Texte intégralThe object of this paper is the analysis of so-called phenomenon of outsourcing and its impact on the employment relationship. Under this definition are confined all the legal and economic structures, in particular contracting, agency work, posting of workers and transfer of undertaking, which are the effect of the emergence of new technologies and the need to adapt to the imperatives of economics and global competition. The aforementioned processes are essentially the breakdown of the medium - large industry, that passes from a "chain" structure, typical of Taylorist-Fordist model, to a "network" structure. We will take into account the economic and legal theories that explain the origins and reasons for the massive use of these organizational types. The purpose of the analysis is to study how the working relationship has been modified and what are the consequences of outsourcing processes on the protection of the weaker party, the worker. Ultimately we shall analyze the International Framework Agreements and the incidence of ILO Recommendation No. 198/2006 construed as contractual and regulatory instruments aimed at the management of trilateral labor relationships.

Il licenziamento, individuale e collettivo, e le dimissioni meglio di tutti gli altri istituti del diritto del lavoro sintetizzano il rapporto di potere tra datore di lavoro e lavoratore, spingendo continuamente il legislatore ad intervenire, di fatto specializzando la normativa, per far fronte alla sottoprotezione contrattuale del lavoratore, bisognoso di una tutela che ponesse un freno allo strapotere del datore di lavoro. In realtà, la disciplina del licenziamento non è totalmente avulsa dalle regole comuni dei contratti, registrandosi, infatti, un continuo andirivieni dal e verso il diritto civile. Texte intégralFaced with the choice of the legislator to divert the demand for justice from state jurisdiction to private regulation, both by also economically discouraging access to the former and providing the latter with elements of facilitation and speed, it is necessary to question the degree of effectiveness of the protection of the rights of the worker. in the new legal structure characterized by the lowering of the levels of labor protection and the compression of the spaces for judicial protection. If this is true, however, it cannot be denied that in this desire to return to a juridical order preceding the one originating from the acquisitive period of the second half of the twentieth century, the legislator is not free, but must always take into account the constitutional never interrupted with the multilevel system of fundamental rights. The Constitutional Charter, in fact, taking note of the contrast between capital and labor, instructs the Republic to correct the imbalance of powers and opportunities between the parties through redistributive mechanisms and the implementation of substantial equality. This is because the worker, through his activity, participates in collective life, associates himself with the community, becomes a citizen, as well as obviously receiving adequate means of support for the worker and his family. In this perspective, the intervention of the Constitutional Court appeared to be crucial in balancing legislative tendencies ablative of rights, so much so that, as already explained, it has - albeit partially - reopened areas of procedural protection with reference to access to justice, expanding the hypotheses of compensation of litigation costs, with indirect effects also on arbitration procedures, as well as defusing the mechanism of fixed and mathematical predetermination of compensation in the case of unlawful dismissal in the so-called contract with increasing protections. In this context, access to alternative forms of dispute resolution, albeit in the context of an overall asystematic and sometimes inconsistent discipline, could indeed constitute a further way to implement the effectiveness of workers' rights. It therefore seems reasonable to conclude that if the choice of the legislator is in the sense of enhancing alternative dispute resolutions, this implies that from a substantive point of view the rights of the worker must be restored in their effectiveness, also in consideration of the fact that the combined action the reduction of the levels of protection and the use of alternative solution tools produces, as mentioned, a real regulatory short-circuit, diametrically opposite to the one declared to be intended. On the other hand, a discipline on conciliation and arbitration inspired by the canons of systematic clarity and technical simplicity, as well as accompanied by provisions that even improve the guarantee of protection and effectiveness of the rights of the worker indeed appears to be the sine qua non for making these instruments up to the task entrusted. In this context, the fundamental principles outlined in social and labor matters by the Republican Constitution must continue to constitute the essential legal basis for the regulation of substantive rights and the related judicial or contractual protection, so that labor law can continue to be an effective bulwark. of solidarity defense of people from the otherwise disintegrating logic of the market.

Texte intégralSafety in the workplace is an extremely important factor both for the protection of the worker and in terms of a company’ competitiveness, especially the craft one, whose endurance also depends on the prevention management of the workplace. The digital-technological evolution offers important and new tools, valuable for improving working conditions. These are rarely accepted by artisan employers, often due to the limited resources, not only economic, that characterize them. At the same time, however, it is essential to guarantee even to craft enterprises and their respective employees, adequate levels of workplace safety, in light of the social function that the artisan field plays in the entire "Country System". For this reason, therefore, in the matter of workplace safety, it becomes fundamental the role of support and assistance that the Consolidated Law on Workplace Safety assigns to social parts. These include representative associations of craftsmen employers and trade unions, from which activities, also and above all in a bilateral and equal form, ultimately depends on the practical success of the initiatives and the various tools that are provided at a regulatory level, especially in relation to the production and work systems updates in the face of technological evolution and its derivatives. Furthermore, the analysis of the craft industry relations of the Sassuolo’s Distretto Ceramico allows us to comprehend the reasons that, even today, determine the non-safety policies in the workplace and to discover new and innovative methods, sometimes thanks to modern technologies, that are valuable for increasing the quality of working conditions in small craft enterprises. At the same time, however, it is possible to identify what may be the causes that may slow down this essential improvement process, by thoroughly examining methods that are applied by collective bargaining in order to assist and support the artisan universe.

Texte intégralThe author analyzes, in a comparison with the Spanish legal system, the complex and current discipline of work-related redundancies for justified and objective (so-called economic) reasons, starting from the renewed interest of case-law and legal writings on an issue marked by important but often controversial and contrasting reforms. This research is oriented towards the analysis of a dismissal case, as regulated in its substantial profiles by art. 3, part 2 , L. 15 July 1966, n. 604, in relation to two essential aspects among which those that make up the complex framework of employment relationships: the interest of the company being in the fruitful work of the employee and that of the worker in the stability and the continuity of the employment relationship. In relation to the first profile, availing itself of the profuse and productive case law on the subject, a precise and current reconstruction of the notion of trade-related redundancies is carried out, examining the multiple and diverse bureaucratic justification dictated by law. These "reasons", unquestionable regarding the merits by the judge (according to article 30, paragraph 1, L. November 4, 2010, no. 183), and not considered culpable acts committed by the worker , legitimize the resolution of the employment relationship by the entrepreneur as a consequence of "production activity", the "organization of work" and the "regular functioning of it" (article 3, Law no. 604/66). With the aim of balancing the opposing interests of the contracting parties, it is then highlighted how the legal doctrine and the judges have not abandoned a favorable approach towards the worker, who represents the weaker party, and how they have limited their decisive actions ( within the standard of law), placing precise safeguards to protect workers expelled from the production cycle. On the other hand, as regards to the sanctioning system of illegitimate dismissal, the author critically analyzes the current remedial measures, varied according to of the worker's starting date of employment, in two diverse procedures of protection, underlining how the legislator has chosen to "favor" the employer’s business needs. This clearly emerges from the fact that the reintegration of the worker into the workplace is marginalized in favor of indemnity. Consequently, the interest in the preservation of the workplace is completely overcome.

Texte intégralLa tematica affrontata ha ad oggetto una ricostruzione puntuale, in chiave problematica, del livello di tutele predisposte a favore dei prestatori di lavoro nell'ordinamento cinese alla luce di un confronto con il sistema giuslavoristico italiano. Sfruttando i risultati di una ricerca di dieci mesi presso la Guangzhou University, si intende comprendere il grado di protezione offerto dalla legislazione sociale e del lavoro della Repubblica Popolare Cinese e la sua adeguatezza agli standard richiesti dalle Convenzioni internazionali in materia. Tale legislazione viene poi confrontata con la corrispondente italiana, non in ottica di mera comparazione, quanto allo scopo di comprendere come, per il tramite di forme di tutela differenti, possano essere perseguiti i medesimi scopi di assicurare un'adeguata protezione sociale ai lavoratori subordinati. L'indagine riguarda, in particolare, istituti del rapporto individuale di lavoro particolarmente delicati per quanto attiene alla situazione di debolezza contrattuale dei lavoratori, in primo luogo il licenziamento. In relazione alle tematiche affrontate, si prendono in considerazione altresì le norme tutt'ora vigenti che limitano il godimento di alcuni dei diritti fondamentali dell'individuo che in Occidente vengono dati per presupposti da decenni, impedendo così al Paese di raggiungere i livelli di tutela esistenti nei Paesi occidentali.

Texte intégralThe thesis aims to reconstruct the conceptual framework and that it has come to devise following the repeal of the law n.1369/1960 concerning the interposition of labor, as well as the contemporary expansion of joint liability of the buyer of a tender contract for work or services under the provisions of art. 29, Legislative Decree n. 276/2003. In the perspective of giving special attention to the system of joint and several liability in tender contracts the author describes, in the first chapter, all cases of joint and several liability in the Italian Civil Code with the intent to establish a common base in all cases examined. In the second chapter we analyze the evolution of the art. 29, Legislative Decree n. 276/2003 and the many changes that this standard has had to endure, extending the analysis to social insurance contribution and tax, as well as the rules on the health and safety of workers. The third chapter analyzes the critical aspects of joint and several liability in tender contracts, the issue of succession in the contract by a new contractor to that of the compatibility of social clauses with European law through the derogation to that scheme by the collective bargaining, the simulation assumptions of tender contracts, without neglecting to analyze the scope of joint liability in art. 29 , Legislative Decree n. 276/2003 also to other cases adjacent negotiating. The analysis concludes, then, with the refutation doctrinal opinion according to which the outsourcing business achieved through procurement contracts would lead to the onset of hypotheses of joint employment doctrine.

Texte intégralThe benefits due to a sustainable global economy are included in the range of values protected by international law; starting from this consideration, the principal scope of the research is to analyze the points of contact between economic interests and non-economic values, which have always been considered as inconsistent. In this perspective, it is necessary to examine the multilateral system regime within the World Trade Organization (WTO) and then, to study the provisions contained in the Free Trade Agreements (FTAs) concluded at a regional and/or at a bilateral level. During the twentieth century, international trade law has radically changed because of the institution of the WTO in 1995; one of the main innovations of the multilateral trading system is the new dispute settlement mechanism managed by the Dispute Settlement Body (DSB). The thesis analyzes, more in general, the competences of the WTO, which are all addressed to the aim of promoting a full international trade liberalization, through the removal of obstacles to trade and the prohibition of protectionist or discriminatory national measures. However, because of the globalization and the growing participation of developing countries in economic relations that the need of a greater consideration for non- economic values arises. Among the most debated issues, the one relating to the influence that the progressive elimination of any form of obstacle to trade liberalization has on the protection of fundamental rights at work in an individual dimension, as much as in a collective one, assumes great importance; that is because work represents a primary factor in the productive process and, in general, in global economy. As widely observed in this dissertation, the debate relating to the possibility of an inclusion of a social clause in WTO law, in order to achieve the integration of the “core labour standards” within the multilateral system, as established by the International Labour Organization’s (ILO), is characterized by some critical points and tendentially conducts to poor results because of the structural limits within the WTO. More specifically, developing countries, which represent the majority of the members of the Organization, have never agreed on the adoption of a restrictive legal framework with specific limits, like non- trade values. Starting from these considerations, the thesis comes to the conclusion that beyond the progress made thanks to the role played by the interpretative activity of the WTO panels and its Appellate Body in attempting to integrate non-economic values into the multilateral system, other alternative solutions have been identified at a regional and bilateral level. Among the solutions mentioned, it is interesting to consider the provisions contained in the North American Agreement on Labour Cooperation, a Side Agreement in social matters adopted in the context of the Free Trade Agreement between USA, Canada and Mexico in 1992 (NAFTA); this last FTA will be replaced by the US-Mexico-Canada Agreement (USMCA), a new agreement signed on November, the 30th, 2018 and currently just ratified by the Parties. In the same context, the dissertation takes into account the Dominican Republic-Central American Free Trade Agreement (CAFTA-DR), that is a free trade agreement within the meaning of which the United States have undertaken a legal action against Guatemala in 2010, based on the alleged violation of the core labour standards; in particular, the proceeding represents the first case in absolute in the practice of a social clause application within a FTA, in which the panel has examined a range of important labour law issues. On the basis of these considerations, the research shows that although it seems to be easier to find an equilibrium between economic interests and non- economic values at a regional or bilateral level, we should not exclude future progress within WTO, thanks to the encouraging interpretative activity made by the panels and the Appellate Body.

Texte intégralOggetto dello tesi è l’analisi delle problematiche giuslavoristiche connesse al trasferimento di azienda alla luce dell’evoluzione normativa e giurisprudenziale. La disciplina del trasferimento d’azienda è contenuta nell’art. 2112 c.c. che, in deroga a quanto previsto per la cessione del contratto dagli artt. 1406 e ss. del codice civile - prevede che i rapporti di lavoro proseguano automaticamente con il nuovo titolare dell’impresa, a prescindere dal consenso dei lavoratori ceduti. È stata preliminarmente messa in evidenza la cd. “eterogenesi dei fini” dell’art. 2112 c.c., per poi ripercorrere, anche alla luce dell’impatto del diritto comunitario, le principali tappe dell’evoluzione normativa della disciplina, analizzando altresì le diverse tecniche utilizzate dal legislatore. Successivamente sono state analizzate le caratteristiche strutturali delle fattispecie individuate dall’art. 2112 c.c., evidenziando come il legislatore abbia accolto una nozione squisitamente lavoristica di azienda. Il trasferimento d’azienda (e soprattutto di ramo di azienda) è stato poi inquadrato nell’ambito del più generale fenomeno della esternalizzazione e della disarticolazione dei processi produttivi. Quanto alla tutela garantita ai lavoratori coinvolti nel trasferimento, sono stati esaminati distintamente i profili individuali e quelli collettivi, che presentano sicuramente aspetti di maggiore criticità. Inoltre, una particolare attenzione è stata dedicata all’analisi delle più recenti problematiche giurisprudenziali emerse in tema di trasferimento di azienda, e specificamente a quelle relative all’interesse ad agire, all’accettazione del trasferimento per facta concludentia, alle ipotesi di trasferimento di azienda in frode alla legge e all’ipotesi in cui il trasferimento d’azienda intervenga nel corso di una procedura di licenziamento collettivo. Brevi cenni sono stati altresì dedicati alla procedura disciplinata dall’art. 47 della L. 428/90 - mediante la quale il legislatore ha realizzato, anche nel campo del trasferimento d’azienda, la cd. procedimentalizzazione dei poteri datoriali – e alla disciplina del trasferimento d’azienda in crisi, analizzando in particolare le problematiche connesse con l’attuazione delle direttive europee ed i relativi interventi della Corte di Giustizia, che ha sanzionato l’Italia, rilevando un contrasto tra la normativa interna e i vincoli comunitari. Infine, l’ultimo capitolo è stato dedicato all’analisi della normativa relativa al trasferimento di azienda nell’ordinamento spagnolo che, in quanto adottata in attuazione della medesima direttiva, presenta, ovviamente, molti punti di contatto con la disciplina italiana, pur essendo tuttavia caratterizzata anche da alcune apprezzabili differenze. Texte intégralThe considerations of this doctoral dissertation originate from two legal cases (known as Viking and Laval) that submit to the Court of Luxembourg the conflict between economic freedoms and social rights and, therefore, between two opposite interests (companies and workers). For lack of specific rules, the European judge solves such cases in a way that seems balanced to all appearances, but that in effect recognizes the economic supremacy which is at the root of the foundation of the European community. These rulings represent the opportunity to begin to think about the relationship between social rights and economic freedoms in a particular dimension as the European one. After explaining the main differences between the European contest and the national ones, in particular the Italian situation, I analysed the settlement’s freedom and workers’rights: in both cases it is possible to specify a patrimonial and a non-patrimonial dimension. The critical moment occurs when the patrimonial spirits of these rights come into conflict. The survey on which my dissertation is based shows from the very beginning the diabolic face of settlement’s freedom on all cases when it is exerted in order to exploit the territorial differences between workers’ national tutelage. In this case the economic competition is fulfilled through the juridical competition and expresses its incapacity to act with ordinary instruments; the juridical competition in its turn expresses a different juridical level between the countries. Also, there is a question concerning the settlement’s freedom: when is it possible a legitimate exercise of it, and when is there an abuse? The awareness of the two inseparable components that coexist in every law – the patrimonial and the non-patrimonial one – points out the importance of a true connection between substantial and procedural rules: the rule that establishes the law to be applied in the case of settlement’s freedom ends up causing consequences on individual rights. After these considerations we come to the last question: which economy for which labour law or which labour law for which economy; but the answer is completely different from the options that have been proposed and represents the outcome of my research and the conclusion of my doctoral dissertation.

Texte intégralManagerial power, which is "inside the labour law", is above all a simple fact, a prevailing influence that can be exercised by the employers on their employees. Over time managerial power has evolved as a result of increases in the "opportunistic behaviours" that have been pursued by employees, behaviours that arose as result of an evolution in production tasks. In response to the opportunistic behaviours, employers strengthened , the intensity of the hierarchic controls and used to their own advantage the disciplinary measure menace. This increase of employer power, particularly recognizable in the temporary work or in the work schedules, matches with a structural weakening of labour law. I analyze a types of managerial power, including the powers to monitoring, schedule, to set work norms around working conditions. Moreover, to shed greater light on the matter I pursue a comparative analysis, contrasting the French and Italian cases. What is interesting about these two cases is that they both have similar conceptions of the employee, while also being influenced by the construction of the European Union, which is trying to harmonize national differences pertaining to labour law. Despite these similarities, however, we find that the construction of managerial power has evolved differently over the last 30 years

Texte intégralThis PhD thesis focuses on the analysis of the discipline about fixed-term employment contract in Italy, France and Spain. It deals with two States that make a big use of such typology, that actually is the principal way to join the labour market, with overall percentages of fixed-term relationships higher than those Italian. The comparison with legal systems so close to us from a juridical, cultural and social point of view is helpful to assess the rationality and the opportunity of the deep changes brought to the general discipline from the decree-law n. 34/2014 (c.d. “decree Poletti”) and still before from the reform of damages compensation (law n. 183/2010). They are considered for each country the rules finalized to ensure fixed-term workers’ rights, as well as court decisions that have contributed, especially in subject of not-discrimination, to improve the guardianship level of the workers themselves. Furthermore, specific attention is turned to the discipline of the public sector, in which we often find a misuse of temporary recruitments, as evidenced by the experiences of French agents contractuels and Spanish workers so called indefinidos no fijos de plantilla. The conclusion of the research pays attention to the study of the contentious originated ahead to the European Court of Justice from Italy, France and Spain, with the purpose to isolate possible moments of synthesis of the different regulations. The unifying element that emerges from the dicta of the highest community organ of justice is the principle of stability of employment, whose general and transversal extent can be useful to the aim to direct the production and interpretation of national rules towards the implementation of fixed-term workers protection.

Texte intégralThe thesis analyses the phenomenon of “crowdwork”, which is one of the two types into which the platform work is divided, according to a macro-classification proposed by scholars. From the reconstructive investigation of the phenomenon as a whole, carried out in the first chapter of the thesis, it emerges that of the two, the one under study is the mode of working on a digital platform that has been less widely analysed by national and supranational scholars, courts and lawmakers. As part of this investigation gap, the thesis captures the peculiarities of crowdwork, highlights the main critical issues and analyses them through the lens of labour law with a view to identifying a protection system also for crowdworkers. Specifically, Chapter I outlines the origins of digital platform work, illustrates its diffusion on a national and global scale, and limits the field of investigation to crowdwork. Chapter II describes the main features of this type of work through the direct observation of two crowdwork platforms with different structure and organisational models, in order to grasp as many shades as possible of this highly heterogeneous phenomenon. Chapter III brings together the main critical profiles that emerged in Chapter II (the presence of elements of internationality in the crowdworker-digital platform-client relationship, the role of the crowdwork platform in the relationship with the workforce, the exercise of the power of control, working time, remuneration and the health of the crowdworker) and analyses them from a more strictly legal point of view with the aim of identifying a protection regime for crowdworkers. Chapter IV focuses on the potential role of collective protection; it describes the experiences of the formation and action of spontaneous coalitions of workers, recorded at European and international level, and examines the urgency of strengthening the “voice” of platform workers in supranational and international contexts and the feasibility of collective rights for these workers, in the light of the existing legal framework and case law.

Texte intégralLa tutela dei lavoratori subordinati e dei livelli occupazionali nel trasferimento d’azienda di imprese in crisi o insolventi – Riassunto. La ricerca, partendo da una ricostruzione storica della disciplina interna del fenomeno circolatorio delle imprese in bonis, anche alla luce del diritto dell’Unione europea e della sua giurisprudenza, si è concentrata sulle novità che hanno interessato l’ordinamento domestico, rispetto al trasferimento delle imprese in crisi o insolventi, a seguito della condanna del nostro Paese da parte della Corte di giustizia europea con sentenza n. 561/07 del 2009. In particolare, l’analisi si è concentrata sul nuovo art. 47, c. 4 bis, della l. n. 428/1990 e di come lo stesso si pone, in termini di compatibilità, riguardo alle indicazioni sovranazionali. Significativa attenzione è stata posta ai risvolti lavoristici connessi non solo al nuovo concordato preventivo e all’accordo di ristrutturazione dei debiti, ma anche alla procedura dell’amministrazione straordinaria, pur non mancando di rilevare i costanti profili di criticità rispetto alla direttiva comunitaria n. 2001/23. Lo studio, infine, si è concentrato sulle tutele collettive, nell’ambito del processo circolatorio, poste a favore dei lavoratori dipendenti delle imprese in crisi o decotte, nonché sulla strategicità che possono assumere, rispetto alla conservazione dei livelli occupazionali, sia le politiche passive che quelle attive del lavoro.

Texte intégralThe power to control the activity of workers has always been an ineradicable manifestation of the employer’s legal position. To the extent that it is necessary for the correct performance of the contract, the subjection of the worker to the employer control is an essential element of the relationship referred to in Article 2094 of the Italian Civil Code and plays a crucial role in the definition of subordination. For this reason, an accurate recognition of the legal limits on the entrepreneur’s controls is important to avoid the risk that the employment relationship becomes an occasion for conditioning workers’ freedom in a way that is incompatible with the principles of a democratic society. Based on these considerations, the study analyzes the regulatory framework on the employer’s power to control workers, focusing mostly on the rules laid down by Legge no. 300/1970 (Statuto dei lavoratori) and on the recent Personal Data Protection Regulation. The reflection, which is organized around four chapters, is carried out with an eye on both traditional problems related to this topic and new challenges raised by technological innovation.

Texte intégralThis work addresses the issues of competition and inventions in the U.S. employment relationships. The research was carried out in part at the Boston University School of Law of, under the supervision of Micheal C. Harper, professor of Labour Law. The selection of the topic is justified in the light of its importance, given that in the new production organization, based largely on globalized knowledge, employees are now increasingly being asked for professionalism, innovation and creativity. The decision to examine this issue from the perspective of the "U.S. laboratory" is due to the primacy that this nation holds at international level on the economic, scientific and innovation of work processes, which bring out critical issues that in other Countries probably have not yet been raised. In order to frame the above-mentioned topics, it has become appropriate to give an account of the system of regulatory sources in the USA, with particular focus on the Restatement of Employment Law, i.e. the collection of fundamental principles developed over the years by common law in the field of employment relationships. The examination of the sources is followed by the definition of the concept of employee and self-employed worker (independent contractor), necessary for the assessment of the application of the obligations arising from the employment relationships, including the duty of loyalty, involved in the fiduciary law. In this context, the evolution of the case law has been observed, as well as the examination of the criteria relating to the distinction between employees and independent contractors, mainly concerning the judgement on the relevance of the factual elements determining the assessment of the existence of an employment relationship. Subsequently, this study addresses the issue of the typical form of the U.S. employment contract, the so-called employment-at-will. This peculiarity is originated from the principle that the parties are not bound by any obligation to provide reasons for termination. The third part of the work has as its object the discipline of competition of the worker carried out on the basis of the knowledge acquired, legally or illegally, during the relationship and the relative legal remedies for the employer, against the violation of the duty of loyalty, intended as an obligation of the employee to perform the work in the exclusive interest of the entrepreneur and, consequently, to refrain from engaging in prejudicial conduct against the company. About the remedies available in the event of breach of the obligations examined, the legal and equitable remedies that U.S. law offers the employer have been explained. The final part of this study deals with the rules governing the ownership of rights arising from inventions developed by employees in the course of their employment. The definitions of "invention" and "patent" and their relationship in the context of employment law has been examined and the difference between invention as a work of genius and intellectual property protected by copyright has been highlighted. In addition, the mechanisms underlying the basic rules governing the subject matter and their coexistence with the contractual freedom of the parties and their power to dispose of these rights have been observed.
