On 27 April 2022 the Divisional Court of the Queen's Bench Division of the High Court ruled that the Government committed an unlawful act in the early days of the COVID-19 pandemic when it directed that thousands of hospital patients should be transferred to care homes without being checked for infection. This direction was a response to the massive pressure on hospital beds caused by the unexpected onset and rapid spread of the virus. John Finch examines the circumstances which led to this decision being made and the reasons why the courts ruled it as unlawful.

This reply to the Symposium on Stefano Guzzini (ed.) The return of geopolitics in Europe?, answers the criticisms by John Agnew, Jeffrey Checkel, Dan Deudney and Jennifer Mitzen. It justifies (1) its specific definition and critique of geopolitics as a theory – and not just a foreign policy strategy; (2) its proposed interpretivist process tracing; (3) the role of mechanisms in constructivist theorizing and foreign policy theory; and (4) its usage of non-Humean causality in the analysis of multiple parallel processes and their interaction. At the same time, it develops the logic of the book’s main mechanism of foreign policy identity crisis reduction.

The British Qurʾānic researcher, John Burton, believes that the extant Qurʾān was organised and approved by the Prophet of Islam himself. The role of the Prophet of Islam in collection and promulgation of the Qurʾān was negated in favour of the concept of abrogation. Abrogation of both wording and ruling and abrogation of wording, but not of ruling are ideas fabricated by Muslim jurists attempting to base their juristic decrees on the Qurʾān even though the Qurʾānic text lacked any reference to such decrees. If the Prophet of Islam had, in fact, edited, checked, and promulgated the Qurʾānic document, jurists could no longer speak of such omissions or abrogations of texts in the extant Qurʾān. Their solution was to falsify traditions in order to exclude the Prophet of Islam from the history of collection of the Qurʾānic text, suspending such collection until after his death. John Burton’s treatment of the relationship between abrogation and collection of the Qurʾān demonstrates the rigour of his research in Qurʾānic and Islamic sources. On the basis of his book, traditions dealing with collection of the Qurʾān developed in the third century AH. One thing he did not consider was whether historical evidence confirms his depiction of the development of these traditions.

Abstract In Test 1 Temik and Thimet were applied to 6-row, irrigated plots (38 inch row widths), clay loam soil type, which accounted for approximately 0.3 acres each, replicated 4 times on 8 Mar. Applications were made either at-planting with a John Deere Max Emerge planter/applicator and/or side-dressed at bloom stage with a Gandy brand insecticide applicator. In Test 2 Temik at the rate of 3.0 lb(AI)/acre was applied side-dress at bloom. Gandy brand insecticide applicators were used to apply the material to the 4 replicated plots arranged in a randomized complete block. SPW (adults, eggs, immatures, and pupae) on leaves were checked once per wk and counts were based on a laboratory examination of 3 to 5 leaves per plot, 4th leaf from the top of each randomly-selected sampled plant. All counts were recorded as insects per leaf. Sidedress applications were made on May 21, followed 7 days later with an infurrow irrigation of approximately 4 acre-inches of water. Yields were machine harvested with a John Deere brand 2 row spindle harvester. Subsamples were extracted from each plot and ginned for fiber analysis and percent lint. Data were analyzed using Proc Anova of PC-SAS and mean separations with Duncan's Multiple Range Test.

That you've built from scratch a highly respected scientific research center, the Whitehead Institute in Cambridge, Mass. And then imagine that you wake up one morning and read in the hometown paper that you're accused of what "appears to be fraud and misrepresentation." The accusation is from a "Pete Stockton," whom you've never met, but who the paper says is a "staff member for Rep. John Dingell." That's more or less what happened to David Baltimore a year ago. His experience since has taken him into the Kafka maw of "congressional oversight," Dingell-style. Readers of this space will recall that the last time we checked with Congress's grand inquisitor, Chairman Dingell was retreating from a botched attempt to smear a former federal prosecutor. Now he's assailing Dr. Baltimore and, to make the effort really worthwhile, American science. The first time I met John Dingell I must admit to coming away with some respect for his intelligence and rough-hewn candor. But the more I've watched him and his investigators at work, the more it's clear that they are manning a runaway train. The arrogance bred of unchallenged power has stripped them of self-restraint and distorted their understanding of the public good.

The study considers gold-water nanofluid flow past a porous rotating disk while accounting for prescribed heat flux and suction at the boundary layer of the disk. The physical parameters of the nanoparticle volume fraction, magnetic parameter and entropy generation are investigated and presented in this paper. The numerically solved nonlinear equations by the spectral quasilinearization technique. The main findings are presented in graphical form and discussed for variations of the flow parameters. The findings indicate that increased nanoparticle volume concentration fall in velocity but a overshoot in temperature, while enhancing the magnetic parameter is associated with reduced velocity distribution and increased skin friction. Among other findings, the results also show that increasing the Brinkman number leads to increased entropy generation but reduced Bejan number, while the Reynolds number increasing in the generation of elevated levels of entropy production. The reliability, error analysis and accuracy are checked through convergence of the method. The accuracy is further tested through a comparison of results for limiting cases with those in the literature. The findings of this study have significant applications in engineering, science and technology.

Present assessment is considered to analysis flow as well as heat characteristics of steady, thermal slip flow of three-dimensional Casson fluid embedded in a porous medium with internal heat generation. Geometry of the present analysis is linearly stretched surface. Later, all the PDEs corresponding to the study are altered to set of nonlinear equations ODEs by means of appropriate similarity transformations. An efficient numerical scheme of spectral relaxation method (SRM) is applied to solve the nonlinear ordinary system. Variations of Nusselt number, temperature, velocity, and local skin friction coefficient with fluid parameters exhibited by graphs and tables. Spectral relaxation method gives an exact convergence to the nonlinear boundary value problems compare with general methods. In this study, to improve the precision and accuracy of the SRM successive over-relaxation (SOR) strategy is utilized. Proposed method as well as outcomes is checked with the comparison. A sensible connection is acquired between the current outcomes and accessible outcomes in writing. Some of the observations are skin friction coefficient raises and velocities decreases by the magnetic field strength. Skin friction and Local Nusselt number at the surface is more pronounced for non-Newtonian case than that of Newtonian case.

This study is a content analysis of Op-rd from US, Chinese, Indian and Pakistani press. It is based on the war journalism frame and peace journalism frame devised by John Galtung. Convenient sampling method was used and each paragraph was taken as a unit of analysis. Statistical analysis was done using SPSS 20.0. The study checked the overall inclination of a countrys press with the perspective of war and peace journalism. The study analyzed the data from three year and found the significant results. It was observed that press of almost all countries are doing war journalism in sizeable measure. The global press has given stories with a war journalism frame in more quantity than the peace journalism. The study found that global press has given notable importance to the issue of terrorism between India and Pakistan. The statistical analysis and ChiSquare test of the data also gave significant results.

On Monday 23 May 550 a directive was issued by the Emperor Justinian to John, metropolitan bishop of Anazarbus in Cilicia Secunda. Another directive, cast in corresponding terms, was sent to Cosmas, bishop of Mopsuestia (the present day Misis, seventeen miles east of Adana in southern Turkey) in the same province. ‘We indicate to your holiness”, he writes to John, ‘that you are to convene all the most-religious bishops of your synod; you are to repair to the town of Mopsuestia and make a detailed examination, with the senior men (whether clerics or laity), there established, foregathering, and learn from them whether they know the date when Theodore's name was removed from the diptychs.” If the senior persons in question do not know the answer, the fact is to be expressly recorded and the diptychs themselves are to be duly checked. Into the events leading up to this directive I will not now enter. It must suffice to recall that the setting was the so-called Three Chapters Controversy: what to do about Nestorius' precursors Theodore and Diodore, about Theodoret's writings against Cyril of Alexandria's twelve Anathematisms and the Letter of Ibas to Maris. On these matters the Council of Chalcedon had been indecisive. A hundred years after that council, it looked to many people, the emperor included, as if a few modest addenda to the council's decisions, amounting, perhaps, to nothing more than explications of its mind on Nestorius and his school, would put an end to the painful disunity of eastern Christendom.

This chapter reflects on facts. It looks at John D'Agata and Jim Fingal's book The Lifespan of a Fact. D'Agata is an essayist, while Fingal is a much younger man who had been hired by The Believer as a fact-checker to review one of D'Agata's essays for publication. Fingal ended up writing more than a hundred pages’ worth of corrections on D'Agata's essay. However, D'Agata defended his facts and his choices. He gave up in the end, though; the version of the essay that appeared in The Believer was a fact-checked, corrected version. The Lifespan of a Fact is a book they put together after the dust settled; it is a reconstruction of the exchanges, or really, their battle, as they work their way line by line through the original essay. But what makes the book remarkable is that it is a kind of staging of an investigation into such questions as: What is a fact? What is the truth? When is it okay, for the sake of a good story, to simplify, or change, or color facts? Is it possible to tell a story without doing so? Can one even draw a sharp line between fiction and non-fiction?

Most of these hailed his leadership; some compared him to John Muir. During a 34-year career with the Coastal Commission Douglas witnessed an overall severe cut in the agency’s funding and staffing; still, development had been checked and regulated while California registered the nation’s largest coastal economy, proving that effective regulation and economic growth could be compatible. Moreover, beach access had been increased substantially. Though Peter Douglas’s achievements for the coast have been singular and might land him in the pantheon of California’s greatest environmentalists, more time will have to transpire before history hands us its verdict on his legacy.

The presence of both paroled and unparoled rebel soldiers in the state spiraled out of control when some began to ransack warehouses filled with much needed goods in Greensboro. Even when such chaos was checked, the soldiers from Lee's army discovered that Johnston would not accept their service. Some finally gave up their war. But others remained determined to continue the fighting, pressing farther south in search of the fleeing Confederate president Jefferson Davis.

Abstract President Hoover nominated Judge John J. Parker, a circuit court judge from North Carolina, to be an associate justice of the Supreme Court. Within one week Walter White had checked into Parker’s record and learned that ten years before, when Parker was a candidate for governor of North Car olina, the Greensboro Daily News quoted him as saying, “The participation of the Negro in politics is a source of evil and danger to both races and is not desired by the wise men in either race or in the Republican Party of N.C.” Walter White believed that any jurist who maintained such a view point was not qualified to serve on the High Court. He further argued that he stood his best chance of obtaining justice. In that court there have been won six notable decisions within the last fifteen years, each of them of far reaching effect on the Negro’s constitutional rights. Three of those decisions outlawed the herding of Negroes in ghettos by means of city ordinance or state laws; another established the principle that trial of a person accused of crime in a court dominated by mob influence is not due process of law; while two others ended dis franchisement by means of Grandfather Clauses and through enactments pre venting participation in Democratic primaries.

The classical model of Malthus ([1783] 1970) can be described as a supply-side, dynamic, macro theory of population. It is a supply-side theory because Malthus did not emphasize the role of individual demand decisions on population-related variables. Individuals in ancient times certainly had their preferences for children and marriage; but Malthus assumed that such preferences would by and large be checked by natural constraints and that only when families had sufficient incomes would their preferences for children and marriage be effectively revealed (Schultz, 1981). In ancient times, when the hygienic environment and medical technology were primitive, and when production technology and administrative capacity changed relatively slowly, the natural checks on human growth and fertility almost always dominated the dynamics of population; the demand-side scenario, which originates from individual preferences, never played a significant role. The Malthusian theory is mainly a dynamic one because it describes why a population would have an equilibrium size that corresponds to the subsistence level of income and why a population would converge to such an equilibrium. Malthus argued that when a population size is larger than the equilibrium size, the per capita income will fall because of diminishing returns. This fall will be followed by an increase in mortality and a reduction in population growth rate, which in turn will drive the population size down to the equilibrium. When a population size is smaller than the equilibrium, the adjustment mechanism works in the opposite way, and the size increases toward the equilibrium. The conventional Malthusian model also largely ignores differences in decisions made by individual families; hence a set of macro variables becomes the only focus, thereby making a simple dynamic analysis possible. As Samuelson (1976) pointed out, although most classical economists, such as Adam Smith, David Ricardo, and John Stuart Mill, considered population analysis part of economics, by the early twentieth century most economists had decided that demographic movements were largely exogenous to the economic system and should be left to sociologists and other noncconomists for discussion. A more active alternative for economists is to modify the conventional Malthusian theory to allow it to be compatible with contemporary population practices and issues.

A widely used method for noise reduction in Monte-Carlo ray tracing is combing different means of sampling, known as multiple importance sampling (MIS). For bi-directional Monte-Carlo ray tracing with photon maps (BDPM), the join paths are obtained by merging camera and light sub-paths, and since several light paths are checked again the same camera path, and vice versa, the join paths obtained are not statistically independent. Thus the noise in this method obeys laws different from those in simple classic Monte-Carlo with independent samples so the weights that minimize that noise must also be calculated differently. This paper drives that weights for the simplest case when we mix contribution from only two vertices of camera ray. It shows that the weights obey an integral equation which is qualitatively different from the well-known MIS formulae for uncorrelated samples. Besides that, even if forget the integral operator, the weights depend on the integration sphere radius and the number of light rays used. The integral equation is solved analytically in a closed form and it is demonstrated how to perform the necessary calculations in BDPM.

A Monte-Carlo ray tracing is nowadays standard approach for lighting simulation and generation of realistic images. A widely used method for noise reduction in Monte-Carlo ray tracing is combing different means of sampling, known as Multiple Importance Sampling (MIS). For bi-directional Monte-Carlo ray tracing with photon maps (BDPM) the join paths are obtained by merging camera and light sub-paths. Since several light paths are checked against the same camera path and vice versa, the join paths obtained are not statistically independent. Thus the noise in this method does not obey the laws which are correct in simple classic Monte-Carlo with independent samples. And, correspondingly, the MIS weights that minimize that noise must also be calculated differently. In this paper we calculate these weights for a simple model scene directly minimizing the noise of calculation. This is a pure direct numerical minimization that does not involve any doubtful hypothesis or approximations. We show that the weights obtained are qualitatively different from those calculated from classic “balance heuristic” for Monte-Carlo with independent samples. They depend on the scene distance, but not only on scattering properties of the surfaces and the distribution of light source emission.

United Nations have declared the current decade (2021-2030) as the ”UN Decade on Ecosystem Restoration” to join R&D forces to fight against the ongoing environmental crisis. Given the ongoing degradation of earth ecosystems and the related crucial services that they offer to the human society, ecosystem restoration has become a major society-critical issue. It is required to develop rigorously software applications managing ecosystem restoration. Reliable models of ecosystems and restoration goals are necessary. This paper proposes a rigorous approach for ecosystem requirements modeling using formal methods from a model-driven software engineering point of view. The authors describe the main concepts at stake with a metamodel in UML and introduce a formalization of this metamodel in Alloy. The formal model is executed with Alloy Analyzer, and safety and liveness properties are checked against it. This approach helps ensuring that ecosystem specifications are reliable and that the specified ecosystem meetsthe desired restoration goals, seen in our approach as liveness and safety properties. The concepts and activities of the approach are illustrated with CRESTO, a real-world running example of a restored Costa Rican ecosystem

Abstract A rigid subsea spool is used to connect the riser of a jacket platform to oil export pipeline in Johan Sverdrup oil field. The location is within the lifting zones of the platform. Consequently, the dropped object hazard has potential high risk and needs to be checked. This paper presents a numerical model on accessing the structural dynamics of subsea spool under the dropped container impact loads by using de-coupled local and global model. The impact impulse was obtained from local impact analysis by Abaqus Explicit solver, in which deformations from container and pipeline are both captured. The global model was built by using inhouse program utilizing ANSYS APDL macros. A simple input file is only needed for end users. The nonlinear pipe and soil interaction is included in a simplified manner. The model comprises of static and dynamic analysis parts. The static analysis captures the in-place configuration and the functional loads. The dynamic analysis is a restart with inherited stress state from static analysis. The impact impulse was applied by point loads in a certain time range. The nonlinear soil stiffness was approached by spring elements (compression only). The dynamic analysis was done in a longer time, ensuring to capture any dynamic effects. The interface loads at the riser stick-out and riser anchor are both extracted and discussed. Concluding remarks have been made accordingly.

The Jet Propulsion Laboratory at the Berlin University of Technology has recently introduced a multimedia aeroengine design project under the working title “Project Jet Propulsion”. The seminar, in which the German aeroengine industry is actively involved, is directed at students who have successfully finished their basic engineering training course. The objective of the course is to provide experience of all stages of the complete design process of an engine component in a genuine industrial working environment. The component is selected to ensure that a wide range of design requirements, including customer requirements, aero-thermodynamic and mechanical design, costing and certification, have to be taken into consideration. An experiment supporting the design completes the course. The course is attended by a fixed number of students and lasts for one year. It involves fortnightly working sessions, which are organized the same way as they would be in the industry, with minutes being kept and action lists checked. The students are encouraged to work on their own initiative, identify the necessary tasks and set up a schedule to accomplish the work within the given time limit of the course duration. Industry participates in a variety of ways. At the end of each working session experts from the companies involved join in a telephone conference, giving their comments on the work of the group and answering questions. A video conference supported by one of the industrial partners is also on the agenda. During the course, both companies involved are visited and progress is reviewed in an intermediate and a final design review respectively. No scripts are handed out during the course. Communication is done by e-mail and progress reports, memoranda and minutes of the meetings are made available on the internet.

Mojave National Preserve (MOJA) in the Mojave Desert of southern California hosts an extensive geologic record, with units ranging in age from the Paleoproterozoic (2.5 to 1.7 billion years ago) to the Quaternary (present day). MOJA topography is dominated by numerous mountain ranges hosting extensive geological exposures divided by expansive valleys, dunes, and a low elevation dry salt lake. Some geological units are fossil-bearing, both within the preserve and in adjacent lands outside the boundaries of the preserve. The fossils preserved within MOJA span from the Proterozoic Eon (uncertain maximum age of fossiliferous rocks, but at least approximately 550 million years ago) to the Holocene Epoch (beginning 11,700 years ago). Abundant and diverse marine fossils are preserved in units dated from the late Proterozoic through most of the Cambrian, as well as from the Devonian through the early Permian. More recent volcanic tuff and unconsolidated sedimentary deposits in valleys preserve Cenozoic flora and fauna. Geologic surveys documented paleontological resources within the modern (2023) boundaries of MOJA as early as 1914, but fossils were rarely the focus of detailed study, and no comprehensive inventory was compiled. John Hazzard was the first geologist to devote significant attention to the study of paleontology within MOJA. Throughout the 1930s and 1940s, Hazzard and collaborators identified Paleozoic assemblages within the Kelso and Providence Mountains. Between the 1950s to 1980s, several dissertations and theses described the geology of various areas within MOJA, in which the authors provided limited paleontological descriptions and fossil locality information. Jack Mount conducted extensive paleontological research in the Cambrian sections of the Providence Mountains in the 1970s and 1980s, focusing on olenellid trilobites in the Latham Shale. As early as the 1960s, rockhounds collecting opalite and petrified wood discovered fossilized plant material and vertebrate bones in areas now in south-central MOJA and notified paleontologists at San Bernardino County Museum (SBCM). This resulted in one of the only paleontological excavations in what is now MOJA, with collections of Miocene vertebrate fauna including camelid and early rhino material. More recently, James Hagadorn reported the late-surviving Ediacaran organism Swartpuntia in an assemblage from the Wood Canyon Formation of the Kelso Mountains in 2000. From October 2021 to January 2022, a field inventory was conducted to determine the scope and distribution (both temporal and geospatial) of paleontological resources at MOJA. An additional week of field work was conducted in December 2022. A total of thirteen localities were documented and field-checked throughout the preserve. These localities resulted from field checks of previously reported fossil sites, as well as new discoveries based on literature searches and information provided by MOJA staff. The findings of this report constitute a baseline of paleontology resource data for MOJA, and reflect the current understanding of the scope, significance, and distribution of MOJA’s fossil record.
