The prediction of internal human states—what a person is thinking and feeling—by computers remains an elusive yet attractive goal. The potential applications of such a system are many, including but not limited to lie detection, consumer satisfaction and interest, autonomous vehicle safety, enhanced social networking, and even robotic friendship and companionship.
We believe that scientific progress towards such lofty and exciting applications as described above has been slowed because prior efforts to create an autonomous computer system capable of predicting what a human being is thinking or feeling have been largely predicting or detecting “emotions” in humans, rather than detecting more empirically falsifiable events. There is much scholarly disagreement as to the exact nature of what emotions actually are, and thus Affective Computing dealing with emotional prediction is forced to rely on poorly-defined and often-contradictory ground truths.
In our research, we focus on predicting discrete events based on the expressive behavior of human subjects. Our systems use a user-dependent method of analysis and rely heavily on contextual information to make predictions about the meaning behind subject expressive behavior. Our system’s accuracy and therefore usefulness are built on provable ground truths that prohibit the drawing of inaccurate conclusions that other systems could too easily make.
While the current application of our research idea—a Contextually Informed Program for Hyper-personalized Empathetic Report, or CIPHER—is modest (predicting player behavior during a game of poker), we believe it to be the foundation upon which much more extensive empathetic and affective analysis systems could be solidly and eventually built.

ENGLISH ABSTRACT: This study investigates differences in L1 and L2 Grade 12 learners' interpretation of an English literary text. In particular, the research focuses on pragmatic features of the text, or features which require knowledge of the cultural and situational context in order to be understood. It is hypothesised from the outset that L1 learners will be more adept at interpreting the pragmatic features of the text since L2 learners may lack the necessary linguistic and cultural knowledge needed to derive meaning from an English literary text. The research takes the form of a qualitative study in which data was derived from ten participants in the form of a standardised test and semi-structured interviews. The test was based on F. Scott Fitzgerald's The Great Gatsby and aimed to determine learners' textual and pragmatic competence through a series of questions. Semi-structured interviews then followed in order to investigate the students' own reasons for shortcomings in the test. In addition, the research draws on theories put forth by Brown and Levinson (1978) and Sperber and Wilson (2005) regarding “pragmatic competence”, Hymes‟ (1972) notion of "communicative competence‟, as well as research into how narratives are embedded into cultural mores, customs and norms. These concepts and ideas were incorporated into the research so far as they could assist in articulating the reasons for shortcomings in the literacy test. The two methods of data collection and subsequent analysis generated significant information which was then correlated. First, the L1 learners outperformed their L2 peers in the literary test, both in terms of understanding the literary elements and in terms of understanding the cultural and contextual elements of the text. Second, the semi-structured interviews revealed two contrasting methods of language socialisation pertaining to the learners: while the L1 learners acquired English through direct methods and were found to engage more with English literary texts in the home, the L2 learners generally revealed that English was not practised outside of the classroom and engagement with English or English texts was not explicitly encouraged in the home. The study reveals that inadequate exposure to a language not only affects text-comprehension on a grammatical level, but prevents the learner from engaging with and understanding critical pragmatic elements of the literary text such as idioms, metaphors and other cultural references.

ENGLISH SUMMARY: This study is based primarily on the presupposition that the conventional definition or description of a biblical heroine does not take into account certain ‘hidden’ women in the Old Testament who could be distinguished due to their wisdom. By using the Yoruba woman as a contextual interpretive lens, the study investigates two female characters in the Old Testament each of whom is named in only one verse of Scriptures – “the First Deborah” in Genesis 35:8 and Sheerah in 1 Chronicles 7:24. The investigation takes its point of departure from the figure of Woman Wisdom of the book of Proverbs, which commentators have characterized as a metaphor for the Israelite heroine – a consummate image of the true Israelite female icon. It is indeed remarkable that Woman Wisdom has been associated with various female figures in the Old Testament such as Ruth, Abigail, the Wise Woman of Tekoa and the Wise Woman of Abel, etc. However, this study calls for a broader definition of wisdom based on the investigation of certain women in Old Testament narratives (e.g. Deborah and Sheerah) who have received only fleeting mention and recognition but whose lives reflect a possible connection to wisdom on a deeper level. It is shown that classical (arguably masculine) ways of reading the text tend to sideline or altogether overlook certain female characters, which are regarded as marginal such as Deborah and Sheerah. However, there are narrative gaps in the units where such women are found that could be filled by a reading of the text that is sensitive to details. It is argued that a more careful examination of the minute details in the texts could break down the metanarratives in a way that shows that they have hermeneutical significance. Therefore, attention to the narrative details unveils new dimensions of meaning and implications between the two texts (women) under investigation that have not been related in previous studies. Of significance is the fact that classical readings of the two verses that mention “the First Deborah” and Sheerah (Gen 35:8 and 1 Chron 7:24) regard them as intrusive in their respective contexts. However, a multiplex reading of each of the two verses in this study has shown that, rather than being intrusive, both have been strategically constructed to underscore the importance of the two women, and that the verses actually fit into their present pericope. The references to both Deborah and Sheerah are rooted in strong Old Testament traditions namely Bethel and Ephraimite, respectively, both of which play visible roles within the pericopes. What’s more, both verses are found within significant contexts – one in the middle of a section that closes the Jacob Cycle and introduces the Joseph Cycle, the other in the midst of a theologically driven genealogy that begins with Adam. Again, based on the multifaceted character of Woman Wisdom, in particular, as a teacher, a nourisher and a builder, it is argued that this metaphor of an Israelite heroine is embodied in both “the First Deborah” and Sheerah. Whereas Deborah was a wet nurse who must have nourished and nurtured the offspring of Rebekah, her mistress, Sheerah has been identified as the only female builder throughout Scriptures. The identification of the role of a wet nurse as a nurturer and nourisher as well as the role of a daughter as a builder with Woman Wisdom points to two silent heroines, one in the private domain and the other in the public sphere, who have remained unrecognized and uncelebrated in Old Testament scholarship. Furthermore, the roles of Deborah and Sheerah, respectively as wet nurse and builder, indicate that women participated in various spectrums of societal life especially in the Second Temple period when it is assumed that the texts reached their final forms. Not only did they perform roles that were associated with women, they equally participated in roles that were regarded as traditionally masculine. In this regard, a study of the women in the book of Chronicles offers a fresh glimpse into the roles and positions of women in the Second Temple period as well as into the Chronicler’s purpose and emphasis, in particular, regarding his concept of laer"f.yI-lk'. On a theological level, the achievements of the two women demonstrate God’s penchant for supporting the weak and the marginalized and for affirming those who are regarded as less likely to succeed. The mention of the First Deborah in the Old Testament proves that in God’s script, there are no little people. In the case of Sheerah, the point that there is a lare f" y. -I lk ' that includes outstanding female achievers indicates that, theologically speaking, there is no barrier against what women can do.
AFRIKAANSE OPSOMMING: Die vertrekpunt van hierdie studie is die veronderstelling dat konvensionele beskrywende definisies van Bybelse heldinne sekere 'versteekte' vroue in die Ou Testament, wat uitstaan danksy hulle wysheid, verontagsaam. Met die Yoruba-vrou as kontekstuele interpretatiewe lens word twee vroulike karakters in die Ou Testament bestudeer wat elk in slegs een vers genoem word – “die Eerste Debora” in Genesis 35:8 en Seëra in 1 Kronieke 7:24. Die vertrekpunt is die figuur van Vrou Wysheid uit die boek Spreuke, wat deur kommentators gekenmerk is as 'n metafoor vir die Israelitiese heldin – 'n volkome beeld van die ware Israelitiese vroulike ikoon. ENGLISH ABSTRACT: In this project, contextual readings of four works by Arnold van Wyk are developed. They are the Symphony No. 1 in A Minor, the First String Quartet, the Duo Concertante and the Missa in illo tempore. These readings are grounded in richly detailed descriptions of the compositional processes, drawing on material such as sketches, autographs, diaries, correspondence and reception documents, as well as in structural analyses of Van Wyk’s music and of certain peer compositions. Each reading is set in a separate theoretical frame, resulting in a multi-perspectival consideration of Arnold van Wyk’s music that partakes in a range of current disciplinary discourses. The First Symphony is discussed in the discursive context of English Sibelianism, and Arnold van Wyk’s dialogue with Sibelius’s symphonic works is investigated through comparisons of Van Wyk’s and Sibelius’s applications of two-dimensional sonata form and tragic reversed sonata form. The reading so developed sheds new musical light on the difficulties of Van Wyk’s position as a colonial composer residing in the centre of a crumbling Empire. The compositional process of Van Wyk’s First String Quartet is described in juxtaposition with the compositional process of Bartók’s Sixth String Quartet, and the similarities and differences of the two narratives and the two compositions highlight a second aspect of Van Wyk’s colonial identity, namely the ambiguity of his return to South Africa from England, neither of which place could signify “home”. The reading of the Duo Concertante focuses on the Elegia from that work, interpreting the piece as part of a network of intertextual connections, including Van Wyk’s model for this piece, Martin Peerson’s (1580-1650) The Fall of the Leafe, Gerald Finzi’s Elegy for Orchestra Op. 20, entitled The Fall of the Leaf, as well as Van Wyk’s own theme for the Rondo of the Duo, to which he made various musical references in the Elegia which are associated with the concept of “prophecy”. This intertextual reading considers Van Wyk’s continuing problematic identification with the English musical culture and tradition, compounded by his uncomfortable place in the stifling cultural establishment of apartheid South Africa. Van Wyk’s Missa in illo tempore is interpreted in a post-apartheid context. The work purports to react to the conditions in London in 1945 at the end of the Second World War (when Van Wyk first started to work on it) as well as the conditions in apartheid South Africa in 1977-1979 (when he completed the work as a commission for the Stellenbosch Tercentenary Festival). The reading considers the ethics of art that intends to respond to situations of suffering, drawing on post-Holocaust art scholarship as a theoretical frame. In developing interpretations of compositions that have never been studied in such detail or with such theoretical rigour before, the thesis makes a significant contribution to Arnold van Wyk studies, and in its application of a range of methodological tools in order to construct poetic hermeneutic readings that are grounded in musical and contextual materials, it also represents a meaningful methodological innovation.
AFRIKAANSE OPSOMMING: In hierdie projek word kontekstuele lesings van vier werke deur Arnold van Wyk ontwikkel. Hulle is die Simfonie Nr. 1 in A Mineur, die Eerste Strykkwartet, die Duo Concertante en die Missa in illo tempore. ENGLISH ABSTRACT: This study investigates how the contextual frames of reference (CFRs) of the three extant Setswana Bibles – Moffat, Wookey and BSSA (Bible Society of South Africa) – could have impacted on their renderings of the book of Ruth. The fact that the Bibles were translated within contexts that differed from those of the Hebrew text of Ruth gives rise to the assumption that some of such contexts or frames could have had problematic influences on decision making during translation. Differing frames were assumed to have led to differences (i.e., translation shifts) between the translations and the Hebrew text. Such frames were hypothesised to have emanated from socio-cultural, textual, communication-situational and organisational circumstances pertaining to the making of the Hebrew text and the translations. Since contextual frames of various kinds presumably converged on the Setswana target texts (TTs), this study proposes an integrated multidisciplinary approach to frame analysis, namely, the cognitive CFR model. The framework, which is embedded in biblical interpretation, merges insights from other disciplines including translation studies, cognitive semantics and cultural studies. The translators‟ decisions are evaluated using the heuristic perspective of “an exegetically justifiable rendering.” The study identified indeed countless shifts in the three Setswana translations which resulted from hypothetical socio-cultural, organisational, communicational and textual factors. Moffat‟s shifts revealed a predomination of organisational CFRs throughout the book of Ruth. The organisational CFR also stood out occasionally for Wookey as well. BSSA did not show a predomination of any class of CFRs but manifested the least problematic CFRs. As far as the negative influences of CFRs were concerned, BSSA was the least affected, followed by Wookey and lastly Moffat. The study reveals that it could sometimes be simple, but other times also be difficult or impossible, depending on the pertinent CFR, to provide an exegetically justifiable rendering of an ST unit. Yet, it can be concluded from this study that an awareness of CFRs during translation or analysis of translations can contribute towards the improvement of existing translations or the reduction of problematic shifts in new Bible translation projects.
AFRIKAANSE OPSOMMING: Hierdie studie ondersoek hoe die kontekstuele verwysingsraamwerke (KVRs) van die drie bestaande Setswana Bybels - Moffat, Wookey en BSA ( Bybelgenootskap van Suid-Afrika) – hulle weergawes van die boek Rut kon beïnvloed het. Die feit dat die Bybels vertaal is binne kontekste wat verskil van dié van die Hebreeuse teks van Rut, dra by tot die aanname dat van die kontekste of raamwerke moontlik ‟n problematiserende invloed op besluitneming tydens die vertalingsprosesse kon hê. Daar is aangeneem dat verskillende raamwerke lei tot verskille (byvoorbeeld: vertaalskuiwe) tussen die vertalings en die Hebreeuse teks. Daar is veronderstel dat sulke raamwerke spruit uit sosio-kulturele, tekstueel-kommunikatiewe en organisatoriese omstandighede van die vertaalproses asook die van die Hebreeuse teks. Aangesien verskillende soorte kontekstuele raamwerke vermoedelik ingespeel het op die Setswana teikentekste (TTs), fokus hierdie studie op 'n geïntegreerde multi-dissiplinêre benadering tot die raamwerk-analise, naamlik die kognitiewe KVR model. Die raamwerk, wat ingebed is in die veld van Bybelse interpretasie, kombineer insigte uit ander dissiplines, insluitend: vertaalkunde, kognitiewe semantiek en kulturele studies. Die vertaler se besluite word geëvalueer met behulp van die heuristiese perspektief van "'n eksegeties begrondbare vertaling." Die studie het inderdaad talle vertaalskuiwe in die drie Setswana vertalings geïdentifiseer wat teruggevoer kon word na hipotetiese sosio-kulturele, organisatoriese-, kommunikatiewe- en tekstuele faktore. Moffat se vertaalskuiwe vertoon ‟n dominansie van organisatoriese KVRs regdeur die boek Rut. Die invloed van organisatoriese KVR‟s is dikwels ook in Wookey geïdentifiseer. BSA vertoon egter nie „n oorheersing van enige klas van KVRs nie. Tewens, dit vertoon die minste problematiese KVRs. Sover die negatiewe invloede van KVRs betref, is BSA die minste geraak, gevolg deur Wookey en laastens Moffat. Die studie toon dat dit soms eenvoudig, maar ander kere ook moeilik of onmoontlik is, afhangend van die pertinente KVR, om 'n eksegeties-regverdigbare vertaling van 'n GT eenheid te bied. Tog, kan dit afgelei word uit hierdie studie dat 'n bewustheid van KVRs tydens vertaling of ontleding van vertalings kan bydra tot die verbetering van reeds bestaande vertalings of die vermindering van problematiese vertaalskuiwe in nuwe Bybelvertalingsprojekte.

Moderna mobiltelefoner är utrustade med en rad sensorer, däribland en tre-axlig accelerometer, vars ursprungssyfte var att avgöra telefonens betraktningsvinkel och senare för användning i underhållningsapplikationer. Ytterligare ett användningsområde som underlag för tränings- och hälsoappliaktioner.Affective Health är namnet på ett projekt som exemplifierar sistnämnda tillämpningsområde - en digital loggbok som utnyttjar accelerometern och andra sensorers möjlighet att använda kroppsliga markörer i en hälsokontext. Svårigheten i att presentera accelerometerns högupplösta data på ett sätt som är förståeligt, engagerande och meningsfullt för en användare har sedemera gett upphov till detta arbete. Att den metod och det resultat som redogörs för häri kom att kretsa kring aktivitetsigenkänning motiveras av att det är ett effektivt sätt att filtrera fram de för användaren intressanta fynden utan att ge avkall på indatans stora detaljrikedom.Inledningsvis ges en överblick av problemdefinitionen såväl som dess bakgrund. Aktuell status på både den kommersiella marknaden samt publicerade forskningsresultat redogörs för i efterföljande kapitel. Detta i syfte att visa på ett behov i en hypotetisk produktrealisering och ett nyskapande och teknisk höjd som examensarbete, där det senare går att finna i tillämpningen av slutsatser från studier inom informationsvisualisering och kognition samt den höga träffsäkerheten för ett system med relativt få fysiska restriktioner. För att en läsare som är oinvigd i klassificeringsalgoritmer ska kunna följa arbetetsgång redogörs även dessa för. Det slutliga konceptvalet realiseras till prototypstadie i form av en datamodell med implementerad funktion och form.Aktivitetsigenkänningsmodellens precision valideras i flera steg för en grupp av 5 deltagare som utför 7 aktiviteter. Genom att kombinera hierarkiska tröskelvärden med en KNN-algoritm för att separera en sjudimensionell attibutsrymd uppnås en träffsäkerhet på 97,6%.

Healthcare dialogue systems are developed to automate and simplify routine tasks such as collecting patient information or making an appointment. Often, these models are trained to mimic doctor-patient interaction as their constant availability is a key feature for patients, in particular with chronic conditions. Chronic patients regularly visit their doctor and are asked to repeatedly fill in standardized questionnaires, which may trigger repetitive, incorrect input. In collaboration with the ALIAE company, we focus on developing novel dialogue models which can maintain a conversation with the patient while collecting both specific answers to a set of pre-defined questions and serendipitous information about the patient condition that we conjecture, may be useful for the patient treatment. Specifically, we propose a dialogue system and automatic questionnaire filling pipeline that should complement existing routine between doctors and patients.This thesis makes three main contributions. We first propose an approach to flexibly guide the user through a pre-defined medical decision tree using naturally written user input -- this allows the health-bot to collect answers to a set of pre-defined questions. To improve user engagement, increase the probability of all required medical topics being addressed and allow for further information about the patient condition to be collected, we then extend this initial model by integrating additional bots designed to handle health-related follow-up questions and maintain small talk. Finally, we introduce novel zero-shot Question Answering models and pre-processing techniques so that standard, clinical questionnaires can be automatically filled in based on the content of collected human-bot dialogues

A relative notion (consisting of a basic concept and a qualifier) could appear as an equivocalprovision. However the principle of legality imposes to base every decision on a reference norm ;referral to a court implies moreover that the person subject to trial has a spontaneous knowledge ofit, neither the legislative context nor investigative measures being sufficient to correct the linguisticimprecision of the law. If custom allows to make explicit the basic concept, it doesn’t for all thatdelimit the threshold inferred by the legislative qualifier. The margin of praetorian appreciationfollowing from it renders then the sanction conceivable only according to factual obviousness. Thelatter leads to reverse the onus of proof by loading the defendant with the proof of the normality ofthe facts with regard to the socially accepted norm. It also excludes from the judicial field theinsufficiently characterized situations, suggesting that the civil code tolerates a share of anomaly insociety and entailing a personalization of the decision for the occasion. In short, only thedisproportion of facts is sanctioned and involves a balancing of the rights in dispute. Understood likethis, relativity gives to the law some flexibility without leading to judicial arbitrary : it affords toinclude marginal situations into a same political finality. The recourse to relative notions is akin to theidea to not regulate by a law imposed ipso jure and reveals the retreat of directional public order. Thedanger lies then in the instrumentalization of relativity in order to make of it a legistics tool pavingthe way for an ill-considered flourishing of one’s rights

Para tanto, ? tra?ado um panorama da ?pera brasileira e seu comportamento nos principais teatros l?ricos do pa?s no tri?nio 2014-2016, numa contextualiza??o que se apoia em autores como NEVES (1981), KATER (2001), HARTKOPF (2010), e as compila??es de VOLPE (2012), al?m de relacionar os dados colhidos da plataforma Operabase com os colhidos do censo 2010, do IBGE. A pesquisa bibliogr?fica inclui um brev?ssimo relato biogr?fico dos autores da obra (compositor e libretista), al?m de reflex?es acerca do libreto e da m?sica, abordando as bivocalidades do discurso na ?pera infantil e as ferramentas composicionais nela empregadas. This study takes place a data collection from the research developed under the master degree in musical conducting at the Universidade Federal do Rio Grande do Norte - UFRN, a proposal that includes an approach of the camera opera Maroquinhas Fru-Fru, from the composer Ernest Mahle. For this, is delineated a panorama of Brazilian opera and your behavior in main opera houses of the country in the triennium 2014-2016, with the contextualization supported by authors like NEVES (1981), KATER (2001), HARTKOPF (2010), and VOLPE's compilation (2012), besides related the data collected from the Operabase plataform with the data of Brazilian cense 2010. The bibliographical research includes a very brief biographical account of the authors of the work (composer and librettist), besides reflections about the libretto and the music, addressing the discourse multivocality in the opera for children and the compositional tools used in it. Authors like SCHERCHEN (1933), RUDOLF (1993), BOWEN (2003) and others comes give support the statements about conducting techniques and their application in the operatic genre, as well as the specifics that the work requires of the conductor. Finally, in order to give vent to the musical practices of our time, which is revealed as an artistic need to be ingrained in the formation of new musicians and new audiences, we have an experience report of the preparatory stages of lyrical recital held in Campina Grande city, pointing to the implications of the assembly this work in northeastern Brazil and showing some of the constancies and inconstancy of a production in the current situation.

Syftet med föreliggande studie är att studera så kallad historiskt informerad uppförandepraxis, och därmed även min egen musikaliska inriktning, ur ett generellt musikfilosofiskt perspektiv. De olika begrepp och frågeställningar som kan sägas dominera diskussionerna kring denna framförandetradition är verk, autenticitet, intention och interpretation. I fokus för studien befinner sig musik inom den västerländska konstmusiktraditionen inom vilken framförandet av musik, den klingande realiseringen av ett noterat verk, är central. Därför står framförandet, i relation till ovan nämnda begrepp, i fokus. Detta mer övergripande tema leder fram till följande frågeställningar: Vilka faktorer kan betraktas som avgörande för att ett framförande kan betraktas som ett historiskt informerat framförande? Hur kan dessa faktorer identifieras? Innebär det att det finns instruktioner i musiken som jag som musiker måste följa? Hur ser min konstnärliga frihet ut? Var finner jag den? Vägen till tentativa svar på dessa frågor har gått via teoretiska resonemang, och applicering av teorin i såväl metod och analys som interpretation. Studiens teoretiska perspektiv och överbyggnad baseras på kontextuell musikontologi. Det vetenskapsteoretiska ramverket, utifrån denna ontologiska grund, formuleras inom ramen för den socialkonstruktionistiska tanketraditionen. Genom detta perspektiv kan framförandet av verket identifieras som en omistlig del av verket, vilket också innebär att enbart notationen inte är tillräcklig för att definiera verket. Vidare innebär teorins betoning av kontextens betydelse att ett framförande för att vara ett framförande av verket, medvetet måste förhålla sig till verkets kontext. Detta perspektiv fördjupas i studien genom att betona den socio-kulturella kontextens betydelse i ett större perspektiv, såväl den historiska som den nutida, för framförandet. För verket innebär det att dess identitet är föränderlig, då de olika framföranden som är en del av verket inte kan vara identiska. Denna syn baseras på socialkonstruktivistiska teorier om kunskapsbyggande. Med utgångspunkt i kontextuell musikontologi formuleras också en strategi för att analysera och undersöka ett verk utifrån notationen, instrumentationen och uppförandepraktiska konventioner, tre delar av verket som griper in i varandra och som konstateras vara omistliga att förhålla sig till vid ett framförande. Studiens teoretiska del åtföljs av en fallstudie där en sonat av Johann Sebastian Bach studeras utifrån det teoretiska perspektivet. Fallstudien består av en undersökande del och en tillämpande interpretativ del. För den undersökande, och i viss mån deskriptiva delen står verkets notation hela tiden i fokus, med tyngdpunkt på notationens socio-kulturella kontext. It was recognized a decade ago that the World Trade Organization (thereafter WTO) dispute settlement mechanism would be the central pillar of the world trading system and the unique contribution for sustainable development of global economy. So far the WTO has handled 418 trade disputes including 121 Appellate Body and panel report adopted. Among all the procedural and substantial issues, the treaty interpretation is critical important for the WTO dispute settlement. However, there are no expressed rules of interpretation provided by the Understanding on Rules and Procedures Governing the Settlement of Disputes. The WTO Dispute Settlement Body had to develop the interpretative rules by practices of Appellate Body and panels, which have been integrated with the rule-based world trading system. Many issues of treaty interpretation then have been raised from the practices of the WTO dispute settlement. This paper is focused on the rules of treaty interpretation, in particular an examination on how widely “context” is to be understood by the Appellate Body and panels in interpreting the WTO Agreements. Inline with its essentially “textual” approach, the Vienna Convention embodies a relatively narrow interpretation of “context” to comprise only the rest of the treaty and documents directly connected with the conclusion of that treaty. Nevertheless, Article 31(2) of the Vienna Convention can be read in a less restrictive manner as compared to this traditional view. On a closer look the preparatory work of the Vienna Convention and the jurisprudence of the WTO are both indicative of the need for a broader, flexible interpretation. From the WTO jurisprudence, this paper further analyses the necessity to define the boundaries of contextual interpretative method for the current and future practices, with a view to distinguishing from other interpretative method. Nuances in the definition of context are possible, but by defining the boundaries of context through a series of criteria, context is defined in an open-ended manner, yet being confined to a reasonable realm. The creation of these criteria are explored also by the preparatory work of the Vienna Convention and the jurisprudence of the WTO, and the application of these criteria does not mean that how the panels and the Appellate Body apply the interpretation rules would be changed. Rather, they will operate together to provide security and predictability to the dispute settlement system and the multilateral trading system.

This paper examines the concept of industrial heritage by conducting a systematic empirical inquiry into present Industrial Archaeology related literature and seeks to highlight the current “state of play” in industrial heritage preservation, and explore future theoretical and methodological directions. All over the world, abandoned industrial sites are being removed or redeveloped for new uses. Until recently, little effort was made to preserve remains located on these sites, as few believed they were worthy of conservation. Over the last fifty years, a movement called ‘Industrial Heritage” has arisen which aims to preserve these as historical assets. Industry has been the most powerful force in shaping much of the modern world, and its remains require protection not just to conserve the technological achievements they represents as well as our own society and identities they reflects,, but also provides an holistic archive of ephemeral materials for the interest of future generation. In Taiwan, the remains from industrial sites initially had difficulties in asserting themselves as objects of value, due to inhibiting factors which excluded industry as a cultural heritage. In 1990’s, however, several factors changed this situation. These factors included globalization which escalated trend of industrial reformation and privatization of national enterprises, and a growing interest in the conservation of industrial heritage from emerging civil society. This meant that the discourse about cultural heritage changed so that industry could be included as part of it. Several industrial heritage preservation projects have been established throughout the isles of Taiwan. Those projects have so far been lacking the scope of industrial heritage and a theoretical framework for practicing in survey, interpretation and representation of industrial heritage in the context of Taiwan are still in waiting for negotiation. As we move beyond data-gathering, expanding from basic technological studies to draw from the fields of labour history, economics, sociology, and anthropology, how do we manage and represent industrial sites as particular types of cultural landscapes? How can we find new social meanings in our recent industrial past? In these contexts, attempts to practice ‘industrial archaeology’ are fraught with problems of defining what is ‘heritage’ and what is not, or debated about why are some objects and phenomena considered to be part of cultural heritage while others are not? Through a review of an industrial heritage investigation project, a 1960s Underground Power Station in Kinman, this paper also argues that beside the traditional view emphasizing unique and lasting, even “universal” things, the means of industrial sites have had difficulty in being accepted as cultural heritage. The preservation of industrial heritage must move beyond the traditional cultural heritage preservation paradigm. Industrial sites need to be considered within a framework of inference which seeks to establish social meanings in order to map a holistic understanding of a place. Specifically, the critical element for the idea of value as a basis for preservation decision-making should preserve the social dynamic of material remains.

The central thesis of the present study, entitled Alms or legs? A contextual reading of Acts 3:1-10 in the light of an alternative theory of hwnan development, is that when read contextually, some biblical texts are capable of empowering individuals and small groups for social and structural transformation (Human Development). A contextual reading of the story of the crippled beggar at the Jerusalem temple entrance (Acts 3: 1- 10), within a context of begging and lack of initiative in a small community in the Eastern Cape provides a good example of such texts. The "horizons" of the text's author and the text's present reader are drawn together, in the creation of a "symbolic universe" for the context of underdevelopment. This serves as a vision, a positive alternative for the underdeveloped and non-developed communities. Following an introductory chapter in which the purpose and context of the study are outlined, and methodological problems introduced, the study proceeds, in the second chapter, with an outline of the contextual approach, undergirded by the "alternative theory" of development, namely, a people centered development (as opposed to the "economic growth" approach). This does not only result in a grid or categories against which to read the text, it also provides a broad framework within which subsequent discussions of the subjects of beggars (Chapter 3) and miracles (Chapter 4) respectively, take place. The topics of beggars and miracles, like "alms or legs", are used on the same semantic level, thus suggesting that if beggars constitute a problem, then miracles provide a solution. In communities of antiquity under investigation, no evidence is found to support almsgiving as the basis of Christian social action. On the one hand, Christians advocated charity, which was a reflection of deep friendship and oneness; on the other, miracles in the Christian context served in part, to integrate those on the margins into the community (or church) by transforming their physical and psychological conditions. This makes a developmental reading, which then follows in chapter 5, the main chapter of the study, possible. The conclusions of chapter 5, which amount to a vision for Human Development, lead to the concluding chapter (Chapter 6) in which a way forward for development in the post-apartheid South Africa is suggested.

A combination of written and interview protocols were collected from 4 participants, two men aged 27 and 29, and two women, 24 and 28. The participants responded to questions about their understanding and use of sexual fantasy, giving concrete examples. The data were analysed qualitatively using the phenomenological themes of Space, Time and Being. These themes demonstrated the value of examining sexual fantasy experience as a unique lived experience. The data were then discussed in light of this and also with reference to previous research. The data collected for this study demonstrate the unique way in which fantasy exists in interaction with its fantasiser. It also highlights the change between the fantasy and the retrospective experience of fantasy.
