The P.A.C.E. operational methodology presented here is designed to assist subordinate crew members in resolving the basic question of the junior airman: “To Intervene or Not to Intervene?.” The P.A.C.E. system has unraveled “The Copilot's Catch 22: You are damned if you ignore the Captain's mistakes; you are damned if you do something about them.” The four operational procedure steps of P.A.C.E. establish a systematic intervention progression of inquiries to reduce risks at each level of the sequence. The P.A.C.E. skills enable subordinate flight crew members to use proven operationally based procedures to effectively intervene when a Captain is not performing up to reasonable professional standards. P.A.C.E. procedures have been developed from case studies of voice recorder transcripts of National Transportation Safety Board aircraft accident reports. The P.A.C.E. methodology provides the skill and knowledge to implement new, operationally relevant components into Crew Resource Management training for each individual organization.

In the article have been analyzed the features and the criminal threat of an offence of conducting business activity on the premises of the Extermination Memorial or its protection zone without the required consent, specified in Art. 19 § 1 of the Act on the protection of the areas of former nazi death camps (p.a.d.c.). In this context – the issues of the subject of protection, verb feature, economic activity and its regulation-rationing, object, objective side, place of committing the offense, criminal threat – are raised. The economic activity, referred to in Art. 19 § 1 p.a.d.c., is an organized gainful activity that is carried out on one’s own behalf and on a continuous manner. This activity may take a limited form, defined in Art. 8 § 1 p.a.d.c. This offense: may be committed intentionally or unintentionally, has common and formal character. The perpetrator of this offense is subject to a fine, which may – exceptionally – be replaced by socially useful work or a penalty of arrest.

O texto apresenta dados de pesquisa em curso cujo objeto de estudo é a educação especial e de jovens e adultos, entendida como parte do direito à educação para todos. Problematiza como os estudantes, à luz das desigualdades e preconceitos que marcam suas vidas, foram impediram de gozar de seu direito. Esses estudantes, Público-Alvo da Educação Especial (P.A.E.E.) e da Educação de Jovens e Adultos, vivenciam grandes dificuldades em razão dos desdobramentos produzidos pelas Políticas Educacionais no Brasil. O texto discute a Base Nacional Comum Curricular (BNCC), especificamente a forma como a EJA e os estudantes P.A.E.E foram excluídos do debate, o que nos leva à seguinte questão: a quem serve de fato a BNCC? Por fim, apresenta exemplo de prática pedagógica curricular, planejada por professores críticos e mostra como a referida prática se tornou instrumento de luta e resistência para os alunos.

A Private Finance Initiative (PFI) is a way of establishing Public-Private Partnerships (PPP) by funding public infrastructure projects with private capital investment. The election in 1979 of a Conservative government under Margaret Thatcher marked the start of a still-continuing shift of activities away from the UK public sector. PFI was implemented in the UK for the first time in 1992. HCP is an award winning PFI asset-management company and, as part of the EngD course, the researcher has spent a large amount of time based at HCP. HCP stands for Healthcare Projects, and this thesis presents an alternative, combined-methods research approach to one of the most mechanically complex asset types under HCP’s management, in its largest healthcare facility. The research presents a risk-based approach to the operational lifecycle planning of 113 air-handling units at a central London hospital. The two components to the project are engineering risk (How likely is the asset to fail?) and contractual risk (What are the financial implications of such a failure?). Currently, these assets are modelled by HCP on a ‘strategic’ level, but using CIBSE- recommended guidance and part-failure data collected from six other UK-based hospitals, the Physical Asset Lifecycle Model (PALM) produces a funding profile for the replacement of the 1,247 internal components, as opposed to 113 bulk assets. The numerical model has also been visualised through the extraction of 3D BIM geometry into a geometrical-modelling tool (Rhino5) and computational plug-in (Grasshopper) to connect to the lifecycle model and visualise the replacement strategy proposed. The qualitative part of the combined-methods approach involved interviewing HCP Management board members as to their views on the models. The current profile adopted by HCP for the management of the air-handling units involves a £6.045m spend during the remaining 33-year concession period. The main findings of the PALM lifecycle model are that, based on a component-level replacement approach, this figure can be reduced by more than £1m based on a recommended replacement profile (£4.709m). Such a reduction can be based on how HCP currently manages its assets, and the engineering survey conducted showed that three air-handling units currently being life-cycled by HCP either had no components or were decommissioned prior to construction. The main findings of the PALM geometrical model (based on thematic-interview analysis) are that such a tool has largely been unseen in the industry before and it displays major translatability to other complex mechanical assets with component parts. It can also be integrated into HCP business propositions for new and existing clients in the future because of its clarity and ability to produce transparent lifecycle modelling from a decision-maker’s point of view. The research concludes that while the PALM model provides a glimpse as to how lifecycle modelling may be conducted in the future, a number of barriers to its implementation remain (namely data availability in a competitive environment, the time versus income generated business-case paradigm and a generational ability to change and accept technological advancements amongst senior decision-makers).

Le Code civil permet à ceux qui souhaitent partager leur existence d'opter pour l'une des voies suivantes : vivre en concubinage, conclure un P.A.C.S. ou s'unir par le mariage. Tout à fait distinctes en 1999, ces trois formes de conjugalité sont de plus en plus souvent appréhendées de façon unitaire par la règle de droit, au point de pouvoir évoquer l'émergence d'un véritable droit commun des couples. Cette tendance à l'harmonisation, voire à l'uniformisation, a été clairement perçue par la doctrine et a été expliquée de plusieurs façons. Témoin d'une emprise des principes d'égalité et de non-discrimination pour les uns, ce droit commun s'expliquerait, pour d'autres, par la prise en compte de la seule communauté de vie. Ces explications nous ont toutefois semblé insatisfaisantes et c'est en observant les rapports entretenus entre couple et politique que cet élan unificateur nous a paru compréhensible: le droit commun des couples existe en raison de l'utilité qu'il présente pour la réalisation des fonctions étatiques, qu'il s'agisse de ses fonctions sociales ou économiques. De lege Lata, la règle de droit, moyen d'action du politique, ne reconnaît donc les couples unitairement que si cette appréhension est utile à l'Etat. Cette utilité est toutefois perçue ponctuellement, ce qui conduit à un droit commun lacunaire, construit par strates successives et incohérentes. Une réflexion d'ensemble sur l'utilité des couples pour la mise en œuvre des fonctions étatiques, associée à la défense essentielle d'une préservation · : du pluralisme, permettrait de reconstruire, de lege ferenda, un droit commun des couples plus cohérent et plus logique
The civil code allows those who wish to share their lives to choose one of the following ways: to live a concubines, sign a P.A.C.S or to be united in marriage. Distinctly different from each other in 1999, these thee forms of union are more and more similar under the rule of law to the extent that a true common law for couples seems to have emerged. This trend towards harmonisation and standardisation was clearly perceived by the doctrine and was explained in several ways. Proof of the influence of the principles of equality and of non-discrimination for some, this common law would be explained by others as the taking into account of the only lifepartnership. These explanations seemed unsatisfactory to us and it was in observing the relations between couples and politics that this unifying momentum seemed comprehensible to us: the common law of couples exists due to the utility that it presents to establish state functions, whether they be social or economic. De lege lata, the rule of law, the means of political action only recognizes couples individually if this apprehension is useful to the State. This utility is perceived from time to time, which leads to a Jack of common law, built by successive and incoherent levels. A review of the usefulness of couples for the implementation of state functions, in association with the essential protection of the preservation of pluralism, would allow for the reconstruction, de lege ferenda, of a more coherent and more logical common law for couples

In the financial market usually notices are taken of the shares sequentially over the time in order to characterize them a time series. However, the major interest is to forecast the behavior of these shares. Motivated by this fact, a lot of models were created based on the past information considering constant averages and variance over time. Although, in financial series a feature often presented is called volatility, which can be noticed by the variance to vary in time. In order to catch this characteristic were developed the models of the family GARCH, that model the conditional variance through known information. These models were well used and have passed by many formulation modifications to be able to catch different effects, such as the effect leverage EGARCH. Thus, the goal is to estimate volatility patterns obeying the specifications of the family GARCH verifying which ones of them describe better the data inside and outside the sample.
No mercado financeiro costuma-se fazer observações sobre as carteiras sequencialmente ao longo do tempo, caracterizando uma série temporal. Contudo, o maior interesse está em prever o comportamento destas carteiras. Motivado por este fato, foram criados muitos modelos de previsão baseando-se em observações passadas considerando a média e variância constantes no tempo. Porém, nas séries financeiras uma característica muito presente é a chamada volatilidade, que pode ser observada pela variância não constante no tempo. A fim de captar esta característica, desenvolveram-se os modelos da família GARCH, que modelam a variância condicional através de informações passadas. Estes modelos foram muito utilizados e sofreram muitas modificações nas formulações para poderem captar diferentes efeitos, como o efeito de leverage (EGARCH). Assim, deseja-se estimar modelos de volatilidade obedecendo às especificações da família GARCH, verificando quais deles descrevem melhor os dados dentro e fora da amostra.

Résumé :
Introducción: En 2019 se creó un recurso asistencial para patología dual en la provincia de Salamanca; un modelo de tratamiento integrado, multidisciplinar, de segundo nivel y con un afán de ser un nexo de unión entre los recursos de la red de salud mental y la red de drogodependencias. Se presenta los datos descriptivos del nuevo Programa Ambulatorio de Patología Dual (P.A.P.D) tras casi 2 años de desarrollo. Objetivos: Exponer de los primeros datos descriptivos del programa centrándonos en las características sociodemográficas, valorar la demora en la atención inicial, identificar los recursos derivadores, valorar la adherencia, describir los principales diagnósticos duales para detectar mejoras. Material, métodos: La muestra la conforman 47 pacientes aceptados del P.A.P.D. del Complejo Asistencial Universitario de Salamanca. Se realizó una entrevista semiestructurada desarrollada por el equipo multidisciplinar. Resultados: El 65,95% de la muestra son hombres, el 34,04% mujeres. La media de edad es 34,3 años. Se tardan 7,1 días en atender en 1ª consulta. Se deriva ligeramente mas desde la red de salud mental. Un 10,6% no acude a la primera cita; a la 4ª semana se observa una tasa de abandono del 14,89% y a las 16 semanas hay una adherencia del 51,1%. Los diagnósticos mas frecuentes son la esquizofrenia, los trastornos psicóticos inducidos y los trastornos de personalidad, respecto a consumo de sustancias; cannabis y cocaína son los mas comunes. Conclusiones: Los pacientes que acuden a un programa ambulatorio de patología dual son jóvenes y predominantemente hombre. La espera para la primera consulta es adecuada a las exigencias de los parámetros del servicio con 7,01 días. A las 12 semanas la mitad de los pacientes permanecen en el programa, siendo uno de los factores a mejorar. Es mas frecuente diagnosticar trastornos relacionados con la psicosis y el consumo de cannabis, cocaína y ansiolíticos.
