Rispetto al suo ipotesto antico francese, il romanzo arturiano Ferguut pone alcuni accenti differenti, soprattutto nella seconda parte. Risulta ad esempio evidente la volontà di rivalutare l’universo femminile. In alcune scene, inoltre, l’omonimo protagonista appare maggiormente in dif-ficoltà, con la voce narrante che sovente indugia sulla sua sofferenza. Il presente contributo si pro-pone di presentare dapprima i momenti in cui il giovane eroe ha uno scontro fisico con i suoi avversari e, in seguito, di indagare le possibili motivazioni che hanno portato lo sconosciuto autore ad ampli-ficare i dettagli inerenti alla sfera del dolore. Il confronto con alcune opere che definiscono lo standard del romanzo cortese dimostra che l’enfasi sulle sfortune del protagonista mirava ad avvi-cinare il testo al canone arturiano e ad umanizzare la figura di Ferguut.

El sistema legal sajón fue el precursor de la complicada planta judicial que durante siglos rigió el funcionamiento de las cortes de justicia inglesas. Desde un concepto en el que primaba la pertenencia a la familia y a un orden social concreto y ligado a la inicialmente fragmentaria que siguió a la caída del Imperio Romano, fue evolucionando a un sistema judicial y legal más complejo partiendo una estructura social más jerarquizada en la que la propiedad tenía una importancia esencial y en el que valor económico del individuo y su palabra ocuparon un lugar esencial. Resumo: O presente trabalho tem por objetivo apresentar uma análise da obra teatral A dama das camélias apontando para elementos do texto que indicam um acordo entre a personagem central da obra, Marguerite Gautier, a cortesã, e a família do seu amado Armand Duval, representante da burguesia. Será feita uma breve ilustração de dados biográficos do autor e de aspectos históricos do contexto da encenação e recepção da obra, para uma melhor compreensão da mensagem do romance. Entendemos aqui, baseados na leitura de Hobsbawm (1977) que o relacionamento dos dois jamais poderia se dar naquela organização social vigente, sustentando com as ideias propostas por Roland Barthes (2009), que a renúncia ao amor foi um acordo entre a cortesã e a burguesia emergente.

É bem provável que o romance Crime e Castigo (1866) de Fiódor Dostoiévski seja a obra da literatura russa mais conhecida no mundo todo. Apesar de diversas edições do romance terem circulado no Brasil na primeira metade do século XX, a primeira tradução verdadeiramente brasileira, assinada por Rosário Fusco, foi publicada apenas em 1949. Ao comparar a tradução indireta, feita por Rosário Fusco a partir do texto em francês, com a primeira tradução direta, realizada por Paulo Bezerra e publicada em 2001, confirmamos um amaneiramento geral do texto original na versão indireta, bem como cortes e alterações de estilo e paragrafação.

En la Antigüedad grecolatina se observaban diferencias en la forma de hablar de hombres y mujeres. Este artículo examina los diversos mecanismos que caracterizan el habla de personajes femeninos en la comedia Cistellaria, de Tito Maccio Plauto, autor romano del siglo II a. C.. Entre ellos se cuentan algunos juramentos normalmente usados por mujeres y fórmulas de cortesía, consideradas como un rasgo típico del habla femenina.

Lucíola, romance de José de Alencar, publicado em 1862, trata do breve envolvimento de um jovem provinciano com uma bela cortesã. O desejo libidinoso, mesmo quando negado, ocupa posição central na trama, movendo personagens e narrativa até a morte prematura da protagonista. Inclusive esse desfecho, com sua carga de purificação e punição, ocorre por complicações do aborto e,portanto, como consequência do sexo, numa alegoria máxima entre Eros e Tânatos. O narrador reconhece a imoralidade de seu texto, mas afirma que não vai se esconder na hipocrisia das reticências. É possível perceber aí uma preocupação com a maneira de mostrar os signos lascivos. A análise de três cenas de forte conotação erótica e as suas relações com outras passagens do romance pretende contribuir para a compreensão desse processo de representação.

<p><strong>Resumo:</strong> O presente artigo visa refletir acerca das funções jurídicas atreladas ao desempenho das magistraturas que compunham o <em>cursus honorum</em> senatorial durante o período do Principado romano. Objetivamos com tal análise compreender o entrelaçamento entre a administração do Império e a aplicação da justiça. Para tanto, interpretaremos os vestígios existentes na documentação de autoria de Plínio, o Jovem, acerca das magistraturas que compunham o <em>cursus honorum</em> e que atuavam na aplicação das leis em cortes de justiças.</p><p><strong>Palavras-chave: </strong>Principado – Direito Romano – Cortes de justiça –<em> cursus honorum</em> – Plínio, o Jovem.</p><p> </p><p><strong>Abstract: </strong>This paper aims to reflect on the legal functions associated with the practice of magistratures that composed the senatorial <em>cursus honorum</em> during the Roman Principate. Our objective with this analysis is to understand the interlacement between the Empire administration and the application of the law. Os estudos de Galileu são reconhecidos por diversos historiadores, especialmente devido sua proposta de geometrização do comportamento dos corpos físicos em sistemas mecânicos. Porém, consideramos que esse processo não se restringiu às discussões exclusivas ao âmbito da Filosofia Natural, mas também quanto à validação da relação desta com a geometria, sofrendo a influência de agentes e dinâmicas sociais, dentre as quais encontramos um Galileu político, intervindo em espaços como as Cortes Italianas e o Collegio Romano. Assim, este artigo tem como objetivo analisar os vínculos estabelecidos por Galileu com esses agentes sociais que intervieram e promulgaram a legitimação das matemáticas nos estudos da Filosofia Natural.

El Ms. Corsini 625 es un Cancionero musical español formado por treinta y tres poemas, en su mayoría de carácter tradicional, y fue compuesto a comienzos del XVII en la corte de un príncipe romano. Es uno de los frutos de la moda de la guitarra española que contribuyó a difundir la poesía española por las cortes de Italia. Este Manuscrito es, por un lado, portador de muchos unica (alguno de los cuales compuestos sin duda en la corte misma) y, por el otro, de varios poemas que están difundidos también en otras fuentes conservadas en Italia. Se analizan en particular aquellos poemas que están atestiguados solamente en Italia.

A presente dissertação propõe-se analisar com detalhe a obra De Vita Duodecim Caesarum, do autor latino Caius Suetonius Tranquillus, observando de perto a vida dos doze Césares que governaram a Vrbs nos primórdios do Império Romano. Procurámos, antes de mais, elaborar a caracterização global de cada um dos biografados, pelo que a investigação incidiu em diversas vertentes da vida pública e privada dos imperadores, que Suetónio descreve na sua obra: desenvolvimento físico e mental, vínculos familiares e vida íntima, conduta social, política, económica e judicial e relação com a cultura e a religião do tempo. Para além disto, foram ainda explicitadas algumas condutas, crenças e valores típicos da cultura romana do tempo, absolutamente necessários para compreender a época histórica em que os doze imperadores romanos estudados se moveram. Isto permitirá ao leitor compreender, de forma clara e indubitável, a conotação que Suetónio atribui a determinadas informações culturais e a consequente imagem, positiva ou negativa, que elas veiculam. Neste processo, foram abordados variados domínios científicos, que vão desde a História, Medicina e Religião na Antiguidade até ao campo da Linguística e das ciências jurídicas e sociais. Além disso, procurámos ainda analisar as diversas técnicas de caracterização que Suetónio utiliza para inculcar determinados juízos de valor no leitor da sua obra. Estas técnicas relacionam-se com a introdução de figuras de estilo no texto, a disposição textual das informações, a comparação entre imperadores, a refutação de comportamentos anteriormente revelados, a introdução de diferentes vozes na narrativa e a revelação das opiniões do biógrafo. Por fim, foi ainda analisado o discurso de Suetónio, numa digressão linguístico- -semântica que permite observar o juízo valorativo do biógrafo e a forma como induz o leitor a determinados julgamentos capazes de beneficiar ou prejudicar indelevelmente a reputação de cada um dos principes romanos estudados.
This dissertation thoroughly analyses the work entitled De Vita Duodecim Caesarum, by the Latin author Caius Suetonius Tranquillus. It will look closely into the life of the twelve first Caesars that governed Rome at the beginning of the Roman Empire. We have tried to sketch an overall characterization of each emperor, focusing both on his personal and public lives: physical and mental development, family bonds and sexual life, social, political, economic, judicial, cultural and religious conducts. We have also accounted for the habits, beliefs and values of the Roman society in order to shed some light on the culture of the time. This will allow the reader to appreciate the meaning of Suetonius’ information and to characterize, either in a positive or negative manner, the emperors. In this process, we have therefore resorted to a variety of disciplines: History, Medicine, Religion in Antiquity, Linguistics, Law, and Sociology. Finally, we have also analyzed the different techniques used by Suetonius to convey his ideas to the reader: the stylistic devices involved, the organization of the information, the comparison between emperors, the introduction of voices within the narrative framework, the refutation of previous information, the recurrence of personal statements. We have also concentrated on the biographer’s discourse in order to assess its influence on the reader’s opinion.

L’histoire de l’amour courtois propose un récit complexe, dans les faits littéraires autant que dans les vicissitudes de son herméneutique. De nombreux embarras et impasses dérivent d’emblée de l’histoire de sa désignation - et du patrimoine théorique qui l’accompagne. Utilisée régulièrement comme unité minimale d’identification de la représentation amoureuse, la notion d’amour courtois continue de délimiter l’érotique galloromane : mais si, d’une part, elle aide à en souligner les spécificités, elle en force, de l’autre, l’univocité. Depuis l’étude fondatrice de G. Paris (1883), l’amour dans la littérature médiévale a fini par correspondre, au sein des consciences critiques, aux critères fondamentaux de l’amour courtois. Les conséquences de cet équilibre trompeur sont, dans la production critique, variées. Dans le domaine de l’étude synchronique mono et intertextuelle, les autres formes et sens que l’amour médiéval connaît en dehors de ce schéma ne font pas l’objet d’une attention interprétative aussi scrupuleuse que celle qu’on accorde à l’amour courtois proprement dit ; dans la perspective de l’histoire des origines, l’amour courtois est aisément placé dans un parcours idéologique et culturel indépendant par rapport à l’histoire littéraire générale ; les aspects chronologiques internes à ce phénomène sont généralement aplatis, dans un mécanisme de nivèlement des cycles temporels ; à l’immobilité des paradigmes exégétiques s’est associée, enfin, la constitution d’un “canon” de textes faisant fonction de garants de la définition. L’état de l’art, qui compte à présent des progrès remarquables, bénéficie d’études éminentes sur ce sujet. L’ensemble de ces résultats n’a toutefois pas engendré un réseau critique compact, au vu de ce qui procède des pivots interprétatifs fondamentaux. Dans notre thèse, nous offrons des hypothèses herméneutiques et un modèle méthodologique visant à l’éclaircissement et à l’élargissement des perspectives. à l’univocité des théories liées au canon et à la notion d’amour courtois, le présent travail substitue un plan d’analyse plus ample, celui du discours amoureux galloroman : les marges d’un tel objet sont ouvertes à toutes les expressions et représentations érotiques de matrice laïque. Les possibilités hétéroclites du discours amoureux (R. Schnell 1989), qu’il est fondamental de considérer comme un ensemble idéologique, culturel et littéraire, sont soumises à une analyse visant à offrir un cadre interprétatif à la fois particulier et général. Afin de réévaluer les fondements de cet objet (en renouvelant mais aussi en bornant les horizons de R. R. Bezzola, 1944-63), notre enquête fait collaborer les plans critiques et chronologiques: la phase exégétique de cette étude, supportée par l’analyse philologique des textes, s’accompagne de l’étude stylistique et rhétorique. Ce travail procède selon les étapes suivantes : l’identification des motifs et des thèmes génératifs (noyaux de fond) a été suivie par la construction d’un répertoire de prototypes du discours amoureux et par l’étude de leur diffusion selon les époques et les lieux. Cette opération a été supportée par la périodisation du discours amoureux en trois phases distinctes, au sein desquelles le code expressif s’est fixé : le Midi, d’abord, inaugure la phase de formation d’un langage lyrique primordial, qui vise à valoriser et sublimer l’amour humain, pour exalter la chasteté dans une morale interne et élitiste ; dans le Nord, ensuite, naît un discours amoureux qui concilie la pensée et la formation des clercs avec l’idéal conjugal séculier, construisant de ce fait un modèle d’ordre social ; enfin, les réalités urbaines septentrionales offrent, d’un côté, une réception néo-curiale des prototypes lyriques et, de l’autre, une réélaboration théologique et encyclopédique, mais aussi profane et pratique, de la tradition courtoise.

Resumo: Este estudo tem por finalidade analisar as cortes de justiça senatorial e imperial, através das obras Cartas e Panegírico a Trajano escritas por Plínio, o Jovem, e Diálogo dos Oradores, Agrícola, Histórias e Anais I-VI de Tácito. A organização judiciária da cidade de Roma, durante o Principado, contava com diferentes cortes de justiça. Apesar de perpassar a jurisdição de diferentes cortes de justiça, a presente tese irá se centrar na interpretação das acusações de maiestas e repetundae, relatadas por esses dois senadores romanos, que foram instauradas perante as cortes senatorial e imperial. Ambas as cortes se configuraram como ambientes privilegiados para a análise das negociações entre o Senado e o princeps e, por esta razão, serão objetos do nosso estudo. Veremos como a escolha de uma corte de justiça e os procedimentos empregados no julgamento dos processos eram permeados por negociações entre o Senado e os imperadores atuantes. Como discorremos, Tácito e Plínio centraram suas narrativas no (des)equilíbrio da distribuição das funções e dos poderes jurídicos e político-administrativos entre o Senado e o princeps. Assim, investigaremos a hipótese da existência de um entrelaçamento entre as práticas político-administrativas e as práticas jurídicas durante o Principado. Nesse sentido, partiremos do estudo das acusações de repetundae e maiestas identificadas em nossa documentação. Abstract: This study’s goal is to analyze the senatorial and imperial law courts through Pliny the Younger’s works Letters and Panegyric to Trajan, as well as Tacitus' works Dialogue on Oratory, Agricola, Histories and Annals I-VI. The judiciary structure of the city of Rome, during the Principate, featured different law courts. Although it encompasses the jurisdiction of different law courts, this thesis will focus on the interpretation of the accusations of maiestas and repetundae reported by these two Roman senators that were installed in the senatorial and imperial law courts. Both courts of justice became privileged environments for the analysis of the negotiations between the Senate and the princeps, and, for this reason, they are the objects of our study. We will see how the choice for a law court and the procedures employed in the trials of the processes were permeated by negotiations between the Senate and the regent emperors. As discussed, Tacitus and Pliny centered their narratives around the (im)balance of function distribution and legal and political-administrative powers between the Senate and the princeps. Thus, we will investigate the hypothesis of an interweaving between the political-administrative practices and the legal practices during the Principate. In this way, we will proceed to the study of the accusations of repetundae and maiestas identified in our sources. Résumé: Cette étude vise à analyser les cours sénatoriales et impériales, à travers les oeuvres Correspondance et Panégyrique de Trajan, écrites par Pline le Jeune et le Dialogue des orateurs, la Vie d’Agricola, les Histoires et les Annales I-VI de Tacite. L’organisation judiciaire de la ville de Rome, pendant le Principat, avait différentes cours de justice. Malgré aborder la juridiction des différentes cours de justice, cette thèse se concentra sur l’interpretation des accusations de maiestas et de repentundae, rapportées par ces deux sénateurs romains, qui ont été instaurées devant les cours sénatorial et impérial. Les deux cours ont été configurées comme des environnements privilégies pour l’analyse des négociations entre le Sénat et le princeps et, pour cette raison, feront l’objet de notre étude. Nous verrons comment le choix d’une cour de justice et les procédures suivies lors du procès ont été imprégnés de négociations entre le Sénat et les empereurs actifs. Comme nous avons discouru, Tacite et Pline ont centré leur récit sur le (dés)équilibre de la répartition des fonctions et des pouvoirs juridiques et politico-administratifs entre le Sénat et le princeps. Ainsi, nous étudierons l’hypothèse de l’existence d’une imbrication entre pratiques politico-administratifs et pratiques juridiques pendant le Principat. Apesar de o direito ser feito para trazer estabilidade à sociedade e garantia a seus membros, hoje em dia no Brasil esse propósito não se verifica adequadamente como deveria. Este trabalho se concentra na segurança jurídica, uma expressão no direito romanogermânico que contém a idéia de como o direito deve dar ao povo um sentido de certeza e também embasa a coisa julgada e o controle de constitucionalidade. Na verdade, o sentido de estabilidade no direito brasileiro está em crise. Este estudo procura saber o motivo e tenta achar uma resposta na doutrina e nas decisões do Supremo Tribunal Federal para entender como isso afeta a coisa julgada e o controle de constitucionalidade. A conclusão leva à idéia de que o modelo de controle difuso de constitucionalidade sem a vinculação obrigatória dos precedentes, combinado com um enfoque no controle concentrado e abstrato de constitucionalidade é a causa de vários problemas, afetando não apenas o conceito de coisa julgada mas também trazendo danos à segurança jurídica.
Altough law is made to bring stability to the society, and assurance for its members, nowadays in Brazil its purpose is not occurring properly and as it should do. This work focuses on legal security, a term in civil law that contains the idea of how law must give people a sense of certainty, and also supports the res judicata and judicial review. Actually, the sense of stability in Brazilian law is in crisis. This study wonders why and tries to find an answer in jurisprudence and in the Supremo Tribunal Federal (Brazilian supreme court) decisions to understand how it affects the institutes of res judicata and judicial review. The conclusion leads to the idea that a judicial review model without stare decisis combined with the classic civil law constitutional court is the cause of several problems, affecting not only the concept of res judicata but also damaging the legal security.

Fin’amors, « cet amour courtois si compliqué à vivre et à chanter, cet amour dont la mesure de la sincérité est la qualité de la poésie», is a very complex concept to define; since it was first exalted by the troubadours’ poetry, it has always elicited a keen interest in modern and contemporary critics. The corpus of troubadours’ poems laid the foundations for the first erotic language and for the creation of a series of topoi and motifs, which characterise the ideal of the fin’amors; they eventually found a breeding ground for the other European literatures: in the North of France, specifically with the trouvères’poetry, in the German-speaking areas, thanks to the Minnesënger, in the Iberian Peninsula and in Italy. We have tried to build a case study, as a possible interpretation of a traslatio amoris into the different French literary manifestations of the 12th and 13th centuries, particularly starting from the troubadours’ poetry until reaching the prose romance. It appears that a certain number of topoi and motifs of the fin’amors - among these one can mention the desire in absentia and two topical characters, the lauzengiers and the gelos who find a new dimension in the Arthurian romance - have been used by the Medieval writers to create their great summae, by making the courtly love the heart and motor of the story-telling: the syntagmatic axis around which the whole romance revolves. The love legends of Tristan and Iseult and Lancelot and Guinevere offer the most successful narrative representation of the fin’amors: it is about two stories of immersive erotic passion based on adulterous relations, which share a social dimension and a courtly perspective. The remarkable interest for these illicit loves is best expressed in the prose continuation of the 13th century which assures the circulation of the legends all over Medieval Europe, by making the protagonists’ adulterous love a myth for the Western culture. On the one hand the protagonists’ love stories find a new dimension in the prose romances, which evoke and develop certain themes and motifs of the fin’amors into a more complex narrative frame; on the other hand there is a whole tradition of verse romances, called “Romans de l’amour troubadour,” that is a sort of hybrid category, which alternate narration and poetry. These peculiar stories, entirely based on the adulterous relationship between the protagonist and a married woman, revive some of the most important elements of the troubadours’ poetry, by making the fin’amors the keystone of the narration. However, both in the verse and the prose romances, the authors’ choice to set up a whole story based on an adulterous relationship implies a series of social and moral implications, which are revealed through the different characters’ speeches, and appears to mirror the writers and the society’s thoughts at the time. From verse to prose, the two couples’ forbidden loves are remarkably developed. The courtly love carries out a double function: it gives the narration an internal and external cohesion and, being the common thread for the various episodes, it allows the writers to (re)create new adventures and to foster the romance continuations.

The Cividade of Bagunte is the most publicized archaeological site of the municipality of Vila do Conde. Located on a mound with great visibility over the territories to the north and south of the Ave River it called the attention and interest of various archaeologists such as Ricardo Severo and Martins Sarmento, in the end of the 19th century, and F. Russell Cortez in the 40’s of the next century. F. Russell Cortez organized digging campaigns at the site that uncovered a mixture Castrejo and Roman type buildings and structures, distributed by orthogonal spaces that already have the seal of a Roman influence in the region. The most recent archeological campaigns give us a higher precision to determine its evolution as a settlement, despite the many questions that remain unanswered.
