Testo completoIn the years following the Cold War, East Asia has been characterized by a resurgence of maritime piracy. The situation transcends popular literary images: police reports replace the chronicles of Joseph Conrad; hoodlums and others marginalized by the Asian economic miracle take the place of the proud 19th Century Bugis heroes. Petty bandits and organized crime syndicates employ similar methods, from theft, and hijacking, to kidnapping. As a result, governmental authorities are challenged, and the pillars of the State undermined. Does this plague of crime pose a potentially fatal threat to the current powers in place? By challenging on the high seas the model of political organization inspired by the Treaties of Westphalia, and adopted by the governments of the region, what does piracy reveal about the status of the modern State in East Asia? On the surface, the State may appear to have lost ground and no longer have control over either its territorial waters, targeted by pirates, or the means of combating piracy, which since the early 80s are wielded by competing and often private actors. However, over the long term, piracy has offered States in East Asia an opportunity to reinforce their presence on the regional stage. States have managed to resist, and to take their revenge. Pressed from all sides, States have succeeded in equipping and organizing themselves to impose their authority at sea. Better yet, through regional cooperation, States have tapped new sources of legitimacy and effectiveness. At the conclusion of this Asian fable, which stages the pirate against the State, the more weakened of the two protagonists is perhaps not the one most would expect

Testo completoThe study concerns the investment policy of south-east asian countries based on the legal instruments upon which it is founded. These instruments consist of municipal laws, including fiscal incentives, laws governing bilateral, regional and multilateral economic relations. We endeavour to analyse their success considering if it was applicable to other third world countries. But we observed that an asian model was inexistent. Rather, we showed that each country implements a national policy which took only its own interests into account. Secondly, that with the exception of singapore, despite their protectionist policies, countries of the region attracted over 70 % of total investment flows to developing countries in 1995. Thirdly, that the first generation of newly industrialised countries (nic) which have become net exporters of capital to other third world countries are faced with the same problems which faced the developed countries in the 70s concerning protection and treatment of their investment abroad. Therefore, of great interest to asian countries, are current efforts at the oecd aimed at concluding a multilateral investment protection treaty open to all countries

Testo completoThis research was led on phanat nikhom refugee camp in thailand, where refugees from vietnam and cambodia followed french language classes and cultural orientation for 6 months before their ressettlement in france. We tried to analyse the foreign learning process when the refugees are not successful in learning, considering their resetlement project and psychological dynamics. We used a questionnaire for everybody at first (328 ex submitted to a multifactoral analysis), wehad interviews (90 for thematic and computerised text analysis). Our research is an ethnopsychological approach our hypotheses are that succesful learning is linked with : - grief elaboration, the people are able to speak and think about the past. - building an exile or resettlement project to free them from anxiety and doubts about the future. - to get into an acculturation process, to have relation with the foreign without the fear of deseapearing or be destroyed on a paranoid mode (fearof unknown). The results show how much the foreign language learning process is linked with psychological factors such as (depression, nostalgy or grief, post-traumatic troubles, projects,. . . ) we write some conclusions and suggestions about foreign language classes for refugee and their social psychological support

Testo completoUndoubtedly, regional arrangements play an essential role in the protection and promotion of human rights. Given the fact that there are many social, political, economic and historical similarities among people who live in a specific region, the creation of regional mechanisms for the protection of human rights should, in principle, be much easier than that of universal mechanisms. By the same token, regional mechanisms are more efficient than universal ones. The human rights systems established in Europe and America provide successful examples of regional systems. Asia, as the world's largest and most populous continent, is the only region which does not have a developed and well-established human rights mechanism. However, efforts have been recently made to create a human rights machinery within the framework of ASEAN. The present study attempts to present a comprehensive picture of legal situation for the regional protection of human rights in the Southeast Asia and, for this purpose, materials have been divided in two Parts. Part I analyse the existing human rights bodies and instruments in the Southeast Asia, and Part II tries to identify the reasons why a developed system has not yet come into existence in the region

Testo completoThis dissertation is a contribution to the description of Kmhmouʔ, a language with an oral tradition spoken in Laos. It presents the general characteristics of this language, which is among the less described languages of the region of Southeast Asia, as shown by the bibliography. Kmhmouʔ, an isolating language, does not exhibit any grammatical morphology. Words are mostly multi-categorial as regards parts of speech, and multi-functional: the verb-noun distinction is based essentially on combinatory properties of words. Nouns are basically all mass terms bearing a notional meaning, and they become countable and referential by means of determiners (classifiers, deictics, quantifiers and qualifiers); due to the lack of verb morphology, tense, aspect and mood can be either unmarked and identifiable by the context, marked by lexical means (adverbs or adverbial phrases), or marked by particles originating from various parts of speech (mostly verbs), and for the most part borrowed from contact languages.This grammatical description is based on spontaneous data collected during fieldwork in Kmhmouʔ villages and from the Lao national radio (Kmhmouʔ broadcast). The fieldwork was conducted in Kmhmouʔ, and the analysis and interpretation of the corpus benefited from the fact that the author is native speaker of Kmhmouʔ. A significant part of the corpus (1h30 in total) is provided in an appendix, fully glossed and translated into French and Lao.This thesis, besides making data and grammar of the Eastern Kmhmouʔ dialect available for the first time, opens up some new and challenging paths for the study of the typology of isolating languages and transcategoriality, as well as for studies of the role of language contact in grammaticalization

Testo completoAll the palaeoanthropologists agree that during the Pleistocene or Ice Age, the Sea was between 50 and 90m below today’s level, exposing a vast shelf of land (the Sunda Shelf) uniting Java, Sumatra and Borneo with the mainland. We may safely assume that our area was fully occupied by human species, at least 50. 000 years ago, all of whom were following a hunting and gathering way of life. By the end of the Pleistocene in about 8. 000 BC, sealevel became what it is today and the region took on its present appearance. The period of SE-Asian early kingdoms began in the IInd century AD. These are the Pyus, the Mons, Fu nan and Zhenla, Champa and the Vietnamese kingdom of Tonkin, as well as the kingdoms of Sumatra and Java. The next period sees the consolidation of important Indianised empires: Pagan, Angkor and Champa, as well as the rise of new States: Ayuttaya, Majapahit and Malacca. The abandonment of Angkor by Khmer Kings in the middle of the XVth century, the abandonment of Vijaya in 1471, mark the definitive retreat of 2 ancient Indianised kingdoms under the pressure to the South of the Thai and the Vietnamese. In Insular SE Asia, Islam triumphs in Java around 1520 and the Hindu culture takes refuge in the Island of Bali, Malacca, successor since the XVth century of the commercial power of Sumatranese kingdoms, falls in 1511 into the hands of the Portuguese. From XVIth century to the end of World War Two, all the SE Asian States except for Thailand, are colonized by the European Powers. All these kingdoms see their culture either declining or disappearing under the Western culture shock. The modern independent SE Asian States live an extremely rapid growth. One can chose between 2 extreme options, on one hand those where urban dynamics are strongly linked to the globalisation of the world economy and, on the other hand, those which are much more linked to political and economic functions specific of the State to which they belong. The isolationist option is the one adopted by the military junta in power in Myanmar. The global opening is the one adopted by a group of SE Asian States deliberately engaged in the liberal economic system. Large flows of foreign investments in industry, tourism, land and business development are largely focused on major metropolitan centers. All capital cities of this latter group tend to become mega-urban regions

Testo completoAquifer arsenic (As) contamination is occuring throughout deltaic areas of Southeast Asia, including the Mekong Delta, and affects the health of millions of people. As is highly sensitive to fluctuations of redox conditions which are generated by the alternating wet-dry cycles during the monsoonal seasons. A survey of geophysical and chemical characteristics of soil and groundwater in the An Phu district, located in the vicinity of the Mekong Delta in Vietnam, shows the occurrence high As aqueous concentration in this region. Chemical and geophysical data indicate a strong positive correlation between As concentrations in the anoxic groundwater and conductivity of soils. In addition, mechanisms of As release are shown to be associated with colloidal and iron (oxyhydr)oxides which undergo microbial mediated reductive dissolution under redox oscilatting conditions. The presence of sulfate microbial reduction potentially stabilizes As in the solid phase and diminish As in the aqueous phase through the adsorption/desorption of As onto iron (oxyhydr)oxides and/ or sulfides with formation of thiols complexes in solid phase. Because of the high pyrite content in sediment, pyrite oxidation may drop in pH values, leads to inhibition of sulfate reducing bacteria and reduces sequestration of dissolved As. Although the biogeochemical cycling of redox sensitive species such as As in dynamic systems is challenging, it has been possible to strengthen our collective understanding of such system

Testo completoThis thesis examines the role of the banquing system in the triggering of the Asian financial crisis in 1997-1998. We show that currency crisis and runs models are quite inadequate (but can be withdrawn) to explain that crisis because they don't take into account nether the banking crisis that precedes the exchange rate crisis in Asia nor an encompassing approach of the crisis. By tests, we conclude that banking problems help to predict the asian currency crisis. Thus, we propose models of runs triggered by foreign investors and a cross generation exhange rate crisis. .

Testo completoThere are three important themes in this thesis: first, the process of regional economic integration by means of trade integration, and second, the effect of the volatility exchange rates on macroeconomic fundamentals, and finally the determinants of real effective exchange rates (REER) volatility. Our empirical results show: first, the indices of complementary commercial goods of the four ASEAN countries are very high and indicate a very good prospect of trade agreement. However, the value of the trade intensity index (CII) according to the Standard International Trade Classification (SITC), during the period from 1995 to 2008, shows that these indices are in the category of [0. 00-24. 99] or class of low integration. The high complementarities of trade in commercial goods among the four ASEAN countries shows that the program objective of reducing the Common Effective Preferential Tariff (CEPT), both in the normal track and the fast track, which is lower tariffs commercial products among the countries of ASEAN in 2010, was achieved. However, the low trade integration of the four ASEAN countries shows that the decline in tariffs is not enough to ensure the success of the ASEAN Free Trade Area (AFTA). Second, in Indonesia, our empirical results show that the macroeconomic vulnerability lies in the relationship between the volatility of the exchange rate of the rupiah and the inflation level. While in Malaysia, macroeconomic vulnerability lies in: (i) the relationship between the volatility of the ringgit exchange rate and trade balance; (ii) between the volatility of the exchange rate of the ringgit and foreign direct investment (FDI); and (iii) between the volatility of ringgit exchange rate and GDP. These relationships are always negative and significant. In contrast, in Thailand and in the Philippines, we found an opposite result to the Malaysian result. Third, the positive and significance relationship between the REER volatility of the rupiah and the financial and capital account shows that whenever there is an increase in capital inflows to Indonesia, then the REER is more volatile. In the case of Malaysia, the relationship between the REER volatility of ringgit and its determinant are significant and negative. In the case of Thailand, there is a negative and significance relationship between the REER volatility of the baht and the current account, between the REER volatility of the baht and the financial and capital account, and between REER volatility of the baht and the interest rate on the currency market. However, there is a positive and significance relationship between the REER volatility of the baht and the passage of managed floating exchange rate regimes to the floating exchange rate regimes. Testo completoIn this research task, we present a certain number of empirical results concerning the articulation between the development of the financial markets and the growth rate of the economies of the emergent countries of Southeast Asia. We defend the thesis according to which the existence of a money market in an emergent country can be regarded as a source of economic growth. We show that the financial markets, because their strong growth rate and their high output rate can support the economic growth by ensuring a better adequacy of investment savings, as well as by identifying and diversifying the risk of liquidity. This is not only for the benefit of national and international investors, but all the economy. We underline, that the opening of the financial markets to foreign investment constitutes, for the emergent countries, a great opportunity. The economies of these emerging countries need enormously these flows of capital. However, the size as well as the nature of these flows of capital and the speed to penetrate the economic systems can cause certain problems at the level of macroeconomic management and can have destabilizing effects. The Asian financial crisis points out in a particularly, spectacularly way, that the countries which open their financial markets to foreign capital become, in the case of reversal of the investor's confidence, vulnerable to massive exits of capital; what is likely to involve a strong depreciation of their currency, a destabilization of their financial system and a serious degradation of their economic results. Although the financial crises are inevitable, it is, however, possible to reduce the frequency and gravity of it. Consequently, the prevention of the crises is a priority

Testo completoDental microwear study has been applied in palaeoanthropology, archaeozoology, primatology etc. For the reconstruction of ancient diet and environmental adaptation for more about 30 years. The classical method uses the SEM to record the teeth surfaces’ images and analyze them in different ways. New 3D technology has been adopted recently to record teeth surface in microroughness parameters. The buccal surfaces of 69 molars of south-eastern Asian hominids have been analyzed in this study. Only a few of them conserved the occlusale surface. Our objectives include: (1) to observe the inter-group variations of the samples; (2) to infer the relation of the dental microwear and the type of subsistence; (3) to standardize the research protocol of the application of 3D microroughness technology. We have applied the classical method and the 3D technology. A new protocol and the S series amplitude parameters of microroughness analysis adopted in current study are firstly applied in dental microwear study. The results show a high accordance between two methods. The grouping according to the environmental difference but not taxonomic difference is significative in the Javanese Homo erectus and Homo sapiens samples. The abrasiveness of the diet between groups is also distinct

Testo completoJudicial review is aimed at ensuring the supremacy of the Constitution on legal norms by means of a jurisdiction-type procedure. The process of introducing one of its patterns into an environment that is different from the one where it was born gives rise to two meanings. Firstly its being adopted, secondly its being adapted. The first meaning referred to primarily stems from various reasons and then it takes on the most diverse forms – and nevertheless are they true to the original, namely the European or Kelsenian pattern. That reveals the different rules which have been transposed, should they be organic and functional, or substantive and procedural ones. If the process of adopting one of those paradigms is seen as an important phenomenon, how crucial appears its adaptation because the effective activity of the implanted model only will hold a mirror up to a characteristic adjusting within an environment distinct from the original: constitutional litigation will convey the second meaning above-mentioned. Basically, bringing in such a formula elsewhere occasionally clashes with cultural and historical particularities

Testo completoThe aim of this work was the study of the impact of the South-East Asian monsoon on the South China Sea (SCS) sedimentary record along the last 2 Ma. The terrigenous fraction of 3 ODP Sites (Leg 184 - Sites 1144, 1145 and 1146) located in the northern part of the SCS, was investigated in terms of sedimentology, mineralogy and geochemistry. X-ray diffraction (XRD) associated with isotopic geochemistry (Rb/Sr and Sm/Nd) allows us to identify the sources of the sediment. The fine fraction (<2[mu]m) comes mainly from the Pearl River with, however, some important inputs (3 to 15% of the <2[mu]m fraction) of smectite from the Luzon volcanic arc when the summer monsoon strengthens (23ka cycles). The grain-size analyses allows us to characterize the sedimentary dynamic by identifying 3 granulometric populations, varying separately along the record et showing grain-size increases during the glacial stages. These variations are attributed to the shelf reworking during the sea level variations. These results are in contradictions with the previous hypothesis, which linked the grain-size increases to eolian inputs associated with enhanced winter monsoon winds. During the last 2 Ma, the summer monsoon intensity shows 3 major periods of variations : 2-1,2 Ma : low amplitude oscillations linked with the high latitude insolation (41ka). 1,2-0,9 Ma : intensification associated with the decrease of the global oceanic circulation strength and the closing of the indonesian thresholds. 0,9-0 Ma : gradual decrease linked with the global cooling of the climate

Testo completoHistorical biogeography is the science that deals with relationships between biogeographic areas, understood as set of taxa distributions. The complex geological history of South East Asia and the Indo‐West Pacific region makes it a very interesting area for biogeography studies. We propose a new approach, cladistic, for the study of this area around the famous “Wallace’s line”, placing our study in the paradigm of vicariance where speciation appears following the implementation of a geographic barrier (as opposed to the dispersal model from a center of origin, classically admitted). Indeed, here we use the existing analogy between Systematics and Biogeography to apply cladistics methods for Systematics to Biogeography. This is to answer the question : "Why is there such distributions of taxa in this region of the world ?” The expected results are a better understanding of the evolutionary history of the region and the life history traits of taxa that inhabit it. Provided that the joint distribution of several unrelated taxa cannot be obtained by "chance", thus it is necessarily due to a common event (ie a vicariant event) which affected equally these taxa. The cladistics approach we propose has been made possible by the completion of a software that implements the so‐called 3‐element analysis (3ia) method : LisBeth is now freely available for download from our website and offers new perspectives of analysis to its users, whether systematicians and biogeographers. We show that the representation of characters offered by LisBeth allows new inferences about the existing relationship between areas of endemism studied. We have highlighted the emergence of a general "pattern" from a joint analysis of 35 unrelated taxa (plants and animals). In a second step we are interested in a major theoretical problem of contemporary biogeography : "What about the time dimension in historical biogeography?". How to account unambiguously different time scales during diachronic analyzes ? We propose a model based on the 3ia which allows us to consider the temporal dimension and realize, therefore, true analysis of integrative biogeography

Testo completoThe countries located in Southeast Asia have, very soon, during the postcolonial period, foreseen to regroup to forming a regional organization named “ASEAN” (Association of nations of Southeast Asia). We would like to address the concept of economic regional integration from a legal perspective based on the example of ASEAN. This will in particular lead us to distinguish such a concept with other terms similar or very closed, such as regionalism, regionalization and economic cooperation. What are the features of regional integration? What are its manifestations? Despite all the diversity of regional organizations the purpose of which is to build an economic integration within a specific region, what are the common features that a lawyer can observe? How to reveal the ASEAN regional organization through the economic integration process it has launched and strategies chosen by it? What are its peculiarities? What are the challenges it has to face to achieve its integration goals through the following three dimensions: the ASEAN Economic Community, the ASEAN Political &Security Community, and the ASEAN Socio-Cultural Community? What external support can ASEAN receive to strengthen its regional integration process? Southeast Asian countries look for a closer proximity between themselves on the basis of intergovernmentality and with the deep concern of recognition and protection of their sovereignty that lead to favor Soft law more than hard law in decision-making production. Our approach will be well differentiated from those adopted so far by the economists and political scientists or experts in international relations and will not be reductive to a Eurocentric viewpoint. The main features and the internal dimension of the ASEAN will be addressed in a first part, while the second part will be devoted to the external dynamic of the economic integration of the ASEAN based on a selective choice of partnerships (EU, free trade agreements, Asian Development Bank, APEC)

Testo completoThe genetic diversity of a population carries with it traces of cultural practices and is a testimony of certain past events. Thus, language, which can be a cultural barrier to reproduction, and the kinship system, which will determine when, where and with whom individuals reproduce, will influence genetic diversity. The aim of this PhD thesis is to try to retrace the demographic histories of populations of South and Southeast Asia, at several cultural scales, from the Austroasiatic language family to descent groups using the genetic data. Firstly, we studied in the Austroasiatic language family. Languages belonging to the same linguistic family come from the same "mother" language and we wanted to know whether, in addition to this linguistic kinship, the speakers of these languages shared a genetic kinship. We have studied the autosomal genetic diversity of Austroasiatic speaking populations and compared them to neighboring populations belonging to other linguistic families. We could not highlight any particular genetic kinship between populations speaking Austroasiatic languages. These results exclude the hypothesis of a common origin of populations speaking Austroasiatic languages and favor the hypothesis of a cultural diffusion of Austroasiatic languages. Then, we investigated genetic kinship in descent groups in eight Southeast Asian populations. Individuals belonging to the same descent group claim to descend from a common paternal ancestor, in patrilineal populations, or from a common maternal ancestor, in matrilineal populations. We wanted to know if the common ancestor of these populations is mythical or biological. We investigated the genetic diversities of the Y chromosome and mitochondrial DNA of eight populations in Southeast Asia: four matrilineal populations and four patrilineal populations. Our data showed that individuals belonging to the same matrilineal clan are closely genetically related to their maternal line, visible in their mitochondrial DNA. Conversely, individuals belonging to the same patrilineal clan are no more genetically related to each other than two individuals randomly selected from the population in their paternal line, visible on the Y chromosome. These results reflect different realities between the patrilineal and matrilineal populations of Southeast Asia with a real common ancestor in matrilineal populations and a mythical common ancestor in the patrilineal clans. Together, these results showed how different cultural processes have left genetic signatures on uniparental and autosomal genetic diversities and illustrated how the population geneticist can use these genetic diversities to trace the populations' demographic history

Testo completoThe birth of human rights regionalism in Asia is not a myth. Although Asia distinguished itself with the absence of a formal regional mechanism for the protection of human rights, its relevance shall not to be questioned. Evolving within various challenging contexts, most Asian States formally recognise fundamental human rights while tolerating domestic and international enforcement mechanisms. Thus, a preference is given to constitutions and their courts, NHRIs and UPR against most intrusive mechanisms such as the UN committees. Nevertheless, elements of a human rights regionalism are rising upon Asia’s economic associations increasing interest in human rights – such as the ASEAN – and the civil society broadening interest for transnational movements. A comparative analysis into the Asian States relationships with these mechanisms will reveal worrying signs of massive human rights violations. However, acknowledging the continuous recognition of human rights as well as the growing experience of the ASEAN Intergovernmental commission, it is believed the enactment of an Asian human rights court is now only a matter of time

Testo completoL'objectif des travaux présentés dans ce mémoire est, par une approche sédimentologique, de reconstituer les conditions environnementales, tant sur les continents que sur les plates-formes, ayant conduit aux dépôts étudiés. Sur cette base, nous avons entrepris des études sur des dépôts du Pléistocène en mer du Nord ainsi que dans les mers de Chine de l'Est et du Sud. Cette époque, par sa proximité, permet des études à très haute résolution temporelle tandis qu'elle est caractérisée par des oscillations climatiques et eustatiques importantes et rapides. De plus, les dépôts les plus récents portent la trace de l'Homme.
Sur la plate-forme, l'étude des grands corps sableux, bancs et très grandes dunes, a permis de préciser les mécanismes de leur mise en place. A court terme, même dans les environnements dominés par la marée, l'importance de phénomènes sporadiques tels que les houles de tempêtes, a été démontrée. Ils impriment aux formes et à la structure des fonds marins leur marque tandis que les agents tidaux sont les pourvoyeurs du matériel sédimentaire. A plus long terme, ce ne sont plus les agents dynamiques qui conditionnent la préservation des corps sédimentaires mais la création d'espace disponible et l'importance des apports sédimentaires. Au niveau de l'estuaire de l'Authie, des séries de carottages nous ont aidé à mesurer les conséquences du mouvement vers le nord des divers ensembles sédimentaires sur le type de sédiment rencontré ainsi que sur les modifications d'un espace naturel convoité par l'Homme.
Dans les bassins profonds, en mer de Chine du Sud, nos études ont permis de préciser les sources du matériel sédimentaire et son transport en faisant la part des contributions éolienne, fluviatile et marine. L'étude des caractères sédimentologiques de la fraction détritique a permis également d'étudier la balance ntre l'érosion et l'altération sur les zones émergées ainsi que de voir quelle est la réponse des marqueurs détritiques aux changements climatiques globaux depuis 2 millions d'années.
