The era of digital reality offers and shapes new dispute resolution mechanisms, imposes high demands and sets its own rules to be complied with. The introduction of information and communication technologies and artificial intelligence into judicial and out-of-court dispute resolution proceedings in India has shown innovative results quite rapidly. Transformation of digital modes of dispute resolution continues with new research and development of modern technologies that strive for excellence. The purpose of this study is to analyze transformation of digital dispute resolution methods in India, considering the historical evolutionism that led from the Vedic era to the global digital revolution, formation of a hybrid model that combines several modes of dispute resolution - offline courts, online courts and online dispute resolution using digital technologies and alternative dispute resolution methods. However, the digital system is far from being perfect; it has significant drawbacks associated with the risks of cyber-attacks and leakage of personal data containing sensitive confidential and personal information. Besides, the digital literacy of the Indian population located on the periphery is quite low, which greatly reduces the level of trust in electronic courts and online dispute resolution.

Purpose: Due to the flaws in the traditional judicial system, the use of Alternative Dispute Resolution (ADR) methods is gaining popularity among scholars and lawyers around the world. Most scholarly articles have examined the inherent advantages of Alternative Dispute Resolution (ADR) techniques over the traditional judicial processes for resolving different types of conflict. Despite the increasing frequency and classification of conflicts in Nigeria, little research has been conducted on the reasons for, and barriers to, disputants' use of alternative dispute resolution (ADR) systems as viable options. Given the complexity of the nature and structure of disputes in Nigeria, this research delves into the factors that push and pull litigants into the use of Alternative Dispute Resolution (ADR). Methodology: This study utilized an explanatory research approach to investigate the many distinctive kinds of conflicts and match them with the most relevant ADR procedures. In particular, property disputes, family conflicts, and business disagreements were investigated. Findings: According to the findings, Alternative Dispute resolution (ADR) may lead to a considerable reduction in the amount of time and expense of the dispensation of justice that addresses unfairness in the system of criminal justice administration, ultimately resulting in positive social change. Contributions to Theory, Policy and Practice: The study concludes that Alternative Dispute Resolution (ADR) processes have significant potentials for handling the growing number of disputes. However, it is necessary to address their shortcomings as well as facilitate collaboration between the practitioners and the regular courts. It would improve social stability and guarantee satisfaction for the perpetrator, the victim, the community, and society as a whole if this were done. The study recommended, among other things, that the general public and litigants be educated on the inherent advantages of Alternative Dispute Resolution (ADR) in the resolution of conflicts.

The subject of the work is a comparative analysis of the OECD approach and the EU approach to the resolution of international tax disputes. The research is conducted on the basis of the provisions of the OECD Model Tax Convention, the OECD Multilateral Tax Convention, the EU Arbitration Convention and the EU Directive. The purpose of the work is to find the most effective mechanism for resolving international tax disputes in terms of ensuring the protection of taxpayers' rights in the dispute resolution procedure. The methodological basis of the work was made up of general scientific (analysis, classification, synthesis, deduction, induction, analogy), private scientific (system method) and special legal (formal legal and comparative legal) methods of scientific research. The scientific novelty of the work suggests the proposal and justification as a way to increase the effectiveness of the resolution of international tax disputes, the use of mediation in a mutually agreeable procedure with the provision of the taxpayer with the possibility of direct participation in the dispute resolution procedure. Based on the results of the study, the author came to the following conclusions. The practice of applying the mutual agreement procedure and arbitration shows that this dispute resolution mechanism has a number of significant drawbacks. In order to improve the efficiency of dispute resolution, the OECD and the EU are striving to develop mandatory arbitration and do not consider non-binding mechanisms, since they do not guarantee an agreement on the dispute. However, mandatory arbitration cannot be considered a universal instrument, since States see it as a threat to sovereignty. The experience of States that actively use mediation to resolve domestic tax disputes shows that mediation can also become an effective mechanism for resolving disputes at the international level, since it allows the parties to consider various aspects of the dispute from different sides. According to the author's position, the shortcomings of mediation outlined in the doctrine can be mitigated by granting the affected taxpayer the right to participate directly in mediation, presenting his position on the case.

If you look deeper into the substance of arbitration, the regulations are more dominant compared to the regulations regarding alternative dispute resolution. This arrangement is very important regarding the legal capacity of a mediator in carrying out his mediation function. Alternative dispute resolution in Indonesia is a tradition that has been implemented for a long time, such as in customary law in rural communities. An alternative model for resolving disputes in customary law communities is carried out by means of deliberation to reach a consensus. Dispute resolution through mediation is much more effective and efficient in terms of time, energy and costs when compared to dispute resolution through court. the process of resolving disputes through mediation is final and binding. The method used in this research is normative juridical. where doctrinal research is related to mediation within the framework of norms that have been abandoned or there is a legal vacuum. the rules regarding mediation are very simple while the legal requirements are increasing. the substance of the mediation arrangements is incomplete, such as arbitration. National legal product was regulated arbitration and alternative dispute resolution. in addition to being able to resolve civil disputes to general courts, there is also the possibility of submitting them through arbitration and alternative dispute resolution. laws arbitration and alternative dispute resolution such as mediation do not have legal certainty, because the substance of the mediation arrangements is incomplete. This is certainly detrimental to the disputing parties. Supreme Court regulated vacuum law to control this legal proceeding. Alternative forms of administrative-legal dispute resolution are considered in the article based on current legislation. The object of the study is public- legal relations that are formed in the process of resolving administrative-legal disputes. The subject of the research is the theoretical, organizational, legal and applied aspects of public legal regulation of alternative resolution of administrative-legal disputes. The purpose of the research is to build a theoretical model of alternative resolution of legal disputes. The methodological basis is a dialectical method of cognition using special scientific methods. In accordance with a generally systematic approach, comparative-legal, formal-legal methods were used. It is noted that the technology of alternative resolution of a legal dispute can be found out as a specially created and empirically based system of methods and rules of purposeful step-by-step activity in this direction and the very set of alternative forms of dispute resolution with a certain sequence of application. The resolution of administrative and legal disputes by state institutions of non-judicial protection is carried out by state bodies, local self-government bodies and officials whose activities are regulated by national legislation and departmental regulations. Administrative-legal disputes are classified according to the criteria of the bodies that resolve the dispute: those that are resolved in court, administratively, and conciliation procedures. The alternative way of resolving an administrative-legal dispute is proposed to be understood as a procedure for resolving administrative-legal disputes regulated by the norms of administrative and administrative- procedural law, which is not related to the exercise of public-authority powers by entities that are not parties to the dispute. The parties to the dispute may have public-authority powers, and the implementation of alternative resolution of administrative-legal disputes may be an element of administrative competence. Further research will be aimed at determining the possibilities of using digital technologies as an alternative form of administrative dispute resolution.

The author took the example of the case of PT Holcim Indonesia Tbk's unilateral layoff of its employees which was resolved through litigation in court. Industrial relations. With the enactment of Law Number 2 of 2004 concerning Settlement of Industrial Relations Disputes, there is a guarantee of protection for workers regarding the basic rights of workers/laborers and guarantees of equality, opportunity and equal treatment without discrimination on any basis.

The labor dispute is one of the most common civil disputes. It can be resolved in the order of the following steps, which include mediation in arbitration, arbitration award, first-instance mediation, first-instance judgment, and second-instance judgment. The process can cease at any step when it is successfully resolved. In recent years, due to the increasing rights awareness of employees, the number of labor disputes has been rising annually. However, resolving labor disputes is time-consuming and labor-intensive, which brings a heavy burden to employees and dispute resolution institutions. Using artificial intelligence algorithms to identify and predict the critical path of labor dispute resolution is helpful for saving resources and improving the efficiency of, and reducing the cost of dispute resolution. In this study, a machine learning approach based on Shapley Additive exPlanations (SHAP) and a soft voting strategy is applied to predict the critical path of labor dispute resolution. We name our approach LDMLSV (stands for Labor Dispute Machine Learning based on SHapley additive exPlanations and Voting). This approach employs three machine learning models (Random Forest, Extra Trees, and CatBoost) and then integrates them using a soft voting strategy. Additionally, SHAP is used to explain the model and analyze the feature contribution. Based on the ranking of feature importance obtained from SHAP and an incremental feature selection method, we obtained an optimal feature subset comprising 33 features. The LDMLSV achieves an accuracy of 0.90 on this optimal feature subset. Therefore, the proposed approach is a highly effective method for predicting the critical path of labor dispute resolution.

Rule of law and ADR are one of the benchmark in determining the underdeveloped world from the developed. Therefore, in today’s contemporary world, the role and application of alternative dispute resolution (ADR) is increasingly attracting attention in legal and academic discourses. Its application in various jurisdictions particularly is said to strengthen the rule of law. From a development perspective, the main aim of ADR is to increase the possibilities and opportunities for the underprivileged to attain maximum social, economic and legal rights in their daily lives. This in turn helps the rule of law to sustain and consolidate contributing to human security, well-being, and dignity- a vital component for progress and socio-economic developed. ADR modes in a supplementary component in legal domain such as commercial arbitration and court-annexed mediation in civil litigation, also provides immense benefits for development.The purpose of this paper is to briefly review the efficacy of ADR modes in different jurisdictions. It then examines how ADR impacts the rule of law. The paper finds that the adoption of various ADR modes has made a considerable impact in various jurisdictions.

In specific judicial practice, the ODR mechanism has played an important role in the settlement of e-commerce disputes and network disputes. However, ODR is still in the exploratory stage in many aspects, and it is inevitable that there will be some problems. This article focuses on the A priori algorithm and frequent pattern growth algorithm in association with rule mining learning. The shortcomings of A priori algorithm and frequent pattern growth algorithm are described and researched accordingly, and an improved algorithm for learning A priori association rules based on matrix is proposed. By analyzing the international commercial dispute resolution mechanism in the Internet era, this article constructs an international commercial dispute resolution mechanism platform. By analyzing the process of disputes in foreign trade e-commerce transactions, this article proposes a method to automatically capture gateway dispute information through automated management system tools to improve the efficiency of the gateway. The algorithm in this paper scans the transaction database only once, and according to the matrix structure, it performs the logical AND operation of the row vector representing the data item in the matrix, and it learns frequent item sets quickly and accurately. The entire process effectively reduces the time consumption and space occupation required for frequent item set learning. According to the effective measurement method of the association rules, the effective association rules are extracted from the frequent item set. Through the realization of functions such as allocation, viewing, dispute handling, and statistics in the management tool, the progress and processing efficiency of the gateway dispute handling can be effectively managed. In addition, this article gives the dispute handling process of the website itself, adds the process of automatic completion of disputes by buyers and sellers through agreements, and improves the tools of the CS manual handling management system. The data results show that the method in this paper greatly improves the efficiency of handling disputes in foreign trade e-commerce transactions.

Cette thèse explore les facteurs de résistance aux Modes Alternatifs de Règlement des Conflits (MARC) présents au sein des entreprises françaises, en particulier dans les interactions entre gestionnaires et professionnels du droit en situation de litige d’entreprise. Cet ouvrage se compose de trois articles académiques qui proposent des avancées théoriques, notamment en transposant la théorie de l’agence dans les services professionnels, et deux études empiriques. La première lève le voile sur la diversité et le caractère dynamique des relations gestionnaires-juristes et propose des leviers organisationnels visant à promouvoir une gestion efficace des litiges. La seconde lie les comportements individuels des gestionnaires, en particulier en relation avec leurs conseils juridiques, avec l’utilisation et le succès des MARC. Ensemble, ces articles mettent en lumière la notion de coproduction et invitent à seconcentrer sur le comportement des clients de la résolution des litiges d’entreprise. Ils suggèrent que, les MARC se trouvant à la frontière de la sphère de compétence des juristes français, des pratiques efficaces de résolution des litiges nécessitent que les clients s’adaptent, voire des efforts de changement organisationnel. Ces études contribuent à la théorie de la gestion des conflits et participent à la promotion d’une résolution efficace des litiges au sein des entreprises françaises
This dissertation explores resistance factors toward Alternative Dispute Resolution (ADR) that can be observed in French companies, more precisely in relation with the micro interactions between managers and lawyers as they respond to business disputes. It consists of three academic papers that feature new theory developments, transposition of agency theory in professional services, and two supporting empirical studies. The first one unveils the diverse and dynamic nature of manager-lawyer interaction schemes and offers potential organizational levers to promote efficient dispute resolution practices. The second relates manager individual behavior in disputes, especially in relationship to lawyers, with the successful use of ADR. As a whole, this thesis places at the forefront the notion of coproduction and invites to focus on client behavior in business dispute resolution. It suggests that, as ADR lies at the borders of the French lawyers’ sphere of competency, efficient dispute resolution may require adaptation on the clients’ side, as well as organizational redesign. These studies aim to offer new insights for conflict management theory and reflections for the further promotion of efficient resolution of disputes in France

L'hypothèse de l'existence de quatre changements d'échelle (spatiale, temporelle, des coûts et dans le traitement de l'information) en ODR (Online Dispute Resolution) s'inspire de la thèse principale du professeur canadien Marshall Mc Luhan selon laquelle, "le message d'un médium ou d'une technologie, c'est le changement d'échelle, de rythme ou de modèle qu'il provoque dans les affaires humaines". On constate en pratique, une transnationalité renforcée, caractérisée par une nouvelle mobilité internationale, qu'illustre par exemple la délocalisation de certaines procédures extrajudiciaires nationales auprès de centres de médiation et d'arbitrage situés à l'étranger. On relève également la nouvelle célérité de certaines procédures rythmées par le temps électronique des communications. Par ailleurs, les technologies de l'information ont débouché dans certains secteurs sur une massification du nombre de différends et sur la création de centres ODR à grande échelle à même de résoudre ces nombreux différends, notamment grâce à l'apparition de l'automatisation informatique dans le règlement des différends. Les effets des quatre changements d'échelle principaux se manifestent aussi bien sur le plan des principes, que sur celui des règles en ODR, ce qui démontre que ces changements d'échelle sont la caractéristique des procédures en ligne. Les ODR sont des ADR qui ont opéré les quatre changements d'échelle principaux des technologies de l'information. L'étude des ODR est ainsi un exercice d'interdisciplinarité et d'approche comparative et culturelle transnationale.

Le sujet de la thèse est la résolution en ligne des litiges (ODR) et l'objectif de la thèse est de proposer un modèle de système ODR basé sur l'expérience du mouvement de résolution des différends. ODR n’est pas un phénomène isolé de ces derniers temps, mais en raison de l'évolution des conflits et la résolution des différends. Initialement, les différends survenus entre les parties à la proximité géographique et pour laquelle les tribunaux traditionnels sont le principal moyen de résolution. Cependant, comme les gens ont commencé à voyager de plus grandes distances et de communiquer de loin, les conflits ont évolué comme ils ont augmenté en nombre, sont devenus frontière plus complexe et de plus en plus transversale. Résolution des différends évolués en règlement des différends parallèle et alternatif (ADR) a été utilisée. Cependant, les conflits ont évolué une fois de plus quand le monde est entré dans l'ère numérique. Non seulement les conflits sont devenus encore plus transfrontalier, mais de nouveaux conflits sont apparus qui proviennent exclusivement dans le cyberespace. Afin de satisfaire aux exigences de l'ère numérique, la résolution des différends fit sortir le concept de l'ODR. ODR est née de la combinaison de l'ADR et de la technologie de l'information et de la communication (TIC) de l'ère numérique. D'autres moyens de règlement des différends ont été transférés dans le monde virtuel et ont donné naissance à la résolution des litiges en ligne. ADR et ODR sont examinés largement, et l'examen comprend leurs concepts, leur origine, les principales formes de négociation, de médiation et d'arbitrage et leurs équivalents en ligne, ainsi que leurs avantages et leurs inconvénients. La thèse illustre l'évolution des conflits et la résolution des différends de l'ère analogique, lorsque la résolution des différends était face à face, à l'ère du numérique, lorsque les différends sont réglés dans le cyberespace. Il démontre que l'ODR est une nécessité de l'ère numérique, mais aussi qu'il a le potentiel pour être un moyen révolutionnaire, efficace et réussi à résoudre les différends; d'une manière qui sera l'avenir de la résolution des différends. Sur la base de l'expérience accumulée par l'examen de l'évolution de la résolution des différends et sur ? Lla base des conclusions tirées, la thèse formule une proposition pour le système ODR. La thèse décrit le système ODR, de son processus en trois étapes et la nécessité de l'arbitrage en ligne, sur le réseau ODR, la régulation du système ODR, l'architecture technologique des fournisseurs ODR, leur financement, ainsi que les mesures nécessaires de la sensibilisation et la confiance afin que ODR remplit son plein potentiel
The subject of the thesis is Online Dispute Resolution (ODR) and the aim of the thesis is to propose a model ODR system based on the experience of the dispute resolution movement. ODR is not an isolated phenomenon of recent times but a result of the evolution of disputes and dispute resolution. Initially, disputes occurred between parties with geographical proximity and for which traditional courts were the principal way of resolution. However, as people started to travel further distances and communicate from afar, disputes evolved as they increased in number, became more complex and increasingly cross border. Dispute resolution evolved in parallel and Alternative Dispute Resolution (ADR) was employed. However, disputes evolved once more when the world entered into the digital era. Not only disputes became yet again increasingly cross-border, but new disputes appeared that arose solely in cyberspace. In order to satisfy the requirements of the digital era, dispute resolution brought forth the concept of ODR. ODR arose from the combination of ADR and the Information and Communication Technology (ICT) of the digital era. Alternative means of dispute resolution were transferred to the virtual world and gave birth to Online Dispute Resolution. ADR and ODR are examined extensively, and the examination includes their concepts, their origin, the main forms of negotiation, mediation and arbitration and their online equivalents, as well as their advantages and drawbacks.The thesis illustrates the evolution of disputes and dispute resolution from the “analog” era, when dispute resolution was face to face, to the “digital” era, when disputes are resolved in cyberspace. It demonstrates that ODR is a necessity of the digital era but also that it has the potential to be a revolutionary, effective and successful way to resolve disputes; a way that will be the future of dispute resolution. Based on the experience accumulated by examining the evolution of dispute resolution and based on the conclusions drawn, the thesis formulates a proposal for the ODR system. The thesis describes the ODR system, from its three step process and the necessity of online arbitration, to the ODR network, the regulation of the ODR system, the technological architecture of ODR providers, their funding, as well as the necessary steps of creating awareness and trust so that ODR fulfils its fullest potential

This work is dedicated in the first instance to the necessity of insolvency proceedings for municipalities as territorial entities. Therefore, the current debate on insolvency proceedings for states is presented briefly in an introductory overview to introduce the debate that insolvency proceedings for territorial entities has reached all levels of government worldwide. This is followed by examples of historical experience with insolvency scenarios of states and local authorities to show that insolvency scenarios at all levels of government are part of reality, and that a procedural handling is possible, but also necessary. Based on this, the US-Chapter 9 procedure, perhaps the most well-known legal remedy for insolvent cities, and the most globally developed proceeding for municipal insolvencies, is taken closer into view. In the first step, the principles and mechanisms are pointed out. This is followed by a semantic preamble regarding the development of insolvency law and its public perception, a short discussion of the experience with the Chapter 9 process and last, but not least, a presentation of the key advantages of Chapter 9 proceedings. The goal is to convey that the Chapter 9 proceeding may serve as a useful tool and model for other countries to solve excessive indebtness of municipalities. As a result, in particular, the abstract possibilities and objectives of the procedure are considered.

For over eighty years the momentum density of an electromagnetic wave in a material medium has been in dispute. Minkowski proposed that it was DxB while Abraham proposed that it was ϵo E x μoH. In recent years opinion has tended, though not unanimously, toward resolution based on the Abraham result being (true) momentum density and the Minkowski result being pseudomomentum density. We differ with both of these conclusions: we find the (true) momentum density to be ϵo ExB and the pseudomomentum density to be PxB. Our results are obtained from derivations of the momentum and pseudomomentum conservation laws, the latter resulting from homogeneity of the material medium. The derivations follow from a Lagrangian formulation of an arbitrary dielectric crystal, treated non-relativistically, in Interaction with the electromagnetic field. The formulation produces all the modes of motion of the system, acoustic, optic (both Ionic and electronic), and electromagnetic, and allows for arbitrary interactions between them. This permits a physical interpretation of the difference between ϵoExB and ϵoExμoH. By obtaining the conservation laws both from the equations of motion and from the Lagrangian by Noether's theorem we are able also to interpret the difference between PxB and DxB.
