influences work attitude through psychological contracts. It is recommended that when managers select staff, they should consider individuals with more achievement motivation, and who are willing to fulfill psychological contracts since they have a better work attitude.

Infants have remarkable abilities to learn several languages. However, phonological acquisition in bilingual infants appears to vary depending on the phonetic similarities or differences of their two native languages. Many studies suggest that learning contrasts with different realizations in the two languages (e.g., the /p/, /t/, /k/ stops have similar VOT values in French, Spanish, Italian and European Portuguese, but can be confounded with the /b/, /d/, /g/ in German and English) poses a particular challenge. The current study explores how similarity or difference in the realization of phonetic contrasts affects word-learning outcomes. Bilingual infants aged 16 months were tested on their capacity to learn pairs of new words, differing by a phonological feature (voicing versus place) on their initial consonant. Two groups of infants were considered: bilinguals exposed to languages (French and either Spanish, Italian or European Portuguese) in which the contrasts tested are realized relatively similarly (“similar contrast” group) and bilinguals exposed to languages (French and either English or German) in which the contrasts are realized very differently (“different contrast” group). In the present word-learning situation, the “similar contrast” bilinguals successfully processed the relevant phonetic detail of the word forms, while the “different contrast” bilinguals failed. The present pattern reveals the impact on word learning of phonological differences between the two languages, which is consistent with studies reporting slight time course differences among bilinguals in phonological acquisition. In line with a larger literature on bilingual acquisition, these results provide further evidence that linguistic similarity or difference in the two languages influences the pattern of bilingual acquisition.
