Texte intégralThis thesis is a study of the housing transformations in Kyiv, Ukraine, after the end of USSR through the lense of political economy. Thus, the thesis explores the housing sector development in the context of post-Soviet peripheral capitalism focusing on real estate-finance-state interplay in the period from 1991 to the present. The study examines the processes of privatisation, commodification, financialisation and assetisation of housing in Kyiv since the demise of USSR. The form, spatial and historical dimensions of these transformations in Kyiv varied compared to Western and also to other post-socialist cases. These varieties are underpinned by the model of integration of Ukraine into the global economy, as well as by international and national power verticals and cultural context. Moreover, the transformation of housing finance, production and distribution was an actor driven process and the case of Kyiv reveals the conflicts, alliances and dependencies between international and domestic capital. Also the outcomes of the subsumption of housing by market differed from the broadly studied scenarios of gentrification, but took specific for the post-Soviet context form of socio-spatial polarisation. Another aspect of housing finance, production and distribution addressed in the thesis is the discourse on housing and urban space, which shows the ideological side of the housing transformation. Through study of city in the periphery of Europe the thesis, on the one hand, shows that housing commodification, financialisation and assetisation are global trends interconnected with the shifts of world capitalist economy, such as global financial crisis of 2008, and on the other hand, challenges the conceptualisation of these processes through the mechanisms and outcomes typical for Western societies, offering empirics on forms of commodification, financialisation, assetisation, as well as housing inequalities and violation of right to the city from Kyiv context.

Texte intégralA bathtub rises slowly, as pushed by the Mother Earth’s breath, from the bowels of a metallic hill near Zenica, in central Bosnia. A cargo of freshly extracted steaming coal is ready to be sieved, stowed in 50 kg bags, and loaded into an old Yugoslav army truck by the miners working outside. Here, from the depths of the earth where hundreds of Bosnian illegal miners find work, a thriving parallel coal trade is born, in order to feed stoves, boilers and kitchens for thousands of families across the country. This occurs in the total absence of contracts, any kind of safety regulations, insurance protections or guarantees for the workers. During the Tito period, this city was considered a «miniature Yugoslavia», a true model of real socialism, driven by both its steel mill (Željezara Zenica) and the metallurgical-mining industries (which employed more than 50,000 workers). Until the beginning of the nineties, the economic and socio-cultural environment was enhanced by the pervasive sense of sigurnost (security) and the confidence in the future, released by a work paradigm based on Samoupravljanje (Self-management). This was focused on the man-worker, an authentic symbol of progress and improvement of living and working conditions, which took place in the second post-war period. The dissolution of Yugoslavia and the consequent war led to the collapse of this life-system, known by the inhabitants of Zenica for 50 years. The steel mill and State mines workers were all expelled from the labor market without valid alternatives in terms of employment. They were also penalized by an economic context based on a single, great and bright direction: the “heavy” industry, fundamental and everlasting point of reference for thousands of workers and citizens. Considering the deep changes occurred in Bosnia and Herzegovina in the last few decades: how the lives of the Zenica (the "Incandescent City") inhabitants have been set up again from a working and social point of views? I tried to approach this question by analyzing the condition of the underground economy. During the last postwar period and throughout the structural adjustment plans in a neoliberal view (for example, the opening to the free market, privatization of social property, financial deregulation, de-unionization of companies), this hidden economy has gained a leading role in the entire Bosnian economic-productive landscape (Divjak & Pugh, 2013). Considering the ethnography and my experience working with the illegal miners in Zenica, I wanted to investigate the situation of the labor market (in particular illegal coal mining) and the related issues, such as unemployment, emigration, rights of workers, corruption, exploitation, gender, conflicts, cooperative methods and illegal production processes in this particular post-industrial, post-war and post-socialist context. The illegal "private" extraction of Bosnian black gold, together with my interest in issues like the complex and diverse economic-social and political-cultural framework of the Country, led me to the specific studies of the Artisanal and Small Scale Mining (ASM), from which the theoretical framework of this thesis is based. As the first European study project on ASM, this work does not have a literature background to rely on, therefore the theoretical framework will be inspired by different sources, without claiming to be exhaustive. My aim (and hope) is to contribute to the academic debate. Through ethnography, I am trying to explain the complexity of the new social and economic relationships connected to the changed life meanings in which the artisanal miners of Zenica are working now. Also, I want to present the future possibilities for the large world of illegal work, deeply linked to political and economic choices, not only local but especially the federal, national and global ones.

Texte intégralWith the ascension of national-socialism in 1933, a series of measures such as promulgation of laws and the creation of special courts were introduced in order to guarantee the maintenance and expansion of the regimes power. As an example of the use of nationalsocialism court system as a power tool and its consequences in the post-war period, in this research we highlight the testimony of two political victims of the People\'s Court, Hans Hirzel and Franz J. Müller. Both were part of the student resistance group known as The White Rose, which has contributed for the contestation of the validity of the criminal judgments issued in this period. We developed a study at the interface between the fields of History (HUDEMANN, 2014; BENZ, 2008; STEINBACH; TUCHEL, 2004; ARENDT, 1989, among others) and Law (SILVA, 2011; ALEXY 1997; STOLLEIS, 1994; HART, 1958; RADBRUCH, 1946; among others) having the Unrecht concept (Extreme Injustice) as the core concept. Based on the model of text analysis of Christiane Nord (2010, 2009), on Translation Studies, we highlight the relevance of interdisciplinary analysis of the communicative situation and the topic of the source texts for translation. We produce a bilingual edition of three documents that are relevant to approach the concept studied in this research. Our corpus consists of an official document sent in 1983 by the Justice Administration of the state Baden-Württemberg to Franz Müller; his testimony beside Hans Hirzel at the German parliament in 1984, which central topic is based on the validity of the law and the legal practices in the period of national socialism, and the Law of annulation of extreme national socialist injustice in the implementation of criminal law, from 1998, measure that cancelled retroactively criminal judgements issued by national socialist courts. These are documents that register part of the historical and legal path of correction of national socialist injustice in the post-war period. With this research, we intend to facilitate the access to researches from different areas of knowledge to this unreleased material in Portuguese about the validity of the Law legally produced in totalitarian periods.

Texte intégralThe concepts of imperialism and colonialism brought a reformulation of the theme colonization in all areas. Thus, it is important to distinguish that, though related, the methods used by “colonialism”, and “imperialism” are different. As Young refers, colonization presents itself in a pragmatic way and develops in a local and disordered way. On the other hand, imperialism has its basis in ideological principles and its implemented by a metropolitan center whose ambition is to affirm and expand itself. Hence, the investigation focuses on the relationship between Germany and Latin America, especially during the National-Socialist government. Attempting to substantiate a possible colonialist attempt from Germany towards Latin America. Thus, the investigation focuses on three areas that aid to the comprehension of the topic presented: the German stance on colonialism; the historical-cultural relationship between Germany and Latin America; and the influence of the German educational system in Latin America. So, it tries to understand if the position assumed by Germany on the Latin-American countries, were indicators of a pursue to colonize these countries. The investigation concludes that the German proximity to the South American continent was ambiguous. Whilst, Germany looked eager to colonize these countries, their practices did not resemble the ones used in East Europe. Also, the idea that such proximity was a strategy to gain foreign allies was not clear. Altogether, the investigation concludes the existence of a hybrid relationship between Germany and Latin America, which leaves room for further investigation on this topic.
