The field of public administration writes and theorizes a good deal about institutional and structural racism, but as an applied field, we don’t address some of the potential intervention strategies for dismantling racist structures and institutions. This article examines some of the prospective strategies in areas such as reparations, criminal justice, health care, and housing which have been implemented seeking to upend institutional and structural racism in this nation. Policies or programs, unless implemented, create a revolving-door syndrome. However, even when policies are developed and implemented, their efficacy is not always guaranteed, as will be seen. This article discusses how public administration can move away from the “ready, aim, study more” conundrum, and offers suggestions for moving forward to the next frontier.

Abstract Structural racism is a fundamental cause of racial inequities in health in the United States. Structural racism is manifested in inequality in the criminal justice system; de facto segregation in education, health care, and housing; and ineffective and disproportionately violent policing and economic disenfranchisement in communities of color. The inequality that Black people and communities of color face is the direct result of centuries of public policy that made Black and Brown skin a liability. The United States is now in an unprecedented moment in its history with a new administration that explicitly states, “The moment has come for our nation to deal with systemic racism . . . and to deal with the denial of the promise of this nation—to so many.” The opportunities for creating innovative and bold policy must reflect the urgency of the moment and seek to dismantle the systems of oppression that have for far too long left the American promise unfulfilled. The policy suggestions made by the authors of this article speak to the structural targets needed for dismantling some of the many manifestations of structural racism so as to achieve health equity.

While prior research has uncovered racial disparities in the administration of death sentences, little attention has been devoted to earlier stages in the capital punishment processes. To understand the locus of racial bias within death penalty institutions, this study examines the entry of homicide cases into Los Angeles County’s criminal justice system during a 5-year period. This two-part analysis seeks to answer the following research questions: (1) Does victim/defendant race influence homicide clearance and death penalty charging decisions? and (2) if so, does the likelihood of clearance mediate the effect of victim race on death penalty charges? Logistic regressions indicate that cases involving Latino victims are less likely to be cleared. Moreover, cases with Black and Latino victims are less likely to be prosecuted with a death penalty–eligible charge. Racial disparities accumulate across these stages, with clearance patterns influencing subsequent death penalty charging decisions. Results underscore the cumulative nature of racial within criminal justice institutions. By linking police and prosecution outcomes, these findings also highlight the interrelationship between criminal justice agencies.

Shortly after the alleged discovery of America and its vast expanse of land waiting to be cultivated with cash crops using cheap human labor, millions of Africans fell victims and were kidnapped to work as slaves in American plantations for about four centuries. Even though it has been over 150 years since the official abolition of slavery in America, the effects of the 400 years of enslavement continue to reverberate: irrespective of the blackletter rights protecting Black people from injustices, the deep racist structures typically decrease the potency of these rights, and thus perpetuate oppression. This article assesses the roles being played by race and profit in the administration of criminal justice: it deems the systemic oppression of Black people as a humanitarian crisis and seeks to ascertain this by interpreting the attitudes of the various key players in the American Criminal Justice System, the majoritarian population, mainstream media, and Corporate America: it challenges some entrenched racist practices suspected to be the umbilical cord that links Black people in America with mass incarceration.

Consideration by a judge of criminal cases is closely related to the formation of internal conviction, which, in turn, is influenced by numerous factors, including internal psychological ones. One of them is the phenomenon of stereotyping, inherent to every person as a component of human social nature. The Article Purpose is to analyze the phenomenon of stereotype, its historical development, and study into the influence of the stereotyping process on the judge while consideration of criminal cases. To fulfil the specified goal, a systematic approach was chosen out of general scientific and special scientific methods, among which the most widely used are: historical-legal, formal-legal, and systemic-structural. Significance of the stereotyping phenomenon for society as a whole and for an individual in particular has been also analyzed, its influence on a judge’s internal perception of the defendant and case circumstances, as well as its impact on evidence evaluation in a criminal proceeding. The influence of various types of stereotypes on perception by a judge of a person brought to criminal responsibility (depending on his/her gender, race, or nationality) has been studied, along with racial bias during consideration of criminal cases (depending on crime type). It has been proven that a deeply-rooted stereotype can influence the development of a judge’s internal conviction, and therefore, evaluation of evidence in a case, the decision on a person’s guilt (innocence), determination of punishment, etc. It has been highlighted that stereotyping during administration of criminal cases by a judge negatively affects the judge’s impartiality and may provoke discrimination against parties in a criminal proceeding, which is inadmissible.

AbstractThe rise of crack cocaine in the late 1980s propelled the war on drugs. The experience of Canton, Ohio, shows how the response to crack solidified mass incarceration. A declining industrial city of 84,000 people in northeast Ohio with deep-seated racial divides, it was overwhelmed by aggressive, enterprising crack dealers from outside the city. In response, politicians and residents united behind the strategy of incessant arrests and drastic prison sentences. The law-enforcement offensive worsened conditions while pursuing African Americans at blatantly disproportionate rates, but few people engaged in reframing the drug problem. Instead, a punitive citizenry positioned punishment as the principal remedy. The emergency foreclosed on more comprehensive assessments of the city’s tribulations, while the criminal justice system emerged as the paramount institution.

AbstractIn general, during the nineteenth century the British were indifferent to the condition of the insane in colonial Burma. This was most apparent in the Rangoon lunatic asylum, which was a neglected institution reformed reluctantly and episodically following internal crises of discipline and the occasional public scandal. However, whilst psychiatry was generally neglected, British officials did intervene when and where insanity threatened the colonial order. This occurred in the criminal courts where the presence of suspected lunatics was disruptive to the administration of justice. Insanity was also a problem for the colonial regime within the European community, where erratic behaviour was viewed as a threat to racial prestige. This paper shows how, despite its neglected status in Burma, psychiatric knowledge contributed to British understandings of Burman masculinity and to the maintenance of colonial norms of European behaviour.

Racial segregation in California prisons is a primary means of maintaining control and safety for inmates and correctional staff, yet little is understood about how racial segregation in prison impacts reentry of offenders into the community. The research question examined in this study focused on how living in the racial segregation of a California State prison, for 2 years or more might influence African-American, White, and Latino men's ability to interact with other races in a culturally diverse community upon release. Using Donald Clemmer's theory of prisonization as the foundation, the purpose of this phenomenological study was to understand the experiences of men who lived in a racially segregated environment in prison regarding post-release reintegration. Specifically, their experiences with interacting in a culturally diverse environment after prison were examined to understand how behaviors and attitudes in prison were adapted by formerly incarcerated men in community life. A sample of 15 formerly incarcerated males were interviewed in response to posted fliers and community presentations. Collected data were analyzed between and among races for similar responses to the interview questions according to the Van Kaam method. Fourteen of the 15 participants reported that racial reintegration added challenges such as difficulty trusting and interacting with races other than their own post release, and additionally they stated they were grateful to return to a culturally diverse community. Positive social change stemming from this study include recommendations to prison leaders to introduce social skill building training into reintegration programming that supports former inmates to more effectively interact with diverse populations as they transition to community life.

Texas leads the nation in the number of executions carried out since capital punishment was reinstated in 1976. Race was a key factor in the 1972 moratorium, and though the Supreme Court allowed for its return under new statutes, race continues to plague the capital punishment legal system. In this study, I examine the influence of race on case clearances in capital and non-capital homicides in Texas, using the extra-legal and non-discretionary theories from existing clearance literature. I find that race influences the probability of cases being cleared in non-capital cases but has no statistically significant effect in clearing capital cases.

The literature which addresses the treatment and disposition of juvenile offenders thoroughly establishes the prevalence of racial bias. Though research is abundant regarding racial bias in both the mental health field and in the juvenile justice system, little exists which examines whether the two combine to contribute to the disproportionate percentage of minority offenders in the justice system. This paper examines this possible contribution. It is hypothesized that both probation officers and mental health professionals employ racial discrimination in dispositional recommendations leading to recommendations for the incarceration of black offenders although white offenders with identical characteristics are recommended for placement in mental health treatment facilities. A log-linear model for single-response qualitative data was modified to a 2 x 2 chi-square analysis due to the low number of referrals to detention which would not allow an evaluation of interactions between the variables. Utilizing a chi-square analysis, statistical significance was not met. Possible reasons for these findings and implications for research are addressed.

The criminal justice administration has failed the American Indian. Since the usurpation of traditional tribal criminal justice management by the local, state, and federal criminal justice systems, the impacts of Indian crime have become epidemic. The American Indian has the highest arrest rates, alcohol-related crime, violent-related crime, and conviction rates of any group in the United States. Indians are 15% less likely to receive deferred sentences, and 15% less likely to receive parole. In addition, the Indian offender has the highest recidivism rate of any ethnic group in the United State. This paper discusses the problems of Indians in the criminal justice system at the adult and juvenile level. As recommendations it stresses the empowering of the Indian community, the greater autonomy of tribal courts, the concepts of alternative sentencing programs for Indian offenders, treatment as justice, and the idea that Indian people can take charge of this problem and do a better job in addressing their relatives.

This study explores the experience of people who have been publicly declared guilty. It retells the narratives of offenders from the point of arrest through to conviction and, where relevant, imprisonment and release. The experiences of close relatives are also explored and provide an important part of the thesis. These accounts are set against the institutional context of the criminal justice system and a systemic account of police, courts, prisons and community corrections is provided. The main aim of the study is to investigate and document the impact of the criminal justice process on offenders' sense of 'self'. At a theoretical level, the study is informed by symbolic interactionism, particularly the work of Erving Goffman. This enables the development of insights into issues such as loss, shame, humiliation and loss of self. The asymmetrical power relationship in which these feelings are engendered and maintained is emphasised. At the same time, the study records the level and types of resistance among the subjects of the criminal justice system. The findings are significant for our sociological understandings of the impact of being declared guilty, for they suggest that the criminal justice process per se contributes to a severely damaged self, and that the subjective experience of 'being found guilty' starts at the moment of arrest and persists well after sentencing as subjects try to re-integrate into the community with a record of conviction. The study also suggests that these processes are not passively absorbed by subjects. As well as describing feelings of shame and loss, those participating in the research talked about the unfairness of the system, their preparedness to resist in numerous ways, and of their longing for an older, better life in which their sense of self was undamaged. The study concludes by arguing that profound change to the culture of the criminal justice system is needed if rehabilitation is to be successful. In this context it emphasises the importance of accountable and transparent human services concerned with the human and civil rights of offenders, court diversion schemes, alternatives to custody, and the practical application of restorative and therapeutic justice.

COVID-19 caught humanity off guard at the turn of 2019/2020. Even when the Chinese government sealed off Wuhan, a city of millions, for weeks to contain the epidemic, no one in other parts of the world had any idea of what specifically was heading for the countries. The ignorant and belittling public statements and tweets of the former US president are still fresh in everyone's memory. Only when the Italian army carried the coffins with the COVID-19 victims in northern Italy, the gravesites spread in the Bergamo region, as well as the intensive care beds filled in the overcrowded hospitals, the countries of the European Union and other parts of the world realised how serious the situation threatened to become. Together with the World Health Organisation (WHO), the terms changed to pandemic. Much of the pandemic evoked reminiscences originating in the Black Death raging between 1346 and 1353 or in the Spanish flu after the First World War. Meanwhile, life went on. The administration of justice in criminal cases could not and should not come to a standstill. Emergency measures, such as those that began to emerge in February 2020, are always the hour of the executive. In their efforts to stop the spread of the virus, in Germany, governments particularly reflected on criminal proceedings. Neither criminal procedural law nor the courts and court administrations applying this procedural law were adequately prepared for the challenges. Deadlines threatened to expire, access to court buildings and halls had to be restricted to reduce the risk of infection, public hearings represented a potential source of infection for both the parties to the proceedings and the public, virtual criminal hearings via conference calls had not yet been tested in civil proceedings, but were legally possible, but not so in criminal cases. The taking of evidence in criminal cases in Germany is governed by the rules of strict evidence and is largely not at the disposal of the parties to the proceedings. Especially in criminal cases, fundamental and human rights guarantees serve to protect the accused, but also the victims and witnesses. Executive measures of pandemic containment might impact these guarantees. Here, an attempt will be made to discuss at some neuralgic points how Germany has attempted to balance the resulting contradictory interests in the conflict between pandemic control and constitutional requirements for criminal court proceedings.

In the regulation of the current Romanian Code of Criminal Procedure (Law no. 135/2010, entered into force on February 1, 2014), the contestation regarding the duration of the criminal trial was conceived as a procedural remedy in the case of the lack of celerity of the judicial bodies. The lack of promptness of the criminal investigation bodies can lead to the violation of the fundamental right to resolve the case within a reasonable term, as a component of the right to a fair trial, enshrined in the European Convention for the Protection of Human Rights and Fundamental Freedoms (art. 6 par. 1). Starting from a recent decision of the supreme court in Romania (Decision of the High Court of Cassation and Justice no. 7/2022) pronounced in the resolution of a recourse in the interest of the law, the present work addresses the issue of the admissibility of the contestation regarding the duration of the criminal trial in the case of facts whose authors have not been identified. In this study, the following research methods are used: documentation, interpretation and scientific analysis (including the comparative analysis of some jurisprudential solutions). The study aims to contribute to the unified interpretation and application of the provisions relating to the special procedure of contestation regarding the duration of the criminal trial, as currently regulated in the Romanian Code of Criminal Procedure. The paper emphasizes the need to exercise the active role of the criminal investigation bodies in the administration of evidence, including in cases with unknown authors. The conclusion is that, considering the hierarchy of normative acts, the application of methodological norms (with lower legal force than the law) regarding the administrative organization of criminal investigation activities in cases with unidentified perpetrators cannot have the effect of diminishing the role of the contestation regarding the duration of the criminal trial, as a remedy in speeding up the procedure, when the judge of rights and freedoms finds that the reasonable duration of these activities has been exceeded.

A new dual-campus subject librarian program is being rolled out at the University of Central Florida (UCF) whereby several subject librarians divide their time between two campuses, the legacy main campus in East Orlando and the new Downtown Orlando Campus. As of Fall 2019, four UCF subject librarians regularly travel to the new Downtown Campus to provide library support for academic programs, faculty, and students who recently relocated to the new facility. Dual-campus subject librarians are also maintaining support services for their assigned academic programs that remain at the UCF Main Campus. This article provides information and reflections about how the dual-campus subject librarian model operates and how it impacts staff duties from two perspectives. The first perspective is from the UCF Social Sciences subject librarian, who supports graduate and undergraduate programs in The School of Public Administration and Public Affairs graduate programs at the Downtown Campus, as well as graduate and undergraduate programs in Politics, Security & International Affairs and Criminal Justice at the Main Campus. The second perspective is from the Main Campus Head of the Research and Information Services Department, who supervises the dual-campus subject librarians.
