Texte intégralMetaphorically speaking, the relationship between criminal liability and abuse of law may be described as a flame beneath ashes. In summary, a punishment based on the abuse of law is not consistent with the principle of legality recognized by the Italian Constitution: according to the Article 25, paragraph 2, in fact, no one may be punished except on the basis of a law enacted by the Parliament. Nevertheless, an infringement of the constitutional principle of legality occurred in the Dolce & Gabbana case where a criminal conviction for tax avoidance was pronounced by the Criminal Courts. In the lack of an express provision punishing tax avoidance, only tax evasion may be punished under Italian criminal law. Moreover, the punishment for tax avoidance was not foreseeable according to the principle of legality enshrined in Article 7 of the ECHR due to the fact that prior to the “Dolce & Gabbana” case tax avoidance was not qualified as an offence in the Italian case-law.

Texte intégralThe precautionary principle states that if an action or policy has a suspected risk of causing harm to the public or to the environment, in the absence of scientific consensus that the action or policy is harmful, the burden of proof that it is not harmful falls on those taking the action. This principle allows policy makers to make discretionary decisions in situations where there is the possibility of harm from taking a particular course or making a certain decision when extensive scientific knowledge on the matter is lacking. The principle implies that there is a social responsibility to protect the public from exposure to harm, when scientific investigation has found a plausible risk. In some legal systems, as in the law of the European Union, the application of the precautionary principle has been made a statutory requirement. Transposed in a criminal law context precautionary principle meets him with the characteristics of this branch of law. Criminal law is in fact a retrospective law and the classic type of crime (behaviour and event) clashes with a criminal policy time to avoid harmful events. The first stage of the research will be the analysis of actual characteristics of criminal law with particular regards to the meaning of that principle, according to the law and to the case law. The second proposal of the present project is to investigate whether the criminal intervention is feasible in case of scientific uncertainty, according to the different points of view of the Italian doctrine and I will try to identify a method of intervention, if it is possible.

Texte intégralThe PhD thesis draws its origin from the appearance of the tax abuse of right in criminal procedures and by becoming one of the main actors in one of the most controversial performances of cd. ‘ciminal jurisprudential law’, brought to our attention by the renowned interpretative branch of Dolce&Gabbana. Therefore, once introduced the general concept of tax abuse, it will be separated from the notions of tax evasion and tax savings (legal); these three fundamental concepts and their limits and interactions will be the leitmotiv of the analysis. Moreover, there will be a study on the action of the “living law”: a jurisprudential season characterized, as it may be noticed, by light and shadow, full of application contrasts (diachronic and synchronic) and with a strong unpredictability on the criminal judgement for those behaviors assessed as violations. The analysis of the origin and the development of the punishability of the violation of the law in tax policy will allow a broader consideration on the crisis of the criminal law principles. After tracing back the phenomenon of violation in the broader trend that has struck contemporary criminal science, the study will concentrate on the law data represented by the new Article 10-bis of the l. 212/2000 The novelty represented by the legislative decree 128/2015 represents a fundamental achievement on the topic: not only it (finally) gives a fundamental definition of the concept of violation of law, but also the legislator has expressly stated expressis verbis the criminal irrelevance. However, the interpretation of the article 10-bis and of its interactions with the Criminal Tax Law has its own critical points. Therefore, this study will try to suggest a possible solution.

Texte intégralL’unica definizione di famiglia presente tra le fonti oggi vigenti è rintracciabile all’art. 29 della Costituzione. Il Legislatore ordinario, sia civile che penale, non ha invece mai ritenuto di esplicitare chiaramente il perimetro di tale bene, limitandosi a far riferimento e a disciplinare di volta in volta i singoli rapporti familiari. Abbiamo allora voluto cercare di appurare se esista una nozione di famiglia da applicarsi ogniqualvolta il bene famiglia assuma rilevanza penale ed eventualmente quali ne siano i tratti caratterizzanti. Si è affrontato, in particolare, il problema del riconoscimento e della tutela penale delle coppie di fatto omo- ed etero- sessuali, alla luce delle recenti evoluzioni legislative e della copiosa giurisprudenza formatasi negli ultimi anni. La ricerca si è inoltre allargata ad ulteriori realtà familiari, come le famiglie multietniche e multiculturali, sempre più diffuse per effetto dei massicci flussi migratori. In quest’ambito, nella tesi è affrontato il tema dei cd. reati familiari culturalmente orientati, perché integrati da condotte percepite dai soggetti attivi come lecite e normali secondo le usanze delle loro terre d’origine, ma penalmente sanzionate nel nostro ordinamento perché lesive di beni familiari. Sono poi stati approfonditi i temi legati all’evoluzione scientifica e tecnologica, che ha portato oggi al diffondersi di tecniche riproduttive che inducono a un radicale ripensamento delle stesse modalità di genesi della famiglia ed a un sovvertimento dei tradizionali ruoli familiari, comportando la necessità di una ridefinizione dei concetti di filiazione, maternità e paternità. La ricerca si è così rivolta ai reati previsti dalla Legge n. 40 del 19 febbraio 2004 in materia di procreazione medicalmente assistita, con una particolare attenzione al reato di realizzazione, organizzazione e pubblicizzazione della maternità surrogata, ma anche ai profili di penale responsabilità ipotizzabili in capo a chi ricorre al cd. turismo procreativo per sottoporsi all’estero a tecniche vietate in Italia.

Texte intégralThe work deals with the criminal protection of public health in the food sector. The study is divided into five chapters: after a general theoretical investigation on endangerment crimes (ch. I) and a historical-comparative analysis on the criminal protection of public health (ch. II), the main problems that characterize the current discipline of food crimes (ch. III) and its interrelationship with the supranational legislation (ch. IV) are examined in depth, while finally the prospectives of reform of the sector are examined through the study of a recent draft law (ch. V). More precisely, the research starts from an analysis of the regulatory techniques available to the legislator in the protection of consumer health in the food sector. Then, the study focuses on: the problems of legal certainty and procedural practicability that concern concrete endangerment crimes; the relations between this normative technique and the use of epidemiology; the merits and drawbacks connected to further techniques of anticipated protection. Finally, particular attention is dedicated to the use of the so-called threshold limits, to their role in the structure of the crime as well as to their legal discipline, the relative determination procedure, and the relations with the rule of law and the principle of harmfulness. In the light of this approach, the work proceeds to investigate the historical origin of the current discipline of crimes against public health, in the awareness that the understanding of the problems posed by the current legislation needs to pass through the history within which it was formed. The analysis is first of all dedicated to the main codification models that have influenced the drafting of the Zanardelli code - including the Napoleonic code of 1810, the codes of pre-unification Italy and the code of the German empire of 1871 -, followed by a reconstruction of the related preparatory work, aimed at understanding the dogmatic and political-criminal profiles that characterise crimes against public health in the code of 1889. At this point, the research shifts to current legislation. After examining the problems connected to the differentiated sanctioning treatment of offences against public health and proposing a reconstruction more in line with the primary rank of health within the Italian Constitution, the work addresses the problems of taxability and reasonableness concerning both Articles 439 et seq. of the Criminal Code and the relative relationship with the offences provided for by Law no. 283 of 1962, coming to support the opportunity to overcome the traditional so-called quantitative conception of the public danger, centred on the diffuseness of the threatened damage. Subsequently, the reform of the food sector carried out by the European legislator starting from the EC Reg. n. 178 of 2002 and its connections with the national discipline of food offences are analysed, highlighting the main aporias of the internal sanctioning system. The research concludes by examining the draft law C. 2427 of 6 March 2020 and highlighting, through the formulation of some regulatory proposals, the opportunity to reform the sanctioning discipline of the food sector in order to strike a better balance between the need to protect the health of consumers and the principles of reasonableness and legal certainty.

Texte intégralThis thesis explores the problematic aspects of the relationship between criminal proceedings and journalistic information. It was therefore considered appropriate to divide the research into two sections, one case study, the other purely theoretical. In the theoretical section, attention was focused on the most debated issues: the protection of the judge's cognitive virginity, the protection of procedural secrets, of the freedom of the press, of the confidentiality of those who are even only occasionally approached by a criminal investigation, of the self-determination of the persons participating in the trial and of the serene development of the latter. The ultimate aim was to examine the current balances laid down in the code. Where legislative inadequacy could be observed, an attempt was made to put forward a proposal for reform. It was possible to observe some inconsistencies in Article 114 of the Code of Criminal Procedure. Not only this.The future witness exposed to the influence of public opinion may be shaken or disturbed, to the point of suffering a mnemonic alteration of his memory. Last but not least, a comparative perspective was helpful, from which valuable ideas could be drawn for an ideal solution to the problems reviewed. On this side, the Spanish system was observed, interested in understanding the constitutional balances on which the relationship between freedom of reporting and criminal trial is built and the codified rules on the dissemination of judicial acts to the Iberian public opinion.At the end, it was possible to draw conclusions.

Texte intégralIn this thesis, the author critically explores the opportunity to introduce restorative conferences and victim-offender mediation in our criminal proceeding. In particular, this contribution stars with the analysis of foundation and development of restorative justice practices and how this procedure has influenced the victim conception and the born of the new conciliative paradigm. Subsequently, it examines the victim offender mediation itself as a type of restorative practices and how in our Country this procedures are used and applied: youth and juvenile probation; adult offenders probation and Justice of the Peace. Furthermore this contribution reports some English example of victim-offender mediation to show the importance of this procedures and it analyzes the most important research on that theme that have been done in Europe, England and Italy. At the end of the analysis, the author, after verified the perfect adaptability of this practices with our Constitution; purposes some hypothesis of mediation conferences, inspired from English system, to include them in our criminal proceeding.

Texte intégralThe spread of the criminal justice process is hampered by multiple causes. It is not yet possible, among other things, to exclude paper filing of the crime reports under art 109 Disp. Att..c.p.p. And subsequent acts Legislative aspects, even though it can be telematicly transmissible without, if technically possible, being digitally signed. Moreover, the secrecy of preliminary investigations and the safeguarding needs of the criminal process have been a deterrent to the implementation of a telematic informative systems over the years. Aspects of a technical nature, a criminal justice process uses different telematic information systems unlike the civil process where a unique telematic application is used. Organizational aspects: the peculiar nature of the judicial office consists in the coexistence of two different types of work categories: on one hand, magistrates are characterized by the strong logic of independent action and, on the other hand, the administrative staff, a category within which relations are rigidly regulated. Such a profound difference has hindered the spread of information systems in the judicial offices, and the only realistic solution to solve this problem lies in a conciliatory approach and mediation between the different types of people working in the Italian justice sector, as confirmed by the interviews Carried out in our offices. An approach towards sharing the importance of the dissemination of Information Technology, which, if shared by the hired staff and freelancers, would eliminate the risk of rejection of the information system. Sharing not only the objectives to be pursued, but also the IT, legal and organizational issues that the two types of organizations face when implementing the information system in order to find concrete collective solutions, to specific problems that needs to be resolved.

Texte intégralShould a Defendant be allowed to plead her innocence by saying that, given the circumstances, she had no real choice but to break the law? Does the Judge, while assessing her criminal liability, have to check whether she was able to do what she was required to by a relevant provision? These are, in short, the questions this essay aims to answer to. Their roots go deep into a traditional subject of the general part, such as the theory of excuses and the role of superlegal defences, which has been brought back into light by the most recent case-law. The essay shall begin from an in-depth historical and comparative analysis, trying to describe the reason why interest raised upon this topic and to highlight the most common objections that oppose it. After underlining how insufficient is the categorisazion ordinarily brought forward by the legal doctrine, the author explains why the whole issue has to be reviewed in the light of the constitutional principles ruling culpability and blame, and tries to give some hints for its possibile future empyrical applications. The final part, then, is dedicated to an analysis of the recent case-law, in order to assessing the Courts’ approach to the subject and removing random ambiguities; a particular attention is drawn on cases of the so-called ‘economic necessity’.

Texte intégralThis research proposal aims to analyse the specific paradigm of corporate criminal responsibility with special regard to its consistency with the requirements of criminal negligence. The analysis has shown that the corporate crime foreseen by Legislative Decree No. 231/2001 should be considered as a “special” offense of negligence which essentially acts as a breach of a precautionary duty: namely, a violation of a rule with precautionary objectives that imposes to the corporation the adoption of compliance programs aimed to prevent the occurrence of harmful events. The research aspires – from a de jure condendo viewpoint and by using a comparative approach focused on the English system of corporate criminal liability – to elaborate some reform proposals in order to modulate the culpability criteria on the type of offense that may actually occur and in relation to the judicial determination of adequacy of compliance programs.

Texte intégralLa decisa affermazione di un diritto penale improntato al principio di offensività rappresenta il risultato intangibile di un moderno Stato di diritto. S’intende, con ciò, riferirsi all’odierna concezione del diritto penale quale strumento di tutela contro comportamenti concretamente offensivi di beni giuridici ritenuti meritevoli di protezione e promozione da parte dell’ordinamento, espungendo ogni possibile riferimento alla criminalizzazione di mere violazioni di doveri.. Nel nostro ordinamento, il secolare dibattito sul diritto penale dell’offesa non può prescindere da una prospettiva costituzionale: in particolare, lata parte della dottrina sostiene che la Costituzione repubblicana affermi, sia pur non expressis verbis, il principio di necessaria offensività del reato. L’esigenza di un diritto penale dell’offensività, dove il ricorso alla sanzione penale rappresenta effettivamente un’extrema ratio, volta a punire esclusivamente comportamenti concretamente offensivi di ben determinati beni giuridici, si scontra con la proliferazione di interventi legislativi, in particolare nell’ambito del diritto penale dell’impresa e nel diritto penale delle società, orientati alla repressione di comportamenti privi di un concreto orientamento offensivo, che vedono la sanzione penale chiamata a reprimere semplici inosservanze formali. Le conseguenze sul piano delle scelte di penalizzazione dovrebbero essere evidenti: la sanzione penale non dovrebbe scattare solo in presenza di una compiuta aggressione a una situazione individuale, perché l’intrinseca, naturale pericolosità dell’attività d’impresa troverebbe uno spazio troppo ampio sottratto alla disciplina penale, con quasi certe ripercussioni sulla tutela del bene del singolo. Si profila così la necessità di un’anticipazione della risposta sanzionatoria.

Texte intégralThe exposition to dangerous substances that may produce harmful effects on the environment and human health is a phenomenon that call into question the industrial "risk management". The human origin of environmental and/or health disasters leads to look for possible liability (even criminal) of a single individual. Therefore, the purpose of the research is firstly to analyse these phenomena within the framework of the Italian and French criminal systems. More specifically, the choice of analysing the criminal response to environmental/health disasters in the French legal system lies in the fact that this system presents some structural differences compared to the Italian one which have significant outcomes on the case-law. At the same time, recent cases brought before the European Court of Human Rights (ECHR) impose to reflect on the liability of States, which are equally involved – albeit in a different manner – in the industrial "risk management". In fact, the ECHR imposes on the national authorities to take all the necessary measure (so called positive obligations) to protect the health of individuals from dangerous activities, whose violation can lead to a conviction for the State. Therefore, the further aim of the research is to examine the ways in which States are required to protect the health of their citizens. Adopting this second perspective does not mean, however, abandoning the field of criminal law: the aim, in fact, is that of verifying whether States are required to resort criminal law and how the Court of Strasbourg balances the need to protect the fundamental rights of the accused and the need of ensuring effective protection of the right to health of the victim. The basic intention of this work is therefore to investigate the ways in which the basic criminal law principles, on the one hand, and the need to protect health, on the other, are concretely balanced in the Italian and French systems, within the framework of the European Convention of Human Rights.

Texte intégralThis research is about within the judicial information technology a field that studies the information systems implemented in courts, in order to improve the efficiency of the service and to provide the mean for reducing the long duration of trials, ultimately the goal is to ensure the respect of rights granted to citizens and to increase the competitiveness of the Country. The specific subject of this research project is the use of ICT in the judicial process. It is an field less studied comparing it to the civil trial, but the crisis of efficiency of the process is just as much in this area. Looking at the criminal trial through the eyes of the designer of information systems, means to see an uninterrupted flow of information that includes bits of reality located both upstream and downstream of the process itself: before we find the police report of the crime, after the trial you still have to ensure the execution of the sentence. In this perspective it becomes clear the consequence of proper management of information: the quantity, accuracy, and speed of access to the same factors are vital to the criminal trial so that it becomes clear how the efficiency of information system and the quality of justice ensured the citizens are strongly interrelated. The research project aims to identify under which conditions this efficiency can be achieved effectively and, above all, to understand which technology choices that can preserve or even enhance, the principles and guarantees of the criminal process. In criminal trials, in fact, are involved fundamental rights such as liberty, dignity, privacy, rights that are protected by a wide range of procedural rights such as presumption of innocence, the right of defense, the right to reply, and ultimately by the purpose of rehabilitation of punishment.

Texte intégralThis research thesis investigates all the issues related to the criminal liability that arise when highly automated and/or artificial intelligence systems are used in e-Health. This investigation has been conducted looking at the health system with a socio-technical point of view, paying specific attention to the human-machine interaction, the specific level of automation involved, and finally to concepts of error and risk management. Some topics over the others have been deeply examined, e.g. product liability for defective medical devices; medical liability in case of highly automated systems with defects; criminal liability in presence of artificial intelligence systems, along with the doctrine models developed to cope with these issues. The following models have been analysed: the zoological model, the perpetration through another model, the natural and probable consequences model, and finally the direct liability model. The existence of the criminal requirements, actus reus and mens rea, as mandatory elements to identify the criminal liability, has also been investigated. All the liability profiles have been analysed using real world case and scenarios. Eventually, some solution and remedies have been proposed as a conclusion, using also the theory elements of normative agents.
