Can a modern liberal democracy’s criminal law be pleaded as a defense of feelings? The intricacies of regulation issue from the extreme difficulties to sound out psychic processes as well as from the pivotal point, which derives from the undaunted research of criteria capable of preserving the free circulation of expressive displays in a open and pluralist society.
The acknowledgement of liberty is related to the need of equal respect towards different identities, along with diverse life forms coherent to the preservation of a nucleus of values essential to cohabitation.
The perspective of a jurist is aimed to the research of reasonable counterbalances, among the need of respect of individuals and the preservation of forms and communicative contents, of which liberty is itself a basic part of mutual respect, due from each of us to all. The prescriptive model on which to establish a perspective concerning the defense of feelings is the one defined by the contemporary political philosophy as “equal respect”. The normative attainment of a horizon through which feelings and diversity are respect-worthy cannot be not subject to the impetus of contingent disputes; the real requirement consists of setting in advance an equal shape of the (not unlimited) spaces in use to democracy; to grant people, since equal, the chance to live according to their values. The idea of equality itself sets itself up as a line of defense against personal aggressions instrumentally based on feelings as a demeaning factor having a purpose to the detraction of the equal dignity of an individual: to prevent cases of marginalization, of discrimination, as well of democratic reciprocity. Può il diritto penale di una moderna democrazia liberale essere invocato a tutela di sentimenti? Le complessità di una regolamentazione normativa derivano sì dalla estrema difficoltà di sondare i processi psichici, ma il nucleo problematico fondamentale sembra risiedere nella ricerca di criteri che possano preservare la libera circolazione di manifestazioni espressive in una società aperta e pluralista.
Il riconoscimento di libertà si lega all’esigenza di un eguale rispetto delle diverse identità, delle diverse forme di vita compatibili con la salvaguardia di un nucleo di valori essenziali per la convivenza. La prospettiva in cui si muove il giurista è la ricerca di ragionevoli bilanciamenti fra le esigenze di rispetto per le persone e la salvaguardia di forme e contenuti comunicativi la cui libertà è anch’essa parte essenziale del reciproco rispetto dovuto da ciascuno a tutti.Il modello normativo su cui fondare una prospettiva di tutela di sentimenti è quello che la filosofia politica contemporanea definisce come “eguale rispetto”. La realizzazione normativa di un orizzonte nel quale possano essere rispettati sentimenti e diversità non è condizionata all’impulso di conflitti contingenti: la reale esigenza è pre-disporre un assetto paritario degli spazi (non illimitati) di cui la democrazia dispone; offrire alle persone, in quanto eguali, la possibilità di vivere secondo i propri valori. Quale orizzonte di tutela si configura l’idea stessa di eguaglianza contro attacchi personali che adoperino strumentalmente il sentimento (rectius, il modo d’essere e l’identità dell’individuo) come fattore degradante per la negazione della pari dignità della persona: impedire fatti di emarginazione, di discriminazione, di negazione della reciprocità democratica.

Resumo: Esta dissertação tem como tema a questão do sentimento de pudor muitas vezes manifestada em ambientes clínicos, mais precisamente na clínica obstétrica. O trabalho de campo foi realizado no Hospital Nossa Senhora da Luz dos Pinhais, no município de Pinhais/PR, tendo duração de três meses. A metodologia de pesquisa baseou-se na observação participante de diversos setores do hospital com o objetivo de detalhar cada função clínica específica desempenhada pelos diversos serviços prestados pelo hospital. Neste contexto, três setores se destacaram quando a questão é o pudor, setores estes de internação (Ambulatório, Centro Cirúrgico Obstétrico e Alojamento Conjunto) para gestantes e puérperas. Por meio da observação participante algumas gestantes foram acompanhadas desde sua entrada no hospital, assim como o período pré e pós cirúrgico (parto), até sua saída no momento em que receberam alta. Também foram realizados sete entrevistas com mulheres que estiveram internadas, sendo as entrevistas realizadas fora do ambiente hospitalar. O objetivo geral da pesquisa foi compreender os significados que os sujeitos atribuem ao pudor em relação ao corpo e aos sentimentos. Em que situações sociais estes significados são manifestos. Nossa análise nos levou a entender o pudor como uma "constelação de sentimentos" que se manifesta em diferentes situações da clínica obstétrica, na qual o processo de interação entre sujeitos é sempre o suporte e o lócus de sua manifestação. Durante a internação as gestantes passam por mecanismos onde as relações são estabelecidas conforme uma rotina já estabelecida pela lógica dos protocolos clínicos, tendo como conseqüência a sujeição do corpo da mulher por meio de normas institucionais. Os aspectos morais envolvidos na interação, como a integralidade do corpo, a intimidade frente à diferenciação dos sexos, os sentimentos de dor e sofrimento, angústia, medo, vergonha e pudor, também estão submetidos ao conjunto dessas normas e dos protocolos.

Etudier les comportements insulaires face à la liturgie romaine, à travers le chant sacré, c'est ce que nous propose ce travail. Entre respect et transformation, et parfois même perversion, c'est à l'usage que les Corses se construisent un monde religieux qui met en scène les rituels chantés selon des temps et des espaces spécifiques. Le corpus met à jour la préoccupation constante de la hiérarchie cléricale face aux risques de ce traitement populaire du répertoire sacré, l'histoire musicale en Europe étant celles des rapports, quasi belliqueux, du moins étranges, entre l'Eglise et ses paroisses. L'étude suivante essaye de mesurer le poids de ce phénomène dans la société corse traditionnelle, utilisant les directions de mutations les plus importantes et l'adaptation populaire tout au long des temps forts de son histoire, observant la manière d'organiser son " espace sonore " à travers la maîtrise de son répertoire profane et sacré. Les temps chronologiques se superposent parfois dans un même espace sonore, et la référence au pouvoir, au maître du temps, éclaire le comportement traditionnel à l'aide du corpus étudié. Trois grandes périodes s'imposent : l'Antiquité avec le planus-cantus qui vient se confronter à la paghjella, une forme musicale spécifique en usage dans le rituel religieux insulaire, la fin du Moyen-âge qui diffuse le répertoire des confréries, et le XVIIIème siècle qui va contribuer à la subversion du rituel sonore. Ainsi l'étude de l'évolution des lieux, des rites et de la liturgie qui permettent aux chants traditionnels d'exister et de se transmettre de manière autonome, sera privilégiée, mettant en évidence les changements portés sur le rituel de la Semaine Sainte, sur l'Office des morts, sur la Messe et leurs conséquences sur cette transmission populaire (traitement altéré de la durée des rituels, formes des processions, des vêpres, de la granitula).

El presente trabajo consistirá en el análisis de tres personajes de la novela Pudor de Santiago Roncagliolo. A través de ellos, y con la ayuda de la teoría psicoanalítica, se verá cómo la novela construye una imagen del sujeto posmoderno. La novela describe a tal sujeto como uno que vive en la paradoja constante de necesitar al otro para satisfacer su deseo y, a su vez, considerarlo una amenaza que interrumpe su goce. Esto traerá como consecuencia que el sujeto se aísle de los demás, lo cual refuerza la sensación de soledad en él. Esta tesis se encargará de demostrar que dicho problema, en la novela, está directamente relacionado con los tiempos en los que vivimos: tiempos que ponen en duda la existencia del Otro y enaltecen el valor del individualismo. Así, a partir del malestar sentido por los personajes, la novela quiere darnos a conocer más sobre el malestar que azota al sujeto de nuestra realidad.Tesis

A presente dissertação se enquadra dentro de uma série de esforços de pesquisa realizados nos últimos anos sobre violência sexual pelo Núcleo de Pesquisas Margens - Modos de Vida, Família e Relações de Gênero. A literatura sobre homens que cometem estupro no Brasil ainda é parca e pouco desenvolvida em comparação com outros países. A falta de pesquisas e de teorias que dêem conta destes homens remete também à falta de qualquer intervenção para com estes homens. A pesquisa teve como objetivo uma compreensão balizada epistemologicamente pela psicanálise Freudo-Lacaniana e pelos feminismos pós-estruturalistas, utilizando principalmente os conceitos de enunciação e performatividade para abarcar o discurso que os sujeitos apresentam ao relatarem situações de violência sexual. Para atingir este objetivo foram realizadas oito entrevistas semi-estruturadas com homens apenados pelos crimes de estupro, atentado violento ao pudor, pedofilia e corrupção de menor dentro da Penitenciária Estadual de Florianópolis. Entrevistas que então foram transcritas e analisadas. Destas oito entrevistas cinco foram analisadas nesta dissertação e três foram descartadas por não apresentarem elementos que fizessem parte do foco da mesma. As cinco entrevistas foram tratadas como estudos de caso isolados, priorizando uma escuta sem o objetivo de estabelecer uma teoria subjacente e aplicável à todos os casos. A utilizaçao de teorias feministas e da psicanálise se provou uma ferramenta útil de análise pois promove uma visão mais complexificada, elaborada e detalhada dos casos apresentados. É necessário que se estabeleça uma tradição de estudos com homens que cometem estupros no Brasil para que assim se possa dar conta da realidade social vivida no país assim como compreender quais masculinidades são performativamente produzidas pelos mesmo, e como essa promove violências sexuais.

Food has a near-ubiquitous role in the fiction of Charles Dickens. From the action that does and does not take place, to the appearance and essence of the characters, and to the language and style in which they were written, virtually every aspect of Dickens's novels and short stories is, to some extent and at one time or another, connected with food. This thesis explores the nature and implications of food in Dickens and, in addition to its introduction and conclusion, it has been divided into three chapters: (a) Language, Style, and Subject/theme; (b) Plot and Setting; and (c) Characterization. As well, the parallel between food's omni-presence in Dickens's fiction and its centrality in the so-called 'real world' has meant that the literary concept 'realism' is a recurrent concern.

This thesis analyzes the People's Republic of China's modernization strategy in order to test the hypothesis according to which the "open-door" policy might represent a shift from Marxism to a Neoclassical economy model. To do so, the author compares the performance realized by the Special Economic Zones (SEZs) and by the newly established Shanghai-Pudong New Area (1990). Although it benefits from the fourteen year old SEZs experience, it is argued, Pudong duplicates the flaws inherent to the SEZs and fails to offer advancement over their development. The author then suggests that China's initial objective to build a strong modern socialist country has apparently been gradually displaced by an evolutionary process of change similar to that in the Asian New Industrialized Countries (NICs), namely South Korea, Taiwan, Hong Kong and Singapore.

Este estudo apresenta uma análise das relações de poder estabelecidas entre o Estado e travestis, que viveram em Porto Alegre durante a Ditadura Militar, na década de 1970. O ponto de partida para construção do problema de pesquisa surge a partir da narrativa da história de vida da militante do movimento LGBTT Marcelly Malta, que veio do interior para capital gaúcha nos anos 1960, quando inicia a experiência na prática da prostituição e a expressar sua travestilidade. Foram localizadas outras experiências de travestis que vivenciaram o mesmo período histórico, registradas a partir de inquéritos policiais da Delegacia de Costumes e processos judiciais do Tribunal de Justiça do Rio Grande do Sul. A partir de um recorte de pesquisa, os processos escolhidos para análise foram aqueles em que as travestis sofreram prisões arbitrárias acusadas de vadiagem e atentado ao pudor, especificamente por dois dispositivos legais ou jurídicos, respectivamente, os artigos 59 e 61 da Lei de Contravenções Penais. Identificou-se a construção de uma estratégia para punição da prática da prostituição com base no arcabouço legal existente, especificamente no caso das travestis uma transição discursiva sobre as expressões de travestilidades do âmbito jurídico para uma questão de relevância médica ou psiquiátrica. Por fim, apresentamos a materialização desses acontecimentos através da alteração das trajetórias dessas travestis na cidade e os espaços de sociabilidade LGBTT, como estratégias de resistência à perseguição sistemática que sofreram dessas instituições do Estado.Este estudio presenta un análisis de las relaciones de poder establecidas entre el Estado y travestis, que vivieron en Porto Alegre durante la Dictadura Militar, en la década de 1970. El punto de partida para la construcción del problema de investigación surge a partir de la narrativa de la historia de vida de la militante del movimiento LGBTT Marcelly Malta, que vino del interior hacia la capital gaucha en los años 1960, cuando empieza su experiencia en la práctica de prostitución y a expresar su travestilidad. Fueron ubicadas otras experiencias de travestis que vivenciaron el mismo periodo histórico, registradas a partir de investigaciones policiales de la Comisaria de Costumbres y de procesos judiciales del Tribunal de Justicia de Rio Grande do Sul. A partir de un recorte de investigación, los procesos elegidos para el análisis fueron aquellos en los que las travestis sufrieron detención arbitraria acusadas de vagabundeo y atentado al pudor, específicamente por dos dispositivos legales o jurídicos, respectivamente, los artículos 59 y 61 de la Ley de Contravenciones Penales. Se identificó la construcción de una estrategia para punición de la práctica de prostitución con base en el marco legal existente, específicamente en el caso de las travestis, una transición discursiva sobre las expresiones de travestilidades del ámbito jurídico para una cuestión de relevancia médica ou psiquiátrica. Por fin, presentamos la materialización de esos hechos a través de los cambios en las trayectorias de esas travestis, en la ciudad y en los espacios de sociabilidad LGBTT, como estrategias de resistencia a la persecución sistemática que sufrieron de esas instituciones del Estado.

Previous issue date: 2011Aiming to investigate sex and sexuality representations imparted over the years, by the cinema of fiction feature film produced in Rio Grande do Sul, the study seeks to map some of the major aesthetic and narrative strategies used to approach sexuality kinematics especially in this filmography. To this end, the research conducts a survey of works produced since the early days of cinema feature film in the state to the year 2009. It then proposes an indexation of filmic fragments (scenes/sequences) that contain representations of diegetic sex, whose contents are analyzed taking into account formal and symbolic aspects, the relationships that can be established amongst the works, and also between them and their historical and social context of production. The qualitative evidence confirms the existence of strategies of sex representation common to different works, even though their uses are changed according to the time of production. The recurrences and the evolution of such strategies in accordance with the socio-historical context in which they operate allow the survey to propose a grouping of filmic fragments, generally in three phases: a phase predominantly elliptical and metaphoric, in which sex is kept restricted to offscreen representations, which corresponds to the movies prior to 1979; a phase of radical break with the previous model, operated by the films produced during the 1980s and that inaugurates new themes and imagery representations of greater explicitness, and a hybrid phase corresponding to the predominant representations from the years 1990 and that seem to revisit the relatively limited repertoire of symbols that had been consolidated in previous decades.
Com o objetivo de investigar as representações do sexo e da sexualidade veiculadas, ao longo dos anos, pelo cinema de ficção em longa-metragem produzido no Rio Grande do Sul, o estudo procura mapear algumas das principais estratégias narrativas e estéticas utilizadas para abordar a sexualidade cinemática nesta filmografia. Para tal, realiza um levantamento das obras produzidas desde os primórdios do cinema de longa-metragem no estado até o ano de 2009. Em seguida, propõe uma indexação dos fragmentos fílmicos (cenas/sequências) que contêm representações do ato sexual diegético, cujos conteúdos são analisados levando em consideração aspectos formais e simbólicos, as relações que podem ser estabelecidas entre as obras e, ainda, entre elas e seu contexto histórico-social de produção. As evidências qualitativas confirmam a existência de estratégias de representação do sexo comuns a diversas obras, ainda que seus usos sofram alterações de acordo com a época de produção. As recorrências e as evoluções de tais estratégias de acordo com o contexto sócio-histórico em que estão inseridas permitem à pesquisa propor um agrupamento dos fragmentos fílmicos, de maneira geral, em três fases distintas: uma fase predominantemente elíptica e metafórica, na qual o sexo é mantido restrito às representações extracampo e que corresponde aos filmes anteriores a 1979; uma fase de ruptura radical com o modelo anterior, operada pelos filmes produzidos durante a década de 1980 e que inauguram novas temáticas e representações de maior explicitude imagética; e uma fase híbrida, correspondente às representações predominantes a partir dos anos 1990 e que parecem revisitar, como se operassem uma espécie de síntese, o repertório simbólico relativamente limitado que se consolidara ao longo das décadas precedentes.

Background: With the emerging application of autonomous vehicles in the automotive industry, several efforts have been made for the complete adoption of autonomous vehicles. One of the several problems in creating autonomous technology is the detection of water puddles, which can cause damages to internal components and the vehicle to lose control. This thesis focuses on the detection of water puddles on-road and off-road conditions with the use of Deep Learning models. Objectives: The thesis focuses on finding suitable Deep Learning algorithms for detecting the water puddles, and then an experiment is performed with the chosen algorithms. The algorithms are then compared with each other based on the performance evaluation of the trained models. Methods: The study uses a literature review to find the appropriate Deep Learning algorithms to answer the first research question, followed by conducting an experiment to compare and evaluate the selected algorithms. Metrics used to compare the algorithm include accuracy, precision, recall, f1 score, training time, and detection speed. Results: The Literature Review indicated Faster R-CNN and SSD are suitable algorithms for object detection applications. The experimental results indicated that on the basis of accuracy, recall, and f1 score, the Faster R-CNN is a better performing algorithm. But on the basis of precision, training time, and detection speed, the SSD is a faster performing algorithm. Conclusions: After carefully analyzing the results, Faster R-CNN is preferred for its better performance due to the fact that in a real-life scenario which the thesis aims at, the models to correctly predict the water puddles is key

L’écoulement au sein d’une flaque d’eau lors du passage d’un pneumatique en roulement est étudié dans ce travail. Une méthode de mesure adaptée aux mesures sur piste sous un véhicule en roulement est développée dans un premier temps. Cette méthode basée sur la méthode PIV (Vélocimétrie par Images de Particules), consiste en la réfraction de la nappe laser à l’interface hublot/écoulement afin de pouvoir éclairer les particules par le même accès optique que la collection d’images. Cette technique appelée refracted PIV (R-PIV) est caractérisée dans un premier temps sur un écoulement contrôlé en laboratoire. Cette technique est ensuite adaptée au cas de la piste pour les mesures in-situ. Ces mesures appliquées à la piste ont permis de mettre en évidence différents comportements de l’écoulement dans la flaque d’eau en amont du pneumatique mais également au sein des sillons pneumatiques. En amont du pneumatique les évolutions linéaires de la vitesse du fluide en fonction de la vitesse du véhicule est mise en évidence dans ce travail. Des effets non linéaires sont également observés et mis en lien avec la réduction de l’aire de contact pneu chaussée. Dans un second temps, l’étude de l’écoulement au sein des sculptures du pneumatique dans l’aire de contact nous permet de mettre en évidence deux grands types de sculptures. Le premier est composé de tous les sillons longitudinaux du pneumatique. Dans ces sillons, la vitesse de l’écoulement à travers ces sculptures dépend de la vitesse véhicule mais également de la présence du témoin d’usure du pneumatique. Un écoulement secondaire tourbillonnaire a également été mis en évidence grâce à nos mesures sur piste. Dans le second type des sillons composés de toutes les sculptures orientées transversalement, la vitesse du fluide, en leur sein, dépend de leur position dans l’aire de contact. Cette évolution semble être fonction de la déformation du pneumatique dans l’aire de contact. Pour finir, les interactions entre ces différents types de sculptures sont également discutées dans ces travaux permettant d’expliquer certains comportements spécifiquesIn this work, the fluid flow in a water puddle while a rolling tire crosses the puddle is studied. A measurement method adapted to track measurements under a rolling tire is developed. This method, based on PIV (Particle Image Velocimetry), is based on the refraction of the laser light sheet at the flow/window interface. This allows us to illuminate particles and record their images from a single optical access. This technique called refracted PIV (R-PIV) is characterised with a laboratory controlled experiment. When characterised, this technique is applied to in-situ measurements on the track. Measurements performed allow to highlight specific behaviours in different parts of the flow, in front of the tire and inside tire grooves in the contact patch area between the tire and the road. In front of the tire, the linear evolution of the water velocity in the puddle as a function of the vehicle speed is demonstrated. At high vehicle speed, non-linear effects are highlighted and linked to the shape of the contact patch area which evolves at high vehicle speed. Under the tire contact patch area, two main types of grooves contribute to the draining of water. Firstly, the longitudinal grooves are the straight grooves aligned with the rolling direction. In these grooves, the velocity of the fluid flow depends on the vehicle speed and also on the presence or not of the wear indicator. A secondary vortex like flow structure is also demonstrated in this work. The second type of grooves are the transverse grooves which are the grooves oriented with a certain angle compared to the car rolling direction. In these grooves, this work proved that the velocity is dependent on the groove location in the contact patch area. This seems to be linked to the tire deformation with the load of the car in the contact patch area. Finally, this work discussed the link between the different tire groove types to explain different specific behaviours

Previous issue date: 2012-10-24This study proposes to analyze the new type of criminal problem of rape and crimes contest inserted in art. 213 of the Criminal Code, according to Law no. 12015 of 07 August 2009. This united and equated the offense of indecent assault to rape criminal figure. Ready emerged from studies and debates about the aforementioned legislative innovation, which some refer to the new criminal offense of rape as an alternative mixed type, and others say is a mixed type cumulative. So the question: is the applicable contest crimes in the new type of criminal offense of rape? If applicable, what kind should be applied to the liability of the agent? It is noteworthy that prior to the Act, the key to the consummation of the crime of rape was human conduct to practice "carnal knowledge", we can state categorically that this would be the only action capable of setting up the offense. With respect to the consummation of the offense that was the crime of "gross indecency", the making of any lewd acts in order to satisfy lust, carnal knowledge of diversity, would characterize. So, assuming consummation of the two crimes on the same factual context, the impasse was resolved with foundation material of crimes in the contest. However, with the current wording, the problem lies in ebolição. Therefore, the study of the two institutes, type of rape and crimes contest, becomes relevant because, depending on the position adopted will reflect the application of the sentence considerably. According to the legislative change of the Penal Code, find interesting, or at least try to present a solution that brings soothing more legal certainty, therefore, doctrine and jurisprudence are not in unison on the issue. Thus, this paper aims to examine the issue, considering the application of the contest to the crime of rape crimes, and if possible such application, point the species being used to hold the criminal agent: the "material contract", the "formal tender "or" continuing criminal offense. " In order to conduct the job well and reach a conclusion in accordance with the pre-existing ideas, researched and foreign doctrinal works, and jurisprudence, due to the construction of logical reasoning. O presente trabalho propõe-se a analisar o novo tipo penal de estupro e a problemática do concurso de crimes inseridos no art. 213 do Código Penal, em decorrência da Lei nº. 12.015, de 07 de agosto de 2009. Este uniu e equiparou o delito de atentado violento ao pudor à figura penal do estupro. De pronto surgiram estudos e debates acerca da supramencionada inovação legislativa, os quais alguns se referem ao novo tipo penal de estupro como um tipo misto alternativo, e outros dizem ser um tipo misto cumulativo. Então, o questionamento: é aplicável o concurso de crimes no novo tipo penal do crime de estupro? Se cabível, qual espécie deve ser aplicada para a responsabilização do agente? Cabe ressaltar que, antes da referida lei, o ponto-chave para a consumação do crime de estupro era a conduta humana de praticar a conjunção carnal ; podemos afirmar de maneira categórica que esta seria a única ação capaz de fazer configurar o delito. No que tange à consumação do tipo penal que tratava do crime de atentado violento ao pudor , a realização de qualquer ato libidinoso com o fim de satisfazer a lascívia, diverso da conjunção carnal, o caracterizaria. Então, na hipótese de consumação dos dois crimes no mesmo contexto fático, o impasse era resolvido com alicerce no concurso material de crimes. Entretanto, com a atual redação, a problemática encontra-se em ebolição. Logo, o estudo dos dois institutos, tipo de estupro e concurso de crimes, ganha relevância porque, dependendo da posição adotada, refletirá consideravelmente na aplicação da pena. De acordo com a mudança legislativa do Código Penal, interessa encontrarmos, ou ao menos tentarmos apresentar, uma solução apaziguadora que traga mais segurança jurídica, pois, doutrina e jurisprudência não são uníssonas quanto à questão. Assim, o trabalho objetiva verificar o tema, considerando a aplicação do concurso de crimes ao crime de estupro; e, se possível tal aplicação, apontar a espécie a ser utilizada para responsabilizar o agente criminoso: o concurso material , o concurso formal ou a continuidade delitiva . A fim de conduzir bem o trabalho e chegar a uma conclusão em conformidade com as ideias preexistentes, pesquisamos obras doutrinárias nacionais e estrangeiras; e a jurisprudência, para a devida construção do raciocínio lógico. Entendemos inaceitável a aplicação do concurso material de crimes por tratarem-se as duas figuras típicas previstas no art. 213 de um crime único estupro. Em caso extremo, se aplicaria o instituto da continuidade delitiva, pois não cabe ao operador do direito, pelo menos em matéria penal, corrigir uma falha técnica do legislador, sob pena de violar o princípio fundamental que é o da legalidade. Nesse sentido, o legislador penal reconhece que falhou gravemente, tanto que no projeto do novo Código Penal separa novamente as figuras típicas do estupro e do atentado violento ao pudor, e acaba com o termo conjunção carnal , que tantas dúvidas interpretativas traz na prática. Assim, o novo texto legal que trata do delito de estupro discrimina expressamente o termo conjunção vaginal , integrando também os termos conjunção anal e oral

The objective of this research was to establish a relationship between arc spot weld shear strength and the arc time used to form the weld. Lap shear tests were performed on both 3/4 in. and 5/8 in. nominal diameter welds. Each weld was formed in one-, two-, or four-layers of sheet steel ranging from 22 gauge (0.028 in.) to 16 gauge (.057 in.). Three distinct time series were tested for each unique weld size, thickness of sheet steel and layer configuration. The first of these series were the full-time welds. The two remaining series, 2/3-time and 1/3-time welds, had arc times equal to 2/3 and 1/3 of the average full-time weld arc time, respectively.
Both weld shear strength tests and weld sectioning were performed for each series of weld. Strength tests were performed on a minimum of three specimens from every weld series. If the strength of any specimen deviated by over ten percent from the mean strength, an additional specimen was tested, helping to better understand the true behavior of the weld. Comparisons were made between the strengths of full-time, 2/3-time and 1/3-time welds. Comparisons were also made between the observed strength of each weld and the strengths calculated using the 2001 AISI Specification.
Each sectioning test involved measuring and documenting the visual diameter, average diameter and effective diameter of the weld. Weld penetrations were also documented as sufficient or insufficient and any porosity was noted. A single sectioning test was performed for each full-time series, while three were performed for every 2/3-time and 1/3-time series.
The data taken from the strength tests and the sectioning samples proved that welds formed using reduced arc times were considerably smaller and weaker than full-time welds. The tests also proved that proper penetration is not dependent on the arc time, but is instead a function of the welding current and sheet steel thickness.Master of Science

Com o propósito de investigar a relação entre Comunicação Alternativa e Suplementar (CAS) e a Educação Especial, esta dissertação direcionou-se a conhecer os sentidos atribuídos à CAS por educadores especiais que atuam na Sala de Integração e Recursos (SIR) da Rede Municipal de Ensino de Porto Alegre/RS (RME). Para isso, os objetivos delineados voltaram-se para a análise dos sentidos produzidos acerca da CAS, investigar como CAS está sendo construída, enquanto área de conhecimento, pelos educadores especiais e identificar as necessidades de formação permanente relativas à implementação da CAS no trabalho articulado entre a SIR e a sala de aula comum. A perspectiva teórica que perpassa o trabalho localiza-se na teoria sócio-histórica. O conceito de sentido adotado é entendido, a partir dessa teoria, como contextual, reconstruído por cada sujeito a partir de suas práticas sociais e resultantes dos significados. Estes delimitam as palavras, o que viabiliza a linguagem humana. A metodologia desenvolvida, para os objetivos delineados, foi a de Grupo Focal combinada com observações realizadas pela pesquisadora nas SIRs, onde atuam os educadores especiais envolvidos na pesquisa. Participaram 08 (oito) educadoras especiais, todas atuando em SIR e que atendiam pelo menos um aluno/a com ausência ou dificuldade na expressão da linguagem oral. A dissertação discute e analisa este contexto da SIR, como o espaço do atendimento educacional especializado da RME. As análises sinalizaram que os sentidos para o profissional da Educação Especial, que atua na SIR acerca da CAS, focalizaram-se na relevância dos aspectos orgânicos do aluno decorrentes da deficiência para justificar a não utilização da CAS. Tal sentido evidencia a CAS como um recurso que favorecerá a comunicação somente daqueles alunos onde o quadro orgânico não for tão limitador. No entanto, constatou-se que as educadoras especiais estão promovendo meios alternativos de comunicação, seja com fotos, objetos concretos ou com recursos de informática. No âmbito da prática, elas percebem a necessidade da presença da Tecnologia Assistiva (TA), porém tal constatação suscita insegurança, pois ainda não é uma área de conhecimento próxima da sua formação docente e das suas práticas pedagógicas. A inserção da CAS, nos espaços da SIR e, consequentemente, para além dela, mostrou-se como perspectiva e não como ação planejada e sistemática. Assim, uma análise crítica, não somente sobre a chegada dos recursos de TA nas salas de recurso, com ênfase para a CAS, e suas repercussões para o educador especial – que assume inicialmente a função de operacionalizar tais recursos - é indispensável para a CAS ser utilizada não só na SIR, mas pelas Escolas.Intending to investigate the relation between Alternative Communication and Augmentative (CAS) and the Special Education, this research is directed to investigate the senses attributed to the CAS for special educators who act in the Room of Integration and Resources (SIR) of the Municipal Network of Education of Porto Alegre /RS (RME). In this way, the objectives who have been announced had been turned toward the analysis of the senses produced concerning the CAS; to investigate as CAS are being constructed, while knowledge area, for the special educators, and to identify the relative necessities of permanent formation to the implementation of the CAS in the work articulated between the SIR and the common classroom. The theoretical perspective used in this investigation is situated in the partner historical theory. The concept of sense adopted direction is understood, from this theory, as a contextual, reconstructed by each subject to leaving of its practical social and resultant of the meanings. These helps to delimit the words what makes possible the language human. The methodology developed for the objectives outlined is the Focus Group which were combined with observations made by the researcher in which they operate SIRs special educators involved in research. Eight (08) special educators had participated. All of them acting in SIR and tooking care of at least one student with absence or difficulty in the expression of the verbal language. The research argues and analyzes this context of the SIR, as the space of the specialized educational attendance of the RME. The analyses had signaled that the senses for the professional of the Special Education that acts in the SIR concerning the CAS, had been focused in the relevance decurrent the organic aspects of the deficiency pupil to justify not using the CAS. Such senses, evidences the CAS as a resource that will only be favorable the communication of those pupils where the organic picture is not so limited. However, there are evidences that the special educators are promoting half alternative of communication, either with photos, concrete objects or with computer resources. In the practical scope they perceive the necessity of the Assistive Technology (TA), however such result excites unreliability, therefore not yet it is an area of their knowledge next to its pedagogical practical teaching formation. The insertion of the CAS, in the spaces of the SIR and, consequently, stops beyond it, were revealed as a perspective and not as a planned and systematic action. Thus, the critical analysis not only on arrival of resources TA, with emphasis for CAS, in rooms of resources, however that repercussions acquire for the special educator who assumes, initially, the function of employed such resources, are indispensable it CAS to be used not alone in the SIR but by the Schools.
Con el objetivo de investigar la relación entre Comunicación Aumentativa y Alternativa(CAS) y Educación Especial, esta disertación está dirigida a conocer los sentidos asignado a la CAS para los educadores especiales que trabajan en la Sala e Integración y Recursos (SIR) de la Red Municipal de Educación de Porto Alegre/RS (RME). Para eso, los objetivos descritos se direcionaran hacia el análisis de los sentidos producidos sobre CAS, investigar como a CAS está construyendose, como un campo de conocimiento, por los educadores especiales y identificar necesidades de capacitación para la aplicación de la CAS en un trabajo conjunto entre SIR y el salón de clases comun. La perspectiva teórica el trabajo se basa, se encuentra en la teoria sócio-histórica. El concepto de sentido es adoptado de esta teoría como contextuales, reconstruído por cada persona en sus prácticas sociales y resultantes de los significados. Estos delimitan las palabras que hacen el lenguaje humano posible. La metodología desarrollada para los objetivos planteados, fue la de Grupo Focal en combinación con observaciones hechas por la investigadora en la SIR donde trabajan los educadores especiales. Participaran 08 educadoras especiales, todas trabajando en la SIR y que atendian al menos un alumno/a con ausência o dificultad en la expresión del lenguaje oral. En la disertación se discute y analiza el contexto de la SIR como el espacio del atendimiento educacional especializado de la RME. Los análisis indicaron que los sentidos para el profesional de la Educación Especial que atua en la SIR sobre la CAS, se centro en la pertinência de los aspectos orgânicos que surjan de la discapacidad para justificar el no uso de la CAS. Este sentido, muestra la CAS como un recurso que permitirá comunicarse sólo aquellos estudiantes que las características orgânicas no es tan limitante. Sin embargo, se encontro que las educadoras especiales promueven médios alternativos de comunicación, ya sea con fotos, objetos concretos o recursos de computación. En el contexto de la práctica, se dan cuenta de la necesidad de la presencia de Tecnología Assistiva (TA), pero tal resultado produce incertidumbre, porque no es, todavia, un área de conocimiento cerca de la formación docente y de las prácticas pedagógicas. La introducción de la CAS en los espacios de la SIR y más allá por lo tanto, ha demostrado ser una perspectiva y no una acción sistemática y planificada. Por lo tanto, un análisis crítico no sólo de la llegada de los recursos de TA, con énfasis en CAS, en las SIR, pero ¿qué repercusiones tienen para el educador especial que, en un principio, asume la tarea de poner en funcionamiento estos recursos? Son cuestiones indispensables para CAS ser utilizada no sólo en la SIR, sino por las Escuelas.

Resumo: Esta dissertação tem por objetivo investigar os documentos oficiais produzidos pela Delegacia de Defesa da Mulher (DDM) de Campinas, em casos de estupro e atentado violento ao pudor ocorridos nos anos de 2004 e 2005. Por meio de uma etnografia desses documentos, busquei entender as formas narrativas e burocráticas pelas quais esses atos são transformados em crimes e busquei também a compreensão de como a sexualidade passa a ser campo de intervenção da polícia civil especializada de Campinas. Objetivando delinear as formas pelas quais os inquéritos policiais são produzidos, essa pesquisa tem como cerne os procedimentos de escrita utilizados por essas profissionais, sejam esses ofícios, requisições, relatórios, laudos, termos de declaração e Boletins de Ocorrências. Essas formas de narrar evidenciam não só as convenções narrativas que servem de anteparo para a escrita, mas também os mecanismos pelos quais o trabalho policial é executado. Assim, seja por meio de uma escrita técnica próxima aos expedientes detetivescos, seja por meio de uma forma de escrever sensível e empática ao sofrimento das crianças ou ainda por aquela forma que coloca em suspensão o que é dito em casos de crimes envoltos em conflitos infrafamiliares, é a arte de escrever o ofício policial que ganhará destaque nessa dissertação. Entretanto, também insígnias, carimbos e assinaturas que percorrem os inquéritos policiais são fundamentais nesta pesquisa, pois colocam em evidência as tramas institucionais nas quais a polícia especializada de Campinas está imersa. Sem dúvida, é mediante papéis e por intermédio deles que a polícia se comunica com instituições tais como Fórum Criminal, Instituto Médico Legal e Instituto de Criminalística da cidade. Nas páginas desta dissertação enredaremos nas histórias de mulheres como Marcelas, Joanas, Madalenas e Martas, bem como com os abusos de menores como Anas, Carolinas, Julianas e Lucas. É por meio delas que homens como João, Ricardo, Valmir, Antônio, José, Gilberto e Aldair entram nos meandros burocráticos da polícia civil como autores, averiguados ou indiciados
Abstract: This dissertation aims to investigate the official documents produced by the Women's Police Stations (DDM) in Campinas in cases of rape and indecent assault occurred in 2004 and 2005. Through an ethnography of those documents I sought to understand the narrative and bureaucratic form by the way these acts are transformed into crimes and also to understand how sexuality becomes a specialized Civilian Police interventional field in Campinas. Aiming to outline the ways in which police investigations are produced, the heart of this research is in the written procedures used by professionals. These are letters, requests, reports, findings, terms of statements and Occurrences Reports. These forms of narrative show up the narrative conventions that serve as foundation for the writing and also the mechanisms by which police work is performed. Therefore, either through a technical writing next to detective tasks either by a sensitive and empathetic way of writing about children's suffering or by the one who puts in suspension what is said in cases of crimes wrapped in infrafamiliares conflicts, the art of writing the police's office that will gain prominence in this dissertation. However, there are badges, stamps and signatures that cross the police investigations and are also essential in this research because they put in evidence the plots in which the institutional specialized police Campinas is immersed. Undoubtedly it's by papers and through them that the police communicate with institutions such as Criminal Forum of Campinas, Institute of Forensic Medicine and Institute of Criminology of the city.But it is also through these same roles that the DDM communicates rapes and violent assaults to the judiciary. In the pages of this dissertation we are enmeshed in the stories of women like Marcelas, Joanas, Madalenas e Martas, as well as the abuse's stories of minors as Anas, Carolinas, Julianas and Lucas. It is through them that men like João, Ricardo, Valmir, Antonio, José, Gilberto and Aldair enter into the bureaucratic intricacies of the Civilian Police as investigated or indicted authors

Marketing and society studies aiming to better comprehend consumer debt are of quite relevance as they effectively contribute to public policy making within regulatory agencies of credit, and also to consumer protection agencies that focus on financial consumer protection. In order to encourage research in this field, the objective of this study consisted on analyzing debt constraint factors. Accordingly, a theoretical framework was presented and a structural model of debt propensity, along with its antecedents found in the literature, specially the international one, was elaborated. Attitude towards money, attitude towards credit card, self control, compulsive buying, impulsive buying and debt propensity were the constructs analyzed in this research. As being a quantitative study, descriptive statistical analysis, psychometric analysis and multivariate analysis of structural equation modeling (SEM) were performed. The study s sample was constituted by 301 respondents, questionnaires were administered online using googledocs and its disclosure was made through e-mailing and social networks. Results show that there is a direct relation between self control and impulsive buying, and that power-prestige pursuit influence compulsive buying. The hypothesis concerning the direct influence of credit card attitude and consumer debt propensity was accepted. A need for marketing actions aiming to comprehend and help consumers to better understand credit card usage and rules was identified.
Estudos de marketing e sociedade com a finalidade de compreender melhor a questão do endividamento do consumidor mostram-se bastante relevante, na medida em que contribuem efetivamente no planejamento de ações por meio das agências reguladoras de crédito, bem como dos órgãos relativos à defesa do consumidor que visem à conservação financeira do consumidor. Com o intuito de fomentar pesquisas deste gênero, o objetivo deste trabalho consistiu analisar os fatores condicionantes do endividamento. Para tanto, foi apresentado um referencial teórico e elaborado um modelo estrutural de propensão ao endividamento do consumidor mediante alguns antecedentes dispostos na literatura, em especial, internacional. Os construtos que fizeram parte desta pesquisa foram: atitude frente ao dinheiro, atitude com cartão de crédito, autocontrole, compra compulsiva, compra impulsiva e a propensão ao endividamento. Por se tratar de uma pesquisa de cunho quantitativo, procedeu-se a análise estatística descritiva, análise psicométrica e a análise multivariada de modelagem de equações estruturais (SEM). A amostra da pesquisa foi de 301 respondentes, com aplicação na internet por meio da plataforma googledocs e divulgação através de e-mails e redes sociais. Os resultados apontaram uma relação direta entre o autocontrole e a compra por impulso, bem como igualmente a busca por poder e prestígio influência à compra compulsiva. Verificou-se a aceitação da hipótese que trata da influência direta da atitude com cartão de crédito na propensão ao endividamento do consumidor. Indica-se a necessidade das ações de marketing voltadas a compreender e auxiliar os consumidores quanto ao uso e regulamentos do cartão de crédito.

Esta dissertação problematiza a internação psiquiátrica de jovens, tomando-a não a partir de uma perspectiva psicopatológica individual, mas de uma dimensão subjetivo-social contemporânea, representada pelos percursos desses jovens pelas chamadas redes sociais. A presente pesquisa tem como campo empírico o Centro Integrado de Atenção Psicossocial para crianças e adolescentes (CIAPS) do Hospital Psiquiátrico São Pedro (HPSP), na cidade de Porto Alegre/Brasil. Também fazem parte do campo investigativo o Fórum Técnico Macrometropolitano de Saúde Mental (FTMSM), o Serviço de Admissão e Triagem (SAT) do HPSP e o II Seminário Internacional de Justiça Terapêutica. O objetivo do estudo é investigar como se produz a internação psiquiátrica, tendo como foco de visibilidade desta produção o percurso dos jovens pelas chamadas redes sociais. Para tanto, como metodologia, foram realizadas oficinas com os jovens que estavam em atendimento sob regime de internação no CIAPS/HPSP. Contudo, para que a discussão não se restringisse à perspectiva dos jovens, ampliou-se o campo empírico para as instituições referidas com o intuito de problematizar-se as acepções de rede para os serviços em saúde mental envolvidos nos percursos juvenis. Percebeu-se uma recorrência no modo de funcionamento da “rede”, acarretando na produção de um certo perfil dos jovens que internam, como pobreza sócio-econômica e uso de drogas. Outro aspecto importante diz respeito ao papel da ordem judicial nos encaminhamentos à internação, que por vezes obedece tanto a uma lógica de punição aos jovens e dos serviços, como também de estratégia de acesso aos serviços de saúde.

El presente trabajo tiene como objetivo principal desarrollar los procesos, tanto desde la
dirección como la dirección de fotografía, por los que se pasó para poder realizar el
documental Lo que no pude contar. Este es un proyecto audiovisual que se viene trabajando
desde inicios del 2019 y cuya finalidad es explorar el tema de las violaciones en pareja, las
cuales son comunes en nuestra sociedad, pero no son discutidas de manera pública. Esto se
debe, principalmente, debido al concepto que se tiene de lo que es una violación, por lo que
muchas mujeres tienen problema en denominar su experiencia vivida como tal.
Para poder llevar a cabo este documental se inició con una investigación sobre los conceptos
y teorías que abordan el tema de la violación sexual en pareja desde diversas perspectivas
(psicológica, sexual, legal, etc). Posteriormente se realizó la convocatoria para conocer a las
participantes con las cuales trabajaríamos y finalmente se inició el proceso del documental en
sí mismo, el cual cuenta con tres etapas: el diálogo, la búsqueda y la puesta en escena. La
finalidad de este documental es poder crear un ambiente que les permita dar un primer paso
para poder hablar del tema de manera libre y sin ser juzgadas. Y a partir de esto visibilizar el
efecto que tiene en la vida de las mujeres la violación sexual en pareja y la importancia de ser
discutidas de manera más abierta.The aim of the following essay is to explain the processes used by the director and the cinematographer to make Lo que no pude contar. This documentary started at the beginning of 2019 as a project whose main purpose was to explore a type of sexual violence that is very common in our society but at the same time very hidden and not socially discussed, that is rape within a couple. It was necessary to bring light to this subject and deconstruct the concept that many people have of what a rape is so that women living this type of violence within a couple would finally recognize what it was and call it by its name: a rape. The first step in the process towards making this documentary was a thorough investigation about the different concepts and theories surrounding the theme of sexual violence within a couple. Different perspectives such as psychological, legal and sexual were taken into account. The next step was to release an announcement calling for all the girls who wanted to participate in this documentary, our team met with each one of the girls who responded and after explaining to them what the documentary was about, three girls chose to participate in it. After this, shootings started. The process of filming this documentary was divided into three parts: the dialogue, the search and the staging. Throughout the whole process the main aim was to create an environment that allowed each girl to give a first step towards being able to talk about their violent sexual experiences with freedom and without feeling judged. From this we hope to bring attention to the effect that rape within a couple has on a woman’s life and how important it is to discuss this openly.

Den här språksociologiska undersökningen tar reda på hur individer anpassar sitt språkliga uttryck i samband med toalettbesök i privat, offentligt och högtidligt sammanhang, samt deras grad av medvetenhet och normanpassning i känsliga sammanhang. Detta har gjorts genom en enkätstudie där totalt 362 respondenter svarat på både öppna och slutna frågor, vilket har gett både kvantitativa och kvalitativa data. Det empiriska materialet har efter bearbetning jämförts med tidigare forskning och teoretiska perspektiv, vilket utmynnat i resultaten att de allra flesta ackommoderar efter sammanhang och är medvetna om hur de ackommoderar i formella sammanhang. Ytterligare en tendens resultatet visar är att det postmoderna samhället påverkat samhällsutvecklingen mot en mer öppen kommunikationsstil där relationer skapas och samarbete eftersträvas.This sociolinguistic research examines how individuals adapt their linguistic expression in relation to toilet visits in private, public and formal contexts, as well as their degree of awareness and accommodation in sensitive contexts. A total of 362 respondents, have answered a questionnaire with both open and closed questions, which has given both quantitative and qualitative data. After processing, the empirical material has been compared with former research and theoretical perspectives, concluding that a majority of the respondents accommodate according to context and are aware of how they accommodate in formal contexts. The result also tends to that the postmodern society has influenced the social progress towards a more open style of communication in which relationships are created and cooperation is sought.

Vid exponering av latexhandskar kan latexallergi utvecklas, vilket kan orsaka livshotande reaktioner. Syftet med denna litteraturstudie är att belysa riskfaktorerna för utveckling av latexallergi samt hur denna kan förebyggas och hindras i sin utveckling. Metoden är en litteraturstudie, baserad på elva kvantitativa vetenskapliga artiklar. Resultatet har kategoriserats efter riskfaktorer och preventiva åtgärder. Kategorierna som framkom var: att vara atopiskt lagd, korsreaktioner med frukt och grönsaker, pudret i latexhandskarna, screening och övergång till puderfria latexhandskar. Resultatet kan ge kunskap och information om vad som påverkar utvecklingen av latexallergi. Denna kunskap och information kan skapa gynnsammare förutsättningar för att det preventiva arbetet ska ge resultat.At exposure of latexgloves latexallergy can develop, which can cause life threatening reactions. The aim of this literature review is to elucidate some of the risk factors for development of latexallergy and to elucidate methods to prevent and stop this development. The method is a literature review based on eleven quantitative scientific articles. The result have been categorized after risk factors and methods of prevention. The categories that appeared were: to have an atopic history, cross-reactions to fruit and vegetables, the powder in latex gloves, screening and conversion to powder-free latex gloves. The result can provide knowledge and information about what effects the development of latexallergy. This knowledge and information can create better conditions for the prevention work to achieve results.

Com base nessas narrativas, procuro oferecer uma compreensÃo de como essas mulheres, pertencentes a diferentes realidades sociais, econÃmicas e culturais, vivenciam seus corpos, os sentimentos daà deflagrados e, principalmente, o que essas experiÃncias revelam sobre o contexto social em que estamos inseridos. As narrativas biogrÃficas foram construÃdas, nos termos de Kofes, como fonte de inspiraÃÃo do meio social, como uma evocaÃÃo do sujeito e uma reflexÃo da relaÃÃo entre biografado e pesquisador. This study has a focus in the interpretation of narratives of women of Fortaleza (capital of the Cearà State) that practice gymnastics and their experiences with physical appearance in the quotidian, work, home and in the various social interactions. Starting by these narratives, I want to offer a possible comprehension about how those women, which belong to different social, economical and cultural realities, live with their own bodies, the feelings that break out, and mainly, in how these life experiences reveal aspects of the social context that we are in. Many are the stimulus and demands of mainstream society for women achieve certain esthetical pattern: the processes of socialization, the established âbeauty marketâ and the mass media. This research shows, therefore, how those women build, since the early ages, relationships with their bodies under this current ideals of beauty.

This thesis begins with the hypothesis that the role of ideas in urban and global development is understudied and understated in comparison to studies that privilege economic and political analyses. The thesis generates two related models that seek to provide a comprehensive means of analyzing both the political economic constraints of development as well as the ideational limits that are overlooked by conventional models.
The political economic model adapts constructivist principles to explain the structural limits on urban development that emerge from the contemporary global political economy. The second model draws on previous work done in the field of policy diffusion to posit four relational ways in which ideas are adapted and localized. The thesis argues that political economy analyses provide a comprehensive but mostly macro-level analysis and often fail to adequately understand individual thinking outside of the rational actor model. The ideational adaptation model corrects for this, providing a detailed micro-level analysis that is founded on the political economic framework. Together, the two models provide a comprehensive understanding of the ideational limits and political economic constraints at work in any given development scenario.
In order to demonstrate the utility of the combined models (termed combined conceptual approach), the thesis applies the models to four different applications. Three examples are historical secondary source examples (educational philosophy, international business councils, and water sanitation) related to the history of Shanghai and China, and the impact of foreigners on their development vision, strategies, and practice. One application is a case study of Shanghai’s Expo 2010, which uses original data established through high-level interviews with Expo participants.
The use of the combined conceptual approach shows how the interpersonal and inter-institutional adaptation and localization of ideas affect the way we understand the concept of legitimate best practice in urban development. The combined conceptual approach highlights the role that human thought, emotions, and psychology play in urban development. It links political economic activity to constructed bonds of trust, learning, the mentality of competition, and soft forms of coercive power (hegemonic ideas, leadership, and conditionality). Finally, the most important contribution of the combined conceptual approach is that it allows for an analysis of both the macro- and micro-levels of development in a relational and holistic fashion.

Im interested in the topic of praying machine, because I want to analyze aspects of photography and its functions. It's known, that the reality is manipulated by photography. Bud we can also say, that the relationship between reality and photography is neutral in fact, that the manipulation is made by our interpretation of photography. The change of the reality can be realized just in the dialog between photography and reality. Can it be, that the mechanization change into the will? Does it prays praying mill or the buddhistic monk, who rotates the mill? When he believes into it, is it enough? Or is it enough if believes who watch the monk with his mill? ... The computers from he place A are "praying" the prayers from the place B. With Tomáš Javůrek we collaborated with Vladimír Veselý and Radek Lát to create the Game for re-articulation our reality on the base of the revision of our faith.

Theoretical Rewriting: Globalization and Post-Colonial Development of “ Shanghai-Pudong” This study targets “Shanghai-Pudong” plan and aims to explore the position, meaning and significance. Through this writing strategy, the study also places “Shanghai-Pudong” Plan in three sub-regions of “political and economic analysis of city development”, “colonial and post-colonial city study” and “cultural research of urbanity and landscape of city” for further analysis. Moreover, based on three core theoretical conceptions of “post-colonial nationalism”, “post-colonial modernness” and “mixed modernness”, the result of this trans-regional writing plan will construct a theoretical vision of Shanghai City studies ranging from political economics to cultural research. The study cites the conception introduced by Castells on China evolving from revolutionary country to developmental country and places Chinese “nationalism” pointed out by him in the skeleton of revival of Orientalism caused by the participation of Asian society in the process of socialism and observe it. With analysis of the strategy of resistance of “Oriental people’s Orientalism” which has a long history and is unique in China or socialist China, we re-explain the development, dilemma and transformation of strategy used by Chinese against colonialism for more than one hundred years. It also points out that Chinese “reform and open” policy is in fact that the country opens an space of so-called “vague” relations by Homi Bhabha with the construction and annotation of “Westernism”, and thus discriminates Chinese “developmental country” from the model used by East Asia countries and re-establishes Chinese “post-colonial nationalism”, which usually suppresses dissidence in home and contends for hegemony overseas, constructed by Chinese unique “post-Orientalism” / confrontation discourse of post-colonialism. The research furthers to re-exam and annotate the changes of Chinese “reform and open” policy from 1980s to 1990s with the Chinese implementation of “hybridization/miscegenation” and conception of post-colonial development: from the Greater China plan/discourse and global areas in 1980s to “Shanghai-Pudong” plan/discourse and structure of “China/Orient” in 1990s, concluding with the strategic meaning of post-colonial development implicated in Chinese reform and open policy. From the view of Chinese strategic globalization as a post-colonial country, “Shanghai-Pudong” plan can be re-understood as an agenda of space plan. That is, from “Shenzen-Guandong” to “Shanghai-Pudong”, all projects were re-directed to globalism. The research also observes, compares and positions the role, location and function of “Shanghai-Pudong” plan and presents a totally different theoretical model from the first global city researcher’s model for globalization and global cities by re-defining and re-annotating Shanghai city which is on the way “toward globalization” and “having been globalized” under strategic globalism of a post-colonial country. The research also observes, from angles of histories of Shanghai city and Chinese modernness, the enlightenment and changes brought by “Shanghai-Pudong” plan to the development of this subject by “Chinese modernness”. Furthermore, it presents conception of “post-colonial modernness” to show how Chinese central and local governments skillfully take advantage of various plans and technology of construction to construct “Shanghai-Pudong”, but it in turn implements post-colonial strategy and transform the historical experiences of colonial modernness into the technology of space in the cultural form of post-colonial modernness. Finally, the thesis places “Shanghai-Pudong” plan under the angle of colonial and post-colonial city studies to analyze step by step the complicated and different symbols and significance of space in the cultural form of current “Shanghai-Pudong” City. It also presents the conception of “mixed modernness” for predicting that the effect and significance the 2010 World Fairs in Shanghai will be, among others, the revival of “Shanghai Culture”.

The speech given by Deng Xiao Ping in 1992 during his inspection to Southern China confirmed the open policy adopted by Pudong District in 1990. Thereafter, Pudong adopted the world-class planning and blueprint as the basis for fundamental planning, basic construction, and advanced development in a hasty, quick, and bold manner. It then became the forerunner in Chinese economic development in the world economy, finance, and trade. Following the principle of ‘three piers, three networks, and three capacities’ and ‘fiften plans’, Pudong has attracted multinational companies and investment banks with high-tech development and reform in third industry core which includes service, finance, and trade industries. The government adopted models of ‘one-window’, ‘small government’, ‘electronic government affairs’ and offers tax allowances to meet the economic globalization and implement investment reform. With vigorously support from the PRC central government, Shanghai City government, and Pudong District government on the open policy and development of Pudong, and prior experience drawn from Shenzhen and Zhuhai Special Districts, the development of Pudong is fierce and overwhelming. The industrial development of Pudong was focused on the regional economic development in Long River delta and re-urbanization of Shanghai metropolis to unfold its potentials in global and urban development. From a positive perspective, its active involvement in the development of world cities, information-based cities, network community, knowledge-based economy, and urban and regional economic development, along with incorporation of global economic, financial and trade regulations, and new economic system, could soon resume the prosperity and status of Shanghai as a world-class city and experience the influence of ‘overseas culture’ on China. From a negative perspective, the rapid development of Pudong would result in information gap, digital segmentation, knowledge differentiation. The solutions are still waiting. Whether the innovation, competency, brands, and logistics would support the construction? What are the elite strength and morality of the public? Whether the cross-culture disposition is globalize? Whether the industries could be a part of the international and regional division of labor? Those are some problems that it may encounter. In this respect, this research paper focuses on the following: 一、The research structure is as follows: Chapter 1 Introduction. It proposed research motive, objective, scope, limitation, methodology, structure, process, literature review, theory discussion, and term definitions. Chapter 2 The lay out of industries in Shanghai Pudong and the urban development. It discussed the history of Pudong, regional advantages, background, development factors, investment policies, industries layout, structure, and government policy. Chapter 3 The development features and model of Pudong in the global background. It probed the land resource usage, demographic changes, cultures, medium recognition, and Long River delta development, and discussed the economic development trend, industrial structure changes, urban environment structure transformation, urban image, and urban spirit. Chapter 4 The relationship between the global industries layout and urban development. It analyzed the industries layout and urban development, and described the urban development policies and World Trade Center development goals based on case study of Changjiang High-Tech Industrial Park and Lujiazui Financial District, as well as building of network society and digital city to seek critical problems and resolution strategies. Chapter 5 Conclusion. It concluded the research findings and objectives based on the previous chapters. 二、The research findings are as follows: 1. There are four models of the development in Pudong under the global development: 1) From a capital model to a knowledge-based model; 2) Transforming from technical learning to technical R&D; 3) From growing to re-development and sustainable development; 4) From an industrial society model to a network community model. 2. The urban development system is a world city and transnational city system. 3. The collaboration and development trend of social economy has moved toward new economy and incorporation of regional international industry division of labor and world city network economic development. 4. Dissertação de Mestrado apresentada ao ISPA - Instituto Universitário, na especialidade de Psicocriminologia.A simulação é um dos comportamentos mais esperados de ocorrer durante uma avaliação psicológica em contexto forense. A perspetiva teórica dos profissionais condiciona o seu enfoque e procedimentos a seguir. Contudo uma visão rígida poderá condicionar uma recolha de maior qualidade sobre o sujeito avaliado. Procurou-se analisar a literatura referente a dois conceitos estritamente associados aos comportamentos de simulação, o impostor, advindo de um substrato teórico de origem psicanalítica, e o malingering, fundamentado pela perspetiva comportamental. Pensa-se que será a coesão de mais saberes que proporcionará uma compreensão de maior qualidade sobre o fenómeno em que o sujeito simulador está circunscrito. Assim, foi feita uma revisão dos pressupostos da avaliação psicológica em âmbito forense, da inimputabilidade no sistema jurídico português e dos conceitos impostor e malingering, onde o objetivo é o de juntar esforços e promover a interacção de profissionais da psicologia forense, ainda que, com quadros teóricos de referência diferentes. As conclusões chegadas sugerem a necessidade de olhar o sujeito não só como um estudo de características de personalidade, mas sim pela compreensão destas características no seu funcionamento psíquico. É ao compreender como funciona o sujeito que poderemos observá-lo de modo detalhado, inserindo caracterialmente os seus traços comportamentais na dinâmica analítica do seu mundo externo e interno.
