The purpose of this paper is to demonstrate the crucial role of legal science for the practical side of the law, while analyzing in detail the statutes’ reform of Bergamo (1331). Indeed, the paper discusses the relationship between learned law and practical law during the period of ius commune through the analysis of some relevant quaestiones disputatae regarding criminal transactions. The author seeks to analyze the relationship between the ius puniendi of public ­authorities and private autonomy in the resolution of criminal cases focusing not only on the Roman sources (C. 2,4,18) but also on the quaestiones ex facto emergentes contained in the collections of Alberto Gandino, Alberico da Roscia­te, Alberto Galeotti and Guglielmo Durante.

L’arcidiocesi di Przemyśl (del rito latino) negli anni 1995-2000 ha celebrato il suo primo (dopo la riforma di amministrazione ecclesiastica in Polonia nel 1992) sinodo. Eassamblea sinodale è stata convocata dal mons. Józef Michalik, arcivescovo di Przemyśl, nella prospettiva della rinnovazione dei correnti della pastorale per i prossimi anni. Nello stesso tempo il sinodo è stato collegato con 1’idea della codificazione della legge diocesana nello spirito del Concilio Vaticano II e conformemente alle disposizioni del Codex Juris Canonici del 1983. Dopo aver presentato lo svolgimento del sinodo 1’autore riferisce gli statuti (decreti) sinodali nonchè gli allegati agli statuti.

II sinodo diocesano di Andraa Stanislao Załuski, vescovo di Płock, celebrato nei giorni i 4-5 agosto 1733 a Pułtusk, fu convocato per trattare le cose che si riferivano alle necessità particolari del clero e del popolo della diocesi di Płock. La redazione degli statuti sinodali contiene 47 articuli riguardanti tra l’altro la disciplina dei sacramenti. In questa sfera domina la problematica della Eucarestia contenuta nei quattro articoli: De Echaristia (14), De Sacrificio Missae (15), De conservatione Sanctissimi Sacramenti, processionibus cum eodum atque eius expositionibus (16), De oneribus Missarum reductioneque eorum (17). L’autore presenta le rispettive disposizioni di suddetti articoli riguardanti la s. messa, la s. comunione, la custodia e il culto della ss. Eucarestia. Il complesso di quel frammento degli statuti sinodali dimostra che il clero della diocesi di Płock ha ricevuto un aiuto molto importante nella strada sempre aperta verso la realizzazione della riforma tridentina.

Nel 1390, sotto il dominio di Gian Galeazzo Visconti, anche Lodi ebbe, come molte altre città, i suoi statuti rivisti e pubblicati per iniziativa e con l’approvazione del signore milanese, nell’ambito del tentativo visconteo di uniformare i territori controllati dal punto di vista legislativo. La tesi esamina, sullo sfondo della storia della città e della costruzione dello Stato milanese, questi statuti lodigiani trecenteschi, a noi giunti in due tarde copie manoscritte e due edizioni cinquecentesche. Analizzando il testo, emerge come, in questa stesura, le cariche politiche cittadine vengano ridotte a funzioni amministrative e di controllo, ma il resto delle norme conservi spesso una caratterizzazione locale, nella precisione delle indicazioni volte a mantenere l’ordine pubblico in città, regolare norme edilizie e commerciali o diritti e oneri famigliari, stabilire i rapporti col contado o le modalità di sfruttamento delle acque del canale Muzza, punire reati descritti con estrema precisione.

La tesi prospetta una decostruzione dell’istituto fideiussorio, in ottica non esclusivamente demolitoria, ma di ricostruzione sistematica in un contesto più ampio di quello delineato dal codice civile. Ipotizzando il passaggio dal piano oggettivo a quello soggettivo della garanzia, ci si interroga sull’opportunità di differenziare le qualifiche soggettive del garante, sì da individuare altrettanti “statuti fideiussori”, per verificare se il fideiussore che si trovi in una peculiare situazione sul piano economico-contrattuale possa essere destinatario di specifiche normative, aventi prevalente funzione di tutela, ma capaci anche di realizzare una maggiore coerenza sul piano dell’analisi economica del diritto. L’obiettivo finale è la proposta di configurazione di una disciplina fideiussoria rinnovata in base allo specifico statuto fideiussorio considerato (garante-consumatore, garante-familiare/coniuge del debitore garantito, o garante coinvolto in vicende fallimentari), che consenta di prestare adeguata attenzione agli interessi coinvolti nella vicenda economica complessivamente considerata.

Scopo di questa tesi è l’indagine delle diverse problematiche giuridiche che sorgono nel diritto libanese nell’ambito del diritto matrimoniale poiché manca una normativa statale che ammetta la forma civile del matrimonio. Erede del sistema ottomano delle millet e del diritto personale, il Libano si caratterizza, infatti, sul piano giuridico come l’ordinamento statale che riconosce la più ampia autonomia normativa e giurisdizionale alle comunità religiose nella regione mediorientale nel diritto matrimoniale. Pertanto, il lavoro si è focalizzato nello studio delle problematiche sorgenti nel rapporto tra diritto statale e diritti religiosi, ed in particolare sui matrimoni tra membri di comunità diverse e sui matrimoni celebrati all’estero. Inoltre, la ricerca si occupa delle problematiche giuridiche sorte con la trascrizione del primo matrimonio civile celebrato nel paese da due cittadini che avevano ottenuto l’eliminazione dell’ appartenenza confessionale dai registri di stato civile.

This work is part of a larger theme having the association of the urban secular clergy as a subject and is focused on the Clero Intrinseco Congregation of the medieval Verona. After a general introduction on the documents forming the Clero Intriseco collection - and in particular of those used for this work - and after a survey of historiography produced on the theme, a deeper knowldedge of the Clero Intrinseco Congregation has been made possible by some local studies and thanks to the large amount of documents produced during the third and fourth decades of the XIV Century, when the Cancelleria of the Congregation was formed, enrolling notars coming from the Bishop Curia. On 1323, these notars, along with the Arciprete and other members of the Congregation, were active in producing the Statuti where it is possible to recognize the pre ence of mores and consuetudes already documented on 1177. Within the Statuti, the rituality based on regulation of Cura Animarum vivorum et defunctorum and on some corporative aspects peculiar to the Clero intrinseco congregation prevail. (On 1326, following the indications given by the Constitutions 50, 51 and 42 of the Statuti, the notars of the Cancelleria started a compilation of two very importand registers recording copies and summaries of documents produced till that year)
La ricerca rientra nel tema dell’associazionismo del clero urbano ed è incentrata sullo studio della congregazione del clero intrinseco di Verona nel medioevo. Dopo una indagine di carattere introduttivo e generale sul materiale del fondo archivistico e una presentazione di quello specificamente utilizzato per compiere la ricerca e a seguito di una ricognizione sulla storiografia prodotta su tale tema, è stato possibile ampliare la conoscenza della congregazione del clero di Verona grazie agli studi locali e all’abbondante materiale documentario che fu redatto nel secondo ventennio del Trecento quando venne istituita una cancelleria di notai provenienti dalla curia episcopale. Essi nel 1323, assieme all’arciprete e ai membri della congregazione, furono parte attiva nella stesura degli statuti, in cui è possibile riconoscere la rielaborazione di mores e la presenza di consuetudini, già documentate nel 1177. All’interno di essi prevalgono la ritualità basata sulla regolamentazione della cura animarum vivorum ac defunctorum e degli aspetti corporativi propri dell’ente religioso. Gli stessi notai nel 1326, sulla base di precise indicazioni della costituzione 50,51 e 52 del corpus statutario, procedettero alla compilazione di due poderosi registri riguardanti la raccolta del materiale prodotto fino a quella data

La finalità della tesi è stata quella d'improntare una riflessione sulle società legate all'edilizia nel momento di apice politico ed economico di una città, attiva e importante nel basso Medioevo, come Bologna. Questo tipo di studio, già intrapreso per alcune città dell'Italia centro settentrionale, risulta necessario per comprendere alcune dinamiche politiche, economiche e produttive della realtà cittadina. In particolare, gli obiettivi sono stati quelli di coniugare la vita corporativa dell'arte all'organizzazione lavorativa, individuando gli aspetti legati all'ambito produttivo e valutando, l'evoluzione della società nel passaggio dal Duecento al Trecento. Gli statuti e le matricole, principali fonti compilate dalle due società delle arti e giunte ai nostri giorni, salvo rare eccezioni, completamente inedite sono stati il principale punto di partenza dello studio. Il risultato è la sintesi di alcuni spunti di riflessione emersi dai documenti, quali la mentalità degli uomini che si approcciavano alle arti, le gerarchie nate all'interno delle stesse società, il loro cambiamento e quello legato alla percezione di comunità nel corso dei secoli oltre agli aspetti più prettamente lavorativi e artigianali.
The aim of this treatise was to start a reflection on the society related to craftsmen during the political and economic peak of a city, one of the most active and prominent in the late Middle Ages, as Bologna. This kind of study, wich has already been done for some other cities in central north Italy, is necessary for understanding some of the political, economic and productive dynamics in Bologna. In particular, the goals were sought for combining corporate life to art work organization, identifying the aspects related to the craftamship and, finally, evaluating the evolution of a social group in transition from the thirteenth to the fourteenth century. The starting point of the study were the statuti and matricole, two of the main sources wrote by the Society of Arts and preserved intact until today wich were, with few exceptions, completely unreleased. The result was the synthesis of some theory on the outlook of the men approaching to art societies, the hierarchies born in societies themselves, the changing of the Society of Arts, the perception of “society” over centuries and the aspect purely related to artisanship.

The subject of this study concerns the references to religion and religious culture in the new Statutes of the Italian Regions, enacted after the reforms approved by the constitutional law No. 1 of 1999, which introduced the direct election of the President of the Region, and No. 3 of 2001, which instead managed the relationship between state and Regions as part of an overall reform of Title V of the Italian Constitution. The first chapter is devoted to the study and analysis of the new rules, of which the historical, political and cultural background is reconstructed, taking into consideration the Constitution, the previous Regional Statutes and those of other local authorities such as Provinces and Municipalities. The second chapter deals with the problem of the legal effects of these rules, analyzing the jurisprudence of the Italian Constitutional Court, particularly the rulings 372, 378 and 379 of 2004 that, by choosing an identical argumentation to treat the statements in the Statutes of Tuscany, Umbria and Emilia-Romagna, have determined that the "proclamation of targets and commitments [...] imply, so to speak, a cultural or even political function, certainly not normative". In carrying out this chapter we'll be able to demonstrate clearly enough that the cases cited do not necessarily apply to the rules concerning religion, so that the effectiveness of these is not questioned. Finally in the third and final charter, the theme of the relationship between law and values coming from a religious culture, particularly Christianity, is taken into consideration, in relation to constitutional principles of freedom of religion and the secular state. In particular, we consider those rules as expressing an explicit opening by the Regions to the values and the cultural traditions of the communities they represent. We'll see how it is possible to find an interpretation of these references that is fully compatible with the Italian constitutional system, but the Regions will have to pay attention to avoid the risk of a discriminating application against people from cultures that are not mentioned in the Regional Charters.
L'argomento di questo studio concerne i riferimenti alla religione e alla cultura religiosa presenti nei nuovi statuti delle Regioni Italiane, emanati dopo le riforme approvate con le leggi costituzionali n. 1 del 1999, che ha introdotto l'elezione diretta del Presidente della Regione, e n. 3 del 2001, che invece ha affrontato i rapporti tra Stato e Regioni nel quadro di una riforma complessiva del Titolo V della Costituzione Italiana. Il primo capitolo è dedicato allo studio e all'analisi letterale delle nuove disposizioni, delle quali viene ricostruito il contesto storico, politico e culturale, prendendo in considerazione la Costituzione – alla luce del dibattito svoltosi nell'Assemblea Costituente – e gli Statuti Regionali precedenti, oltre a quelli degli altri enti locali, come Province e Comuni. Il secondo capitolo affronta il problema dell'efficacia giuridica delle norme che formano l'oggetto di questo studio, confrontandosi sul punto con la giurisprudenza della Corte Costituzionale, in particolare con le sentenze 372, 378 e 379 del 2004 che, scegliendo un'argomentazione identica per trattare le dichiarazioni di principio presenti negli statuti toscano, umbro ed emiliano-romagnolo, ha stabilito che le “proclamazioni di obiettivi e di impegni [...] implicano una funzione, per così dire, di natura culturale o anche politica, ma certo non normativa”. Nello svolgimento di questo capitolo crediamo di riuscire a dimostrare con sufficiente chiarezza che le sentenze citate non si applicano necessariamente alle norme che riguardano il fatto religioso, di modo che l'efficacia di queste non ne è messa in discussione. Infine nel terzo e ultimo capitolo viene preso in considerazione il tema del rapporto tra ordinamento e i valori sottesi alla cultura religiosa, in particolare quella cristiana, in relazione ai principi costituzionali rappresentati dalla libertà religiosa e dalla laicità dello stato. In particolare si considererà come le norme considerate possano esprimere un'apertura esplicita da parte delle Regioni rispetto ai valori e alla tradizione culturale delle comunità che rappresentano. Council Regulation (EC) No 2157/2001 of 8 October 2001 on the Statute for a European company (SE) and Council Regulation (EC) No 1435/2003 of 22 July 2003 on the Statute for a European Cooperative Society (SCE), as well as other community acts, govern the legal status of the management organ with two-tier architecture of European structures for business association. In this paper, it is concluded that the management organ shall be responsible for managing the appropriate organizational and legal entities. Therefore, it can carry out day-to-day management of the organization according to the decisions of the general assembly and the supervisory authority. It is stated that assigning day-to-day operational management to the CEOs, members of the management organ, can be defined as transferring certain aspects of their power, while keeping their right of making final decisions. The collective character of the considered authority, carrying out its duties on the principle of collegiality, raises a line of questions, which are considered in this paper. Subjects of study are also the horizontal and vertical relationships of the management organ, considering the representative power, as well as the different types of responsibilities. The discussed problems are in a relatively legal aspect of the legal regulations of the Member States.

Résumé :
This paper summarizes the results of the physical anthropological examination of the middle and late Avar-period cemetery, excavated in 2003 at the site of Biatorbágy-Hosszúrétek. Distributions of gender and age at death are described along with the morphometric analysis, stature estimation, taxonomical description and the observations of the anatomical variations, pathologies, and the dental status. The most important results indicate the presence of the pure Mongoloid type individuals in such a high ratio that the population origin definitely can be traced back to Central Asia.

Abstract. Monuments and museums contents in the Mediterranean area have revealed a poor dynamic behavior and suffered large damages during past severe seismic events. Their protection deserved great research efforts due to their inestimable values and high cultural significance. From an analytic point of view, art and museum objects, statues and displays are generally modelled as rigid blocks and have been extensively studied in the non-linear dynamic context. On the other hand, only limited experimental researches have been carried out. Base isolation devices have proven to be highly effective in control the dynamic behavior of for statue-like items. This work presents an analytical and experimental study for the dynamical characterization of a bidirectional base-isolation device. The ability of the device in reducing the dynamic response of statue-like objects has been investigated by means of full-scale shaking table tests carried out at L.E.D.A. Research Institute at the “Kore” University of Enna. Experimental results are then used to calibrate an analytical model of the device. The Goddess of Morgantina statue has been selected as case-study due to its significance and since it is equipped with a base-isolating device in its present placement.

This paper applies the literary critique of translating poetry to the field of translating statute to raise significant constitutional and practical issues. The field of focus is taxation law, an area notable for its complexity and intricacy in a large number of countries. A linguistic argument is made that the demands that are made on the words of tax law parallel those made in poetry and this necessarily creates a demand for interpretation on the part of users of the law. This aspect of interpretation is then considered in situations that demand the translation of foreign and a number of constitutional and practical issues are highlighted in relation to the role of the translator. The issues raised in the paper are of significant importance in an increasingly globalised international tax world where statutes written in very different languages are called upon to interact with one another.
