The chapter argues that some of the criticism against the use of proprio motu powers is justified, particularly in respect of selectivity, given that other situations outside Africa were not investigated in equal manner. Equally, the evidence by which the Prosecutor initiated proprio motu prosecutions was generally weak and, despite some dissenting voices, it was never turned down by the ICC’s pre-trial chambers. This is particularly interesting if one considers that the situation in Kenya, at least, was politically charged. Although the chapter largely discusses the legal contours of the Prosecutor’s proprio motu powers and their application in the two African situations, it also assesses the impact of these prosecutions on local proceedings and the potential for suffocating the investigated nations’ relations with the ICC. To avoid similar conflicts in the future, the author argues that the politicization of prosecutorial discretion could be assessed by considering comparable situations in which the Prosecutor is not attempting to proceed.

Since prosecution speech events are conducted in the presence of judges and defense attorneys, prosecutors must use more subtle ways of being ambiguously deceptive. In the perjury hearing of union agent Steven Suyat, the prosecutor’s ambiguity converted the speech event of using Suyat as his own witness against other union members into an indictment against Suyat, then used deceptive ambiguity about Suyat’s schema for why he was testifying, conversational strategies for eliciting what appeared to be guilt, and meanings of words that were not shared by Suyat. In the murder trial of Larry Gentry, his prosecutor created ambiguity about Gentry’s concept of the speech event and schema of why he was involved, finally reinterpreting Gentry’s words to make him appear guilty of aiding and abetting. The grand jury hearing of Father Joseph Sica illustrates the prosecutor’s deceptive ambiguity relating to the speech event and schemas, but especially to his reinterpretation of Sica’s words.

The dilemma of holding prosecutors accountable while ensuring their independence was at the centre of the debates surrounding the establishment of the ICC and has been a recurring question ever since. Drastic judicial remedies against prosecutorial misconduct have the potential of harming other interests of international criminal justice, including deterrence, retribution, and the establishment of an accurate historical record. On the other hand, non-judicial mechanisms may compromise the principle of prosecutorial independence and create the risk that politics would influence disciplinary decisions. This chapter examines how the ICC has approached this accountability dilemma in its first years of operation. It advances that the Court should adopt a structured balancing approach in determining remedies for prosecutorial misconduct to include internal bureaucratic controls within the OTP, judicial intervention, and disciplinary measures by the ASP, the IOM, and national or international bar associations.

This chapter focuses on international criminal tribunals. These have emerged as part of a professional field of international criminal law, reshaping how atrocities are handled at the international level. They include the International Criminal Tribunal for Rwanda, the International Criminal Tribunal for the Former Yugoslavia (ICTY), and the International Criminal Court (ICC). In many international courts, authority turns on judicial decisions. Yet in the context of international criminal courts, prosecutorial strategy is often at the core of the building or waning of authority. This is partly because of the power of prosecutors to make headlines and cause political controversy with indictments, and of the highly contentious and atypical political environments in which these courts operate. In building their authority, prosecutors are acutely aware of the constraints on the authority they enjoy and thus seek to speak to the constituencies they need—while avoiding others—through their prosecutorial practices.

Federal prosecutors have immense power and discretion to decide when to bring criminal charges, what plea bargains to offer, and how to implement the federal government’s legal priorities in their districts. While U.S. Attorneys take pains to emphasize their independence, we know relatively little about the extent to which politics colors federal prosecutorial staffing and decision-making. The Politics of Federal Prosecution draws upon a wealth of data from 1990s to the present to examine the interplay of political factors and federal prosecution. First, the authors find that congressional and presidential politics affect who becomes federal prosecutors and how long those individuals serve. Second, the book demonstrates that signals of presidential and congressional preferences, along with local priorities, affect key prosecutorial decisions: whether to bring prosecutions, how to approach plea bargaining negotiations, and when to utilize criminal asset forfeiture to cripple criminal activities. In short, the book demonstrates that politics affects the behavior of U.S. Attorneys at nearly every stage of their service.
