Abstract (sommario):

The paper analyses the problems of concurrence of the conditions under which criminal proceedings are permissible. In Polish legal studies, there are different takes on these problems. The author introduces a division into concurrence of formal conditions of the same kind (Article 17(1)(5) and (7) to (10) of the Code of Criminal Procedure), concurrence of substantive conditions of the same kind (Article 17(1)(1) to (4) CCP) and concurrence of conditions of different kinds, after which she tries to develop practical guidance to help either choose one of the concurrent conditions under proceedings are permissible as the grounds for refusal to initiate criminal proceedings or for discontinuance of such proceedings or – alternatively – for accumulation of such conditions. The author of the article provides arguments for and against both cumulative and eliminative concurrence of conditions under which proceedings are permissible; basically she is inclined to treat them as cumulative.

INTRODUCTION: Medical conditions occurring in spaceflight pose risks to the crew and the mission and these risks will be exacerbated during exploration-class missions. Probabilistic risk assessment is a method used at NASA to quantify this risk for low-Earth orbit operations. Informing Mission Planning via Analysis of Complex Tradespaces (IMPACT) is a next-generation tool suite that will perform these assessments for exploration-class missions. It will require a robust list of medical conditions of significant likelihood and/or consequence to exploration-class missions to accurately inform the tool suite.METHODS: The IMPACT 1.0 Medical Condition List (ICL 1.0) contains 120 conditions selected in the context of a 210-d cis-lunar, Mars analog design reference mission. The conditions were selected via a systematic process that preserved institutional knowledge from nine prior condition lists. Conditions were prioritized for inclusion in the ICL 1.0 based on history of occurrence in spaceflight, concurrence among the nine source lists, and concurrence among subject matter experts.DISCUSSION: The ICL 1.0 has notable advantages over its predecessor lists in that it is more specific to exploration-class missions, contains a greater number, breadth, and depth of conditions, and was derived via consensus across multiple medical specialties.Kreykes AJ, Suresh R, Levin D, Hilmers DC. Résumé En opposition à la sociologie officielle de la science qui ne fait qu'enregistrer l'image triomphante que l'hagiographie scientifique produit et propage, qui constitue la " communauté scientifique " comme un champ social d'exception et qui néglige les phénomènes de domination, l'auteur introduit et élabore la notion de " champ scientifique " qu'il définit à la fois comme le système des relations objectives entre des positions sociales et comme le lieu de la concurrence qui a pour enjeu spécifique le monopole de l'autorité scientifique inséparablement définie comme capacité technique et comme pouvoir social. Il découle de cette définition qu'il est vain de distinguer entre des déterminations proprement scientifiques et des déterminations proprement sociales des pratiques scientifiques : la lutte pour l'autorité scientifique est une lutte irréparablement politique et scientifique dont la spécificité est qu'elle oppose des producteurs qui tendent à n'avoir d'autres clients que leurs concurrents.

RésuméL'objet de cet article est de proposer un modèle permettant de déterminer le prix de transfert optimal entre deux filiales d'une multinationale qui choisissent de façon décentralisée les quantités (concurrence à la Cournot) ou les prix optimaux (concurrence à la Bertrand) sur les marchés oligopolistiques où elles opèrent. Nous montrons que le prix de transfert qui permet à la multinationale de maximiser ses bénéfices consolidés est fonction de trois effets : (1) un effet « transfert de bénéfice » qui dépend de la comparaison des taux d'impôt entre les deux pays où sont situés les filiales; (2) un « effet stratégique » qui provient de ce qu'un prix de transfert sous évalué (inférieur au coût marginal de production de la filiale exportatrice) peut permettre à la filiale étrangère d'être plus agressive sur son marché; (3) un « effet de rétroaction » qui constitue une force de rappel par rapport aux deuxième effet dans le sens où si les coûts marginaux de production de la filiales exportatrice sont croissants, une augmentation des quantités vendues par la filiale étrangère réduit la production de la filiale exportatrice sur son propre marché (et par là même ses profits). Nous montrons en outre que si les coûts de production ne sont plus identiques, le prix de transfert optimal sera d'autant plus faible dans une concurrence à la Cournot que le coût marginal de production de la filiale exportatrice est lui-même faible. Nous étudions enfin les conditions (fiscales) sous lesquelles la multinationale peut exclure les entreprises concurrentes du marché du bien final quand elle les approvisionne en input intermédiaire.

During the high economic growth years (1955-1973), Japan became heavily dependant on food, foodstuff and lumber imports. This evolution was due partly to general contraints (narrowness of land, rise in living standards, etc), partly to the structural transformations of Japanese agriculture (development of stock raising, shrinking of winter crops, etc). Custom barriers have been lowered in many cases. Nevertheless, agricultural and food prices remain very high, and the present policy is to stimulate the productions which, during the high growth era, had been given up to international concurrence. Priority is now given to maintaining or raising self-sufficiency ratios which had dangerously subsided during the sixties.

The use of zeolites in agriculture is part of the current trend of finding viable alternatives for increasing soil productivity in concurrence with growing fertility. Using zeolite as a partial or total replacement for chemical fertilizers is based of the vast capability of this product to improve the physical and chemical properties of soil. The spring barley crop fertilizer use based on zeolite had a beneficial effect, increasing production.

These extreme weather conditions can strongly affect arable crop growth and final yields. Here, early heat waves over Italy from 1995 to 2013 are identified and characterised and their impact on durum wheat yields is investigated. As expected, results confirm the impact of the 2003 heat wave and highlight a high percentage of concurrence of early heat waves and significant negative yield anomalies in 13 out of 39 durum wheat production areas. In south-eastern Italy (the most important area for durum wheat production), the percentage of concurrent events exceeds 80 %.

We investigate the ground state persistent spin current and the pair entanglement in one-dimensional antiferromagnetic anisotropic Heisenberg ring with twisted boundary conditions. By solving Bethe ansatz equations numerically, we calculate the dependence of the ground state energy on the total magnetic flux through the ring, and the resulting persistent current. Motivated by the recent development of the quantum entanglement theory, we study the properties of the ground state concurrence under the influence of the flux through the anisotropic Heisenberg ring. We also include an external magnetic field and discuss the properties of the persistent current and the concurrence in the presence of the magnetic field.

Ainsi, nous nous intéressons au nombre d’actions concurrentielles qui composent une stratégie de rupture, à la vitesse de ces actions et à leur variété. Trois propositions de recherche construites à partir de la littérature sont confrontées au cas des multiplexes dans le secteur français des salles de cinéma.

AbstractSimultaneous bilateral spontaneous pneumothorax (SBSP) is a very rare type of pneumothorax. Most reported cases are associated with underlying lung diseases. In a small number of pediatric studies, SBSP was found to be associated with human bocavirus bronchiolitis, Langerhans cell histiocytosis, and Mycoplasma pneumoniae infection. The present work examines an interesting case of type 2 congenital pulmonary airway malformation presenting with SBSP and bilateral multiple parenchymal cysts.

Notre analyse met en évidence le rôle central joué par les juges dans le processus d’intégration européenne. Contrairement à l’approche juridique dominante qui raisonne en termes de coopération, nous montrons que l’intégration européenne résulte de la compétition que se livrent Cours européennes et Cours nationales pour l’obtention et l’exercice de droits de juridiction sur les marchés nationaux. Cette situation leur fournit des incitations à innover, qui sont fonction notamment de leurs situations respectives sur les marchés. Selon le degré de contestabilité du marché national, la juridiction nationale, initialement en situation de monopole, est amenée à innover pour empêcher l’entrée de la Cour européenne sur son marché. Si cette entrée se produit, suite à une innovation réussie de la Cour européenne, les deux offreurs s’inscrivent dans un processus d’innovation juridique destiné à modifier la répartition des parts de marché sur le marché national. Par suite, les comportements d’innovation des différentes Cours affectent certes les conditions du marché sur lequel elles interviennent, mais sont également, à leur tour, affectés par les conditions de marché. Nous montrons en outre que la concurrence entre juridictions européennes et nationales constitue une force favorable à l'intégration européenne.

Malgré les efforts déployés par le législateur lors de la réforme du Code civil du Québec, la notion d'ordre public demeure vague, floue et difficile à définir en des termes précis. La disparition de la notion de bonnes moeurs n'a pas en effet réglé toutes les questions controversées soulevées sous l'empire de l'ancien Code civil ni dissipé toute la confusion qui régnait. Certaines questions se posent toujours relativement à la distinction entre l'ordre public de direction et l'ordre public de protection, entre l'ordre public économique et l’ordre public politique et social, ainsi qu'au sujet des sanctions applicables en cas de violation d'une disposition d'ordre public en vigueur au moment de la formation du contrat ou d'une disposition qui prend effet alors que le contrat est déjà formé et en cours d'exécution. Les nouvelles dispositions traitant de l'ordre public, malgré leur multiplication et leur précision, n'apportent pas de réponses claires quant à leur applicabilité rétroactive, quant aux effets particuliers qu'engendre la nullité absolue qui frappe un contrat fait en violation de ces dispositions, ni quant aux conditions de la validité d'une renonciation à une règle d'ordre public. La doctrine et les tribunaux conservent leur rôle traditionnel, leur intervention étant toujours requise pour clarifier certaines ambiguïtés persistantes et pour répondre à certaines interrogations qui surgissent dans des situations tout à fait exceptionnelles et imprévisibles à la suite de la réforme du Code civil du Québec.

Nous avons étudié la dynamique de la vie économique aux Pays-Bas et, en particulier, l’importance des entreprises en croissance rapide. Celles-ci stimulent l’innovation, défient les concurrents et créent de nombreux emplois. Dans la période 1989-1997, près de la moitié des créations brutes d’emplois par les entreprises existantes (711 000) est due à des entreprises en croissance rapide, qui sont pourtant en nombre relativement limité (6 %) par rapport aux entreprises en croissance normale (25 %). Les entreprises en croissance rapide semblent revenir bien souvent à un rythme de croissance inférieur (67 %), tandis que près de 8% des entreprises en croissance normale accélèrent leur croissance. Les jeunes entreprises contribuent à augmenter le nombre des entreprises en croissance rapide. Beaucoup d’entreprises croissent par étapes, car elles se heurtent à des plafonnements. Lorsqu’elles ont résolu leurs difficultés, elles peuvent croître à nouveau. Sur ce point, le gouvernement a une mission à accomplir. Les responsables politiques néerlandais s’efforcent de créer des conditions pour favoriser une concurrence dynamique et prévenir les alliances qui entravent le jeu de la concurrence. En outre, ils cherchent à aplanir les obstacles auxquels se heurtent les entrepreneurs, par exemple les faiblesses du marché, et à stimuler la création d’entreprises. Le gouvernement a pris quelques mesures additionnelles en faveur des entreprises en croissance rapide : il a étendu la portée des réseaux, favorisé la formation pour permettre aux entrepreneurs d’acquérir les habiletés nécessaires et, enfin, il a amélioré l’information fournie.

AbstractThis article proposes a solution to two unresolved issues regarding the V2 structure in the history of French: to which type of V2 languages — symmetrical or asymmetrical—does Old French belong, and why did V2 later disappear? It appears that Old French is not homogeneous with respect to V2: it is symmetric up to the 12th century and then goes through a period of grammatical competition between the two types of V2 structure. This indicates a syntactic change in progress, from a symmetrical to an asymmetrical structure. But French never completed this transition and lost V2 after the period of competition, contrary to Continental Scandinavian which underwent the same change. This contrast follows from the fact that Old French failed to meet the learnability conditions of the asymmetrical V2 structure. This analysis thus raises the issue of the relation between syntactic change and learnability.

The concurrence of microorganisms in niches that are hostile like extremes of temperature, pH, salt concentration and high pressure depends upon novel molecular mechanisms to enhance the stability of their proteins, nucleic acids, lipids and cell membranes. The structural, physiological and genomic features of extremophiles that make them capable of withstanding extremely selective environmental conditions are particularly fascinating. Highly stable enzymes exhibiting several industrial and biotechnological properties are being isolated and purified from these extremophiles. Successful gene cloning of the purified extremozymes in the mesophilic hosts has already been done. Various extremozymes such as amylase, lipase, xylanase, cellulase and protease from thermophiles, halothermophiles and psychrophiles are of industrial interests due to their enhanced stability at forbidding conditions. In this review, we made an attempt to point out the unique features of extremophiles, particularly thermophiles and psychrophiles, at the structural, genomic and proteomic levels, which allow for functionality at harsh conditions focusing on the temperature tolerance by them.

Recent research highlights contemporary travel writing’s complicity in global politics, and the genre is claimed to reproduce the discourses that constitute our understanding of the world. It has also been argued that the genre holds a possibility to help us gain further knowledge about contemporary global politics, as it may work as an arena where global politics is commented on, intervened with and re-shaped. With this double view, current research exemplifies how scholars today grapple with the challenge of accounting for simultaneous and sometimes conflicting histories and conditions that are altered and affected by colonial contacts, practices and ideologies, and by recent globalisation. This article explores this double characteristic of the travelogue through the concept of concurrence, and discusses how this concept is useful as a tool for a new understanding of the genre. How can this concept be employed in an analysis of travel writing that is deeply engaged in a critique of colonialism and its legacy in today’s globalism but is simultaneously enmeshed in and complicit with the legacy that is critiques? “Concurrence” is introduced as a concept for such analysis since it contains both the notion of simultaneity and competition. It is suggested that “concurrence” provides a conceptual framework that allows us to account for controversies, intersections and inequities without reinscribing them into a reconciled and universalizing perspective. In exploring the concept of concurrence, this article provides an initial analysis of two contemporary Swedish travel narratives by Sven Lindqvist. The analysis is focused on the genre’s tension between fact and fiction, its discursive entanglement in colonialism, and the problem and possibility of writing postcolonial critique by use of this genre.

Le choix des modalités financières qui accompagnent tout contrat de transfert de technologie n’est jamais innocent. Il peut être tentant pour un donneur de licence d’imposer au licencié, par exemple, un prix de vente de sa technologie, ou encore d’exiger des modes particuliers de versement des redevances dues par le licencié. Ce dernier peut lui-même y trouver son compte. Toutefois, les droits de la concurrence américain, canadien et européen, encadrent plus ou moins la discussion sur ces aspects financiers. Sous cet angle particulier, ces droits font l’objet ici d’une étude comparée. Ces droits reflètent un compromis, variable selon les pays, entre les intérêts du fournisseur de la technologie, qui a le mérite de l’effort créatif, et la libre concurrence, qui peut être entravée par certaines clauses financières. Le régime juridique américain obéit à une tradition de sévérité, remise en cause depuis quelques années. Le Canada offre l’exemple d’un droit incertain ayant connu très peu d’applications jurisprudentielles. L’Union européenne, de son côté, développe un droit de la concurrence particulièrement interventionniste pour préserver les conditions d’une saine concurrence inter-étatique. Ces diverses conceptions ne sont pas ancrées définitivement dans le contexte économique et politique qui leur est propre. Bien au contraire, les différents régimes juridiques des clauses financières restrictives connaissent une mutation commune, dans le sillage de la mondialisation économique. On entrevoit, en effet, une libéralisation progressive de ces régimes, notamment sous l’influence d’auteurs se réclamant de l’École de Chicago. Malgré tout, l’auteur doute du bien-fondé d’une libéralisation totale, en particulier lorsqu’une intégration économique régionale est en jeu, comme le montre le droit européen.

The relationship between entanglement and anisotropy is studied in small spin chains with periodic boundary conditions. The Hamiltonian of the spin chains is given by a slight modification of the dipolar Hamiltonian. The effect of the anisotropy is analyzed using the concurrence shared by spin pairs, but the study is not restricted to nearest-neighbor (NN) entanglement. It is shown that, under rather general conditions, the inclusion of anisotropic terms diminishes the entanglement shared between the spins of the chain irrespective of its range or its magnetic character.

In the paper, the author discusses the normative aspects of the misdemeanor of violent driving from Articles 41 and 329 of the Law on Road Traffic Safety. After the introductory remarks, the legal regulations were analyzed and it was pointed out that, in the opinion of the author, the misdemeanor manifests itself in several forms. Controversial issues arising from the legal norming of misdemeanor and causing dilemmas in practice are defined. Normative aspects of misdemeanor are viewed through the theoretical institutes of unity of action, concurrence of misdemeanors and misdemeanor of extended duration. Special attention is paid to the analysis of the nature of the misdemeanor regulated by Article 41 paragraph 1, which is controversial because it is not precisely defined and leaves a possibility for different interpretations, in contrast to Article 41 paragraph 2 in which the legislator prescribed four alternative acts of execution that represent violent driving. The practical implications of situations when the perpetrator fulfills at least two of the four stipulated conditions from Article 41 paragraph 2, the relationship between the two forms of misdemeanor, as well as the conditions for the existence of a misdemeanor in an extended duration and a more serious form of misdemeanor were considered. The author also analyzed the question of the concurrence of misdemeanor violent driving and other traffic misdemeanors, defining the criteria by which an answer can be given to the question of when there is a concurrence of misdemeanors, and when there is a natural unity of action and iterative realization of the essence of the violent driving misdemeanor. Supporting the argumentation with examples from judicial practice, the author concluded that de lege ferenda the considered misdemeanor should be more precisely regulated normatively in order to avoid wandering in judicial practice.

Résumé Les systèmes fiscaux européens sont très diversifiés et bon nombre d'observateurs craignent que la mise en place de l'euro ne favorise une concurrence fiscale accrue entre États-membres. Celle-ci pourrait se traduire à terme par une dégradation des finances publiques, une exonération de fait des bases les plus mobiles avec un report de la charge fiscale sur les bases les moins mobiles, et une perte de souveraineté des États, notamment par rapport à leur capacité à mettre en œuvre des politiques de redistribution. Actuellement, le débat porte essentiellement sur la fiscalité pesant sur les revenus du capital — impôt sur le bénéfice des sociétés et sur les revenus de placement. En effet, ces revenus sont potentiellement mobiles et les écarts de fiscalité, mesurés grâce au calcul de coûts du capital dans le cas de l'impôt sur les sociétés, sont importants — ils peuvent être supérieurs à 30 % dans certains cas. En ce qui concerne les revenus de l'épargne, force est de constater que le jeu auquel se livrent les États tourne à l'absurde : chaque État taxe ses résidents mais n'impose pas les non-résidents dans un contexte où chacun peut aller chez le voisin. Dans ces conditions, la Commission européenne adopte désormais une position plus pragmatique qu'il y a une dizaine d'années où l'objectif était d'harmoniser les fiscalités nationales pour réduire les distorsions de concurrence entre États. L'accent est mis davantage sur le caractère dommageable d'une concurrence fiscale non maîtrisée, comme en témoignent la proposition de directive concernant l'instauration d'une retenue à la source pour les revenus de l'épargne ou l'adoption par les États en 1997 d'un code de bonne conduite. Quoi qu'il en soit, en vertu de la règle de l'unanimité en matière d'harmonisation fiscale, un pays comme le Luxembourg, favorable à la concurrence fiscale compte tenu des règles qui régissent le secret bancaire dans cet État, se trouve en position de leader dans les négociations.

Hirschsprung’s disease (HD) and annular pancreas are both uncommon congenital gastrointestinal malformations. Although additional abnormalities are associated with 18% of HD cases, there is limited evidence of concomitant HD and annular pancreas. We present a full-term, two-day-old male with abdominal distended, and failure to pass first stool after 3 days of observation and rectal washout the abdominal X-rays showed a double bubble appearance. Intraoperative finding, the patient had pancreas annulare (PA). Colonic aganglionosis was discovered using full-thickness rectal biopsies (FTRB). At the age of seven months, a transanal endorectal pull-through was performed without complications. Although the diagnosis of these conditions might be difficult due to their clinical similarities, appropriate diagnosis, and surgical management are possible and can dramatically minimize morbidity and death in the newborn.

Knowledge of the relationships among different features of quantumness, like entanglement and state purity, is important from both fundamental and practical viewpoints. Yet, this issue remains little explored in dynamical contexts for open quantum systems. We address this problem by studying the dynamics of entanglement and purity for two-qubit systems using paradigmatic models of radiation-matter interaction, with a qubit being isolated from the environment (spectator configuration). We show the effects of the corresponding local quantum channels on an initial two-qubit pure entangled state in the concurrence–purity diagram and find the conditions which enable dynamical closed formulas of concurrence, used to quantify entanglement, as a function of purity. We finally discuss the usefulness of these relations in assessing entanglement and purity thresholds which allow noisy quantum teleportation. Our results provide new insights about how different properties of composite open quantum systems behave and relate each other during quantum evolutions.

An 81-year-old man presented with chronic cough, which did not respond to the initiation of combined bronchodilator/inhaled corticosteroid therapy. CT of the chest revealed calcified nodules throughout the trachea sparing the posterior membrane, and tiny peripheral parenchymal nodules with basal interlobular septal thickening and calcification. Flexible bronchoscopy demonstrated endobronchial nodularity from the proximal trachea to the mid-sections of both main bronchi, sparing the posterior membrane. Histopathology revealed submucosal fibrous connective tissue and benign bone, confirming a diagnosis of tracheobronchopathia osteochondroplastica. CT was consistent with a concurrent diagnosis of dendriform pulmonary ossification. These two rare phenomena often present with non-specific symptoms, and the diagnosis can be made with imaging in both conditions. There is a role for bronchoscopy in the diagnosis of tracheobronchopathia osteochondropastica, and the endobronchial appearance could be diagnostic. The concurrence of both phenomena in our case might represent activity of a common cellular pathway of ossification in both sites.

We report a 2.32-Mb microdeletion at chromosome 17p13.3p13.2 and T-cell lymphopenia in a 6-month-old male infant with MDS. This is, to our knowledge, the first description of these 2 conditions co-occurring in the same patient.

This paper examines methods for counteracting groupthink defined as the extreme concurrence seeking exhibited by decision making groups, typically under conditions of high threat and cohesion (Janis, 1982). The authors identify three major categories of interventions potentially capable of mitigating groupthink tendencies: a) traditional recommendations originally hypothesized by Janis, b) methods for enhancing intellectual conflict during the decision making phase, and c) procedures designed to minimize pressures for the activation of group social identity defenses. The authors critically review the limited research empirically examining these recommendations, identify both advantages and disadvantages associated with implementing these interventions, and discuss conditions under which they are likely to be effective and ineffective.

La tradition civiliste se voit souvent reprocher une certaine sclérose résultant d’un nationalisme qui cherche trop à se mettre à l’abri d’idées venues d’ailleurs. Un code civil européen peut-il provoquer le renouveau ? Il importe d’en explorer les conditions, qui tiennent, d’une part, au caractère (con)fédéral de l’Union européenne et, d’autre part, à la dynamique même de l’innovation. Le succès relatif des fédérations comme mode de gouvernance est attribuable, comme les économistes l’ont montré, à la division des rôles — et donc de la souveraineté — entre les deux niveaux de gouvernement qui les composent. Il s’agit d’équilibres instables, mais dont les bienfaits proviennent notamment de ce que les États membres se trouvent en concurrence pour offrir la meilleure combinaison de biens collectifs moyennant contribution fiscale. Comme le droit civil fait partie de ces biens collectifs, il importe de transposer la concurrence interétatique sur ce terrain également : la concurrence est source d’innovation et de découverte (Hayek). Cette consigne exclut l’option d’un code civil uniforme imposé par le pouvoir central. La mise en oeuvre d’une procédure décentralisée de découverte n’est pas simple pour autant. Elle table sur la liberté qu’auront les citoyens de choisir le droit applicable à leurs rapports, l’éventail de choix pouvant comprendre une 26e option mise à la disposition des citoyens de manière uniforme dans toute l’Union européenne. Pour les juristes de tous les niveaux, cette conception entraînera un engagement à faire du droit comparé de manière significative. Le choc des idées insufflera un nouveau dynamisme dans la tradition civiliste.

La question des ségrégations scolaires qui a émergé au cours des années 1980 a fait l’objet d’une « reconnaissance » publique progressive. L’article montre que la visibilisation d’une question sociale dans le champ politique n’est pas une condition suffisante à sa résolution. Elle peut même donner lieu à un ensemble de hiatus entre chercheurs et « décideurs » politiques. Si, pour les premiers, la ségrégation est perçue comme un analyseur des dysfonctionnements institutionnels et des rapports sociaux inégalitaires, pour les seconds, elle est réduite à sa dimension locale. Les perspectives de résolutions qui en résultent divergent ainsi très fortement en mettant en concurrence deux options possibles et difficilement conciliables : l’égalisation des conditions de scolarisation ou l’aménagement des conditions de circulation des élèves.

Purpose The purpose of this paper is to examine the international standards for establishing national jurisdiction over the transnational crimes of money laundering and bribery and identify challenges to the adoption of those standards by different states in practice. Design/methodology/approach This paper, first, defines transnational money laundering and transnational bribery; then, it examines the legal bases and principles on which a state can claim criminal jurisdiction over these offences. This paper also discusses the application of jurisdictional conditions in a transnational context and how to deal with the problems arising from national claim of jurisdiction over these offences, for example, jurisdictional concurrence. Findings This paper argues that when the jurisdictional concurrence occurs, the involved states should consult one another by taking into account a number of relevant factors and take the “centre of gravity” approach to deciding which state or forum should prosecute eventually. States less able to establish jurisdiction over the offences are often those which have a weak legal basis and/or insufficient resources. Originality/value To the authors’ knowledge, this article would be the good guidance on how a state could claim jurisdiction over the offences of transnational money laundering and transnational bribery.

Le but du présent article est de brosser un tableau général de la doctrine en comparant son application en droit américain et en droit européen de la concurrence. L’article examine les raisons qui ont conduit à l’élaboration de la doctrine et son application par la Cour suprême et les juridictions inférieures américaines, les conditions de son application aux États-Unis, ainsi que la place importante occupée par les cas impliquant des droits de propriété intellectuelle. L’auteur examine ensuite la doctrine à l’aune du droit européen, en attirant l’attention sur les différences principales entre les ordres juridiques, ainsi que sur les controverses soulevées par son application en Europe. L’auteur termine par la question de la nécessité et de la légitimité de la doctrine dans les deux ordres juridiques concernés.

RÉSUMÉ L’objet de cet article est de faire le point sur une question longtemps négligée par les économistes, même si elle est au centre du débat politique chaque fois qu’il s’agit de réformer la fiscalité territoriale : c'est la question de l’empilement des taux de prélèvement quand plusieurs échelons de collectivités publiques taxent une même base imposable. En effet, le comportement non coopératif de gouvernements appartenant à un niveau administratif différent et qui partagent une même matière imposable est à l’origine d’externalités fiscales verticales négatives de recettes fiscales. Celles-ci sont responsables, pour certains, de la dérive à la hausse des taux de prélèvement. Dans ces conditions, les externalités entre collectivités publiques sont non seulement horizontales, comme l’a montré l’importante littérature sur la concurrence fiscale entre collectivités locales, mais aussi verticales quand il y a partage d’une même matière imposable par des collectivités publiques appartenant à un échelon de gouvernement différent. La prise en compte de ces deux types d’externalités permet alors de reconsidérer le débat portant sur les vertus respectives de la concurrence et de la consolidation (coopération) fiscale et sur le niveau optimal auquel doivent être entreprises les politiques de redistribution dans une économie fédérale.

In order to investigate the possibility to increase the efficiency of a flat-plate solar collector the mathematical model of the collector has been worked out. By solving the Laplace heat transfer equation at the boundary conditions accordingly to the construction of the collector, the obtained solution gives possibility to simulate on a computer the construction of the collector in dependence on physical, thermal and economic values of materials used for the construction. The computed results by theoretical formulas with experimental results obtained on special laboratory equipment have been compared and good concurrence acquired.

L’analyse distingue deux types de détournement de main-d’œuvre : l’un fondé sur la transférablilité des compétences, l’autre sur la possibilité qu’ont les firmes concurrentes de transformer ces compétences. Il peut alors être rationnel pour certaines firmes, et dans certaines conditions, déformer même si elles perdent une partie de leur main-d’œuvre. Cette situation n’est cependant pas socialement optimale et justifie l’intervention des pouvoirs publics.

Paliperidone is the 9-hydroxy metabolite (9-hydroxy) of risperidone and is a psychotropic drug of the atypical antipsychotic family. Paliperidone has the racemates (+)- and (-)-paliperidone. It is a dopamine D2 antagonist with serotonergic 5-HT2A antagonistic action that acts centrally. ALZA OROS® osmotic medication release technology is used to create Invega ER tablets. It is a tri-layer longitudinally compressed tablet based on a sophisticated osmotic delivery method that is meant to administer the paliperidone in a defined way over 24 hours. This research aims to create a generic controlled-release single-layer matrix tablet of paliperidone. Different combinations of Polyox and hypromellose in the core were used, followed by coating, to assist/build a stable and strong formulation. All strengths have similar in-vitro dissolution profiles. Freeze formulation was assessed for nitrosamine risk assessment as well as challenge for alcohol dose dumping study. Paliperidone is a basic compound with a pKa1 of 8.2 (piperidine moiety) and a pKa2 of 2.6 (pyrimidine moiety). As a result, a substantial portion of the molecule is ionized at physiological pH. It is relatively insoluble in water (0.003 g/100 mL water at pH 7.4). The solubility decreases at higher pH (0.001 g/100 mL at pH 12.9) and significantly increases at lower pH (3 g/100 mL at pH 5.3). The partition coefficient octanol/water (log P) is 2.39. Hence, discriminating media was identified as pH 2.75 buffer. The Higuchi model was used for expressing the in-vitro release profile through matrix composition. Formulation withstands 0–40% alcoholic conditions under in-vitro release tests. It is easy to formulate, stable and cost-effective. The manufacturing process involves dry blending followed by compression and coating so there will be the least chemical interaction of an active substance with other excipients. Hence, there is a negligible possibility to generate nitrosamine impurity in the formulation. The formulation is classified as rugged against dose dumping.

The article analyses the conditions for the formation of the corporate culture of a children’s health camp team in terms of the milieu approach, which makes it possible to reveal the features of the pedagogical environment of children’s recreation organisations as a self- developing system with many functions. The corporate culture of a children’s health camp is considered in the author’s interpretation as a socio-andragogical phenomenon, expressed in the concurrence and acceptance of the value system by all subjects of interaction. The main factors and conditions for the development of the corporate culture of a children’s health camp are studied both in the context of the “milieu paradigm” and from the standpoint of the organisation’s management and management theory. A reasoned conclusion is made about the need to maintain a balance between commercial profitability and pedagogical ethics in the activities of children’s health camps in competitive market conditions.

Article is devoted to evaluation of the Czech population’s income situation according to the inquiry realized within the frame of the Statistics on Income and Living Conditions (SILC) project. This was carried out by the Czech Statistical Office in the year 2005. Selected introductive analyses are presented with the view of pointing at the primary data usage possibilities. Main aim of the paper is to explicate basic quantitative indicators of Czech households’ income situation in general, then in division according to social groups and regional belonging. Consequent aim encompasses the identification and analysis of the income unevenness measure by the help of alternative methodological approach. The essential findings and income characteristics are introduced, including recomputation to the physical and so-called standardized member. In compliance with the predefined threshold the households endangered with the insufficient income level are identified. Insufficient income level means that household earnings cannot cover standard living costs. This part is followed by the brief statistical analysis of the data set of this group of households and the reference to other studies which are currently being pursued. Conclusion comprehends the spectrum of processes and analyses that could follow, or are already worked out, in concurrence with the existing findings. First of these, for example, is the income situation evaluation of seniors involved in the enquiry. Reason is that this segment is traditionally perceived as economically weak and more or less dependent on the social system settings.
