Texte intégralSince the 1970's, the French coastline has become the favourite location for those purchasing a second home. As a result, more than 90. 000 campers use plots of land, be it farmland or otherwise, to temporarily house their lodgings : caravans, mobile home and other light recreational vehicles. As these small lodgings have gradually become more permanent fixtures, the result has contributed to the increasing urbanisation of these areas. The fact that this popular practice of occupying land has developed outside of current regulation means that the environmental cost of the phenomenon has been high. The study allows a real understanding of the impact of land planning and environmental protection on the behaviour of private landowners in areas under particular strain. It also allows a chance to analyse the management style of the public authorities in the face of the continuing crisis in the levels of public interest, highlighted today by this tolerance of an illegal practice

Texte intégralIn one sense the adjective systemic means what is “relating to or involving a whole system”. With this definition as reference, this study concerns the (dys)functioning of domestic legal systems from an international perspective. The word systematic refers also, in human rights matters, to what is practiced “on a large scale” revealing the absence of care and the absence of rationality in the legal sense, and which can be measured in terms of procedures and legal obligations. These two definitions of the word systemic represent two principal aspects of our research, as they are linked to eachother. In studying international jurisprudence related to human rights matters, our research aims, on one hand, to build a category of violations that we designate as systemic and to demonstrate the particularity of their legal treatment. On the other hand, we will demonstrate the manner in which human rights jurisdictions adapt to this type of violations. Finally, there is the aim of illustrating the specificity of international liability of the state arising from systemic violations

Texte intégralBuilt around the employment contract, labour law is based on a bilateral relationship between an employer and an employee. The leasing and subcontracting of labour force disrupt this balance because the employee's labour force benefits a third party to the employment contract. The original mistrust resulted in two criminally sanctioned prohibitions: illegal subcontracting and illegal labour leasing. The evolution of the economic market has forced the legislator to go beyond repression alone and to consider the legalization and supervision of more and more types of manpower leasing. These numerous legislative interventions, in the absence of the revalorization of the incriminations, question the effectiveness of the criminal prohibition. Is criminal law still suited to fight against the excesses of labour leasing and subcontracting? Although the current repressive framework and its implementation are open to criticism, decriminalization alone is not the only solution

Texte intégralThe international law has finally a set of rules on the responsibility of the international organizations for internationally wrongful acts. After 10 years of work, the International Law Commission was able in 2011 to elaborate a draft articles codifying the rules on the matter. However the task was difficult: subject these entities, whose nature and functioning is different from States to a single set of rules in the field of international responsibility. The purpose of this study focuses on the work of codification made by the Commission in the draft articles. This is specifically to analyze the techniques of codification used by the Commission in the elaboration of the applicable rules: is it a codification sticto sensu of the practice or a creation of new rules under the "progressive development" of the international law? The answer to this question presupposes to define the sources of codification in each of the provisions of the draft articles concerned, wondering if it embodies a well-established practice of international organizations, or rather a transposition of the rules of the draft articles on States responsibility, adapted to the features of international organizations. At present the authority of the draft articles does not seem to have unanimity, and in this context, the present study on the relation between codification and progressive development in the codification work of ILC can appreciate the substantial own authority of each provisions of the draft articles. Especially that no one knows if a codification convention will be adopted, which will set the provisions of the draft articles up as legally binding norms

Texte intégralCriminal liability of technical intermediaries is a central and actual issue in the regulation of cyberspace. Not also their vast economic implications in the cyberspace are in question, but also their entire legal framework regarding criminal liability of technical intermediaries is an unresolved issue. This is because a liability allegation to the author for an illicit activity can be difficult or impossible thanks to the complex nature of cyberspace and the insolvent status of the technical intermediaries Considering their state of solvency and identification facility, taking legal actions against the technical intermediaries will be a conceivable solution to the jurists. Having implied legal proceedings, even the fact that a judicial action will be taken against them will prevent them from involving illicit activities. Non-existence of a liability regime which is specifically applicable to the technical intermediaries in the Canadian legislative corpus makes us obligated to apply to the «guiding principles» of imputability which can be released from several national and international texts. In this essay, we will study, at first, the conditions of applicability of the criminal liability for the technical intermediaries with regard to Canadian Criminal Law and, in second time, will answer the following question: Is Canadian Criminal Law complied with guiding principles arising from International norms and practice in terms of imputability of the technical intermediaries?
