Résumé :
Since 9/11, private litigants have been important players in the “fight” against terrorism. Using several federal tort statutes, these plaintiffs have sued foreign states as well as other parties, like non-governmental charities, financial institutions, and social media companies, for terrorism-related activities. While these private suits are meant to address injuries suffered by plaintiffs or their loved ones, they often reinforce and reflect the U.S. government’s terrorism-related policies, including the racial and religious discrimination endemic to them. Indeed, much like the U.S. government’s criminal prosecutions for terrorism-related activities, private terrorism suits disproportionately implicate Muslim and/or Arab individuals and entities while reinforcing the belief that those groups are predisposed to engage in or support terrorism. This short Article provides a brief overview of the world of private terrorism litigation. It begins by describing the various federal tort statutes on terrorism—including their fraught relationship with foundational tort law norms. It explains the connection between those laws and the U.S. government’s terrorism prosecutions, as well as its other terrorism-related priorities. It ends by demonstrating how private terrorism suits reinforce discrimination and prejudice against Arabs and Muslims that are reflected in criminal terrorism prosecutions. In focusing on private terrorism litigation, this Article highlights how private parties are furthering the government’s counterterrorism work, as well as how private terrorism suits reinforce the state’s endemic discrimination against Arabs and Muslims in the counterterrorism realm.

Résumé :
The year 2020 marks the twentieth anniversary of the passage of United Nations Security Council Resolution (“UNSCR”) 1325, the most important moment in the United Nations’ efforts to achieve world peace through gender equality. Over the past several decades, the international community has strengthened its focus on gender, including the relationship between gender and international peace and security. National governments and the United Nations have taken historic steps to elevate the role of women in governance and peacebuilding. The passage of UNSCR 1325 in 2000 foreshadowed what many hoped would be a transformational shift in international law and politics. However, the promise of gender equality has gone largely unrealized, despite the uncontroverted connection between treatment of women and the peacefulness of a nation. This Article argues for the first time that to achieve international peace and security through gender equality, the United Nations Security Council should transition its approach from making recommendations and suggestions to issuing mandatory requirements under Chapter VII of the U.N. Charter. If the Security Council and the international community believe gender equality is the best indicator of sustainable peace, then the Security Council could make a finding under Article 39 with respect to ‘a threat to the peace’—States who continue to mistreat women and girls pose a threat to international peace and security. Such a finding would trigger the Security Council’s mandatory authority to direct States to take specific actions. In exercising its mandatory authority, the Security Council should organize, support, and train grassroots organizations and require States to do the same. It should further require States to produce a reviewable National Action Plan, detailing how each State will implement its responsibilities to achieve gender equality. The Security Council should also provide culturally sensitive oversight on domestic laws which may act as a restraint on true gender equality.

Résumé :
Rakshasa marriages, and Paisacha marriages are all attested to in the Vedas. One of the eight types of Hindu marriages, Gandharva marriage, involves events that are strikingly comparable to those in a live-in relationship . The Gandharva form of marriage was the most common during the Vedic era. A type of marriage known as a "Gandharva marriage" allows the couple to live together because of love and consent, finally becoming married consensually. Shakuntala and Dushyanta are a well-known couple that chose this type of union. Gandharva marriage is a type of union in which the woman selects her own spouse. According to Apastamba Grhyasutra, an ancient Hindu literature, Gandharva marriage is the method of marriage where the girl selects her own husband. They meet each other of their own accord, consensually agree to live together, and their relationship is consummated in copulation born of passion. This form of marriage did not require consent of parents and The Gandharva marriage method is defined by the ancient Hindu text Apastamba Grhyasutra as the marriage when the girl chooses her own husband. They meet on their own, decide to live together amicably, and then consummate their relationship through passionate copulation. The consent of the parents and anyone else was not necessary for this type of marriage. This was one of the earliest and most common type of marriage during the Rig Vedic period, according to Vedic records. In the Mahabharata, one of the two great Hindu epics, Rishi Kanva, Shakuntala's foster father, suggests the Gandharva union, saying that it is the best union possible between a desiring woman and a desirous man, without the use of rituals.

Résumé :
Global problems are very different. The division of global problems into three big groups: Inter-social global problems usually included the problems like the problem of diverting world wars, nuclear, eventually other conflicts connected to the problematic of armament (the problem of war and peace). At present, there gains in importance also the fight towards terrorism. The problem of the social and economic backwardness of developing countries, eventually the whole North-South relationship also belong there, as well as the problem of solving global debts, the relationship of the indebted and creditors. The problem of the international relationships (namely economic) changes under the new conditions formed namely by the scientific and technological progress. Into the second group of natural-social global problems, there are most often included the following problems: environmental problem, raw material and energy problem, population problem, food, respectively nutrition problem. Lastly, the third group of anthropo-social problems includes the general human problems of the social, cultural and humanitarian-ethical nature. Sometimes, they are ranked as one great complex problem (so-called problem of the future of man), sometimes this group is divided into a number (10–15) of partial “sub-global” problems the common denominator of which are the shortcomings of the development of man in the relationship to the life and social conditions created by himself. Here belong different kinds of the unequal approach to education, health care, housing, culture, human rights, eventually also serious defects in their securing or a disharmonic and uncontrolled development (e.g. accelerated urbanisation) etc.

Résumé :
The creation and growth of new enterprises and, on the other hand, their decline and market exit are crucial factors of business dynamism and economic growth. Thus, business dynamism is an important aspect in the market chain and productivity of an economy, as well as a trigger for market reforms. The aim is to analyze business dynamism using Global Competitiveness Index 4.0 and its variables worldwide and to verify the relationship between business dynamism in the EU states and economic characteristics such as Valued added at factor cost, Enterprise Birth Rate and Enterprise Death Rate. Data were collected from the 2019 Global Competitiveness Report and from the EUROSTAT database, using the most recently updated source for each indicator. The 11th pillar of the Global Competitiveness Index, focused on business dynamics, and a set of indicators were analyzed using PCA to verify if all the variables are effective representatives of the concept. It was found out that the pillar does not effectively represent the concept of business dynamism in case of the EU countries; therefore the new pillar was constructed. A strong and statistically significant correlation between business dynamism and Value Added was confirmed. A relationship between business dynamism and other economic indicators was not proven. From a territorial point of view, Oceania achieved the best overall result in the analyzed field. The process of starting a new business is the most challenging in terms of start-up costs in South America. By contrast, the EU has reached the best result in this process.

The Indian delegation led by Sir Jeremy Raisman, Finance Member of the Government of India, proposed the name "International Bank for Reconstruction and Development India managed to lift 133 million people out of poverty between 1994 and 2012. However, India with a population of 1.3 billion shows 5% of its population living in extreme poverty. India exported USD 261 billion in 2016, making it the 17th largest exporter in the world. However, India's export structure is still not really diversified and focuses primarily on commodities and primary products. Résumé :
The present project was intended to provide an initial exploratory investigation into the relationship between hostility and world assumptions for a firefighting sample. Specifically, we hypothesized that increased hostility would be associated with more negative assumptions with respect to world benevolence, world justness, and self-worth, and that these variables would also be related to years of service and self-reported mental health. The current study was part of a larger study with firefighters from British Columbia, Canada, and included 186 paid-professional firefighters who completed a series of questionnaires. We demonstrated that, for our firefighting sample, hostility was related to both world benevolence and self-worth across multiple measures, even while controlling for the individual characteristic neuroticism. We did not find any significant relationship with years of service, but world benevolence and self-worth were also important in the prediction of mental health outcomes. These findings may have clinical or occupational intervention implications in therapeutic relationships with firefighters, in that the present project demonstrated a first indication that reduced hostility in combination with increased positivity in world assumptions may help achieve good mental health.

Geography, flat or not, creates special relationships between buyers and sellers who reside in the same neighborhoods, but Friedman turns this metaphor inside-out by using The World is Flat to warn us of the perils of a relationship-free world in which every economic transaction is contested globally. In his “flat” world, your wages are set in Shanghai. In fact, most of the footloose relationship-free jobs in apparel and footwear and consumer electronics departed the United States several decades ago, and few U.S. workers today feel the force of Chinese and Indian competition, notwithstanding the alarming anecdotes about the outsourcing of intellectual services. Of course, standardization, mechanization, and computerization all work to increase the number of footloose tasks, but innovation and education work in the opposite direction, creating relationship-based activities—like the writing of this review. It may only be personal conceit, but I imagine there is a reason why the Journal of Economic Literature asked me to do this review.

Résumé :
The red and black formed in Egypt a système antinomique (B. Mathieu). Desheret (the desert) represented the sphere of the wild and the natural, while kemet (alluvial land) signified cultivated and civilised areas. These were not the only opposites involved. The red desert was seen as the source, base and place of origin of the black land and its inhabitants. This could also be compared to the raw vs worked (natural vs artificial) relationship. At the same time, it reflected the relationships between Seth and Osiris, evil and good and chaos and order. In developed Egyptian cosmology and eschatology, red represented Ra, day, life and activeness against black, which represented Osiris, night, death/rebirth and potential states. From these connections, red/divine and black/royal connotations emerged. Examples of the use of red and black can be found in both architecture and art from Naqada I vessels through to New Kingdom obelisks. This reflects the fundamental ideology of these colours.

Résumé :
This article, based on data from 1995 to 2022, considers the commercial and economic processes between the USA, Japan and China and stock indexes indicators of these countries. In the course of research, the authors have created multiply regression model, adequacy of the model was determined using the Fisher’s F-test, Student’s t-test, and the stability of the parameters of the regression model was checked using the CUSUM test. Stationarity of the time series was checked by the Dickey-Fuller test. As a result, econometrically sound recommendations are developed, which allows to conduct dynamic analyses to effectively regulate economic processes, integration and international trade, foreign investment operations between the three countries. The Granger causality of the relationship was investigated. Johansen tests were implemented to find the cointegration space, after which a vector error correction model was constructed that describes the long-term equilibrium relationship between the studied indicators and the path to return to the equilibrium trajectory in case of deviation from it. During the modelling, all necessary statistical procedures were used to identify and evaluate the parameters of the model and check its adequacy, accuracy of short-term and long-term forecast values using Eviews 8 tools. The results show that not only for the countries studied here, but also for each country, conduction of monitoring by the governments by using the methodology of the vector model of error correction is very important in order to ensure effective regulation of foreign trade and to participate in regional and global integration processes.

Résumé :
The relationship between an organization and its public represents a central concern for the research and practice of public relations. This paper is based on the central research question: How can digital media and technologies contribute to a company’s global relationship management? Stemming from the general question I have three more research-related questions: 1. How can social media communities contribute to corporate relationship management? 2. What are the key questions for global relationship management? 3. What are the organizational prerequisites for global relationship manage- ment? Conclusion: Digital media and technologies can contribute in a unique way to global relationship management. These peculiarities comprise the “big four”: integration, accessibility, connectivity and interactivity. Connectivity and inter- activity are the two most important for global relationship management. Social media channels have opened up new opportunities for companies to benefit from platforms in recent years, where users meet, communicate, exchange ideas and even create products. The problem for global relationship management is that these platforms are very different world-wide, their users and the culture of the com- munication within these channels are equally different. As a consequence for global relationship management, organizations have to set up a systematic and long-term process of analysis, planning, creation and control to professionally manage the organization’s communication.

Educational virtual worlds can give students opportunities that would not otherwise be possible in face-to-face settings. The SciEthics Interactive simulations allow learners to conduct scientific research and practice ethical decision-making within a virtual world. This study examined the in-world behaviors that identify students who perceive learning in virtual worlds as effective. Participants include 53 students in higher education coursework. This study indicated that there is a positive relationship between learning and a feeling of presence, specifically with avatar identification. Movement in-world that is explorative and open is also correlated to presence. These findings indicate if learning in virtual worlds is to be perceived as a worthwhile activity by students, then learners require support to develop identification with their avatar and to build a sense of immersion within the virtual world.

Résumé :
The authors present a parsimonious theoretical model that illustrates how Internet-based virtual environments (such as social networking Web sites) moderate the relationship between social networks and social entrepreneurship. Social networks promote social entrepreneurship by means of (a) technology and knowledge transfer; (b) locating information; (c) generating entrepreneurial opportunities; (d) building entrepreneurial competency; (e) financing innovation; and (f) building effective networks for commercialization of innovations. Internet based virtual environments increase the velocity with which online social networks are formed and operationalized. They, thus, have a moderating effect in the relationship between social networks and social entrepreneurship. The authors also represent three concepts that are core to social networks: density, centrality, and heterogeneity. They posit that all three explain variance in social entrepreneurship and that Internet-based virtual environments moderate each of the relationships these three elements of social networks have with social entrepreneurship.

Purpose The purpose of this paper is to investigate the relationship of flexible and permeable boundary management with both life domain conflict and life domain enrichment among expatriate workers. Design/methodology/approach This study utilizes a sample of 199 expatriates working in a higher education context, and analyses survey data with hierarchical regression analysis and cluster analysis. Findings Relationships between the permeability and the flexibility of life domains, and work-private life conflict, private life-work conflict, and work-private life enrichment were found. However, no significant results were obtained for the relationship between boundary management and private life-work enrichment. Two clusters of boundary management used by expatriates are described. Research limitations/implications Due to cross-sectional data, causal influences cannot be determined with confidence. Practical implications The findings underscore the need to consider the role-related stakeholders of expatriates, especially in the private life domain. Implications for the support of expatriates based on the boundary management clusters are discussed. Originality/value This is the first study analysing boundary management distinguishing between flexibility and permeability in an expatriate context.

This research aims to analyse the influence of optimism on technology readiness and co-creation experiences in the consumption experiences of the millennial generation at Disney's theme parks as well as their relationship to customer delight. Quantitative research was carried out. The sample obtained 530 respondents, and the Structural Equation Modeling for data analysis was used. The results indicate that the consumption experiences of the Millenials are linked to factors not previously evidenced by other generations, such as the co-creation experiences and the optimism for technological readiness, which increase the degree of these experiences and can lead to consumer delight. On a practical level, it is worth highlighting the importance of theme park marketing teams understanding the behaviour of the millennial consumer, given his/her continuous growth in purchasing power compared to other generations.

Résumé :
Humanity’s search for a new and effective orientation will bring with it a changing relationship between cause and effect. Individuals disillusioned by culture, society, politics and religion, who seek refuge and help in their private worlds, will in turn multiply the collective problems because of these shifting relations. This shows us once again that none of these cultural systems is good in itself. Their qualities only reveal themselves in the ways in which they are effective for the people who live within them and to the extent to which the rules of their games allow for constructive encounters with other sociocultural systems and their members. So, there is much that the members of various cultural systems could learn from each other – even if they only learn to understand one another. First published in Hessisches Ärzteblatt Journal. Résumé :
Abstract Transnational social networks are vital to West Africans in managing relationships but also in ascertaining viable ways of being and belonging in the diaspora. Drawing from ethnographic fieldwork in the metropolitan area of Barcelona, Catalonia, Spain, this paper examines the ‘Baay Faal paradox’ to address sites of contention in West African endeavours to bind a sense of self to transnational social networks. I propose urban world-making practices that sustain connections to transnational social networks from the margins of these relations signal what I am calling ‘affective tethering.’ The term ‘tethering’ in my analysis foregrounds an imagined distance between normative models of practice and purported deviations that result in precarious, unstable and patchy connections to transnational social networks. This approach sheds light on the complex relationship between a person’s sense of self and the transnational social networks that inform ideas of personhood in the context of global mobility and settlement.

Résumé :
This paper compares the vision documents for a British borough and a German city to see how the city-as-brand is encoded in different semiotic modes, to draw inferences about the cognitive structure of the brand, to ascertain in how far any global brand values are adapted to local contexts, and discuss what this tells us about the relationship between councils and citizens. As such, the study represents a cognitive critical approach to discourse in which texts are seen as vehicles for their producers’ mental representations, disseminated to align recipients’ representations with those of producers. This approach leads to the investigation of linguistic and visual parameters such as attribution, actors and processes, modality and tense, and layout and logo elements. Despite local adaptations, both municipal entities are conceptualized as brands with largely generic and interchangeable attributes. Global competition among cities leads to the appropriation of corporate discourses, such as branding, which redefine and ultimately depoliticize the relationships between council and citizens.

Résumé :
This article marks the thirty-eighth year of including statistical information on World Christianity and mission in the International Bulletin of Mission Research. This year it includes details on the growth of world religions, increasing religious diversity, and personal contact between Christians and people of other religions. The world is becoming more religious, and the world’s countries have become more religiously diverse, yet Christians have inadequate personal contact with members of other religions. Solidarity, including friendship, love, and hospitality, is posited as the way forward in addressing these trends.

Résumé :
There are legal, political, economic, social, and environmental links between tourism and World Heritage Areas, some straightforward but others controversial. These are examined here as aspects of a long-term, stable, but complicated, relationship. Management of small-scale mobile tourism operations is well established. It includes activities, equipment, timing, numbers, group size, marketing, fees, and permit latency. Management of large-scale fixed-site tourism infrastructure and accommodation involving private equity or operational control is more controversial. It includes legal structure of partnership arrangements, and allocation of revenues, costs, and risks. The relationship framework shows the importance of picking partners carefully and establishing mechanisms for external counseling. Research opportunities include: the marketing value of World Heritage Area (WHA) controversies; the tourism effects of In Danger declarations; funding models; and impact assessment, stakeholder roles, and co-management mechanisms, in different jurisdictions. Quantifying these effects needs large-scale compilation and comparison of case studies.

Résumé :
The level and direction of the relationship between WT (World Trade) and TFT (Turkey Foreign Trade) statistically analysed in this study. For this purpose, in addition to some descriptive statistics, correlation and regression algorithms were utilized to observe the relationship. In addition, point, box and line graphs were used to observe the relative distributions of WT and TFT. According to the results, there is a 99.258 % correlation between WT and TFT. In addition, a linear regression model was designed in which TFT was determined as dependent and WT was determined as independent variable. The model is statistically significant at a confidence level of 0.05 and R, R-square and adj.-R-square explanatory ability rates of the model are 99.2 %, 98.5 % and 98.4 %, respectively. The scatter-plot shows that the binary value points are generally distributed around the linear line. In the box-plot, it is observed that WT has a wider range than TFT, but generally both variables have a symmetrical distribution. Finally, the line graph shows the ordered and consequetive 38-year distribution of both variables. Although the distribution is generally parallel to each other, the upward movement of WT has been observed to be sharper and accelerated in the last 10 years. All these results indicate that TFT has a very strong level of relationship with WT and that WT can be used as an important parameter in understanding TFT.

Résumé :
This paper explores from a critical mad studies perspective, the under-investigated relationship between madness and constructions of childhood. Through analyzing a video published by the Oprah Winfrey Network on YouTube where the host conducts an ‘interview’ with a young girl labelled with ‘childhood schizophrenia’ named Jani, I argue mad experiences of children are doubly characterized as dubious. Beyond dubious, they are conceptualized as a form of human experience so unfamiliar to sane adult perceptions they become conceptualized as entertainment. Moreover, I contend viewing the different psychogeographies or world(s) of mad people, more specifically children, that are not omnipresent to sane and mad minds alike, as farcical or disordered is problematic as it excises these realities are in fact real to those who experience them. This paper asserts the sanist move to only consider the shared phenomenological conscious experiences of populations at large is a form of cognitive injustice that ignores the multiplicity of realities that exist. What I propose towards the end of the paper is that scholarly analysis consider individuals as individuals, rather than what their subjective intersectional identities culturally demarcate. What mad positive futures can be imagined if we dare to consider Jani as Jani and not a ‘crazy little girl?

Résumé :
The article presents the ecological vector of philosophical understanding of the relationship between human and his world. The specifi cs of ecophilosophy and social and humanitarian directions of ecology are indicated. The human world is defi ned as a “home”, “place of being”, “existential territory” and is presented as an organic unity of interrelated and mutually infl uencing parties (natural, cultural, social, anthropological), characterized by interdependence, interpenetration and conjugation. The relationship “human — the world” is understood as an integral ecosystem, a complex of interacting and mutually reinforcing elements that are in a natural connection, synergy, harmony and cooperation. Eco-philosophical priorities and eco-humanistic principles for the development of this relationship are outlined: the principle of the priority of the whole in relation to parts, optimality, coordination and ecosystem.

Résumé :
In today’s world, sustainable development has become the consensus of the international community. With the development and progress of the world economy and the launch of the wave of environmental protection in the world, market trade and environmental protection issues have gradually gained the full attention of government departments and people in many countries around the world, and gradually developed into one of the core issues in the global political, economic and multi-industry fields. The laws and regulations on environmental protection adopted by international organizations and countries and the basic rules of market trade constitute the basis for applying environmental control supervision. The researchers adopted a systematic online search to identify journal articles, reports, and other relevant documents related to the market trade and environmental protection. The online search was done mainly on Google, Google Scholar and Bing to retrieve related documents on market trade and environmental protection. The study unraveled a complex relationship between market trade and environmental protection, and the international community has paid too much attention. Foreign trade policy aims to avoid the development of a new market trade restriction and implementation program, protect market trade, eliminate the existing barriers to the market trade, restrict market trade laws and regulations, and finally achieve the way to increase the effectiveness of market trade. Therefore, environmental protection and market trade are two systems, and it is a core contradiction to abide by which fundamental principles are observed. To solve and deal with the relationship between market trade and the environment, it must redefine the relevant influencing factors in these two systems. The researchers suggested that through the coordination of management, there should be a careful study from the experience of relevant organizations, such as the European Union, NAFTA, OECD and then put forward specific ideas for coordinated management.

Résumé :
Abstract Critiques of World Literature often come with assumptions that are formed with reference to more central cultures’ conceptualization(s) of the relationship between literature, society and politics. As a result, they almost always neglect, perhaps unwittingly, the pluralities of literature in the world, and the specific and unexpected way(s) translated literature functions in diverse contexts. Focused on the condition of peripherality and engaging literary translation, academic relevance, and political impact, this paper addresses some of the critiques with specific examples from a peripheral context, to argue why the study of World Literature matters, and how it can lead to social and political effects that are not visible from the perspective of central cultures.

Résumé :
The article emphasizes that the issue of «dark» tourism is insufficiently studied in scientific sources, but it is already attracting interest in science and society. A short author’s analysis of the materials of modern scientific research and research on theoretical and practical aspects of the development of «dark» tourism in the world by foreign and domestic scientists was carried out. The resource base for the development of «dark» tourism in the world was studied. A list of 57 potentially popular tourist «dark» places and objects («dead cities» and places of alienation, medieval castles, dungeons, catacombs, thematic museums, prisons, barracks, hospitals, cathedrals, ancient settlements, cemeteries, sanctuaries , anomalous zones, places of power, objects or territories of natural phenomena and disasters, battlefields and battles, etc.), which can be used in the development of new tourism products. According to monitoring data, a map scheme of «dark» tourism objects has been completed. Geographical (by macro-regions of the world) and thematic (by objects belonging to specific types of dark tourism: mystical tourism, necropolis tourism, thanatotourism and disaster tourism) structuring of these objects was carried out, and regularities in their geospatial organization were revealed. The most interesting objects of dark tourism in the regions of the world are highlighted and a brief description of several destinations is given. It is noted that the study of objects of «dark» tourism can be useful in the process of forming strategies for the development of tourism in countries and regions, in the arrangement of infrastructure of the appropriate profile (quest rooms, amusement parks, thematic entertainment centers), in the organization of cultural events, contests, quests, festivals , educational excursions in mystical places to popularize them among tourists and attract additional investments, in the activities of tourist enterprises that plan to expand the existing range of tourist programs. The importance of further research on dark tourism is emphasized, as it is designed to stimulate humanity to realize the scale of disasters, to recognize the need for a peaceful relationship between people, science, military and nuclear technologies, which sometimes endanger the existence of the entire human civilization, and which makes clear the errors of these events and tragedies of the past and present.

Résumé :
A review is presented of empirical research on the effects of gender and power on the use of influence strategies in interpersonal relationships. Several variables are considered, including gender, power, status, relationship of agent to target, and the goal of the influence attempt. Although gender appears to account for some of the findings, power and status are more critical variables in choice of power strategies. Because gender is inextricably linked to power and status, the relationship of gender to influence strategy usage can only be understood in terms of its relationship to power and status.
