Furthermore, the dissertation deals with some crucial points on the subject, like the nature of collegio sindacale’s control function and the functions relationship between the collegio and the Bank of Italy.

Texte intégralThe work analyzes the evolution of the management of the trade union’s dissent and, in particular, it aims to offer a systematic reconstruction of the normative and an analysis of the majority principle in the context of labor relations, considering their current and potential effects. This especially because, in cases of periodic interruption of the action of the major trade union federations, the “major revolution” - already been adopted in the public sector – is often referred as the fundamental solution to conflicts; that’s why it is accepted by the recent inter-confederation agreements. But what is the relation between the union democracy and the majority rule? The answer is provided in the four chapters of the work, with the historical and reconstructive approach, through the study of the grounds and the limits of the majority principle both in its associated field and in the evolution of labor relations, with the goal of reaching the analysis of “Testo Unico del 10 gennaio 2014” and art. 8, d.l. 138/2011 (l. n. 148/2011)”. Finally, in the last chapter, we are going to discuss, in case of a trade union law, the challenges and the concrete problems that the possible adoption of the majority rule could provide.

Texte intégralOggetto della ricerca è l’analisi della gestione del conflitto sindacale nelle relazioni industriali nell’Unione europea, e in particolare l’assenza del riconoscimento dello sciopero tra le materie legislative di competenza della Comunità europea. Lo studio è strutturato in tre capitoli. Il primo è dedicato all’esame degli aspetti fondamentali del sistema di relazioni industriali in Europa; in particolare vengono ripercorse le tappe dell’evoluzione del dialogo sociale, i principali attori e regole, le differenti modalità di organizzazione delle parti sociali, le forme di partecipazione dei lavoratori nonché il sistema delle relazioni industriali nell’Unione Europea. Il secondo capitolo è incentrato sul tema del riconoscimento all’interno dei diritti sociali fondamentali “comunitari”, del diritto di sciopero. In particolare, nei paragrafi centrali l’attenzione si incentra, sul diritto dei lavoratori a ricorrere ad azioni collettive per la difesa di propri interessi, così come sancito nella Carta dei Diritti Fondamentali dell'Unione Europea, (proclamata a Nizza il 18 dicembre 2000). Nonostante tale importante riconoscimento, la regolamentazione del diritto di sciopero non rientra tra le materie legislative di competenza della Comunità europea (art. 137.5, del TUE, ora art. 153.5 TFUE). L’esclusione può essere letta come espressione della volontà politica degli Stati membri di rispettare gli standard nazionali, rinunciando a qualsiasi interferenza del diritto comunitario su un terreno nel quale è difficile prospettare armonizzazioni normative, in ragione della eccessiva difformità delle discipline nazionali. Tale scelta ha, tuttavia, determinato una grande differenziazione tra le discipline nazionali, con particolare riferimento alla regolamentazione dello sciopero nei servizi pubblici essenziali. Il tema dell’esclusione si è riproposto e acutizzato negli ultimi anni a seguito di una serie di pronunce della Corte di Giustizia, relative ai casi Viking, Laval e recentemente Commissione vs Germania. In particolare, nel secondo paragrafo sono analizzate le sentenze Viking e Laval, abbinate non solo dal contenuto, ma anche dalla prossimità temporale, la prima dell’11 dicembre, la seconda del 18 dicembre 2007 che registrano un cambiamento rispetto alla precedente fase di indifferenza, in quanto per la prima volta, il diritto di sciopero è riconosciuto come diritto fondamentale dell’Unione europea. L’attenzione è posta anche sulla recentemente pronuncia della Corte di Strasburgo sul diritto di sciopero che con la sentenza Enerij del 21 aprile 2009 marcherebbe una netta evoluzione giurisprudenziale, in quanto si potrebbe sostenere che la Corte abbia ritenuto che il diritto di sciopero, fintantoché è esercitato per sostenere la contrattazione collettiva, è ugualmente essenziale alla libertà sindacale e pertanto direttamente riconosciuto e tutelato dall’art. 11 della Convenzione Europea per i Diritti dell’Uomo. Il terzo capitolo, infine, si propone, pertanto, di analizzare comparativamente le soluzioni legislative adottate dall’ordinamento italiano, francese, inglese e tedesco, riguardo la disciplina dell’azione di autotutela collettiva e del diritto di sciopero nei servizi pubblici essenziali nei principali Paesi dell’Unione Europea dove, i differenti ordinamenti nazionali rendono difficile un confronto teso al raggiungimento di una disciplina comune. In particolare, la legislazione italiana con la previsione di una apposita Commissione di garanzia, quale autorità pubblica indipendente, cui sono affidati compiti di verifica e anche di statuizione in relazione alle prestazioni indispensabili da effettuare per garantire ai cittadini la possibilità di continuare a fruire, seppure con delle limitazioni, dei propri diritti costituzionalmente tutelati, rappresenta un caso unico in Europa che pone l’Italia sotto questo profilo in una posizione più avanzata rispetto all’Europa.

Texte intégralThe search starts with the reconstruction of socio-economic processes. Moving from these reflections, it's possible to see that today's companies take advantage of increasingly self-employed coordinated and continuous and, after d.lgs. 276/2003 “lavoratori a progetto”. These employees are, therefore, subject to a power (contractual) coordination of the customer that, at times, it adds up to a state of economic dependence by the same. It then creates an internal differentiation into autonomy area that does not seem properly valued by the ordinary legislator, but that seems to involve trade unions. Given that in reality there are different representations, we move to circumscribe the scope of applicability of the Arts. 39 and 40 Const. The absence of a genuine interest and genuine self activities suggest that employees "strong" and its associations can only benefit from the protections posed by Arts. 2, 18 and 41 Const. At the end tackling the problems so that the reconstruction turn raises, namely how to ensure the effectiveness of the safeguards recognized unionism collaborators "weak" and reconcile the associations of employees "strong" with the antitrust law.

Texte intégralIn the Italian legal framework, the question concerning the regulation of procedures and contents of collective bargaining represents one of the major labour law issues, which has not found a satisfying solution yet. The abovementioned topic is, in addition, strictly connected to the selection of criteria aimed to determine the actors of the bargaining process. The purpose of the present dissertation is then to examine, first of all, the historical development of the debate on the aforementioned issues in the Italian context, to focus attention, afterwards, on the most recent instances to enact a clearer regulation of the bargaining process, in reason of the crisis of trade unions’ cohesion and of the fragmentation of production originated by globalisation. Finally, the last part of the dissertation will be centred on a comparative analysis with the French regulative context that, in opposition to the Italian one, disciplined by law prerequisites and procedures to accede to collective bargaining process already at the beginning of XX Century. In particular, the first chapter starts from the matter of contention at the base of the whole national discussion referred to the regulative process of arrangements executed between employers’ and workers’ organizations: the incapability of the Italian legislator to enact a law concerning the collective bargaining proceeding respecting, in the meantime, the criteria set forth by Article 39 of the Constitution, that has been at the base of the consequential declaration of illegitimacy of all the legislative attempts to generalize the efficacy of the considered agreements, circumventing the provision of the Fundamental Chart. The analysis continues focusing on the evolution of collective agreements regulated by civil law in the national legal framework: highly centred during the Fifties, then organized on two ordered levels in the brief period of “contrattazione articolata” – introduced initially in public industries with the Protocol Intersind-Asap of 1962 and soon extended to the private field – until the total independence between company and sectorial bargaining level in the years between the end of the Sixties and the beginning of the Seventies, and to the particular characteristics assumed by the said agreements during the oil crisis and in the following years, when the practice of the three-side covenants executed between main trade unions, employers’ organizations and the government, with different outcomes, perdured until the middle of 2000’s. In this context, particular attention is devoted to the collective agreements executed at national level in July-December 1993 that, during the following twenty years, have been considered the fulcrum of the two-level collective bargaining system, and which attempted, in the meantime, with the introduction of Trade unions’ Unitary Representative bodies (in Italian, Rappresentanze Sindacali Unitarie, RSU) to contrast the deep crisis of representativeness of workers’ organizations, whose gravitas has been highlighted, several months after, by the national referendum held in 1995 on Article 19 of law no. 300 of 1970. The last section of the first chapter founds an ideal continuation in the second one. In this field, the main topic become the most recent issues concerning the Italian bargaining system, and significantly the one which moved social actors of the industrial sector – on the base of the crisis of the system of 1993, showed by the Fiat dispute of 2009-2011, followed by the connected judgment of Constitutional Court that in 2013 modified another time the interpretation of Article 19 of law no. 300 of 1970, expanding the criteria to admit workers’ organization to benefits provided by the law, and by the enactment of Article 8 of law-decree no. 138 of 2011 – to affirm that is come the time to set new rules to try to govern the bargaining system. On this point, the dissertation focuses attention on the three national collective agreements held on 28 June 2011, 31 May 2013 and 10 January 2014 and on the further arrangement of 28 February-9 March 2018 and on the respective debate centred, in a perspective of reform, on the opportunity to introduce a bill able to completely fulfil the requirements of Article 39 of the Italian Constitution. The third chapter, finally, follows the scheme of the precedent ones, from the point of view of the French legal framework. Therefore, firstly is described the evolution of the said juridical context, from the loi of 1919 concerning collective agreements regulated by civil law and the regulations of 1936 and of 1950 on the extension erga omnes, through an administrative decree, of collective agreements signed by representative trade unions, until the new model of “citizenship in the company” promoted by the laws Auroux enacted in 1982 and to the fragmentation of the labour law system occurred between the 80s and 2000s, characterised by measures without a systematic approach and, sometimes, in contrast between each other. The attention is focused, then, on the reforms that, recently, heavily redefined the structure of the French labour law framework consisting in the introduction, in 2008, of objective criteria to select representative trade unions, in the extension of this model to employers’ organizations in 2014-2016 and, with reference to the bargaining structure, in the disputed reform responding to the name of loi Travail, held in 2016, and in the ordonnances promoted by the new President Macron in the late 2017, towards the direction of a relevant and decisive expansion of company collective agreement, to the detriment of sectoral level. The arrival point of the path traced above regards the attempt to reply to the issue concerning the opportunity to provide or not, in the Italian context, for a law regulating collective bargaining and the related obligations and rights of social actors, to clarify and stabilize the arrangement system. Secondly, also on the base of the comparison with the French frame of reference, the dissertation is closed by a reflection on the possible legal institutes to be introduced in the Italian juridical framework, in order to assure a general extension of collective bargaining, in the light to allow an harmonious development also of the company level.

Texte intégralThe research work that presents itself is divided into three chapters, in which it is examined the issue of job instability. In the first chapter, the candidate shows the causes that led to the dizzying increase in use of flexible contracts and, in this regard, analyzes the European directives, principles and guidelines that, in the path of development of the European strategy for employment, have placed the 'flexicurity' as a typical model of European labor market; from the same perspective, paying attention to the theme of social problems of the global markets, it analyzes to the economic investigation of labor law and, in particular, the consequences for job security related to the economic transformations. The second chapter is devoted to the role played by trade unions in Italy on the issue of flexibility. In this sense, the author shows how the "institutional" function which are also called to comply workers' organizations has also characterized the political choices of trade unions' in the field of temporary work; so are examined the concepts of flexibility "negotiated", as already shown in the literature, and are theorized the differences between mandate "open" and "closed", such as different forms of delegation of legislative power to the trade unions in the theme of flexibility. In the third and final chapter the author tries to highlight the benefits and features that relate to the use of fixed-term contracts, as the main form of flexible contract in use in our labor market. Introduced such benefits, he made a critical judgment about the degree of liberalization of this type of labor contract considered that in the last reforms is always more the arbitrariness in the choice of the employer of the duration and conditions of carrying out the work performance.

Texte intégralResumo: No presente trabalho, a organização sindical brasileira é estudada na confrontação com um modelo democrático de relações coletivas de trabalho, concebido a partir de normas da Organização Internacional do Trabalho acerca do assunto, e apresentado por intermédio do Direito Estrangeiro, centralmente Estados Unidos da América e Itália, e dos princípios comuns que o informam na União Européia. A inexistência de liberdade à associação sindical brasileira é verificada no seu relacionamento com o Estado, que mantém a sindicalização por categoria econômica e profissional em todos os graus da organização sindical - dessa maneira são excluídas as centrais sindicais - e a contribuição sindical obrigatória, e institui a unicidade sindical na Constituição Federal de 1988, bem como com outras entidades sindicais, que, desde a unicidade sindical, não têm meios para demonstrarem mais representatividade, de sorte a substituir outro sindicato em seus âmbitos pessoais e territoriais de representação legal. As causas da manutenção, a persistência das apontadas notas, que serviram de parâmetros para estudo do Direito Estrangeiro e dos referidos princípios, bem como a necessária reforma, são problematizadas no contexto das pretensões de reforma no Direito Coletivo do Trabalho, advogadas na década de 90 e informadas pelo deliberado propósito de modernização das relações de trabalho, no sentido de serem mais disciplinadas mediante negociação coletiva. Riassunto: In questo lavoro, l'organizzazione sindacale brasiliana viene studiata in confronto col molello democratico dei rapporti collettivi di lavoro concepito a partire dalle norme della Organizzazione Internazionale del Lavoro sull' argomento, e presentato tramite il Diritto Straniero, specie negli Stati Uniti d'America e Italia, e dei principi comuni che lo informano nell'Unione Europea. L'assenza di libertà all'associazione sindacale brasiliana viene confermata nel suo rapporto com lo Stato, che mantiene la sindacalizzazione per categoria economica e professionale in tutti i livelli dell'organizzazione sindacale - cosiquè sono escluse le centrale sindacali - e il contributo sindacale obbligatorio, e stabilisce l'unicità sindacale nella Costituzione Federativa del 1988, così come con le altre entità sindacali, che fin dalla unicità sindacale non riescono a dimonstrare piú rappresentatività, in modo da sostituire un'altro sindacato nei suoi ambiti personali e territoriali di rappresentazione legale. Le cause della manutenzione, il persistere degli appunti, che sono stati presi come parametri per gli studi del Diritto Straniero e dei principi riferiti, così come la necessária riforma, sono questionati nel contesto delle pretensioni di riforma nel Diritto Collettivo del Lavoro, diffese negli anni'90 ed informate dal deliberato proposito di modernizzazione dei rapporti di lavoro con l'intenzione di renderli piú disciplinate tramite trattativa collettiva. Texte intégralThe thesis analyses the impact of international labour standards about freedom of association on national legal systems and on the European level, to verify if they can reinforce the protection of collective social rights. The research starts from a survey of ILO sources on freedom of association, considered as a fundamental right to be promoted universally, and from the definition, provided by the supervisory bodies, conceiving strike as an “intrinsic corollary” of the right to organize. The thesis focuses on the use of international labour standards by judges in the context of the cooperation among judiciary authorities and quasi-judicial specialized bodies. In particular, the research considers some judgments of the European Court of Human Rights, as Demir and Enerji Yapi, where ILO instruments, together with the European Social Charter and the decisions of the European Committee of Social Rights, were used to extend the scope of art. 11 ECHR so as to cover the right to collective bargaining and collective action. In the light of the Lisbon Treaty modifications, the thesis considers, after the ECJ rulings in the Viking and Laval cases, if and how ILO standards and the recent ECHR case-law may have a positive impact on EU, stimulating a fairer balancing between economic freedoms and social rights.

In questo lavoro, l'organizzazione sindacale brasiliana viene studiata in confronto col molello democratico dei rapporti collettivi di lavoro concepito a partire dalle norme della Organizzazione Internazionale del Lavoro sull' argomento, e presentato tramite il Diritto Straniero, specie negli Stati Uniti d'America e Italia, e dei principi comuni che lo informano nell'Unione Europea. L'assenza di libertà all'associazione sindacale brasiliana viene confermata nel suo rapporto com lo Stato, che mantiene la sindacalizzazione per categoria economica e professionale in tutti i livelli dell'organizzazione sindacale - cosiquè sono escluse le centrale sindacali - e il contributo sindacale obbligatorio, e stabilisce l'unicità sindacale nella Costituzione Federativa del 1988, così come con le altre entità sindacali, che fin dalla unicità sindacale non riescono a dimonstrare piú rappresentatività, in modo da sostituire un'altro sindacato nei suoi ambiti personali e territoriali di rappresentazione legale. Le cause della manutenzione, il persistere degli appunti, che sono stati presi come parametri per gli studi del Diritto Straniero e dei principi riferiti, così come la necessária riforma, sono questionati nel contesto delle pretensioni di riforma nel Diritto Collettivo del Lavoro, diffese negli anni'90 ed informate dal deliberato proposito di modernizzazione dei rapporti di lavoro con l'intenzione di renderli piú disciplinate tramite trattativa collettiva. Parole-chiave: libertà sindacale; inquadramento sindacale; struttura sindacale; molello dei rapporti di lavoro.
No presente trabalho, a organização sindical brasileira é estudada na confrontação com um modelo democrático de relações coletivas de trabalho, concebido a partir de normas da Organização Internacional do Trabalho acerca do assunto, e apresentado por intermédio do Direito Estrangeiro, centralmente Estados Unidos da América e Itália, e dos princípios comuns que o informam na União Européia. A inexistência de liberdade à associação sindical brasileira é verificada no seu relacionamento com o Estado, que mantém a sindicalização por categoria econômica e profissional em todos os graus da organização sindical - dessa maneira são excluídas as centrais sindicais - e a contribuição sindical obrigatória, e institui a unicidade sindical na Constituição Federal de 1988, bem como com outras entidades sindicais, que, desde a unicidade sindical, não têm meios para demonstrarem mais representatividade, de sorte a substituir outro sindicato em seus âmbitos pessoais e territoriais de representação legal. As causas da manutenção, a persistência das apontadas notas, que serviram de parâmetros para estudo do Direito Estrangeiro e dos referidos princípios, bem como a necessária reforma, são problematizadas no contexto das pretensões de reforma no Direito Coletivo do Trabalho, advogadas na década de 90 e informadas pelo deliberado propósito de modernização das relações de trabalho, no sentido de serem mais disciplinadas mediante negociação coletiva. The thesis stresses that a statutory regulation in this field is not needed with reference to sectoral collective bargaining, but it could be necessary as regard to collective bargaining and workplace representatives at firm level. The thesis outlines the guidelines for a possible regulatory intervention, focusing on the functions of workplace representatives, trade union rights, collective bargaining coverage, no-strike clauses and the relationship between decentralised and sectoral collective bargaining agreements.

Texte intégralThe doctorate thesis “Labor relations after the “Fiat case” examines the corporate contracts between Fiat and trade unions in the factories of Pomigliano and Mirafiori in 2010. These contracts are considerated by lot of observers a real revolution in the labor relations. Fiat, effectively, out of Confindustria, wanted to create, with these contracts, a juridical context in wich there is only an applicable law, the same contract, and Fiat wanted also to keep out the Fiom (no signatory of the contracts of Pomigliano and Mirafiori) from the possibility to establish RSA (corporate union representation) due to literal interpretation of art. 19, l. 300/1970. The research continues with the analysis of the recent evolution of the laboral relations system after the “Fiat case” between attempts of composition (Interconfederal pact of 28th, june, 2011 and Protocol of 31th, may, 2013) in wich Trade Unions rediscovered unity of action and defined essential elements (measurement of Trade Unions' representativity, general effect of corporate contracts, possibility to waive the Collective National Contracts by corporate contracts) and attempts of decomposition of system (particulary about art. 8, l. 148/2011 that introduces the possibility for corporate contracts to waive not only the Collective National contracts but even the law). Finally, the research advances a new possible labor relations system that combines the requirements of competitiveness of companies and economic growth of the country with the necessity to preserve a framework of stable and definite rules. This possible new system of labor relations is constituted by the appreciation of Interconfederal pact of 28th, june, 2011 and Protocol of 31th, may, 2013 with injection of strong elements of workers participation to companies management.

Texte intégralThe paper traces the routes of the doctrine and jurisprudence on the question of civil liability of the union in marriage with profiles on the various models of organization. The picture that emerges is of a tendency of the doctrine to liberate trade unions from the accountability system, compared with a case more open to believing the union subject to the provisions of common law. To test whether the doctrine of immunity of the union still stands, have been examined in case studies of various criminal responsibility, which was dropped in the particular position of the union. The result that comes the real trend is that of a renewal of trade union activity to the normal rules of civil liability.

Texte intégralThe Author, using the methodology of functional law analysis, seeks to define the notion of representativeness and its assessment and measurement techniques. Following this methodological setting, the A. comes to conceptualize union representativeness as a selective technique aimed at identifying unions called to realize peculiar functions that progressively emerge in national and international context. This implies that the criteria for measuring and verifying the representativeness change according to the functions, the areas of application and the union model produced by the legal system. Accordingly, patterns, functions and environments are inevitably intended to intertwine, combine and change over time. This premise is indispensable to establish, at each new settlement of the union system, whether there is a balance between the "privilege" area ensured by representative trade Unions and employers organizations, and the area in which the other organizations of workers and employers operate according to the freedom of association (art. 39 Cost.) The objective of the investigation is twofold: on the one hand, it requires to verify the rules on the measurement of the trade union representativeness set by the inter-federal agreements between 2011 to 2014 and their suitability for the definition of the legal provision of «sindacato dei lavoratori comparativamente più rappresentativo» characterizing the legal devolutions of power towards collective bargaining. On the other hand, the Autor try to decode the emerging concept of «associazione dei datori di lavoro comparativamente più rappresentativa sul piano nazionale» by verifying the possibility to create, trough theoretically developing and using comparative analysis, indexes of representativeness of employers' associations. It is also analyzed the debate over the opportunity of a “Trade Union Act” to enhancing trade unionists and employers’ organizations and to fight the disruptive tendency of the industrial relations system.

Texte intégralThe work analyses the outsourcing processes on the point of view of industrial relations, with the purpose to verify the effectiveness of the collective bargaining provisions to “manage” these processes. The dissertation moves from the assumption that the second-level agreements should be implemented, considering the applicability to all employees and the greater proximity to the interests concerned. The major part of the analysis revolves around the service contracts and the heterogeneous related provisions of the national collective labour agreements (such as the ban on outsourcing, the information to trade unions, the entitlement to certain treatments or to hold down the employment relationship), which should be developed by company or territorial level agreements. Then the dissertation focuses on the transfer of business, highlighting the role of the second-level bargaining, which could be able to find a compromise between competitiveness and social protection, as well as to control the compliance of the transactions. The work also considers the staff leasing contract, hoping for a system of collective representation and negotiation which includes the temporary workers. Finally, with reference to the so called “working project consulting agreements”, the author observes that the trade unions should give to the consultants a major collective protection.
