This chapter describes ARC’s third strategy of employing mental models. This strategy fosters reasoning and thinking that reinforces the use of ARC’s organizational components and that maintains alignment with ARC’s five principles of effective service organizations. Reasoning and thinking are reflected in the mental representations of work experiences service providers hold, and these mental models guide priorities followed when providing services. Case examples are provided to illustrate work with mental models to influence organizational members’ thinking, reasoning, and subsequent actions to improve service quality and outcomes. This chapter reviews the empirical evidence for mental models, including research from social cognition and neuroscience. The description of this strategy highlights several activities and techniques used to explore and alter mental models. These activities foster examination of implicit assumptions and beliefs that help drive reasoning and thinking toward or away from ARC’s key organizational principles, tools, and desired OSCs.

This chapter discusses the process of making contracts by auction and by tender. Although these processes are different they have important features in common both in fact and in law. Reasoning from one transaction has been carried over to the other. Both auctions and tenders are an attempt to achieve the best price by competition without entering into negotiations. Auctions are typically used to sell valuable chattels such as paintings or houses or other buildings. Competitive tendering is commonly used for the procurement of services, particularly in the construction industry. Here the assumption is that those who desire the work will bid the lowest price they can afford, thus ensuring a low price for the person procuring the service.

This chapter describes the ARC model of three core strategies for developing effective human service organizations. These include (1) embedding guiding organizational principles, (2) providing organizational component tools for identifying and addressing service barriers, and (3) developing shared mental models. ARC’s strategies provide the tools and the reasoning to guide behaviors and processes among organizational members that ensure improved service quality and outcomes. These strategies are reviewed as part of ARC’s orchestrated and structured process to improve OSC (i.e., the cultures and climates that influence attitudes, decision making and behavior in organizations). The chapter identifies mechanisms of change that highlight the alignment of organizational priorities with the ARC principles, fostering relationships that provide availability, responsiveness, and continuity, as well as developing innovation capacity to adopt new technologies and approaches.

The Public’s Law is a theory and history of democracy in the American administrative state. The book describes how American Progressive thinkers—such as John Dewey, W.E.B. Du Bois, and Woodrow Wilson—developed a democratic understanding of the state from their study of Hegelian political thought. G.W.F. Hegel understood the state as an institution that regulated society in the interest of freedom. This normative account of the state distinguished his view from later German theorists, such as Max Weber, who adopted a technocratic conception of bureaucracy, and others, such as Carl Schmitt, who prioritized the will of the chief executive. The Progressives embraced Hegel’s view of the connection between bureaucracy and freedom, but sought to democratize his concept of the state. They agreed that welfare services, economic regulation, and official discretion were needed to guarantee conditions for self-determination. But they stressed that the people should participate deeply in administrative policymaking. This Progressive ideal influenced administrative programs during the New Deal. It also sheds light on interventions in the War on Poverty and the Second Reconstruction, as well as on the Administrative Procedure Act of 1946. The book develops a normative theory of the state on the basis of this intellectual and institutional history, with implications for deliberative democratic theory, constitutional theory, and administrative law. On this view, the administrative state should provide regulation and social services through deliberative procedures, rather than hinge its legitimacy on presidential authority or economistic reasoning.

This book proposes an explicit recognition of criminology as a moral science – that is, an empirically rigorous social science that takes full account of the presence and role of values in people’s reasoning and motivation. This endeavour requires input from both criminologists and moral philosophers, and careful dialogue between them, so the book contains chapters by scholars from both disciplines. Several social sciences – notably social anthropology – have in recent decades experienced a ‘moral turn’, leading them to focus research more fully and explicitly on ethical issues. Criminology is now experiencing a similar movement, and the central aim of this volume is to extend and enhance this welcome development. Theoretically, the book explicates inadequacies and implausible elements of social scientific positivism and suggests directions for a more illuminating conception of the role of valuative considerations in social science. It also clarifies key theoretical issues such as the so-called ‘fact-value distinction’. Empirically, analyses are offered of the moral dimensions of important criminological topics, as illustrations of a moral science approach. Guilds ruled many crafts and trades from the Middle Ages to the Industrial Revolution, and have always attracted debate and controversy. They were sometimes viewed as efficient institutions that guaranteed quality and skills. But they also excluded competitors, manipulated markets, and blocked innovations. Did the benefits of guilds outweigh their costs? Analyzing thousands of guilds that dominated European economies from 1000 to 1880, this book uses vivid examples and clear economic reasoning to answer that question. The book features the voices of honourable guild masters, underpaid journeymen, exploited apprentices, shady officials, and outraged customers, and follows the stories of the “vile encroachers”—women, migrants, Jews, gypsies, bastards, and many others—desperate to work but hunted down by the guilds as illicit competitors. It investigates the benefits of guilds but also shines a light on their dark side. Guilds sometimes provided important services, but they also manipulated markets to profit their members. They regulated quality but prevented poor consumers from buying goods cheaply. They fostered work skills but denied apprenticeships to outsiders. They transmitted useful techniques but blocked innovations that posed a threat. Guilds existed widely not because they corrected market failures or served the common good, but because they benefited two powerful groups—guild members and political elites. The book shows how privileged institutions and exclusive networks shape the wider economy—for good or ill.

This book addresses the judicial review on social public policies, intending to propose a new approach to its exercise in Brazil, based on the standards and instruments consolidated in the structural remedies practice. The review approach championed by Brazilian courts creates illegitimate, anti-isonomic and ineffective decisions, which derives from the reliance on a traditional form of adjudication, bipolar and adversarial, that is inadequate to the polycentric and distributive features of the conflicts involving the delivery of public services by the government. Inspired on pioneering experiences in both foreign and domestic jurisdictions, the work outlines a theory of structural remedies applied to public policy issues that seeks to address the shortcomings of the mainstream approach, resulting in a paradigmatic shift in three main aspects of adjudication, regarding legal reasoning (distributive and dialogical), remedial practice (experimentalist, prospective and consensual) and the characteristics of the adjudication process (flexible and cooperative). Besides sustaining the merits of the described methodological shift, the author’s efforts are also aimed at formulating interpretative constructions to allow for its implementation in the Brazilian legal system. By exploring practical solutions towards a more legitimate and effective judicial review, and arranging them in a coherent theoretical framework, the book contributes to the academic debate and also gives valuable input to the public law practitioners entrusted with the duty to oversee the public administration activities in Brazil.

Arguing that progress toward enlightenment requires gradually developing specific cognitive achievements, the Buddhist philosopher Kamalaśīla alternately appeals to scripture and reasoning in ways that typify the always hermeneutical context for the development of Indian Buddhist philosophy. This context did not preclude great originality; his distinctive appeal to both of the Mahāyāna tradition’s main streams of thought (Yogācāra and Madhyamaka) creatively appropriates a famous Yogācāra argument for idealism—an argument against the coherence of any account of atoms—in service of a conclusion that finally undermines the idealism the argument originally supported. The best argument for Madhyamaka, Kamalaśīla thus urges, consists in pressing an argument for idealism against itself. In developing this line of argument, Kamalaśīla well exemplifies the scholastic character of his tradition.

This article describes the National Science Foundation (NSF)'s initiative to close the gap between theory and methods. It also deals with the Empirical Implications of Theoretical Models (EITM) as currently understood as a way of thinking about causal inference in service to causal reasoning. Additionally, it explores the approach's origins and various ways in which NSF's call to EITM action has been interpreted. It makes a brief attempt to explain why the EITM approach emerged, why it is valuable, and how it is currently understood. It then contends that EITM has been interpreted in multiple ways. It emphasizes a subset of extant interpretations and, in the process, offers views about the most constructive way forward. The idea of EITM is to bring deduction and induction, hypothesis generation and hypothesis testing, close together.

The first academic study of Lord Woolton’s important wartime role, first as Minister of Food and subsequently as Minister of Reconstruction. Woolton’s Diaries and correspondence (including with Churchill) provide key insights into how the Ministry of Food continued to operate substantially undisturbed by bombing raids, because of its relocation to Colwyn Bay while Woolton maintained the propaganda machinery for the Ministry in London. This enables a fuller understanding of the political dimensions to decisions on rationing, and the constant challenges facing the Ministry. It reveals Woolton’s consciousness of the social impact of rationing decisions, including reportage of their reception in the newspapers of the day. The book also includes a focus on Woolton’s role as Minister of Reconstruction, and how his non-party status was crucial to the development of key white papers on the main reconstruction issues, including employment, housing and a post-war national health service. His work in this area is little known, and it deserves to be better known as a background to the development of the Welfare State post-1945. As a topic, organization design is poorly understood. While it is featured in most management textbooks as a chapter dedicated to organizational structures, it is unclear whether organization design is a one-off event or an ongoing process. Thus, it has traditionally been understood to be the same as an organizational configuration, with neat lines of communication and distribution of responsibilities, following pre-set typologies. However, what can be said to constitute organizational structure in this first half of the 21st century? The extraordinary growth of digital communications, the decreasing relevance of hierarchical bureaucracies, and the general demise of command-and-control have all but decimated the traditional notion of organizational structure. In this book it is argued that organization design needs a theoretical revamping. Using a mix of design and social sciences theories and concepts, the new approach is divided into three parts: design logics, design processes, and design leadership. A generic definition of organization design logics is offered, as a set of beliefs shared by managers and entrepreneurs in given sectors of the economy about the way organizations should be designed. Five logics and three types of designing processes are put forward. Logics: (1) the identity logic, (2) the normative logic, (3) the service logic, (4) the logic of effectual reasoning, (5) the logic of interactive structure. Processes: (1) intended design, (2) emergent design, (3) perceived design. For the leadership part, a model of leaderful organization design(ing) is proposed, with the following distinguishing features: (a) practice-based, (b) guided by values of democratic participation, (c) places meaning-making and meaning-taking at the centre of organizational life, (d) driven by design logics, which can be adopted and adapted to suit different internal and external environments.
