This chapter begins by distinguishing between tribunals and inquiries. A tribunal is a permanent body that sits periodically, while an inquiry is something which is established on an ad hoc basis. Tribunals are empowered to make decisions that are binding on those parties subject to their jurisdiction; inquiries generally do not have formal decision-making powers. Tribunals are concerned with matters of fact and law, whereas inquiries are concerned with wider policy issues. The discussion then turns to the reform of the tribunal system, the former Administrative Justice and Tribunals Council, the origins of ombudsmen, the Parliamentary Commissioner, ombudsmen of devolved institutions, the Health Service Commissioner, the Local Government Commissioners, ombudsmen and the courts, proposals for a unified Public Service Ombudsman service, and the European Ombudsman.

This case-note discusses the pertinent aspects of the Swiss Federal Tribunal’s decision in the Nada case, where the Tribunal was invited to review sanctions imposed by the United Nations Security Council against Youssef Nada. In a decision closely mirroring the approach of the General Court of the European Union (back then still called the Court of First Instance) in the first Kadi case, the Tribunal accepted to review Security Council sanctions only against the high threshold of jus cogens, and confirmed the legality of the sanctions, leading Nada to bring a case against Switzerland before the European Court of Human Rights.

This chapter explains how the Andean Tribunal of Justice (ATJ) became both active and effective with respect to intellectual property (IP) disputes, and why IP remains an island of effective adjudication that has not expanded to other areas of Andean law. It describes the ATJ's interactions with the domestic administrative agencies responsible for IP and explores how the ATJ's rulings shaped agency decisions and procedures to bolster adherence to the rule of law. The chapter also documents how the relationship between Andean judges and agency officials enabled the ATJ to confront national governments under pressure from the United States and multinational drug companies to violate Andean law. It demonstrates that Andean IP rules differ from those elsewhere in Latin America. Finally, this chapter explains how the legal and institutional contexts within which Andean IP rules are embedded help to bolster the island's stability and protect it from significant meddling by governments.

This chapter examines the relationship between the judiciary and the legislature in Ethiopia. The country has adopted a parliamentary system of government, but by contemporary standards, it has some unusual features. Its governments have historically blended judicial and executive functions, leaving the position of the judiciary somewhat unclear, and the Supreme Court has not tended to assert its power. There are signs of the use of legislative overrides to reverse individual decisions, and of ouster clauses to transfer jurisdiction on various issues from the courts to administrative tribunals within the executive. Although lower courts have attempted to review decisions of these tribunals, the Supreme Court has overruled them on the basis that it lacks jurisdiction. The highest ranks of the judiciary therefore seem to be accepting of a vision of the separation of powers in which other branches define the judicial role.

In investor–state arbitrations, which are concerned with the resolution of disputes between foreign investors and states parties over the state’s exercise of its public authority in relation to legislative, administrative, or judicial measures, the parties often invoke attorney–client privilege as a defence to document production requests. This chapter therefore examines how arbitral tribunals have determined the applicable attorney–client privilege standard in investor–state arbitration. It reports on several procedural orders and decisions issued by arbitral tribunals constituted under the North American Free Trade Agreement and other bilateral or multilateral treaties. As in these proceedings attorney–client privilege claims often arise together with Cabinet privilege claims, the tribunals’ findings on the applicable Cabinet privilege standard are presented as well. Lastly, the chapter explores whether the solution proposed for international commercial arbitration can also be adopted in investor–state arbitration.

This chapter explains how the Andean Tribunal of Justice (ATJ) has significantly diverged from several foundational integration law doctrines developed by the European Union's Court of Justice (ECJ). As such, this updated analysis discusses how the ATJ refined the complemento indispensable principle to more clearly delineate the boundary between Community and national legal authority and to uphold the primacy of clear Andean rules. This principle is a doctrine that permits national laws and regulations to implement and fill gaps in Andean secondary legislation (known as Decisiones). The ATJ has also asserted the supremacy of Andean law over conflicting bilateral and multilateral treaties, and accepted preliminary references from administrative agencies and arbitral panels. In addition, the ATJ has for the first time addressed human rights, stating, albeit in dictum, that governments must prioritize the socio-economic rights of Community citizens over free trade and integration rules.

This fully updated and revised 3rd edition of Preliminary References to the European Court of Justice provides a meticulous and yet easily accessible examination of all aspects of the preliminary reference procedure. A reference for a preliminary ruling is a request from a national court of an EU Member State to the European Court of Justice to give an authoritative interpretation on an EU act or a decision on the validity of such an act. Preliminary rulings have played a pivotal role in the development of the European Union. The European Union’s preliminary reference procedure has been copied by several other international organisations – including not least the European Economic Area (EEA) and the EFTA Court. Since the second edition, the European Court of Justice has rendered a considerable number of rulings which have led to important changes to the book. This is particularly reflected in the treatment of the Court’s acte clair doctrine, of preliminary references from administrative appeal boards and arbitration tribunals and of preliminary references regarding international agreements. And it is reflected in the interaction between the preliminary reference procedure and the European Convention on Human Rights as well as in a more general revision of the text bringing it up to date by taking into account new case law and new legal writings. La migración internacional es un fenómeno que se ha incrementado a nivel mundial, alcanzando sus niveles máximos históricamente. A esta realidad global están innegablemente asociadas las múltiples formas de discriminación que experimentan muchos inmigrantes en base a su nacionalidad y estatus legal. En Europa este panorama no es un asunto de data reciente y sus Estados no están excluidos del fenómeno de la globalización y la migración. Por ello, la Unión Europea (en lo sucesivo, UE) ha consagrado –a través de una serie de normativas regulatorias– la protección de derechos humanos. Esta salvaguarda se ha extendido expresamente a los inmigrantes a través de la implementación de una serie de directivas. Pese a tales previsiones –en atención al principio de subsidiariedad– los Estados miembros de la UE por separado han promulgado legislaciones y adoptado decisiones judiciales con contenido muy variado respecto de sus asuntos migratorios. Esto ha generado debates y polémicas en diferentes ámbitos. A lo anterior se suma la propagación del racismo y xenofobia en Europa –así como el pronunciamiento de órdenes de expulsión– que, lejos de posibilitar la inclusión dentro de la sociedad europea de estos grupos migratorios, exacerba tales conflictos creando segundas categorías de ciudadanos. Por tanto, a nivel de la UE no es tarea sencilla determinar el alcance y contenido de las directivas relativas a los procedimientos de detención y expulsión de inmigrantes. Especialmente cuando se pretende aglutinar los diferentes criterios en la materia contenidos en las diversas legislaciones migratorias de los Estados miembros. Con este propósito, la Directiva 2008/115/CE9 (en lo sucesivo, directiva retorno), se erige como una normativa de mínimos a ser implementada por los Estados miembros. Sin embargo, en su implementación se enfrenta a criterios interpretativos de índole diversa. Estos han pretendido zanjarse mediante el planteamiento de la cuestión prejudicial, con resultados de naturaleza dispar por parte del Tribunal de Justicia de la Unión Europea (en lo sucesivo, TJUE). Por ello, la primera parte de esta investigación tiene por propósito identificar el aporte específico de la UE en la protección de los inmigrantes ante la detención y expulsión. Ello a través del estudio de los principios emanados del derecho europeo primario relativos a la progresiva protección de los derechos humanos de los inmigrantes, junto a la Carta de los Derechos Fundamentales de la UE (en lo sucesivo, la CDFUE) y sus directivas, a fin de responder: ¿bajo qué parámetros se promueve la protección de los derechos humanos de los inmigrantes en estos procedimientos administrativos?, y ¿cómo ha interpretado el TJUE la aplicación de estos principios europeos en relación a la protección de los derechos humanos de los inmigrantes frente a la detención administrativa y la expulsión?
