This research examine the legal consequences of a sale and purchase deed canceled by the court on buyers who have good faith. This research purpose to analyze and criticize the PPAT responsibilitie of the land deed whose deed was canceled by the court as well as legal protection for buyers with good intentions as a result of the sale and purchase. This research uses a normative juridical research method, which is carried out by examining legal materials, such as research on positive law. This research uses three legal approaches, namely the legal approach, the conceptual approach and the case approach. The legal materials used in this research are primary legal materials, secondary legal materials and tertiary materials. Analysis of legal materials is carried out by interpreting all laws and regulations. This research concludes that PPAT can be held accountable individually and legally. Legal responsibilities are in the form of civil and administrative responsibilities. PPAT civil liability can be held accountable for returning the status of ownership rights in administrative responsibility in accordance with the PPAT Code of Ethics may be imposed in the form of reprimands, warnings, temporary dismissals from members as contained in article 7 paragraph (1) of the Profession Code of Ethics PPAT Abstrak Kewenangan Notaris dalam membuat akta autentik sebanding dengan tanggungjawabnya, karena pertanggungjawaban tersebut terus melekat kepada notaris meskipun notaris tersebut sudah pensiun. Namun, adakalanya notaris khilaf dan membuat kesalahan dalam membuat akta autentik baik yang disengaja maupun yang tidak disengaja. Apabila hal tersebut terjadi dan dikemudian hari ternyata karena perbuatan notaris tersebut menimbulkan kerugian kepada para pihak, apakah notaris wajib mempertanggungjawabkan hal tersebut? Sejauh mana batasan tanggung jawab notaris?. Penelitian ini menggunakan metode Yuridis Empiris. Hasil dari penelitian ini apabila Notaris membuat kesalahan dalam membuat akta autentik sehingga merugikan orang lain, sepanjang pihak yang dirugikan dapat membuktikan kesalahan itu akibat kelalaian maupun kesengajaan Notaris, maka Notaris dapat dimintakan pertanggungjawaban dari sudut pandang keperdataan yakni dengan membayar ganti rugi, selanjutnya pertanggung jawaban administrasi apabila Notaris tersebut terbukti melakukan maka dapat dikenakan sanksi berupa peringatan tertulis, pemberhentian sementara, pemberhentian dengan hormat dan pemberhentian dengan tidak hormat, sedangkan dari sudut pandang hukum pidana apabila Notaris terbukti sengaja atau disadari membuat atau bekerja sama dan menandatangani suatu akta palsu maka dikenakan pidana penyertaan pemalsuan akta.

Peneltian ini menggunakan metode penelitian yuridis normatif, yang dilakukan dengan meneliti bahan-bahan hukum, seperti penelitian pada hukum positif. Peneltian ini menggunakan tiga pendekatan hukum yaitu pendekatan undang-undang, pendekatan konseptual serta pendektan kasus. Bahan hukum yang digunakan dalam penelitian ini berupa bahan hukum premier, bahan hukum sekunder dan bahan tertier. Analisis terhadap bahan hukum dilakukan dengan cara menginterpretasikan semua peraturan perundang-undangan. Penelitian ini memberikan kesimpulan bahwa PPAT Tanah dapat diminta pertanggung jawaban secara individu dan tanggung jawab hukum. Tanggung jawab hukum berupa tanggung jawab secara perdata dan administrasi. Tanggung jawab secara perdata PPAT dapat diminta pertanggung jawab mengembalikan status hak pemilikan dalam tanggung jawab administrasi sesuai dengan Kode Etik PPAT dapat dikenakan berupa teguran, peringatan, pemberhentian sementara dari anggota sebagaimana yang terdapat dalam pasal 7 ayat (1) Kode Etik Profesi Pejabat Pembuat Akta Tanah. The international responsibility to protect is the most important and value-added element of the responsibility to protect (R2P) doctrine. However, the existing accounts of the international responsibilities of R2P are often fairly ad hoc and not clearly systematised, largely focusing on particular responsibilities. Consequently, this article provides a typology of the various international responsibilities required by the R2P. In particular, it presents six types of international responsibility to protect: (1) the responsibility to undertake direct action; (2) the responsibility to support direct action; (3) the responsibility to authorise; (4) the responsibility not to act; (5) the responsibility to advance R2P; and (6) the responsibility to reform. In doing so, it will clarify how these responsibilities hang together and highlight underappreciated responsibilities.

"Over the years, numerous ethical implications in stem cell research have been identified. Consequentially, there is a need to anticipate, prevent and/or mitigate these implications. In literature and in the guidelines of the International Society for Stem Cell Research some of these implications have been reframed into (moral) responsibilities. What exactly is meant by responsibility and which notions of responsibility are important often remains unclear. As a consequence, this encumbers the possibility to deal with these responsibilities in a systematic way. Therefore, the goal of this paper is to discuss how the concept of responsibility in stem cell research could best be understood. This paper addresses which notions of responsibility are relevant for the field of stem cell research. This will be done by first distinguishing between backward-looking and forward-looking notions of responsibilities, where backward-looking responsibilities are about reactive attitudes and forward-looking responsibilities are about what could be expected from someone to prevent ethical implications. Subsequently, ethical implications of and wrongdoings in stem cell research will be categorized in these notions of responsibility. Taking one step back and looking at the different notions of responsibility could help to identify gaps in responsibilities as well as to distinguish obligatory and supererogatory responsibilities. Consequentially, this informs how to prioritize, distribute and delegate responsibilities over the different stakeholders in stem cell research. This paper concludes by discussing the distribution of responsibilities and different strategies to promote responsibility in stem cell research. "

This article aims to know and critically analyze the ethical responsibilities of Levinas. He gives a new concept of responsibility. For him, ethics is the first philosophy. The ethics of Levinas's responsibilities must be understood in a metaphysical aspect. The research method used is literature research using hermeneutics method. The essence of Levinas’s responsibility: responsibility as an existential fact, nonnormative, for the others, substitutional, the essential structure of subjectivity, a basis for existence, the responsibility of humanizing himself, and responsibilities make me unique from others. The ethics of Levinas's responsibilities have two characters: concrete and asymmetric.

Based on the logical framework of “Cognition and Motivation-Behavior-Performance”, this paper investigates the cognition and driving factors of managers of small and medium-sized enterprises to corporate social responsibility, and summarizes four behaviors of fulfilling social responsibility according to the Guide to Social Responsibility of Small and Medium-sized Enterprises in China, including employees, market, environment and community, and measures the corporate performance from three aspects: economy, society and environment. The results show that: (1) Social responsibility cognition has a significant positive effect on the fulfillment of social responsibility, and has a greater impact on the fulfillment of employees and market responsibilities; (2) The driving force of social responsibility has no significant effect; (3) Employees’ and environmental responsibilities have a positive impact on corporate performance, while market responsibilities and social responsibilities have no significant impact on corporate performance.

Background: Nurses and surgeons may experience intra-team conflict during decision making about the use of postoperative life-sustaining treatment in the intensive care unit due to their perceptions of professional roles and responsibilities. Nurses have a sense of advocacy—a responsibility to support the patient’s best interest; surgeons have a sense of agency—a responsibility to keep the patient alive. Objectives: The objectives were to (1) describe the discourse surrounding the responsibilities of nurses and surgeons, as “advocates” and “agents,” and (2) apply these findings to determine how differences in role responsibilities could foster conflict during decision making about postoperative life-sustaining treatment in the intensive care unit. Research design: Articles, books, and professional documents were explored to obtain descriptions of nurses’ and surgeons’ responsibilities to their patients. Using discourse analysis, responsibilities were grouped into themes and then compared for potential for conflict. Ethical considerations: No data were collected from human participants and ethical review was not required. The texts were analyzed by a surgeon and a nurse to minimize profession-centric biases. Findings: Four themes in nursing discourse were identified: responsibility to support patient autonomy regarding treatment decisions, responsibility to protect the patient from the physician, responsibility to act as an intermediary between the physician and the patient, and the responsibility to support the well-being of the patient. Three themes in surgery discourse were identified personal responsibility for the patient’s outcome, commitment to patient survival, and the responsibility to prevent harm to the patient from surgery. Discussion: These responsibilities may contribute to conflict because each profession is working toward different goals and each believes they know what is best for the patient. It is not clear from the existing literature that either profession understands each other’s responsibilities. Conclusion: Interventions that improve understanding of each profession’s responsibilities may be helpful to reduce intra-team conflict in the intensive care unit.

Oggigiorno, a quasi vent’anni di vigenza del Decreto, nella prassi l’adozione del Modello organizzativo (“MOG” o “Modello”) si è assai diffusa tra le aziende, soprattutto medio-grandi e, specularmente, si è assistito a un florilegio di contestazioni e di condanne, ai sensi del d.lgs. 231/2001. In tale contesto, l’Organismo di Vigilanza (di seguito anche “OdV”) ha da sempre rivestito, secondo l’impianto stesso della normativa, un’imprescindibile funzione. E’ quindi diventato sempre più frequente che professionisti di varia estrazione (per lo più avvocati e commercialisti, ma non solo) affianchino alla propria attività ‘tradizionale’ quella connessa all’incarico quale membro di uno (o più) Organismi di Vigilanza. Secondo l’opinione di chi scrive, a tale ramificazione della pratica professionale, non sempre si accompagna una piena consapevolezza dei compiti connaturati al ruolo di componente di OdV e delle conseguenze derivanti dallo svolgimento di un’attività non sempre approfondita; ciò sarebbe invece auspicabile, non solo nell’interesse dell’ente che abbia scelto di dotarsi di un Modello – e che pertanto nutre una legittima aspettativa circa l’adempimento di tali compiti secondo le best practices –, ma anche nell’interesse della stessa persona fisica che, rivestendo un ruolo tanto delicato quale quello di componente dell’Organismo di Vigilanza, potrebbe trovarsi indagata e/o imputata in un procedimento penale, oltre che citata in giudizio innanzi al tribunale civile per una richiesta di risarcimento danni avanzata dall’ente. La presente Tesi, dunque, ha avuto l’obbiettivo di percorrere gli aspetti più rilevanti legati all’operatività dell’Organismo di Vigilanza. Si è partiti dall’analisi della sua natura e della sua composizione, per poi passare al nucleo inaggirabile dei compiti da assolvere in tutte le fasi dell’incarico – insediamento, pianificazione delle attività, svolgimento in concreto della vigilanza, cessazione – fino ad arrivare all’esame dell’influenza che il corretto o scorretto svolgimento di tali compiti può riverberare sulla prova giudiziale circa l’efficace attuazione di un Modello idoneo a prevenire reati, così come richiesto ai fini del riconoscimento della scriminante di cui all’art. 6 del d.lgs. 231/2001. La trattazione di tali temi rappresenta il substrato fondamentale sulla base del quale si è sviluppato l’argomento centrale – e più problematico – relativo alla possibilità di imputare una qualche forma di responsabilità (penale e/o civile) ai componenti dell’Organismo di Vigilanza, valutando anche il generale trend in materia, espresso oltre che dalla dottrina anche dalle scarsissime pronunce giurisprudenziali in materia
Nowadays, the adoption of the organizational model ("MOG") is very widespread among companies, especially medium-large ones and, in particular, there has been several convictions, pursuant to the Legislative Decree 231/2001. In this context, the Supervisory Body (hereinafter also the "SB") has always played an essential role. It has therefore become increasingly common for professionals from various backgrounds (mostly lawyers and accountants, but not only) to combine their traditional activity with the one connected to the position as a member of one (or more) Supervisory Bodies. According to our opinion, the ramifications of professional practice is not always accompanied by a full observation of the tasks connected to the role of component of the SB and of the consequences deriving from carrying out a not always correct activity; this would instead be desirable, not only in the interest of the company that he had chosen to adopt a Model, but also in the interest of the same individual who, playing a role as delicate as that of member of a Supervisory Body, could be investigated and/or accused in a criminal proceeding, as well as sued before the civil court for a request for compensation for damages. Therefore, this Thesis has had the objective of covering the most relevant aspects related to the Supervisory Body. We started from the analysis of its nature and its composition, to then move on to the core of the tasks to be carried out in all the phases of the assignment - settlement, planning of activities, performance of supervision in practice, termination - up to the exam of the influence that a correct or incorrect performance of these tasks can reflect on the judicial proof of the suitability of the Model in order to prevent crimes, as required for the application of the exoneration clause provide by Rule 6 of Legislative Decree 231/2001. The discussion of these issues concern the fundamental substratum on the basis of which the central - and most problematic - argument related to the possibility of attributing a form of responsibility (criminal and / or civil) to the members of the Supervisory Body, was developed, also evaluating the general trend in the matter, expressed not only by doctrine but also by very few judicial decisions on this subject.

Using case studies from Australia, Sweden and Finland, and also drawing on examples from parts of Asia, including Papua New Guinea, Indonesia, and Thailand, the thesis explores how state and market actors respond to Indigenous claims and how Indigenous claims are themselves reconstituted through those particular responses. While the duty of protecting Indigenous rights might nominally fall upon the state, we are increasingly witness to the enfolding of market actors and market rationalities in debates concerning Indigenous claims. The research contained in the thesis highlights how a practice of 'passing the buck', or passing of responsibility onto others, is constituted through both market and government relations whereby responsibility for addressing Indigenous claims is shifted from states to corporations, from corporations to states, and from states back to Indigenous peoples themselves. The thesis consists of four articles. Article 1, titled 'Obliging Indigenous Citizens: Shared Responsibility Agreements in Australian Aboriginal Communities' provides a critique of the governmental provision of services to remote Australian Aboriginal communities through quasi-market arrangements. Article 2, titled 'Corporate Social Responsibility, Supply-chains and Saami Claims: Tracing the Political in the Finnish Forestry Industry' explores conflicts over state logging in Saami territories and the construction of the state/market divide in CSR debates over the rights of Indigenous peoples. Article 3, titled 'NGO Campaigns and Banks: Constituting Risk and Uncertainty' studies the negotiated and contested boundaries of markets through debates over the governance of social and environmental risks in the investment banking sector. Article 4, titled 'The Last Frontier? Windpower developments on traditional Saami lands' considers how colonial rationalities constituting the state-Saami relationship are reproduced in new debates over windpower developments in Saami mountain areas.

Corporate social responsibility (CSR) has been a subject of increasing interest among academics and business practitioners globally. This thesis contributes to the discourse on CSR in the context of the Nigerian oil industry with regard to corporate-community relations. Specifically, the thesis constitutes a critique of CSR initiatives by multinational oil companies (MOC) operating in the Niger Delta region and their impact on the traditional livelihoods of local communities. The research attempts to understand the link between CSR and Psychological contract from the perspective of both the host communities and the MOCs. This thesis examines community perceptions, expectations and seeks to interpret the relationship between the host communities and the MOCs. The study provides empirical data through the use of twenty-eight semi-structured interviews and three focus groups. This is significant given that most of the research conducted into CSR in this region has been limited to descriptive and extensive theoretical explanations. Findings from the research suggest that the relationship between the host communities and the MOC is a very complex one and that the impact of the MOCs activities can be interpreted from the host communities’ negative actions. The thesis makes an important contribution to the emerging literature on social license to operate (SLO) and in what manner the local communities seek to enforce it. It also offers an alternative approach to CSR based on need assessment and stakeholder involvement rather than corporate obligations and expectations from society in general.

Inaction by UN peacekeeping troops in the face of the commission of genocide in Srebrenica and Kigali raised significant questions regarding the duty owed by UN peacekeeping forces to those under their protection. Recent court judgments have recognised that the Netherlands and Belgium were to a certain extent legally responsible to protect those under the care of each state’s peacekeeping troops, and that also the role of individual peacekeeping commanders may be questioned. While peacekeeping commanders may have a moral responsibility to act, it is not realistic to argue that peacekeeping commanders have a legal duty to do so. As a result, the use of the existing options to establish criminal liability for a failure to act under domestic and international law would not be justified in relation to the conduct committed. This thesis argues that alternative options to the existing forms of criminal responsibility for military commanders should be considered, possibly focusing more clearly on failing to fulfil a norm of protection that is specific to peacekeeping and distinct from protective obligations under international human rights law and international humanitarian law. Establishing law tailored to the context of peacekeeping would be an important step towards clarification of the obligations and responsibilities held by military commanders in UN peacekeeping missions.

The doping culture represents an issue for sport and for society. Normative debates on doping have been mainly concerned with questions of the justifiability of doping. The practice of assigning responsibility for doping behaviour has chiefly been individual-based, focusing mainly on the individual athlete’s doping behaviour. The overarching aim of this thesis is to investigate the relevance and the importance of the ideas of responsibility in relation to ethical debates on doping. The more specific aim is to examine the possibility of broadening the scope of responsibility beyond the individual athlete, and to sketch a theoretical framework within which this expansion could be accommodated. In the first study, it is argued that bioethicists have a moral/professional responsibility to start out from a realistic and up-to-date view of genetics in ethical debates on gene doping, and that good bioethics requires good empirics. In study 2, the role played by affective processes in influencing athletes’ attitudes towards doping behaviour is investigated, both on an individual and on a collective level. It is concluded that an exclusive focus on individual-level rule violation and sanctions may entail overlooking the greater social picture and would prove to be ineffective in the long term. In study 3, the common doping-is-cheating arguments are examined and it is argued that they fail to capture vital features of people’s moral responses to doping behaviour. An alternative account of cheating in sport is presented in terms of failure to manifest good will and respect. It is concluded that putting cheating in the broader context of human interpersonal relationships makes evident the need to broaden the scope of moral responsibility and agency beyond the individual athlete. In study 4, the particular case of assigning responsibility for doping to sports physicians is used to examine the current individual-based approach to responsibility. This approach underestimates the scope of the responsibility by leaving out a range of other actors from the discourse of responsibility. The central conclusion of the thesis is that transforming the current doping culture requires broadening the scope of responsibility to include individuals and groups of individuals other than the athletes themselves.

Introduction: The society is becoming more aware of the importance of corporate social responsibility (CSR) work. CSR has also be-come a competitive tool in order to reach out to potential cus-tomers. There are also many definitions of what CSR actually means. These are things that makes it interesting to find out how multinational corporations, who has a lot of power, per-ceive and work with CSR, as well as what can be done to make corporations work more with CSR.

Purpose: The purpose of this thesis is to describe what CSR as a con-cept means, whose responsibility it is, as well as why corpora-tions work with it. We also intend to find out what it takes to make CSR a more prevailing and decisive instrument for cor-porations?

Method: We conducted six unstructed interviews with multinational corporations in Sweden.

Conclusion: Today the phenomena of CSR has no unified definition, this is why we believe that a definition that is precise in describing what CSR is can be useful. We think that transparency is something important since information provided to the pub-lic, provides consumers and stakeholders with power to make information based investment, and purchase decisions. We have also concluded that we think that the most important factor in driving the CSR work forward and making it grow in size, is to make consumers reward the corporations that per-form well in their CSR activities.

The way people naturally talk about groups suggests they can be held morally responsible in their own right. People speak of blaming the banks for the global financial crisis while praising Oxfam for its charitable endeavours. In spite of this there is a clear tendency in contemporary philosophy to limit moral responsibility to individuals, thereby denying the existence and relevance of collective moral responsibility in general and the moral responsibility of groups like corporations, states and international institutions in particular. In this thesis I develop an account of responsibility that applies to both collectives and individuals. In particular I focus on developing an account of collective responsibility that is non-distributive. My account does not deny individual responsibility. Nor does it seek to replace individualistic accounts. It is intended to provide and additional layer of moral responsibility. I am particularly interested in scenarios where the harms are mediated by social and institutional structures leading to structural injustice occurring when organisations, institutions or governments discriminate directly or implicitly against certain groups of people to limit their rights. This is important because some of the most serious contemporary harms result from structural injustice, which is a form of injustice where the harms are not traceable to individual wrongdoers. Hence the need for a collectivist account of moral responsibility. Exclusively individualistic accounts of structural injustice do not fully incorporate the many other responsible collectives like states, international institutions and transnational corporations. I also consider the distinction between guilt and responsibility. Some theorists have a favourable view of guilt as it applies to collectives and/or individuals arguing that it has an instrumental value. My account of collective responsibility is sympathetic to this view of guilt but only as it applies to individuals. In which case the issue of distribution does not arise for guilt.

The Responsibility to Protect offers a morally based policy that places a new responsibility on the international community to protect populations from extremes of harm caused by governments. From the policy’s text, the reason for action seems to lie, most fundamentally, in an expression of ‘our common humanity’. However, The Responsibility to Protect does not offer any justification for its proposals. It responds to the question ‘what ought to be done?’ but answers the question ‘what can be done?’ leaving in between a gap in the moral credibility of action. The thesis explores what this lack of philosophical underpinning means to the persuasive power of the policy. The thesis then examines the claim of sovereignty as responsibility and finds it confused and incomplete and lacking the detail necessary for coherent implementation. It uses the Aristotelian square of opposition to investigate the tripartite nature of the new responsibilities to prevent and rebuild. Finally, the thesis investigates the policy’s apparent assumption that an ethically based policy of humanitarian intervention can be appropriately guided by the ethical rules of war. It asks if war and humanitarian intervention are the same thing and finds that they are not. It then explores the incoherence created by using the Just War Tradition for guide R2P. If The Responsibility to Protect offers no greater generation of will and effective action to humanitarian intervention than the current ad hoc process does, its establishment as UN policy becomes a pyrrhic victory. It will result in further anomalies in response by the UN, and consequent damage to the reputation and credibility of the UN as the guardian of international peace and security.

AbstractOne of the main themes emerging from the interviews with 17 families about their long-term experiences of bone marrow transplantation was the perception and distribution of responsibilities among the members of the family. Families reported that they felt it was a shared responsibility to help the sick child, and therefore considered donation a matter of course, even a family duty, which contributed to a dynamic differentiation of responsibilities among family members. Donors, for instance, acknowledged a responsibility for the success or failure of the transplant, and some said that their duty extended over time and included more transplants later in life. In retrospect, most donors valued their donation positively.

AbstractScientific responsibility has changed with the successful professionalization of science. Today, science is a privileged profession, one with a (tacit) management mandate for systematic knowledge acquisition. Within this framework, science acts with responsibility. This chapter reflects the responsibility of science in the German context. After Wold War 2, the extraordinary responsibility of scientists, which C.F. von Weizsäcker emphasized, referred to a specific phase in the institutional development of science, termed scientism (“science justifies society,” science as religion), and corresponded to an elite responsibility. Today, one responsibility of science as a profession is to safeguard and develop scientific standards. This also concerns, on the one hand, the self-organization and control of science as a profession and, on the other hand, the communication of science to society. As a professional scientist, one has two responsibilities, the commitments to good science (professional ethics plus co-responsibility for the development of science as a profession) and civic responsibility. Due to their special knowledge, the civic responsibility of the scientist differs from that of other professionals. This chapter introduces science as a profession and presents an integrative notion of responsibility, also shedding light on the social responsibility of science.

Corporate social responsibility (CSR) is not a refreshing concept for the management of an organization in recent years. This concept refers to a firm, which has more responsibilities to adapt the needs of objectives apart from its stakeholders and owners in commercial, legal, ethical, and environmental ways (Beal and Goyen, 2005), and the responsibilities are achieved by meeting or exceeding the commercial, ethical, legal and philanthropic expectation from these objectives. The concept of corporate social responsibility was firstly introduced by the publication of Bowen's Social Responsibility of Businessmen in 1953, while almost all known companies have integrated this spirit into their business model. Nowadays, the promotion of corporate social responsibility has even become not only the wider responsibilities in which an organization contributes to society but also an approach to promote an organization's corporate image (Chang, 2009). The purpose of this paper is to briefly discuss the concept of corporate social responsibility regarding economic, ethical, legal, and philanthropic aspects, and the objectives served by corporate social responsibility such as environments, the society, and the public. This paper then explains how the realization of CSR from one organization can bring effects to its stakeholders and how the organization can obtain benefits from the implementation. Finally, this paper includes two cases from well-known companies in Taiwan, namely TSMC (Taiwan semiconductor manufacturing company) and FPG (Formosa Plastics Group) about how these companies successfully realize corporate social responsibility, and the impacts that influence the stakeholders, and the benefits they obtain for their corporate images.

In recent years, corporate social responsibility, which comprises economic, legal, ethical and philanthropic responsibilities, has become important concept to build good relations between business and stakeholders and to gain competitive advantage over its rivals. Moreover, it has a positive impact on stakeholder’s (for example; employees, customers, investors) attitudes and behaviors toward business. The main aim of this study is to determine opinions and perceptions of students who study management license toward corporate social responsibility. The research data is gathered from final year students of Alanya Alaaddin Keykubat University, Faculty of Management with a used scale. 251 surveys are used in the research. The findings obtained from research have put forth that management faculty students who are future manager candidates are in opinion and perception of covering respectively economic, philanthropic, legal and ethical responsibilities in their decision-making activities. In addition, the students have listed the company’s four most important stakeholders as community, customers, employees and shareholders. Also corporate social responsibility has been emerged by students as a definition of benefit society, compliance with ethical values, volunteer activities and respect for social values.

An insurance contract is one of rare contracts in which the contracting parties have certain obligations even before they sign an insurance contract. Both the insurer and the insured have certain responsibilities before signing the contract, during the term of the contract and when the insured accident occurs. As for the responsibilities of the client, that is, the insured, besides the obligation to pay the insurance premium, his key responsibility is to inform the insurer on all the risks related to the insurance policy. The insurer will decide whether he will sign an insurance policy on the basis of the risk involved. The responsibility of the insurer to disclose all relevant information prior to signing the insurance contract is based on law, customs and court practice. Although this requirement is imposed on all the clients, there are certain differences depending on the types of insurance, particularly in the area of sanctions foreseen for not complying with it. Also, throughout the life of the policy, the insurer is required to act in line with good commercial practices treating the insured object with due attention and not being careless because of the fact the object is covered by the insurance policy. Client’s failure to comply with these legal requirements and the provisions of insurance contract may result in terminating certain obligations of the insurer agreed in the contract.

Ethical reflection can be of use to any actor in the academic and research world, involving different responsibilities: scientific integrity, general or disciplinary – questions relating to ethics committees, research ethics, or even broader responsibilities relating to the uses and possible impacts of the work undertaken. This last type of concern has been taken into account under the vague notion of responsible research and innovation (RRI), which includes ethics at all levels, and therefore scientific integrity, but also participation and open science. However, it is not easy to combine ethics, participation and openness. This perspective thus proposes a renewal of the reflection on the categories of responsibility and integrity in Research and Innovation (R&I), as well as on the conditions of possibility of ethical participation, in regard to the publics involved, the operating modes and the purposes targeted and included in its operationalization.

When advocating for typically excluded groups in society, it is common for arguments to invoke general principles of universality and equality, referring to the Universal Declaration of Human Rights and to other instrumental documents of a developed society. Considering the wide scope of design fields and its influence on products, services for our quality of life, we can perceive the power and responsibility of design in the observance of those principles. The proposed argument will be categorized according to three perspectives. First, Design as a noun: by enriching the markets for products and services that meet people’s expectations and needs, design is promoting freedom of choice. The second, Design as a verb, is about processes of promoting the right (of people with disabilities) to self-determination and to active and informed participation in decision-making and creation processes. Third, Design as a theme acknowledges designers’ powers and emphasizes their social responsibilities, as activists of change. This paper offers a reflection on the different contributions and responsibilities of Design in promoting fundamental rights such as dignity, freedom of choice, and the right to personal identity of diverse audiences. This article is therefore a manifesto for the Right to Design, drawing on relevant literature, practical experiences, and case studies.

Résumé :
During the outbreak of Covid-19 pandemic which has transformed the way we used to live, learning has been reshaped through MOOCs which aim to offer interactive online courses that vary in anything and length seem to revolutionize the education system all over the globe. Therefore, universities are developing new online platforms to go beyond their academic responsibilities with MOOCs to promote understanding of how universities could better fulfil the societal expectations of the people who want to learn anything in their own pace and interest. This new type of education allows people free access and unrestricted participation to any course of their choice. The main aim of this research paper is to investigate the impact of MOOCs on societal inclusion and offer practical suggestions to include high-quality MOOCs on societal learning. 70 research participants responded the questions in the workshop. These questions are related to the analysis of online learning environments and the awareness on social responsibility of research participants. After getting seminar about societal values and projects, research participants reflected their ideas and experiences in MOOCs, online learning and social responsibility learning. In this respect, they pointed out how they enhance their learning and societal values to the societal practices. Research relies on qualitative research design. In addition to this, as the results of the study were gathered from the workshop in societal research and development of the center, this research study become road map for the future direction of higher education in the digitalization and social responsibility role.

<p>Professional engineers in the US may be found negligent and therefore liable for damages arising from failure to exercise a level of care, diligence, and skill exercised by other reputable practitioners in similar circumstances. If the professional engineer has accepted the obligation to design for sustainability or resilience, where those terms or performance levels are ill-defined or open to interpretation depending on assumptions or outcomes, the professional engineer may be accepting an extreme or uninsurable risk.</p><p>This paper describes the standard of care, which is the measure of a practitioner’s performance as it relates to professional negligence. It examines the relationship between the standard of care and design for sustainability or resilience. The paper addresses 1) a discussion of the sources of the practitioner’s responsibility to design for sustainability or resilience, 2) an explanation of the concept of the standard of care, and 3) the professional liability pitfalls inherent in that design effort. The subject may be unique to professional practice in societies where litigation is used to allocate responsibility for damages, but it may also be universally relevant for practitioners wishing to understand professional responsibilities for such designs.</p>
