Od 1 lipca 2018 r. obowiązują przepisy ustawy z 24 listopada 2017 r. o imprezach turystycznych i powiązanych usługach turystycznych, która reguluje prawa podróżnych za "zmarnowany urlop". Ustawa o imprezach turystycznych zastąpiła poprzednią regulację wynikającą z ustawy z dnia 29 sierpnia 1997 r. o usługach hotelarskich oraz usługach pilotów wycieczek i przewodników turystycznych, wprowadzając zdecydowanie szerszy zakres odpowiedzialności przedsiębiorców działających w branży turystycznej, co miało ułatwić poszkodowanym dochodzenie roszczeń. W artykule przybliżono sposób naprawiania szkody za utratę przyjemności z wakacji w poprzednim oraz obowiązującym stanie prawnym. Następnie Autorka przedstawiła przebieg postępowania sądowego, zarówno w sytuacji gdy podróżny zdecyduje się na postępowanie grupowe, jak również gdy indywidualnie wytoczy powództwo. Autorka zwraca uwagę na konieczność właściwego przygotowania się przez podróżnego do procesu cywilnego ze względu na spoczywający na nim ciężar dowodu, omawia także wady i zalety poszczególnych rozwiązań prawnych.

As society develops, the concept of personality rights and their legal protection gain significance over the years. Naturally, this concept is evolving as society changes, and it should protect new personal interests against infringement. At the same time, there are reported instances of granting legal protection with doubtful legal justification. In Poland, many commentators and scholars point out that the courts, in some cases, seem to use the concept of personality rights as a universal tool in order to compensate for nearly any mental distress. In this paper, I wish to present interesting examples of this "search" for new personality rights as tools to compensate the plaintiffs for non-pecuniary damages, along with some controversial cases of granting non-pecuniary damages based on questionable legal justification. Following, I will attempt to clarify the notion of non-pecuniary loss and examine whether the courts try to expand its meaning to grant legal protection to plaintiffs. My analysis will be based on Polish law, with some comparative remarks. As the problem is complex and varies according to the jurisdiction, this paper provides a general illustration of the issue at hand. Abstract: The purpose of this article is to investigate whether non-pecuniary interests of the parties should be protected in contract law and what should be the scope of such protection. The article sheds light on the theoretical framework of contract remedies and claims that the compensability of non-pecuniary loss is necessary for an adequate protection of the interests of the parties to a contract. It further investigates the policy arguments against the recoverability of non-pecuniary loss in contract law and argues that such arguments cannot be considered a sufficient justification for a bar to compensation of moral damages. Finally, based on a survey of case law from several European jurisdictions, the article provides insight into the kinds of non-pecuniary consequences that may arise from a breach of contract. Résumé: L’objectif du présent article est de rechercher si les préjudices moraux des parties devraient être protégés en droit des contrats et quelle devrait être l’étendue de cette protection. L’article examine le cadre théorique des solutions contractuelles et soutient qu’il est nécessaire d’inclure le dommage moral afin de pouvoir protéger de manière adéquate les intérêts des parties à un contrat. Il recherche en outre les arguments politiques réfutant la recouvrabilité du dommage moral en droit des contrats et indique que de tels arguments ne peuvent être considérés comme une justification suffisante pour faire obstacle aux préjudices moraux. Finalement, en se basant sur l’étude de plusieurs affaires portées devant différents tribunaux européens, l’article donne un aperçu de sortes de dommages moraux pouvant provenir d’une rupture de contrat.

Abstract According to art 82(1) of the General Data Protection Regulation (GDPR), ‘any person who has suffered material or non-material damage as a result of an infringement of this Regulation shall have the right to receive compensation from the controller or processor for the damage suffered’. This provision is at the core of the private enforcement of data protection rights; its interpretation could thus have major implications for business, administration and other organisations. Despite its potential for mass litigation, the case law under art 82(1) GDPR is limited and, five years after the Regulation entered into force, several questions remain still unanswered. This paper gives an overview of the most significant issues relating to the right of data subjects to the compensation of non-pecuniary loss, pending five significant CJEU judgments, which are expected to be delivered in 2023.

AbstractThe existing principles of quantification of damages for non-pecuniary losses deriving from breach of contract which are adopted by the courts or advanced in the legal scholarship appear to be arbitrary and founded on certain misconceptions. This paper proposes three different models for assessment based on the consequences of breach. When the performance is possible after the breach, the damages are equal to the value of an alternative subject matter if such is available from elsewhere. If there are no other sources from where the bargained-for subject matter can be obtained, then the amount of the damages is based on the value of a substitutive benefit which leads to attainment of the initial contractual aim. If the promisee has no interest in delayed performance, the damages are quantified with respect to a different non-pecuniary benefit which is commensurable to the one that was pursued with the contract initially.

This thesis' core aim is to develop a coherent conceptual framework for non-pecuniary loss damages in the tort of negligence. This requires an analysis of existing theoretical frameworks, a redevelopment of the 'nonpecuniary loss' concept, and the development of a new basis for the assessment of damages awards. The thesis argues that it is a mistake to preconceive of damages awards as compensatory and analogise to pecuniary losses; the different nature of non-pecuniary losses gives rises to conceptual problems and tensions with practice where this is attempted. This thesis instead separates the identification of non-pecuniary losses from the aims and assessment of damages awards, arguing that the former must be analysed first and independently. A replacement 'personal loss' concept is developed, free from the deficiencies identified and centred on binary events which raise, for a notional observer, detrimental implications about the victim's personal interests. The thesis proposes that a damages assessment based on vindication, whereby awards serve as counterstatements to those detrimental implications, can then coherently engage that personal loss concept to produce damages awards. The resulting theory is uniquely capable of justifying and providing a defensible theoretical framework for recovery for non-financial losses.

Ši tema aktuali tuo, kad plečiantis draudimo įmonių veiklai, atsirandant vis daugiau privalomojo draudimo rūšių, dėl to, iš kitos pusės visuomenei intensyviai vykdant ekonominę veiklą, atsitinka vis daugiau draudiminių įvykių, kuriuose nuostuolius padengti turi draudimo įmonės, savaime suprantama, kad tai kelia nemažai problemų, nes visos draudimo sritys yra pakankamai naujos ir yra nedaug praktikos susijusios su tokių išmokų priteisimu, be to, pats neturtinės žalos įvertinimas ir jos priteisimas Lietuvos teismų sistemoje nėra nusistovėjęs ir sistemiškai aiškiai suformuluotas. Long ago people recognized non-pecuniary damage, as wel as pecuniary losses, which are stemming from physical injuries, death or emotional trauma. All these kinds of damages are hard to estimate and determine though. Despite the fact that some lawyers argue for abolition of compansation for non-pecuniary damage, this sort of damage still seem to be significant dealing with defence of a plaintiff under this rubric in defferent European countries. By the means of legal practice of non-pecuniary nature the person could claim damages for physical and emotional suffering, nervousness, grief, anxiety and ambarrasment. However, non-pecuniary damage should not be identified with pecuniary losses. At this point, the apprehension of non-pecuniary damage is supposed to be linked to the compensation instead of fine. In order to clarify this statement, the most important is that the compensation of non-pecuniary damage, first of all, serves as damage rewarding or as a kind of civil remedy and protection. Although, some voises said that pain and suffering awardas are hard to estimate due to the fact that the damage valuation of these kinds of losses sometimes we just can not figure out properly. The damages discussed start from compensation for non-pecuniary loss in medical liability. In the medical incident, the deliberate practice apply on considering factors and the amount of gold given how the amount of the specific application. Besides, there is any difference between on the amount of gold given in medical events and in traffic incident or not. In research methods, considering factors and the amount of gold given were discussed in this thesis. At beginning, discuss practices in specific cases about what considering factors to determine the final amount of the judgment and make recommendations on this some scholars about the considering factors. Secondly, Discuss reasons for the amount of medical events consolation given is significantly lower, and we have to think whether the results towards the objective, tabular in order to save judicial proceedings resources, giving the parties in assessing whether to seek the basis litigation. One factor is deliberate false. Second is the amount of fixed amount is significantly lower. Although these two issues were discussed separately, but there were also closely. In short, in order to find out the root causes, we still return to considering factors problems. The thesis put forward questions that medical practice has always been deliberate event consolation payments "personal status, economic status and degree of injury both sides" whether all considering factors and the amount of gold are related or not. Besides, judges and the parties need so spend much time and cost to debate. In addition, to further deliberate on the practice of medical events for cases of "special physical victim, the contributory negligence, the offender’s negligence and medical characteristics of the ", whether are all in cases considered? Why do we need to consider factors such reasons deliberate? Whether these factors and consolation given the amount of gold is closely related? Why such deliberate references to specific factors specific cases, but not cited in other cases? The paper believes that there are two main problems in the medical event gold operation consolation in the current practice. Therefore, judges should simplify as "the parties in family status, age and degree of injury victims," other factors are considered in accordance into consideration case by case, but whether and how deliberate judgment should be attached detailed reasons. The main reasons are as follows. Firstly, from among "the plural right person," observed the complex economic situation, education, occupational status is different. However, people get the same amount of gold in the medical judgment. Access to detailed information on the parties in the court of the form, and as a basis for judgment, in essence, the verdict seems to be no impact on the amount of consolation in the different position of the parties in status. Besides, from the "different types of events," observed the medical events obligor''s financial position is strong, compared with the right people in the economic conditions, the obligor''s financial viability property is clearly higher than the rights holders. Compared with the traffic incident, the obligor''s economic situation is clearly better in most medical events, regardless of the legal interest in the infringement life or physical health of legal interest from the terms of the verdict, and the verdict was not therefore a higher amount of discretion. Finally, from the "plural obligor" observation, it does not seem differ among the obligor large hospitals, small clinics or individual practitioner. We cannot interpret the funding of the obligor level would affect the rights of the person to whom compensation amount from the verdict. Secondly, compared practical cases with other civil event types Germany and Japan, people get the right amount is significantly lower. The main reason is that the court deliberate "defendant’s fault", and the number of judgments are not a minority. In other words, the court held that "the defendant was unintentional" as the reason for the amount of gold consolation reduce it. In addition, the court found due to higher medical risk when the damage occurred to blame the medical staff. We should reduce the responsibility of defendants. Finally, the judges think negligence in patients with special physical causes to lessen the responsibility of defendants. These aggravating factors are not a minority practice. This article takes a conservative view. Whether the amount of the form is to be established in the future, the purpose is to avoid the subjective arbitrary and to assist the parties in assessing the results of litigation and litigation costs. However, about the decision of the amount of gold in medical liability, in distinguishing "the Supreme Court established deliberate Factors" and "Supreme Court of deliberate non-factors", we only consider the "family status", "the degree of injury," and "age" by streamlining the considering factors in the former, by the way we also can achieve the target of saving resources. Besides, judges’ subjective choice and considering factors are unrelated, with objective, external attributes, namely, needless to worry the judge’s arbitrary. On the contrary, considering factors in the latter relate to the value of the judge. Judges should theoretically rigorous use, attaching the specific details of the reasons for taking or not. Therefore, we could seek the equilibrium point between consolation gold objectively and judges of arbitrary.

Il titolo di dottore di ricerca è stato conseguito nel mese di dicembre 1995. La tesi tratta , in chiave comparatistica, il tema della risarcibilità del danno non patrimoniale, in un confronto fra l'esperienza inglese, quella statunitense ed italiana. Dopo un'ampia ricognizione delle soluzioni legislative e giurisprudenziali, si propone una lettura critica delle fonti, basata sull'idea dell'ampiezza della categoria del danno non patrimoniale, comprensiva di voci distinte di danno alla persona (come il danno morale o biologico). Infine, si formulano alcune riflessioni circa gli orientamenti prevalenti, sino ai primi anni Novanta, in tema di punitive damages, auspicando un mutamento, nelle soluzioni giurisprudenziali accolte dalle Corti Supreme, nei due ordinamenti di common law considerati, mutamenti intervenuti negli anni seguenti (v. Gore v. BMW of North America, per gli USA, 1996; Kuddus v. Chief Constable of South Leicester Police, per il Regno Unito, 2001). Personality rights are not only the inherent rights for personality achievement but also the foundation that people, as the legal entity, can enjoy all property rights, so that they are the core value to be protected by the Civil Code. In Taiwan Civil Code, the legal basis of non-pecuniary damages in infringement of personality rights was previously provided only in torts; until 1999, when the Part of Obligations of the Civil Code was amended, Article 227-1 was first added. 16 years have passed since Article 227-1 was applied. Whether Article 227-1 has fittingly exerted its system functions and what benefits apart from tort provisions it has brought for the protection of personality rights in Taiwan are the issues worthy of observation and exploration. First of all, in this article, whether there is the real benefit of Article 227-1 better than tort provisions in practice is observed through the statistics and analysis of judgments. Then, it is reviewed whether the legislation way of the mutatis mutandis of tort provisions in Article 227-1 may cause applicable doubts. Besides, for the inappropriateness of the mutatis mutandis of Article 197 short-term limitation period in Article 227-1, it is suggested that in the case personality rights are for contract performance interest, the application of Article 197 should be excluded through teleological reduction. Further, it is noted in this article that personality rights or other legal interests of personality can be the performance interest of contracts; therefore, in addition to incomplete performance, Article 227-1 should be also applicable to impossible performance and deferred performance so that Article 227-1 will be given with the applicable benefit being exclusive of non-performance and independent of torts. At last, in this article, through the concepts of the freedom-of-contract principle, it is attempted to safeguard personality rights or other legal interests of personality more completely in multiple and diversified contract types so as to give Article 227-1 with the positive significance higher than tort provisions.

With the frequent use of vehicles in daily life, the increasing number of traffic accidents has brought cases of disputes over the amount of compensation to be paid for. Therefore, it is the subject of this study on how to develop a more objective calculation method to calculate reasonable and appropriate amount of compensation for the fact that the amount of compensation for non-property damage cannot be evaluated objectively. This study is divided into five chapters. The first chapter is intended to illustrate the research motives, objectives, methods, research structures and expected results. The second chapter discusses the basis of the claim and the characteristics of the traffic accident compensation, and introduces the meaning of infringement, the constituent elements of infringement claim, and its legal effect. Furthermore, the chapter discusses the meaning and nature of traffic accident compensation as well as the amount of discretion. The third chapter looks into the neighboring countries such as Japan and China on their use of calculation methods in determining the amount of compensation claim, their constituent elements of infringement claims, and their calculation for the non-property damage compensation. The fourth chapter analyses our country’s traffic accident court cases in recent years. Whether or not the court’s decision on a case is determined by the impact on victim, the infringement type, victim’s age, medical treatment, and recuperation time. Chapter five is the conclusion and suggestion for this paper. This study formulated a relatively objective and specific way of calculating non-property damage compensation which includes death and injury, and with a view to achieving a reasonable amount of compensation for each victim. Finally, this study put forward a number of suggestions to get more experts and scholars attention for further research, and to develop a more specific and appropriate solution for traffic accident compensation.

A presente dissertação respeita à perscrutação da admissibilidade da compensação de danos não patrimoniais a pessoas colectivas e a sua sistematização orienta-se, de um modo progressivo, pelos obstáculos que se têm erguido à compensação destes danos. Metodologicamente, visa construir um processo argumentativo por etapas, em linha com a dinâmica do próprio sistema de responsabilização civil. Damages for personal injury The diploma thesis focuses on the analysis and evaluation of the recodified legal regulation on damages for non-pecuniary loss arising from personal injury in the light of its comparison with the relevant English common law. On the background of the historical evolution of the method for assessing the amount of damages for non-pecuniary loss arising from personal injury, as well as through the comparison of Metodika Nejvyššího soudu k náhradě nemajetkové újmy při ublížení na zdraví (bolest a ztížení společenského uplatnění podle § 2958 občanského zákoníku) with Guidelines for the Assessment of General Damages in Personal Injury Cases, the diploma thesis arrives at a conclusion in favour of the development and application of the former, which it deems to have been a suitably chosen pre-emptive measure that would allow Czech legal practice to approach damages for non-pecuniary loss arising from personal injury in a consistent and proportionate fashion right from the moment of the coming into effect of Act No. 89/2012 Coll., the Civil Code, without having to overcome a period of relative legal uncertainty, during which standardised amounts of damages would have been developed through judicial practice, as was the case in the English common law.
