In response to the prospect of service contracting and the privatization initiatives in the City of Indianapolis, a unique partnership has evolved between labor and management that encourages both cooperation and competition between city departments and their represented employees with outside private contractors. A conceptual model was utilized to analyze the Indianapolis partnership with respect to five developmental stages of collaboration. Empirical data were collected from a questionnaire given to all employees within the Department of Public Works. These data were assessed using multivariate regression and logit analyses, and combined with insights drawn from interviews with labor and management. The results from the multivariate regression indicated that 88% of the variation in the perceived success of the Indianapolis partnership could be explained by the five stages of the conceptual model. Moreover, the regression results, when coupled with the results of the logit analyses, identified a number of critical antecedents for successful service contracting in the form of labor-management partnerships.

Résumé :

Water supply system management for providing proper services to the community is a challenge for the Government of Indonesia. The Indonesian government through the Public-Private Partnerships (PPPs) scheme involves the role of the private sector for decent, quality, and cost-effective water supply system infrastructure. This study aims to describe problems faced by the Regional water supply system PPP project initiated by business entities (unsolicited) in Indonesia. Also, describes the application of Critical Success Factors as a problem-solving strategy in the implementation of the water supply system PPP project. To express this, This research uses a case study qualitative method involving Government Contracting Agency (GCA) informants from the Ministry of X. Data were collected through semi-structured interviews and documentation studies. It was found that in this case, the water supply PPP project has gone through the stages of PPP agreement signing which still faced problems in land provision, the certainty of raw water sources, inflation, tariff setting, and downstream infrastructure development. GCA seeks to resolve the problem with intensive coordination between related parties, financial and non-financial compensation, alternative sources of raw water, and support from the GCA Budget for downstream development.

This study aims to shed light on the increasing importance of the public-private partnership in the Saudi Arabia Kingdom, and the growing of available opportunities to attract private investments for many sectors such as aviation, water and port management, as well as clarifying challenges and obstacles of this type of contracting, and requirements for the successful partnership between public and private sectors in order to clarify and crystallize requirements and foundations of the real partnership between them in setting economic policies in order to advance the Saudi economy and achieve the desired economic development in the Kingdom’s Vision 2030. The study concluded that the partnership between public and private sectors, if it has the right structure, can be developed successfully, that’s what has been proved by the actual progress made by the Kingdom by opening new sectors and reforming laws and regulations, which led to an increase interest in partnership projects between the public sector and the private one. Thus, it will contribute to an increase number of partnership projects in the coming years with international, regional and local partners.

AbstractFocusing on the problem of pharmaceutical R&D for drugs and vaccines against neglected diseases in developing countries, this article argues that the effectiveness of global health partnerships potentially lies in their capacity to address the problem of dual market failures: on a first level they may tackle the poverty induced lack of effective demand for health products which impedes the creation of market-financed innovative products. On a second level, they may help overcoming hold-up problems and underinvestment induced by the complexity of neglected diseases R&D. Yet, organizing transactions within a partnership is not a panacea against these problems: a crucial determinant of success is properownership structures. They need to respond to (i) the degree to which the respective parties value the partnership outcome, (ii) the relative importance of the investment of the parties, and (iii) the nature of the partnership outcome. The argument developed in the analysis is built on an integrated framework combining insights from incomplete contracting theory and public goods economics. It is supported by a preliminary statistical analysis of 17 GHPs.

Much research has been carried out to discover partnership critical success factors that influence public-private partnership success. Since most public-private partnership projects are long-term in nature and include contractual arrangements, there is still a lot to learn about contract governance’s role in public-private partnership performance. Therefore, this study examines the effect of contract governance on the relationship between partnership critical success factors and partnership performance in Malaysia. Stakeholder Theory serves as the underpinning theory for this study. This study employed a quantitative method based on the positivist paradigm to distribute questionnaires. The information was collected from 261 contracting parties’ officials in Malaysian public-private partnership projects regulated by the Malaysian Public-Private Partnership Unit, and a stratified random sampling method was employed. The structural equation model analysis found that eight out of ten hypotheses were supported. According to this study, it has been established that contract governance has a direct favorable influence on partnership performance. However, it is also found that contract governance does not moderate the relationship between partnership critical success factors and partnership performance. Due to time constraints and the emergence of the COVID-19 pandemic, this study was from a cross-sectional viewpoint and adopted a quantitative methodology. The findings of this study are important in the contract governance and partnership performance literature, providing policymakers and concessionaires with new information on the impact of contract governance on public-private partnership project performance. Managers of public-private partnership projects should also be able to enhance their projects’ performance by understanding how contract governance influences the performance of their projects.

Public-Private Partnership (PPP) is a commonly used arrangement to develop public infrastructures. Traditional PPP focuses primarily on the public sector as contracting agency and private sector as project company. This research explores a major gap observed in such setup, namely the lack of attention on the people sector who is the end-users or groups impacted by these public infrastructures. Based on literature review, qualitative analysis involving executive interviews, and quantitative analysis involving survey of operational staffs, this study recommends a new Public-Private-People Partnership strategic stakeholder institutional framework along with its components of critical success factors for both policy and operational regulating frameworks to enhance PPP practice, both in Thailand and beyond.

Public private partnerships (PPPs) are a well-known instrument used worldwide by public administration (PA) to build public infrastructure using private knowhow and financial resources, and sharing risks. In recent years, PPPs have been widely adopted to develop energy efficiency projects between public and private sectors. In this context, a successful project requires a contractual arrangement based on energy performance contracting (EPC) that balances the interests of the two parties. This paper aims to answer two questions: how to share the benefits between the contractual parties and reach an optimal long-term contractual agreement; and which type of contract ensures a consistent risk transfer to the private partner, allowing the PA an “off balance” accounting treatment. The research questions are answered through the development of a mathematical equation able to calculate the optimal percentage of benefits sharing between partners in a long-term contractual agreement. The results are tested with a simulation based on a case study about the energy efficiency project of an Italian hospital. The paper is innovative because it provides suggestions to improve the EPC-PPP contractual structure and realize a balanced agreement between the public and private partners. Moreover, it analyzes the different allocation of risks in EPC contracts to identify the implication for the PA in terms of on-off balance accounting treatment in energy efficiency investment. We show how a successful long-term EPC-PPP can benefit from a mixed contractual structure in which profit-sharing percentage changes during the contract’s life to ensure the same net present value (NPV) to both public and private partners. This paper supports public decision making in order to choose contracts that are able to transfer energy and management risks. Moreover, it helps to understand the balance between public and private interests in a long-term EPC-PPP contract.

AbstractStudies have shown that project risks are responsible for the failure of most Public Private Partnership (PPP) projects. The study examined the critical risk factors associated with PPP housing projects. Data for the research was obtained through a questionnaire. The data were analysed using descriptive statistics and mean ratings. Corruption and bribery among contracting parties (0.681), Exchange rate volatility (0.621) Availability of development funds (0.599) and Change in government (0.580) were the critical risk factors identified. The study also indicated that project cost is highly influenced by lack of development funds and changes in interest rates. The quality of PPP housing projects in Abuja was found to be influenced by partner selection risks. The study suggested a competitive, transparent, and efficient bid process to eliminate corruption, workable strategies for ensuring the availability of development funds at a cheaper rate and adopting mixed strategy in which government continues to provide social housing to the low-income class while providing the enabling environment for the private sector to thrive.

Public–Private Partnership (P3) handback experience is very limited in the U.S. and internationally. This paper analyzes the handback experience in three highway P3 projects: East-Link Bridge in Dublin, Ireland, Highway 4 (VT4 Järvenpää-Lahti) in Finland, and M4 Tollway in New South Wales, Australia. Two of the projects did not have any material handback clauses in their P3 contracts. Still, the handback processes and outcomes of all three projects are considered successful. The projects experienced a relatively smooth handback process, mainly because of very good working relationships between the contracting authority and the P3 concessionaire. There have not been significant technical quality concerns or problems in the years immediately following the handback. Other drivers for successful P3 handback include clear definition of handback requirements, sufficient incentives and protections, clear procedures and joint inspection processes, a collaborative approach, and workforce sustainment. These contractual requirements and financial incentives and protections are very beneficial as working relationships between P3 agencies and concessionaires will not always be excellent, which could lead to less smooth handback processes.

Despite an increasing adoption of cross sector collaborative models, especially contractual Public Private Partnerships (PPPs), as an important public services delivery modality, PPPs continue to experience serious institutional gaps that challenge the course of their implementation. This paper utilizes the new institutionalism theoretical lens and draws on interview and documentary evidence from a concession-type Infrastructure Public Private Partnership Project to foreground the different mechanisms used to remedy contractual gaps that are, inadvertently, necessarily or strategically, left open by contracting partners due to the lack of sophistication in setting efficient and precise institutions at the contracting phase. The study discerns the primacy of three socially constructed institutions complementation mechanisms including (a) contract renegotiations and amendments, (b) the development of new regulatory guidelines and standards, and (c) the establishment of inclusive coordinating structures. Based on the evidence, the paper argues that when confronted by emergent and unique challenges unanticipated in the elaborate contractual provisions, there still remains viable opportunity through an ongoing, concerted, and in a collective manner for responsible actors to complement initial institutions in a way necessary to overcome challenges and stay the main cause of the partnership. Other implications relating to specific sector structures and sector regulation are highlighted along with insights for future work.

The broad and extensive application of public-private partnership (PPP), as well as the divergent documented definitions and experiences, have led to a translucent perspective of PPP and strained academia and industry to reach a consensus on the major practice of this concept. Early contractor involvement (ECI), governance tools, and relational contracting are only a few of the frameworks attributed to PPP. This issue has received limited attention from researchers, despite the focus of review studies on different disciplines of PPP. Hence, this paper puts forward the idea of conducting a comprehensive review to not only shed light on the major practice of PPP but also provide a wider outlook on this concept based on the research carried out since 1979. A narrative review is initially accomplished to identify the major drivers and milestones that have contributed to the evolution of PPP. Employing bibliometric analysis in the following phase assists in conducting a multi-dimensional assessment of studies published within the last five decades. The economic and societal practices of PPP throughout its evolution path signified the dominant application of this concept as a business model. The bibliometric analysis revealed that PPP has contributed to various sectors, i.e., urban development, public infrastructure, transportation, health, and education, just to name a few. In addition, economic and organizational management of PPP was revealed as a major research stream that was accompanied by sustainable development. As a matter of fact, economic and environmental sustainability are the major cross-disciplinary elements that form an interplay between the drivers and attributes of PPP. Value for money (VfM), technology, and innovation, along with smart infrastructure (SI) and smart cities (SCs), are identified as the major directions for the future research agenda associated with PPP.

Learning outcomes The central lesson to be learned from studying the case is to understand the challenges and constraints posed by contextual conditions in designing contracts in public–private partnerships (PPP) for financing and delivering health care in emerging economies such as India. Case overview/synopsis Perverse incentives, along with contextual conditions, led to extensive opportunistic behaviors among involved agencies, limiting the effectiveness of otherwise highly regarded innovative design of the program. Complexity academic level India’s “Rashtriya Swasthya Bima Yojana” or National Health Insurance Program, launched in 2007 provided free health insurance coverage to protect millions of low-income families from getting pushed into poverty due to catastrophic health-care expenditure. This study examines the factors that influence public attitudes toward public–private partnerships (PPPs) through an analysis of public opinion data collected in 2014. Although previous literature has examined public attitudes toward government contracting and asset privatization, there is little understanding of how the public feels about more collaborative forms of public–private interaction. Counter to previous studies that suggest that support for free enterprise and a disdain for government increases support for private involvement in public services, we find that attitudes toward PPPs are nuanced: Respondents favor them not only when they have positive feelings toward the business sector but also when they also report trust in government. PPPs are thus perceived not as a replacement to public administration, but as a delivery model that demands competence and trust of both public and private partners. The results also explain a previously unstudied relationship between respondent familiarity with PPPs and their attitudes toward them. Counter to expectations, we find that the more familiarity that respondents have with PPPs, the more likely they are to view them favorably. We also identify factors that predict public opinions of PPPs which can inform public outreach and public involvement programs involved with PPPs.

What is public, what is private, and what is the relationship between them? Can the public interest be clearly identified and protected? What role should government play in the lives of ordinary citizens? These are questions currently engaging policy makers and the general public as well as scholars in a range of disciplines. The provision and financing of urban public goods is one arena in which such questions have arisen. Historically, governments, private entities, and mixed forms such as public-private partnerships have undertaken these activities in the United States and other countries (Beito et al. 1989; Dyble 2010; Goodrich 1960; Hodge et al. 2010; Jacobson and Tarr 1995). In the late-twentieth- and early-twenty-first-century United States, tax revolts and concerns about “big government” led to increased scrutiny of the appropriate role of government. Contracting out of government activities and privatization both assumed increased importance (Dyble 2012; Light 1999).

The formation of Public-Private Partnerships (PPPs) in Brazil took place after the approval of Law 11.079/04. Since then, this new arrangement of shared public management has been causing discussions about its applicability and effectiveness. The objective of this work is to investigate how this new concept of partnerships contributes to the evolution of Brazilian public management, and to the debureaucratization of public services and the effectiveness of shared management, through a descriptive, documentary and bibliographic qualitative research. In the research, it was found that the adoption of PPPs has become a good alternative for countries like Brazil, as it allows for the orientation of investment and management for various programs and projects, as well as freeing up resources to carry out other interests of society. However, this type of innovative modality still needs a series of adjustments, especially in relation to the form of contracting and the regulation mechanisms.

ABSTRACT The main objective of this research is to identify and discuss theoretically the advances, limitations and perspectives pointed by international research to improve the accountability and evaluation aspects of PPPs. This is a theoretical essay based on the Public Choice Theory to show that the PPP accounting treatment is relevant to avoid lack of transparency and accountability, mitigating possible losses in the decision-making process and the ineffective allocation of public resources. The discussion of topics reveals the importance of public accounting in measuring the financial and social consequences that the shared responsibility of PPPs can have, defending the public interest and democratic relations. It is argued that different factors may influence PPP accounting issues, involving governance limitations, institutional weaknesses, widespread corruption, lack of transparency, weak regulatory environments, power imbalances between partners, lack of political commitment and trust. Finally, some accounting research questions and topics are presented that should be considered to prevent private interest from overriding the public interest in contracting a PPP.

Cross-sector collaboration is a growing topic in the discourse of new public governance. This topic is the importance of public managers collaborating with other actors outside the government, such as the private sector and non-profit organizations, in producing and delivering public goods and services. This journal uses a qualitative approach with a literature review method from books and journals that explains the concepts and approaches of cross-sector collaboration. The results of this study show a continuum of cross-sector collaboration approaches. Public managers can choose the approaches such as Government Provision, Contracting-out, Public Private Partnership (PPP), Network, and Independent Public Services Provider (IPSP). Each approach has its character, from the provision, financing, production process, relationship with society, and trust between actors.

This article discusses the concept of contractual uncertainty and assesses its impact upon the ability of public sector bodies to obtain value for money from their suppliers. Particularly in the realm of public private partnerships, governments around the world are increasingly developing specifications that are likely to be subject to contractual uncertainty. Contractual uncertainty is not necessarily a problem in itself, but can be if the public body cannot avoid an unfavourable power relation in its dealings with the supplier, because it is in a poor position to undertake the inevitable post-contractual negotiations. The argument is illustrated with two cases from the UK public sector that highlight the fact that British public bodies are often seeking to manage contractual uncertainty from a position of weakness.

Governments in sub-Saharan Africa are exploring public-private-engagements for the delivery of health services. While there is existing empirical literature on public-private-engagements in high-income countries, we know much less about their operation in low and middle-income countries. Obstetric services are a priority area where the private sector can make an important contribution in terms of skilled providers. The objective of this study was to describe the experiences of managers and generalist medical officers, of private general practitioner (GP) contracting for caesarean deliveries in five rural district hospitals in the Western Cape, South Africa. A regional hospital was also included to explore perceptions of public-private contracting needs amongst obstetric specialists. Between April 2021 and March 2022, we conducted 26 semi-structured interviews with district managers (n = 4), public sector medical officers (n = 8), an obstetrician in a regional hospital (1), a regional hospital manager (1) and private GPs (n = 12) with public service contracts. Thematic content analysis using an inductive, iterative approach was applied. Interviews with medical officers and managers revealed justifications for entering into these partnerships, including retention of medical practitioners with anaesthetic and surgical skills and economic considerations in staffing small rural hospitals. The arrangements held benefits for the public sector in terms of bringing in required skills and having after hours cover; and for the contracted private GPs who could supplement their income, maintain their surgical and anaesthetic skills and keep up to date with clinical protocols from visiting specialists. The arrangements held benefits for both the public sector and the contracted private GPs and were deemed to be an example of how national health insurance could be operationalised for rural contexts. Perspectives of a specialist and manager from a regional hospital provided insight into the need for different public-private solutions for this level of care in which contracting out of elective obstetric services should be considered. The sustainability of any GP contracting arrangement, such as described in this paper, will require ensuring that medical education programmes include basic surgical and anaesthetic skills training so that GPs opening practice in rural areas have the required skills to provide these services for district hospitals where needed.

This study integrates various views on the Public-Private Partnership (PPP) model in correctional institution based on the experiences of various countries (United States, United Kingdom, Australia, France, Japan, Canada). Referring to the terminology of PPP in a broad sense, the correctional institution PPP models according to this study are: 1) the “private governance” model; 2) the “hybrid management” model; 3) the “service infrastructure” model; and 4) the “contracting out certain limited functions” model. The characteristics of the four correctional institution PPP models are mapped in the task specifications in correctional institution, both in the development and operation stages of correctional institution. In the correctional institution development stage, there are design, construction and financing. In the correctional institution operation stage, there are accommodation services or building maintenance; management and administration; and correction services. Only the “private governance” model regulates the involvement of the private sector in all stages of correctional institution development and operation. Through an analysis of the terminology of “correctional institution” and correction function, this study elaborates on the characteristics of the four correctional institution PPP models by mapping private sector involvement in correctional services (order, amenity and service) which show the specific functional characteristics of correctional institution. The “private governance” model allows private sector involvement in all three aspects of correctional services, while the “service infrastructure” model does not allow the private sector to be involved in all aspects of the correctional services in question. The “hybrid management” model and the “contracting out certain limited functions” model allow private sector involvement in the amenity and service aspects, but not in the order or custody aspects. The provision of local public services has become one of the main concerns of local governments. Therefore, the selection of the most appropriate form of management to maximize efficiency levels in the provision of local public services has been widely analyzed throughout the academic literature. In this context, the aim of this paper is to add new knowledge to the literature on efficiency in the provision of local public services. To this end, we propose the study of four forms of management (interested indirect management; indirect management by concession; intermunicipal co-operation; public service provision) through a free disposal hull data panel (FDHDP) methodology for the 2014–2016 period. We find that public-private partnership contracting is less efficient on waste removal services when accounting for quality. However, the promised benefits of contracting out are realized when contractors are made responsive to service quality through concessions.

Construction projects are subject to various uncertainties that impact on achieving the project objectives. This is most apparent in the case of PPP projects due to the number of contracting parties with conflicting interests. Effective risk management in such projects becomes crucial. This paper presents a conceptual framework for managing risks in PPP projects for housing development in Nigeria. The purpose of the conceptual framework is to use it for further studies. The conceptual framework is based on extensive review of related literature in the area of PPP and risk management. It identifies the essential variables for the study. The paper described some major characteristics of PPPs as well as the processes involved in their risk management. The study concludes that, PPPs are most effective when there are adequate legal and regulatory frameworks for smooth operation of PPPs, and the risks sharing structure is spelt out clearly in the contract with adequate measures for enforcing the provisions should any of the contracting party default.

Finding the right balance between public and private competition enforcement is a critical issue for almost all jurisdictions. This article surveys the forces that are producing an apparent contraction in private rights of actions in the United States, an expansion of such actions in the European Union, and the need for some form of private actions including aggregate claims and indirect purchaser actions for any jurisdiction seeking a system of viable private enforcement. The article concludes that some form of private enforcement is a necessary complement to public competition law enforcement and that public-private enforcement networks geared to local needs should be encouraged to create stable and effective competition law regimes.

The text discusses the context and background for development of public-private partnership in the education sector. This development is based in the concept of New Public Management (New Governance) widespreaded in the policy and practice of governments since 1980 s. The article discuses an example of involvement of non-public actors in providing education: The Private Financial Initiative (PFI). PFI has become the predominant model for building and operating of new schools in the United Kingdom. The British experiences have been employed by other countries as the number and volume of educational investments conducted in the PPP formula is steadily growing. This process has been illustrated by the relevant European Investment Bank data. The text also features the Polish approach to contracting out public education services i.e. when local authorities entrusts the operation of public school to a private entity. This concept corresponds with the idea of community schools where local communities become authentic owners of the school itself and its assets.

The Covid-19 pandemic has significantly impacted the health and economy of the world. The pandemic has also frustrated the execution of public-private partnership (PPP) projects across the world, with economic and legal consequences for contracting parties. The impacts of the pandemic have, and may continue to, result in uncertainties and even project failures. PPPs are underpinned by long term contracts which should ordinarily determine the rights, obligations and remedies arising out of the impact of the pandemic. However, the legal outcomes are never always certain or determinable and might not augur well for any of the parties. This article examines legal and contractual tools for managing uncertainties and risks arising from the pandemic. It suggests that, as much as possible, parties should rely on extra-contractual arrangements to resolve the issues that are likely to arise out of the pandemic. This article discusses the possible legal outcomes of the pandemic on PPP arrangements and suggests creative ways of mitigating its impacts.

The described advantages comprised speed of construction, rational cost policy, etc. The reviewer while agreeing with S. Mamontov on some issues insisted on more profound study of possible changes in traditional model of private and public railways that existed in Russia.

The community services sector is the largest provider of non-profit human services in Australia. This sector has experienced considerable growth as a consequence of public policy and sector reforms introduced by successive governments over the past two decades. These reforms have seen the introduction of private sector managerialist agendas, outsourcing of government services and competitive tendering processes. As the community sector has grown governments have sought to consolidate program funding mechanisms, simplify contracting out arrangements and encourage collaboration and formal partnerships through national tender processes. In recent years there has been significant evidence of governments actively encouraging formal intrasectoral partnerships and consortia in program tenders. While there is a considerable body of overseas and national literature on partnerships and collaboration, the predominant focus is on intersectoral relationships such as public-private partnerships between government and the business sector or government contracted services to the community sector. This research responds to a call for more local research on partnerships and collaboration in the Australian community service sector. A case study approach was used to examine the key drivers of intrasectoral partnership and collaborative practice in the context of the literature within business, government and community sectors. The study found prior interactions between organisations significantly influenced whether these drivers were viewed as strong, weak or ambiguous. The findings contribute to the understanding of intrasectoral partnerships and collaboration in the community sector in that prior relationships understood as parallel (i.e. disengaged) or cooperative in nature, can be predictive of potential partnership relationships and outcomes.

Abstract This paper assesses the city of Belo Horizonte’s experience building school infrastructure through public-private partnerships (PPPs). Between 2009 and 2015, Belo Horizonte built very similar schools using both PPPs and traditional public contracting (TPC). As the choice of mode of contracting was unrelated to our outcomes of interest, the experience constitutes a quasi-experiment that allows for a simple and direct comparison of PPPs to TPC. We examine construction- and operation-phase outcomes measured using administrative data and a survey of school administrators. We find that schools constructed under the PPP contracting model outperformed those built using TPCs in most outcomes.

This Article explores the previously overlooked role of relational contracting in forming and maintaining public-private partnerships. Relational contracting generally describes firms using formal but legally non-binding agreements to collaborate on shared objectives. Why do parties invest in forming elaborate contracts that they do not—and cannot—enforce in court? Contract theory suggests that the very act of contracting is relationship-building; it generates commitment, trust, cooperation, a win-win philosophy, and strengthened communication. Writing down goals and intentions allows parties to clarify expectations while maintaining flexibility for unforeseen conditions. This Article demonstrates that agencies also use relational contracting— creating unenforceable written agreements to build relationships with external actors. To shed light on agencies’ use of relational contracting, this Article provides a novel review of the recovery planning process required by the Endangered Species Act. A surprising finding emerges: private groups are providing crucial resources and logistical support to prevent the extinction of endangered species. Tribes, states, nongovernmental organizations, and sportsmen’s groups are providing necessary resources to further agency action. By orchestrating private action through recovery planning documents, the agency can garner the resources necessary to undertake species translocations, which it could not unilaterally facilitate. Although the plans are not judicially enforceable, they nevertheless play a coordinating and commitment-generating role in facilitating private actors to engage in recovery efforts. This example highlights the broader trend of relational contracting building and formalizing relationships between agency and non-agency actors. Environmental impact statements, forest management plans, and recovery plans for endangered species are all examples of such “relational contracts” governing inter-agency and private-public collaborations. Viewed in this light, seemingly prosaic planning documents are, in fact, a crucial component in facilitating many agency collaborations. Descriptively, this account adds institutional detail to literatures on new governance and public-private partnerships. Normatively, it raises questions about whether the benefits of contracting offsets the potential distributional inequities and mechanisms to shroud government actions created by the practice.

This paper focuses on the risk allocation in PPPprojects and argues that the transaction cost economics (TCE)theory can integrate the economics part, which is currently missing,into the risk management research. A TCE-based approach isproposed as a logical framework for allocating risks between publicand private sectors in PPP projects. A case study of the SouthernCross Station redevelopment project in Australia is presented toillustrate the approach. The allocation of important risks is putunder scrutiny. Lessons learnt are discussed and alternativemanagement approaches drawing on TCE theory are proposed.

Adversarial contracting methods are used for most public infrastructure procurement and timely delivery on budget remains a problem. In the past 20 years, OECD countries have adopted a number of alternative procurement methods that are based on collaborative principles including public private partnerships, long-term outsourcing arrangements and relationship/alliance contracts. We review the theoretical principles that operate for both adversarial and collaborative contracting methods. We identify the characteristics of non-adversarial contracting methods such as the output specification, qualitative selection criteria, the alignment of incentives, discrete allocation of residual control rights, life cycle costing, and risk-weighted value for money measurement that are delivering better procurement outcomes for government.

Public-private partnerships (PPPs) are employed in many countries as an alternative method of public service provision in which partners from the public and private sectors share their resources, responsibilities, and risks. Some well-justified factors that drive the partnership development are value for money and lack of budget funding. As PPP drivers may be unique, thepaper surveys the reasons for PPP expansion in two transitional countries, Kazakhstan and Russia. Based on detailed discussion of the commonly employed reasons for partnering (such as greater value for money, or lower total social cost associated with a PPP as opposed to contracting out a service), internal and external PPP drivers in Kazakhstan and Russia have been categorized and examined. Among internal drivers, the need to attract private initiative and funding for upgrading the utilities and housing infrastructure is most influential because of enormity of the task for which governments lack resources. The countries’ intention to align themselves with the requirements of perceived international best practices is yet additional influential driver of external nature. The paper concludes that public policy in the two countries is the major driving force for PPP development although the value for money concept and transaction cost economics appear to be neglected. The emerging PPP policy paradigm in Kazakhstan and Russia has facilitated PPP development in recent years, since 2005. However, lack of reliable solutions and instruments for PPP formation and implementation significantly slows down PPP expansion.

PurposePublic private partnerships (PPPs) centralize decision making into a hybrid type of firm, consisting of a government entity with a private firm, that is either a profit‐seeking or non‐profit entity, that initiates, constructs, maintains, or provides a service. The PPP model recognizes that both the public and the private sectors have certain comparative advantages in the performance of specific tasks. PPPs, grounded in cost/benefit analysis, have been used in Australia for decades and are presently being introduced in the USA as a form of innovate contracting. This paper aims to evaluate PPPs as a potentially transferable model for the delivery of public services. PPP firms are evaluated in terms of capital asset management, productive and allocative efficiency, transfer of risk between the public and private sectors, rights to the residual, and the public interest. A case study comparison of Fremantle Ports (Australia) and the Indiana Toll Road (USA) is employed to demonstrate PPP design and function.Design/methodology/approachA description and evaluation of public private partnerships (PPP) is presented and two original and primary case studies are reviewed.FindingsA PPP functioning as a monopoly provider of a common pool public asset approximates economic efficiency when user fees cover virtually full cost. Identifying optimal output and quality assessment is more challenging in the case of social goods in which the public goal is subsidy minimization and clients cannot assess quality. Best practices are helpful; they guarantee the PPP process, but not the outcome. All PPPs, in whatever country or industry, are vulnerable to bureaucratic expansion whenever they are given access to subsidized loans underwritten by taxpayers.Originality/valueThe two case studies in this paper are 100 percent original; they were examined in person by the authors, and the managers of the two entities were interviewed in Indiana (USA) and Fremantle, Western Australia.

Résumé :

Sustainable public procurement of construction projects is a key objective to fulfill the targets of the EU Green Deal, the new Regulation approved by the European Parliament, and the conditions required by the Facility of Recovery and Resilience approved by EU. However, most of the adopted procedures are based on traditional procedures, open competition, or restricted procedures, which are not appropriate for developing an innovative approach aiming for more ambitious sustainable objectives. Innovation partnership is a new procedure introduced by the EU Directives of Public Procurement of 2014 ( Article 31º of 2014/24/UE), and it has been discussed and applied to the development of new products but, unfortunately, its potential has not been studied as a tool to prepare and to award more innovative and sustainable contracts of public works. This is the objective of the research presented in this paper, and a set of guidelines is deduced and discussed to support public contracting authorities to make better use of innovation partnerships.
