The oceans cover about five-sevenths of the earth’s surface and it is no doubt that they are the most important resource for the population of our modern world. Therefore each of the states has its own interest in this. In some cases, the interests of the states collide, and this may create new disputes in international level. The adoption of the United Nation Convention on the Law of the Sea in 1982 has created a new mechanism for dispute settlement in international law of the sea. There are voluntary and compulsory procedures for dispute settlement in UNCLOS. Arbitration is one of the best dispute settlement procedures which was reflected in Annex VII (Arbitration) and Annex VIII (Special Arbitration) of the convention. Therefore, it has gained big popularity from all around the world. Equivalence-equivalence responding (Eq-Eq) has become a behaviour analytic model of analogical reasoning. In previous works it was demonstrated that the exposition to a non-arbitrary relational task (facilitation procedure) improves performance in Eq-Eq tasks. In the present work we attempted to analyze the role of task components: arbitrary or non-arbitrary relational responses, role as sample or comparisons, and relating relations. In the first experiment, we devised four facilitation procedures combining two dimensions: simple or compound sample or comparisons and arbitrary or non-arbitrary relations among compound stimuli. In the second experiment two facilitation procedures including compound stimuli were tested. In one condition arbitrary relations worked as sample, and non-arbitrary relations as comparison. In the other condition its function was reversed. All procedures were effective to improve Eq-Eq to different extents, being arbitrary relational responses the key element. These results show generalization between non-arbitrary and arbitrary responses, and add further support to Eq-Eq responding as operant behaviour.

While it is controversial what principles an arbitral tribunal should apply when making a cost award under normal circumstances, it is widely accepted that an arbitral tribunal may take the parties’ procedural conduct into account and the most commonly applied institutional rules all confer broad discretion on the arbitral tribunal to consider procedural misconduct when deciding about costs. Procedural misconduct can occur in different forms and facets. The most regularly reported forms include frivolous or inflated claims, meritless requests, unsolicited submissions, dilatory or obstructive behavior and failure to produce documents. Since misconduct contravenes the duty to arbitrate in good faith and the goal to conduct the arbitration in a cost and time efficient manner, procedural misconduct of a certain gravity should not go unnoticed. Arbitrators should under appropriate circumstances indemnify the opponent and/or sanction the party engaged in misconduct for wasteful behavior by rendering an adverse cost award. They can do so either in an interim or partial award or at the end of the proceedings.

Fifty years ago, Frédéric Eisemann coined the expression ‘pathological clause’ to refer to arbitration clauses that substantially deviate from the essential requirements of a model clause. However, arbitration practitioners have not yet learned their lesson; the matter of pathology is far from being outdated. Arbitration clauses may be pathological if they do not provide for mandatory referrals to arbitration proceedings, or do not meet certain other requirements to provide for a workable arbitration procedure, or contain a reference to non-existing arbitral institutions and/or arbitral rules, or provide for a proceeding administered by an arbitral institution pursuant to different institutional rules. In most instances, the competent supervisory court (or the arbitral tribunal or institution dealing with a defective clause) seeks to cure these pathologies. Arbitral tribunals and national courts generally try to ascertain whether the parties’ real intention is to arbitrate, and, if that to arbitrate is apparent, to give effect to and enforce an otherwise invalid arbitration clause. CISG and arbitration are connected with each other. They may work through a combined or parallel procedure. Globalization of trade desires uniformity in trade. For uniformity of trade, we require uniform law. The arbitration may not work to make it uniform, but choosing any uniform law (i.e. CISG), it may lead to deal a particular arbitration in the international standard. The international standard may be maintained while considering the uniform law. Choosing uniform law (i.e. CISG), it may minimize the risk of wrong interpretation and put the arbitral parties on “equal footing”. Parties may consider CISG as the applicable law in their arbitral agreements. As of 13 February 2021, 94 states signed the United Nations Convention on Contracts for the International Sale of Goods 1980 (CISG). The frontline trading states like the USA, Australia, Israel, Canada, China, Germany, France, Russia, and Japan are contracting states of CISG. This research emphasizes providing guidelines as to how parties may apply CISG into their arbitral agreements by maintaining the international standard.

The equilibrium conditions of a system of external forces acting on a rigid body in the scientific discipline of statics are solved by a graphical procedure - construction and analytical procedure - by calculation. The graphical procedure is simpler and more transparent. The technical problems in statics are solved in both procedures and the results should be the same or approximately the same. The accuracy of the results of the graphical procedure using the method III of the force polygons and the III chain polygons presented in this paper is simply verified by cutting the directions of all three results at one point.

Parties who have agreed to arbitrate may sometimes need to obtain urgent relief at the outset of a dispute before the arbitral tribunal is constituted, but are disinclined to seek such relief at a court. The Arbitration Institute at the Stockholm Chamber of Commerce (SCC), has adopted new Rules which make it possible to obtain early interim measures even before arbitral proceedings have been initiated. The new Rules allow for the appointment of an emergency arbitrator within 24 hours of an application and for the emergency arbitrator to make a decision within five days of the appointment. While the new procedure offers opportunities for parties to quickly obtain early urgent relief, it also raises some issues which are discussed in this article.

The Arbitration Act 1996 states that a request for a stay must be conceded before the individual against whom the procedures were brought has made any move to respond substantively to the case and no sooner than after fitting technical advancements (assuming any) are made to recognize the lawful procedures. The ZPO provides that the challenge must arise prior to the start of the oral hearing on the matter of the dispute. When raising an issue with the courts of law, jurisdiction is of the utmost important for the assurance of whether the option to arbitrate may be postponed. Noncompliance may result in the court continuing to consider the subject of the dispute and, for the most part, make a choice that will exert jurisdiction upon the parties. Despite the fact that the arbitral tribunal may not be limited by the court’s choice, it is, on a basic level, necessary to contemplate upon a protest by one of the parties, regardless of whether the option to arbitrate has been postponed.

En tales casos se plantea la duda sobre la aplicabilidad o no en ese procedimiento de las nuevas disposiciones reglamentarias, que no existían cuando se perfeccionó el convenio arbitral y que, por tanto, las partes no podían conocer cuando se remitieron al reglamento arbitral en cuestión. El presente trabajo pretende plantear este debate y obtener conclusiones prácticas para cada uno de los operadores jurídicos implicados en el campo del arbitraje.Arbitration rules are frequently amended. It is sometimes the case that such modifications take place during the time between the signing of the arbitration agreement and the beginning of the arbitration procedure. In such cases, the question arises as to the applicability of the new set of rules, which did not exist when the arbitration agreement was signed and which, therefore, the parties were not aware of when they decided to adhere to that particular set of arbitration rules. The present paper intends to analyze how arbitral tribunals can and should act when the arbitral procedure is faced with issues related to corruption. The context in which Brazil is now inserted provides conditions for the arbitrators to come across these issues more often. On the one hand, the Brazilian political scenario demonstrates intense initiatives for countering corruption, which also involves several public related entities; on the other hand, there is a great incentive for governmental entities, either directly or indirectly owned by the State, to increasingly engage in arbitral procedures. Taken those circumstances into account, it is necessary to analyze what are the possible difficulties that arbitrators may find in order to conduct such proceedings and the possible answers and remedies to those issues.

This article examines the International Chamber of Commerce (ICC's) Emergency Arbitrator procedure as provided by the 2012 ICC Rules. Emergency arbitration procedures are relatively new creatures, and their increasing prevalence signifies their importance. The ICC Emergency procedure raises important, potentially novel, doctrinal questions which touch on the very nature of arbitration: can or should an Emergency Arbitrator be properly described as an arbitrator? How does the jurisdiction of the Emergency Arbitrator interact with the jurisdiction of the court and the arbitral tribunal? These questions become of immense practical import in the context of enforcement. This article analyses the specific provisions of the ICC Emergency Arbitrator procedure and seeks to anticipate the way in which existing arbitration statutes, case law and conventions might perceive the orders of an ICC Emergency Arbitrator. It is the view of this author that, on close analysis, the ICC Emergency procedure cannot and should not be properly described as arbitration in the traditional sense. The parties who sign up for the new ICC Rules intend for the ICC Emergency procedure to be a sui generis contractual creature which shares many similarities with the 1990 ICC Pre-Arbitral Referee, albeit in a new packaging and using different labels.

In this paper, the synthesis of an arbitrary spatial stiffness matrix is addressed. We have previously shown that an arbitrary stiffness matrix cannot be achieved with conventional translational springs and rotational springs (simple springs) connected in parallel regardless of the number of springs used or the geometry of their connection. To achieve an arbitrary spatial stiffness matrix with springs connected in parallel, elastic devices that couple translational and rotational components are required. Devices having these characteristics are defined here as screw springs. The designs of two such devices are illustrated. We show that there exist some stiffness matrices that require 3 screw springs for their realization and that no more than 3 screw springs are required for the realization of full-rank spatial stiffness matrices. In addition, we present two procedures for the synthesis of an arbitrary spatial stiffness matrix. With one procedure, any rank-m positive semidefinite matrix is realized with m springs of which all may be screw springs. With the other procedure, any positive definite matrix is realized with 6 springs of which no more than 3 are screw springs.

In the last decade, arbitration as a mechanism for alternative dispute resolution has become increasingly important. Questions of arbitrability move to the forefront as arbitration expands to disputes whose commercial character might be less obvious. One recent question of interest is whether individual employment disputes can be the subject of arbitration proceedings in Switzerland. This paper identifies two areas of employment disputes which lend themselves to final resolution through arbitration. In particular, sports related and “executive”-employee disputes benefit from dispute resolution outside of state courts. The well-known distinction between domestic and international arbitration proceedings seated in Switzerland has a profound impact on the subject matters that are considered to be arbitrable. Because Art. 177 of the Private International Law Act states that any dispute concerning a pecuniary interest may be the subject of an arbitration procedure, “international” parties desiring to arbitrate their dispute will rarely face an issue since almost all possible employment law claims are of a pecuniary interest to at least one party. On the other hand, the arbitrability of a domestic dispute is governed by Art. 354 Civil Procedure Code, which limits the scope of a potential arbitration procedure to any claim over which the parties may “freely dispose of”. The possibility of arbitration procedures regarding employment law disputes is therefore limited, since the Federal Supreme Court decided that an employee cannot “freely dispose of” all mandatory provisions enumerated in the Code of Obligations. This discrepancy is the main focus of this essay and will be explored in detail.

The article considers a new type of civil, arbitration process and administrative proceedings — a simplified procedure, which is carried out of court by exchange of evidence. The dates and features of the consideration of cases in the order of simplified proceedings are indicated. Conclusions are drawn about the inconsistency of this order with the principles of dispositiveness and competition.

The Supreme Court has actively expanded the Federal Arbitration Act into realms not originally contemplated by Congress. This harms consumers who are parties to pre-dispute, binding arbitration agreements. If consumers sign a contract containing an arbitration agreement, they may be required to arbitrate everything within the agreement’s scope, including their statutory rights. Simultaneously, the Court has restricted class action arbitration—a device on which consumers have relied when they are forced to arbitrate. The Court’s expansion of arbitration and restriction of class action arbitration has led many to distrust and advocate for changing the arbitral system. Arbitration institutions have directly reacted to the concerns about arbitration by promulgating more rules, procedures, and safeguards to make arbitration fairer for consumers. However, adding rules and procedures is probably not enough to make arbitration proceedings truly fair, and doing so creates a system that is so court-like that arbitration loses its chief benefits—affordability and efficiency. Thus, if the Court continues with its expansive arbitration jurisprudence and its anti-class action arbitration jurisprudence, institutional reaction is an unlikely solution to address arbitration’s fairness concerns.

Pursuant to the procedure envisaged by the New York Convention, a party seeking to recognize and enforce a foreign arbitral award shall translate the agreement to arbitrate and the arbitral award into an official language of the country where the enforcement is sought. By and large, such a requirement would not be difficult to interpret. At the same time, the obligation to produce a translation often involves additional (and potentially) high costs to the already expensive arbitration process. Moreover, providing a translation from the language that the parties chose may be considered overly formalistic and going against the pro-enforcement spirit of the New York Convention. This would be particularly so in cases where the enforcement judge’s language proficiency would be sufficient to evaluate the content of the award. This article discusses the consequences of failing to produce a translation, including complicating factors that arise when only the relevant part of the award has been translated by a party applying for recognition and enforcement under the New York Convention. The results of the Kluwer Research showed that, despite Paris being one of the most popular arbitration seats, French courts were the least likely to recognize and enforce an arbitral award, but also those with the highest number of vacated arbitral awards. The article analyses these results and offers some possible justifications for them. Concerning the enforcement and recognition procedures, the study only included reasoned decisions. The specificities of the French procedure however result in most of the decisions not being reasoned (the exequatur procedure is an ex parte procedure, only orders refusing the enforcement are reasoned) and the decision of the Court of Appeal dismissing an application to set aside an award (for awards rendered in France) has the effect of automatically enforcing the award. Therefore, analysing only reasoned decisions is not representative of the French courts’ approach. The article also analyses the grounds invoked by the claimants and their respective success rates, especially in comparison with other jurisdictions. Concerning the annulment procedures, France ranks as the country with the highest number of vacated awards. Indeed, while reviewing the number of annulment actions initiated in recent years before the Paris Court of Appeal, we concluded that the number of actions has doubled, with around 25% of successful annulment actions. As to the grounds for annulment relied upon by the claimants and their respective rates of success, the Kluwer Research revealed that the most relied upon grounds in France (authority not in accordance with the law and violation of public policy) were also the most successful ones. The change in due process, which has always been a guide to arbitral procedure, affords jurists a unique opportunity to study this new amendment, in the light of Arbitration Law, and also with support of foreign doctrine, to take advantage of these new provisions and draw new interpretations of the laws that regulate arbitration in our country. This article - a rehearsal - attempts to explore Arbi­tration Law, arguing that subsequent to the amendment of the Code of Civil Procedure, the legal text supports a new reading, allowing us to make partial arbitral awards.

The purpose of the paper is to identify differences in the normative fixing of the universal procedural institution of a court fine (monetary penalty) that are not justified by industry specifics. The method of comparative law was the determining method of research. The paper compares the titles, structures, sizes, grounds, subject composition, the procedure for considering and appealing the imposition of procedural sanctions under the Criminal Procedure Code of the Russian Federation, the Commercial Procedure Code of the Russian Federation, the Civil Procedure Code of the Russian Federation and the Administrative Procedure Code of the Russian Federation. The wording «court fine» in the criminal procedure and other types of procedures denotes completely different concepts. The application of a monetary penalty is limited to an excessively narrow list of subjects. The Criminal Procedure Code of the Russian Federation provides for a low and undifferentiated size of the sanction; the issue of the possibility of appeal has not been resolved. The author proposes to borrow relevant solutions to these issues from the compared institutions of other procedural branches. The author substantiates the necessity of convergence of universal institutions of criminal procedural, civil procedural, arbitrazh procedural and administrative procedural law, as well as the belonging of the institute of procedural responsibility to the number of universal ones.

Staircase procedures are commonly used to identify the stimulus level corresponding to a specific probability of response. The primary benefit of staircase procedures is that they require only that the probability of response changes monotonically with the stimulus level. The probability of response targeted by the procedure is typically estimated from the mean of reversals. However, the mean of reversals can be asymptotically biased away from the targeted probability. Existing methods to address the bias add assumptions about task performance, thereby limiting their use to well understood tasks and listener groups. We evaluated the hypothesis that the bias could be mitigated without adding assumptions by accounting for the effect of invariant procedural parameters on the estimate of the target probability. The approach was successful for staircases with different ascending and descending steps, for which the bias was found to depend on step size only. For other staircases, predicting bias required adding assumptions comparable to existing solutions. Results suggest that the bias is caused by the factthat reversals are influenced by parameters that do not affect the target point. A method is proposed to accurately estimate an arbitrary probability of response without adding assumptions about the task or listeners. [R01DC015051.]

The new Qatari Arbitration Law is a long-anticipated piece of legislation which operates to repeal the handful of Articles (190 to 210) that had been contained within the Civil and Commercial Procedure Code and replaces it with a series of provisions that, by and large, emulate the scheme of the UNCITRAL Model Law. The Arbitration Law is permissive in nature, allowing the Parties freedom to determine the arbitration procedures. The Arbitration Law provides a comprehensive framework for the arbitration process in Qatar. The Law achieves important reforms in a number of areas. It provides more clarity in relation to the nullification and enforcement of arbitral awards. It also empowers Qatar-seated arbitral tribunals to grant interim measures and preliminary orders. Further, it authorizes the Qatar Court of Appeal or Qatar Financial Centre’s Court of First instance to address all issues under the new Law requiring the assistance of the Qatar courts. Most importantly, arbitral awards cannot be appealed on questions of fact or law under the new Arbitration Law; a positive development that will provide greater certainty to parties and keep sensitive matters relating to the nature of a dispute out of the local courts. Moreover, it is remarkable that under the Arbitration Law, several provisions have envisaged short and swift time bars for procedures either during the arbitral process or after rendering the award. Finally, the Arbitration Law limits liability for arbitrators in the course of the performance of their duties, save in circumstances of bad faith, collusion or gross negligence.

ABSTRACT: The main objective of the present essay is to analyze the relationship between Arbitration and the Bankruptcy Institute on three distinct situations: (i) the extrajudicial recovery with the stipulation of an arbitral clause; (ii) the approval (granting) of the judicial recovery after the beginning of the arbitral procedure; (iii) an arbitral procedure to generate the judicial recovery as a private negotiation established between the debtor and the creditors. The possibility of convention on the extrajudicial recovery allows the parties involved in the litigation to negotiate a settlement to preserve her faculties and interests. On the other hand, the bankruptcy and the judicial recovery are institutes that protect the public interests, leaving a small space to the arbitral procedure, since the arbitration is a form of alternative dispute resolution related to unalienable rights.

An efficient boundary element procedure for the dynamic analysis of crack propagation in unbounded and arbitrary shape finite bodies is presented. The procedure is based on the direct time domain formulation of the boundary element method. A moving singular element and a remeshing technique have been developed to model the asymptotic solution of the stresses near the propagating crack tip. These ideas are easily implemented for a boundary discretization as opposed to similar procedures previously developed in a finite element context. The method is applied to problems of dynamic crack propagation in finite and infinite elastic domains. The obtained numerical results are compared with infinite domain analytical solutions and with available numerical solutions for finite domains.

Traditional sequential solution procedures for solving coupled heat transfer and radiation problems are known to perform very poorly when the optical thickness is high. This poor performance can be traced to the fact that sequential procedures cannot handle strong inter-equation coupling resulting from large absorption and scattering coefficients. This paper extends the use of the coupled ordinates method (COMET) to problems involving anisotropic scattering, where inter-equation coupling results from the in-scattering terms. A finite volume formulation for arbitrary unstructured meshes is used to discretize the radiative transfer equation. An efficient point-solution procedure is devised which is suitable for different scattering phase functions, and eliminates the cubic dependence of the operation count on the angular discretization. This solution scheme is used as a relaxation sweep in a multigrid procedure designed to eliminate long-wavelength errors. The method is applied to scattering problems and shown to substantially accelerate convergence for moderate to large optical thicknesses.

Background: In order to protect the rights of the mentally ill, legislation on the standards and procedures of compulsory detention has been made at the local and national level in China. Aims: This study aims to examine psychiatrists’ attitudes towards seeking involuntary admission in mainland China. Method: Three hundred and fourteen (314) qualified members of the Chinese Psychiatrist Association (CPA) were surveyed using a questionnaire to assess their attitudes about the procedure of involuntary admission to mental hospitals. Data were analysed using χ2 and logistic regression. Results: Some psychiatrists in the CPA had several arbitrary attitudes towards the process of admission. Females, aged under 35, with a low education level and a low position in the institution showed stricter attitudes in the procedure of involuntary admission. Areas with mental health legislation showed significant positive relationships with stricter attitudes. Conclusions: Every effort needs to be made to minimize these arbitrary attitudes to prevent potential negative outcomes. There is still a long way to go in protecting the rights of people diagnosed with mental illness.

In this paper, a concise nonlinear robust control scheme based on the frequency domain is proposed. Compared with the arbitrary selection of weighting function in classical H∞ mixed sensitivity robust control design procedures, the CGSA methods gives a relatively more straightforward and concise design procedure for MIMO robust control problem. In the simulations, the CGSA is applied to an integrated rudder and fin control loop to indicate that the integrated rudder and fin CGSA control scheme is very feasible for future practical application.
