Since the end of « the 30-year post-war boom », the french employment and fight against exclusion policies have been trying to reduce the mass employment (Zoberman, 2011). At national and local levels, job integration plans are happening with greater frequency. However, this diversity make understandable the « insititutional confusing » typical for french job integration system (DARES, 2008) despite the government's desire to reduce this maze through « France Travail » (2023). While a number of academic studies have focused on buildings plans (Ebersold, 2005 ; Trindade-Chadeau) and evaluate the effects of theses plans on job-seekers (Hamzaoui, 2005 ; Wuhl, 1996), few studies have examined the actors in the integration sector, at the end of the employment policy chain. Based on this observation, our thesis, rooted in Work and Organizations Psychology, aims to analyze the professional practice of a specific population of insertion actors : "Revenu de Solidarité Active (RSA) advisors/referents". The french integration system is unique, it is at the crossroads between managerial logics aimed at reducing the number of jobseekers (Bajoit, 2005 ; Zwick Monney, 2015b) and more humanistic values herited from the social sector, which are better to take account of the singularity of jobseekers situations (Brégéon, 2008). In this particular context, how do RSA advisors/referents exercise and represente their professional role? Some RSA advisors/referents, for example, are more likely to adapt their practices to institutional prescriptions on employability. Others are more likely to seek a certain flexibility to take account of the specific situations of the people they support. Inscribed in a psychosocial perspective, the thesis aims to describe and account for the variability of guidance practices through the role orientation of RSA advisors/referents. With reference to the theoretical model of plural and active socialization (Baubion-Broye and al., 2013 ; Malrieu, 1989),we postulate hat the orientation of the professional role of these advisors/referents does not depend in a linear way based on institutional prescriptions, but is the result of a complex subjective activity - of intersignification - putting into perspective values, representations of self, others and work, which can sometimes be coherent with each other, or sometimes competing and a source of intrapersonal conflicts. This activity - not free from doubts and questioning - gives rise to a role orientation specific to each advisor. To account for this variability, we have developed a mixed methodology that articulates two empirical strands : an exploratory qualitative study and an extensive study. The qualitative exploratory study consists of semi-structured interviews with 12 RSA referents. A double analysis of the interviews - thematic and lexicometric via AlcesteEducation2018 - shows two predominant professional role orientations among RSA referents. An extensive questionnaire survey of 211 RSA advisors/referents showed that RSA advisors/referents are either involved in a conflictual dynamic in the orientation of their professional role, or in a dynamic of recognition of the orientation of this role. Both studies show a population that is mostly comfortable in their orientation in its professional role but that develops concerns for the future of its sector

This study aims to analyse and criticise the conflict of laws rules in matter of divorce from the viewpoint of comparative private international law. It takes the example of the French legal system and the Arab States multi-legislative legal systems. The adopted solutions in the resolution of conflicts of laws in matter of divorce are closely linked to the problem of value conflicts and even cannot be dissociated. This expresses not only the legal philosophy of the legislator and his affection by his values but also the judicial tendencies in legal practice. For that, the thesis answers the question to what extent the values of each legal system impact on the resolution of conflicts of laws in matter of divorce. To answer to this question, it needs to proceed through the pathway of the conflict rule. The conflictual and functional approach of the rules applicable to divorce suppose and imply effectively the scrutiny of the form and the intensity of the influence of values. Based on this conceptual framework, the thesis proceeds in two main parts. The first part examines the specificities of the compared legal systems while analysing the choice-of-law rules. This part demonstrates the influence of values on the choice-of-law rules. The second part assesses and examines the excessive importance attributed to the values of the forum state while applying the conflict of laws rules. Based on this assessment, this part illustrates the impact of the values of the legal systems by comparison with the challenges and the difficulties faced by judges while applying the choice-of-law rules

Wether imposed or seeked for, the social change taking place in algeria is faced with an obstacle: the strength of tradition. While it has blought about an evolution within patriarchal family and a new pattern of male and female roles, it is also at the root of both intrapersonal and interpersonal conflicts due to the interiorization of the two antagonistic cultural codes (tradition and modernity). The couple is a major stake in this social restructuration. Conflicting roles emerge acutely during both the formation of the couple and the conjugal life. During the process of formation of the couple, the conflict shows through an agonizing struggle bethween the desire to meet one's aspirations and the wish to abide by parents will; during married life it manifests itself both by both an aspiration to adopt the new conjugal pattern and an attachement to traditional values. However the cultural ambivalence generate regulation mechanism. These help avoid splits and lessen the subject's agony

Economic, political, demographic and cultural pressures have brought about a massive transfer of populations from "the south" to "the north". Thus, large groups, with differing cultures, find themselves in a situation of "cultural shock". We put forward the theory that the time spent in France favoured the adoption of new family values amongst the congolese students living in France during the years 1983-1985, according to their rank in the phratry, the milieu from wich they originated (urban as opposed to rural) and the length of time spent in France. This change in values has led to intra - and interpersonal conflicts. This theory has been only partly substantiated, since the time spent in France does not encourage a total acceptance of the french family values, some restraints remaining, depending on the above-mentioned variables, not without some suffering and conflicts. Finally, to resolve these conflicts, negotiation and compromise are more frequent than rupture. In this study, it has appeared clear that the group as an object of emotional investment plays an important role: the exterior prestigious group as (France), keenly sought after, fantasized at first, then the interior group (con- go) restored, and later reinvested. Thus it is a process of maturing, comparable to that of the crisis of adolescence, in its thematic, search for identity, rejection of origins and the ideal elsewhere

The imbalance and the chaos in which Baroque man lived, changed his vision of his entourage and at the same time they excluded the gratuitousness of his actions. His fascinations are messages to be deciphered, his rejections and attachments represent revealing clues and testimonials. Our study tries to explain the reasons of the fascination of the baroque generation for the liquid element through the examination of the imaginary of its aspects in the baroque work. The imaginary or what Gilbert Durand calls "thought capital" of man is a hybrid organism, several factors participate in its structuring therefore its examination requires an interdisciplinary approach. Through cognitive science, that represent the future of research on the imagination according to Philippe Walter, this study tries to illuminate the Baroque Imagination through the examination of the value the element of water in the works published between 1580 and 1640. Our work uses four of the six cognitive sciences which are designated by Georges A. Miller and which establish interdisciplinary fields through their correlations. To explore the representations of this element with the Anthropology, philosophy, psychology, and linguistics are indispensable to the objective of offering them causal explanations. The baroque imagination is reconstituted in our work by combining these sciences with the disciplines of the history of art, literary criticism, folklore, ethnology, mythology, sociology, and the history of religions. Our work examines one of the aspects of nature in the baroque work. Through our analyzes we try to trace the being and the existence of baroque man through the manifestations of one of their components in the work of the latter. The element of water which is this component and it represents one of the aspects of nature. The problematic in our work is composed of a component that deals with the value of the element of water in the baroque work. The second part aims to prove that the 7 examination of the imaginary represents a tool that helps to identify the reliefs of a baroque text and a text with a similar structure with the latter, that is to say an incoherent structure and complex. Our research proposes a reading for the imaginary of the material in the literary text. Our study would like to demonstrate that distant and interactive examination of human acts and his works serves to identify their explanations; and that the examination of the imaginary of a work which represents an act of the imaginary of man serves to identify its implicit and the reasons for its creation, and the psychology that dominated the circumstances of its production

The goal of this thesis is to understand why social workers and educators are reluctant to enforce a "shared confidentiality" policy between them and mayors as advocated by the 2007 Law of Prevention of Delinquency. Basing my research on 70 semi-directive interviews of students and social workers conducted between 2005 and 2009, l have focused on the representations and use of professional confidentiality by those two professions. First, l discuss the hypothesis that the actual use of confidentiality is closely related to processes of recognition and exclusion in keeping with their professional identity. The first part is an analysis of the way interviewees perceive their peers and the work partners with whom they are supposed to share information. L address the issue of trust and competition in their mutual dealings, without ignoring the problem of power. The second part aims at demonstrating how relevant values are in the mechanisms of justification when workers choose to share or withhold information they have collected about users of social services. L underline the relativity of collective values within that field of activity and analyse to what extent with holding information and questioning the enforcement of the Law of Prevention of Delinquency may illustrate processes which enable social workers to make sure they hold on to the values that pertain to their professional activity. With regard to the prevention of delinquency, those values may induce an ideological stance which, even thongh it impedes effective partnership working, does not necessarily mean giving up transactional processes leading to practical compromises

Harsher and harsher competition in insurance industry increases the importance of the role of insurance salespeople who represents the company, sells services and provides advice to clients. . The research is about role conflicts and coping strategies of insurance salespeople. Coping strategies are used to face these conflicts. They are not allowed according to the company's rules. The research is based on semi-directive interviews with 102 agents and 131 clients. Theses interviews are focused on favourable and unfavourable critical incidents in the service encounter. Content analysis of incidents shows different types of role conflicts linked to contradictory demands of organisations and clients four coping strategies (prevention, exemplary service, negotiation and agreement) are also identified the differences of perceptions between agents and clients are emphasised. To explain the development of coping strategies, a model and some hypothesis are tested with an experimentation. Results shows the importance of professional identity (characterised here by length in service and localisation) and the importance of client : it acts upon the implementation of coping strategies. The practical interest lies in the identification of main difficulties between agents and clients and coping strategies used to face it. At a theoretical level, the use of both disciplines (marketing and human resource management) favours a crossed fertilisation between disciplines and give new insights. At a methodological level, the interest of triangulation (using both qualitative and quantitative methods, comparison client's perceptions with agents' perceptions) is also underlined

This analysis intends to show a stage of this argentine history beginning since the urban and social evolution of mendoza city, capital of the argentine province of the same name. This research project will attempt to establish the relationship that exists between the space, the conflicts and the values of the society of mendoza and their connection with the spatial- structure of the town of mendoza at the end of the 19th century and the beginning of the 20th century. This chosen period is determined by the arrival of the train-road in mendoza in 1885 and it finishes in 1910, which signifies the first centennial of the argentines autonomous governments. It is a moment culminate of modern argentine, managed by governments of oligarchic type on the national and local level. These two historical facts delimiting a quarter of a century are marked by the production of the economic and politic model. The city may to be the place, which can manifest and materialise the conflicts, the contradictions and the values of the society during the precise time. The central line of analysis is to identify the traces of these conflicts and these values. It appears necessary for us to consider the newspaper of this time as a source of documentation. This new consultation of local newspapers, allows us to know, as complement with other sources, the consensus and the discords caused by the urban management for conservators tendencies, and the participation of the different social groups in the definition of the town politics publics put in place during this period

In the publishing field, contents are submitted both to a collective desire for standardization and to a commercial need for innovation. War, a much awkward topic, is a useful terrain to evaluate how children books cope with current social norms and picture them. Adult actors in publishing for the youth want, with more or less awareness, to perpetuate a social pattern incorporated when they were children. This behavior has a conservatory, or even archaistic, effect on their art work. This mimetic trend is strengthened by the literary and iconographic ethos of youth literature. The storyteller’s nostalgia, as we chose to name it, open a gap between a partly out-of-date socialization message, which is fostered by youth literature, and the need for an updated socialization, demanded by social groups. The processes of production and creation in publishing for the youth in France since 1980 have been studied according to the sociology of artworks and the phenomenological and interactionist perspective borrowed from Erving Goffman’s frame analysis. The corpus consists of 300 fiction books for children under 12. This group fits with the first step in the socialization process according to Peter Berger and Thomas Luckmann. In order to avoid searching ethical echoes in a feebly rationalized cultural activity, analysis tools are meant to explain technical gestures. They take part in a comprehensive approach of consensus and trouble among actors

The issue of biodiversity has been at the forefront of environmental concerns in the same way as climate change, and has been the subject of a voluminous literature and numerous alarmist reports worldwide. Depending on whether one looks at the question from the point of view of the life sciences or the social sciences one has complementary but also contradictory views. The issue of biodiversity, particularly in the Mediterranean, is considered from the angle of its territorial management, which focuses on the comparative study of several localized cases in areas marked by intense interactions between men and the environment, where the consideration for this issue is questioned in a conflictual decision-making context. This thesis deals with territorial management and the approach to biodiversity that emerges from practices related to the state of biodiversity, the phenomena that threaten it. This knowledge is confronted with managerial practices when they are constrained by conflicting events revealing the values of multiple stakeholders. We deduce three models of « Man-Nature » relationships and the regulatory implications that arise from them, and we highlight the paradoxes of public policies oriented towards biodiversity. We then show the determinative nature of these explicit and implicit models, mobilized by decision makers at the individual and institutional levels. This brings to light the weakness of the institutionalization of the issue of biodiversity, stammering. This leads us to provide recommendations for the integration of this issue into managerial practices, both public and private

Studies on role conflicts, their antecedents, their consequences on the workplace and the weight of society in the perception of these conflicts are entering their fourth decade and their interest is more relevant than ever.This study aims to highlight the effects of having a different perception from that of one's society of the importance of social roles on the experience of work-family conflict. It studies the consequences of this conflict on burnout and intention to leave.This work has led us to consider 4 imbalances.It particularly highlights the effect of gender on the perception of these imbalances and studies their consequences on individuals.Three studies are conducted. A qualitative study (N=30) in Morocco. Then two quantitative studies in France (N=420) and Morocco (N=295) aim to verify 5 groups of hypotheses.The results show:- The existence of gender differences in the perception of social imbalances in the two samples.- The absence of a direct effect of occupational imbalance on work-family conflict in the two countries and the presence of divergent effects of family imbalances on family-work conflict in the two contexts.- Poor functioning of the conflict between work and family as a mediating variable between imbalances and outcomes.- The effect of work-family conflict and family-work conflict on burnout and intention to leave partially corroborates the literature.- The absence of the moderating effect of religiosity on the relationship between conflict and burnout and intention to leave.The theoretical and methodological contributions and the key managerial implications of these results are discussed before tackling new research perspectives

In the overpopulated region of Temma (Khotang district), in the mountains of eastern Nepal, Indo-Nepalese (Brahman, Chetri and Dalit), Magar communities and the Chamling Rai, an autochthonous population of the Kiranti ethnic group, have been cohabiting for at least three centuries. Though their living conditions are alike, each of these strictly endogamic groups, whose religious practices and family structure differ considerably, leads a separate life. When they competed for a share of the land, they maintained neither openly violent nor cordial relations. The gradual removal of traditional Rai chiefs, then of the notables elevated to local responsibilities during the Panchayat period, the confusion that ensued after the democratic revolution in 1990, then the insurrection in 2001 by a maoist guerrilla in league with Kiranti nationalist and finally the ruthless operations led the army profoundly upset villagers' composure and state of mind, revealing the extent of their frustrations and motives, but also very strong aspirations towards a return to peace and quiet. The thesis, which describes the anthropological particularities of each of these groups, also aims at tracing back over a long period of time the initially slow, gradual then finally painful transformations of a multi-community village society. The research especially focuses on the balances of political and economic power between these groups, on the strategies they use to either cooperate or shun each other, on mutations of religious feelings, on the traumas inflicted by this violence from the outside and on the dynamics that this implies and the social restructuring it heralds

The purpose of this doctoral thesis is to show the complexity of evaluation of the communicative competence in foreign languages and culture's didactics. The specifics of our study are guided by the dufficulty and yet the necessity of the evaluation, while the study itself deals with the issue of a certified evaluation in Estonia. Problems with the evaluation raise mostly due to the technical side of the process, but not all of them-some issues are purely ethical. Thesis given shows what value conflicts are encounterd by an assessor during his work. Values combine in various paradigms (human, social, cultural, institutional; professional and personal values), related to different economical and ethical orders, which make assessor come to the hard compromise in a conflict situation. Study given sets a clear question of the ethical side of people's activity and tries to find an answer to this question based on a standard foreign language test in the national schools of Estonia

The aim of this study is to evaluate the role that groups play in the academic governance of Canadian universities, through the university Senate, during a period of financial retrenchment. Using a theoritical framework taken from Belanger & Lemieux (2002), Hardy (1996) and Jones (2001, 2004), the analysis focuses on the 2008 Winter semester sessions of the University Assembly of Université de Montréal. The results show that unions and associations did not show inter- and intra-group cohesion strong enough to counter the administration’s cohesiveness and ability to make alliances. The Assembly itself has seen its share of formal responsibilites wither and was, during the observation, little more than a soapbox for groups who wanted to place an item on the institutional agenda. The study highlights the importance of further study of inter-groups relationships in higher education, in parallel with the wider scientific trend of revision of management practices in universities.

This exploratory research aims to study academic and social integration of teenagers of Iranian origin recently arrived in Québec. It attempts to identify conflicts of values between parents and these teenagers and to discover identity strategies of these teenagers vis-a-vis these conflicts. It also tries to identify the strategies used by these teenagers to attain social and academic integration in school. Moreover, we try to understand the perception of the parents of these teenagers towards these issues. In this study, social integration is mainly approached with respect to strategies of acculturation by conducting qualitative interviews with fourteen adolescents ages 13-18 and their parents (nine). The analysis of gathered data shows that these young people adapt easily to their new environment while preserving their attachment to their culture of origin. Their life choices are influenced essentially by their family environment. The influence of their friends, generally from diverse origins, mainly affects their leisure and use of free time activities. They believe in the Iranian traditional values while trying to be independent and free with a modern lifestyle, which can lead to potential conflicts with their parents. The preferred identity strategies of these teenagers are primarily those of complex coherence or coherence by moderation of the conflicts of codes. These young people have a positive opinion about their studies and do not seem to feel any conflict in their academic environment. In short, we can state that Iranian youth, recently arrived in Quebec, adapts relatively easily to their new living environment while conserving their attachment to their culture of origin. This enables us to conclude that their process of integration has little similarities with the alienation of Moslem youth often mentioned and described in the international and national literature. Transactions in securities and security interest, and their implementation are far beyond national borders. They involve a multitude of players, such as the issuer, a large number of intermediaries arranged in a pyramid structure, investors, and obviously the beneficiaries of the securities or the security interest. You will also find diversified portfolios containing several securities issuers, from different countries. The difficulty of such a diversity of actors, and financial and legal components, lies in the application of divergent, and often conflicting, rules from legal systems of different origin (common law and civil law). Many jurists, of different nationalities, have found out, in the recent years that the rules creating the enforceability and enforcement of security interest, and the rules of conflict of laws, that helped determine the law applicable to these questions, were no longer responding to national legal requirements in relation with and exponential global financial market, which lack real administrative borders. To address this situation and accommodate the financial market, many regulations have been revised and adapted. Reasons why we have decided to proceed to the analysis of the applicable Quebec’s regulations, in comparison with the Swiss law, which is closest to the Quebec civil law tradition, the American law and the Canadian law, main inspiration of our commercial laws and regulations. Said analysis is also realized in light of the 36th Hague Convention of 5 July 2006 on the Law Applicable to Certain Rights in Respect of Securities held with an Intermediary. As per example, articles 8 and 9 of the Uniform Commercial Code (UCC) have proposed modern and revolutionary solutions that are dramatically different from the traditional rules related to ownership, property, security interest and conflict of laws. Other legal instruments, specifically dedicated to these issues were also suggested or adopted. This is the case of the Uniform Law on the transfer of securities (USTA), which was incorporated in the Quebec commercial laws and regulations, more particularly in An act Respecting the Transfer of Securities and the Establishment of Security Entitlements, RLRQ c. T-11.00 (LTVMQ); the 36th Hague Convention of 5 July 2006 on the Law Applicable to Certain Rights in Respect of Securities held with an Intermediary; the Swiss Federal Act on Private International Law (CPIL) and the Swiss Federal Act on intermediated securities (LTI). The analysis of these laws and regulations has led to the proposal of a new version of the rules of conflict of laws dealing with security interests and transferring intermediated securities under Quebec law. The goal of this study is to provoke, from the perspective of a civil lawyer, a deep reflection on the effectiveness of the, totally inspired by American common law, new Quebec’s rules on security interest and conflict of laws in matters of security entitlements. A choice that seems completely ignores a section of our civil legal system.

This research will address the perception that nurses working in a pediatric setting have of their contribution to the process of consent for care. Data analysis reveals an extension of the more conventional definition: here, the very con-cept of consent is perceived as to include the dimension of a process initiated and continued in dialogue and negotiation. Participants hardly spoke about autonomy but mostly of constantly repeated and renegotiated consent to individual or even routine acts of care. The intent of the nurse is less to obtain the patient’s permission for the caregiver to do his or her job with immunity, in legal terms; it is more to empower the child and his or her parents so as to obtain a collaboration to enable co-management of the disease. Very often, nurses discussed the importance for them of teamwork as the logical way to design their work. It is also logical to extend to parents and children an invitation to partici-pate in the therapeutic team. This is not to say that everything always goes smoothly. The child or the parent may raise opposition. Value conflicts then arise: conflicts and moral distress among nurs-es generated by the confrontation of beliefs and cultural and religious values differ-ent from those the nurse would more easily be comfortable with. But often, the nurse demonstrated a great cultural and religious sensitivity, and even would seek advice from colleagues who could know, more than she, about the value systems that raise questions. We used a set of interpretative initial referents as a conceptual framework that inte-grates concepts from the nursing model of Corbin and Strauss, as well as from the symbolic interactionism perspective.
