This thesis examines the relationships between popular contemporary musical styles and classic-era art music. Analysis of pop-rock songs, and their referential treatment in art rock, classical music, and society will be examined. Pop-rock musicians borrow from the masters of the past and from each other. Rock guitarists such as Eddie Van Halen employ a virtuosic technique suggestive of Liszt and Paganini. The group Rush borrowed freely from opera seria. Frank Zappa referenced contemporary musicians as well as classical techniques. Referential treatment in popular music and the recent advancements in technology, have challenged copyright law. How these treatments and technologies affect copyright legislators and musicians will be discussed.

The growing pandemic of diabetes mellitus (DM) is continuing to spread around the world with developing countries being most vulnerable. Diabetes mellitus is the direct cause of 5 percent of deaths worldwide at present, with an expected increase of 50percent in the next 10 years. Diabetes mellitus was virtually unknown in Africa at the start of the 20th century but the incidence is expected to increase by 80 percent by 2025. South African estimates indicate that at present there are up to four million people living with DM in South Africa, with an expected rise of 25 percent by 2020. If DM is not adequately controlled, life-threatening complications ensue, resulting in financial, physical and emotional costs both for people living with the condition and for their families. There is also a great financial burden on the state, both directly due to the cost of providing health care and indirectly due to loss of productivity and a reduced tax base. Global initiatives against DM include the Diabetes Strategy for Africa compiled by the International Diabetes Federation and World Health Organization. There are several forms of DM with Type 2 being the most common with an estimated 95% of cases. Optimal glycaemic control is essential for the management of DM, potentially allowing the course of the disease to be slowed or halted. The previous medical model of management of chronic disease has changed to an empowerment approach where the person living with the condition is a partner in the management process. This is particularly true of DM where all aspects of life are affected by the condition. During Phase One of this study, a qualitative, exploratory, descriptive, contextual approach was utilized to explore and describe the experiences of persons living with DM and of diabetes nurse educators who assist them in Nelson Mandela Bay. During Phase Two, a conceptual framework was created and utilized to develop strategies which professional nurses may use in facilitating self-management by persons living with DM. Persons living with DM experience a definite initial experience on diagnosis of DM but gradually gain an acceptance and acknowledgment of their condition. They have definite views on the concept of self-management and experience both positive and negative factors influencing self-management. They also have definite ideas on how professional nurses may assist them in achieving self-management. These findings were confirmed ii by the experiences of the diabetes nurse educators who formed the second group of participants in this study. The ACE approach to self-management of DM consists of an Action Strategy, a Coordination Strategy and an Education Strategy. The ACE approach makes use of grand and functional strategies implemented on the macro (national), meso (provincial) and micro (local) levels to enable the professional nurse to assist persons living with DM to achieve self-management of their condition. Grand strategies need to be implemented on a macro or meso level to enable the professional nurse to function effectively on a micro level. Assisting the patient has to go beyond merely improving knowledge about the condition but has to include individual goal setting as well as problem solving skills and coping strategies as part of a therapeutic relationship between the professional nurse and the person living with DM. The level of personal responsibility achieved by persons living with DM is affected by the memes which they hold regarding their level of health and their ability to address any barriers to self-management which they may experience. Making use of the process of the therapeutic relationship, the professional nurse is able to positively influence the memes held by persons living with DM and assist them in achieving a greater level of personal responsibility. The therapeutic relationship is potentially influenced by all three of the strategies described above. This study provides insight into the experiences of persons living with DM and of the diabetes nurse educators who assist them in Nelson Mandela Bay. Recommendations regarding the implementation of a National Diabetes Policy on a macro level are made, as well as recommendations for nursing practice, education and research. The strategies which were evaluated by an Expert Panel provide a tool for the professional nurse to use while assisting persons living with DM by facilitating the growth of personal responsibility leading to self-management.

This study provides a comparative analysis and performance suggestions for three Cirandinhas and three Cirandas for solo piano by Heitor Villa-Lobos in order to demonstrate their aesthetic and pedagogical value. The primary objective is to argue for the significance of the Cirandas as concert works and of the Cirandinhas as didactic ones. To better explore these two sets of pieces and their interconnections, the selected Ciranda-Cirandinhas pairs are all based on the same folksong theme. Thus, the analyses also demonstrate Villa-Lobos’s desire to represent Brazilian culture through his music and the ingenuity with which he treated the same melodic material within performative and pedagogical contexts. Heitor Villa-Lobos is recognized as the most significant creative figure in twentieth-century Brazilian art music and as one of the distinguished Latin American composers to date. His distinctive compositional style represents a thorough synthesis of influences from European art music with the African, Indo-American, and cosmopolitan urban idioms of Brazilian vernacular music. Villa-Lobos’s output comprises more than 2000 compositions in a wide variety of genres: symphonies, concertos, operas, chamber music, art songs, and solo piano music. Throughout his career, he was a devoted supporter of music education for young people and of the development of a distinctively Brazilian art-musical tradition. The Cirandinhas and Cirandas represent an intersection of these two concerns. This study will be meaningful to both performers and piano teachers, whom it will encourage to include Villa-Lobos’s works within their concert repertory or teaching curricula. The document includes an introduction, a brief contextualized biography of the composer, a comparative analysis of the selected Cirandinhas and Ciranda with performance suggestions that touches on stylistic, pedagogical, and technical features of the pieces; a conclusion; appendices that include a chronological list of Villa-Lobos’s piano works and the titles and translations of all the Cirandinhas and Cirandas; and a bibliography.

Resumo: Introdução: As úlceras ou feridas crônicas, são lesões de pele que não cicatrizam e que podem comprometer desde a epiderme até as camadas mais profundas, como músculos, tendões e ossos. Definir um tratamento ideal, ainda é um desafio. A cicatrização, envolve a adesão ao tratamento pelo paciente, a reação do organismo à proposta terapêutica, o comportamento do paciente em relação aos cuidados com a ferida, o manejo com o curativo e os aspectos gerais da manutenção de sua saúde. As demandas sociais, econômicas e culturais, geram fortes influências no tratamento das feridas e atrapalham indiretamente a cicatrização. Objetivos: Correlacionar fatores sócio demográficos e educacionais como preditores para a ocorrência de feridas crônicas, comparando-se indivíduos saudáveis com portadores de feridas crônicas. Casuística e Método: Foram utilizados dois questionários semiestruturados, distintos e customizados com dados sócio demográficos e aspectos da doença. Delimitou-se duas populações: Grupo 1 - constituído pela população geral saudável e o Grupo 2 - constituído por pessoas portadoras de feridas crônicas. Resultados e discussão: Os dois grupos conhecem algum tipo de tratamento caseiro para tratar feridas, contudo não detém conhecimento suficiente sobre feridas crônicas e das terapias convencionais prescritas pela medicina. Abstract: Chronic wound is still a challenge for medicine, either to define its cause and for selecting an optimal treatment. Healing is a long and complex process. It involves adherence to the treatment by the patient, the reaction of the organism to the therapeutic treatment, the patient's behavior regarding wound care, handling the dressing, and general aspects to maintain health, especially if there are other chronic diseases. Social, economic and cultural demands can also generate strong influences upon the treatment of wounds and healing process, since the population, in general, believes in myths, misconceptions and prejudices about wound healing, a knowledge that has been passed on empirically for generations, which may be harmless or extremely harmful. The objective of this study was to correlate socio-demographic and educational factors as predictors for the occurrence of chronic wounds, comparing healthy individuals with patients with chronic wounds. Two semistructured instruments were employed; a questionnaire, specific and customized, seeking socio demographic data, knowledge about chronic wounds, medical treatment of wounds, alternative and unconventional therapies and knowledge about bio-curative. Two populations were delimited: Group 1 - constituted by the healthy population, in general, and Group 2 - constituted by people with chronic wounds. The work of separation of recycled materials in the district of Tangará da Serra is a practice that accompanied the birth and development of the city. With passing of the years it is noticed the presence of the interest of the public power and the community in relation to the importance of the reciclagem work developed in the municipal district in the socia aspects, environmental and generation of income. Starting from the need of the construction of the Municipal Sanitary Embankment, the interest with relationship to the workers that made the separation of the domestic garbage, was still individually more evident. In that sense, the general objective of the work was:contribute to building knowledge about the process of transition from individual work to the collective work in the sector of solid waste collection. The specific objectives were: understand the creation and the development of COOPERTAN in the district of Tangará da Serra-MT, analyze the development of the collective work process in COOPERTAN, make a comparative between the individual work and the collective work in the district, understand how the workers of COOPERTAN notice the differences between the individual work and the collective work after the formalization of the cooperative and to identify the strong points and the challenges for the cooperative. The used methodology was the participant research, through accompaniment of the work, meetings, assemblies and the formation of the group in the thematic of cooperatives in selective collection of the domestic garbage and organization of the work. The research demonstrated fragility and difficulty of collective organization and lack of technical formation of the workers. It was also noticed difficulties of the supporting institutions act with coherence, according to the needs and the specificities of the analyzed group. It is worth to point out that, in spite of so many difficulties in that resource, the great majority of those cooperated, mainly the founders that continue in the group, like what they do, they feel pride of the work and they present great expectation and persistence in the search of the autonomy and good results of the enterprise.
O trabalho de separação de materiais recicláveis no município de Tangará da Serra é uma prática que acompanhou o nascimento e desenvolvimento da cidade. Com o passar dos anos percebe-se a presença do interesse do poder público e da comunidade em relação a importância do trabalho de reciclagem desenvolvido no município nos aspectos sociais, ambientais e de geração de renda. A partir da necessidade da construção do Aterro Sanitário Municipal, o interesse quanto aos trabalhadores que faziam a separação do lixo doméstico, ainda individualmente, ficou mais evidente. Nesse sentido, o objetivo geral do trabalho foi: contribuir para a construção do conhecimento sobre o processo de transição do trabalho individual para o trabalho coletivo no segmento de coleta de resíduos sólidos. Os objetivos específicos foram: entender como ocorreu à criação e o desenvolvimento da COOPERTAN no município de Tangará da Serra-MT; analisar o desenvolvimento do processo de trabalho coletivo na COOPERTAN; fazer um comparativo entre o trabalho individual e o trabalho coletivo no município; compreender como os trabalhadores da COOPERTAN percebem as diferenças entre o trabalho individual e o trabalho coletivo após a formalização da cooperativa, identificar os pontos fortes e os desafios para a cooperativa. A metodologia utilizada foi a pesquisa participante e estudo de caso, através de acompanhamento do trabalho, reuniões, assembléias e a formação do grupo nas temáticas de cooperativismo em coleta seletiva do lixo doméstico e organização do trabalho. A pesquisa demonstrou fragilidade e dificuldade da organização coletiva e falta de formação técnica do coletivo. Notou-se também dificuldades das instituições apoiadoras agirem com coerência, conforme as necessidades e as especificidades do grupo analisado.Vale ressaltar que, apesar de tantas dificuldades nesse percurso, a grande maioria dos cooperados principalmente os fundadores que continuam no grupo gostam do que fazem, sentem orgulho do trabalho e apresentam grande expectativa e persistência na busca da autonomia e de bons resultados do empreendimento.

This study aims to examine the trajectory of sex offenders through the Lebanese criminal justice system while highlighting various human rights violations. It attempts to fill in the gaps within the literature through building on the existing research and by examining the processes and experiences of arrest, detention, court, prison and release. Recently, numerous scholars have argued that most criminal justice systems are following a popular punitive trend rather than focusing on rehabilitation. This study through its focus on human rights violations, participants attitudes and beliefs as well as issues of rehabilitation and treatment of prisoners firmly places Lebanon within the global trend of popular punitiveness. Seventy-three interviews were carried out with sex offenders, police officers, prison guards, judges and lawyers within Lebanon. These qualitative interviews captured criminal justice professionals and offenders experiences, attitudes and perceptions surrounding sex offending and the criminal justice system. The thematic analysis of the interviews specifically focused on uncovering how sex offenders moved through and were dealt with by the Lebanese criminal justice system. Human rights violations were found to be abundant at the various stages of the criminal justice system. Participants highlighted events such as the excessive use of torture within police stations as well as prisons, the use of forced confessions, and the lack of legal representation. Numerous factors were found to play a role in conceding the copious violations of sex offenders rights occurring at the various stages of the criminal justice system. These factors included corruption, the lack of accountability, police culture, the commonly held belief that offenders are undeserving of human rights, the lack of training, and religion. In investigating the structure and the functioning of the criminal justice system, it became evident that religion played a vital role. Religion dictated professionals positions within the criminal justice system and influenced participants beliefs and attitudes surrounding sex offenders. Because of its influence, religion played a vital role in paving the way for the re-occurrence of human right violations. For example, religion granted the criminalisation of homosexuality and the act of de-virginizing as well as legalising marital rape, all of which result in human rights violations. In order to move Lebanon, and other punitive countries, towards a more rehabilitative criminal justice approach, this study highlights the importance of training, change in legislation, as well as the separation of religion from law.

En dépit des atteintes graves qu’il porte à l’ordre social, la vindicte populaire n’a jamais fait l’objet d’une étude juridique approfondie pour recevoir la réponse pénale adéquate. En effet, si le phénomène mobilise les chercheurs au-delà des sciences juridiques, il n’y a pas d’études juridiques spécifiques sur la question. Pourtant, le phénomène vindicatif persiste, évoluant d’ailleurs de la forme physique vers la forme numérique, avec pour conséquence une augmentation considérable du nombre de victimes, signe d’une délinquance de plus en plus importante. Toutefois, en l’état du droit positif, les contours, les manifestations, les modes d’expression et les motivations de cette forme de délinquance sont jusque-là indéterminées. Or, les pouvoirs publics ne peuvent combattre efficacement un phénomène criminel dont ils n’ont pas la maitrise. Notre recherche s’est donc évertuée à étudier les rapports que le droit pénal entretient avec la délinquance vindicative. Elle propose un diagnostic puis des pistes de réflexion en vue d’un traitement pénal de la vindicte populaire. Il a été constaté que l’épreuve entre la vindicte populaire et le droit pénal est sulfureuse et rude, très riche mais très intrigante : c’est une liaison dangereuse. Plus concrètement la vindicte populaire s’exprime face au droit pénal et le droit pénal la réprime à son tour. Dans son expression, il ressort de notre étude, qu’à l’instar de la covid 19, le virus de la vindicte dont souffre le corps social renferme de multiples variants, ce qui rend sa compréhension et son appréhension difficile. Les modes d’expression de la vindicte populaire ont été donc identifiés, une définition proposée et des moyens de prévention identifiés. Dans son élan de répression, face au phénomène vindicatif, le droit pénal peine à trouver ses repères. Il a essayé non sans difficulté d’endiguer le phénomène en procédant autant par adaptation que par innovation. Mais les outils utilisés en l’état son peu efficaces. C’est donc un droit pénal timide qui subit les assauts d’une vindicte dynamique, protéiforme et mutante. Il a été suggéré de repenser la réponse pénale en érigeant la vindicte populaire en incrimination spéciale avec un régime spéciale de responsabilité
In spite of the serious attacks on the social order, mob justice has never been the subject of an in-depth legal study in order to receive the appropriate penal response. Indeed, although the phenomenon mobilizes researchers beyond the legal sciences, there are no specific legal studies on the issue. However, the vindictive phenomenon persists, evolving moreover from the physical form to the digital form, with as a consequence a considerable increase in the number of victims, a sign of a more and more important delinquency. However, as far as positive law is concerned, the contours, manifestations, modes of expression and motivations of this form of delinquency are still undetermined. However, the public authorities cannot effectively combat a criminal phenomenon that they do not control. Our research has therefore endeavored to study the relationship that criminal law has with vindictive delinquency. It proposes a diagnosis and then lines of thought for a penal treatment of popular vindictiveness. It has been noted that the test between popular vindictiveness and criminal law is sulphurous and rough, very rich but very intriguing: it is a dangerous connection. More concretely, popular vindictiveness expresses itself in the face of criminal law and criminal law represses it in its turn. In its expression, it emerges from our study that, like covid 19, the virus of vindictiveness from which the social body suffers contains multiple variants, which makes its understanding and apprehension difficult. The modes of expression of popular vindictiveness have therefore been identified, a definition proposed and means of prevention identified. In its drive to repress the phenomenon of vindictiveness, criminal law is struggling to find its bearings. It has tried, not without difficulty, to curb the phenomenon by adapting as much as by innovating. But the tools used at present are not very effective. It is thus a timid criminal law that is undergoing the assaults of a dynamic, protean and mutant vindictiveness. It has been suggested to rethink the penal response by making mob justice a special incrimination with a special regime of responsibility

This study reintroduces the early-twentieth-century Austrian author Gustav Meyrink (1868-1932) and situates his literary oeuvre at the intersection of literature, religion, and popular culture. This once widely popular satirist, fantasist, and occultist, most commonly remembered for his best-selling novel Der Golem (1915), has received only limited attention from the scholarly community in recent decades. But Meyrink's philosophical essays demonstrate contemplative interaction with questions of spirituality in the scientific and industrial age worthy of further consideration, and these topics, although obscured, are also manifest in his fiction. A practicing occultist highly revered for his esoteric knowledge, Meyrink recognizes the turn-of-the-century occult revival as a justifiable reaction to religious concerns generated by the crisis of modernity, as well as an integral element of European popular culture. In implementing his vast knowledge of esotericism, Meyrink purposefully manipulates occult material in his fantastic works with the result that he effectively demonized certain spiritual notions otherwise deemed essential to attaining spiritual enlightenment. Disenchanted with what he perceives to be the trivialization of occultism initiated by the melding of this brand of spirituality and popular culture, Meyrink's fiction demonizes esotericism by shrouding occultists and their rituals in negative, demonic, and monstrous imagery. In so doing, Meyrink depicts the serious ramifications of unsound and ill-fated occultist practices. Meyrink wishes to send his readers a spiritual message cautioning them against falling victim to erroneous teachings and fraudulent spiritual guides during a time when these risks rapidly increased due to the growing popularity of occultism in Europe. Yet, despite their obvious criticisms of popular occultism, Meyrink's works also promote the benefits of esotericism in the modern era. In a display of the tensions inherent in cultural modernism, Meyrink's seemingly regressive representation of esotericism is actually an attempt to showcase religious currents as progressive belief systems better suited to serve the needs of a scientifically and technologically advanced society.

Leadership is an important theme of social science as it relates to human cooperation from household decision-making to the complex management of organisations and states. In organisations a great place to work is where employees trust their leaders and are respected and valued as human beings. The employees’ treatment with dignity and respect should not be compromised. Therefore, leaders’ ethical and fair treatment of employees is very important as unethical and unfair treatments can negatively impact on the workplace, individuals and their families, and society. This study extends knowledge on the importance of leader–employee relationships. It highlights the impacts of leaders’ unethical and unfair behaviours and practices on workplaces. It does so through examining leadership literature related to ethics and fairness. Additionally, it conducts sixteen confidential individual interviews with leaders and employees currently working at different levels in the private sector, not-for-profit organisations and government sector, including parliamentarians/politicians. This study considers the important factors (power, self-interest and trust) impacting leader–employee relationships and examines popular leadership styles such as ethical, spiritual, authentic, transformational, servant leadership and responsible leadership. As most of these leadership styles do not adequately address the concerns of leaders’ unethical and unfair behaviours and practices, the author saw it necessary to propose a new concept of leadership called cosmetic leadership. While cosmetic leadership is a new concept and to date has not been mentioned in leadership literature, this study considered different circumstances aiding this type of leaders to become leaders in the first place and then continue with their behaviours. The proposal of cosmetic leadership highlights some of the reasons for leaders’ unethical and unfair behaviours and practices. Further, this prompts the policy-makers to assess the effectiveness of their guiding principles, such as codes of conduct. Finally, the author trusts this study’s discussions will benefit the leadership literature and leader–employee relationships for the better.

Résumé :
This dissertation deals with the issue of smoking. Its practical part specifies several objectives, one of them being finding out whether the prevalence of smoking within the population is dependant upon the attained qualifications. Establishing the respondents{\crq} views on the harm of smoking is another goal. The approach of the respondents towards a smoking ban in restaurants is demonstrated in this dissertation, so is their awareness of quitting-smoking methods. The decision to give up is also affected by the knowledge and understanding of all the risks bred by smoking, therefore determining the level of the respondents{\crq} awareness of these health risks is another aim of this dissertation. A quantitative research was used in my dissertation to obtain results. A questionnaire of 18 questions was answered by 211 addressed respondents being in the age group of 45-60 years of age. Analysing the outcome it can be said that the prevalence of smoking within the population is not dependant upon the attained qualifications. Nicotine dependence is referred to as a disease therefore the risk of developing an addiction is the same for everyone irrespective of the qualifications accomplished. Nonetheless, the outcome manifests the fact that smokers with lower qualifications smoke a higher amount of cigarettes a day as opposed to smokers with higher qualifications. Considering the results it can be, furthermore, assumed that smokers with lower qualifications are more tolerant towards the nicotine addiction and they feel less unpleasant in a smoky environment. Moreover, their favour for a smoking ban in restaurants and at working places is lower. At the same time, their awareness of possibilities to treat their nicotine addiction as well as of the negative health effects of smoking proved to be lower. Most smokers would like to quit their nicotine addiction (app. 50% lower- qualified individuals and 72% university and college graduates). However, only a very small percentage would seek any professional help when giving up smoking. The unwillingness to treat the nicotine addiction with the help of an expert reflects the unawareness of the severity of such addiction by the smokers themselves. Therefore, the prevention aimed at non-smokers is as important as effecting smokers so that they become more aware of the seriousness and vast consequences of their addiction.

This diploma thesis deals with the experience of adult population with unconventional medicine. The thesis is conceived in two parts. The first part focuses on the theoretical definition of problems and familiarization with terms, the second part is research. The theoretical part is divided into several subchapters. The first is dealing with unconventional medicine. It describes the historical context from prehistoric times to present. Furthermore, the problems and pitfalls of today's medicine and its complementary existence. Diagnostic, therapeutic and self-help methods of alternative (unconventional) medicine are described in the next part. The practical part maps the experience of the adult population with unconventional medicine, the health problems for which the treatment is sought. It also identifies the type of therapy chosen and the motivation for choosing it. It also maps subjective success in treatment. The research in the practical part is done quantitatively by the anonymous questionnaire method.

v anglickém jazyce: Incidence and management of muscle imbalances in physically active and inactive populations: Objective rehabilitation solutions for populations with nonspecific back pain Summary Totally 258 patients with chronic low back pain aged 51,5 +8,4 years were treated for three weeks in the Rehabilitation Centre focused on lumbar back pain. We observed incidence of muscle dysbalances and accomplished their exact objectiveness using the Tergumed system. We tried to compare and solve their mutual influence during the rehabilitation treatment. We compared differences between physically active and physically inactive population, the impact of total motivation,age and other factors on the improvement of strenght, motion, dysbalances and total pain relief.Significant improvement of movement and muscle strenght p <0,001 were documented on the Tergumed in three weeks.The physically active population and patients motivated.by using the Tergumed preferred active exercises to passive therapy. We also observed improvement in finger-floor distance and reduction of pain, documented by the visual analogue scale, decrease in body weight and cholesterol level (p <0,001).
