During the latter half of the eighteenth century, opposition to the sexual theory intensified among social and religiously conservative asexualists who felt threatened by the political theories of the Enlightenment. For some, the Linnaean system was a stalking horse for libertinism, radical Jacobinism, feminism and anarchy. They maintained their ideological purity citing philosophical, religious and pedagogical reasons for rejection. Among the opponents were the Marquis de Condorcet, Hans Möller and William Smellie. Lazzaro Spallanzi and Charles Alston tried, but failed, to repeat Camerarius’s experiments. Flowers were so feminized symbolically the idea that most flowers were hermaphroditic seemed perverse, but Mary Wollstonecraft attacked hyper-feminine poetic metaphors for women as inimical to the struggle for equality. Meanwhile, hybridization experiments by Joseph Gottlieb Koelreuter eliminated the last rational objection to the sexual theory and demolished the preformationist theory, in both ovist and spermist versions. Christian Konrad Sprengel laid the foundation for floral ecology.

‘Populism’ unites different political positions and strategies that can’t be summed up in a concept which clearly encapsulates all those heterogeneous phenomena. The contributions in this volume therefore address a strategic space in which analyses of populist movements also locate themselves. They, too, take a stance on the problem of democratic representation when they deal with the populist reference to the ‘people’. Social conflict scenarios and the problems of democratic legitimation strategies and functional processes must be taken into account when discussing the populist challenge. This makes critical positioning or the appeal to an enlightened form of rationality difficult: they remain entangled in problems of authorisation and representation; they refer to justifications which presuppose that common ground which threatens to be lost; and they themselves must be wary of the emotions and resentments that they criticise. Understanding acumen and politics plus German culture and Western civilisation as diametrically opposed is a German disease which Thomas Mann also succumbed to. Initially, Mann did not regard democracy as an appropriate form of government for Germans as they were not able to love politics: he was therefore just one apolitical individual among many. Eventually, Thomas Mann liberated himself from this prejudiced approach to politics and the apolitical, and came to terms with democracy. From then on, he countered radicalism’s propensity to use violence with republican reason, which led to him being treated with hostility, persecuted and forced into exile. Politics, which was originally alien to him, swept its way into his life and forced him to adopt a standpoint on it, without him ever having become a political person or even a political thinker at heart. His comments on politics did not leave West and East Germans unaffected, especially as the idea of a cultural nation, through which acumen suddenly legitimised politics, was one of the few things which held the seemingly irreconcilably divided nations together. In post-war Germany, Thomas Mann increasingly became a ‘Praeceptor Germaniae’ (one of the country’s most eminent teachers). In this book, prominent experts clearly depict his gravitation towards the republic, his road into exile, his fight against Hitler and his influence on a divided Germany. Roads, bridges, aqueducts and canals are amongst the physical infrastructures that allowed Roman dominance over the Empire, while meeting economic, social and strategic needs. Due to their structural role in the management and control of a territory, they must be examined in view of the “longue durée”, which necessarily raises the issue of their regular maintenance and occasional restoration. By studying the interactions between different political and administrative authorities, but also the involvement of private individuals, be they users or riverside occupants, the papers gathered in this volume highlight the rehabilitation procedures of road and hydraulic facilities, but also the prevention strategies against potentially irreversible damages. The validity of human rights can be defended. Those who do not want to choose between the imperial assertion that human rights are a triumphal product of the ‘West’ and the relativistic assertion that they are ‘only’ Western would do well to follow closely the debate about ‘affirmative genealogy’, which Hans Joas developed in his ‘Apology of Human Rights’. Résumé :

The Weimar Constitution marked Germany’s first sortie into democracy, with the Republic intended to be democratic, humane and constitutional and based on the principle of popular sovereignty. However, its election system of proportional representation favoured small parties and impeded the formation of a government, with its final governments being presidential cabinets. Constitutions are often analysed by various academic fields. While philosophy and historiography set the framework for this analysis, constitutional law may be regarded as the principal discipline in this regard. The social sciences are first and foremost concerned with constitutional reality, and there is indeed strong evidence that it was the Weimar Republic’s lack of socio-economic foundations that ultimately caused its demise. This volume is divided into twelve parts (perspectives) and will appeal to readers interested in politics, law, (contemporary) history, sociology and philosophy. Résumé :

Alleviating the tension between security and freedom is a fundamental challenge for a free and democratic constitutional state. How difficult it is to strike a balance between these concepts became particularly clear during the period of terrorism instigated by the German militant group ‘The Red Army Fraction’ in the 1970s. Forty years later the question of the right way of achieving such a balance is no less relevant. However, in view of our increasingly technological and globalised society, the legal questions which have emerged from this conflict require new responses. The documentation from the ‘JuWissDay 2017’ conference confronts this task. It collates articles regarding the need for reform of Europe’s security architecture, the obligation of the German Federal Intelligence Service to respect fundamental rights, the obligation of transparency in risk prevention law, the function of migration law in counterterrorism as well as reflections on the concept of an ‘anticipated state of emergency’ in legislation.
