The chapter begins by noting that the prohibition of the use of force is the quintessential ius cogens rule of an erga omnes character. The same holds true for Common Article 1 of the Geneva Conventions. Both norms create third-party rights and obligations. However, structural deficits in the international legal order often hinder their effective enforcement. Moreover, recent state practice challenges certain obligations stemming in particular from the prohibition on the use of force. This chapter analyzes and compares the normative framework of both rules and examines recent contestations in state practice. It concludes by exploring the question as to what extent both rules reflect community interests or are still grounded on a reciprocal bilateral basis related to states’ self-interest.

This chapter argues that the process commonly described as the development of international law “from bilateralism to community interest” should be dis-aggregated into its formal, procedural, and substantive dimensions. A move away from formal and procedural bilateralism is always a move towards community interest because it furthers the rule of law. In contrast, a move away from formal/procedural bilateralism does not guarantee a better protection of the community’s substantive interests. International humanitarian law is a trailblazer of procedural and formal progress, yet a slacker in the substantive move toward what is commonly taken to be community interest: protecting the individual. The chapter further shows that alongside protecting the individual, the international community has a second competing substantive interest in the regulation of warfare: preserving military efficacy. International humanitarian law’s development highlights that progress in international law is more complex than the phrase “from bilateralism to community interest” suggests .

International law regime of conflicts between treaties is obtained by combining the principles of the succession of treaties over time (the later treaty abrogates the earlier one) and the principle concerning the effects of treaties on third-party States (Pacta tertiis neque nocent neque prosunt). In fact, conflicts between treaties are not frequent as states prefer to negotiate in order to avoid them. Most of the time, negotiations lead to the inclusion in a treaty of declarations of ‘compatibility’ or ‘subordination’ with another or a series of other treaties. Some of them are analysed in this chapter.

This chapter examines principles and rules on environmental protection in two critical situations: non-international armed conflicts and post-conflict peacebuilding. What kind of environmental obligations apply in bello between a government and rebels? In what sense are parties to the conflict accountable for environmental devastation? May states be liable also for injurious consequences of acts not explicitly prohibited under international law? How can their obligations be enforced? Furthermore, issues of post-conflict peacebuilding are discussed to explore whether specific principles and rules of jus post bellum are relevant for the protection of the natural environment. While certain aspects of the protection of the environment in relation to armed conflicts appear to be still unclear, some recommendations are developed in support of efforts currently undertaken in the International Law Commission.

This chapter comments on Article 98 of the Rome Statute of the International Criminal Court. Article 98 emerged in the context of the debate on grounds to refuse surrender and assistance. The Rome Statute has the potential to conflict with other obligations of States under international law, whether pursuant to customary international law or treaty. In particular, they are required to respect the immunities of diplomats and international officials. States that allow military activity by foreign troops on their territory often have agreements, known as ‘status of forces agreements’ (SOFAs). Article 98 governs these conflicts by, in effect, making obligations of arrest and surrender under the Statute subordinate to other legal norms.

This chapter addresses the dilemma that faculty members face when their obligation to help their students get jobs conflicts with their obligation to tell the truth about those students. To this dilemma, it can be replied either that (1) anyone who now must either violate his duty of veracity or fail to fulfill his obligation to a student must previously have created the problem by doing something he shouldn’t, or that (2) our obligations to our students never require that we distort the truth or omit important facts, or that (3) we owe our students plenty of distorting and omitting, but doing these things in letters of recommendation is not wrong. Some problems with each approach are discussed, and examples of both truthful and less than truthful letters are provided.

Conscientious objection in health care generally involves conflicts between health care providers asserting authority not to provide certain goods and services such as emergency contraception or abortion and patients seeking them. The conflict is may be exacerbated by objectors’ refusal to cooperate with others performing these actions. Equitable resolution of this conflict depends on the role responsibilities of health care providers and the availability of alternatives for patients. Protection of the integrity of providers should not substabtially limit patients’ access to needed goods and services, especially because of the power and knowledge differential between health care professionals and patients and the restrictions on patients obtaining goods and services through other means. Although professional obligations entail clear duties such as notification, informed consent, and emergency treatment, there is contining debate about obligations to refer and what constitutes discrimination. Organizations may make analogous claims regarding their integrity and similar systems should be developed to assure patient access.

The controversy surrounding the applicability of the right to life during armed conflict makes it arguably one of the most divisive and topical issues at the junction of international humanitarian law and international human rights law. Recent litigation has, among other things, prompted the UK government to signal an intention to derogate from Article 2, ECHR, subject to certain caveats, in future armed conflicts. The litigation pursuant to Article 2 is also set to continue as the UK, and many other States with right to life obligations, will continue to use lethal force overseas; thus the significance of the issue will remain unabated. The scope and application of the right to life in armed conflict not only concerns parties to the ECHR; the predominance of coalition military operations in recent years has necessitated that it is essential for all troop-contributing States to understand the legal limitations of those States bound by the ECHR. It is equally important that the UN, NATO, NGOs, and other governments not directly involved in the armed conflict are aware of any States’ right to life obligations. Notwithstanding this, the applicability of the right to life in armed conflict is yet to be fully considered in academic literature. This book aims to close this lacuna and address the issue of the right to life in armed conflict by identifying and analysing the applicable law, citing recent examples of State practice, and offering concrete proposals to ensure that States comply with their right to life obligations.

This chapter is devoted to certain miscellaneous aspects of the law of treaties. Treaty interpretation is the daily fare of international activity, and is also of considerable importance at the national level. In addition, the chapter shows how it is important to grasp what reservations are (and what they are not), and what effect they might have—these being difficult and delicate questions that arise both when a treaty is under negotiation and after its conclusion. Similarly, claims by States to terminate their treaty obligations are a frequent source of international friction. The same goes for claims that a treaty, or part of it, should be regarded as void, because it conflicts with a fundamental rule of international law (ius cogens). Finally, the effect of armed conflict on treaty rights and obligations may have immediate consequences for diplomats.
