This chapter illuminates the role that sources doctrine plays in construing international law as a system. It frames international law’s systemic qualities within the recursive relationship between sources doctrine and debates over international law’s systematicity. Sources doctrine reinforces and buttresses international law’s claim to constitute a legal system; and the legal system demands and requires that legal sources exist within it. International law’s systematicity and the doctrine of international legal sources exist in a mutually constitutive relationship, and cannot exist without one another. This recursive relationship privileges unity, coherence, and the existence of a unifying inner logic which transcends mere interstate relations and constitutes a legal structure. In this respect, the social practices of those officials who are part of the institutional workings of the system, and especially those with a law-applying function, are of heightened relevance in conceiving of international law as a system.

With regards to global trade, where new technologies impact both on what is traded and how, this chapter sketches the current regulatory landscape and projects the implications of emerging technologies for future regulatory approaches. While the regulation of technology mainly rests with domestic law, it is international trade law that addresses problems of regulatory diversity, overcomes unnecessary barriers to international trade and investment, and articulates common standards. Apart from general principles of non-discrimination and transparency, technology is particularly addressed by rules of intellectual property protection and by technical regulations and standards for industrial and nutritional products. For international trade law to respond to the challenges of legitimacy and democratic accountability, there need to be new approaches to regulatory cooperation and coherence, operating within a proper framework of multi-level governance that harnesses the process of globalization which is much driven by technological advances.

This chapter discusses the different theories employed in the field of international criminal law, which is now increasingly supported by theory. Case theories were developed after events had taken place; operational theories were produced to match complex facts; foundational theories were created to justify existing practices; external theories tried to make sense of the phenomenon of international criminal law as it had been observed; and so did the popular theories based on everyday encounters. Ago, rather than cogito, ergo sum was the field’s implicit maxim. Against this background one still finds that factual, operational, foundational, external theories prove to be less coherent when they are considered in light of each other. Rich theories could thus emerge from more joint theorizing among those working on variably factual, operational, foundational, and external theories, between scholars and practitioners, and between scholar-theorists and quotidian theorists.

Two French law professors, Ferdinand Larnaude and Albert de Lapradelle, prepare a report for their government on the legal issues involved in prosecuting the Kaiser, something that they recommend enthusiastically. The British set up a committee of experts that also studies the legal difficulties, recommending prosecution, although not unanimously. The French are mainly interested in atrocities perpetrated in the parts of their country that were occupied. The British focus on such issues as submarine warfare. Both groups of experts concur in dividing the types of charges that might be made against the Kaiser into waging a war of aggression, violating the treaties of neutrality, and unlawful conduct during the conflict, and believe Kaiser Wilhelm II cannot invoke immunity before an international tribunal.
