This research was conducted to introduce the principle of the best interest of the child as a basis for judges to create decisions regarding the child custody that reflects child protection. Based on this idea, the problem formulations in this research are: First of al, what is the basis for determining child custody by judges in Indonesia? and Secondly, what is the basis for determining child custody that reflects the principle of The Best Interest of The Child This paper is legal research which applies statute approach, conceptual approach, and case approach. Based on this research, it was found that Firstof all, there are differences for judges in determining child custody in Indonesia for Muslim and non-Muslim couples. For Muslim couples, if the child is 12 (twelve) years old and over, the custody of the child is prioritized to be handed to the mother and if the child is under 12 (twelve) years of age, then custody will be given to the mother. For non-Muslim couples, generally, the custody of the child will be prioritized to be given to the mother. Secondly, The basis for determining the provision of child custody that reflects the principle of the best interest of the child for Muslim couples is that if the child is over 12 (twelve) years old, therefore the judge should not necessarily prioritize giving custody to the mother, rather they must pay attention to aspects of the need and the wishes of the child. If the child is not yet 12 (twelve) years old, the judge should also consider the desires and needs of the child and not necessarily give custody to the mother. The basis for determining the granting of child custody that reflects the principle of the best interest of the child for non-Muslim couples is when the judge does not necessarily give priority to the mother, but should consider the desiresand needs of the child.

Il dibattito sul fine-vita in pediatria negli ultimi tempi ha mostrato di incagliarsi quando viene usato come principio decisionale il cosiddetto best interest del bambino, dato che esso è solitamente invocato sia dai fautori della prosecuzione delle cure sia da quelli della sospensione. Il best interest è un principio troppo elastico per essere usato in maniera semplice e rispettosa della vita e della dignità del paziente in maniera inequivocabile. In questo articolo si propone un protocollo chiamato “pain principle”, che a) misura il livello di sofferenza del soggetto, valuta se questa sia eliminabile, e in caso di dolore insopportabile passa al punto b): la diminuzione dell’intensità e invasività delle cure. Questo protocollo ha il vantaggio di evitare la sofferenza inutile, di ridurre al minimo il soggettivismo delle scelte e di non provocare mai intenzionalmente la morte del paziente, rispettandone al tempo stesso la dignità. ---------- The debate on end-of-life in pediatrics has recently proved to be stranded when the so-called best interest of the child is used as a decision-making principle, since it is usually invoked by both advocates of treatment and those of suspension. The best interest is a principle too elastic to be used in an unequivocal manner. In this article we propose a protocol called “the pain principle”, which imposes to a) measure the level of suffering of the subject, assesses whether this is eliminable, and – in the case of unbearable pain – b): to decrease intensity and invasiveness of care. The pain protocol has the advantage of avoiding unnecessary suffering, of minimizing the subjectivism of choices and of never intentionally causing the patients’ death, respecting their dignity as well.

Article 12 of the un Convention on the Rights of the Child (crc) stipulates that children should have their views accorded due weight in accordance with age and maturity, including in proceedings affecting them. Yet there is no accepted understanding as to how to weigh children’s views, and it is associated strongly with the indeterminate notion of “competence”. In this article, case law and empirical research is drawn upon to argue that the concept of weighing their views has been an obstacle to children’s rights, preventing influence on outcomes for children in proceedings in which their best interests are determined. Younger children and those whose wishes incline against the prevailing orthodoxy (they may resist contact with a parent, for example) particularly lose out. Children’s views appear only to be given “significant weight” if the judge agrees with them anyway. As it is the notion of autonomy which is prioritised in areas such as medical and disability law and parents’ rights, it is proposed in this article that a children’s autonomy principle is adopted in proceedings – in legal decisions in which the best interest of the child is the primary consideration, children should get to choose, if they wish, how they are involved and the outcome, unless it is likely that significant harm will arise from their wishes. They should also have “autonomy support” to assist them in proceedings. This would likely ensure greater influence for children and require more transparent decision-making by adults.

SummaryThe study is devoted mainly to the logical-legal analysis of the provisions of art. 2 of Law no. 272/2004 on the promotion and protection of children’s rights, as well as art. 263 of the Civil Code, which establish the main normative solutions regarding the “priority promotion of the principle of the best interests of the child”. Although the phrase “the best interests of the child” is used in the construction of many rules of Law no. 272/2004, the Civil Code and other normative acts, the legislator refrained from establishing its significance, leaving this approach to the doctrine. The proposed study is intended to be a contribution to achieving this goal. We were also concerned with the identification of normative inaccuracies and the substantiation of pertinent proposals of lege ferenda for the improvement of the regulations regarding the principle of promoting with priority the principle of the best interest of the child.

In this article, children’s rights will be studied in the Iranian legal system with remarks on its references in the Shia Jurisprudence. One of the main issues regarding children, is their guardianship, custody or tutorship. The Iranian legal system, same as the Shia Jurisprudence, has always kept the best Interest of the child as an essential ground for law making. Referring to court decisions; it is evident that control of the guardianship on the child is limited by the best interests of the child, because this interests is what we are sure to understand from the reason of custody of the child and that this system is designed only to secure child’s best interests since he/she might be incapable to secure his/her interests alone. The Iranian legal system, especially in the family law section is based on the Islamic rules. The main documents in the Shia Jurisprudence in Islam are Quran, Hadith, Consensus and reasoning which will be defined herein. In addition, a more recent review will be made in this study regarding the ratified laws regarding children’s rights and international treaties and conventions while focusing on the Convention on the Rights of the Child even though, Iran joined this convention by having several reservations.

Il fenomeno della sottrazione internazionale dei minori consiste nell’illecito allontanamento (o nel mancato rientro) del minore «in violazione dei diritti di affidamento derivanti da una decisione, dalla legge o da un accordo vigente in base alla legislazione dello Stato membro nel quale il minore aveva la sua residenza abituale» da parte di un genitore. Ad esso sono dedicate alcune norme del Regolamento (CE) n. 2201/2003 relativo alla competenza, al riconoscimento e all’esecuzione delle decisioni in materia matrimoniale e in materia di responsabilità genitoriale e le disposizioni della Convenzione dell’Aja del 25 ottobre 1980 sugli aspetti civili della sottrazione internazionale di minori. Tali atti prevedono, oltre ai criteri di definizione delle autorità competenti e alle norme sul riconoscimento ed esecuzione delle decisioni, la creazione di una rete di cooperazione fra gli Stati membri diretta alla risoluzione celere della questione e al perseguimento degli interessi del minore coinvolto. I casi di sottrazione dei minori coinvolgono, inoltre, ulteriori aspetti riguardanti la vita familiare degli stessi, il diritto ad essere ascoltati, la valutazione della loro vulnerabilità, il diritto di mantenere rapporti con entrambi i genitori e il diritto di visita. A ciò si aggiunge l’affermazione dell’obbligo per gli Stati di rispettare il diritto alla vita familiare (artt. 8 CEDU e 7 della Carta dei diritti fondamentali dell’Unione europea) e le pronunce rese dalla Corte europea sulla compatibilità tra gli obblighi scaturenti dalla Convenzione dell’Aja del 1980 e le norme CEDU. La sottrazione internazionale dei minori è, dunque, un fenomeno in cui gli aspetti processuali del diritto internazionale privato si fondono con i principi sottesi all’effettiva ed efficiente cooperazione tra Stati e con la tutela dell’interesse superiore del minore (previsto su scala universale dall’art. 3 della Convenzione Onu sui diritti del fanciullo del 1989), nonché, con il diritto alla vita familiare. Profili che investono il diritto internazionale, europeo e nazionale, condizionando inevitabilmente quest’ultimo e la sfera di esclusiva competenza riservata al legislatore statale. La tutela del minore quale principio preminente rispetto ai diversi interessi coinvolti ha, dunque, una valenza particolarmente incisiva tale da superare le stesse delimitazioni di competenza tra Unione europea e Stati membri, nel senso che gli aspetti processuali atti a garantire il rientro del minore nello Stato di residenza abituale possono condurre nelle singole fattispecie concrete ad un superamento della disciplina nazionale in materia di affidamento. As the divorce rate in the United States remains steady at 50%, the last few decades have shown an increase in child custody disputes. Within these litigations, interparental conflict can reach high levels and incite behaviors that wreak havoc on the children who are caught in the middle. When considering custody arrangements, judges and other evaluators use the Best Interest of the Child Standard (BICS), a jurisdictionally-specific framework that examines several factors that contribute to a child’s health and well-being. Parents who allow their resentments to get the better of them sometimes engage in behavior that encourages their child to become alienated from the other parent, known as Parental Alienation (PA) —a form of psychological abuse that can result in emotional and behavioral consequences for the child. While some states investigate components relevant to PA during a BICS evaluation, none include criteria that directly addresses this construct. Therefore, to achieve the intended outcome of BICS, which is to create a custody arrangement that will best meet a child’s needs, recognizing and addressing the presence of PA within a family system is required.

This thesis explores current and historical child custody laws in the State of Arizona and how they have correlated with child development theories. It discusses the impact child development theories have had on Arizona child custody cases. Additionally, it includes an overview of early Arizona Supreme Court cases and the implications it has on the best interest of the child. The thesis also provides insight to problems with Arizona courts and the actors involved with making the decision for the best interest of the child. The investigation demonstrates a disconnection between judicial discretion and the best interest of the child standard. An example from the United States Supreme Court case Troxel v Granville (1999) is reviewed to illustrate how courts discretion, in general, can be misused. Overall, court discretion in Arizona is liberal and the impact it has on child custody decisions can sometimes conflict with the best interest of the child.

Best interests of the child (BIC) is a construct that is central to legal decisions in several areas including parenting matters in the Family Courts, guardianship, child-protection, and adoption. Despite the centrality of the construct, BIC has not been operationalised (Thomson & Molloy, 2001) and there is little agreement about what is considered best for children within social service and legal communities (Banach, 1998). Given that one of the aims of law is to reflect public sentiment (Green, 1996), the current study explored the general public’s conceptualisation of BIC. More specifically, I sought to determine what community members think the term “best interests” means and what factors they believe need to be considered when determining BIC? A qualitative approach was used and data were collected through semi-structured interviews. Participants (n= 19) defined BIC as parents effectively meeting the developmental needs of children to produce healthy young adults, both physiologically and psychologically. A complex hierarchical model was generated from participant responses that outlined the primary developmental needs of children and sets of conditions and parenting practices that elicit these. Despite the indeterminate nature and vagueness of the BIC standard, the findings from the current study suggest that current legislative practices do reflect public sentiment. Results of this research represented an important step towards a more comprehensive understanding of the BIC concept and endorse existing practices of forensic evaluators. Moreover, embedding gathered information in the context of child development and parenting literature appears essential to the utility of forensic psychological assessments. Finally, the model generated highlights the complexity of BIC and the need for practitioners to be aware of interactions that exist between child development and contexts of the home, community, culture and society.

The concept of inter-country adoptions was reintroduced into the South African legal sphere in The Minister of Social Welfare and Population Development v Fitzpatrick 2000 3 SA 422 (CC), where the constitutionality of section 18(4)(f) of the Child Care Act 74 of 1983, which prohibited inter-country adoptions, was successfully challenged. The decision evoked criticism from all around the world, some in favour of inter-country adoptions and others not. In considering this decision, one also has to keep in mind section 28(1)(b) of the Constitution of the Republic of South Africa, 1996 which affords every child the right to family care or parental care, or to appropriate alternative care when removed from the family environment. The aim of this paper is to investigate the inner workings of inter-country adoptions, which are regulated by the Hague Convention on Protection of Children and Co-operation in Respect of Intercountry Adoption of 1993 and, nationally, the Children’s Act 38 of 2005. These findings will then be relayed back to the ‘best interests of the child’ principle to determine whether inter-country adoption is in the best interests of the child, or not.

A presente dissertação traz uma reflexão sobre a aplicação do princípio do melhor interesse nos conflitos interfamiliares de guarda, buscando a sua origem e levantando alguns critérios que possam nortear a sua utilização, uma vez que não há um conceito expresso na legislação. Nosso objetivo foi verificar se o princípio acima mencionado estava ou não sendo considerado nas decisões judiciais oriundas das disputas de guarda entre os genitores, após o divórcio ou a separação. Para efetivá-lo, desenvolvemos um estudo qualitativo de tipo exploratório junto ao Núcleo de Prática Jurídica da PUC/RJ, procedendo à análise de catorze processos de guarda identificados no período de 1997 a junho de 2007. A leitura e análise dos processos evidenciaram que o princípio do melhor interesse ainda não é totalmente considerado pelos operadores do Direito. Nos processos em que há atuação da equipe técnica (assistentes sociais e psicólogos) pode-se perceber uma conduta que explicitamente coloca a criança/adolescente como personagem principal do processo (prioridade absoluta), ouvindo-os sempre (proteção integral) e averiguando de que forma seriam melhor atendidos (melhor interesse). A conduta de juízes e promotores, por outro lado, não se afigurou, nos processos analisados, como algo que demonstrasse a preocupação com a aplicação do princípio do melhor interesse, mas ao contrário a ênfase era no encerramento dos mesmos a partir de um acordo elaborado apenas com os genitores, desconsiderando as peculiaridades do litígio e em especial o bem estar das crianças e adolescentes envolvidos.
The present dissertation brings a reflection on the application of the principle of the best interest of the child in the interfamiliar conflicts of custody, searching its origin and raising some criteria that can guide its use, once there is not an express concept in the legislation. Our main goal was to verify if the referred principle was being considered or not in the decisions of the disputes of guard between the genitors, after the divorce or the separation. In order to accomplish it, we developed a qualitative and exploratory study at the Núcleo de Prática Júridica of the PUC/RJ, in which fourteen proceedings of custody in the period of 1997 until June of 2007 were analyzed. The analysis of these proceedings showed that the principle of the best interest of the child is not yet taken into consideration by some of the Law workers. The proceedings in which the social workers and psychologists participated we noticed that the adolescent/child were seen as the main characters (absolute priority) so they always got the chance to express their opinions (full protection) and therefore offered the means to point out the most suitable way to solve the cases (best interest). On the other hand, the judges and prosecutors of the analyzed proceedings did not seem to be concerned about the principle of the best interest of the child, their greatest concern was to put an end to the lawsuits making a deal with the parents, disregarding the details of the conflicts and the well being of the children and adolescents involved.

While the Best Interest of the Child (BIOC) standard has been used since the 1970’s, alternatives such as the Approximation Rule have recently been proposed to remediate perceived weaknesses in BIOC. This study examines the applicability of the Approximation Rule using cross-sectional data collected from 517 children (age 10-18) of divorced parents using the Co-Parenting Behavior Questionnaire (CBQ). Data for all co-parenting and parenting variables (n = 517) were analyzed to determine relationships by time since divorce and custodial relationship. Physical custody was associated with significant differences in children’s’ ratings of both co-parenting and parenting effectiveness. Results for time since divorce revealed only one significant relationship with all divorcing parents showing significant decreases in ratings of inter-parent conflict over time with the most substantial reductions occurring 5 years after the separation. Findings were then used to measure the accuracy of the assumptions in both the Approximation Rule and in BIOC.

ENGLISH ABSTRACT: The Constitution of the Republic of South Africa entrenches the best interests of the child as being of paramount importance in all matters concerning the child. This commitment to the promotion of the welfare of children is not unique to modern South African law, but is an acknowledged principle of the common law and international child law as well. With such well-established recognition the question, which forms the primary focus of this study, arises whether the principle of the best interests of the child is workable and applicable in real life scenarios where the custody of a child has to be decided. The challenge to the application of the principle in this context is to reach a decision that will protect the parent-child relationship regardless of the marital breakdown. The question is whether the principle allows for and creates an honest awareness of and commitment to the welfare of children that influence decisions in this context or whether courts and decision-makers merely pay lip service to it in order to conceal the haphazard way in which custody is awarded. In order to determine the workability and applicability of the principle, it is necessary to know how the principle has evolved in the South African legal context. Through the examination and analysis of existing literature, international conventions, legislation and case law, a number of different perspectives on the developments in the interpretation and application of the principle are provided. These perspectives culminate in the useful and constructive insight and conclusion that the value of the concept is dependant upon the correct approach to the principle and its characteristics. The defining characteristic of the principle of the best interests of the child is its inherent vagueness and indeterminacy. Though this subjects the principle to serious criticism, this study supports the argument that indeterminacy is in fact essential. It ensures not only the flexibility of the concept, rendering it applicable to the time, cultural sphere and social context and unique circumstances of each case it is applied to, but a holistic approach to the child as individual and family as a unit as well. This holistic approach forms the foundation of the lists of criteria in McCall v McCall 1994 (3) SA 201 (C) and the Children's Bill, thereby establishing the workability and value of the principle for fair and just results in all decisions pertaining to the custody of children.
AFRIKAANSE OPSOMMING:Die Grondwet van die Republiek van Suid-Afrika verskans die beste belange van die kind as van deurslaggewende belang in elke aangeleentheid rakende die kind. Die verbintenis tot die bevordering van die belange van kinders is nie 'n verskynsel uniek aan die moderne Suid-Afrikaanse reg nie, maar is 'n erkende beginsel in beide die gemenereg en die internasionale kinderreg. Met hierdie wyd-verspreide en algemene erkenning ontstaan die vraag, wat dan ook die primêre fokus van hierdie studie vorm, of die beginsel van die beste belang van die kind werkbaar en toepaslik is in ware lewensdramas waar 'n beslissing oor die bewaring van 'n kind gemaak moet word. Die uitdaging vir die toepassing van die beginsels in hierdie konteks is om 'n besluit te neem wat die voortbestaan van die ouer-kindverhouding ten spyte van die verbrokkeling van die huwelik sal verseker. Die vraag is of die beginsel werklik 'n eerlike bewussyn van en verbintenis tot die welstand van kinders skep wat die besluitnemingsproses in hierdie konteks beïnvloed en lei en of howe en besluitnemers bloot die regte lippetaal gebruik om die lukrake manier waarop besluite geneem word te verbloem. Om die werkbaarheid en toepasbaarheid van die beginsel te bepaal is dit nodig om die proses van evolusie van die beginsel in die Suid-Afrikaanse reg onder oënskou te neem. Deur die ondersoek en analise van bestaande literatuur, internationale konvensies, wetgewing en hofuitsprake word 'n aantal perspektiewe op ontwikkelinge in die interpretasie en toepassing van die beginsel voorgelê. Hierdie perspektiewe lei tot die betekenisvolle en opbouende gevolgtrekking en insig dat die waarde van die konsep afhang van 'n korrekte benadering tot die beginsel en sy kenmerke. Die hoofkenmerk van die beste belange van die kind beginsel is die inherente vaagheid en ondefinieerbaarheid daarvan. Hoewel dit die beginsel aan ernstige kritiek onderwerp, ondersteun hierdie studie die argument dat die onbepaaldheid in der waarheid noodsaaklik is. Dit verseker nie alleen buigsaamhied, wat toepassing op alle tye in alle kulturele en sosiale omgewings en besondere omstandighede van 'n spesifieke geval moontlik maak nie, maar ook dat 'n holistiese benadering tot die kind as individue en die gesin as eenheid gevolg word. Hierdie holistiese benadering vorm die grondslag van die lyste van faktore in McCall v McCall 1994 (3) SA 201 (C) en die Wetsontwerp op Kinders 2003 waarmee die werkbaarheid en waarde van die beginsel vir billike en regverdige resultate in alle aangeleenthede rakende die bewaring van kinders verseker kan word.

The monograph is a comprehensive study of the current practice of resolving cases on determining the place of residence of children, the procedure for communicating with them separately living parents and other relatives; restriction and deprivation of parental rights; on the departure of children outside the Russian Federation and return within the framework of the Convention on Civil Aspects of International Child Abduction of 1980, the Convention on Jurisdiction, Applicable Law, Recognition and Enforcement and Cooperation in relation to Parental Responsibility and Measures for the Protection of children of 1996.The relations that develop between the child and parents, the child and the court, parents and the court, as well as parents as parties to the process are analyzed. The central place is occupied by the study of the content of the concept of the best interests of the child as a guarantee of the protection of his rights and the vector of development of the current legislation. The cases of abuse of parental rights and improper performance (or non-performance) of parental duties, illustrated by current judicial practice, are considered. The analysis is presented: measures of family legal responsibility, including restriction and deprivation of parental rights in connection with non-execution of a court decision on the upbringing of a child; features of the application of principle 6 of the Declaration of the Rights of the Child in resolving disputes about the place of residence of children; the possibility of taking interim measures in disputes between parents about upbringing; the ratio of legal and psychological categories in child-parent relations in order to apply special knowledge; the procedure for conducting forensic examinations in these categories of cases. Finally, the possibilities of out-of-court settlement of some family disputes, including through mediation, are investigated. For a wide range of readers interested in the rights of the child. It will be useful for students, postgraduates and teachers of law schools.

AbstractArticle 22 guarantees the substantive application of all Convention rights to the particular situation of asylum seeking and refugee children, and also guarantees them protection and assistance in advancing their immigration and residency status claims and in overcoming the hurdles posed by international migration channels, including guarantees of due process. The rights of refugee and asylum-seeking children can be analyzed in relation to four essential attributes. First of all, Article 22 insists upon appropriate protection and humanitarian assistance. Refugee children are not granted a special status under the Convention, but they are not given any lesser status. They are to be treated as children first and foremost and not as migrants per se, in the sense that national immigration policy cannot trump child rights. The basic rights to education, health, and child welfare of these children needs to be protected to the same extent, and as much as possible, as children who are nationals of the host country. The second attribute preserves the rights of refugee children not only under the Convention but under all other international human right treaties and humanitarian instruments binding on the relevant States Party. These may include, for many governments, the 1951 Refugee Convention, the Convention on the Reduction of Statelessness, the Geneva Conventions and the Hague Convention for the Protection of Minors, 1961, among others. A third attribute of Article 22 insists upon the duty to protect and assist refugee children. This entails a clear duty to provide children with appropriate due process rights throughout their asylum and refugee claims procedures, including the child’s right to be heard and participate in all the processes determining the child’s residence or immigration status, border admission, deportation, repatriation, detention, alternative measures, or placement, including best interest determination processes. The fourth and final attribute of Article 22 asserts that two basic principles should guide each activity with the refugee child: the best interests of the child and the principle of family unity.

Parental consent on undertaking the child's major medical treatments constitutes the issues that significantly affect the life of the child. In that sense, undergoing such medical treatments demands explicit and written consent of both parents, encompassing even the cases of sole exercise of parental responsibility in domestic legislation. Firstly, the author tries to define the concept of major medical treatments taking into account rules of the Law on the Rights of Patients. It has been found that this concept involves exceptional diagnostic and therapeutic invasive medical measures that may have significant effect on the child' right to life, survival and development. Furthermore, special attention is paid to the child's autonomy enforcement in the context of parental consent to the child's major medical treatments. It has been shown that applying the principle of the best interests of the patient in the domain of medical service provision requires bigger involvement of paternalistic elements reducing even the autonomy of the competent child. Finally, this paper suggests legal mechanisms that can be used for overcoming the problems of parental disagreement on undertaking child's major medical treatments. These mechanisms differ in their compliance to the concept of urgent medical measures

One of significant legal innovations brought by the new domestic Law on Medically Assisted Reproduction involves widening the concept of reproductive autonomy in case of single woman as a user of medically assisted reproduction services. Thus, the new Serbian legislation in this field adopts quite liberal approach which largely relieves single woman to engage in medically assisted reproduction procedure. Firstly, the right of a single woman to access the medically assisted reproduction is not formulated as an exemption from the rule that such right belongs primarily to marriage couples and cohabitants. In this way, medically assisted reproduction is permitted under same conditions to single woman as for the spouses and cohabitants. Even more, new Serbian legislation in this field has abolished the principle of medically necessity in case of a single woman as a user of medically assisted reproduction. Thus, she has been given even bigger reproductive autonomy in domain of medically assisted reproduction comparing to those of marriage couples or cohabitants. Such unchecked and overwhelming reproductive autonomy significantly impairs the balance among the interests of participants in medically assisted reproduction procedures endangering the public interests, as well as the best interests of the prospective child.

The motivation for choosing this theme is centered on the concrete applicative size, at the level of the elaboration of a coherent counseling program, aimed at training educational counselors from a scientist-practitioner type of perspective, which is adequate for the necessities and the psychological profile adapted to the real clients’ needs, those of children with high aptitudes in Romania, who represent an informational vacuum in the Romanian educational system in what concerns the applicative dimension of the counseling services involved in promoting excellence; it is necessary to raise awareness in what concerns the fact that the best way of understanding counseling in this area involves the integration of the paradigms concerning the counseling of talents in a more eclectic way. The purpose of the research is that of identifying the qualitative and quantitative aspects involved in the continuous training of counseling teachers working in centers and offices of pedagogical support in order to provide appropriate psycho-pedagogical counseling services for gifted children, approach which is presented as necessary to optimize the psycho-individual potential of each gifted child. During the investigation there have been used qualitative and quantitative research methods: the survey based on the semi-structured type of interview as well as the questionnaire-based survey. The results target: a radiography of the level of training in the case of school counselors in the Romanian schools, in order to conduct specific activities for promoting excellence, for creating a space suitable for the adequate development of specific skills in the case of each gifted child, stimulating the parents’ interest in becoming more knowledgeable in what concerns their children' s psycho-pedagogical features and much more effectively involved in the education of gifted children. The research findings have been obtained through a diagnostic study, which indicates in a comprehensive and exhaustive manner the issues that circumscribe the psycho-pedagogical counseling activities designed to promote pedagogical excellence in Romania, being considered the size of continuous training of teachers in relation to quality results in advising and promoting excellence.

"Worried about the car’s future? Don’t be. What we do need is a new perspective on personal mobility. Car makers compete over the same markets, margins are slim. Now the car faces growing criticism on a number of subjects; the industry is asked to transform. Reducing vehicle footprint offers whole new opportunities. Mind you, not the same as bringing a small car. My submission (based on over 15 years of research) carries the following subjects. 1. Think post-Tesla Solely based on battery drive, Tesla grew out to be more valuable than Volkswagen. Imagine the potential when other car travel-related issues are tackled too: zero-emission drive without subsidizing, energy efficiency, gridlock, traffic safety, profitable ride-hailing, self-driving. 2. Less = More In principle, low energy-dense propulsion (batteries) are a better match for lightweight vehicles. If we keep on putting large battery packs in oversized EVs, we end up with a lot of shortage, disposal and reusability issues. Daily gridlock is proof of how poorly we manage space, energy, materials, precious time. Think of infrastructure in terms of internet bandwidth which is difficult to expand. How to utilize roads more efficiently? 3. Smart-app vehicle No doubt, future generations will look at cars as ‘personal mobility devices’ - electric, smart, sleek, practical. Technology tends to influence product format anyway. The phone went from brick-like to sleek, cool, efficient, smart. So can the car. 4. Driverless favors sleek There’s more margin to scan-sensor-image the vicinity, take evasive action. Instead of putting autonomous hard- and software in conventional cars as add-ons, reformat the car first to have it benefit optimally from driverless technology. 5. Bridge the gap between personal mobility and public transit Outside rush hours, fewer people need to be carried, making the deployment of coach buses too costly to cover running expenses, less eco-friendly per passenger. When passenger payload drops, smaller vehicles are far more efficient. The average ride-hail trip is 1.2 passenger. Now there’s an opportunity for ride-hailers (TNCs) and transit authorities to work together, leaving room for micro-mobility as well. 6. Basically a whole new market Best to avoid the label and stigma of ‘driving a small car’. People don’t particularly favor or like small cars. So, bring something else, something in between car and two-wheeler. A ‘Best of Both Worlds’ - the fun, economy, agility of a scooter... and the comfort and safety of a car. Time to happily, purposefully cater to the growing and diverse market of urbanites, two-car households, early-adopters, singles, couples, one-child families, greenies, techies, ride-hail companies. Together they represent more than 1 out of every 1000 prospective car buyers. 1/1000 is a ratio which suffices to have a viable production (with global car sales averaging 90 million). 7. Streamline production Through 3D printing, C2C, appliance-like manufacturing methods, localized. 8. Sky’s the limit Lightweight, low drag and energy efficiency are quintessential for aerial vehicles too. A modular setup enables seamless '2D and 3D transit'."
