The essay brings together the results of two researches carried out within the project: Limen, Languages of Notarial Mediation between the Middle Ages and the Modern Age, presented in July 2019 at the Extraordinary Call for Interdepartmental Projects of the University of Milan and considered worthy of funding with the recognition of the Seal of excellence in 2020. In ricordo di Dino Puncuh, a cura di Denise Bezzina - Marta Calleri - Marta Luigina Mangini - Valentina Ruzzin, Notariorum Itinera Varia 6, Società Ligure di Storia Patria, Genova 2022) the Author used the hermeneutic tool of the ‘function’ of mediation to connect the results of the historical-legal research with those equally in-depth of the historians of society, institutions and the economy. Thus the medieval notary’s activity emerges from the examination of testimonial depositions, mortis causa deeds and contracts of writing and discipleship: the notary was protagonist of the institutional, social and economic life of the medieval municipality and also a spiritual and family mediator in his customers’ most intimate and personal life.

Résumé :
This study intends to analyse the participation of the married woman and the widow in the notarial public deed of the 16th century, in Spain, in light of the notarial forms and treatises of the time and the process itself of executing a notarial public deed. Visigothic Law would gather, to certain extent, Roman limitations and the openness brought by the Christian doctrine, resulting in the different legal systems of High Medieval times, when the married woman needed a licence from her husband in order to act. Spanish Law 56 of Toro would regulate the marital licence as a general system and compulsory requirement for the valid intervention of the married woman. In the beginning of the 16th century, not a few women executed notarial deeds and wrote royal letters related to registering as residents, returning properties and shortening litigations.

This paper examines the links between Classical (Ciceronian) rhetorical theory and the teaching of medieval Latin prose composition and epistolography between the eleventh century and the renaissance, mainly in Italy. Classical rhetorical theory was not replaced by dictamen, nor was it the “research dimension” of everyday dictaminal activity. Rather Classical rhetorical theory, prose composition and epistolography responded to distinct market niches which appeared from time to time in different places as a consequence of social and political changes. Boncompagno's apparent setting aside of Ciceronian rhetorical theory in favour of stricter notarial and dictaminal procedures was in turn superseded by his successors who chose to enrich their notarial theory with studies of classical rhetoric. Classical rhetorical theory proved influential on dictaminal theory and practice. Dictamen was not ousted by classical rhetoric. It only really declined when growing lay literacy and the use of the vernacular combined with the autonomous professionalism of the legal training institutions to erode the privileged position occupied in medieval times by the dictatores.

Résumé :
AbstractThis article asks a simple question that nevertheless has broad implications for historians of premodern continental Europe: What did notaries do? It answers it by applying descriptive statistics, principal component analysis, and clustering techniques to the typological distribution of all deeds preserved in the notarial collections of six French and Italian cities—Paris, Toulouse, Mende, Turin, Florence, and Livorno—for the year 1751, as well as smaller datasets for other dates and locations. The results of this analysis are surprising. In spite of a high degree of consistency in the notarial profession and terminology (a trait that facilitates our comparisons), the notarial style of each city varied greatly. Variations within a single state were sometimes greater than those across state borders. Both supply and demand of notarial services differed from city to city. Overall, our conclusions are as important as the methodology that we adopt to reach them. Our aim is to offer a replicable analysis that puts quantitative methods in the service not only of the study of a source (notarial records) that is widespread across late medieval and early modern continental Europe and its overseas empires but also of a renewed comparative social history that does not shy away from the heterogeneity of primary sources.

This study explores the experiential dimensions of apprenticeship and work as part of the adolescent life phase in fourteenth-century Montpellier on the basis of approximately two hundred surviving notarial contracts. The strong role of family in apprenticeship of young men and women, the acquisition of specific occupational skills, character formation, and the well-being of the apprentice/worker are discussed. Apprenticeship for Montpellier youth represented a lengthy (early teens to late twenties) and elaborate transition between childhood and adulthood.

The writer defends the Menéndez Pidal's traditional linguistic interpretation on the language of the legal documents of the Kingdom of León as written in Latin.

If notarial offices in medieval Italian towns had not offered their dual services of commercial law contracts and family law documents on the same premises and in the homes of their clients, perhaps the cross-fertilization of ideas that created the instruments of trade sustaining Europe’s emerging market economy would not have followed. Italian traders carried the contracts that undergirded long-distance trade across Europe and the Mediterranean Sea leaving a singular mark on economic development. Corresponding effects on families who were involved in trade were dramatic, if unintended.

No obstante, es preciso tener en cuenta que nos hallarnos ante textos escritos de tipo notarial, con un estilo especial y con abundancia de fórmulas fijas, que sólo reflejarán mínimamente toda la variedad de perífrasis que podían darse en la lengua hablada, perífrasis que de hecho se mantienen en la actualidad en amplias áreas dialectales asturleonesas.</p><p>The aim of this paper is to analyze the verbal periphrases with infinitives that appear in documentation from different areas of the ancient Kingdom of León.</p><p>The study is centred on notarial texts mainly from the 13th century and, more specifically, on the over 600 documents that make up the Colección Diplomática del monasterio de Carrizo (León), although Fueros (codos of law) and documents from other Le onese areas like Salamanca, Zamora and Asturias have also been taken into consideration.</p><p>The most commonly occurring periphrases whith infinitives are those that have a modal value. However, it should be remembered that we refer to notarial texts, written in a special style that uses many fixed formula expressions. This reflects only minimally all the varieties of periphrases that could appear in the spoken language and which do, in fact, still appear in wide AsturianLeonese dialectal arcas nowadays.</p>

Résumé :
By piecing together fragments of diverse archival evidence, it is possible to document a large minstrel population in urban settings in late medieval southern France that was able to support itself through a multiplicity of freelance activities and complex working relationships. Information concerning the urban minstrel in medieval Europe is usually drawn from city accounts and contracts providing details concerning the duties, function and wages of civic musicians. In order to create a multi-dimensional image of the urban minstrel, however, a wide variety of archival sources needs to be explored. Such sources – accounts of confraternities, university statutes, city statutes, tax records, property listings, private notarial contracts, among others – have offered glimpses into aspects of the minstrel community that have tended to remain elusive. This essay first establishes the nature of freelance activities, which were central to the urban minstrel's livelihood. Second, the socio-economic status of minstrels will be investigated, to determine how successful musicians were at supporting themselves in the medieval urban environment.

Abstract Fragments of a Hebrew manuscript in thirteenth-century Sephardic script were recently discovered in the binding of a fourteenth-century notarial manual in Perpignan. These fragments are identified here as originating in a copy of Tosafot redacted by a disciple of Isaac ben Samuel of Dampierre. It is suggested that the redactor was Samson ben Abraham of Sens. This find is doubly significant—for the study of Tosafot, and for the intellectual history of medieval Perpignan Jewry.

Abstract This article presents editions of three Arabic parchment deeds of sale from the 4th/10th-century Fayyūm Oasis belonging to two monks, Babā Banīla and Babā Buṭrus, of the Dayr al-Qalamūn monastery. The transactions recorded in our documents are mundane in and of themselves. But put together they offer bits of insight into Christian society in rural medieval Egypt, the notarial practice of provincial Muslim scribes, the relationship between monastic and Islamic legal institutions, and the important but little-attested Dayr al-Qalamūn.

Résumé :
<p>Abstract: In 1917, Josep Masdeu, the monastery archivist of Sant Joan de les Abadesses, identified four songs written down in some blank spaces of a paper-based notarial book of the village. In 1935, Higini Anglès, a musicologist of recognized prestige, made them public and since then, they comprise the songbook of Sant Joan de les Abadesses, the unique troubadour catalogue in Catalonia including both the text of the songs and their equivalent musical notation to be performed. From that moment on, the manuscript has been studied in many occasions from a linguistic and musical point of view. The manuscript, currently preserved at the National Library of Catalonia, includes some other text passages of legal topics which we analyse in depth because they delimit the exact chronological period of the song writings. Our study, therefore, has been focused on three main purposes. In the first place, we revise the contributions made so far regarding the description of the document. Next, we build up the archivistic history of the manuscript, from the moment it was discovered until it was deposited in the library mentioned above. Finally, we frame the overall context of the songbook production based on the extraliterary and extramusical texts.</p><p><br />Keywords: Troubadour songs, Medieval manuscripts, Medieval songbook, Sant Joan de les Abadesses Archive, Court books, Notarial -<br />History.</p>

AbstractGenoa was involved since the 13th century in the commercial activities in the region around the Black Sea (Caffa, Pera, Kiliya, etc.). Numerous texts of that time written in Latin (especially old notarial records) have survived to our days. As the region was a melting pot of traders and travelers from East and West, the sources also contain some interesting lexical borrowings from Arabic. The present article illustrates this phenomenon on the basis of selected examples from the edition of Gheorghe Ioan Brătianu (Actes des notaires Génois de Péra et de Caffa de la fin du treizième siècle, Bucarest, Cultura naţională, 1927) which so far has not yet been taken into account in linguistic research.

Résumé :
This communication is something of a paradox. The project I am going to discuss here concerns an issue I have been working on for years, but on the other hand it is very much work in progress –and for technical reasons the progress is unfortunately much less advanced than I thought it would be when I first planned my contribution.First of all, the map illustrates what I mean by the term ‘notarial societies’ –mostly the world of the Greek islands – both along the western coast (Ionian islands) and the central Aegean (Cyclades and others), as well as in the south (Crete). The fall of Constantinople (1453) confirmed the Ottoman dominance on the major part of the former Byzantine Empire. However, some islands remained in Venetian hands or under various Latin lords affiliated with Venice (Khios with Genoa): major examples are Crete (until 1669), the Cyclades (to 1566) and the Ionian islands (to 1797). During the 17th century the Venetian presence was still strongly felt in the region. But the local population was – and remained – predominantly Greek in language and Greek Orthodox in religion. Those societies preserved the notarial tradition throughout the period and part of the vast amount of notarial acts has survived, throwing light on aspects of the social life about which there is very little evidence for the ‘non notarial’ parts of the region. Thus, the term ‘notarial societies’ designate those parts of the post Byzantine Greek world that preserved the medieval notarial tradition up to modern times. The extant notarial documents, therefore, outline the realities of populations, which in their majority shared a common language, religious creed and cultural (Byzantine) heritage. At the same time these were societies with differing physical characteristics, varying historical experiences, and different political and administrative framework, which moreover were subjected to variable cultural influences. All these factors are reflected in the significant regional variations that can be observed: take the example of the types of law regulating notarial practice, which offer a vital key for the interpretation of the information gleaned from the documents. At any given place the prevalent legal system might be any mixture of disparate elements: the Venetian law, in territories held by Venice; the customary law, which regulated most legal relations in regions like the Cyclades; and other influences, such as the feudal Frankish code used by the Latin rulers of formerly Byzantine lands; also, the canon law (which was in effect a continuation of Byzantine legal theory and practice) or the Islamic law, in places where Muslims had settled in large numbers.

The authors focus on the issue of urban elites in two Adriatic cities, Rab and Rovinj, which differ in their origins and development alike. Rab is an ancient civitas, while Rovinj was classified as a terra in the Venetian administrative system. The two cities also differ in the amount of their preserved written sources. Whereas the medieval sources for Rovinj are only sporadic, for Rab there are a number of notarial books from the late Middle Ages, which allows for a different approach to the spatial identification of urban elites than in Rovinj’s case. Based on the available sources, the paper compares the development, significance, and status of urban elites in both cities

Résumé :
Summary During the late Middle Ages, the organisation of voluntary jurisdiction in the customary regions of the Southern Low Countries was strongly determined by local developments. While it thrived in the major bishoprics of Liège and Tournai as well as in the commercial centers of Flanders and Brabant, historiography long assumed that the notary public failed to integrate into society in the rural county of Hainaut. Competition with the more dominant aldermen and comital vassals or hommes de fief supposedly prevented notaries from institutionalising their role as private legal intermediaries. Yet, the long-held top-down perspective disregarded interactions between, and the mutual competition among these different ‘agents’, thus creating a unilateral view that emphasised the importance of existing or indigenous alternatives. This contribution aims to better comprehend the organisation of late-medieval voluntary jurisdiction in Hainaut, taking the co-existence of public notaries and hommes de fief into consideration. From a bottom-up approach, relying on contemporary documentary writing practices, it will demonstrate how they both employed pragmatic literacy to gain authority, claim fides publica, and consolidate their own institutional position as such. This paradigm shift offers a framework that nuances previous insights regarding the reception of and developments within the notarial office in late-medieval Hainaut.

Résumé :
AbstractThis article describes how Islamic and Frankish legal devices complemented each other and were even combined to settle disagreements in the late medieval Middle East. For this purpose, it focuses on two legal institutions that provided responses to the biases of Islamic law against non-Muslims and to the prejudices of Franks against the local law. The first are the notaries sent to the Mamluk cities by the Venetian government to draw up legal documents and to support the transactions of Venetian merchants. The second are the new royal orsiyāsacourts implemented by the sultans, where justice was dispensed by government officials instead of by traditional judges, orqāḍīs. Specifically, the article discusses, in a comparative manner, what constituted proof for Christians and Muslims, whether minorities could bear testimony or not, and how notaries and judges dealt with unbelievers. A common notarial culture, together with the expansion ofsiyāsajurisdiction over the affairs of foreigners, brought about a much deeper legal interplay than has previously been understood. Ultimately, it is argued that Mediterranean medieval societies had evolving attitudes toward justice and diversity, and approached their own legal traditions in ways compatible with the conflict resolution, while constantly borrowing legal concepts about difference from each other.

Résumé :
Abstract In Medieval Latin, the adjective armelinus, -na and the noun armelinus are attested in notarial documents and other texts from different regions of Western Europe, in a wide chronology. At first glance, both the name and the adjective are related to the classical Latin demonym Armenius, but this etymon does not explain several aspects of its form and function. The present paper reviews all the etymological hypotheses suggested so far and arrives at the proposal that armelinus could be the result of the adaptation of the Andalusian Arabic armaní ~ arminí ‘Armenian (tissue)’, after converging semantically with armini ~ ermini, derived from the Latin armenius ‘(skin of the) Mustela ermine’. The authors suggest that both terms – adjective and noun – could arise in the territories corresponding to the linguistic domain of Catalan and that they passed from there to Italy and the rest of Western Europe.

Abstract: Whereas we have come to find a substantial increase in the number of studies focusing on medieval queens in recent years, less attention has been paid to those who became widowed. This article’s aim is to conduct a detailed analysis of the prolonged period of time that Margarita of Prades remained a widow (1410-1430), a considerably long period when compared to her short reign which lasted for just over eight and a half months. A wide range of largely unpublished sources kept in royal, papal, nobilty, notarial and municipal archives will provide us with the information needed to recreate a reality marked by the severe and recurring financial difficulties faced by this short-reigning queen. Résumé :
Notarial signs serving to authenticate private and public legal documents emerged in Dalmatia during the 12th century, and by the late Middle Ages they had become a mandatory part of official documents written on parchment for the legal parties. These signs were graphic as a rule: more or less elaborate drawings with decorative motifs, occasionally with integrated typography, yet without any figural elements. Among the very diverse forms of notarial signs preserved in Croatian archives, that of Split’s canon and Zadar’s notary Helias deserves special attention: instead of using a simple graphic symbol, he depicted a young man’s torso, which for several reasons may be presumed to be his self-portrait. More than fifty notarial signs by Helias have been preserved, but it may be presumed that he produced more than a thousand during more than two decades of his career as a notary. These signs are drawing of very small dimensions (3 x 1.5 cm on the average) and most probably not a result of “artistic” ambition, presuming that such terminology applies at all to the visual production of the time. As many other literate men, Helias probably indulged in drawing and incorporated some of this inclination and skill into his work in a peculiar manner. Over the period of two decades, the depicted figure went through several transformations. Starting from a relatively realistic and quite detailed depiction, in the second phase Helias simplified the drawing and enhanced its elements of caricature, ending with a partially stylized and unified version of his sign. Generally speaking, his drawings were closer to the genre of caricature than an official visual representation, which is why he could style them rather freely as compared to the norms that could be observed in the professional circles, especially in the monumental painting of the 14th century. Despite the fact that they seem somehow timeless, their visual features indicate certain knowledge of the formal language of representative painting. Helias’s skilful handling of lines and the ease with which he used a minimum of expressive devices to outline not only the portrait itself, but also the psychological characteristics of the depicted person, are basically a legacy of Gothic visual culture. Self-portrait as a form, albeit absent at least declaratively from medieval monumental painting, was nevertheless present, even if quite rarely and only in isolated cases, in medieval miniature painting (e.g. the self-portraits of St. Dunstan, the notary Vigil, the painter Hildebertus and his assistant Everwinusa, friar Rufillus, the nun Gude, the miniature painter Matthew Paris, or the illuminator Richard de Montbaston and his wife Jeanne). Nevertheless, the paucity of such examples, as well as the spatial and temporal (partly also cultural) distance, makes it difficult to assess the place of Helias’s self-portraits within a broader context. In any case, the group of some fifty portraits from the 14th century, regardless of their dimensions and character, is certainly a peculiar phenomenon in the context of European visual culture. The key point is thereby not the artistic quality of the drawings, but rather the variety of visual communication in 14th-century Dalmatia.

Résumé :
AbstractThe marital property regimes, inheritance practices, and kinship structures of Renaissance Italy and early modern Portugal were at opposite ends of a spectrum. In Italy, the legitimacy of marriage was defined as the outcome of dowry exchange governed by exclusio propter dotem, thus conceptually linked to the disinheritance of daughters and wives. In Portugal, where the Roman principle of equal inheritance was never abolished, domestic unions qualified as marriages insofar as joint ownership was established. Kinship structures were rigidly agnatic in Italy, but cognatic, even residually matrilineal, in Portugal. An investigation of notarial records from Lisbon, Venice, and Florence shows how women's capacity for full legal agency as property owners in both societies differed. Female legal agency, however, whether measured by women's capacity to engage in property transactions independently of their marital status (Portugal), or as the manipulation of limited legal resources, even resistance against a system of dispossession (Italy), always unfolded within the context of larger agendas that were beyond women's control, such as the processes of state formation in medieval Italy and empire-building in Portugal.
