The connection between social change and marriage is of critical concern for nineteenth century English novelists, and the progression of both class shifts and alterations in marriage are discernable through these novelists' respective works. Due to the Industrial Revolution and the Napoleonic Wars, England's social hierarchy began to shift allowing for the rise of a middle class; with the professional class's ascension came the decline of the landed gentry. These social changes blurred class boundaries and created an increasing socially mobile society. Additionally, they coincided with changes to marriage framework, as matrimony was moving towards being based on love rather than the traditional socioeconomic foundation. As both class lines and the love-revolution took place around the same time historically, there was a key change in marriage suitability, making cross-class and love-based marriages more of a reality. Jane Austen and Thomas Hardy are two of the most notable authors from the nineteenth century who chronicle this tension between marriage and class in their respective novels. This thesis focuses specifically on Austen's Persuasion and Hardy's Far From the Madding Crowd, arguing that they both visualize a successful marriage that is predicated on both love and socioeconomic status. Their similar image of the sustainable marriage gives value to both the socioeconomic-based and love-based marriages, depicting a realistic conceptualization of marriage.

Background: Recent trends in the world of business notably globalization and advanced technology have had significant effects on most companies irrespective of size and operations. A major consequence of these trends is increasing competition. This has consequently, increased the need for broader and more comprehensive strategies capable of ensuring the long-term survival of companies. One such strategy is strategic alliances. Strategic alliances provide companies with wider access and utilization of resources that they find difficult to acquire.

Purpose: The purpose of the thesis is to achieving a better and deeper understanding of global alliances and how they are coordinated. In so doing the research includes the nature of global alliances in general and the Renault-Nissan alliance in particular. The main focus and case study is the Renault-Nissan alliance but, the researchers also examine the reasons for the failure of the alliance between Volvo-Renault to determine what lessons if any, did Renault learn from this alliance and how these lessons has helped the Renault-Nissan alliance.

Findings: The research found that coordination at the operational level of the Alliance was achieved through coordination mechanisms. The coordination mechanisms were responsible for coordinating the resources and activities of both companies at the operational level. These mechanisms are the result of deliberate planning, implementation and monitoring to ensure that they function effectively as required. The research also found that the effectiveness of the mechanisms are greatly aided by factors such as trust, mutual respect, managerial commitment, and learning as well as structures such as the Coordination Bureaus, the Alliance Board and the Alliance Steering Committees. These were consequently labelled ‘facilitators’ of the coordination mechanisms. Finally, It was also found that the role of ‘facilitators’ permeates the entire coordination process. On the basis of these findings and the analysis made thereof, the researchers through analytical generalizations concluded that effective and efficient coordination of resources at the operational level leads to successful strategic alliances, which are achieved through planning, implementation, creation and monitoring of coordination mechanisms.

Ukuthwala is traditionally a marriage custom within the amaXhosa culture in South Africa which permits a ‘legal abduction’ of a bride-to-be. Similar customs of ‘bridal abduction’ exist, most notably in Kyrgyzstan, where it is known as ala kachuu. Research into these customs necessitates a more innovative approach to explore the impact of this social phenomenon. In this article the authors mobilise a fictional narrative to offer a backdrop for a comparative assessment of the impact of bridal ‘legal abduction’ and assess its contemporary status and role within a multicultural society which celebrates the rights of the individual while recognising the value and importance of maintaining cultural identity and traditions. Cultural dissonance has always been characteristic of modern and post-modern societies as they strive for a workable shared ethos. However, when customs such as ‘legal abduction’ (Mtuze, 1993:50) continue under the veil of cultural rights, the wider social sensibilities and perspectives can be at odds with the maintenance of such activities where these activities contradict the rights of the individual as enshrined for example in what can be seen as a liberal South African Constitution.

The focus of this dissertation entitled 'Difference, Identification & Desire: Contemporary Lesbian Genre Fiction' is the representation of lesbian identity in four contemporary popular lesbian genres: autobiographical fiction, speculative fiction, romance fiction and crime fiction. The aim of the dissertation is three-fold. Firstly, it seeks to acknowledge and celebrate the large variety of representations of lesbianism produced by lesbian writers working with popular forms of the novel during the past twenty five years. Secondly, it explores the ways in which lesbian writers have reworked popular genres in order to highlight lesbian and feminist concerns and to depict aspects of lesbian existence. It analyzes the effects of introducing discourses of lesbianism into the plots of popular genres, showing how the latter have been subverted or adapted by lesbian use. Thirdly, the thesis seeks to specify the ways in which the generic forms themselves, according to their own codes and conventions, shape and mediate the representation of lesbian identity in the text. In addition to this focus, the dissertation traces a number of themes and concerns across and within the four genres under discussion. These include the relationship in the texts between the sign 'lesbian' and the discourse of feminism, and the oscillation between the representation of lesbian sexual identity in terms of woman-identification and difference-between women. The aim throughout the analysis of contemporary lesbian genre fiction is to identify both that which is specific to lesbian representation and that which is characteristic of the particular genre under discussion. The dissertation represents a contribution to three areas of literary study: Genre Studies and Feminist Studies in general, and to Lesbian Studies in particular.

ZULEIKHA, who was trained as a pianist in her hometown of Lahore, Pakistan, arrives in Irving, Texas after her arranged marriage to ISKANDER, but finds it difficult to get accustomed to the appurtenances, encumbrances, and perquisites of the middle-class housewife lifestyle. Despite giving birth to a son, WASIM, she quickly falls out of love with her dutiful but straight-laced husband. She begins giving private lessons, and commences an affair with PATRICK, a transplanted Canadian who is trapped in his own loveless marriage. When she gets pregnant, Zuleikha is convinced the child belongs to her husband. She ends her affair with Patrick, but Iskander finds out about it anyway. The ensuing confrontation between Zuleikha and Iskander turns into a physical altercation, during which Zuleikha, having fallen to the floor, is unable to see if Iskander stomps on her belly, or falls on her by accident as he will later claim. The trauma results in a miscarriage. The unusual set of circumstances surrounding this violent episode serves as the backdrop for the rest of the story, by catapulting this otherwise nondescript couple into the glare of the public eye. Iskander is arrested and charged with feticide, and he faces a long prison sentence under Texas law. A court order prohibits him from contacting Zuleikha and Wasim, who are taken to a shelter for Muslim women and children. There, the other domestic abuse victims view Zuleikha as someone who "had it coming" because of her infidelity, and are therefore openly hostile to her. The shelter's director, a woman named REZA, is beholden to wealthy Muslim donors, and therefore arranges for Zuleikha to meet with members of a highly controversial Islamic tribunal. Zuleikha is pressured to forgive her husband and testify in his favor, so as not draw further negative attention to the Muslim community. JANE, the District Attorney, on the other hand, initially plays nice with Zuleikha and informs her that she will devote any and all available resources in the prosecution of Iskander. When Zuleikha can't get her story straight and hesitates about testifying against her husband, however, Jane, too, turns against her. Zuleikha discovers that the DA has been caught hiding her own secrets and now faces a public confidence crisis of her own. Zuleikha comes to realize that Jane's reasons for being so gung-ho about winning Iskander's conviction have as much to do with re-endearing herself to her electorate as with justice. Zuleikha thus finds herself at the epicenter of a political firestorm fueled by winds of anti-Muslim hysteria, with different people trying to use her situation to their own advantage. When Wasim gets in a scuffle at the shelter and has to be taken to a clinic, she panics and contacts Iskander against her better judgment. Husband and wife finally confront each other while Wasim is being treated. Iskander claims to still love Zuleikha and begs her to take him back so that they and their son can resume their prior family life. But Zuleikha realizes that even if Iskander is sincere and not merely seeking reconciliation in order to avoid a harsh prison sentence, she will never be able to forgive him, let alone love him and live with him again. She comes to accept the fact that she has no control over Iskander's fate in court, and can only move forward by testifying truthfully and trying to do what is best for her and her son. While waiting for the trial to begin, she gains admission in a summer training program for piano instructors and begins the next phase of her life.

Nothing much has changed in the Law of Family in Peru. The main doctrine argues that it is not possible to make agreements between spouses on non-economic aspects of their relationships or their duties with their children, even when they could make decisionsin a more convenient way.In the article, the author argues that it is desirable to relax the rules on agreements between spouses or prospective spouses to regulate their rights during marriage or the benefits and obligations of each one in case they end their marriage. In that way, the author alludes to the figures of prenuptial and marital agreements present in American reality.

Moving on from Jackson's belief in fantasy as the literature of subversion, this thesis argues that by filtering Todorov's concept of the fantastic through a contemporary theoretical understanding of transgression, the stasis which has resulted from the obsessive desire to pin down a single definition of literary fantasy can be transformed into a dynamic and interactive narrative process. This dynamism then provides a particularly useful strategy for the fictional exploration of the problematic positionality of women within patriarchal society. The Introduction sets out and contextualises this theoretical framework, the particular significance of transgression to socio-political marginalisation being illustrated by reference to the work of post-Bakhtinian theorists such as Stallybrass and White. The importance of the precarious threshold positionality offered by the adoption of fantastic hesitancy on the part of the woman writer is also introduced. The three main textual sections each focuses upon four novels by contemporary women writers, taking as their themes women and the domestic, women and nightmare and women who are "larger than life" respectively. In each case the intervention of the fantastic is seen to be inseparable from the problematic relationship between prohibition and transgression, a relationship largely set up and explored through a preoccupation with enclosure. Throughout there is a presiding concern with the importance of paradox and ambivalence as a radical literary and political strategy. To this end the concluding section sets this thesis within a feminist fantasy framework, arguing that the problematic dynamism of the fantastic offers far more transformative possibilities than the "closed-system" of the feminist utopia. The originality of this thesis resides in the fact that it adds two further dimensions to existing perspectives on the fantastic. By fully integrating the concept of transgression as a narrative positionality as well as a category of content, it aims to extricate fantasy criticism from the bounds of genre theory. In addition, by combining this with a variety of feminist theoretical perspectives and by taking as its focus contemporary women's fiction, this thesis provides something still not otherwise available: a full-length feminist reading of the application of the fantastic to contemporary women's fiction.

Alice Lyttkens (1897-1991) was a very popular author in Sweden during several decades in the middle of the twentieth century. She was most famous for her historical novels. During her first period as a novelist in the 1930s, however, she wrote contemporary fiction, reflecting the situation of contemporary Women. The traditional view of the two sexes as “complementary” permeated the interwar period. Complementary at this time was presupposed as an asymmetrical and hierarchical relation between the two sexes. The male was seen as superior to the female in being strong when she was weak etc. According to the Swedish researcher Kristina Fjelkestam’s dissertation Ungkarlsflickor, kamrathustrur och manhaftiga lesbianer this view was close at hand in representations of femininity. In this paper I discuss how the protagonists in Alice Lyttkens novels Flykten från vardagen (1933) and - kommer inte till middagen (1934) relate to this social norm, or ”doxa”. By making such an analysis I come to the conclusion that this ”doxa” is represented in both novels, but strongly challenged by the protagonists in their actions and life choices. The narrator also questions the predominated complementary view and demonstrates the protagonist’s thoughts and feelings throughout the novels. The author there by emphasizes a critical feminist attitude. The narrator is also critical of the superficial so-called modern characters, which apparently is under the influence of the ”doxa”.

This dissertation explores the relationship between the ‘rise’ of the British novel and the critical changes happening in contemporary English marriage law from early eighteenth-century to the end of the nineteenth-century. While citing landmark legal treatises and acts and positioning these novels as the medium through which to see the way these legal moments significantly shaped British culture and society, equity is ultimately at the heart of this study, with equity functioning as part of law but a corrective to it. Running parallel to this protocol of reading through equity is a reading informed through moral philosophy, drawn predominantly from the work of Adam Smith and other thinkers from the Scottish Enlightenment. They encourage us to think about obligation, and the relationship between intentions, expectations, and consequences on the point of promise and contract. Beginning with Daniel Defoe’s Moll Flanders (1722), I show the moral and legal difficulties that arise when promises are based purely on verbal contracts. I then move to Samuel Richardson’s Pamela (1740) and Pamela in Her Exalted Condition (1741) to address the importance and utility of contract, but also the need to outline and endorse a system—introduced through Hardwicke’s Act (1753)—that would provide a more reliable structure for the marriage narrative. Mary Wollstonecraft’s Maria (1798) and Sir Walter Scott’s The Bride of Lammermoor (1819), both of which I call historical novels, pinpoint legal structures that are both oppressive and obsolete, and those who fall victim to the insufficient common law require a more equitable judgment. George Eliot’s Daniel Deronda (1876) encourages readers to think about the potency behind intentions, both expressed and implied, and how resulting consequences can often run counter to the original intentions and expectations. I posit each text as a ‘case’ warranting treatment and judgment in a court of equity, where the particular details are judged in and of themselves but then stand as an offering for ways to continue to think about the general pattern and evaluation of human nature and morals.

This thesis comprises three sections. Section One is a novel Silhouettes of Alice, divided into four parts. Parts I and II are set in the fifties and sixties, and Part IV is set in the twenty-first century. The novel highlights the formative years of a girl's life from the age of five to twelve years, leaving home at twenty, and later, at mid-life, getting divorced and starting over. Section Two is a collection of twenty poems that form part of the creative writing component, a new work entitled Country Girl. Section Three is an essay on Views from the Veranda: Visual Maps of Place, Culture and Identity. This area of research highlights the veranda as a significant cultural contribution to the Australian way of life, place and identity. The veranda is featured in both manuscripts, and is integral to themes of love, home, friendship and familial guardianship. In the essay, by utilizing several authors' works, I discuss how the veranda acts as a caesura, a pause on the edge of the house, a reflective space where families interact, educate, communicate, and socialize. The research into the veranda, especially Philip Drew's work Veranda: Embracing Place, has facilitated my inquiry into the social, physical and cultural significance of the veranda. The essay also utilizes Gaston Bachelard's The Poetics of Space, primarily for theoretical insights into spatial environments, and his philosophical and metaphysical theories on intimate places where the mind rests, evoking the imagination, memories and daydreams - the writer's essential tools .

This study explores the influence of the Indian socio-cultural hegemonic discourse on the urban Hindu arranged marriage. For this purpose, four novels in English by Indian women writers have been selected for their location within the specific urban Indian socio-cultural tradition. These novels are the avenues through which the Gramscian theories of hegemony and consensual control are observed. The study focuses on unravelling the damage caused by the hegemonic socio-cultural traditions within the marriages portrayed in the fiction. The interplay between the reader and the texts is vital in further exploring the reach of hegemony into the reading codes of the audience. The need for a model reader is discussed within the study which also addresses the roles of both protagonists and readers as 'cultural insiders/outsiders.' The study focuses on the emotional and socio-cultural dilemmas faced by the protagonists and the audience who occupy the 'in-between-zones' of those who fall into neither category of absolute insiders or outsiders in cultural terms. This thesis is not an attempt aggressively to deconstruct the Indian traditional social structure. The main aim of this thesis is to use the literary discourse as an instrument to explore the subversion of the ancient Hindu discourses whenever it has suited the vested interests shaping the hegemonic socio-cultural discourses. This study also attempts to further an understanding of the exploitative manipulation of married couples by various interest groups. In the process, using fiction as an instrument, there might be a chance to create stronger marriages and more harmonious marital interactions within urban Indian society.

Assume, contudo, um inegável interesse na evolução deste fenómeno, a análise da Lei de imigração (lei nº 23/2007,de 4 de Julho), como também, o que se entende por casamento de conveniência, quais as motivações para a sua pática, os seus indícios, assim como, o modus operandi dos agentes, na tentativa de construir um perfil criminal inerente à prática delituosa. Deste modo, este trabalho pretende, essencialmente, uma breve compreensão dos “casamentos de conveniência”, não dispensando, para um maior aprofundamento do tema, a consulta da bibliografia referenciada.
This study aims to analyze the designated "marriages of convenience” in a criminological perspective. This is a subject that takes increasingly a particularly important role in Portugal, as well as in countries where there is a strong immigration. Assumes, however, an undeniable interest in the evolution of this phenomenon, the analysis of immigration law (Law Nº 23/2007 of 4 July), as also, what is meant by marriage of convenience, that the real reason of this practice, their evidence, modus operandi of the agents, as well as the motivations that lead to the perpetration of the same, in trying to build a criminal profile inherent in criminal practice. Thus, this work aims, essentially, a brief understanding of "marriages of convenience", not excusing, to a larger issue of deepening, the query referenced bibliography.

In nineteenth-century England one of the most popular types of civil legal actions was the suit for breach of promise of marriage, wherein the plaintiff, most often a woman, could bring an action to recover financial damages from a man to whom she was engaged if he failed to fulfil his promise to marry her. When brought to trial these actions provided a point of intersection for competing ideologies of marriage, gender, and common law, and as such generated a substantial amount of interest from the politicians who legislated them, the legal community that regulated their practice, and the general reading public whose behaviour they governed. This interest resulted in the production of a variety of texts that incorporated or reported on issues of breach of promise, including legal practice manuals instructing solicitors and barristers on how to handle the cases when in court, published proceedings and newspaper articles giving reports of culturally interesting or significant trials, and novels that incorporated actions for breach of promise into their romantic plots. However, because of the monologic nature of the legal environment, which I term the chronotope of the courtroom, the majority of these genres frequently represented actions for breach of promise in a manner that reproduced the unassailable, authoritarian discourses of the courtroom rather than attempting to explore the inherently problematic nature of such discourses and the legal fictions they construct. The exception to this is the dialogic novel, which I argue was developing throughout the time period under investigation in this thesis. For, by drawing on the theories of language and the novel developed by Mikhail Bakhtin and other members of the Bakhtin Circle, this thesis suggests that it is only that developing genre that is capable of portraying the struggle that occurs between the centripetal and centrifugal forces of culture within a given text, and hence of representing the essential 'messiness' of actions for breach of promise of marriage. In this thesis these characteristics will be examined at various moments in the evolution of the genre, by considering texts from three prominent authors at different periods of their artistic careers. Hence the key fictional texts of this thesis are Charles Dickens's novels Pickwick Papers and Bleak House, Elizabeth Gaskell's first and last novels, Mary Barton and Wives and Daughters, and Anthony Trollope's first novel The Macdermots of Ballycloran and his later works The Small House at Allington and The Eustace Diamonds.

The Second Space is a novel that presents the place of women in a patriarchal society, exploring themes such as sexuality, reclamation of space, and the power of physical objects. It follows the story of a woman who escapes from the prospect of marriage and works to discover her self-identity, forging meaningful relationships with other women. The accompanying critical study contributes to the knowledge of women’s writing and the creative process by acknowledging the existence of a distinct space for women in a patriarchal society. This concept is called ‘The Second Space’. This study refutes the assumption that women’s fiction is autobiographical due to the use of themes such as domesticity and motherhood, demonstrating the value of building a narrative for women. Les études consacrées à la représentation du mariage dans les textes narratifs au XVIe siècle cherchent le plus souvent à mettre en rapport l’image du lien conjugal construite par les récits avec les débats de l’époque. Nous avons voulu combiner cette approche, relevant davantage de l’histoire des idées, à une analyse des formes littéraires en nous interrogeant sur le rôle joué par le thème du mariage dans les évolutions du genre narratif à la Renaissance.Nous menons notre enquête sur un ensemble de douze fictions narratives en prose, de composition française, écrites entre 1515 et 1559. Durant cette période, le mariage se trouve au cœur de nombreuses controverses théologico-politiques et les regards portés sur la vie conjugale se modifient. En nous appuyant sur un travail de contextualisation historique, nous croisons une approche thématique avec une réflexion sur la poétique narrative pour étudier la structuration des intrigues, la construction des personnages et les dispositifs didactiques et herméneutiques des textes. La comparaison de nos récits à d’autres œuvres – contemporaines ou antérieures, françaises ou étrangères – fait apparaître, au cours de notre période, un renouvellement de la matière narrative autour du mariage. L’accent mis sur certaines situations matrimoniales et les enjeux spécifiques qui leur sont associés à l’époque se révèlent être un ferment favorable à l’apparition de structures narratives innovantes. In most cases, studies devoted to the representation of marriage in narrative texts of the 16th century aim to link the image of the marriage bond as elaborated in the narratives to the controversies of the time. In order to show how the theme of marriage has played a part in the development of the narrative genre in the French Renaissance, we have decided to combine such an approach, which is rather based on the history of ideas, with an analysis of literary styles.We have conducted our survey on a set of twelve prose narrative fictions written in French between 1515 and 1559. Marriage was then at the heart of many theological-political controversies and married life started to be seen in a new light. Basing our work on historical contextualization, we have intertwined a thematic approach with a reflection on narrative poetics so as to study the plot structure and characterization as well as the didactic and hermeneutic systems of the texts. Comparing these narratives with other literary works – contemporary or prior, French or foreign – has enabled us to highlight a renewal of the narrative matter related to marriage themes during that period. The emphasis put on certain matrimonial situations and the related specific challenges in those days created favourable grounds for the advent of innovative narrative structures. Marriage stories have particularly contributed to orienting short stories towards the style of tragic stories and to giving birth to original novelistic forms in which the early stirrings of the style of the sentimental novel can be seen

Art therapy and narrative therapy techniques are both used separately in treating sexual abuse, however they are not often used together. This heuristic study explores the experience of a wounded healer when using art within a narrative therapy process, specifically storytelling, to support healing from multigenerational incestuous abuse. This researcher used a science fiction story she is currently writing, to stimulate 8 reflections on the parallels in that story and in her personal trauma narrative, and then made adjoining art pieces about the reflections. The data was analyzed to find themes, such as protection, anger and fear. The art helped support the story by documenting the journey of wound healing. Both the art and text informed the creative synthesis, which exemplified this researcher’s process of forming her identity as a wounded healer. The parallels found in the science fiction story helped reveal and enlighten this researcher’s own trauma narrative and encourage self actualization. This study supports the use of art and storytelling with survivors of multi-generational incestuous abuse.

On account of their supposed link to nature, women in post-revolutionary France were pigeonholed into a very restrictive sphere that centred around domesticity and submission to their male counterparts. Yet this thesis shows how a number of women writers – Cottin, Genlis, Krüdener, Souza and Staël – re-appropriate nature in order to reclaim the voice denied to them and to their sex by the society in which they lived. The five chapters of this thesis are structured to follow a number of critical junctures in the life of an adult woman: marriage, authorship, motherhood, madness and mortality. The opening sections to each chapter show why these areas of life generated particular problems for women at this time. Then, through in-depth analysis of primary texts, the chapters function in two ways. They examine how female novelists craft natural landscapes to expose and comment on the problems male-dominant society causes women to experience in France at this time. In addition, they show how female novelists employ descriptions of nature to highlight women's responses to the pain and frustration that social issues provoke for them. Scholars have thus far overlooked the natural settings within the works of female novelists of the late eighteenth and early nineteenth centuries. Yet, a re-evaluation of these natural settings, as suggested by this thesis, brings a new dimension to our appreciation of the works of these women writers and of their position as critics of contemporary society. Ultimately, an escape into nature on the part of female protagonists in these novels becomes the means by which their creators confront the everyday reality faced by women in the turbulent socio-historical era which followed the Revolution.

The academic work is expressed in the adjunct creative project, Haunchebones, a 10-minute drama that echoes the tale and its zoomorphic influences, while presenting the content in a stylized play influenced by Theatre of the Absurd and artwork from the medieval and early renaissance period.

Suite à la croissance du phénomène migratoire clandestin, la prise de conscience publique et officielle de ce phénomène et du trafic des migrants est évidente. En conséquence, la signature du Protocole de l‘ONU contre le trafic de migrants et l‘adoption d‘une directive et d‘une décision-cadre au niveau européen sont conçues pour faire face à ceux qui profitent de ce phénomène, à savoir les trafiquants. Le droit français quant à lui, a accru la répression contre les tierces personnes impliquées, de près ou de loin, dans les activités clandestines de l‘immigration. Malgré l‘objectif affiché par ledit Protocole de « lutte contre le trafic illicite de migrants », les mesures adoptées et la large liberté laissée aux États membres, indiquent clairement le vrai but de cet instrument international, à savoir la lutte contre l‘immigration clandestine elle-même, but qui est le même pour l‘UE. Mais quel est le statut accordé par le protocole et par les dispositions européennes ainsi que françaises aux migrants qui font appel aux services des passeurs ? À travers cette étude nous pouvons entrevoir que la formulation des dispositions du Protocole et celle des dispositions européennes visent à n‘assurer aucun statut juridique aux migrants clandestins. Il n‘y a pas de statut juridique, ni victime, ni coupable, le migrant est en détresse. En revanche, en droit français, le migrant clandestin n‘est presque jamais regardé comme un homme, mais plutôt comme un délinquant. Le législateur français a choisi la loi pénale face à ces migrants. Cependant, les sanctions et la sévérité ne pourront rien contre un homme torturé, affamé, méprisé dans son pays. La loi pénale, à elle seule, ne permettra sans doute pas d‘apporter une solution. La préservation de l‘équilibre nécessairement fragile entre le respect de la liberté individuelle et le maintien de l‘ordre public est rarement prise en considération. En revanche les considérations économiques ont justifié une plus grande rigueur à l‘encontre des clandestins, au niveau de leur entrée, de leur séjour
As a result of the ever increasing illegal migration phenomenon, Public opinion and officials are now clearly aware of it and of the trafficking involved. Therefore, the signing of the UN Protocole against the smuggling of migrants and the adoption of a directive together with a decision framework at European level are tailor made to fight against the traffickers taking advantage of this phenomenon. French law, as it is concerned, has increased repression against whoever might be involved in this clandestine smuggling and trafficking. Despite the objective stated in the, so called, Protocol of ―fighting against the smuggling of migrants‖ The measures adopted and the large freedom given to the members states, clearly indicate that the true purpose of this international instrument is indeed the same as the E.U‘s that is to say : fighting against illegal immigration. But what is the status granted by the protocol and the European as well as French provisions to the migrants who use the services of smugglers? All through this study we can see that the formulations of the provisions of the protocol and that of the European provisions are intended to ensure that no legal status is granted to clandestine migrants. As far as they are concerned they have no legal status so there is no victim and no offender: a clandestine migrant is just in distress. However in the French law a clandestine migrant is seen as an offender but not as a man in distress. The French parliament has chosen to enforce criminal law against these migrants but, will this stop migrants who are tortured, despised and starving in their country of origin? Choosing to see them only as offenders won‘t probably bring any solution to the problem. The necessary preservation of the delicate balance between respect for individual freedom and the maintenance of public order is rarely taken into consideration. However economic considerations justify rigour againt illegal immigrants concerning who is allowed to enter the country and how long they will be allowed to stay

This thesis explores the interaction between the mobility and conjugal trajectories of married couples involving migrants in an undocumented position and the state regulation of residency rights in Portugal. In a context in which securitarian approaches prevail in European Union migration policies, family reunification is increasingly controlled and framed as a potentially fraudulent channel to evade migration restrictions and obtain residency documents. Namely, residency and nationality applications based on conjugal motives are the object of growing institutionalized suspicion. In 2007, the Portuguese government introduced a specific crime denominated as “marriage of convenience”, defined as a marital act that is contracted for the “exclusive purpose” of gaining residency rights (Law 23/2007). The implementation of this legislation by state authorities is based on the assumption that conjugal motivations may be investigated on the basis of institutional criteria capable of differentiating “genuine” marriages from “fraudulent” relationships. The research focuses on the underpinnings and repercussions of restrictive regulations, weighing institutional paradigms and practices against couples’ experiences. A qualitative case study was developed on the basis of interviews with both state representatives and married couples involving subjects in an undocumented or precarious residency situation. The thesis argues that the current mobility and intimacy control policies, notwithstanding the resistance enacted by some couples, impact in a discriminatory way on the opportunities and constraints faced by specific social categories. The empirical data indicates that restrictive migration policies (re)produce the stratification of subjects along gender, socioeconomic and national origin lines by regulating residency opportunities. The fundamental categories of illegality, marriage and migrant imposed through “marriage of convenience” policies reveal narrow and normative definitions, and thus consolidate a particular way of life and social profile as a condition for full citizenship recognition. This selection process fails to recognize the inherent complexity of transnational lives and relationships, and reinforces underlying unequal power relations by criminalizing marginalized social profiles.

This dissertation argues that interethnic romance narratives reflect and express central religious, political, racial, and gendered identities and agendas of Jewish American literature and culture in the early twentieth century. Chapter One shows that fin-de-siècle Reform Jewish women authors employed interethnic romance narratives to express a belief in America as exceptional as a place of religious and gender egalitarianism. Chapter Two turns to journalist and fiction writer Abraham Cahan, who wrote interethnic romance narratives to weigh the balance between idealism and pragmatism, socialist universalist values and the principles of Jewish nationalism in determining the character of Jewishness in America. Chapter Three demonstrates that Jewish American women’s popular fictions of interethnic romance in the 1920s employed interethnic romance plots to show women’s independence and mobility in light of early feminism and to express the limitations of feminist discourse when it ran counter to their ethnic identities. Chapter Four describes how narratives of interethnic romance written by Yiddish writers I. I. Shvarts, Joseph Opatoshu, Isaac Raboy, and David Ignatov employ tropes of interethnic romance together with geographical border crossings into non-immigrant or non-Jewish spaces, co-locating physical dislocation and disorientation and intimate interpersonal desire and unease. Together, these studies demonstrate the significance of interethnic romance in the American Jewish collective imaginary in this period and reveal the flexibility and longevity of this central theme in American Jewish discourse.

Huang Juan devoted herself to writing when Taiwan confronted social transformation from an agricultural to industrial society in the 1960s. She drew her attention to women’s love marriages in many of her stories. She particularly dwelt on the psychological transition of those who confronted difficult problems in love and marriage. Her stories revealed the awakening of women’s self consciousness. There is certainly a close correlation among literature, life and society. Focusing on the theme of love and marriage, my thesis discusses Huang Juan’s writing of women’s subjectivity which underwent transformation in accordance with social changes in the 1960s. This thesis explores several themes: the effects of patriarchal culture, the changes of economic and education conditions in the 1960s, traditional marriage, women’s sexual desire, and women’s psychological struggle for love marriages. This paper takes the approach of cultural and gender criticism to explore women’s situations and the awakening of the female subjectivity in the process of dealing with their love and marriage. Huang Juan’s short stories such as “Dumb Marriage,” “Lost Shadow,” “A Wife,” and the novel, “Girls in Aisha Gang,” exposed various difficulties that women encountered in the 1960s, e.g. arranged marriages, blind dates, and marriage for love. Through the discussion of Huang Juan’s writing, this paper probes into the author’s styles of writing love marriage, the influence of traditional marriage on both men and women, and various manners of how women assert their self consciousness, socially and psychologically. This study not only gives us insights into women’s psychological change and self awareness when they were allowed to receive education and access job market, but also lets us understand the influence of social transformation on gender relationships in the 1960s.

This thesis looks at literature by two South Asian, diasporic writers, Jhumpa Lahiri and Monica Ali, as a space where creative, cross-­cultural and independent identities for diasporic women might be created. The central claim of the thesis is that diasporic migration affects South Asian women in particular ways. The most positive outcome is that these women adopt new trans-­border identities but that these remain shaped by class, culture and gender. Hence a working class milieu such as the one depicted by Monica Ali, leads to an immigrant, ghetto-­ised, community-­based identity, located solely in the land of adoption, with return or travel to the homeland no longer possible. However, the milieu imagined in Jhumpa Lahiri’s text, a middle-class, suburban environment, creates a solitary, transnational identity, lived between countries, where travel between the land of birth and the land of adoption remains accessible.

Résumé :
Migration offers a spectrum of illegal channels through which migrants enter their target countries. Marriages of convenience are one of these ways. Specifically this means marrying a foreigner who has no residence status or has a lower one than their partner they are marrying. Their partner may be the citizen of their target country or also a foreigner, however, having a higher residence status. People entering such marriages misuse the marriage institute in order to obtain a legal residence in the given country. The objective of the diploma thesis is thus illegal migration through marriages between nationals coming from third countries of the Muslim world and people living in the area of the Czech Republic. Subsequently, foreigners obtain the status of a family member, of an EU citizen, and together with that the right of a free residence and movement within the EU. The general aim of the research was to compare two categories of these foreigners who were looking for the entry into the Czech Republic based on a short-term visa. One category consisted of visa applicants who succeeded in their applications, and those whose applications were refused due to a detected circumvention of the immigration law in the form of a marriages of convenience.
