This book examines the complexities of sentencing when the offender stands convicted of multiple crimes. Contributors tackle the problem of multiple-offense sentencing in different ways and diverse perspectives. They consider the potential justifications for adopting a different approach when sentencing multiple offenders, one that results in more lenient sentences than would be the case if the crimes had been committed (and punished) as single offenses. They also discuss the courts’ pragmatic solutions to the problem, including the totality principle and the concept of overall proportionality, as well as proposals to justify the so-called bulk discount for multiple offending. Finally, they address the tension that exists between multiple concurrent crimes, and multiple crimes committed and punished sequentially.

This chapter focuses on the punishment of offenders sentenced for multiple offenses that have not been separated by independent prosecution and sentencing. Most scholars believe that the striking discrepancy between sentences imposed on multiple and repeat offenders cannot be justified in terms of retributivism. The existing solutions to the overpunishment of offenders convicted of multiple crimes invoke concurrent sentencing or the exercise of mercy by a sentencing court. Both approaches mitigate excessive punishment, but also create a number of problems. This chapter first considers the nature of the problem and the deficiencies of current approaches to multiple-offense sentencing before explaining how much of the gap between the repeat and the multiple offenders’ sentences can be accommodated within a retributive framework. It also describes culpability and harm as independent elements of deservedness and argues in favor of reduced sentences when the offenses are related to one another.

Chapter 8 outlines the potential merits and challenges of prosecuting individuals suspected of being involved in state organized crime before international criminal courts and tribunals. It identifies potential advantages common to international criminal courts and tribunals, namely the unavailability of jurisdictional immunities as a procedural bar, the greater likelihood of a genuine investigation, the existence of formal rules to deal with concurrent claims of jurisdiction, the capacity to address complex cases of system criminality, and the expressive potential of international criminal courts and tribunals. It then considers the respective advantages and disadvantages of different institutional mechanisms that could be used or adapted for the prosecution of state organized crime, examining in turn the International Criminal Court, ad hoc tribunals, and the future criminal chamber of the African Court of Justice and Human Rights.

At the same time that reactionary conservative political figures like Donald Trump were elected and disastrous socioeconomic policies like Brexit were voted into law, representations of bleakly comic white fragility spread across television screens. Analyzing a cycle of transatlantic television programs that emerged mostly between 2014 and 2016 targeting affluent, liberal, white audiences, Horrible White People examines the complicity of the white Left, obsessed with its own anxiety and suffering, in the rise and maintenance of the Far Right—particularly in the mobilization, representation, and sustenance of structural white supremacy on television. The authors use a combined methodology of media-industry analysis and feminist cultural studies, especially close textual analysis, to interrogate a cycle of US and British programming, like Broad City, Casual, You’re the Worst, Catastrophe, Fleabag, and Transparent, that features the abjection of middle-class, liberal, young white people. Throughout, they put these “horrible white people” in conversation with similar upmarket comedies from creators and casts of color, like Insecure, Atlanta, Dear White People, and Master of None, to highlight the ways those shows negotiate prestige TV’s dominant aesthetics of whiteness to push back against the centering of white suffering in a time of cultural crisis. The authors argue that multiple, concurrent, interrelated crises—recession, the emergent mainstreaming of feminism(s), and the unmasked visibility of racial inequality and violence—have caused upheaval among liberals. These crises are represented in this cycle as a collection of circumstances inextricable from and intertwined with the reactionary conservatism, antifeminism, and racism of the rising Right.

This chapter examines the multiple-conviction paradox, in which punishments of people convicted of multiple offenses are often discounted if sentences are imposed at one time but enhanced if imposed at different times. A bulk discount characterizes sentencing for concurrent convictions. A recidivist premium attaches to successive convictions. The chapter first reviews empirical data to show that the multiple-conviction paradox is the central issue that normative accounts of punishment must adequately address. It then discusses efforts by theorists to justify the bulk discount before proposing a framework for addressing the multiple-offense paradox within just sentencing systems that integrates principled considerations with blameworthiness and crime prevention. This approach favors parsimonious and human capital–enhancing punishments.

This chapter comments on Article 90 of the Rome Statute of the International Criminal Court. Article 90 primarily concerns extradition treaties. Most States Parties to the Rome Statute have pre-existing treaty obligations to facilitate extradition. Some may also have status of forces agreements that govern jurisdiction over crimes committed on their territory. Situations may arise where there are competing requests, one from a third State (which may not be a State Party to the Rome Statute) and one from the International Criminal Court. Article 90 provides a legal framework to resolve such conflicts. If a State Party that has received a request from the Court for surrender pursuant to article 89 also receives a request from a State to surrender the same person for the same conduct, it is to notify the Court and the requesting State of the fact that there are competing requests. From that point, the solution to the problem depends upon whether or not the requesting State is a State Party to the Rome Statute.

This chapter advances the proposition that while multiple offenders are more culpable than single-crime offenders and should thus be treated differently, multiple offenders should not be punished to such an extent that the state ends up treating an offender who has committed multiple offenses more harshly or in the same way as those who have committed more serious offenses, given the message each punishment communicates about the character defects about the recipient of the punishment. Following this principle would likely result in a presumption in favor of concurrent sentencing or at least “bulk discounts,” where even if an offender is guilty of committing multiple offenses, the punishment for each additional offense is smaller than that for the first offense. This chapter further argues that the practice of bulk discounts for multiple offenders is consistent with the practice of imposing the recidivist premium on those who, after having been convicted and punished, continue to reoffend.

The digital era presents fundamental challenges for the application and enforcement of state criminal laws. Questions of jurisdiction are becoming increasingly important to the investigation, prosecution, and punishment of crime, as with the growth of technology and the internet many crimes no longer take place within neat national boundaries. This is unfamiliar ground for criminal practitioners, and it begs the question of whether traditional approaches to criminal jurisdiction can adapt to the new global reality. In this innovative book, leading experts in criminal, international and internet law unite to address this fundamental question. They consider how jurisdictional regimes are orientated around concepts of territoriality and extraterritoriality, how these categories are increasingly blurred in the digital era, and how a range of jurisdictional transformations are occurring in the process. Part I presents novel doctrinal, empirical and theoretical perspectives on criminal jurisdiction, exploring how states are shaping and reimagining jurisdictional concepts in the crafting and interpretation of criminal offences, and the ramifications of increasing jurisdictional concurrency in state practice. Part II focuses on the investigative and enforcement powers of the state to assess how these issues are transforming traditional understandings of jurisdictional rules and boundaries, the challenges and opportunities that these present for law enforcement authorities, and the sorts of constraints and safeguards that may be necessary as a result. This book explores the notion of digital capitalism and its crash in 2007–2008, which it attributes to the uneven character of information and communications technology (ICT). It advances two main arguments: that the economic contributions made by ICT to digital capitalism rendered digital technology a fundamental pole of growth; and that, when it arrived, the economic crisis could be traced not only to financial speculation but to capital's multifaceted integration of digital systems into the political economy. In this account, the contradictory matrix of technological revolution and stagnation that constitutes capitalism today is highlighted. The book also elucidates the role of information and communications in the political economy's chief developmental processes, including capital's reorganization of the system of production, through fresh cycles of labor restructuring and spiking foreign direct investment; capital's concurrent ingress into finance; escalating military procurement spending; and the wide-ranging changes in the ICT sector. Finally, it considers how commodity chains bring together diverse labor systems to effect globally distributed production processes.

In the early twenty-first century, the Punjab region’s traditional drummers, dholis, were experiencing “the toughest time ever.” Concurrently, their instrument, the iconic barrel-drum dhol, was experiencing unprecedented global popularity. This book uncovers why, notwithstanding the emblematic status of dhol for Punjabis, the dholis’ local communities are facing existential crisis. The pursuit of a national identity—which aids in political representation and maintaining historical consciousness during change—has led modern Punjabis to make particular economic, social, and artistic choices. A casualty of this pursuit has been the disenfranchisement of dholis, who do not find representation despite the symbolic import of dhol to that national identity. Through the example of dhol’s subtle appropriation, the book argues that the empowerment gained by bolstering Punjabi identity in the global arena works at the expense of people on Punjabi society’s margins. At its core are the hereditary-professional drummers who, while members of society’s low-status “outcaste” population, created and maintained dhol traditions over centuries. Exacerbated by a cultural nationalist discourse that downplays ethnic diversity, their subaltern ethnic identities have been rendered invisible. Recognizing their diverse ethnic affiliations, however, is only the first step towards hearing hitherto absent perspectives of individual musicians. As a work of advocacy, this book draws on two decades of ethnography of Indian, Pakistani, and diasporic Punjabi drummers to center their experiences in the story of modern Punjab.

"Las discusiones en torno al dinamismo de tierras sugieren la necesidad de un cambio en enfoque para examinar con mayor detenimiento los efectos, las consecuencias y las influencias que sobre el territorio y sus habitantes tienen las dinámicas de concentración y acaparamiento de tierras. Independientemente de la escala (miles de hectáreas o solo unas pocas), la forma de posesión y/o adquisición (compra, arrendamiento, concesión, imposición), el origen de los capitales y las personas involucradas o los orígenes del fenómeno (legado histórico, leyes y políticas públicas, globalización, crisis alimenticias y liberalización de mercados), lo sobresaliente debe ser el cambio, el trastoque o el control territorial. Territorio en donde concurren recursos, personas y modos de vida. Así, encontramos que los conceptos de concentración de tierras y acaparamiento de tierras son insuficientes, pues encierran solo una dimensión de los patrones observados en las dinámicas de propiedad, uso y ocupación de la tierra. Por esta razón, en vez de replicar estos dos términos, presentamos en este libro el acaparamiento territorial. Con este nuevo término hacemos evidente la necesidad de un análisis exhaustivo de las implicaciones socioespaciales que las políticas y las dinámicas en relación con la tierra pueden implicar para las comunidades en términos de impactos, influencias y [re]significados de sus territorios y territorialidades. Por lo tanto, nuestro objetivo es ir más allá de la discusión sobre la adquisición o acumulación de tierras y recursos (y, por lo tanto, la discusión sobre la dinámica de la tierra en relación con la globalización, la inversión extranjera, la liberalización de mercados, la violencia y el control) para incluir también en el debate implicaciones socioespaciales diversas y significados que puedan crear una imaginación geográfica capaz de tener profundas influencias en la manera en que las personas y los grupos entienden su lugar en el mundo.
