This chapter explores the ways in which the supposedly inert materials of the monastic compound are understood to function as unique vehicles for awakening. It examines Dōgen’s Talk on Pursuing the Way (Bendōwa), dated 1231, and observes how the material universe (the five phases of earth, water, fire, wood, and metal, as well as yin-yang theory and feng shui geomancy) is invoked to envision a new, biaxial Zen temple layout in Japan. It also considers how Dōgen redeploys these material categories, and even alludes to Chinese contract pledges (fu), to seal the deal with his potential patrons in Japan. Finally, it reflects on Dōgen’s preferred phrase of “grasses and trees” (sōmoku), which he often substituted for the idea of zazen practice-realization in and as the monastery itself.

Class action litigation that includes a focus on constitutionally inadequate correctional mental health care systems has been a major and effective force in jail and prison reform during the past four decades. Benefits to correctional mental health systems resulting from such litigation have included increased resources needed to implement basic policies and procedures that are necessary for a constitutionally adequate system. Following the passage of the Prison Litigation Reform Act of 1995, newly initiated consent decrees related to class action litigation involving correctional mental health services significantly decreased. The reduction in litigation related to this act followed from limiting the discretion of judges in approving such decrees that were previously allowed. Private settlement agreements and/or memoranda of agreement or their equivalents (the “Agreement”) have been substituted for the consent decree process. Although the judicial enforcement specific to implementation of these Agreements is weak, the monitoring process of such Agreements is very similar to those previously used with consent decrees. This chapter will summarize the monitoring process frequently involved in an Agreement resulting from a class action lawsuit specific to a correctional mental health care system using a single prison mental health system as an illustrative example. Emphasis will be placed on the importance of developing a quality improvement process that should ultimately eliminate the need for a monitor external to the mental health care system.

This chapter explores Mill’s famous mental crisis and period of despondency as a young man. He wrote of it in language that strongly and explicitly paralleled loss-of-faith narratives (in this case, the faith that was in crisis was not a conventionally religious one, but rather Benthamism) and the evangelical conversion narrative (again, in this case, what he was being converted to was not a conventional religious faith, but rather Romanticism). This chapter also traces Mill’s strong connections with Unitarian Christianity, not least through his relationship with the Reverend William Johnson Fox. His substitute mother, Sarah Austin, was also a Unitarian, as was the great love of his life, Harriet Taylor.

The United Nations Convention on the Rights of Persons with Disabilities (CRPD) presents in a tailored form the rights of such persons. Mental health disabilities are included. While the Convention is most welcome, it is hugely challenging when it comes to involuntary treatment. Important authorities have interpreted it as excluding all forms of ‘substitute decision-making’. The Convention demands ‘respect for the rights, will and preferences’ of persons with disabilities. This chapter examines the meaning of ‘will’ and of ‘preference’. A problem arises when a person’s currently expressed ‘preference’ (or desire or wish) diverges from the person’s ‘will’ (taken to mean a person’s relatively enduring and deeply held value commitments). Both cannot be respected at the same time. Which should have precedence? The method of ‘interpretation’ discussed in Chapter 7 allows such a determination to be made, and aligns the ‘fusion law’ proposal with the objectives of the Convention.

Psychological testing is of substantial value in a range of correctional situations and can be a helpful adjunct to standard clinical assessments. Tests provide additional sources of data for use in comprehensive assessments, but they do not substitute for clinical evaluations. This chapter discusses the rationales and purposes for using psychological testing, special issues in administering and interpreting these tests in correctional settings, and caveats about their proper use. Well-validated psychological tests can be an important adjunct to a comprehensive mental health assessment, and help to identify psychiatric symptoms and cognitive deficits that may impair functioning in correctional institutions. In addition, testing can assist in determining the validity of self-reported symptoms by inmates. Given the range of tests, with varying suitability to a correctional population, a qualified doctoral psychologist should make the decision about which tests to administer. The referral should identify the issues and questions to address, instead of requesting specific tests, to allow the psychologist to choose the best instruments. The psychologist should produce a report that explains the results, their applicability to the referral issues, and any caveats about their validity. The results can then be integrated into the diagnostic assessment and treatment plan for the inmate. This chapter will present some of the history and contexts for when it is done, when it can be done and when it should not be done on the basis of best practice and evidence based practice.

In the blink of an eye, I can redirect my thought from London to Cairo, from cookies to unicorns, from former President Obama to the mythical flying horse, Pegasus. How is this possible? How can we think about things that do not exist, like unicorns and Pegasus? Thinking About Things addresses these and related questions, taking as its framework a representational theory of mind. It explains how mental states are attributed, what their aboutness consists in, whether or not they are relational, and whether any of them involve nonexistent things like unicorns. The explanation centers on display theory, a theory of what is involved in attributing attitudes like thinking, hoping, and wanting. These attributions are intensional: some of them seem to involve nonexistent things, and they typically have semantic and logical peculiarities, like the fact that one cannot always substitute one expression for another that refers to the same thing without affecting truth. Display theory explains away these seeming anomalies. For example, substituting coreferring expressions does not always preserve truth because the correctness of an attribution depends on what concepts it displays, not on what the concepts refer to. And a concept that refers to nothing may be used in an accurate display of what someone is thinking. The book describes how concepts can be learned, originated, and given a systematic semantic description, independently of whether there exist things to which they refer. There being no things we are thinking about does not mean that we are not thinking about things.
