Lo scopo del presente articolo è studiare la funzione dei prinicipi nel diritto processuale civile anche nell’ambito del Nuovo Codice di Procedura Civile (NCPC) brasiliano del 2015, con enfasi nella ricerca dell’equilibrio tra garanzie ed efficienza nel processo. Innanzitutto vengono studiati i principi e le regole nel NCPC brasiliano e nel processo civile in generale. Sono anche studiati i principi nei nuovi codici di procedura civile dei diversi paesi. In seguito si discute la funzione dei principi lungo la storia per arrivare al momento del recupero dela funzione assiologica dei principi processuali e alla questione della collisione tra questi ultimi con prevalenza delle garanzie delle parti nel processo.

Anche nel settore del giudizio civile si registra un crescente interesse per il giurista e filosofo londinese Jeremy Bentham e per le sue proposte in tema di disciplina della prova e di organizzazione della procedura giudiziaria. Le tesi utilitaristiche benthamiane possono scorgersi pure nella impostazione generale delle “Civil Procedure Rules” inglesi e nella teoria, che vi è accolta, della “proportionate justice”. Peraltro, tanto le concezioni di Bentham, quanto l’impiego del canone di proporzionalità in chiave utilitaristica, pongono delicati problemi e rischiano di ostacolare una piena tutela dei diritti individuali alla tutela giudiziaria.

În acest studiu ne propunem să dovedim că procedurile de insolvenţă sunt menite să protejeze debitorul şi creditorii deopotrivă, inclusiv pe cei care participă în procedura penală. Procedura de insolvenţă se desfăşoară sub controlul de legalitate al judecătorului sindic. Totodată, presupune parcurgerea anumitor etape, prevăzute de lege, caracterizate prin continuitate şi celeritate. În acelaşi timp, noţiunile de „dizolvare” şi „lichidare” nu sunt specifice insolvenţei, ci sunt instituţii comune în viaţa unei persoane juridice. Scopul măsurilor preventive aplicate persoanelor juridice este să prevină sustragerea de la urmărire penală sau judecată. Noţiunea de „sustragere” este intrinsec legată de o conduită frauduloasă, menită să eludeze răspunderea. Interpretarea logică a art. 493 alin. (1) lit. a) C.proc.pen. conduce la concluzia că măsura preventivă nu poate fi aplicată persoanelor juridice în insolvenţă, deoarece nu există o conduită frauduloasă. Procedura este definită de lege şi supravegheată de un judecător specializat. Este imposibil ca legiuitorul să fi conceput un conflict între atribuţiile a doi judecători din secţii diferite ale aceleiaşi instanţe. De lege lata există cazuri în care operează un transfer al răspunderii penale. Tot astfel, soarta daunelor civile în procedura penală este prevăzută de lege, chiar dacă radierea persoanei juridice intervine înainte de finalul procesului penal. În fine, efectele măsurii preventive prevăzute de art. 493 alin. (1) lit. a) C.proc.pen. în procedurile de insolvenţă sunt negative pentru toate părţile implicate, inclusiv pentru creditorii care participă în procedura penală. Drept urmare, instanţele nu pot, în baza art. 493 alin. (1) lit. a) C.proc.pen., să interzică începerea procedurilor de insolvenţă sau să le suspende, nici măcar în ceea ce priveşte interzicerea dizolvării sau a lichidării care are loc în cadrul acestei proceduri.

Il saggio ripercorre alcune tappe dell’evoluzione del principio di immediatezza nella procedura penale italiana, entro l’arco cronologico compreso tra la fine del secolo XVIII e il codice Finocchiaro-Aprile del 1913. Dopo una breve rassegna delle diverse definizioni del lemma e un cenno diacronico alla demarcazione dal concetto di oralità, la ricerca muove dagli spunti offerti da ‘pionieri’ quali Francesco Mario Pagano e Niccola Nicolini; esamina la letteratura europea (francese e, soprattutto, tedesca) che permeò la riflessione dei giuristi italiani; quindi si addentra nella stagione post-unitaria. Quest’ultima fu connotata dal contrasto tra un codice di rito (1865) ancora prettamente inquisitorio e una dottrina tutt’altro che compatta: se i primi commentari e, ancor piú, la scuola carrariana classificavano l’immediatezza tra i canoni inderogabili della giustizia liberale, la scuola positiva vi scorgeva un indebito cedimento alle interferenze popolari ed emotive nel dibattimento. La lunga elaborazione del codice Finocchiaro-Aprile non solo stimolò un serrato confronto dottrinale ma partecipò a quel movimento per l’oralità grazie al quale Chiovenda confidava di modernizzare il rito civile e penale.

<p>Em março de 2015 foi promulgado o novo Código de Processo Civil brasileiro (CPC). A partir de março de 2016, fica revogado o Código de Processo Civil de 1973 (CPC-1973).</p><p>Um dos pilares do novo Código é a estruturação dogmática de um sistema de precedentes judiciais obrigatórios. Essa transformação do direito brasileiro deve-se muito ao modo pelo qual a jurisdição vem sendo examinada pelos estudiosos do Direito no Brasil.</p><p>Nicola Picardi, em texto célebre e muito difundido no Brasil, fala da “vocação do nosso tempo para a jurisdição”<a href="file:///C:/Users/913206/Desktop/SISTEMA%20BRASILEIRO%20DE%20PRECEDENTES%20JUDICIAIS.docx#_ftn1">[1]</a>. Il giurista nizzardo Giovanni de Foresta è un personaggio poco noto e pochissimo studiato, nonostante il suo notevole apporto dato alla causa dell'unità d'Italia. Sostenitore di Cavour, sedette alla Camera subalpina per due legislature, la IV e la V, e rivestì due importanti incarichi di governo: fu ministro di Grazia e Giustizia sia nel primo governo D’Azeglio sia nel secondo governo Cavour, nel periodo di entrata in vigore delle leggi Siccardi. Oggetto di questo articolo sono i progetti elaborati da De Foresta durante questi due incarichi ministeriali. Innanzitutto il progetto che si tradusse nella legge del 26 febbraio 1852 sull’introduzione di misure restrittive della libertà di stampa: il dibattito parlamentare che ne seguì portò alla frattura della destra e alla stagione del "connubio" Cavour-Rattazzi. Successivamente viene illustrata l’opera svolta da De Foresta negli anni 1855-59 per il rinnovamento della codificazione del Regno di Sardegna attraverso l’apertura di un cantiere sia per l’elaborazione del codice di procedura civile sia per la revisione dei codici penali, che nel 1860 sostituirono quelli albertini. È infine presentato il contributo dato nel 1858 da De Foresta all'alleanza con la Francia, ritenuta indispensabile da Cavour per realizzare l'unità d'Italia, quando il Guardasigilli, per venire incontro alle richieste del governo francese, fece approvare dal Parlamento subalpino la legge sulle sanzioni da infliggere ai cospiratori contro i capi di stato stranieri.

The development of judicial procedures is an indicator of increasing complexity of civil procedure, a clear manifestation of the general pattern – unification and differentiation of civil procedural form. And one of the main tasks of the legislator is to make sure that the objective complexity of the legal space does not lead to complication of the access to judicial protection for interested persons. This thesis, put forward by the author, acts as one of the key ideas of this study and is disclosed in the article in terms of “incomplete” judicial procedures. The “incomplete” judicial procedures, according to the author’s conception, include simplified proceedings, absentee proceeding, court-ordered proceedings and proceedings on insignificant claims. The latter should be understood as proceedings before a justice of the peace in action cases (see clauses 2–5 part 1 of Article 23 of the Civil Procedure Code of the RF). In conclusion it is concluded that the procedural nature of the Russian process, laid down in the codes of the early 20th century, now acquires conceptual importance, which requires a different methodology to solve current legislative problems. The procedures we have considered is a “litmus test” of the methods of justice, which allows us to comprehend the general vector of the further path of civilizational process reform.

The article presents the results of the author’s dissertation research on legal responsibility in the civil procedure. The author substantiates the conclusion of the broadest interpretation of the civil procedure, according to which it should include: 1) judicial civil procedure: civil procedure, arbitration procedure, administrative procedure (legal proceedings); 2) out-ofcourt civil procedure: notary, enforcement proceedings, mediation, pre-trial conflict resolution, arbitration. Legal liability in civil proceedings should be understood as a type of state coercion, which consists in the subject of civil proceedings undergoing the adverse consequences provided for by the rule of law for a procedural offense committed by them in civil proceedings. The author also distinguishes between the concepts of responsibility in civil proceedings and civil procedural responsibility. Civil procedural responsibility should be understood as a subspecies of procedural responsibility, which is the obligation of the subject of civil procedure to undergo adverse procedural consequences provided for by the norm of civil procedure law, affecting the course of the procedure, for the procedural offense committed by him. Accordingly, it is proposed that court fines, performance fees, and compensatory (legal) liability (payment of court expenses, compensation for actual loss of time) should be attributed not to procedural, but to material and legal liability implemented in civil (civil) proceedings. The general state of implementation of civil and procedural liability measures in various branches of the civil procedure is clearly demonstrated in the form of a comparative table.

Based on the results of the study, the author identifies the following obligations: use procedural rights in good faith, show respect for the court or other persons involved in the case, inform the court about the change of name, address during the proceedings, disclose evidence, prove the circumstances, to which the person participating in the case refers, provide the required evidence, perform all procedural actions on time, submit procedural documents that meet the requirements of the procedural codes for form and content, notify the court of the reasons for failure to appear at the court session and provide evidence of valid reasons.

This review examines some changes introduced by the Federal Law on January 28, 2018, No. 451-FZ, to the Civil Procedure Code, the Arbitration Procedure Code, and the Code of Administrative Procedure of the Russian Federation. The media called the amendment pool “procedural revolution”. It touched many institutions. On the one hand, it promoted unification of the civil process and imposed legal certainty on many issues. On the other hand, it simplified some ordinary procedures. Some of the changes fix the rules formed in judicial practice; others are essentially transitional and imply the need for further refinement. The present research explores the following innovations: modernization of the institute of court competence in the context of the availability of judicial protection, simplification and unification of the procedure for reviewing a challenge to the court, expanding the scope of simplified procedures for reviewing requirements, fixing the rules of continuous appeal in civil and administrative proceedings, etc. The review introduces the upcoming changes to the reader and outlines the author's opinion on the procedural reform. Some changes are characterized as positive, and the author substantiates the need for reform. Meanwhile, some innovations are criticized as they will inevitably lead to restriction of the rights of participants in the procedural relations. The author believes that the innovations of the “procedural revolution” will not lead improve the court system.

The article is devoted to some leading issues that appeared both before and during the modernization of the civil procedure in the area of the conciliation procedures development. Firstly, the authors analyzed the issue of including the conciliation (mediation) period in the general period of the trial, as well as the issue of unification of the conciliation periods application in civil and commercial procedures, administrative proceedings and legislation on mediation. Secondly, the authors kept up to date the issue of popularizing conciliation procedures among citizens, the solution of which is proposed to be achieved by teaching special skills of the judiciary for the effective implementation of conciliation in the civil procedure.

I dedicate the article to Professor of the Department of Civil Law and Process of the Faculty of Law of Tomsk State University, Doctor of Law, Honored The article highlights the role of the Professor of the Department of Civil Law and Procedure of Tomsk State University Viktor Nifonovich Shcheglov in the development of the theory and method of teaching civil procedural law. I can separate the main directions of V.N. Shcheglov’s research activities: the legality and validity of a court decision, civil procedural legal relationship, the problem of a “broad” understanding of civil procedure and the subject of civil procedural law, a lawsuit and a claim form of legal protection. We pay particular attention to the formation of a scientific school under the leadership of Professor V.N. Shcheglov, continuity in conducting theoretical research, and introducing its results into the method of teaching civil procedural law. The content of the works of Professor V.N. Shcheglov enables us to conclude that the research interest of the scientist was focused primarily on the analysis of the nature, features and problems of the effectiveness of civil procedure as a special legal form of protection of rights and legally protected interests. Within the framework of this broad problem, it is possible to identify several methodologically significant aspects, which were found in the articles and monographs of V.N. Shcheglov. The first of them is the consideration of civil procedure as a special legal relationship. V.N. Shcheglov devoted several articles to this issue and his monograph “Civil Procedural Legal Relationship” (1966) was awarded the Tomsk State University Prize in 1967. The main idea defended by the author was the assertion that the civil procedure is a social relationship regulated by the norms of civil procedural law. The subject of this relationship is, on the one hand, the jurisdictional body that resolves the civil case, and on the other hand, the parties to a civil trial. The content of this legal relationship is the behavior of its subjects that is clothed in in the form of procedural powers, subjective, procedural rights and obligations. V.N. Shcheglov paid attention to a broad understanding of civil procedure and the subject of civil procedural law; whether civil procedure is only a trial of civil cases or any jurisdictional procedure aimed at protecting civil rights. V.N. Shcheglov and Professor N.B. Zeider concluded that the nature of the procedure is determined not by the body resolving the case, but by the nature (branch affiliation) of legal relations that are the subject of consideration within the framework of a particular procedural form. Therefore, civil procedural law regulates the procedural relations that develop in adjudication of civil cases by various jurisdictional bodies (a broad understanding of the subject of civil procedural law). The author declares no conflicts of interests.

The article analyzes the changes made to the Civil Procedure Code of the Russian Federation, the Arbitration Procedure Code of the Russian Federation and the Administrative Code of the Russian Federation by the Federal Law of 26 July 2019 No. 197-FZ, related to the regulation of conciliation procedures. The question is raised as to whether the civil procedural codes should regulate relations on reconciliation and to what extent. Agreement is expressed with those authors who believe that, by their nature, the relations that develop in conciliation procedures between its participants (including in cases where the conciliation procedure is directed by a judge) are not procedural and are not part of the subject of civil procedural law. The non-procedural nature of the relationship between the judicial conciliator and the court in the procedure of judicial conciliation under the Civil Procedure Code of the Russian Federation, the Arbitration Procedure Code of the Russian Federation and the Administrative code of the Russian Federation is substantiated. It is concluded that due to the qualitatively different nature of reconciliation relations from civil procedural relations, as well as their lack of connection with the resolution of a civil case in a certain system of guarantees (civil procedural form), there is no place for articles on individual conciliation procedures among procedural norms. In this regard, it is proposed to either exclude them, or, as an option, transfer them to the appendix to the Civil Procedure Code of the Russian Federation, the Arbitration Procedure Code of the Russian Federation, the Administrative code of the Russian Federation (just as in the Civil Procedure Code of 1964 there was an appendix, in particular, about the arbitration court).

The French Code of Civil Procedure of 1806 remained binding on the Polish territories for about 70 years and it exerted a significant influence on, among others, the shaping of the contemporary Polish terminology in this area.The present publication analyzes the issue of the nature of Code de procédure civile which – despite the extremely strong pressure during the French Revolution to introduce drastic change in the court procedure – in large part reproduced the solutions put forward in the ordinance by Louis XIV from April 1667 (Ordonnance civile touchant la réformation de la justice). On its basis, this branch of the law had been already codified in 17th century. Thus Code de procédure civile was certainly not the first code pertaining to civil procedure in France. Furthermore, the extent of the borrowings described in the article justifies the assumption that it was more of an amendment to the 1667 ordinance rather than a separate codification.

The article covers structural characteristics of optimization of civil procedure. It is noted that the study of optimization of civilprocedure determines the establishment of all essential characteristics of this phenomenon. Among them, undoubtedly, one should referto the issues of forms and methods of optimization.It is substantiated that optimization involves the novelization of civil procedural legislation or certain amendments to the rules inforce of carrying out civil procedural activities. It is possible only as a result of legislative work. This is the main form of optimizationof civil procedure.It is proved that judicial enforcement is a prerequisite of the legislative form of optimization. In this case, generalization andanalysis of judicial practice play an important role, allowing discerning the problematic aspects of law enforcement, determining themost effective ways to resolve the relevant problems and achieving the necessary unity of judicial practice.It is argued that optimization is a certain instrumentarium for assessing civil procedure, as well as possible directions for its transformation.It is emphasized that optimization should be studied both from the perspective of stages and procedural form of carrying outcivil procedural activities, and from the perspective of implementing certain norms and institutions of civil procedural law. At the sametime, the author relates the conciliation procedures and procedural periods to the general provisions of civil procedure rather than tospecial optimization methods.It is substantiated that optimization, as well as improvement of civil procedural legislation, cannot be reduced solely to simplificationand acceleration of civil procedure.The author considers optimization of civil procedure as a complex legal category. It is noted that it is right to study the procedurefor the consideration and resolution of civil cases in general or to concentrate on the narrower issues of the content of particular stagesor proceedings. Attention may also be paid to issues of the formation of adequate judicial practice in civil cases. It is important to studyany section of civil procedural activity from the perspective of optimization.The author believes that within the framework of studying optimization of civil procedure, issues of optimization of particularstages and proceedings of civil procedure can be considered. Moreover, the comprehension of the activities of subjects of civil procee -dings also needs to be carried out in the light of of its optimization and efficiency. In the same way, the analysis of the procedural meansof ensuring the realization of the task of civil procedure is possible through the study of optimization problems.

În încercarea de a evita încălcarea repetată a duratei rezonabile a procesului penal, legiuitorul Codului de procedură penală în vigoare a implementat, pentru prima dată, procedura contestației privind durata procesului penal, care era deja funcțională în materie civilă. Deși nu a fost luată în considerare în primul moment al redactării Codului de procedură penală, această procedură a fost introdusă ulterior, intrând în vigoare, prin urmare, concomitent cu noua reglementare. Practicile judiciare în materie relevă faptul că procedura a fost folosită de nenumărate ori, reprezentând adesea un mijloc eficient de accelerare a procesului penal, asigurându-se astfel respectarea dreptului justițiabililor de a obține o hotărâre judecătorească într-un termen rezonabil. Având o reglementare suficient de clară și precisă, instanțele s-au confruntat cu situații care aparent au scăpat de incidența prezentei proceduri, fiind uneori obligate să recurgă la standardele convenționale elaborate în această materie de Curtea Europeană a Drepturilor Omului. După aproape nouă ani de la intrarea în vigoare a contestației privind durata procesului penal, practica judiciară apare a fi încă neunitară, motiv pentru care, prin intermediul acestui studiu, ne-am propus să aducem câteva lămuriri asupra modului în care prevederile legale ar trebui interpretate și aplicate, inclusiv din perspectiva jurisprudenței Curții Europene a Drepturilor Omului, care a facilitat introducerea acestei proceduri.

One of the most important dates in German legal history is 1 October 1879. On this day the four Imperial Judiciary Laws (Reichsjustizgesetze) became effective: the Code of Civil Procedure (Zivilprozessordnung), the Code of Criminal Procedure (Strafprozessordnung), the Law on the Organization of Courts (Gerichtsverfassungsgesetz) and the Bankruptcy Code (Konkursordnung). They replaced a large number of different organizational and procedural provisions in the existing German states and effectively established legal uniformity in civil and criminal procedure in the German Empire. More specifically, the Court Organization Law created a national system of courts for civil and criminal matters consisting of Local Courts (Amtsgericht), District Courts (Landgericht), Appeals Courts (Oberlandesgericht) and the Imperial Court of Justice (Reichsgericht). The Code of Civil Procedure, the Code of Criminal Procedure and the Bankruptcy Code provided the procedural framework for all these courts thereby bringing procedural unity to the German Empire for the first time.

Based on a comparative analysis of the norms of the procedural legislation of the Russian Federation, the paper discusses certain problems and prospects of legal regulation of the status of persons contributing to the administration of justice: expert, specialist, witness, interpreter, assistant judge, court clerk, as applied to civil proceedings.The authors analyze modern approaches to the persons contributing to the administration of justice, considering, along with traditional subjects, such a procedural figure as judicial representative in a civil procedure, taking into account the latest changes and additions to the Civil Procedure Code of the Russian Federation, entering into force on September 1, 2019.Based on a comparative analysis of the provisions of the arbitration and civil procedural laws, the authors of the paper point that the Civil Procedural Code of the Russian Federation lacks a separate chapter on legal regulation of the status of participants in civil proceedings, including those assisting in the administration of justice. This makes it difficult to establish the circle of such entities in practice. In this regard, they propose, by analogy with the Arbitration Procedure Code of the Russian Federation, to fix the circle of participants in the civil procedure in a separate chapter, revealing in detail and specifying the legal status in other articles of the Civil Procedural Code of the Russian Federation of other participants in the civil proceedings.In the paper, the authors conclude that the judicial representative must be considered as an independent subject of the civil proceedings. Finally, this problematic issue can only be resolved by making appropriate changes and additions to the Civil Procedural Code of the Russian Federation.It is noted that, despite the absence of special instructions in the Civil Procedural Code of the Russian Federation to other participants in the process, their list is not exhaustive and in fact, the circle of persons involved in the case is much wider. Such persons include court bailiffs and witnesses, whose legal status is currently debatable.

The article formulates the content of the concept of "unnamed procedural action", as well as the conditions and limits of its application in modern civil proceedings in Russia. The complexity of understanding this phenomenon is due to the presence of a logical contradiction, which manifests itself in the following. On the one hand, the legislator considers permissible only those procedural actions, the list and order of which are legally fixed. On the other hand, the rapid development of public relations increasingly requires participants in the civil process to go beyond the prescriptions existing in the law. This state of affairs suggests that all procedural actions can be divided into two main groups. The first of them is the named procedural actions (procedural actions and the procedure for their commission are provided for in the law). The second is unnamed procedural actions (procedural actions and (or) the procedure for their commission are not provided for by law). We believe that unnamed procedural actions should be considered through the prism of such categories as "legal conduct", "judicial discretion" and "unnamed legal action", the latter of which has been studied in sufficient detail in the theory of civil law. Unnamed legal actions are also present in the theory of criminal procedure, but here they are usually referred to as "other procedural actions". In the theory of civil procedure, there is no mention of the term "unnamed procedural actions" or its analogues. There are no specified categories in the legislation. The conducted research allowed us to draw the following conclusions. All actions committed in the civil process, including those not named, can be considered as part of legal behavior, which is characterized by: 1) Normativity; 2) State control; 3) The presence of legal consequences. In relation to unnamed procedural actions, these signs, especially normativity, receive a slightly different, often broader, content. Nevertheless, if a number of conditions are met, the existence and possibility of their commission in modern civil proceedings is beyond doubt. Thus, we believe that an unnamed procedural action can be defined as a legally fixed or legally determined active behavior of participants in civil proceedings, implemented within the framework of initiated civil proceedings, entailing legal consequences and aimed at timely and correct consideration and resolution of a civil case. The author declares no conflicts of interests.

The essence of the principles of civil procedural lawis revealed through their features. Different approaches in the science of civil procedurallaw to determine their characteristics are analysed.The definition of the principles of civil procedural law is formulated, which are thebasic ideas, fundamental principles of the tasks and objectives of civil justice, enshrinedin the rules of civil procedural law, which reflect the specifics of the subject and methodof legal regulation of civil procedural law relations and are in a dialectical relationshipand interdependence with other elements of the mechanism of legal regulation.The functional purpose of the principles of civil procedural law is directly related tothe impact on legislative activity, becoming its guideline. On the other hand, externalfactors can influence the principles themselves and the mechanisms for their implementation.The peculiarities of the implementation of some procedural actions in martiallaw, which are reflected in the draft Law of Ukraine «On Amendments to the Code of AdministrativeProcedure of Ukraine, the Civil Procedure Code of Ukraine and the CommercialProcedural Code of Ukraine (concerning the conduct of proceedings under martiallaw or state of emergency)» № 7316 and related to the implementation of the principleof openness of civil proceedings. The peculiarities of court summonses andnotifications for the period of martial law or state of emergency are revealed, the author'sopinion on the proposed mechanism of realization of the principles of openness of civilproceedings, equality and justice, legal certainty is stated. He substantiated the conclusionthat the legislator did not consider the system of principles of civil justice to ensureaccess to martial law, and some provisions of the law contradict the principles of opennessand several constitutional principles such as equality and justice, legal certainty.

Based on the positivist approach to consciousness the law principle, the classification of the principles of Russian civil procedure law is clarified. The principles of civil procedural law of the Russian Federation are understood as the basic provisions of the civil procedural law branch, enshrined in the Constitution of the Russian Federation and (or) the Civil Procedure Code of the Russian Federation. Depending on the source of consolidation, there are three types of normative principles of civil procedure law: 1) constitutional principles of civil procedure law, duplicated in the Civil Procedure Code of the Russian Federation; 2) constitutional principles of civil procedure law that are not duplicated in the Civil Procedure Code of the Russian Federation; 3) branch principles of civil procedure law, reflected in the Civil Procedure Code of the Russian Federation. The first group includes 12 prin-ciples, the second – 7 principles, and the third – 2 principles. In contrast to the previously proposed approach to the principles of civil procedure law in our classification, the number of principles included in the first and second groups is expanded. In particular, the first group includes the principle of le-gality, the principle of guaranteed protection of human and civil rights and freedoms, the principle of respect for the individual's honor and dignity, the principle of the individual's freedom and inviolability, the principle of secrecy of correspondence, telephone and other conversations, postal, telegraphic and other messages, the principle of home inviolability, the principle of freedom from the obligation to testify, and the principle of administering justice only by the court. We put forward the position that some of the nor-mative provisions of the Code of Civil Procedure are not the initial, funda-mental ideas of civil procedure law.

In this article, the authors identify two important gaps in the literature on civil justice reform, both of which relate to the concept of stability in the law as an added value of public adjudication. The article aims to suggest avenues for future research on civil justice reform, especially in light of increasing recourse to private modes of dispute resolution. First, the article draws attention to the role played by judicial rituals and architecture in court-based, public adjudication, as a means of generating stability in the law and enhancing the legitimacy of dispute resolution. Second, from a more theoretical perspective, the article brings out the added value of formulating and formalizing legal norms through a public adjudicative process. Stability in the law encourages human agency and dignity by permitting individuals to form expectations and make decisions about their lives, acting in reliance on the law and the values that the law promotes. The value of stability must be taken into account in future research and policy work on civil justice reform, particularly as private justice, which lacks many of the characteristics that encourage stability in public adjudication, is increasingly explored as a potential solution to problems of access to justice. Dans cet article, les auteurs analysent deux lacunes importantes qu’ils ont relevées dans la littérature concernant la réforme de la justice civile et qui gravitent autour du concept de la stabilité du droit en tant qu’avantage découlant du processus public de règlement des différends. Les auteurs proposent des sujets à explorer lors de futures recherches sur la réforme de la justice civile, eu égard, notamment, au recours croissant aux modes privés de règlement des différends. Dans un premier temps, ils soulignent que les rituels et l’architecture du système judiciaire public favorisent la stabilité du droit et rehaussent la légitimité du règlement des différends. Examinant ensuite la question sous un angle plus théorique, ils s’attardent aux avantages découlant de la formulation et de l’officialisation des normes juridiques dans le cadre du processus public de règlement des différends. La stabilité du droit favorise l’intervention et la dignité humaines, car elle permet aux personnes d’avoir des attentes et de prendre des décisions au sujet de leurs vies en se fondant sur les règles de droit et sur les valeurs qui les sous-tendent. L’atout que représente la stabilité doit être pris en compte dans les futurs travaux de recherche et d’orientation sur la réforme de la justice civile, surtout à l’heure où la justice privée, qui est dépourvue de bon nombre des caractéristiques qui engendrent la stabilité dans le processus public de règlement des différends, est de plus en plus explorée comme solution possible aux problèmes d’accès à la justice.

Based on the positivist understanding of law principles, we analyze the legislation of the Russian Empire, which normatively enshrines the principles of civil procedural law. We substantiate the position that in the pre-revolutionary doctrine there were certain ideas about the principles of civil procedural legislation, however, a special analysis of normative acts with the aim of identifying them was not carried out. We highlight the features of pre-revolutionary scientists work – specialists in the field of civil procedural law, namely: theorization, reasoning about the principles of civil procedure “in general” as some universal ideas in isolation from the real analysis of the Charter of civil procedure, “inscribing” of Russian civil procedural law in the European context and as a consequence of this, the use of a wide range of foreign literature. Based on the analysis of the Charter of Civil Procedure of 1864 and the Nominative Decree given to the Senate “On the Establishment of Judicial Regulations and on the Judicial Charters” dated November 20, 1864, we substantiate and conclude that seven principles of civil procedural law were enshrined in the legislation of the Russian Empire: 1) principle of independence of judges; 2) principle of equality of all before the court; 3) adversarial principle; 4) principle of humanism; 5) principle of justice; 6) principle of publicity; 7) principle of speedy proceedings (principle of considering a case on the merits in no more than two instances).

Résumé :
The scientific work is devoted to the fundemental of civil procedure in Ukraine such as inadmissibility of abuse of procedural rights. The goal of our scientific research is definition of theoretic aspects of the princilple of inadmissibility of abuse of civil procedural rights, analisis of the main kinds and forms of such abuse, problems of legal reglamentation and realization of this fundemental and effective ways to overcome and prevent the abuse of procedural rights in civil procedure. The high level of this scientific research's actuality depends on different factors, bit we will admit the main ones: 1) the urgent need in Ukraine to supply the access to effective, as fast as possible (without unreasonble delays) justice against the backdropof european integration processes; 2) the large number of complaints against Ukraine to European Court of Human Rights because of violation right to a fair trial; 3)the direct connection between the effective realization of the right to a fair trial and the good faith conduct of parties in the civil case; 4) frequent cases of abuse of procedural rights by parties in the civil cases in order to delay the consideration of a case. The author researched the term of abuse of civil procedural rights through the Ukrainian laws and law doctrine. Also it was differed from other similar legal categories. There were defined the main kinds and forms of abuse of procedural rights in national legal practice. Also there were given the characteristics to the most popular kinds of abuse of procedural rights in Ukraine. The author paid attention to legal gears of overcomming of abuse of procedural rights in civil procedure in Ukraine.

The purpose of the paper is to identify differences in the normative fixing of the universal procedural institution of a court fine (monetary penalty) that are not justified by industry specifics. The method of comparative law was the determining method of research. The paper compares the titles, structures, sizes, grounds, subject composition, the procedure for considering and appealing the imposition of procedural sanctions under the Criminal Procedure Code of the Russian Federation, the Commercial Procedure Code of the Russian Federation, the Civil Procedure Code of the Russian Federation and the Administrative Procedure Code of the Russian Federation. The wording «court fine» in the criminal procedure and other types of procedures denotes completely different concepts. The application of a monetary penalty is limited to an excessively narrow list of subjects. The Criminal Procedure Code of the Russian Federation provides for a low and undifferentiated size of the sanction; the issue of the possibility of appeal has not been resolved. The author proposes to borrow relevant solutions to these issues from the compared institutions of other procedural branches. The author substantiates the necessity of convergence of universal institutions of criminal procedural, civil procedural, arbitrazh procedural and administrative procedural law, as well as the belonging of the institute of procedural responsibility to the number of universal ones.

This paper studies the principles of good faith and the cooperation between judges and parties, which are considered as highly relevant in current civil procedural law. According to many scholars, a new approach to defining their roles allows to overcome the basic urgent problems of modern civil justice – duration, high costs and, to some extent, the complexity of the trial. At the same time, its implementation leads to a positive impact on ensuring the efficiency and access to justice, which are integral parts of the rule of law. The evolution of the idea of directing litigation to peaceful compromise of parties and settling their dispute, has become of tremendous importance since the middle of the last century and today is considered as one of the inherent features of modern litigation. The idea ofgood faith in participating in the process was much developed in the first codes of civil procedure in Europe, in particular, in Austrian Code of Civil Procedure of 1898 and in French Code of Civil Procedure of 1806. The national legal doctrine contains the reflection of F. Klein's research, in particular the loyal cooperation between a judge's and parties' ideas. Later the national legislation of most European states applied the abovementioned during the reforms. Within the ELI-Unidroit Project of European Rules of Civil Procedure the Working Group on Procedural Rights used the idea of court and parties cooperation as the main ground and proposed to joint responsibility introduce with the aim of fair and just trial and avoiding of the traditional problems of two procedure models (A. Uzelac). The provisions of civil procedural law of many states, in particular of Ukraine, have more fully realized the idea of inadmissibility of abusing the procedural rights, which are justly regarded as an element of the principle of cooperation of the court and the parties in civil proceedings.
