This research aims to fill a void in the extant policy implementation literature that has overlooked the leadership contribution of sergeants to the successful adoption of policy decisions by front-line police officers. Using a qualitative approach and a sociological institutionalism perspective, and focusing on the racial profiling policy of a large North American municipal police organization, 17 sergeants representing 17 divisions (precincts) were interviewed. This research does not aim to assess the efficacy of the selected policy but, rather, examines leadership and supervisory perspectives relating to implementation and compliance. The findings demonstrate the methods used by sergeants to influence and achieve the compliance of front-line police officers with the racial profiling policy. Methods include auditing, being present, training, encouraging, rewarding, and disciplining. To explain these methods, it is theorized that sergeants blend two leadership approaches to ensure front-line officers conform to the racial profiling policy: an authoritative leadership approach and a supportive leadership approach. This study emphasizes the leadership contributions of sergeants when attempting to implement perceived controversial or unpopular policy—in this case, racial profiling policy—in a police organization and contains implications for law enforcement leaders, oversight committees, policy writers, and all government legislators who oversee public safety and security.

Purpose – The purpose of this paper is to examine the impact of sergeants’ less lethal force policy perceptions on subordinate officers’ policy perceptions. Sergeants are a critical level of supervision in police departments with respect to policy administration, particularly in regard to the use of force. Little empirical research, however, has been conducted on either officer policy perceptions or this aspect of the supervisory role. Design/methodology/approach – Surveys of 765 patrol officers and 146 patrol sergeants served as the data source. Multilevel modeling procedures were used to test for supervisory influences on officer force policy perceptions while controlling for relevant officer-level variables. Additional analyses were conducted to examine potential moderating effects for this sergeant-officer attitudinal relationship. Findings – Findings revealed that sergeant policy perceptions, views of top management, and their level of support had a significant impact on officers’ force policy perceptions. Furthermore, post hoc analyses revealed that sergeant support moderated the sergeant-officer force policy perception relationship. Research limitations/implications – The results indicate that officers’ force policy perceptions are associated with the attitudinal dispositions of sergeants. Future work could expand the focus on administrative attitudinal outcomes beyond less lethal force policies as well as other perceptions of the work environment. Practical implications – For police leaders, the findings illustrate the need to pay attention to mid-management levels and the organizational climate, as negative orientations can impact additional domains (i.e. policies and procedures) and other organizational members (i.e. subordinates). Originality/value – The study adds to the limited body of research on two accountability mechanisms of departments: administrative rulemaking and frontline supervision.

The article examines the process of reforming the law enforcement system in Ukraine, in particular the creation of the National Police in 2015, and its impact on the rank system of police officers. Special attention is paid to the main changes that occurred as a result of this reform. In particular, such positive aspects as bringing police standards closer to the European level, as well as creating a new police uniform and changing the rank system are highlighted. It is important to note that the reform is aimed at improving the efficiency of law enforcement agencies and their interaction with the public. The article also highlights the problem of the lack of additional ranks and limited career opportunities for junior police officers, which can lead to professional burnout and reduced staff motivation. An analysis of the positive experience of using the extended rank of junior and sergeant ranks in countries such as Canada, Germany, Greece, Spain, as well as the states of Virginia and Delaware in the USA is conducted. The proposed ways of solving the shortcomings in the rank system are aimed at improving the working conditions and motivation of the police personnel. In addition, it is proposed to introduce new ranks for junior and non-commissioned officers of the police in order to stimulate further self-development of professional skills and career growth prospects. In addition, each new rank will have separate duties and functions that will facilitate mutual assistance and cooperation with other police officers. It is also important to emphasise the need to update the design for cadets of higher education institutions with specific learning conditions and lyceums.

Restorative justice-based criminal policies within the framework of criminal justice which has legal certainty carried out by Polri (Indonesian National Police) are implemented through Penal and non-Penal policies. Penal policies are carried out by investigators as the function of law enforcement, and non-Penal policies are carried out by bhabinkamtibmas (a police sergeant assigned to take care problems related to laws in a village or sub-district) as the function of pre-emptive efforts and patrol unit as the function of preventive efforts.Overcoming crimes based on restorative justice intent to solve problems of society in such a way. The problems can be resolved using the principle of restorative justice, that is, the sense of justice for each party involved in the problems can be realized. Such overcoming involves victims, perpetrators, victims' families and the community as well as the relevant parties in order to reach a fair agreement and settlement.The research focuses on restorative justice in Polri. Meanwhile, the problem questions of the research are: (1) How is the construction (ius constitutum) of crime prevention policies based on restorative justice within the criminal justice framework that has legal certainty? (2) How is the implementation (ius operatum) of crime prevention policies based on restorative justice within the criminal justice framework that has legal certainty? And (3) How is the reconstruction (ius constituendum) of crime prevention policies based on restorative justice within the framework of criminal justice with legal certainty?The research employs the normative juridical approach. The research employs secondary and primary data. Secondary data is obtained by conducting library research and documentary studies, and primary data is obtained by conducting interview studies. Data is then analysed using the mix method (quantitative and qualitative).The results of the research reveal that (1) the construction of crime prevention policies is seen from a philosophical aspect based on Pancasila values and the principles of restorative justice; from a juridical aspect by taking into account legal norms originating from abroad, customary law, Islamic law, and national law, all of which are rooted in Pancasila values; from a sociological aspect that it needs the active participation from the community in supporting the crime prevention based on restorative justice, (2) the implementation of crime prevention policies based on restorative justice using Penal and Non-Penal carried out by the investigative function, bhabinkamtibmas and patrol units, to parse and resolve existing problems in society, and (3) the reconstruction of crime prevention through substance aspects in the forms of renewing Criminal Procedure Code and police regulations, structural aspects of compiling restorative justice mechanisms and increasing personnel competence, cultural aspects in the form of increasing community participation to be aware of laws and support restorative justice programs.

Purpose Cybercrime is the greatest threat facing law enforcement agencies in England and Wales. Although these crimes are transnational by nature, the burden of response has been placed on line officers. Not all officers, however, believe they are capable of responding to calls involving cybercrime. The current study, using latent class analysis (LCA) on a large sample of English and Welsh officers, finds two types of officers: those prepared (39 percent) and those unprepared (61 percent). Using logistic regression to predict who falls into either classification, the authors find that training and age are the best predictors of latent membership. Implications for policy and future research are discussed. The paper aims to discuss these issues. Design/methodology/approach In this study, the authors used LCA to determine the number and character of unobserved categories of officers in how they deal with cybercrime. Findings The LCA indicated there are two distinct categories of police in the English and Welsh constabulary: those prepared (39 percent) and those unprepared (61 percent). Training and age were the two key determinants of this classification. Research limitations/implications LCA is an exploratory analysis technique that requires additional validation to confirm the findings of any one study. Practical implications The salience of training in helping officers feel prepared to deal with cybercrime cases as well as victims was demonstrated. A full 60 percent of the officers in this study fell in the “unprepared” category, which continues to highlight the limitations of local police to handle cybercrime cases; nevertheless, almost 40 percent of officer could be considered ready when responding to cybercrimes. Social implications As the harm cybercrime brings to our financial and social well-being, law enforcement agencies will be required to improve their response capabilities. Most current cybercrime responses address technical issues related to online fraud and abuse, but officers often perceive the problem as outside their legal and geographic jurisdiction. Knowing how officers perceive cybercrime as well as their own capabilities will allow us to begin changing enforcement policies, training capacity and individual response efficacy. Originality/value This study involved a sample of English and Welsh constables and sergeants to classify their cybercrime readiness. The analysis and particular data are unique to the study of cybercrime.

The article presents the results of the data obtained on the level of special physical fitness of future sergeants-commanders of the Armed Forces of Ukraine (AFU). In the conditions of martial law, when Ukraine has been facing very acute challenges to its national security and territorial integrity for more than two years due to the full-scale invasion and aggressive policy of the Russian Federation, the problem of training military personnel capable of meeting these challenges becomes important. Specialised physical training is a key factor in achieving this goal in any military speciality. The article presents the results of the special physical training of future sergeants of the Armed Forces of Ukraine under martial law in the 2022-23 academic year. The analysis of the indicators of the cadets of the Non-Commissioned Officer College of the graduation course (4th semester) showed that the results of our research indicate that cadets of various specialties in the fourth semester in the grenade throwing exercise scored - 42.6 points. The cadets in the exercise of throwing a grenade at a distance completed it at 33.5 m. Swimming in uniform with weapons (100 m) was completed in 189.7 s. The above-mentioned cadets in the general control exercise on a single obstacle course showed a result of 143.3 s. The 6×100 m shuttle run exercise with a machine gun was completed in - 142.9 s. Cadets of the above-mentioned specialties in running (3100m) with overcoming obstacles as part of a unit (10 people) showed the result - 1013.6 s in the graduation semester. In our opinion and according to the requirements of the 20021 physical training instructions, the results are insufficient and need better.

Empirical juridical, criminal acts of not obeying an official order)Indonesian National Amed Force (TNI) as a means of state defense requires high discipline from its soldiers. Various efforts and regulations have been made in order to maintain this discipline, however, as an organization, TNI cannot be separated from various problems that can interfere with the implementation of its duties caused by various factors. One of these problems is the crime of withdrawing from the unit as committed by Anjas Widiastama (the defendant), rank/SN: Sargent/21170039431196, Squad Commander 1/II/C Military Police Batalyon of Indonesian Army Military Police Centre. There are two formulations of the problem specified in the writing of this thesis. First, how to apply sanctions for criminal acts of not obeying an official order. Second, how are the obstacles of the military court in resolving criminal acts of not obeying an official order. This paper was made by conducting research using empirical juridical methods with a statutory approach, cases that occurred and conceptual. The form of research in writing this thesis is descriptive which means this research focuses on explaining the object of research in order to answer what events or phenomena occur so that it is expected to be a problem solver if the same event occurs again in the future. The depiction designed to obtain the necessary information is carried out by going down the field to conduct observations and interviews in order to collect primary and secondary data. The crime of not obeying an official order regarding absence without permission in this study is regulated in article 86 of the KUHPM paragraph 1. The condition of military absence in the fact that this incident occurred with reasons or motivations that did not endanger the institution or the state and constituted a minor offense. The imposition of sanctions for criminal acts that occurred by the panel of judges by applying Article 86 of the 1st KUHPM was considered fair in base on the evidence. The obstacles that exist for the military court II-08 Jakarta regarding disobiente of an official order made by Sergeant Anjas Widiastama have been handle base on the law. Tentara Nasional Indonesia (TNI) sebagai alat pertahanan negara memerlukan kedisipilinan yang tinggi dari para Prajuritnya. Berbagai upaya dan aturan telah dibuat dalam rangka menjaga kedisiplinan itu, namun demikian sebagai sebuah organisasi bukan berarti TNI bebas dari masalah-masalah yang dapat mengganggu pelaksanaan tugas yang disebabkan oleh berbagai faktor. Salah satu permasalahannya adalah tindak pidana kejahatan menarik diri dari kesatuan seperti yang dilakukan oleh Anjas Widiastama (terdakwa), pangkat/NRP: Serda/21170039431196, danru 1/II/C Yonpomad Puspomad. Ada dua rumusan masalah yang ditentukan dalam penulisan skripsi ini. Pertama bagaimana penerapan sanksi perbuatan tindak pidana tidak mentaati suatu perintah dinas. Kedua bagaimana kendala peradilan militer dalam menyelesaikan tindak pidana tidak mentaati suatu perintah dinas. Tulisan ini dibuat dengan melakukan penelitan yang menggunakan metode yuridis empiris dengan undang-undang sebagai pendekatannya (Statute Approach), kasus yang terjadi (Case Approach) dan konseptual (Conceptual Approach). Bentuk penelitian dalam penulisan skripsi ini adalah deskriptif yang bermakna penelitian ini fokus pada menjelaskan objek penelitian guna menjawab peeristiwa atau fenomena apa yang terjadi sehingga diharapkan dapat menjadi pemecah masalah bila peristiwa yang sama terjadi lagi dimasa depan. Penggambaran yang dirancang untuk memperoleh keterangan-keterangan yang diperlukan dilakukan dengan turun kelapangan untuk melakukan observasi dan wawancara guna mengumpulkan data-data primer dan sekunder. Tindak Pidana tidak mentaati suatu perintah dinas mengenai ketidakhadiran tanpa izin dalam penelitian ini diatur dalam pasal 86 KUHPM ayat 1 (satu). Kondisi ketidakhadiran militer dalam fakta peristiwa ini terjadi dengan alasan atau motivasi yang tidak membahayakan institusi atau negara dan merupakan pelanggaran yang ringan. Pemberian sanksi atas perbuatan tindak pidana yang terjadi oleh majelis Hakim dengan menerapkan Pasal 86 ke-1 KUHPM dinilai sudah adil sesuai dengan bukti-bukti yang ada dipersidangan. Melalui pemberian keputusan ini maka dapat dikatakan bahwa kendala yang ada bagi peradilan militer II-08 Jakarta dalam menyelesaikan perkara tindak pidana tidak mentaati suatu perintah dinas yang dilakukan oleh Serda Anjas Widiastama telah dapat diatasi sesuai dengan aturan yang berlaku.

The article outlines the actual processes taking place in the Armed Forces of Russia concerning contract servicemen. The definitions of the concepts of professional training, readiness for professional activity, including the professional activity of an officer are given. The components, criteria and indicators of diagnostics of the level of readiness of cadets of educational organizations to work with this category of servicemen are specified. On the basis of the author’s model the article analyses the results of cadets’ training on the example of Saratov Military Order of Zhukov Red Banner Institute of National Guard Forces of the Russian Federation to work with contract servicemen in the positions of soldiers and sergeants. The conclusion indicates the general level of cadets’ readiness to work with this category of servicemen, as well as the further course of its formation and diagnostics.

Abstract Objectives Examine how the amount and makeup of police-initiated activities changed after the introduction of body-worn cameras (BWCs). Methods From May 21 to November 22, 2016, patrol officers and sergeants from the Milwaukee Police Department were involved in a randomized controlled trial. Through a stratified random sampling procedure, half the officers (n = 252) were assigned BWCs, while officers from the control group (n = 252) continued business as usual. The counts of proactive activities, which included a total count of self-initiated events, as well as traffic stops, business checks, subject stops, and park and walks, were examined using random-effects negative binominal panel regression analyses. The models included a unique measure of contamination to assess its impact on officers’ proactivity. Results BWCs had no impact on the total amount of officer-initiated activities, traffic stops, or business checks. Officers with BWCs conducted approximately 8% fewer subject stops and 23% more park and walks than those in the control group. In all models, contamination levels were significantly, positively associated with the number of proactive activities that were conducted; however, the size of this effect was very small. Conclusions Results suggest that BWC-wearing officers may be less likely to engage in proactive activities that are highly discretionary and that could potentially lead to confrontations with community members. As departments continue to develop BWC programs or fine-tune their existing BWC policies, more research is needed to understand the degree to which BWCs affect officers’ behaviors and interactions with the public.

The article traces the main stages of formation and development of the Department of Organization of Judicial and Law Enforcement Activities, established at the Russian State University of Judgment in 1998. The creation of the department has opened a new stage in the study and teaching of disciplines, the development of which is a prerequisite for the professional training of a lawyer – judicial activity, law enforcement and judicial authorities, prosecutorial activity, human rights and law enforcement activities, enforcement proceedings. The decisive contribution of the founder of the department, Honored Lawyer of the Russian Federation, Chairman of the Military Board of the Supreme Court of the Russian Federation, retired Colonel-General of Justice Nikolay Alexandrovich Petukhov to the definition of tasks and areas of work of the department, to the creation and development of the concept of training law students, to the formation of scientific and pedagogical staff, to achieving significant success in professional retraining and professional development of judges. The article reveals the main pages of the history of the department as a center for studying the problems of organizing judicial and law enforcement activities in one of the few educational organizations in the country, the military training center at which trains reserve officers in military accounting specialties of the legal profile and reserve sergeants. The concept of judicial activity in special periods is argued, reflecting the experience of the department»s staff in solving current problems of legal science in the context of the revival of the sovereign statehood of Russia and the affirmation of the inviolability of its democratic foundation, the modernization of the economic, political, cultural, social and legal foundations and institutions of Russian society.

The article substantiates the importance of creative competence in the professional activities of a sergeant of the Ground Forces of the Armed Forces of Ukraine. The essence of the process of forming the professional competence of a sergeant of the Ground Forces of the Armed Forces of Ukraine has been revealed. The interpretation of the term «professional competence» has been highlighted. A review of various points of view of scientists on the understanding of creative competence has been performed. This has made it possible to define this category as a person’s ability to perform variable, flexible and innovative mental activity, which precedes the process of creative activity. The professional tasks of sergeants of the Ground Forces of the Armed Forces of Ukraine have been disclosed, namely: to skilfully manage the subordinates, to show a role-model of discipline, to constantly educate the subordinates with the orientation towards humanism, love of the Motherland and humanity, compliance with the statutory order and readiness to perform tasks as intended, prevention of emergency events and crimes among the military personnel, the creativity of the implementation of which requires a creative, non-standard approach to solving problem situations.

At all stages of Ukraine’s development, the system of investigation of criminal offenses was one of the attributes of ensuring the rule of law in the state. Among this, the system of investigations of military criminal offenses in the Armed Forces of Ukraine (hereinafter – the AF of Ukraine) is not an exception. It should be noted that there is an urgent need to reform such a major military law enforcement agency as the Military Law Enforcement Service of the AF of Ukraine, which does not meet modern NATO standards, the member of which Ukraine plans to become in the nearest future, into a new Military Police that will investigate military criminal offenses together with the State Bureau of Investigations. To this date, in connection with the possibility of creating a Military Police in Ukraine we should: adopt amendments to the Criminal Code of Ukraine, which provide for the classification of certain crimes under Articles 402, 403, 405, 406, 407, 408, 409, etc., to criminal offenses; to determine the powers of the Military Police to conduct a pre-trial investigation in the form of investigation of criminal offenses committed by servicemen, civil servants of military formations, and to leave the powers to investigate war crimes and crimes in the military sphere (the latter include various encroachments on the military-industrial complex) for the State Bureau of Investigations; to refer to the jurisdiction of the Military Police certain components of criminal offenses, in addition to Article 422 of the Criminal Code of Ukraine, committed by servicemen, sergeants and junior officers, and civil servants of military formations, whose positions belong to “B” category. December 2002 shook up South Korea's conservative establishment and its U.S. ally. Five days before the South Korean presidential election, with a quarter of the electorate still remaining undecided, leaders of nongovernmental organizations (NGOs) and religious activists staged a massive candlelight vigil in front of Seoul's city hall to protest against “unequal” provisions in South Korea's Status of Forces Agreement (SOFA) with its U.S. ally. The political rally drew some 40,000 protestors from all walks of life. Moreover, it was only one among many climaxes in a long mobilization drive launched by NGOs and “netizens” since June, when a U.S. armored vehicle driven by Sergeant Fernando Nino and Mark Walker ran over two teenage girls during a military exercise in Hyochonli. That month saw some thirty NGOs establish a national umbrella organization to demand the trial of Nino and Walker under South Korean law. Then, in December, the Catholic, Buddhist, and Protestant religious orders joined in to lend their authority to the protestors by collectively calling for the revision of SOFA to give South Korea “primary jurisdiction” over criminal cases. The radicalhanchongryonuniversity students, too, showed up in protest sites to stir up and escalate anti-American sentiments, regularly raiding U.S. military bases in Uijongbu and Yongsan and even breaking into the U.S. Embassy compound in November. But unlike the past, this intrusion of radicalhanchongryonactivists did not drive away presumably conservative middle-class groups from political rallies. On the contrary, the call for a SOFA revision grew louder after the U.S. military court judged Nino and Walker not guilty of negligent homicide.

The essence of the Geneva Conventions (1949), which deal with the protection of persons under the rule of the protecting state during the war are summarized in the article. The correspondence of the norms of the constitutional legislation of Ukraine with the Geneva Conventions (1949) in the context of such values as freedom, non-discrimination, justice, responsibility is studied. It is found out that the Constitution of Ukraine and some constitutional laws contain norms concerning the rights and freedoms of persons, including war prisoners and civilians, who needs protection. These norms coincide with the requirements of the Geneva Conventions (1949). But the norms of constitutional law are local in their nature, and international norms are universal ones. It is noted that the constitutional legislation and the Geneva Conventions (1949) have certain collisions. Some acts of military legislation of Ukraine and their correspondence the Geneva Conventions (1949) are analyzed. Attention is drawn to the Charter of the Internal Service of the Armed Forces of Ukraine, which defines the obligations of certain categories of persons to comply with international humanitarian law. Among them are the Assistant Brigade Commander for Legal Affairs and Chief Sergeants of the Battalion, Troop and Platoon. It is mentioned that such approach allows not only to implement the rules of the Geneva Conventions (1949), but also to control this process. The conformity of by-laws of the military legislation of Ukraine to the requirements of the Geneva Conventions (1949) is revealed. It is stated that, among other things, these acts define the information about war victims, namely: wounded and sick, persons who suffered from a shipwreck, war prisoners and others whose freedom is restricted due to armed conflict, civilians at the occupied territories. The conclusions state that the Geneva Conventions (1949) and the constitutional and military legislation of Ukraine protect the rights and freedoms of war victims, although they need some unification. This paper discusses law and order politics and policy in Australia. It challenges the conventional criminological wisdom that Australia does not have a serious crime problem. It argues that, while political responses to crime are all too frequently irrational, this is not because Australian state and territory governments so often rely on punitive law and order policies. Australian law and order policy is irrational because it usually lacks any clear rationale, is rarely subjected to any effectiveness or cost-effectiveness evaluation, frequently ignores the possibility of unintended side-effects and is occasionally founded on a misdiagnosis of the crime problem that prompts it. The paper concludes by discussing various explanations for this state of affairs and what can be done about it.

The reverse order law and the forward order law have been studied for various types of generalized inverses. The $(b,c)$-inverse is a generalization of some well known generalized inverses, such as the Moore-Penrose inverse, the Drazin inverse, the core inverse, etc. In this paper, the reverse order law for the $(b,c)$-inverse, in a unital ring, is investigated and an equivalent condition for this law to hold for the $(b,c)$-inverse is derived. Also, some known results on this topic are generalized. Furthermore, the forward order law for the $(b,c)$-inverse in a ring with a unity is introduced, for different choices of $b$ and $c$. Moreover, as corollaries of obtained results, equivalent conditions for the reverse order law and the forward order law for the inverse along an element are derived.

Paradigms play an important role in the activities of the scientific community, contributing to the acquisition of new knowledge, they create conditions for the integration of scientists into a single group of like-minded people. At the same time their content and significance in relation to specific legal phenomena have not been sufficiently studied. The article attempts to scientifically comprehend legal paradigms regarding the phenomenon of "law and order", which is well known to legal science. According to the authors the paradigm of the study of law and order is of a formal legal nature, the basis of which is formed by the idea of a purely legal nature of the phenomenon, in combination with a specific linear determinism, which leaves an imprint on the perception of the model of the relationship between law and order as a cause and consequence. The authors express a number of critical judgments in relation to the formal legal paradigm, note the signs of the formation in the scientific community of a new binary paradigm in the study of the law and order.
