This essay considers Mary Shelley's The Last Man (1826) as intervening in the ongoing debate between Thomas Malthus and William Godwin. Malthus published An Essay on the Principle of Population (1798) in large part as a response to Godwin's Enquiry Concerning Political Justice (1793) and “Of Avarice and Profusion” (1797); Godwin later wrote an extended refutation of Malthus in Of Population (1820). Mary Shelley uses The Last Man, a story of the end of the human species, in part as a meditation on the merits of Malthus's philosophical positions in the Essay on the Principle of Population, but she seems to disagree with a number of the mechanisms he identifies: in contrast to Malthus, Shelley identifies a blind and random nature rather than any divine plan as controlling population change, and disease rather than food scarcity as the primary cause of population reduction, but insists upon the importance of individuating and empathizing with the suffering.

On 11 July 1996, the International Court of Justice, in its third Substantive decision and first Judgment in respect of the dispute brought before it by Bosnia and Herzegovina (Bosnia or BH) against the Federal Republic of Yugoslavia (Yugoslavia or FRY) under Article IX of the 1948 Convention on the Prevention and Punishment of the Crime of Genocide, dismissed all the preliminary objections that had been raised by Yugoslavia, as well as several additional bases of jurisdiction invoked by Bosnia. The Court also found that it had jurisdiction to adjudicate upon the dispute and that the application filed by Bosnia on 20 March 1993 was admissible. It thus positioned itself, over three years after the application had been filed, to resume the proceedings to consider the case on its merits, though still on an somewhat lcisurely schedule.

Abstract:Aaron Ancell and Walter Sinnott-Armstrong (A&SA) propose a pragmatic approach to problems arising from conscientious objections in healthcare. Their primary focus is on private healthcare systems like that in the United States. A&SA defend three claims: (i) many conscientious objections in healthcare are morally permissible and should be lawful, (ii) conscientious objections that involve invidious discrimination are morally impermissible, but (iii) even invidiously-discriminatory conscientious objections should not always be unlawful, as there is a better way to protect patient rights. Pursuant to (iii), A&SA propose a framework that legally allows discriminatory conscientious objections, but that shifts the financial costs associated with such objections from patients to the clinics that employ doctors who discriminate against patients. Though their proposal is controversial, it has attractive features, and merits further discussion. In this paper, I remain neutral on the third claim A&SA advance in support of their proposal, but point out a problem with the two first claims. In the light of my criticisms, I propose to modify their proposal so that costs are shifted to clinics in a broader range of cases.

On November 8, 2019, the International Court of Justice (ICJ) delivered a highly anticipated judgment on the preliminary objections raised by the Russian Federation with respect to the lack of the Court's jurisdiction over the claims brought by Ukraine under the Convention on the Elimination of All Forms of Racial Discrimination (CERD) and the International Convention for the Suppression of the Financing of Terrorism (ICSFT). The Court overwhelmingly rejected all of Russia's preliminary objections under both Conventions and confirmed the admissibility of Ukraine's claims under the CERD. Therefore, Ukraine's case will be heard on the merits in its entirety.

Prioritarianism is the view that we ought to give priority to benefiting those who are worse off. Sufficientism, on the other hand, is the view that we ought to give priority to benefiting those who are not sufficiently well off. This paper concerns the relative merits of these two views; in particular, it examines an argument advanced by Roger Crisp to the effect that sufficientism is the superior of the two. My aim is to show that Crisp's argument is unsound. While I concede his objections against the particular prioritarian views that he considers, I propose a different version of prioritarianism that is invulnerable to those objections.

This case note examines the findings of the Tribunal in the Decision on Jurisdiction in Adamakopoulos v. Cyprus, focusing on Respondent’s objections based on the alleged incompatibility of the BIT S and the EU Treaties, and the mass claim nature of the proceeding. The decision of the majority of the Tribunal in dismissing the EU law objection adds to a body of investment arbitration jurisprudence in which similar reasoning has been used to dismiss comparable objections. However, the dissenting opinion of Marcelo Kohen is the first time that an arbitrator, presented with an intra- EU investment arbitration claim, has considered that the tribunal lacks jurisdiction on the basis of the incompatibility between the relevant BIT S and EU law. Furthermore, Adamakopoulos is one of the few ‘mass claim’ arbitrations brought under the ICSID Rules. If it proceeds to the merits stage as planned, it will provide an opportunity for the Tribunal to resolve questions regarding the management of the procedure under the ICSID framework with such a large group of claimants, whilst maintaining the right to be heard, procedural equality and fairness.

Not a single arbitral award was issued in 2021, and the only case decided by the International Court of Justice was on the merits in the maritime dispute between Somalia and Kenya. Finally, a Special Chamber of the International Tribunal for the Law of the Sea rendered a judgment on preliminary objections in the maritime dispute between Mauritius and the Maldives.

Trust in transformational leadership is related to motivation, self-enhancement, and positive job outcomes. Trust in the leader-follower relationship, from the perspective of subordinates, has yet to be examined. Trust is considered an important factor when seeking to improve the chances for organizational success and positive job outcomes. The merits of trust in transformational leadership were addressed in this qualitative case study for the purpose of understanding the value of trust in leader-follower relationships viewed from the experiences of subordinates. Interviews were conducted with 30 participants from 2 organizations within the Newton and Rockdale counties located in the state of Georgia; the chosen sample size was an exhaustive representation of those interviewed and conveyed the depth and breadth of participants'. Research questions addressed how subordinates perceived trust in their leaders and how leaders put into practice trust in their leader-follower relationships. Questions were analyzed using open and axial coding and the following themes emerged: perseverance, effective communication, feedback, commitment, confidence, unity, dependability, exemplary leadership, helpfulness, and satisfaction. Some connections were made between trust in transformational leadership and subordinates' views of their trust in leaders. By implementing these practices and hiring managers with transformational behaviors, organizations can help succeed in engaging employees to promote trusting relationships and encourage future research in the leadership management field. This study may affect positive social change by demonstrating how trust can be created by both leaders and followers: these findings may also contribute to the expansion of new leadership development training programs.

The act of applying makeup is a ritual shared by many, often beginning at an early age. Though makeup is presented as a final product in the public sphere, the process of applying makeup can be just as, if not more important. This thesis acts as the theoretical basis for my digital art project, Facing the World. My work gives insight into the lesser understood motivations behind wearing makeup while shedding the stigma that wearing it is merely a superficial act or sign of vanity. The project Facing the World presents the makeup routines and personal narratives of seven women to uncover the merits of cosmetics as a means of identity creation, self-care, and mindful reflection. The work is exhibited as a single channel looped video of approximately twenty minutes with the corresponding subject’s audio portion played over headphones.

Earlier identification of autism allows for interventions to begin during toddlerhood. Literature suggests that parents are an important part of very early intervention and specific goals have indicated that they are important to progress. The use of telemedicine may increase access to interventions. The purpose of the study was to evaluate a parent-toddler training program that targeted social-communication skills and incorporated a telemedicine component. Measures included parent teaching targets, child attending, vocal requesting, and coordinated joint attention and the parent's response to coordinated joint attention. Results indicate that parent teaching increased, child attending and vocalizations increased, child coordinated joint attention increased, and the parent's response to coordinated joint attention was primarily social in nature. Analysis of the home observations indicates that direct in home observations or teleconference observations neither under or overestimated behaviors. The results are discussed in the context of teaching and feedback delivery and selection of teaching targets.

In this paper, we present a paradigm which prescribes a procedure for a systematic design, analysis and development of nanopositioning devices. In this effort, we have used many tools from modern control theory to model devices, to quantify device resolution, bandwidth, range, and robustness, and to tackle undesirable nonlinear effects such as hysteresis and creep. The implementation of this procedure for the simultaneous achievement of robustness, high precision, and high bandwidth objectives is presented. The merits of the paradigm are demonstrated through experimental results.

Case studies are used in design research to analyze a phenomenon, to generate hypotheses, and to validate a method. Though they are used extensively, there appears to be no accepted systematic case study method used by design researchers. Considering its nature and objectives, the case study method could be considered as a suitable method for conducting design research. Many times, design researchers have to confront questions about the validity of using case studies and their results. The objective of this paper is to present a brief overview of case study method, compare it with other qualitative and quantitative research methods, and study the merits and limitations of using the same in design research. Requirements are derived from the general characteristics of design research. Four popular research strategies are evaluated with respect to the requirements. A preliminary benchmark study suggests that case study method is a suitable method for conducting design research.

Abstract Throughout history there have been a variety of accuracy measures applied to the act of throwing, hurling, launching and/or firing of objects. These include string measure, mean radius, extreme spread, closest to center, probability of hit and score. There are two objectives of the present contribution. The first is expository in nature, to describe the use and relative merits of these measures. Historical data will be examined to estimate the accuracies of such weapons as the trebuchet (a technologically advanced form of a catapult), longbow, smooth bore rifle, “Kentucky” muzzleloading rifle, early breech loading rifle and turn of the century schuetzen rifle. Data related to modern military and sporting firearms will also be discussed. The second objective is to illustrate the use of such measures by evaluating actual data from firings of a scale model of a trebuchet. The model was designed using computer simulations and optimization techniques developed by others.

The paper first reviews different interpretations of robustness. On this basis objectives facilitating the quantification of robustness of engineering systems are formulated. Thereafter a generic framework for risk assessments of engineering systems is presented in which robustness is related to the ability of the system to sustain damages. This framework is then applied to quantify robustness of structural systems and to develop a robustness index facilitating a consistent ranking of structures according to their robustness. The proposed approach to the assessment of robustness principally takes into account the effect of redundancy, ductility, damage and failure consequences as well as strategies for condition control and intervention during the service life of structures. Finally, a simple example illustrates the use of the framework for the assessment of the robustness of a jacket steel structure subject to fatigue damage. The example shows that presently used indicators for the robustness of jacket type steel structures such as the RIF only capture part of the picture and illustrates the merits of a risk based framework for robustness assessments.

We examine some basic attributes of, and challenges in, modeling of the mechanical behavior of materials and structures in microelectronics and photonics (mainly fiber optic). The emphasis is on the role that methods and approaches of Structural Analysis should play (and, in effect, have played) in the design, manufacturing, testing and operation of micro- and opto-electronics assemblies, packages and systems. The objectives, merits and shortcomings of Structural Analysis (analytical modeling) are addressed, as well as the interaction between the analytical (“mathematical”) and numerical (mostly, FEA) modeling. We discuss also the interaction of the theoretical and experimental approaches, which should complement each other, when there is a need to design, build and operate a viable and reliable micro- or opto-electronic system. The review is based primarily on author’s work carried out during his tenure with Ball Laboratories, Physical Sciences and Engineering Research Division, and is a revised, updated and expanded version of an invited lecture presented several years ago at the RPI. It is carried out in connection with the author’s 2004 ASME award (Worcester Warner Reed Medal) “for outstanding contributions to the permanent literature of engineering through a series of papers in Mechanical, Microelectronic, and Optoelectronic Engineering, which established a new discipline known as the Structural Analysis of Microelectronic and Photonic Systems”.

Noticing the conclusion of the Preliminary Objections Judgment in the case of Mauritius vs. Maldives Maritime Delimitation, this paper asks whether the Special Chamber’s decision has resolved the sovereignty dispute over the Chagos Archipelago. It re-examines the conclusion that the continued claim of the United Kingdom to sovereignty over the Chagos Archipelago is a mere assertion and the UK has no legal interest in it. This paper argues that the legal system has a self-reproducing nature by which the Special Chamber regenerates decisions already established in the legal system as the distinction between lawful and unlawful is the most fundamental determination of this system. In this sense, the confirmation of the Advisory Opinion of the International Court of Justice by the Special Chamber should be regarded as a consequence of its subjectivity and the fact that it almost distinguishes the legal system from other systems outside the law. From a perspective outside the legal system, the claim of courts that its role of “dispute settlement” is more like “case settlement”, since courts are resolving disputes after legalization, not the disputes themselves. The de facto settlement of disputes should be based on the elimination of the interests or claims of the disputing parties. In this sense, dispute settlement depends on how the legal and political systems work together in a coupling relationship.
