Zhao, Richard. « Second Chances : Why Michigan Should Categorically Prohibit the Sentence of Juvenile Life Without Parole ». University of Michigan Journal of Law Reform, no 55.3 (2022) : 691. http://dx.doi.org/10.36646/mjlr.55.3.second.

Texte intégral
Résumé :
The United States is the only country in the world that sentences children to die in prison. This practice, known as juvenile life without parole (JLWOP), is condemned by the United Nations Convention on the Rights of the Child. Yet twenty-five states still permit the sentence, and Michigan houses one of the nation’s largest JLWOP populations. Despite the U.S. Supreme Court’s ban on some forms of JLWOP, more must be done to further limit the use of this sentence. The current JLWOP sentencing scheme is untenable, imposes a significant financial burden on taxpayers, and perpetuates racial inequality. This Note explores these reasons for eliminating the practice and ultimately urges Michigan to follow other states in enacting a categorical ban on JLWOP, either through judicial decision or legislative action.

Résumé :
The case of a 29-year-old university student is used to discuss impairments in decoding skills in older students. Factors are reviewed that contribute to decoding unfamiliar words, such as phonological awareness skills, quality of visual orthographic images, type of decoding strategy used, and morphological awareness skills. The assessment and intervention procedures used with this student highlight the application of current literature when developing assessment and intervention programs for students from middle school and high school to the university level. Additionally, the need is emphasized to recognize and work with the special emotional needs of older students with reading impairments.

Résumé :
Computing Grammar is a basic part of the Second Chance School degree course. It provides agilities in order to improve the student’s position in the digital world. The degree course is open for all at Second Chance Schools. The teacher according to the students’ needs and beliefs provides the guidelines to be followed. They can be updated from time to time. Teaching loops is elementary in the algorithm theory. In High Schools loops and algorithms are the main field at computing lessons. The usage of Microworlds software is up to the teacher in recent years. This phenomenon is very rare at Second Chance schools and this is the first time that it is implemented. Using a poll, students’ beliefs and views were stored and analyzed by the usage of statistical software in order to extract the results. Family situation, work and age constitute a strong factor of the student’s agilities. Sex does not make any difference, fact that is confirmed by other researches.

Résumé :
Throughout history, there are numerous examples of business and government leaders who have fallen from grace only to rise again, and have a “second act” and a “second chance” as a legitimate social actor or leader—that is, they achieved redemption. We explore “the road to redemption” of leaders—when and why it occurs, and what “bumps” prevent it. In our analysis, we conceptualize redemption as a process with three elements—remorse, rehabilitation, and restoration—and as an outcome (the restoration of legitimacy). We argue that achieving redemption is not a product of chance; rather, it is a social construction process of narrative creation and identity construction involving many parties. Also, the road to redemption is shaped by cultural-specific factors—and it is temporally dependent. From this framework, we identify new directions for the theory and practice of leadership.

Résumé :
While service failure is inevitable in the banking sector, the manner in which service recovery efforts are expedited poses vital implications for organizations vested in profitable relationships with their clients. In this vein, this study investigates the significance of post-transgression forgiveness in defining the resultant satisfaction levels of customers. A structured questionnaire was self-administered among 371 premium banking customers. The findings point to the salience of selected service recovery efforts towards the forgiveness inclinations and ultimate satisfaction levels of banking customers. In particular, both bank reciprocity norms (ß=0.459; p<0.000) and extra-role behavior (ß=0.348; p<0.000) positively influence post-transgression forgiveness by customers. On the other hand, extra-role behavior (ß=0.407; p<0.000) and forgiveness (ß=0.373; p<0.000) positively influence bank service satisfaction. Nevertheless, bank reciprocity was found to have a positive influence on extra-role behavior (ß=0.548; p<0.000) in this study. The findings suggest the need for the development of a prescribed set of guidelines and bank procedures to support personalized service recovery efforts in the wake of service failures.

Résumé :
Abstract We have developed a general quenched-flow approach to study platelet function as early as 0.3 seconds after stimulation. Phosphorylation of 20- and 40-kd proteins has been analyzed during the first five seconds of platelet response to thrombin from 0.1 to 5.0 U/mL and compared with the progress of aggregation and serotonin secretion. The onset time for aggregation and phosphorylation of both proteins was less than one second, although with lowest (less than 0.5 U/mL) thrombin levels, a lag of up to 0.6 seconds occurred before 40K phosphorylation increased. The thrombin sensitivity of aggregation and 20K phosphorylation was approximately twice that of 40K phosphorylation, with Ka values of 0.51 and 0.53 v 1.10 U/mL, respectively. External calcium was necessary for maximal 20K phosphorylation, since EDTA inhibited this by 30%. The 40K phosphorylation was not affected by EDTA. Platelet activation by thrombin thus induced biochemical changes well before one second. The quenched-flow approach may help to reveal relationships between phospholipase activation, calcium fluxes, and protein phosphorylation during these early periods of platelet function.

Résumé :
Background. Maternal cholestasis of pregnancy was found to have a negative effect on the kidney structure of firstgeneration offspring. It is not known whether changes in the urinary system will occur in second-generation offspring. Objective. To establish the peculiarities of kidney development in second-generation offspring from rats with cholestasis of pregnancy. Material and methods. Second generation 15-, 45- and 90 day-old rats born from males and females developed in maternal cholestasis. Surgical, somatometric, histological, morphometric and statistical methods of research were used in the experiment. Results. Maternal cholestasis induced on the 17th day of pregnancy leads to structural changes in the kidneys of second-generation offspring. These changes include a decrease in the weight of kidneys of experimental animals, a decrease in the width of their cortical substance, a decrease in the diameter of convoluted proximal and distal tubules of nephrons and the development of structural abnormalities in the epitheliocytes of tubule sections. Hypoplastic changes in renal nephrons persist up to 90 days of postnatal development of animals. Conclusions. Maternal cholestasis induces hypoplastic abnormalities in the kidneys of second-generation rats.

Résumé :
In November 2014, the Chicago Housing Authority approved a pilot program to allow a limited number of individuals with criminal records to live in their housing programs. In this article, I contend that the pilot provides an important opportunity to institutionally recognize and extend material benefits to formerly incarcerated individuals for whom housing is both especially difficult to secure and especially important to find. Drawing on Wacquant, I argue that the pilot also offers an opening for key institutions of urban governance, such as housing authorities, to acknowledge their own role in perpetuating a pervasive “carceral continuum” that disciplines the urban poor and feeds mass incarceration. However, drawing on interviews with pilot organizers and participants, I show how the pilot responds to and replicates pervasive fears of crime that link poverty and criminality in particular. As a result, its cautious experimental design relegates participants to the status of test cases and exceptions, rather than normalizing their presence in public housing. The pilot further relies on a problematic and paradoxical understanding of “return” that obscures public housing’s historical role in the carceral continuum. In all of these ways, the logics of this pilot and others like it remain limited, thus undermining their potential to disrupt such carceral continuities.

Résumé :
As contracts between health systems/hospitals and physician groups approach their renewal dates, negotiations for second-generation contracts must consider the lessons learned from previous contracts and the changes in the healthcare industry. While productivity is still a significant factor in these contracts, changes in reimbursement paradigms, structural changes, and corporate entities must also be considered. A thorough financial analysis, an issues tracker, a letter of intent, and definitive agreements are tools that can facilitate the negotiation process. Keys to a successful negotiation include respecting the changes in the industry, delineating the key needs and expectations of both parties, creating a negotiation subgroup, avoiding misunderstandings, and allowing for changes in the future post-transaction. Ultimately, the negotiation process should be collaborative, communicative, and transparent. These considerations, along with a give-and-take spirit by both parties, can lead to a successful second-generation contract.

Platelet activation by ADP thus induced biochemical changes well before 1 second. The quenched- flow approach may help to reveal relationships between phospholipase activation, calcium fluxes, and protein phosphorylation during these early periods of platelet activation.

Résumé :
Background The usual transbronchial coagulation techniques include microwave, argon plasma coagulation (APC), electrocautery and cryotherapy. However, there are serious clinical problems in the safety of each. By analyzing the experimental data and clinical observations, we observed the variable effects of different coagulation techniques via bronchofibroscopy, to look for an optimal interventional management of luminal bronchus diseases, and evaluate the safety and the equivalent point. Methods Four kinds of coagulation techniques under bronchoscopy were performed on the fresh bronchus of healthy sheep, and the pathologic changes in all groups were observed under the microscope. The different treatment parameters were as follows: microwave 60 W×1 second, 3 seconds, 5 seconds and 40 W×1 second, 3 seconds, 5 seconds; APC 40 W×1 second, 3 seconds, 5 seconds; electrocautery 40 W×1 second, 3 seconds, 5 seconds; cryotherapy 100 Ω×60 seconds, 120 seconds. Results After treatment, ovine bronchial mucosa in all groups showed pathologic changes such as local necrosis and amotio of the mucosa lining epithelium, local submucosa coagulative necrosis or tissue defects, while inflammation in the surrounding tissue was not obvious. Under the same output power and action time, different methods had different outcomes. The damage by APC was the most superficial, microwave was the second, and electrocautery caused the worst damage. The study also found that effects of electrocautery at 40 W×3 seconds, microwave at 40 W×5 seconds or 60 W×3 seconds, APC at 40 W×5 seconds and cryotherapy at 100 Ω×120 seconds were the equivalent point conditions. The appearance included mucosa absence, partial submucosa absence, and collagen fiber coagulation in treatment areas. Conclusions Each coagulation technique has its own characteristic. It is very important to choose the appropriate power and action time of the suitable method according to the therapy requirement.
