Résumé :
This Article critically examines the division of regulatory jurisdiction over telecommunications issues between the federal government and the states. Currently, the line between federal and state jurisdiction varies depending on the service at issue. This compartmentalization might have made sense fifteen years ago, but the advent of technology convergence has largely rendered this model obsolete. Yesterday's telephone and cable companies now compete head-to-head to offer consumers the vaunted "triple play" of voice, video, and internet services. But these telecommunications companies are finding it increasingly difficult to fit new operations into arcane, rigid regulatory compartments. Moreover, services that consumers view as near-perfect substitutes-such as cable and satellite television-face different regulatory treatment largely due to historical accident. This Article proposes that Congress instead allocate jurisdiction in a platform-neutral manner based upon the relative strengths of federal and state regulators. The federal government is best positioned to regulate economic issues that, if left to the states, would generate substantial spillover effects and disrupt economies of scale. By comparison, state regulators are best qualified to make decisions that turn upon local knowledge. The Article recommends a hybrid model for consumer protection, whereby states bring local issues to the FCC's attention, and the FCC adjudicates these issues from an appropriately national scope.

Environmental controls in the United States are often said to be “technology-based” because the polluter’s duties are determined by the available technology for controlling that pollution rather than by the social costs and benefits of doing so. Indeed, this is much of what distinguishes U.S. environmental law post-1970 from that which preceded it. But technology-based standards have in fact weighed the costs of controlling pollution in unique, often obscure ways, yielding an analysis that defies standardization and basic notions of transparency. Often lumped under an umbrella heading called “feasibility” analysis and justified on the grounds that it avoids many of the known pitfalls of cost-benefit analysis, the factoring of cost into technology assessments hands our Environmental Protection Agency a uniquely hard problem of prediction: the inducement of innovation. This Article traces the evolution of the practice to the state of the art today, offers several clarifications upon reflection, and suggests that cost estimation in technology- based standard setting is actually more likely to be a useful decision input than the orthodox cost-benefit balancing procedures. Most importantly, it is more likely to accurately assess the possibilities of inducing innovation—accuracy that is increasingly vital to meeting environmental challenges like climate change.

In modern society life is changing due to vast using innovative technology in all human domains, especially in higher education system. Learning FL is a long, complex process, requires learners to work hard on acquisition linguistic skills (writing, reading, speaking and listening). In such case we have to use information technology in order to better motivate learners learning languages with more interest comparing to traditional methods of teaching. Consequently, in reading comprehension adult learners mostly rely and spend much time on machine translation (GT) to perform tasks such as translating authentic texts on specialty from German into Uzbek which enable them quick accomplishing in that area of learning.

The Danish higher technical examination programme (HTX) is the only high school program in Denmark that specialises in technology and engineering. Central to the HTX curriculum are the profile subjects; technology and technical science. In this article, we take a closer look at these subjects, or more precisely, we examine the concept of technology embedded within them. The ministerial order regarding the subjects places the concept of technology within the ‘technology model’. We will examine the background for the model, its potential and limitations and the model's place in teaching through empirical findings from fieldwork in order to examine whether the technology model lives up to its described purpose. Overall, it can be argued that the model works but it can also be argued that the teachers should be aware of the model’s shortcomings and discuss these with students, so they obtain a more dynamic and dialectical understanding of technology.

Enterprise innovation activity supposes coordinated technical and business processes of decision-making and its performance required for successful transformation of new product or service from concept to market. The purpose of this study is to develop valuation methods of innovative technology market potential and prospects of their introduction into the production enterprise activity. In order to achieve this goal, we used brand new evaluation tool, this is technology audit conception, application of which increased significantly the accuracy and reliability of technology market potential evaluation. Clarification of terminological essence of technological audit allowed the authors to discover the content of technology audit components required for the market research and thereupon to develop evaluation mechanism for innovative technology market potential using technology audit. This mechanism is built on structure evaluation table of technology market potential level detection as an object of commercialization. To ensure the efficiency of practical effect of the mechanism proposed, the authors systematized and completed methods of functional analysis and scanning of market environment for the purpose of qualitative comprehensive evaluation and innovative technology market potential forecasting.Introduction of the proposed evaluation method for technology market potential will result in the improvement of efficiency of enterprise innovation activity due to more rational distribution of available resources and immediate financing of developments with greater market potential.

Technological determinism initially emerged in the relationship between technology and society. In the environment surrounding technology and society, technology determinism and social construction of technology (SCOT) have a tense relationship. This study aims to reveal the characteristics of SCOT by exploring and reflecting on the substantive debates and criticisms surrounding the social constructionism of technology, which is opposed to technological determinism in terms of the philosophy of technology. It is intended to substitute for the conclusion of the study by suggesting the implications obtained through reflection on SCOT. First, driving technological development in SCOT is achieved through consensus between social groups and technology developers. In the process of technological development, conflicts arise among social groups due to different problems and solutions with respect to technology, and the form of the technological artifact that has reached an agreement is finally selected. Second, technological flexibility or interpretative flexibility can solve a problem in various technical ways in SCOT. This variety of flexibility appears as a difference of interpretation and conflict between the social groups surrounding technology. Third, in SCOT, the technology frame greatly affects the artifacts. The function of the description frame differentiates it from most other concepts and is intended to be applied to the interaction of various actors. Fourth, for a specific technology to develop from the SCOT perspective, it has momentum through the consolidation of the technology system. A technological system is composed of physical artifacts, organizations, science bases, legal devices, and natural resources, with each element contributing to the overall goal of the system by interacting with other elements.Fifth, in SCOT. Finally, the main criticism of SCOT is that researchers’ methodologies are formal, they focus on the early stage of the emergence of technology, there is indifference to the influence of technology, and the social structures and power relations accompanying technological change are ignored.
