From December 2003, for the first time, people looking for work and those in jobs or training will have a right to complain about discriminatory behaviour based on their sexual orientation and religion or religious belief. Similar protection against discrimination based on age should also some into force in 2006. It seems clear that these regulations represent a significant step forward in addressing unfair discrimination in the UK and in achieving a certain level of uniformity and coherence across discrimination legislation.

Purpose The purpose of this paper is to summarize the limited body of research that focuses on the efficacy of sexual orientation anti-discrimination legislation in reducing discrimination. Design/methodology/approach Reviews past research that documents overt and subtle forms of workplace discrimination against gay, lesbian, and bisexual individuals and describes how legislation plays an important role in changing social norms and underlying attitudes. Findings Empirically demonstrates that legislation effectively can reduce discrimination. Originality/value Informs legislative debate and promotes the expansion and adoption of national, state, and local legislation on sexual orientation anti-discrimination legislation.

Purpose The purpose of this paper is to examine employment discrimination in the English-speaking Caribbean by analysing evidence from jurisdictions where anti-discrimination legislation has been enacted (namely Guyana, St Lucia and Trinidad and Tobago (T&T)). Design/methodology/approach This paper reviews existing anti-discrimination legislation in the three named countries, along with available court and tribunal decisions, with a view of determining whether the protections reasonably cover all minority groups. Findings It has been shown that, despite the existence of anti-discrimination law in T&T, St Lucia and Guyana, discrimination is still reported. T&T is the only jurisdiction with a functioning Equality Opportunity Commission and Tribunal, and where a wide range of cases has been adjudicated, relative to St Lucia and Guyana. Research limitations/implications Legislators and policy makers may wish to consider the findings of this research in making legislative amendments or enacting new laws, with a view to broadening the range of protections. Organisational practitioners may use the findings to assist them with interpreting the law (and their responsibilities to protected groups) and its intended impact on HR practice and, where necessary, make changes where current practices are incongruent with the legislation. Practical implications Legislators and policy makers may consider the findings of this research in making legislative amendments, with a view to broadening the range of protections. Organisational practitioners may use the findings to assist them with interpreting and implementing the law. Originality/value This paper reviews current Caribbean anti-discrimination legislation and cases, which to date has not been done. It highlights the omission of sexual orientation from legislation enacted across the region. There is currently a paucity of research on employment discrimination within Caribbean territories and specifically as it relates to the effect of applicable legislation. Consequently, this paper establishes a benchmark for future researchers and it informs organisational and societal stakeholders as to what may constitute prohibited practices.

Anti-discrimination law in Australia is at a crossroads. After four decades of proliferation of legislation to regulate discrimination, national attention has turned from increasing regulation to legislative consolidation and reform. This article contributes a theoretical analysis to the reform debate. Two liberal theoretical justifications for prohibiting discrimination, harm and redistributive justice, are considered. This investigation assists to determine when the state should intervene in order to restrict discrimination, and whether state and territory anti-discrimination regimes have a legitimate continuing role in Australia's legislative landscape.

Despite the fact that in national legislation there is a direct, general ban on the use in advertising of statements and/or images that are discriminatory, as well as directly making claims of a discriminatory nature on the basis of race, skin color, gender, age, state of health, sexual orientation, etc. in advertisements about available vacancies, the latter (discriminatory job advertisements) will continue to be an "integral attribute" of the employment process. It is worth noting that discrimination against employees/candidates in job advertisements is widespread not only in Ukraine. Every country to a certain degree or another faces this type of discrimination, and as a result, the requirements are set at the legislative level for job advertisements, namely: their content, place of publication; cases are prescribed in detail, when advantages are still allowed for one or another reason; liability of employers for violations of legislation. The article provides a concise retrospective analysis of national legislative requirements regarding the prohibition of discrimination in the advertising of employment services; the provisions of the regulatory acts establishing the procedure for prosecuting advertisers for violations of anti-discrimination norms were analyzed. It was concluded that, in general, the changes made to the current legislation in the field of advertisers' responsibility deserve a positive assessment, but the question of the effectiveness of fines in the real fight against discrimination in practice remains open. A study of the existing legal requirements for job advertisements and liability for their violation in such countries as the USA, Australia, France, Germany, Great Britain was carried out. The comparative legal analysis of national and foreign legislation made it possible to conclude that: 1) the list of signs for which discrimination in job advertisements is prohibited is almost similar; 2) foreign legislation, generally, defines in sufficient detail the possibility of deviating from anti-discrimination requirements, in contrast to national legislation; 3) in foreign practice, there are also requirements regarding the place of publication, placement of advertisements, failure to comply with which may indicate hidden or indirect discrimination, but in Ukraine, as of today, there are no such requirements; 4) responsibility, as in Ukraine, in most cases comes in the form of fines, although warnings are also possible.

This thesis seeks to examine if there is a connection between female representation among U.S. legislators at state level and support of legislation protecting LGBT+ people from discrimination in terms of adoption and foster care. Using the theories of substantive and descriptive representation, three hypotheses regarding female representation and partisanship were tested. In the analysis, it became clear that there is a positive significant correlation between female legislators and voting in favour of anti-discrimination legislation in terms of LGBT+ rights. In addition to this, the study found that partisanship also has a significant effect of the voting outcome, in fact one that is even greater than the effect of gender.

Government figures put the current indigenous unemployment rate at around 23%, 3 times the unemployment rate for other Australians. This thesis aims to assess whether Australian indirect discrimination legislation can provide a remedy for one of the causes of indigenous unemployment - the systemic discrimination which can result from the mere operation of established procedures of recruitment and hiring. The impact of those practices on indigenous people is examined in the context of an analysis of anti-discrimination legislation and cases from all Australian jurisdictions from the time of the passing of the Racial Discrimination Act by the Commonwealth in 1975 to the present. The thesis finds a number of reasons why the legislation fails to provide equality of opportunity for indigenous people seeking to enter the workforce. In nearly all jurisdictions it is obscurely drafted, used mainly by educated middle class white women, and provides remedies which tend to be compensatory damages rather than change to recruitment policy. White dominance of the legal process has produced legislative and judicial definitions of "race" and "Aboriginality" which focus on biology rather than cultural difference. In the commissions and tribunals complaints of racial discrimination are often rejected on the grounds of being "vexatious" or "frivolous", not reaching the required standard of proof, or not showing a causal connection between race and the conduct complained of. In all jurisdictions the cornerstone of liability is whether a particular employment term, condition or practice is reasonable. The thesis evaluates the approaches taken by appellate courts, including the High Court, and concludes that there is a trend towards an interpretation of reasonableness which favours employer arguments such as economic rationalism, the maintenance of good industrial relations, managerial prerogative to hire and fire, and the protection of majority rights. The thesis recommends that separate, clearly drafted legislation should be passed to address indigenous disadvantage and that indigenous people should be involved in all stages of the process.

2000-talet markerade födelsen av en ny sorts terrorism. Sedan dess har Europa fått utstå frekventa terrorattacker vilket resulterat i att länder antagit strängare lagar och kontrollåtgärder för att bekämpa terrorismen. Mot bakgrund av detta är uppsatsens syfte att försöka svara på om strängare anti-terrorlagstiftning i Frankrike och Storbritannien kan medföra omfattande begränsningar i människors grundläggande fri-och rättigheter. Genom att använda sig utav en rättsdogmatisk metod och en komparativ metod har uppsatsen kritiskt granskat internationella konventioner, lagstiftningar, rättsfall, vetenskapliga artiklar och doktrin i syfte att besvara följande frågeställningar; vad krävs för att länder ska kunna deklarera allmänt nödläge och således ha en lagstadgad rättighet att derogera från eller begränsa vissa mänskliga rättigheter? Vilka rättsliga åtgärder gällande preventiv häktning och andra kontrollåtgärder har Frankrike och Storbritannien tagit i syfte att bekämpa terrorism och riskerar dess inskränkningar att kränka artikel 5 EKMR? Hur regleras rätten till icke-diskriminering i artikel 14 EKMR?  Uppsatsen har också försökt att svara på om de eventuella begränsningarna av människors rättigheter kan försvaras genom John Finnis rättsteori och tankar om mänskliga rättigheter.                             Den första slutsatsen som nås i uppsatsen är att terrorism kan utgöra ett accepterat allmänt nödläge enligt artikel 15 EKMR då det uppfyller artikelns rekvisit. Därmed är både Frankrikes och Storbritanniens deklarerande av allmänt nödläge accepterat och lagligt enligt artikel 15 EKMR. Uppsatsens andra slutsats slår fast att Frankrikes och Storbritanniens lagstiftningar gällande preventiv häktning kan utgöra en möjlig kränkning av artikel 5 EKMR då lagstiftningarna saknar kravet på förutsägbarhet. Studien har också påvisat att lagstiftningarna gällande preventiva häktningar riskerar att användas för generella misstankar om terrorism vilket också kan utgöra en möjlig kränkning av artikel 5 EKMR. Uppsatsen sista slutsats är att dessa lagstiftningar riskerar att diskriminera vissa samhällsgrupper om de tillämpas på ett felaktigt sätt, t.ex. endast mot icke-medborgare.
The 21st century marked the birth of a new kind of terrorism. Since then, Europe has suffered frequent terrorist attacks, resulting in countries adopting stricter laws and control measures to combat terrorism. The aim of this thesis is therefore to investigate if stricter anti-terrorist legislation in France and Great Britain can lead to unlawful limitations on human rights. The thesis critically examines international conventions, legislation, case law, articles, and doctrine by using an investigative approach and a comparative method to answer the following questions; what is required for countries to declare a state of emergency and thus have a statutory right to derogate from or limit certain human rights? What legal measures regarding preventive detention and other control measures have France and Great Britain adopted to combat terrorism and does the limitations violate Article 5 of the ECHR? How is the right to non-discrimination regulated in Article 14 of the ECHR? The thesis also aims to clarify if any limitations of human rights can be justified by the legal theories of John Finnis.                                                                                                                               In conclusion, the thesis reveals that terrorism can constitute a state of emergency according to Article 15 of the ECHR.  Thus, both France and Great Britain's declarations of states of emergency are accepted and legal in accordance with Article 15 of the ECHR. Furthermore, the thesis states that the legislation in France and Great Britain, which regulate preventive detention, may constitute a possible violation of article 5 ECHR, due to its lack of predictability. The thesis has also shown that the legislation regarding preventive detention may constitute a violation of article 5 ECHR if its applied wrongfully and thus, may also constitute a violation of article 14 ECHR.

Notre dissertation investigue les actions individuelles et légales de contestation des discriminations raciales ou ethniques par ses victimes, objet rarement étudié en psychologie sociale. Alors que les actions collectives s’inscrivent dans un cadre des relations intergroupes, nos études montrent que les actions individuelles restent plutôt dans le cadre de relations perçues endogroupales par les acteurs qui contestent les discriminations. Les implications en termes d’identité sociale dans ce type d’action sont différentes et nous postulons qu’une catégorisation à un niveau supra-ordonné (ex. comme membre de la société hôte ou être humain) facilite l’entreprise des actions individuelles de contestation des discriminations par la voie légale. L’égalitarisme qui rend saillant ce niveau de catégorisation supra-ordonné, et en tant que croyance qui délégitime le statut désavantagé des individus stigmatisés, faciliterait la remise en question du statu quo en augmentant la perception de la discrimination ainsi que la tendance à s’engager dans des actions de lutte contre les discriminations par la voie légale. De plus, motivés par des démarches qui rentabilisent le rapport coûts-bénéfices, les individus portés par l’égalitarisme et qui perçoivent la discrimination s’engageraient plus facilement dans des actions de contestation lorsqu’ils pensent qu’ils peuvent le faire au bénéfice de la collectivité plutôt que dans leur propre intérêt uniquement. D’autre part, l’entreprise d’actions contre les discriminations par la voie légale nécessite une connaissance relative de ces lois qui fonctionnent comme des normes injonctives indiquant aux individus ce qui est admis ou non en société (ex. caractère interdit de la discrimination). Une source experte (ex. organisme de lutte contre le racisme) qui véhicule ce type de normes injonctives anti-racistes serait particulièrement influente dans l’entreprise d’actions légales pour lutter contre les discriminations.

Abstract (sommario):
This study analyzes narratives of individual Jewish experiences of discrimination and genocidal violence in Hungary during the period of 1920–1945. The aim is to increase our knowledge and understanding of the events through an investigation of survivor testimonies concerning anti-Jewish laws and the Holocaust. The main focus is on how survivors perceived the treatment to which they and their fellow Jews were exposed, and how they responded to the persecution they faced. Perceptions and responses are analyzed through multiple factors such as gender, age, social class, and geographical place. The period under investigation stretches from 1920, when the law of Numerus Clausus (a quota system influencing admission to universities) was introduced, until the end of the Second World War in early 1945. Focus is placed on the war years, especially on 1944, the year of German occupation and the fascist Arrow Cross rule. Experiences from the labour service system, the Jewish houses in Budapest, and the ghettos, as well as of hiding and resistance, are some of the recurring themes which are examined here. Extensive interviews, along with eyewitness reports and memoirs, form the empirical basis of the study. The results demonstrate the complexity of individual experiences during times of upheaval, and the importance of the above factors is evident within the testimonies. The survivors’ experiences greatly depended on gender, age, social class, geographical place, civil status, religious orientation, as well as “race”. However, the importance of the different factors changed over time. For instance, in the beginning of this period, discrimination had a direct impact on adult males, while children, women, and the elderly were indirectly affected. Furthermore, persons belonging to the upper classes could circumvent the anti-Jewish laws in various ways. Ultimately, differences in treatment decreased, according to the testimonies. Women, children, and the elderly also became victims, as did individuals from all social classes.

Об’єктом дослідження даної кваліфікаційної роботи є правові засади забезпечення захисту прав і свобод жінок в умовах гендерної нерівності в сучасному українському суспільстві. Предметом дослідження є розбіжність між статусними позиціями жінок та чоловіків в економічній, політичній, культурній сферах життєдіяльності суспільства, а також між соціальним потенціалом жінок та їх соціальним статусом як прояв гендерної нерівності. Захист прав людини та домовленості, які укладаються для захисту цих прав, найбільшою мірою залежать від розробок та механізмів на національному рівні. Закони, процедури і механізми, які існують на національному рівні, є ключовими для здійснення прав людини в кожній країні. Тому дуже важливо зробити права людини компонентом національних конституційних і правових систем, навчити чиновників органів юстиції застосуванню стандартів в області прав людини, а також забезпечити накладання санкцій за порушення прав людини. Права людини – комплекс природних і непорушних свобод, юридичних можливостей, обумовлених фактом існування людини в суспільстві. В основі концепції прав людини лежать дві основні цінності. Перша - це людська гідність, а друга - рівність. Права людини можна розуміти як щось, що визначає базові норми, необхідні для того, щоб жити з цим почуттям гідності, і їх універсальність випливає з того, що принаймні в цьому, всі люди рівні. Рівноправність є найважливішою основою будь-якого демократичного суспільства, що прагне до соціальної справедливості і поваги прав людини. Права і свободи жінок займають особливе місце у контексті прав людини. Практично у всіх суспільствах і сферах діяльності вони піддаються дискримінації як з юридичної, так і з практичної точки зору. Наразі можна спостерігати стрімке зростання ролі жінок у різноманітних сферах суспільного життя. Безперечно, ця проблема набуває особливої актуальності у зв’язку з численними порушеннями прав жінок, зокрема, недостатній захист від насильства, недотримання права на участь у здійсненні міжнародної і внутрішньо-державної політики, а також нерівність між чоловіками й жінками у сфері праці. Мета кваліфікаційної роботи полягає в науковому обґрунтуванні та опрацюванні теоретичних засад соціологічного аналізу гендерної нерівності; у з'ясуванні основних характеристик та тенденцій закріплення гендерної нерівності щодо жінок в різних сферах життєдіяльності сучасного українського суспільства.

The object of the study of this qualification is the legal basis for the protection of women's rights and freedoms in the face of gender inequality in modern Ukrainian society. The subject of the study is the discrepancy between the status positions of women and men in the economic, political, cultural spheres of society, as well as between the social potential of women and their social status as a manifestation of gender inequality. The protection of human rights and the arrangements made to safeguard these rights depend to a large extent on developments and mechanisms at national level. Laws, procedures and mechanisms in place at the national level are key to the implementation of human rights in every country. It is therefore very important to make human rights a component of national constitutional and legal systems, to educate justice officials on the application of human rights standards, and to ensure that sanctions are imposed for human rights violations. Human rights - a complex of natural and inviolable freedoms, legal possibilities, conditioned by the fact of human existence in society. The concept of human rights is based on two fundamental values. The first is human dignity and the second is equality. Human rights can be understood as defining the basic norms necessary to live with this sense of dignity, and their universality stems from the fact that at least all people are equal. Equality is an essential foundation of any democratic society that strives for social justice and respect for human rights. Women's rights and freedoms play a special role in the context of human rights. In virtually all societies and sectors, they are discriminated against both legally and practically. At present, there is a rapid increase in the role of women in various spheres of public life. Undoubtedly, this problem is of particular relevance in connection with the numerous violations of women's rights, in particular, the lack of protection against violence, the failure to respect the right to participate in international and domestic policies, and the inequality between men and women in the workplace. The purpose of the qualification work is to provide scientific substantiation and elaboration of theoretical foundations of sociological analysis of gender inequality; in finding out the main characteristics and tendencies of consolidating gender inequality against women in different spheres of life of modern Ukrainian society.

Racial and gender inequality, as well as other forms of discrimination has been a part of the South African, American and Indian histories for a very long time. Even today racial disparity is still very evident in the South African and American societies whilst discrimination based on caste is still prevalent in the Indian society. This is illustrated by continued racial discrimination and the remaining signs of societal segregation. Due to continuing disparities amongst the people, it became necessary to implement affirmative action programmes. Focusing in particular on education and jobs, affirmative action policies require active measures to be taken to ensure that blacks and other minorities enjoy the same opportunities for career advancement and school admissions that had been the nearly exclusive province of whites in SA and the USA, or for the forward castes in India. Affirmative action has been both praised and denounced, as an answer to racial inequality. One of the key issues that arise when affirmative action is discussed is whether or not affirmative action in fact promotes equality and atones for past prejudices. Another concern is whether the current affirmative action policy is the right policy to use. The issues surrounding affirmative action seems to be universal as are the circumstances. Perhaps the most widespread similarity among the programmes in these very different countries has been that group preferences and quotas are almost always discussed. The debate on affirmative action exists because it is a very divisive issue and it affects different groups of people in different ways, and some groups or persons seemingly benefit more from affirmative action than other persons or groups. In addition, it causes people to be classified into groups, and at the same time, strives to break down group barriers. It is an issue that is difficult to resolve because people have varied ideas about how the problems of racial inequality and historical discrimination should be addressed

"This research enters into the field of philosophy of law. He investigated it about the positive differentiation of women in legal thought. After defining the assumptions of the concept, such as the necessity to distinguish between formal equality, and real equality, because positive differentiation is a privilege given to the disadvantaged as if it appears to create inequality, and it is formed until it compensates them with the forbidden, which was practiced before and is now practiced. And that positive differentiation is not only concerned with women but also with all other disadvantaged groups, such as minorities, children and the elderly, even if the female component is more visible. So it entered into the global legislative policy, whether in international law or in national law, so would hold international agreements, hold conferences and establish international organizations for that. Positive differentiation is considered a subsidiary legal principle and complementary to the principle of equality and fairness, and for this existence is related to the existence of that principle, and it is known that the principle are not often written in legislation, but the legislator must take them into account when setting legal rules. Positive the positive differentiation as a legal principle that is observed in global legislation, and the legislator in the Kurdistan region of Iraq tried to observe the principle at a time when the federal legislator did not pay much attention to the principle, and this legislative policy in the region is more in line with the global legislative policy, and this is why the Kurdistan legislator tried to repeal or amend federal law Or legislate new laws in implementation of the principle that fall within its powers, so the anti-family violence law is a perfect example of this, which has no parallel in Iraq so far."
