General aviation in the United States has been an important part of the economy and American life. General aviation is defined as all flying excluding military and scheduled airline operations, and is utilized in many areas of our society. The majority of aircraft operations and airports in the United States are categorized as general aviation, and general aviation contributes more than one percent to the United States gross domestic product each year. Despite the many benefits of general aviation, the lead emissions from aviation gasoline consumption are of great concern. General aviation emits over half the lead emissions in the United States or over 630 tons in 2005. The other significant negative externality attributed to general aviation usage is aircraft accidents. General aviation accidents have caused over 8000 fatalities over the period 1994 - 2006. A recent Federal Aviation Administration proposed increase in the aviation gasoline tax from 19.4 to 70.1 cents per gallon has renewed interest in better understanding the implications of such a tax increase as well as the possible optimal rate of taxation. Few studies have examined aviation fuel elasticities and all have failed to study general aviation fuel elasticities. Chapter one fills that gap and examines the elasticity of aviation gasoline consumption in United States general aviation. Utilizing aggregate time series and dynamic panel data, the price and income elasticities of demand are estimated. The price elasticity of demand for aviation gasoline is estimated to range from -0.093 to -0.185 in the short-run and from -0.132 to -0.303 in the long-run. These results prove to be similar in magnitude to automobile gasoline elasticities and therefore tax policies could more closely mirror those of automobile tax policies. The second chapter examines the costs associated with general aviation accidents. Given the large number of general aviation operations as well as the large number of fatalities and injuries attributed to general aviation accidents in the United States, understanding the costs to society is of great importance. This chapter estimates the direct and indirect costs associated with general aviation accidents in the United States. The indirect costs are estimated via the human capital approach in addition to the willingness-to-pay approach. The average annual accident costs attributed to general aviation are found to be $2.32 billion and $3.81 billion (2006 US$) utilizing the human capital approach and willingness-to-pay approach, respectively. These values appear to be fairly robust when subjected to a sensitivity analysis. These costs highlight the large societal benefits from accident and fatality reduction. The final chapter derives a second-best optimal aviation gasoline tax developed from previous general equilibrium frameworks. This optimal tax reflects both the lead pollution and accident externalities, as well as the balance between excise taxes and labor taxes to finance government spending. The calculated optimal tax rate is $4.07 per gallon, which is over 20 times greater than the current tax rate and 5 times greater than the Federal Aviation Administration proposed tax rate. The calculated optimal tax rate is also over 3 times greater than automobile gasoline optimal tax rates calculated by previous studies. The Pigovian component is $1.36, and we observe that the accident externality is taxed more severely than the pollution externality. The largest component of the optimal tax rate is the Ramsey component. At $2.70, the Ramsey component reflects the ability of the government to raise revenue aviation gasoline which is price inelastic. The calculated optimal tax is estimated to reduce lead emissions by over 10 percent and reduce accidents by 20 percent. Although unlikely to be adopted by policy makers, the optimal tax benefits are apparent and it sheds light on the need to reduce these negative externalities via policy changes.

This dissertation probes critical questions about the relationship between the production of cultural meanings, social power, and material objects. By using the public discourse on traffic accidents in the United States as a historical case study, this study investigates in particular the various ways by which social groups respond to unintended technological consequences and dangers within definitional processes of collectively constructing a social problem. The textual-thematic analysis draws largely upon theories from social problems literature and science & technology studies, as it looks at a number of salient historical claimsmakers, sites of discourse production, and cultural vehicles of meaning making. Specifically, the contributions of the private insurance industry, safety establishment, consumer market, automobile clubs, and printed media are closely dissected to flesh out the contours and content of the accident problem's construction and development through time. In line with a contextual constructivist approach to social problems analysis, the research has observed the emergence, evolution, and eventual waning of the accident issue along several structural anchors that provide possible explanations for some of these dynamics. To a great extent, the traffic accident problem has gradually 'disappeared' in America throughout the twentieth century - a disappearance that is not physical but conceptual. Specifically, it means that the troubling social condition is defined as something to live with, a necessary evil of which there seems to be limited ability or desire to substantially affect or eradicate. The sociological concept I employ to name this particular trajectory towards problem attenuation is normalization. Applied to the case analyzed here, the findings offer a way to understand the processes by which traffic accidents become nom1alized in America as an acquiescent price to pay for the benefits of the automobile. Theoretically, these conclusions have laid the groundwork for producing a hypothetical model of social problems normalization. The model highlights the role played by several cultural devices of claimsmaking in affecting issue attenuation or 'disappearance.' When the problem is constructed through highly technicizing, commensurating, commodifying, and socially controlling modalities of sense making, the likelihood of its normalization and eventual floundering increases.

After an unfortunate series of accidents in the mid 1930’s the Air Transport Association (ATA) lobbied Congress for regulation of the industry. The ATA claimed that unfair competition was endangering the public safety. The Civil Aeronautics Act of 1938 created the Civil Aeronautics Board (CAB) and gave the CAB the authority to regulate the industry. During the regulation era airline ridership increased and safety improved. During the regulation period, opportunity for comparing the safety record of the regulated industry with the record of the unregulated portions of the industry was limited. The few attempts made rendered inconclusive results. During a period of high inflation and high interest rates in the 1970’s interest in deregulating the airlines arose. With passage of the Airline Deregulation Act of 1978, interest in the effects of regulation on airline safety was renewed. More than a decade has passed since deregulation. The industry has continued to improve its safety record during the deregulation period. The question remains: "How has deregulation affected airline safety?" In this study records of airline accidents and incidents investigated by the National Transportation Safety Board are examined. The occurrences are divided into those with causes that are under the airlines control and those that are not under their control. Those under the airlines control are regressed against time and a dummy variable for deregulation. The possible effects of airline profitability on the results are also explored. The results indicate that deregulation had an adverse effect on airline safety. The effects of alternative formulations are also examined. The effect though statistically significant is small. It does not suggest the need to return to a regulated airline industry. But, it does suggest the need for additional research into the connection between airline safety and competition.

The purpose of this study was to locate, examine, classify and analyze lawsuits based on student injuries due to alleged negligence in public school physical education and athletic programs in the United States during the period of 1980 to 1984. A preliminary investigation of the American Digest System revealed appropriate case citations for this study. Each citation was used to locate the lawsuit in the respective regional reporter of the National Reporter System. Each case was thoroughly studied and reported. The analysis of cases revealed that 21 sports-injury lawsuits in physical education and 24 in athletic programs occurred during this time period. Twenty-one lawsuits involving playground or other injuries were also examined for related information. Each case was classified and discussed according to the primary area of alleged negligence. These primary areas included standard of care, adequacy of instruction, adequacy of supervision, adequacy and safety of facilities and equipment, adequacy and safety of protective equipment and other related areas. Of all of the cases discussed in this study, 23 were ruled in favor of the plaintiff, with 15 held for the defendant. The doctrine of governmental immunity was upheld in 28 of the cases. The legal liability of school districts and boards of education and that of physical education teachers and athletic coaches was determined from this analysis. The status of governmental immunity and current trends of the court decisions were also discussed. The study concluded with implications for the field and recommendations for further study.

At the international level, standards and recommended practices adopted by the ICAO have settled the general framework followed by States in the provision of ATC services. However, as those international instruments have no binding effect, liability of air traffic controllers is governed by national regulations. Therefore, if in both the United States and France the liability regime is based on fault, nevertheless the nature of the fault and the one of the duties of air traffic controllers, as determined by the courts of each States, differ. This lack of uniformity is also obvious regarding the comparison between controllers' and pilots' liabilities. To mitigate the consequences of the deficiency of harmonisation, taking into account technical improvements inherent to the field of ATC and, broadly, to air navigation, two solutions have been suggested. The first one, Free flight, is still under study whereby the second one, privatisation, has already been successfully implemented in several countries and, while being strongly considered by the French government, has by now been initiated by the American one. However, we will have no option but to ascertain that such solutions will not solve the problem pertaining to disparities of regulations and holding of the courts on the matter of air traffic controllers' liability.

In the early 21st century, the private commercial space transportation industry demonstrated that commercial human space flight is both technologically and economically feasible. In 2004, the United States Congress responded by passing legislation authorizing the Department of Transportation to license and regulates commercial human space flight.
This thesis examines and assesses the U.S. commercial human space flight vehicle licensing and regulatory law. Tort liability is inextricably linked to the success of the commercial human space flight industry and to that end this thesis provides an analysis of U.S. tort liability law in the event of a commercial human space flight vehicle accident.

In December 1978, United Airlines Flight 173 arriving in Portland from Denver with 189 people aboard crash-landed in a suburb at 157th and East Burnside. Ten people were killed and dozens more were injured. The jet ran out of fuel after it had circled for an hour while the crew tried to determine what was wrong with the right main landing gear, which had fallen with a huge double jolt on extension. The investigation that followed the crash placed the blame squarely on the pilot for his negligence in failing to monitor his fuel supply, and secondarily on his crew members, who failed to adequately communicate their concerns about it. The accident was a watershed event in what would become known in the airline industry as crew resource management, a communication model designed to reduce human error by fostering collaborative decision-making and assertiveness training. In the years that have followed the accident, very little has changed in the narrative surrounding it. Articles and docudramas on the plane crash consistently repeat the tale as is, blaming the pilot and shedding no light on the factors that led to the in-flight emergency or on United's role in contributing to the crash. This thesis is a "cold-case" investigation that reveals those contributing factors, which have been so thoroughly ignored. In the words of renowned attorney F. Lee Bailey, "The rule of law requires that all parties who contribute to an accident share in the responsibility for whatever harm has been caused." This is the untold story of all the decisions that brought down United Flight 173, and of the responsibilities heretofore overlooked.

This study analyzes the effect of the Army Air Forces’ wartime experience on the selection and training of aviation cadets and the steps taken by the Army Air Forces to reduce the number of accidents and fatalities. Over the course of the war, the US Army Air Forces suffered over 54,000 accidents in the continental United States. These accidents accounted for over 15,000 fatalities, the equivalent of a World War Two infantry division. As a result of this wartime experience the Army Air Forces began instituting and enforcing stricter safety measures and emphasizing safety in all phases of training. By the end of the war, the Army Air Forces had transitioned from an organization with loose standards for selection, training, and safety to one with formal procedures for all three. In the process, the Army Air Forces established a new culture of professionalism for the US Air Force.

Launch activities are increasingly performed by private entities and launch participants deal with a complex legal environment. The Space Treaties provide a framework placing liability for non-governmental activities on the launching State and the duty to authorize and supervise them on the appropriate State. Launch participants are subject to specific regulation in certain States or are under institutional State control in others. They also have to comply with general domestic law of liability. Limited insurance availability led to the development of contractual risk allocation techniques, the inter-participants waivers of liability and claims, inspired by NASA practice.
This thesis offers a contribution with the synthesis of information, so far scattered, on today's legal environment, providing an overview of the norms at play in this field to allow the grasp of their relative weight and interactions in the assessment of liability risk attached to launch activities.
This synthesis reveals a legal framework presently lacking the predictability necessary for an efficient liability risk management: (1) inter-participants waivers of liability suffer the weaknesses of all limitation of liability clauses; they also lack uniformity and implementation rigor; (2) the Space Treaties contain ambiguous terms preventing predictable determination of the State liable for damage and the State obliged to authorize and supervise launch activities, and do not reflect the de facto primary liability of launch operators.
This thesis offers a contribution to the advancement of legal work on these problems by suggesting new approaches emphasizing the need for: (1) harmonization of inter-participants waivers of liability to improve their consistency and validity and ensure identical flow-down by all participants; (2) improvements of the Outer Space Treaty, Liability Convention and Registration Convention for their implementation to non-governmental launch activities.
Although the launch community is small and the need for lawmaking is not as compelling as in fields such as aviation. Nevertheless, tailored adjustments to the present legal framework are required and proposed in this thesis through model clauses and an international instrument, both of which are submitted for further thinking and contribution by those sharing the opinion that creative lawmaking is now necessary to prepare for tomorrow's endeavors.

No other government agency receives as much attention as the National Aeronautics and Space Administration (NASA). The high-profile agency frequently captures attention of the media in both positive and negative contexts. This thesis takes a case study approach using organizational learning and sensemaking theories to investigate crisis communication within NASA's 2003 Columbia tragedy. Eight participants, who in some capacity had worked for NASA during the Columbia tragedy in a communication centered position, were interviewed. Using a grounded theory framework, nine themes emerged pertaining to organizational learning, leadership, structure, and organizational culture. The results of the study aid in understanding how high risk organization's (HROs) can learn from previous failures and details how organizational culture can hinder organizational change.

Properly written waiver of liability forms can be an effective tool in decreasing injury liability of intramural and recreational sports programs. In order for a waiver to be effective, (i.e., held up in court), participants must not only read and sign the waiver, but they must understand it as well. Readability, the ease of which text can be read and understood, is an important part of a well-written waiver. Waiver of liability forms should be written at a reading level consistent with that of the intended audience. On average, students read three grade levels below the last grade they completed in school. The highest grade level at which waiver of liability forms written for use in college settings should be the 9th grade. The main goal of this study was to assess the reading level of intramural and recreational sport waiver of liability forms, and compare them to the 9th grade level. Nine NIRSA member schools and nine non-NIRSA member schools from each of the six NIRSA regions were randomly selected for inclusion in this study. Following multiple mailings, the forms received were scanned into a computer, and readability was assessed using the Readability Calculation software (Micro Power & Light, Dallas, TX) for McIntosh. A one-sample t-test was performed to compare the forms to the 9th grade reading level. Forms were written significantly higher than the 9th grade level (t[26]=14.53, p<.0001). An analysis of variance was performed to assess possible moderating variables (e.g., NIRSA membership status and involvement of a risk management team in writing the waiver). No significant differences were found. Font size was also measured, and forms were found to have been written at a significantly higher level then the recommended 12 point font (t[28]=-2.88, p<.01). This study brings into questions the efficacy of waiver of liability forms used in many collegiate/university intramural and recreational sports programs in the U.S.

Traumatic brain injury (TBI) is considered the “signature injury” for United States Veterans who deployed in support of Operation Enduring Freedom (OEF), Operation Iraqi Freedom (OIF), and Operation New Dawn (OND) since 2001. Veterans with TBI may be at higher risk for subsequent intentional and unintentional injuries due to cognitive and executive function impairments from the injury and co-occurring psychiatric conditions. This dissertation evaluated the association between TBI and attempted suicide, motor vehicle accidents, and opioid overdose, in a large cohort of United States OEF/OIF/OND Veterans aged 18 to 40 who received care in the Veterans Health Administration (VHA). These studies utilized data from the VHA electronic medical records collected between April 2007 and September 2012. Study 1 evaluated the association between TBI and attempted suicide. Veterans with TBI had approximately a 4-fold increased risk of attempted suicide compared to those without, adjusting for demographics (adjusted hazard ratio (aHR): 3.73, 95% CI = 3.07, 4.53). The mediation analyses suggested that the psychiatric conditions substantially attenuated the impact of TBI on attempted suicide (aHR: 1.25 (95% CI = 1.05, 1.48). Study 2 evaluated the association between TBI and motor vehicle accidents. Veterans with TBI had a 56% increased risk of motor vehicle accident compared to those without, adjusting for demographics (aHR: 1.58, 95% CI = 1.27, 1.97). However, the mediation analyses attenuated this association (aHR: 1.17, 95% CI = 0.96, 1.43). Study 3 evaluated the association between TBI and opioid overdose among OEF/OIF/OND Veterans receiving long-term opioid treatment for non-cancer, chronic pain. Veterans with TBI had 2-fold increased risk for opioid overdose compared to those without, adjusting for demographics (aHR: 2.00, 95% CI = 1.26, 3.16). Nevertheless, the mediation analyses suggested that psychiatric conditions attenuated the impact of TBI on opioid overdose (aHR: 1.38, 95% CI = 0.94, 2.01). In conclusion, these studies add to the literature about risk of intentional and unintentional injuries among Veterans with TBI. Additionally, it highlights that Veterans with TBI and at least one co-morbid psychiatric condition are a particularly vulnerable group with the highest risk for injuries.

This report is an in-depth analysis of the media coverage of the 1999 collapse of the Texas A&M Bonfire. The report also provides insight, through extensive interviews with journalists involved in the coverage, of how reporters handle the personal emotions associated with tragedy reporting. Through the interviews, I paint a picture of what it was like to arrive on the scene in College Station on Nov. 19, 1999 and detail some of the different strategies and philosophies journalists used to cover the event. The final part of the report is dedicated to exploring the relationship between media and communities in tragedy. The Bonfire collapse and the Columbine school shootings in Littleton, Colo., serve as case studies to analyze the effect of media on a community and vice versa. To conclude, the report attempts to paint a picture of the reality of the Bonfire coverage – its difficulties, its successes and, in some areas, where the media failed.

The dilemmas and challenges faced by firefighters are increasing daily. The world’s firefighting teams are not satisfied with their achievements and disaster relief skills. In the face of potential disasters, more comprehensive response strategies are required to set out countermeasures that provide the public with sound disaster prevention quality and relief services. The investigations that follow a fire related disaster can involve: people’s individual legal responsibilities, rights, and obligations; evaluation of a disaster; post-disaster recovery; different insurances; managing emergency relief funding applications; civil and criminal law responsibility; and certifying that victims of the disaster are taken in. These steps are long term pressures. The deep feelings of the public and annual fire prevention policy reviews can determine the direction of future disaster prevention efforts. These, alongside the results of a fire investigation, can serve as reference for how effective the fire rescue efforts have been and can help in improving fire rescue technology while providing information on effective fire prevention methods. In addition, in recent years arson cases have remained high. How arson prevention methods should be established in response to modern needs is a major issue for departments in the government. Government agencies need to formulate group strategies, execute these strategies, solve this problem effectively. At the moment, many countries around the world highly value fire prevention jobs. Our country shares similarly strict ways of doing things and lifestyle characteristics with Japan. Therefore, the purpose of this paper is to gather, summarize, and sort through fire disaster investigations in Japan, the UK, and the USA’s successful experience as the fire investigation work reference. Трансплантація органів та інших анатомічних матеріалів людини та правове регулювання в цій сфері – є одними із головних показників, за якими відслідковується рівень розвитку медицини в загалом в кожній країні, тому це і зумовлює актуальність обраної теми та проведення порівняльного аналізу сутності та правового регулювання трансплантації як в нашій державі, так і в країнах ЄС та вироблення на основі цього рекомендацій та пропозицій щодо вдосконалення українського законодавства. Метою кваліфікаційної роботи є визначення поняття, сутності, проблем в сфері трансплантології України та комплексному порівняльному аналізі трансплантації органів та інших анатомічних матеріалів людини в України та країнах ЄС. Об’єктом дослідження даної кваліфікаційної роботи є суспільні відносини та їх правове регулювання в сфері трансплантації органів та інших анатомічних матеріалів людини. Предметом дослідження виступають конституційні основи трансплантації органів та інших анатомічних матеріалів людини. Методологічну основу кваліфікаційної роботи складають сукупність принципів, підходів та методів пізнання. Для проведення дослідження в роботі застосовуються такі методи як: метод критичного мислення, порівняльно-правовий метод, метод співставлення та співвідношення, метод структурного аналізу тощо.
EN : Qualifying work consists of 100 pages, contains 71 sources of used information. Today in the world transplantation of organs and other anatomic materials of man is examined as a non-alternative method of treatment of irreversible diseases and damages of vital and became widespread enough as medical service that helps to save greater part of patients and recover the functions of organism of sick man. In present time the question of transplantation of organs in Ukraine, regulation of this sphere and financing of development of the system of medical service are distant from perfection. From it greater part of Ukrainians annually must drive out foreign country for the receipt of such medical service. In activity of the establishments of health care, related to transplantation and to activity that related to transplantation an important place occupies a procedural aspect - terms, order, features and limitations. Transplantation of organs and other anatomic materials of man and legal adjusting in this sphere are one of main indexes on which the level of development of medicine is watched in general in every country, therefore it stipulates actuality of the chosen theme and realization of comparative analysis of essence and legal adjusting of transplantation as in our country so in European Union and making on the basis of it recommendations and suggestions concerning the improvement of the Ukrainian legislation. The aim of qualifying work is determination of concept, essence, problems in the field of transplanting in Ukraine and complex comparative analysis of transplantation of organs and other anatomic materials of man in Ukraine and European Union. The object of research of this qualifying work are public relations and their legal adjusting in the field of transplantation of organs and other anatomic materials of man. Constitutional bases of transplantation of organs and other anatomic materials of man come forward the article of research. Methodological basis of qualifying work is made by totality of principles, approaches and methods of study. For realization of research different methods were used, such as: method of the critical thinking, comparatively-legal method, method of comparison, method of structural analysis, etc.
