Sharing substitutes private rights to a collectiveownership over an asset or set of assets which is split.Joint possession is shown traditionally as a transient state, a bad state which must be ended.Legal regulations specific to sharing have subsequently been implemented; recorded taxationhas ensured that these regulations are supported.Today, sharing is conceivable as a value. Sharing regulations have therefore developed.This development is not apprehended by tax legislation. The processing of balances, reducedcompensation or reported compensation is sometimes disputable.In addition, the tax office still maintains the distinction between pure and simple sharing andsharing with a balance, a distinction which bears no consequence in civil law, and which is nolonger justified today.Sharing has a declarative and retroactive effect. Each one of the allottees is considered to havebeen the sole owner of the asset put into their lot.The individuals’ capital gains system is modelled on this analysis, which consequently,throws caution to the wind, and balances or compensation which are paid by the allottee of theasset. The legal analysis of the sharing ignores the economic aspect of the sharing.As regards taxation on work, the regulations are complex and disparate, not necessarily basedon the legal analysis; the tax processing of the sharing is then all the more complicated

Texte intégralSustainability issues are increasingly influencing customer behavior and corporate strategy. Consequently, the optimization of distribution networks through horizontal collaboration is becoming a necessity. After a comprehensive review of the literature, we found that most studies proposing quantitative approaches address the operational decision level through the optimization of transport planning. Therefore, in this thesis we deal with both strategic and tactical decision levels. The first level is studied by the collaborative distribution network design problem, while the second level is studied by the cost and CO2 emission allocation problem. Furthermore, we believe that reducing all sustainability dimensions to a single objective is not desirable. In this context, we address both problems by taking into account economic, environmental and social sustainability. We have developed mathematical models to design two- and three-echelon distribution networks. In addition, the inclusion of sustainability indicators in the profit-sharing process makes it possible to reward partners who best contribute to sustainability. In this context, we have developed two approaches that use the levels of sustainability and flexibility of each partner in order to distribute the benefits of the collaboration in a fair way. Furthermore, several scenarios are compared on the basis of the proposed indicators. Regarding the resolution of the mathematical models, the single-objective optimization is carried out in an exact way and by using the genetic algorithm and the simulated annealing, while the multi-objective optimization is carried out by the ε-constraint method and the NSGA-II. The results and analyses obtained show that collaboration always provides better performance compared to non-collaboration on all sustainability levels. Several managerial decisions are presented to properly apply horizontal collaboration and further improve its sustainability performance

Texte intégralThis doctoral thesis aims at investigating how the social context and the characteristics of individuals influence their Fairness-Related Decision Making. To this end, we used different approaches from neurosciences, social psychology and experimental economics.In a first study, we examined the electrophysiological correlates associated with economic decision-making in an ultimatum game simulating a situation of exclusion and inclusion. The results showed that participants accepted unfair offers more frequently from the proposer when they were intentionally selected by the proposer than when they obtained the same offers by being randomly paired to proposer by a computer. Electrophysiological analyzes revealed amplitude modulations of the FRN, P200 and P300 associated with Fairness-Related Decision Making in a context of social inclusion/exclusion. The purpose of our second study was to determine whether participants preferred to establish economic interactions of a prosocial or strategic nature when they had the opportunity to select their economic partners (responders) in an ultimatum game simulating a biological market. The results revealed that participants had preferences for prosocial economic interactions when social information is provided to them and when they are allowed to choose their economic partners based on this information. Gender information was also found to influence the participants’ decisions depending on their gender, but also their level of sexism and their representation of gender inequalities. The third study was designed to investigate the disadvantageous and advantageous inequity aversion of young and older adults. The results showed that young adults behaved in a pro-social way by equalizing their payoffs and those of the other player. In contrast, older adults behaved in a proself way, by preferring the options that maximized their payoffs, so that their behavior reflected less aversion to advantageous inequity compared to their younger counterparts
