The history of participatory budget (PB) in Poland is less than 10 years old. The occurrence of PB was to raisethe local government to a higher level of civil society by introducing so-called deliberative democracy. Forsome contemporary political thinkers, what defines politics is intersubjective dialogue conducted by citizensin an open and public space. Deliberative democracy is characterized by: a) elementary competences of theparticipants who have to become acquainted with the material concerning the issue concerned b) the needto formulate their position, which is the result of reflection, reflection on the issue c) civic debate where allproposals have the right to be presented, argued and discussed. The subject of this paper is the civic budget,also referred to as participatory budget (both names are often used interchangeably) as an expression of thewillingness of citizens to allocate funds that are available to local authorities. Editions of the citizens’ budgetin Krakow between 2014 and 2019 were analysed, the procedure and functions of this social institution wereshown.

Résumé :
The last day of Nazi German occupation of Siedlce started a new chapter in the life of the local community. Being destroyed in 75 percent, the town was far from its former status of an important regional centre of administration and education. As a result of military actions many buildings and schools were burned or destroyed. The local power plant and waterworks were damaged. The scale of damages and nonfunctioning of numerous, basic town facilities made the living situation of local citizens very complicated and hard to resolve. By de-scribing the extent of damages, the author tries to show the conditions in which the local community had to live and how difficult it was to recover after the mili-tary actions during the Second World War, including the battle of 1944. The violent political changes, which occurred after the Red Army’s ap-pearance, formed the background to rebuilding of the town and social recovery. Despite the propaganda and brutal political struggle, the imposed local gov-ernment was considered „foreign” by the majority of citizens. Having sketched the grim post-war situation of Siedlce’s residents, the author analyzes the causes of anxieties and later hostile attitude of the local society towards the new admin-istration built on the principles set by Polish Committee of National Liberation, whose operations changed the social landscape for the worse.

Obiettivo di questo articolo č di studiare le modalitÀ attraverso cui le due principali banche miste italiane, la Banca commerciale italiana e il Credito italiano, presero parte all'espansione del mercato edilizio ed immobiliare durante gli anni venti del Novecento e come invece reagirono alla successiva crisi, mettendo in luce le differenze esistenti tra i due istituti nel modo di operare sul mercato. Queste banche avevano giÀ operato nel settore ma fu negli anni venti che il loro intervento si strutturň in misura piů evidente, dapprima cogliendo le opportunitÀ offerte da una congiuntura nazionale favorevole agli impieghi immobiliari, in seguito venendo indotte dal mutato quadro economico a riorganizzare la propria rete di partecipazioni azionarie in societÀ del comparto. Il sostegno finanziario fornito a queste ultime negli anni di crisi sembra suggerire un comportamento anticiclico da parte delle due banche, prima che l'intervento dell'Iri mutasse profondamente le loro possibilitÀ d'intervento anche nel settore edilizio ed immobiliare.

“Obligation of a historic city”. Historiography of Poznań and its institutional contexts Using the example of Poznań, the article takes up the question of the connection between the development of research on the history of particular cities and their institutional establishment. Here, beside universities, a major role was also played by archives, libraries, academic and urban societies, as well as editorial offices of the periodicals they published. In the case of Poznań, which in the 19th century did not have a university, research on the city was inspired mainly by the German historical society. Between the wars, although the university had already been established, the initiating role was still played by local non-academic circles, gathered around the “Kronika Miasta Poznania” chronicle published by the Poznań city hall. After 1945, an ever increasing role was played by the university academic milieu, whose representatives carried out in the 1980s/1990s various publishing projects, creating and strengthening the group of researchers dealing with urban themes. After 1990 they gathered again around the “Kronika Miasta Poznania”, which inspired readers to examine different aspects of the city history.

One of the major objective of this essay is to show that Woody Allen’s Manhattan (1979) is a renewal of an old film genre called the city symphony. In this movie, the director outlined a suggestive portrait of his beloved New York City. After Annie Hall (1977), Manhattan is the second most complete expression of the specificity of Allen’s style, which consists of comic and tragic elements. Another object of this essay is to demonstrate that while creating the image of the metropolis the director particularly exploits the tools of film expression. Audiovisual layer of Allen’s work allows to juxtapose Manhattan with the city symphony (genre which came into being in the twenties as an innovative combination of documentary and avant-garde forms). The similarity between Manhattan and the original city symphonies is visible at the very beginning of the film, because of black and white, kaleidoscopic shots of metropolis as well as the backing sound (Rhapsody in Blue by George Gershwin). Allen’s picture is not only a sophisticated portrait of New York, but also the critical study of the society

Il tema dell'elaborato è l'introduzione del processo con giuria in Giappone, con una particolare riflessione sull'impatto che ciò ha determinato nella società giapponese contemporanea. L'elaborato si sviluppa in quattro capitoli, nel primo dei quali si discutono i cambiamenti legali avvenuti nel paese con la sua entrata nel periodo moderno. In particolare, si tengono in considerazione le trasformazioni dei maggiori Codici dell'Ottocento, la stesura della Costituzione Meiji e le tendenze politico-legali del periodo, che hanno spianato la strada per introdurre le prime forme di giuria. Nel secondo capitolo si spiegano i vari tentativi di introduzione del processo con giuria negli anni, a partire dalla giuria burocratica (sistema sanza) all'interno dei tribunali civili e di quelli militari. Si discute la giuria proposta da Gustave Boissonade e il dibattito che ha impedito la realizzazione della sua idea. Successivamente, viene spiegato il passaggio nell'era Taishō e i conseguenti cambiamenti, la promulgazione della Legge sulla Giuria nel 1923 e il funzionamento della giuria pre-guerra. Infine, si parla della nuova costituzione del 1946, e delle proposte di giuria nel periodo di occupazione americana. Nel terzo capitolo vengono spiegati i passaggi che hanno portato all'attuazione della Legge sulla Giuria del 2009, e all'attuale sistema saiban'in seido. Partendo con una spiegazione delle maggiori riforme della fine del Novecento, al cui fulcro vi era la proposta di introdurre una giuria, e di coinvolgere maggiormente i cittadini nel sistema della giustizia. Viene poi discusso il funzionamento della giuria mista giapponese, il tipo di casi adatti ad essa, e il processo di selezione dei giudici popolari. Vengono esaminate le varie posizioni all'interno del dibattito locale, partendo da quelle a favore, fino a quelle contrarie al sistema, e si conclude il capitolo con un caso di studio sulla prima esperienza del sistema a giurie miste, nel 2009. Nell'ultimo capitolo, infine, si discute effettivamente dell'impatto che questa esperienza ha nella vita e nella sfera emotiva dei giurati laici. Confrontando le statistiche e i sondaggi proposti annualmente dallo Stato, si mettono in evidenza le caratteristiche e i problemi legati all'aspetto psicologico, e si cerca di dare una valutazione del sistema, anche in relazione al raggiungimento degli obiettivi per cui era stato creato. Successivamente, si valuta un problema della giustizia giapponese, e l'impatto che la giuria mista ha avuto su esso. Si tratta della pena capitale, con particolare riferimento all'andamento delle esecuzioni negli ultimi anni, dopo l'introduzione della giuria mista. Si analizzano poi alcune testimonianze dirette di ex giurati, per verificare il pensiero dei cittadini prima e dopo l'esperienza. Per concludere, si riassumono gli obiettivi posti dal governo con l'introduzione della giuria mista, e si analizza quanti di questi sono stati realizzati, facendo una valutazione generale del sistema, anche in luce di ciò che pensano i cittadini giapponesi.

A tese tem por objeto o estudo da participação do Estado como sócio de empresas que não integram a Administração Pública. Parte-se da constatação de que o Estado tem se valido de técnicas de engajamento empresarial em que uma empresa estatal é sócia de uma empresa privada e, nessa condição, exerce seus poderes de sócio para influenciar em alguma medida a atuação da empresa. Tal sistemática é utilizada por instituições financeiras de fomento (como o BNDESPAR), foi empregada nas recentes concessões de aeroportos, e é bastante utilizada para a diversificação das atividades realizadas por empresas estatais (como a Petrobras e a Eletrobras). Na tese, denominam-se essas sociedades de empresas público-privadas. As empresas público-privadas são sociedades comerciais privadas, não integrantes da Administração Pública, em que o Estado, por meio de um ente estatal, participa como sócio e se vale de instrumentos societários destinados a direcionar o comportamento da empresa para a realização de determinados objetivos públicos previstos no ordenamento jurídico, mas sem possuir, de modo permanente, preponderância no exercício do poder de controle. O trabalho busca compreender inicialmente por que o Estado atua por meio de organizações empresariais e como se dá a sua relação com os particulares em ambiente societário. Depois, faz-se uma caracterização mais apurada das empresas público-privadas e da técnica acionária como forma de intervenção na economia. Examinam-se em seguida os objetivos, os impactos e as limitações de tal técnica de intervenção, bem como o regime jurídico das empresas público-privadas e a questão da escolha do sócio privado. Por fim, analisa-se a utilização dos acordos de acionistas e das ações de classe especial (golden shares) nas empresas público-privadas. A tese busca contribuir para o estudo do tema, que até o momento recebeu pouca atenção dos estudiosos.<br>La tesi ha lo scopo di studiare la partecipazione dello Stato come azionista delle società che non fanno parte della Pubblica Amministrazione. Parte dal fatto che lo Stato ha un tecniche di coinvolgimento in cui una impresa statale è socio di una società privata e, come tale, esercita i suoi poteri per influenzare in qualche misura il funzionamento della società. Questo viene utilizzato sistematicamente per le istituzioni finanziarie di sviluppo (come BNDESPAR), è stato utilizzato nelle recenti concessioni aeroportuali, ed è ampiamente utilizzato per la diversificazione delle attività svolte dalle imprese statali (come Petrobras e Eletrobras). Queste aziende non sono parte della Pubblica Amministrazione, ma il socio statale si basa su strumenti aziendali per dirigere il comportamento della società per raggiungere determinati obiettivi pubbliche previsti dalla legge. La ricerca inizialmente analisa perché lo Stato agisce attraverso le organizzazioni imprenditoriali e come è il suo rapporto con gli individui in ambiente aziendale. In secondo luogo, è fatta una caratterizzazione più precisa di imprese pubbliche-private e della tecnica di partecipazione come un intervento statale nell\'economia. Essere esaminati poi i gol, gli impatti e i limiti di tale tecnica di intervento, il quadro giuridico per le imprese pubbliche-private e la questione della scelta del partner privato. Infine, la tesi analizza l\'uso dei patti parasociali e dei azioni speciali (golden shares) in aziende pubbliche-private. La tesi si propone di contribuire allo studio del soggetto , che finora ha ricevuto scarsa attenzione da parte degli studiosi.

This research deals with the comparison between competition rules and water services. The first Chapter analyses the relationship between water service and public services in general. The first Chapter also identifies the most peculiar characteristics (legal and economic) of water services. The second Chapter analyses italian water law and its application, in order to identity the main problems in the administration and regulation of water services. The third Chapter compares Italian water law with the law of other EU States. The last Chapter deepen the analysis of the most problematic aspects in the administration and regulation of italian water services, in order to suggest possible legal solutions to the most problematic aspects.

Il lavoro mira a fornire un complessivo inquadramento dell'istituto della società mista, identificato in primo luogo quale strumento di diritto privato a cui partecipano soggetti pubblici e soggetti privati. L'indagine si svolge su differenti piani di valutazione. Si dà ragione delle caratteristiche peculiari di tale contratto associativo e dei limiti che il nostro ordinamento impone allo sviluppo della figura. L'attenzione si sposta poi sulla specifica declinazione che il modello di società mista ha assunto in ambito europeo attraverso l'analisi del partenariato pubblico privato istituzionalizzato. L'istituto è di particolare interesse perchè individua nella società mista un modello organizzativo dai tratti specifici, all'interno del quale il ruolo del socio privato assume connotazioni e forme non comuni a tutti i modelli societari. La ricerca mira a mostrare come tale figura ha trovato riscontro nell'ordinamento interno e quali possibili sviluppi la stessa possa trovare in differenti campi della vita economica. In questi termini, si cerca di valutare quale sia l'incidenza delle procedure competitive nella costituzione e nella vita della società mista ed in che termini lo svolgimento delle attività affidate al socio privato debba essere inquadrato all'interno del rapporto di partenariato. Sul punto è centrale la declinazione fornita all'istituto in relazione ad uno specifico ambito di attività: i servizi pubblici locali di rilevanza economica. In questo contesto, particolarmente rilevante sul piano sistematico è la ricerca di un equilibrio tra il rispetto delle disciplina posta a tutela della concorrenza, ed il perseguimento delle finalità che hanno portato alla scelta di costruire una società mista. La scelta in favore di tale modello organizzativo pare infatti giustificata solo qualora essa apporti un reale vantaggio nella gestione del servizio e la realizzazione di concrete sinergie positive.<br>The present research aims to provide an view of IPPP, as an instrument of private law bringing together public and private entities. Firstly, it focuses on the peculiar characteristics as well as limitations of this type of contract. Institutionalised public-private partnerships are interesting having regard to operative organization, especially to the role of the private partner. Secondly, the research shows how the Italian legal system receipt this figure along with likely developments. In these way, the thesis assesses the impact of competitive procedures in the companies constitution and life, and how the execution of the tasks assigned to the private partner should be framed within the partnership. Moreover, a central point of the analyses is hoe such institutions are configured in relation to a specific area of activity: local public services. In this context, the balance between the protection of competition and the pursuit of the scope of the partnership has a special place. The choice of this operative solution seems justified only if it provides a real benefit in the management of the service and the realization of a real partnership.

The justice and the wellness, as drivers of those policies, are evaluated in the formation of justifying public interest the adoption of unusual practices in business activity and often distanced profit purpose and duty of loyalty to which these companies are subjected, because of its commercial nature. They are also the object of study the principles of economic order positivized in the 1988 Constitution, the question of the right to private property as a fundamental right and a state responsibility as principles that guide the action of governments in the capital market. In the finish, it is the company's management, the controlling shareholder and the legal status of minority shareholders. These topics deepen the corporate issue, which puts him at odds state interests (often a government) on the one hand and the interests of minority shareholders of another, creating administrative and judicial proceedings that may lead to disastrous convictions against companies controlled by State. The findings point to a hermeneutic aspects of output, which seeks to adapt the objectives of the Welfare State and the legitimate economic interests of the investors of joint stock companies.<br>O presente trabalho almeja investigar o processo de constru??o das pol?ticas de gest?o de sociedades de economia mista, as quais v?m impondo reiterados preju?zos ? minoria acion?ria, respons?vel pelo aporte de capitais que viabilizam tais investimentos. A justi?a e o bem comum, como propulsores dessas pol?ticas, s?o avaliados na forma??o do interesse p?blico justificador da ado??o de pr?ticas incomuns na atividade empresarial e, muitas vezes, distanciadas do intuito de lucro e do dever de lealdade aos quais essas companhias est?o submetidas, em raz?o de sua natureza mercantil. Tamb?m s?o objeto de estudo os princ?pios da ordem econ?mica positivados na Constitui??o de 1988, a quest?o do direito ? propriedade privada como direito fundamental e a responsabilidade estatal como preceitos que norteiam a a??o dos governos no mercado de capitais. No arremate, trata-se da administra??o da companhia, o acionista controlador e o regime jur?dico dos acionistas minorit?rios. This dissertation examines two ideological clashes underlying contemporary political theories of linguistic justice (instrumentalism/constitutivism; monism/pluralism) with the aim to elucidate (a) why languages matter to people, in terms of communication and identity-related interests, and (b) how these interests work in mixed societies, where members of different language groups live intermingled. It combines theoretical analysis and empirical evidence obtained through the study of 112 linguistic regulations adopted in western democracies. First, it critically analyzes current theories. Second, it contributes a typology of valued ends for language policies and a comparison of their uses in language acts. Finally, it develops the concept of mixed society, identifies and characterizes some cases and suggests lines of suitable language policies for them. The thesis concludes that linguistically plural societies require pluralist solutions, grounded both on communicative and identity interests, and argues that in mixed societies policies should foster a reciprocal bilingualism, sustainable over time, to favor fair conditions of choice.<br>Aquesta tesi examina dos conflictes ideològics subjacents en les teories polítiques contemporànies de la justícia lingüística (instrumentalisme/constitutivisme; monisme/pluralisme) amb l’objectiu d’elucidar (a) per què les llengües importen les persones, en termes d’interessos de comunicació i identitat; (b) com aquests interessos funcionen en societats mixtes, on conviuen membres de diferents grups lingüístics. La tesi combina l’anàlisi teòrica amb l’evidència empírica obtinguda de l’estudi de 112 lleis lingüístiques adoptades en les democràcies occidentals. Primer, fa una anàlisi crítica de les teories actuals. Després, aporta una tipologia d’objectius valuosos per a les polítiques lingüístiques i compara com els utilitzen les lleis. Finalment, desenvolupa el concepte de societat mixta, n’identifica i en caracteritza casos i hi suggereix línies de polítiques lingüístiques adequades. Conclou que les societats lingüísticament plurals requereixen solucions pluralistes, basades tant en interessos comunicatius com d’identitat, i argumenta que en les societats mixtes convé promoure un bilingüisme recíproc, sostenible en el temps, per afavorir condicions equitatives de tria.

La ricerca intende affermare che il partenariato pubblico privato istituzionalizzato è un’organizzazione ibrida all’interno della quale, le due parti (quella privata e quella pubblica) combinano impegni comuni ed obiettivi confliggenti. La ricerca rivela i tratti giuridici significativi, all’interno dell’ordinamento italiano, del partenariato pubblico-privato istituzionalizzato dove la partecipazione comune avviene all’interno della società di capitali. L’approcio al partenariato pubblico-privato istituzionalizzato secondo la teoria dei costi di transazione offre una nuova prospettiva circa la ricostruzione giuridica della cooperazione tra il soggetto pubblico e la parte privata. Le organizzazioni ibride costituite in forma di società di capitali forniscono soluzioni per la gestione dell’incertezza conseguenti all’incompletezza contrattuale attraverso l’inserimento della relazione di partenariato all’interno del sistema societario di amministrazione e controllo. In dipendenza del lungo periodo di funzionamento, il partenariato pubblico-privato istituzionalizzato deve essere in grado di adattarsi a cambiamenti nell’ambiente economico, giuridico e tecnologico e tali cambiamenti debbono essere considerati ed approvati nel contesto della relazione societaria tra il soggetto pubblico ed il socio privato. L’analisi, dedicata al sistema giuridico italiano, conferma che il diritto delle società di capitali ed il diritto amministrativo rilevano effettivamente e svolgono un ruolo cruciale nella costruzione appropriata della transazione tra le parti al fine di evitare squilibri di relazione tra il socio privato e la Parte Pubblica, la quale opera anche come Pubblica Autorità (il c.d. “problema di doppio allineamento”).<br>Core assumption of the research is that the joint participation and cooperation of public and private parties in a corporatized entity could be regarded and reconstructed as a hybrid organization within the theoretical model of the Transaction Cost Economics (TCE). The research is inteded to affirm that the IPPP is a hybrid” where the two parties (the public and the private one) combine joint efforts and competing goals. The research reveals the most distinctive legal features, within the Italian Jurisdiction, of this form of “Institutionalized PublicPrivate Partnerships (IPPP)” where the joint participation takes place within a corporatized entity. The TCE Approach to Institutionalised Public-Private Partnerships (IPPP) offers a new perspective on the legal reconstruction of the cooperation between the public entity and the private party. The Corporatized Hybribs organizations provide solutions to manage uncertainty due to contract incompleteness by means of embedded relationships within the corporate governance framework. Due to the long-term functioning, the IPPP must be able to adjust to changes in the economic, legal or tecnological environment and those changes must be assessed and approved in the context of the corporate relationship between the public entity and the Private Partner. The analysis, focused on the Italian legal system, confirms that company law and administrative law do matter and play a key role in the appropriate design of the transaction in order to avoid unbalanced relationship between the Private Partner and the Public Party which acts as Public Authority too (the so called “double alignment problem”).

It is all very well to contemplate what policies are likely to prove effective and just, as we did in Chapters 4 and 5, but that assumes we have some effective authority to put them into practice. So comparisons of (for example) emissions trading schemes against carbon taxes as ways of achieving greenhouse gas emissions reduction need some kind of body to craft the policy and implement it effectively. Sometimes that body will be a sovereign government, but sometimes the government is missing altogether or has only partial jurisdiction—for example, if a carbon trading scheme can extend across national boundaries. When government is missing we can however still speak of processes of governance— notably at the global level. “Governance” is a broader concept that allows for more fluid, informal, and transnational arrangements, though it can also include government as conventionally defined. Global inaction on greenhouse gas emission reduction and inadequate national policies are sometimes blamed simply on an absence of political will. But a big part of the story is that if we can’t get the structure and process of governance right, we are not going to get the policies right. So it remains remarkable that some high-profile proposals either ignore the governance question altogether, or treat it in simplistic terms. For an example of ignoring governance altogether (doubly remarkable in that the person doing it is a political scientist) consider the policy proposals ranked by a group of experts assembled by Bjørn Lomborg under the auspices of his Copenhagen Consensus Center (Lomborg, 2010). Using cost–benefit analysis plus expert judgment, the top three solutions were: 1. Marine cloud whitening research 2. Energy research and development 3. Stratospheric aerosol insertion research The first of these would require creating mists from sea water to create clouds that better reflect sunlight, the third injecting tiny particles into the atmosphere to simulate the cooling effects of volcanic eruptions. Though cast in terms of “research” the reason for this ranking is the anticipated net benefit of the anticipated policy (policies to reduce greenhouse gas emissions came bottom).

The aim of this article is to present an image of the fallen German capital, as seen through the eyes of Soviet and American political officers, responsible for rebuilding German life in the sectors of Berlin they occupied. The image of Berlin presented in this article is a picture of the city as seen primarily through the eyes of Soviet officers: Alexander Dymschitz, a literary scholar and cultural editorial staff member at the Tägliche Rundschau newspaper published by the Russians as early as 15 May, Sergei Tjulpanov – head of the Propaganda Board of the Soviet Military Administration in Germany (SMAD), and Grigory Weiss, an officer in the Cultural Department of SMAD. The narrative is supplemented by testimonies of Western Allies – memoirs of General Frank L. Howley and reports of American political officers, a selection of which was presented in 1979 by historian Brewster S. Chamberlin. The aim of the narrative based on the above-mentioned sources will be to show Berlin through the eyes of the Allies, which will also serve as a pretext for asking the question about the so-called “Americanisation” and “Sovietisation” of German society immediately after the end of the Second World War.

Bach’s last two decades saw him gradually distancing himself from his official responsibilities and engaging more with, first, the Collegium Musicum, then the revision and codification of his major compositions. These years were darkened by disputes with his superiors around 1730 and again in the mid-1730s (the “Battle of the Prefects”); the death of a son in 1739; and a crisis involving the direction of the Collegium and published criticism of Bach’s music. Yet Bach also gained a royal title in 1736, following submission of the B-Minor Missa to the elector, and in 1747 he made a celebrated visit to the Prussian court, where his son Emanuel had become a royal chamber musician. Although afflicted during his final months with blindness, the result of a botched eye operation, Bach continued to teach and was honored by membership in Mizler’s Corresponding Society.

Abstract The challenge of ideational insurgency is that it does not provide the state with a physical target, an aim for its response. De-territorialized, the insurgency spreads out like a mist, until it is everywhere. The result is not a cataclysmic defeat of the state, but more like a death by a thousand cuts, as societal norms and values shift to accommodate an increasingly unassailable force. This chapter presents options for state response. Three major categories of response are discussed--disruption through law enforcement; suppression through online censorship; and the fostering of individual and societal resilience, be it through counter-messaging, preventive interventions, or education on media and digital literacy. This chapter lays out these three approaches, pointing to the U.S. context and its targeting by both the ISIS and alt-right ideational insurgencies. The implications for state response are vast and touch upon freedom of speech, disinformation, trust, as well as societal cohesion and resilience. In turn, ideational challenges force a major rethink of what is meant by counterinsurgency.
