Over the last decade, the Internet has transformed how information can be made available-it is now used to transfer information about things as varied as financial transactions and celebrity gossip and to link and coordinate activities between otherwise isolated people, from protest groups to lonely hearts. This unprecedented ease of access to a wealth of information and contacts presents a challenge to national governments who wish to control and restrain some of this activity. In recent years, Internet control has become one of the major indicators to assess the balance between freedom and security in democracies. This book explores and compares how, why, and to what extent, national governments decide to control the Internet and how this impacts on crucial socio-economic activities and fundamental civil rights. The author provides detailed studies on the US, Germany, Italy and further case studies on Brazil, Canada, India, the Netherlands, South Africa and Switzerland, to address topics such cyberterrorism, the protection of information infrastructure, and the impact on individual privacy and freedom of speech. This is the first cross-country, comparative study on the issue of Internet control. It will be of interest to international relations scholars and students, and particularly those with an interest in the Internet.

Texte intégralUtilizing the theories of change and social development, this study analyzes the extent to which participation in cross-national learning assessments has influenced educational policy and curriculum reforms in three African countries: Kenya, Tanzania and South Africa. The study also interrogates structural reforms and exchange of technical capacities and evaluates the culture of learning assessment in these countries. To collect data, the researcher conducted semi-structured interviews with key informants drawn from the Ministries of Basic Education, national examinations councils, civil society organizations and curriculum development institutions in the three countries. In total, 17 key informant interviews were conducted (five in Kenya and six a piece in Tanzania and South Africa). The interviews were complemented by summative content review of policy/strategic papers. This study shows that overall, at least 18 policy/official strategic documents were formulated in these three countries (seven in Kenya and six in Tanzania and five South Africa) as a consequence of participating in the cross-national learning assessments. Five curriculum reforms attributable to the participation in the cross-national learning assessments are also recorded. However, the findings of the current study suggest that these curriculum reviews have not critically considered learning outcomes and are limited in relation to content, design, delivery mechanisms and assessment of literacy and numeracy programmes. As far as teacher capacity is concerned, the study has established that teachers in these countries lack skills in measurement mainly due to the limited training or lack of coverage on psychometrics in the teacher training curricula. Capacity to implement own national learning assessments is varied across the three countries. South Africa and to some extent Kenya have demonstrated improved capacities to implement independent large-scale learning assessments. Much progress has however been made by South Africa in resourcing and implementing independent large-scale learning assessments, an indication of commitment to sustain the culture of monitoring of learning outcomes. There is also much variation in policy and programme formulation and resource investment in literacy programmes across the three countries; at least three programmes/initiatives in South Africa and one each in Kenya and Tanzania have been launched to respond to learning challenges especially in lower grades, with at least $USD 645.2 million invested between 2010-2015. However, the programmes in Kenya and Tanzania are technically and financially donor driven. In terms of structures, South Africa and Kenya have put in place official structures that could support the sustainability of the system of monitoring learning outcomes. For sustainability, a recommendation is made that learning assessments be decentralized and collaboratively managed with stakeholders at the provincial and county/local council levels. The study concludes by discussing the social development implications of these findings.

Texte intégralThe problem highlighted above, based on the research done in local authorities (Annexure 1), led to the conclusion that it would be of considerable assistance to local authorities if provided with a guide containing applicable information and practical guidance to address and overcome the problem areas highlighted above. The study endeavours to provide such information and guidance. Based on theoretical research the study gives an overview of affirmative action in the United States of America with specific reference to court cases which deal with contentious aspects of affirmative action also faced by employers in South Africa. It also discusses the legal and developmental environments steering the implementation of affirmative action in South Africa and specifically in local government. In doing so, it focuses on lessons to be learned from the experience of other employers in South Africa with specific reference to local authorities as indicated by research done (Annexure 1). As highlighted guidance in respect of process and content will make a significant contribution to the success of affirmative action in the local government sector and will assist local authorities to avoid some of the problem areas and pitfalls highlighted. Therefore based on legislation and agreements pertaining to local government and practical research (Annexure 1), the study discusses a step-by-step organisation/sector-specific process to be followed in implementing affirmative action in local government and the basic content to be addressed during the various phases of the process. In so doing the study inter alia highlights the procedure to be followed to adopt and give effect to all legislation and agreements in the local government sector in a political and economic balanced manner; focuses on how to establish and task the appropriate and legitimate structures which must champion the process of planning and implementation, provides a working method and framework through which common ground can be reached on the extent and content of affirmative action and commitment obtained therefor, provides the procedures and methods through which perceptions, fears and expectations of employees can be determined and addressed as the basis for establishing a culture and climate conducive for affirmative action, discusses the process to be followed to establish an affirmative action policy and strategic plan including the basic contents of these documents and the specific key performance areas to be addressed and programmes to be developed during planning and implementation; Policy Framework for the Implementation of Affirmative Action in Local Government 6 • through the provision of abovementioned aspects, establishes a framework and methods for the continued evaluation and monitoring of the implementation process. In combining theory and practice to give a holistic perspective of affirmative action within the local government context, the study should make a valuable contribution to the successful implementation of affirmative action in the local government sector in South Africa. Given the historical constraints such as human perceptions and intolerance, cultural diversity, lack of education of certain groups, etc., achieving such a perfect balance will be a laudatory accomplishment in the interest of all South Africans and one that must be pursued. It is believed that through a proper implementation of the process detailed in this study and specifically through the establishment and utilisation of the structures and programmes identified, a workable and balanced implementation of affirmative action can be achieved. This is specifically so since it is a democratic, accountable and transparent process based on constructive engagement of, and consultation with, all the role-players involved in affirmative action.

Texte intégralThe study explores the beliefs and wishes of respondents in Pretoria concerning crime seriousness and criminal sentencing in South Africa. It is suggested that in a democracy, the legal system must reflect the values of the individual citizen if it is to achieve a legitimacy based upon the concepts of moral consent and universality, and argues that this can only be achieved when all citizens have a voice. The study undertakes and reports on a survey of 400 units, across race divisions in and around the City of Pretoria by initially emulating, and thereafter extending, the British Crime Survey. The thesis offers seven chapters divided into two primary components. The first component, chapters one to four, systematically debate the historical/theoretical foundations of sentencing practice (both globally and in respect of South Africa), and identifies the inherent problems faced by contemporary criminal justice systems. The study utilises sentencing literature to provide an in-depth appraisal of theoretical paradigms and, thereafter, evaluates the successes and failures of various sentencing options. The second component, chapters five to seven, unpack the Pretorian research in relation to various other foreign research surveys, and culminates by offering a South African sentencing guide (severity index) based upon the research findings. The findings identify the people of Pretoria to be punitive. Respondents are shown to regard rape and driving whilst over the legal alcohol level causing the death of an innocent victim as the most serious crimes, followed by deliberate murder, selling illegal drugs and terrorism. Percentage differential between these "most serious" crimes is negligible. Many respondents indicate long prison sentences or the death penalty for these specific offences. Overall, Blacks prefer imprisonment whilst Whites are shown to be more conservative and more amenable to other sentencing options. Gender differences in relation to seriousness and sentence scores are slight, but females and the older age group are noted to be more fearful of being victimised even though this fear is not supported by actual victimisation rates. The study justifies the motivation fot the inclusion of public opinion into sentencing policy by recording a 72 percent positive response to people involvement in the sentencing of offenders.

Die uitgangspunt is dat die regsplegingstelsel veronderstel is om die waardes van die gemeenskap te reftekteer, gebaseer op die konsepte van morele eenstemmigheid en universaliteit, en argumenteer dat dit binne 'n demokrattese bestel slegs kan realiseer as alle inwoners inspraak daarin het. Die navorsing en rapportering gaan oor 'n opname van 400 eenhede in en om die stad Pretoria oor rassegrense heen. Die Britse misdaadopname het as vertrekpunt gedien vir die ontwikkeling van die opname. Die tesis bestaan uit sewe hoofstukke wat verdeel is in twee hoofkomponente. Die eerste komponent, hoofstukke een tot vier, debatteer sistematies die histories/teoretiese begrondings van die vonnisopleggingspraktyk (beide globaal en ten opsigte van Suld-Afrika), en identifiseer die inherente probleme waarmee kontemporere strafregsplegingstelsels gekonfronteer word. Die navorsingsbevindings identlfiseer respondente van Pretoria as strafgeorienteerd. Oorhoofs gesien, verkies Swartmense gevangesetting, terwyl blankes meer konserwatief maar ook meer ontvanklik blyk te wees met betrekking tot ander vonnisopsies. Genderverskille in verhouding tot die erns- en die vonnistellings is gering, maar vroue en die ouer ouderdomsgroepe vertoon groter vrees vir viktimisasie, alhoewel hierdie vrees nie ondersteun word deur werklike viktimisasieratio's nie. Hierdie navorsing onderskryf die motivering vir die oorweging van die gemeenskapsmening in formulering van vonnisopleggingsbeleid met die resultaat dat 72 persent respondente gemeenskapsbetrokkenheid in die vonnisoplgeging voorstaan.
