This research aims to fill a void in the extant policy implementation literature that has overlooked the leadership contribution of sergeants to the successful adoption of policy decisions by front-line police officers. Using a qualitative approach and a sociological institutionalism perspective, and focusing on the racial profiling policy of a large North American municipal police organization, 17 sergeants representing 17 divisions (precincts) were interviewed. This research does not aim to assess the efficacy of the selected policy but, rather, examines leadership and supervisory perspectives relating to implementation and compliance. The findings demonstrate the methods used by sergeants to influence and achieve the compliance of front-line police officers with the racial profiling policy. Methods include auditing, being present, training, encouraging, rewarding, and disciplining. To explain these methods, it is theorized that sergeants blend two leadership approaches to ensure front-line officers conform to the racial profiling policy: an authoritative leadership approach and a supportive leadership approach. This study emphasizes the leadership contributions of sergeants when attempting to implement perceived controversial or unpopular policy—in this case, racial profiling policy—in a police organization and contains implications for law enforcement leaders, oversight committees, policy writers, and all government legislators who oversee public safety and security.

Purpose – The purpose of this paper is to examine the impact of sergeants’ less lethal force policy perceptions on subordinate officers’ policy perceptions. Sergeants are a critical level of supervision in police departments with respect to policy administration, particularly in regard to the use of force. Little empirical research, however, has been conducted on either officer policy perceptions or this aspect of the supervisory role. Design/methodology/approach – Surveys of 765 patrol officers and 146 patrol sergeants served as the data source. Multilevel modeling procedures were used to test for supervisory influences on officer force policy perceptions while controlling for relevant officer-level variables. Additional analyses were conducted to examine potential moderating effects for this sergeant-officer attitudinal relationship. Findings – Findings revealed that sergeant policy perceptions, views of top management, and their level of support had a significant impact on officers’ force policy perceptions. Furthermore, post hoc analyses revealed that sergeant support moderated the sergeant-officer force policy perception relationship. Research limitations/implications – The results indicate that officers’ force policy perceptions are associated with the attitudinal dispositions of sergeants. Future work could expand the focus on administrative attitudinal outcomes beyond less lethal force policies as well as other perceptions of the work environment. Practical implications – For police leaders, the findings illustrate the need to pay attention to mid-management levels and the organizational climate, as negative orientations can impact additional domains (i.e. policies and procedures) and other organizational members (i.e. subordinates). Originality/value – The study adds to the limited body of research on two accountability mechanisms of departments: administrative rulemaking and frontline supervision.

The article examines the process of reforming the law enforcement system in Ukraine, in particular the creation of the National Police in 2015, and its impact on the rank system of police officers. Special attention is paid to the main changes that occurred as a result of this reform. In particular, such positive aspects as bringing police standards closer to the European level, as well as creating a new police uniform and changing the rank system are highlighted. It is important to note that the reform is aimed at improving the efficiency of law enforcement agencies and their interaction with the public. The article also highlights the problem of the lack of additional ranks and limited career opportunities for junior police officers, which can lead to professional burnout and reduced staff motivation. An analysis of the positive experience of using the extended rank of junior and sergeant ranks in countries such as Canada, Germany, Greece, Spain, as well as the states of Virginia and Delaware in the USA is conducted. The proposed ways of solving the shortcomings in the rank system are aimed at improving the working conditions and motivation of the police personnel. In addition, it is proposed to introduce new ranks for junior and non-commissioned officers of the police in order to stimulate further self-development of professional skills and career growth prospects. In addition, each new rank will have separate duties and functions that will facilitate mutual assistance and cooperation with other police officers. It is also important to emphasise the need to update the design for cadets of higher education institutions with specific learning conditions and lyceums.

Restorative justice-based criminal policies within the framework of criminal justice which has legal certainty carried out by Polri (Indonesian National Police) are implemented through Penal and non-Penal policies. Penal policies are carried out by investigators as the function of law enforcement, and non-Penal policies are carried out by bhabinkamtibmas (a police sergeant assigned to take care problems related to laws in a village or sub-district) as the function of pre-emptive efforts and patrol unit as the function of preventive efforts.Overcoming crimes based on restorative justice intent to solve problems of society in such a way. The problems can be resolved using the principle of restorative justice, that is, the sense of justice for each party involved in the problems can be realized. Such overcoming involves victims, perpetrators, victims' families and the community as well as the relevant parties in order to reach a fair agreement and settlement.The research focuses on restorative justice in Polri. Meanwhile, the problem questions of the research are: (1) How is the construction (ius constitutum) of crime prevention policies based on restorative justice within the criminal justice framework that has legal certainty? (2) How is the implementation (ius operatum) of crime prevention policies based on restorative justice within the criminal justice framework that has legal certainty? And (3) How is the reconstruction (ius constituendum) of crime prevention policies based on restorative justice within the framework of criminal justice with legal certainty?The research employs the normative juridical approach. The research employs secondary and primary data. Secondary data is obtained by conducting library research and documentary studies, and primary data is obtained by conducting interview studies. Data is then analysed using the mix method (quantitative and qualitative).The results of the research reveal that (1) the construction of crime prevention policies is seen from a philosophical aspect based on Pancasila values and the principles of restorative justice; from a juridical aspect by taking into account legal norms originating from abroad, customary law, Islamic law, and national law, all of which are rooted in Pancasila values; from a sociological aspect that it needs the active participation from the community in supporting the crime prevention based on restorative justice, (2) the implementation of crime prevention policies based on restorative justice using Penal and Non-Penal carried out by the investigative function, bhabinkamtibmas and patrol units, to parse and resolve existing problems in society, and (3) the reconstruction of crime prevention through substance aspects in the forms of renewing Criminal Procedure Code and police regulations, structural aspects of compiling restorative justice mechanisms and increasing personnel competence, cultural aspects in the form of increasing community participation to be aware of laws and support restorative justice programs.

Purpose Cybercrime is the greatest threat facing law enforcement agencies in England and Wales. Although these crimes are transnational by nature, the burden of response has been placed on line officers. Not all officers, however, believe they are capable of responding to calls involving cybercrime. The current study, using latent class analysis (LCA) on a large sample of English and Welsh officers, finds two types of officers: those prepared (39 percent) and those unprepared (61 percent). Using logistic regression to predict who falls into either classification, the authors find that training and age are the best predictors of latent membership. Implications for policy and future research are discussed. The paper aims to discuss these issues. Design/methodology/approach In this study, the authors used LCA to determine the number and character of unobserved categories of officers in how they deal with cybercrime. Findings The LCA indicated there are two distinct categories of police in the English and Welsh constabulary: those prepared (39 percent) and those unprepared (61 percent). Training and age were the two key determinants of this classification. Research limitations/implications LCA is an exploratory analysis technique that requires additional validation to confirm the findings of any one study. Practical implications The salience of training in helping officers feel prepared to deal with cybercrime cases as well as victims was demonstrated. A full 60 percent of the officers in this study fell in the “unprepared” category, which continues to highlight the limitations of local police to handle cybercrime cases; nevertheless, almost 40 percent of officer could be considered ready when responding to cybercrimes. Social implications As the harm cybercrime brings to our financial and social well-being, law enforcement agencies will be required to improve their response capabilities. Most current cybercrime responses address technical issues related to online fraud and abuse, but officers often perceive the problem as outside their legal and geographic jurisdiction. Knowing how officers perceive cybercrime as well as their own capabilities will allow us to begin changing enforcement policies, training capacity and individual response efficacy. Originality/value This study involved a sample of English and Welsh constables and sergeants to classify their cybercrime readiness. The analysis and particular data are unique to the study of cybercrime.

The article presents the results of the data obtained on the level of special physical fitness of future sergeants-commanders of the Armed Forces of Ukraine (AFU). In the conditions of martial law, when Ukraine has been facing very acute challenges to its national security and territorial integrity for more than two years due to the full-scale invasion and aggressive policy of the Russian Federation, the problem of training military personnel capable of meeting these challenges becomes important. Specialised physical training is a key factor in achieving this goal in any military speciality. The article presents the results of the special physical training of future sergeants of the Armed Forces of Ukraine under martial law in the 2022-23 academic year. The analysis of the indicators of the cadets of the Non-Commissioned Officer College of the graduation course (4th semester) showed that the results of our research indicate that cadets of various specialties in the fourth semester in the grenade throwing exercise scored - 42.6 points. The cadets in the exercise of throwing a grenade at a distance completed it at 33.5 m. Swimming in uniform with weapons (100 m) was completed in 189.7 s. The above-mentioned cadets in the general control exercise on a single obstacle course showed a result of 143.3 s. The 6×100 m shuttle run exercise with a machine gun was completed in - 142.9 s. Cadets of the above-mentioned specialties in running (3100m) with overcoming obstacles as part of a unit (10 people) showed the result - 1013.6 s in the graduation semester. In our opinion and according to the requirements of the 20021 physical training instructions, the results are insufficient and need better.

The field of law enforcement is one of the most sought-after careers. People have various reasons why they choose to embark on this field of work. There are many levels of law enforcement from correctional officers to particular agents, such as patrol officers, federal officers (FBI, DEA, IRS etc). There is a lack of females that represent the field of law enforcement in numerous police divisions nationwide. Previous studies explored these deficiencies, yet they failed to examine the perspectives of high-ranking female officers. There is a gap in the literature that analyzes female officers' academy experiences, struggles, and barriers as women in law enforcement. The purpose of this qualitative narrative was to explore the perspectives of female law enforcement officers' experiences in obtaining high-ranking positions. In this study, I interviewed 12 high-ranking women in law enforcement and revealed their skills in this traditionally male-dominated field. Theories associated with this research are advocacy coalition and sex discrimination. NVivo software was used to organize the findings. Results indicated that there is an invisible barrier that women face when they are trying to promote to leadership positions. Participants offered insights into their journey, including balancing family life, facing adversity in the training academy, in the workplace, and conrinued success as supervisors. The current study suggests that lines of discourse are causing organizations to change their traditional masculine styles of leadership.

Although born in Prague under the Austro-Hungarian Empire and dying before Stalin took control of the USSR, Kafka clairvoyantly understood the full paradox of Soviet authoritarianism. His short parable “Before the Law” provides an interesting intellectual exercise for anyone wishing to study Soviet law, for in Russia it evokes tragic truth. The man who futilely attempted to reach the law is a metaphor for Russian masses seeking the same goal. Just as the doorkeeper with his air of conscious superiority and vacillating temperament mirrors the nature of Soviet rulers. The absurdity that underpins Kafka's work poignantly and painfully parallels the arbitrary ‘justice' of Stalin's rule. The man's futile search is symbolic of the many purge victims who, while wasting away in the gulags, clung to the slim hope of using legal means to exonerate themselves. Through an intellectual and visceral response, Kafka conveys the authoritarian split between the elite and the masses in Russia. No one knows how many countless Russian and Soviet citizens' lives were wasted in the same shadow of indifferent omnipotence. And we are forced to ask why the law was kept from them. And yet, what fueled the insatiable pursuit of the law in the face of certain futility? Even the Purges took place within a legal framework, as perverse as it may have been. But was Communist legality simply an oxymoron, or was there something more?

Um dos maiores constrangimentos da democracia liberal estadunidense é seu fracasso de gerar qualquer reação política relevante contra o ethos punitivo, aqui chamado law and order, que legitima o encarceramento sem precedentes de seus próprios cidadãos. Com efeito, a população prisional dos Estados Unidos passou de quase 200 mil detentos em 1970 para mais de 2.3 milhões em 2007. De acordo com o Departamento de Justiça (2007), mais de 10 milhões de americanos são enviados para cadeias todos os anos e outros 600 mil acabam indo parar nos presídios onde cumprem em média três anos de reclusão, na maioria das vezes por crimes contra a propriedade ou uso de drogas. Excetuando as crianças e os idosos com mais de 65 anos, um em cada 50 adultos encontra-se atrás das grades nos Estados Unidos. Qual a origem e as causas desse fenômeno? Esta pesquisa documenta a grande mudança no modo pelo qual o problema da criminalidade foi percebido nos círculos oficiais e as conseqüências políticas que tal percepção acarretou. Visa analisar como as questões relacionadas ao crime foram socialmente construídas através de processos políticos, interpretativos e representacionais nos quais as elites políticas e a mídia mobilizaram símbolos e referências culturais poderosas a fim de atrair a atenção da opinião pública para o problema da criminalidade e assim gerar suporte popular para as políticas públicas punitivas. Não obstante a extrema complexidade do discurso político sobre crime, tudo indica que apenas uma abordagem preencheu o vácuo deixado pelo declínio do ideal reabilitador, fenômeno chamado por David Garland (2001a) de “nihilismo terapêutico”: endureça com o crime! Semelhante resposta se baseia em visões contraditórias do comportamento criminoso, as quais, não obstante, concordam que a forma mais apropriada para se tratar da criminalidade seria a expansão do direito penal e o aumento da severidade das punições. Essa retórica punitiva mudou a antiga ênfase na reabilitação e reintegração social dos ofensores para a crença na capacidade da lei penal de estruturar as escolhas e condutas dos indivíduos. A retórica law and order foi mobilizada pela primeira vez no final dos anos de 1950, quando políticos conservadores chamaram a atenção dos eleitores para o problema do “crime de rua”, ridicularizaram a idéia de que o comportamento desviante também tem raízes sócio-econômicas e promoveram uma visão alternativa segunda a qual o crime é conseqüência direta de apetites e impulsos desregrados que impelem os indivíduos em direção às atividades criminosas. Essa tentativa de reconstruir as percepções da opinião pública com relação ao problema da criminalidade fez parte, por sua vez, de um cenário político muito mais abrangente: o esforço conservador para substituir o Estado de bem-estar social pelo Estado de controle social como princípio de governabilidade. Com o Estado sofrendo pressões crescentes dos defensores dos direitos civis, dos programas assistenciais e do movimento estudantil no sentido de assumir mais responsabilidade para reduzir as desigualdades sociais, políticos conservadores articularam programas de governo alternativos que reduziram o welfare state e aumentaram os controles sociais. As hipóteses centrais desta pesquisa são assim resumidas: 1) A questão do crime foi essencial para a construção de uma nova política social. 2) Iniciativa política e mídia, não os índices oficiais de criminalidade, foram os fatores que despertaram a preocupação popular com o crime. 3) A hegemonia de law and order não resultou de um movimento democrático de base, mas foi conseqüência do projeto conservador de reconstrução do Estado.
One of the great embarrassments to the American democracy has been its collective failure to raise any substantial political opposition to the punitive ethos known as law and order that underlies the unprecedented use of imprisonment on its own citizenry. The nation´s prison population grew from less than 200,000 in 1970 to over 2.3 million by 2007. According to the Department of Justice (2007), over 10 million Americans are admitted to jail each year and another 600,000 find their way to prison to spend an average of almost three years largely for property and drug crimes. If children and those over 65 are dropped from the denominator, nearly one in 50 adult Americans is locked up. How dit it all start and what are the reasons for such a phenomenon? This research documents the major shift in the way in which the crime problem was officially perceived and the political positions to which these perceptions gave rise. It aims at analysing how crime-related issues were socially and politically constructed through interpretative, representational, and political processes, in which political elites and the media deployed mediated symbols and mobilized powerful cultural references to call the public opinion´s attention to crime- related problems and defined these problems as the consequence of insufficient punishment and control, and generated popular support for punitive anticrime policies. Despite the complexity of political discourse on crime, it appears that one single view has filled the vacuum created by the demise of the rehabilitative ideal—what David Garland calls “therapeutic nihilism”: get tough on crime. This tough response to the crime problem are predicted upon various and sometimes contradictory explanations of criminal behavior. Despite their differences, these explanations of crime similarly imply that expanding the scope of criminal law and increasing the severity of its penalties are the most appropriate responses to the crime problem. In this get-tough rhetoric, the emphasis has shifted from a concern with rehabilitating and reintegrating offenders to the capacity of the law and the social control system to structure the choices and conduct of individuals. The rhetoric of law and order was first mobilized in the late 1950s, when conservative politicians paid an unprecedented amount of attention to the problem of “street crime”, ridiculed the notion that criminal behavior has socioeconomic causes, and promoted the alternative view that crime is the consequence of insufficient curbs on the appetites and impulses that impel individuals towards criminal activities. This attempt to reconstruct popular perceptions of the crime problem was, in turn, a component of a much larger political contest: the effort to replace social welfare with social control as the principle of state policy. As the civil rights, welfare rights, and the students movements pressured the state to assume greater responsibility for the reduction of social inequalities, conservative politicians attempted to popularize an alternative vision of government, one that diminishes its duty to provide for social welfare but enlarges its capacity and obligation to maintain social control. This thesis explores the idea and praxis of "law and order" as an opposing principle of government to the rule of law, through study of the criminal juridical system of Myanmar. It finds that this system alludes routinely to the rule of law while enabling practices that contradict it. It explains this contradiction by arguing that the system is animated by politics that conflate law and order with the rule of law. The origins of the criminal juridical system in Myanmar lie in the authoritarian imperatives of the British colonial regime. These imperatives the regime expressed legalistically. A formalistic rule-of-law idea took hold and carried over into the postcolony. It expanded to encompass notions of substantive rights; however, after a military takeover of the state apparatus in 1962 it lost credence. When the rule of law re-emerged strongly in political and juridical language during the 1990's, under a new military junta, it was as a synonym for law and order. Yet, semantically "law and order" in Burmese does not refer to "law" at all. It describes an ideal society that is subdued administratively, not one governed juridically. Reading records of 340 court cases, accompanied by findings from research among legal professionals and extensive study of published and unpublished government documents, I argue that law and order has subsumed the rule of law in Myanmar both as an idea and in practice. I advance the argument by exploring some of the system's key features, including its pursuit of public enemies, and the role of the policeman as bearer of sovereign authority. I show how the criminal juridical system operates as a marketplace for the buying and selling of case outcomes, and how this feature of the system is consonant with the maintenance of order. I examine how the making of complaints against officials is possible within the system's pragmatic frame, and to an extent is encouraged. And I reveal how in response to protest during 2007 courts in Myanmar, rather than sanctioning police officers and other officials for violating law instead functioned as gatekeepers on a juridical threshold, across which people could be taken at will, but from which they could be returned, through trial and sentencing. The thesis constitutes an empirical response to conceptual debate about the rule of law. It argues that the debate can be enriched through more effort to construct and critique opposing concepts, and through research of systems animated by principles of government other than the rule of law or its likenesses. By positing law and order as one opposing concept, this thesis queries the seeming ubiquity of rule of law discourse. It also illuminates the contradictory qualities of "law and order" itself, alerting us to the persistent difficulty of attempting to reconcile the normative and general properties of law with the pragmatic and particular properties of order.

Sliding mode control is a technique to design robust feedback control laws. In its classical formulation, this approach involves discontinuous controls that arise several theoretical and practical challenges, such as the existence of non-unique solutions of nonlinear differential equations and chattering. Numerous variations of the sliding mode control architecture, such as the higher-order sliding mode method, have been presented to overcome these issues. In this paper, we present an alternative sliding mode control architecture that involves Hölder continuous feedback control laws, is simpler to implement than other non-classical nonlinear robust control techniques, guarantees robustness and uniform asymptotic stability of the closed-loop system, and ensures both existence and uniqueness of the closed-loop system’s trajectory. Our results are applied to design a robust nonlinear observer in the same form as the Walcott and Żak observer. Moreover, a numerical example illustrates our theoretical results and compares the proposed control law to the classical sliding mode control, the second order sliding mode control, and the super-twisting control.

The Center of Legal Practices is intended to guarantee law students a field of experience and knowledge that constitutes possibilities for the articulation of theory and practice, in order to develop skills, habits, and attitudes relevant and necessary for the acquisition of professional skills. On the theoretical side, it seeks to give opportunities for law school students, both UNIARP and University Center of Brusque Center of Legal Practices to work in simulated civil, criminal, and labor practice, in order to develop the skills and knowledge necessary for the performance of various legal branches in the practice of law. On the practical side, currently, the NPJ handles lawsuits involving the most diverse civil areas. The mission of these centers is to increase access to justice, assist in the dejudicialization process, and through its conciliation projects, seek the resolution of conflicts through alternative resolution methods. In this way, the Centers for Legal practice do not only have value as an instrument for training future lawyers, but have a societal function as well, in particular, to make legal counsel more accessible.

Existing and emerging applications of artificial intelligence in armed conflicts and other systems reliant upon war algorithms and data span diverse areas. Natural persons may increasingly depend upon these technologies in decisions and activities related to killing combatants, destroying enemy installations, detaining adversaries, protecting civilians, undertaking missions at sea, conferring legal advice, and configuring logistics. In intergovernmental debates on autonomous weapons, a normative impasse appears to have emerged. Some countries assert that existing law suffices, while several others call for new rules. Meanwhile, the vast majority of efforts by States to address relevant systems focus by and large on weapons, means, and methods of warfare. Partly as a result, the broad spectrum of other far-reaching applications is rarely brought into view. One normatively grounded way to help identify and address relevant issues is to elaborate pathways that States, international organizations, non-state parties to armed conflict, and others may pursue to help secure greater respect for international law. In this commentary, I elaborate on three such pathways: forming and publicly expressing positions on key legal issues, taking measures relative to their own conduct, and taking steps relative to the behavior of others. None of these pathways is sufficient in itself, and there are no doubt many others that ought to be pursued. But each of the identified tracks is arguably necessary to ensure that international law is — or becomes — fit for purpose. By forming and publicly expressing positions on relevant legal issues, international actors may help clarify existing legal parameters, pinpoint salient enduring and emerging issues, and detect areas of convergence and divergence. Elaborating legal views may also help foster greater trust among current and potential adversaries. To be sure, in recent years, States have already fashioned hundreds of statements on autonomous weapons. Yet positions on other application areas are much more difficult to find. Further, forming and publicly expressing views on legal issues that span thematic and functional areas arguably may help States and others overcome the current normative stalemate on autonomous weapons. Doing so may also help identify — and allocate due attention and resources to — additional salient thematic and functional areas. Therefore, I raise a handful of cross-domain issues for consideration. These issues touch on things like exercising human agency, reposing legally mandated evaluative decisions in natural persons, and committing to engage only in scrutable conduct. International actors may also take measures relative to their own conduct. To help illustrate this pathway, I outline several such existing measures. In doing so, I invite readers to inventory and peruse these types of steps in order to assess whether the nature or character of increasingly complex socio-technical systems reliant upon war algorithms and data may warrant revitalized commitments or adjustments to existing measures — or, perhaps, development of new ones. I outline things like enacting legislation necessary to prosecute alleged perpetrators of grave breaches, making legal advisers available to the armed forces, and taking steps to prevent abuses of the emblem. Finally, international actors may take measures relative to the conduct of others. To help illustrate this pathway, I outline some of the existing steps that other States, international organizations, and non-state parties may take to help secure respect for the law by those undertaking the conduct. These measures may include things like addressing matters of legal compliance by exerting diplomatic pressure, resorting to penal sanctions to repress violations, conditioning or refusing arms transfers, and monitoring the fate of transferred detainees. Concerning military partnerships in particular, I highlight steps such as conditioning joint operations on a partner’s compliance with the law, planning operations jointly in order to prevent violations, and opting out of specific operations if there is an expectation that the operations would violate applicable law. Some themes and commitments cut across these three pathways. Arguably, respect for the law turns in no small part on whether natural persons can and will foresee, understand, administer, and trace the components, behaviors, and effects of relevant systems. It may be advisable, moreover, to institute ongoing cross-disciplinary education and training as well as the provision of sufficient technical facilities for all relevant actors, from commanders to legal advisers to prosecutors to judges. Further, it may be prudent to establish ongoing monitoring of others’ technical capabilities. Finally, it may be warranted for relevant international actors to pledge to engage, and to call upon others to engage, only in armed-conflict-related conduct that is sufficiently attributable, discernable, and scrutable.

The article discusses the history of social entrepreneurship development in Russia. The concept and activities of a new social project in the country are being studied, legal regulation of entrepreneurial, social legal relations of subjects of law is being studied. Particular attention is paid to the requirements for the establishment of separate legal regulations for social enterprises. In the future, the author identifies a change in the vector of development of social entrepreneurship in the Russian Federation and assistance from the state in various priority areas in order to develop economic entities. It is proposed to improve some articles of the current legislation and, at best, to adopt a separate federal law "On Social Entrepreneurship of the Russian Federation."

China is the subject of Western criticism for its supposed disregard of the rules-based international order. Such a charge implies that China is unilateralist. The aim in this study is to explain how China does in fact have a multilateral approach to international relations. China’s core idea of a community of shared future of humanity shows that it is aware of the need for a universal foundation for world order. The Research Report focuses on explaining the Chinese approach to multilateralism from its own internal perspective, with Chinese philosophy and history shaping its view of the nature of rules, rights, law, and of institutions which should shape relationships. A number of case studies show how the Chinese perspectives are implemented, such as with regards to development finance, infrastructure projects (especially the Belt and Road Initiative), shaping new international organisations (such as the Asian Infrastructure Investment Bank), climate change, cyber-regulation and Chinese participation in the United Nations in the field of human rights and peacekeeping. Looking at critical Western opinion of this activity, we find speculation around Chinese motives. This is why a major emphasis is placed on a hermeneutic approach to China which explains how it sees its intentions. The heart of the Research Report is an exploration of the underlying Chinese philosophy of rulemaking, undertaken in a comparative perspective to show how far it resembles or differs from the Western philosophy of rulemaking.
