In June 1991, the Antarctic Treaty states, meeting in Madrid, Spain, approved the Protocol on Environmental Protection to the Antarctic Treaty (the Madrid Protocol). The Protocol was adopted by the Antarctic Treaty Consultative Parties and opened for signature on October 4, 1991. Negotiated over a three-year period, the Protocol, together with its annexes, is the most comprehensive multilateral document ever adopted on the international protection of the environment. It promises to be a significant blueprint for preserving the Antarctic. An ironic feature of the Protocol is that, while it bans mining in Antarctica, it had its origins in the 1988 Convention for the Regulation of Antarctic Mineral Resource Activities (CRAMRA), which permitted mining.

The purpose of this paper is to explore possible legal issues concerning the Dronning Maud Land Air Network (DROMLAN) under the Antarctic Treaty system. By examining the recent discussion concerning DROMLAN within the Antarctic Treaty Consultative Meeting (ATCM) and relevant State practice, this paper argues that States parties have difficulty in fully complying with the obligations of advanced notice under Article VII (5) of the Antarctic Treaty and Environmental Impact Assessment under Article VIII (2) of the Madrid Protocol for DROMLAN’s operation. Finally, this paper suggests that good communication among relevant States parties and private actors is important for enhancing compliance with these obligations.

There have been little to no investigations in Hungarian historiography concerning the visit of István Bethlen, Prime Minister of Hungary between 1921 and 1931, to Madrid. Unfortunately, the Hungarian National Archives only disposes of the text of the treaty drawn by the Hungarian-Spanish arbitrary committee. On the other hand, the Archive of the Spanish Ministry of Foreign Affairs holds numerous documents in relation with the treaty, amongst them, the correspondence between the heads of the ministries of foreign affairs. The Hungarian and Spanish press of the era also presents a detailed picture of the negotiations. Bethlen timed his Madrid visit to coincide with the congress of the League of Nations in the same city during the first days of June in 1929. The agenda of the congress contained two items that concerned Hungary, both related to the accords established in Trianon concerning the frontiers: the arrangement of the situation of double Romanian and Hungarian, and Serbian Hungarian nationality, respectively, and the question of minorities. After signing the treaty of the Hungarian-Spanish arbitrary committee, Bethlen also participated in the negotiations of the League of Nations. The aim of this paper is to analyze the reasons why Bethlen's visit generated such an impact, mostly in the countries of the Little Entente, and to discuss the importance of the treaty drawn up by the Hungarian-Spanish arbitrary committee for Hungary, an important milestone also in the relations between the two countries.

On 13th October 2015, Iceland quietly submitted its instrument of accession to the Antarctic Treaty to the US Department of State (the depositary for the Antarctic Treaty). Iceland’s accession was not accompanied by any official declaration or public discussion in Iceland or elsewhere. This paper investigates some of the factors that are likely to have spurred the decision to join the Antarctic treaty system, examines current Icelandic interests in the Antarctic and proposes constructive policies to enhance Icelandic involvement in Antarctic governance and cooperation following the accession. The authors conclude that logistical operations and adventure tourism involving Icelandic companies in the Antarctic are the most likely triggers for the accession and they propose that Iceland consider ratification of the Protocol on Environmental Protection to the Antarctic Treaty (Madrid Protocol).

Abstract Due diligence standards have been read into treaty provisions for the protection for the environment and beyond in a wide range of international legal settings. The compliance provision of the Madrid Protocol on Environmental Protection to the Antarctic Treaty, Article 13, invites a similar analysis. Despite the doubts of ten years ago that a due diligence standard would be sufficient and appropriate for protecting the Antarctic environment the concept has arguably evolved to the point where it can provide an effective framework for operationalising States’ responsibilities under the Protocol as well as more widely in international environmental law, subject to adequate contextualisation.

The aim of this article is to discuss the relationship between invasions, cartography, and possessory law in the context of diplomatic relations between Portugal and Spain in the first half of the eighteenth century, in South America territories. The Castilian siege of Colônia do Sacramento and the French invasion of Fernando de Noronha island (1736 and 1737), awoke in the Portuguese ambassador D. Luís da Cunha the need to change the foundation on which the frontiers of Brazil were negotiated. He began to use the concept of uti possidetis as a strategy, which would become the directive for the diplomatic negotiations in the 1750 Treaty of Madrid. Despite its acceptance as a resource to demarcate frontiers, uti possidetis created various controversies at the moment of the demarcation of the territories and the Treaty was annulled by the Treaty of El Pardo (1761), when the legal frontiers returned to their previous positions.

Em 1750, era assinado entre as Coroas da Espanha e de Portugal o Tratado de Madri. Este determinava, entre outras coisas, a troca da Colônia de Sacramento pelas missões ao leste do rio Uruguai, o que levaria os guaranis que ali viviam a transmigrar para a outra margem do mesmo rio. Na medida em que estes indígenas apresentaram resistência, foram mandadas tropas para realizar esta função. É nesse contexto que se percebe a atuação de Sepé Tiaraju: como membro de uma elite missioneira, elaborada pelos padres jesuítas, que se revoltou contra as determinações de deixar suas terras. Analisando a trajetória de Sepé, percebe-se a construção de sua liderança e autoridade perante os demais. A abordagem versa sobre a forma e a maneira de como sua liderança foi construída: através das redes de relação e da forma de como estas foram elaboradas. Ao mesmo tempo, o modo como o prestígio de Sepé, e das autoridades indígenas em geral, é estabelecido também é abordado. A opção metodológica cai sobre a micro-história, sobretudo a sustentada por Carlo Ginzburg, buscando uma leitura atenta aos detalhes da fonte. Além disso, o método de pesquisa traçado pela etno-história, que combina elementos da História e da Antropologia e insere o indígena na História da conquista da América, também é utilizado, fazendo da pesquisa uma releitura da documentação disponível sobre Sepé à luz da “Nova História Indígena”.
In 1750 the Treaty of Madri was signed between the Crowns of Spain and Portugal. It supposed, among other points, the exchange of the Colônia de Sacramento for the missions at east of the Uruguai river, which would force the Guaraníes that lived there to migrate to the other side of the river. As the indigenes resisted, troops were sent to do the task. It is in this context that the role of Sepé Tiaraju is noted: as a member of a Missions elite, organized by the Jesuit priests, which had rebeled against the resolution of leaving their land. Analyzing Sepé's trajectory, it's perceived the development of his leadership and authority over the others. This approach examines the ways and means how his leadership was built: through the relationship networks and the way they were made. At the same time, it's explained the way that Sepé's and the authorities' reputation is established. The methodological option is the microhistory, mainly the part sustained by Carlo Ginzburg, seeking a careful reading of the source details. Moreover, the research method delineated by etnohistory, that combines elements from History and Anthropology and put the indigene in the History of the conquest of America, is also used, converting the research into a rereading of the available documentation under the light of the “New Indian History”.

Esta dissertação parte de dois eixos de investigação: um deles é Crisanto Neranda, um Guarani letrado das missões jesuíticas do Paraguai, membro de uma congregação e integrante da administração da redução de São Luís; o outro, um relato escrito que é atribuído a esse sujeito. Esse registro narra as situações que Crisanto teria vivenciado no ano de 1754 após ser capturado por portugueses durante os conflitos conhecidos como “Guerra Guaranítica”, que estão associados à demarcação do Tratado de Madri (1750). O texto, no entanto, não se restringe a esse momento específico, pois o relato foi instrumentalizado por diversos outros personagens, se vinculando também a conjunturas posteriores. A primeira parte deste estudo examina a trajetória do documento, com o objetivo de compreender como ele foi difundido e conservado, e o papel desempenhado não apenas pelo “autor” da narrativa, mas também por aqueles que se encarregaram de copiá-la, traduzi-la e citá-la. As seções seguintes buscam identificar quem foi Crisanto Neranda e quais lugares ocupava no contexto reducional, bem como o conteúdo comunicado pelo relato, as formas pelas quais faz isso, as motivações para sua produção e quais seriam os seus possíveis destinatários, visando observar como esses aspectos se relacionavam ao manuseio do seu testemunho por outros sujeitos e ao caráter de “autor” que é conferido a esse indígena da redução de São Luís. A análise desse caso possibilita, assim, o estabelecimento de considerações acerca dos usos da escrita e das possibilidades apresentadas por essa tecnologia no contexto da fronteira americana meridional entre os impérios ibéricos na segunda metade do século XVIII.
This dissertation departs from two lines of investigation: one of them is Crisanto Neranda, a Guaraní from the missions of Paraguay who was a literate member and administrator at the Jesuit reduction of São Luís, and also belonged to a congregation; the other, a written report that is attributed to this person. This record narrates the situations that Crisanto would have experienced in the year of 1754 after being captured by the Portuguese army during the conflicts known as “Guaraní War”, related to the demarcation of the Treaty of Madrid (1750). This text, however, is not restricted to this specific moment, because the report was utilized by several other characters, and is also linked to later conjunctures. The first part of this study examines the document’s trajectory, with the objective of understandig how it was widespread and preserved, and the role played not only by its “author”, but also by those who took charge of translating, copying and citing it. The following sections seek to identify who was Crisanto Neranda and which places he ocuppied in the context of the mission, as well as the content communicated by the report, the ways in which it does this, the motivations for its production, and which would be its possible recipients, aiming to observe how these aspects were related to the handling of the testimony by other subjects and to the character of “author” that is conferred to this native of the reduction of São Luís. The analysis of this case makes it possible to establish considerations about the uses of writing and the possibilities presented by this technology in the context of the southern American frontier between the Iberian empires in the second half of the eighteenth century.

During the eighteenth century Portugal developed a large military construction process in the Ultramarine possessions, in order to compete with the new born colonial trading empires, mainly Great Britain, Netherlands and France. The Portuguese colonial seashores of the Atlantic Ocean (since the middle of the sixteenth century) and of the Indian Ocean (from the end of the first quarter of the seventeenth century) were repeatedly coveted, and the huge Portuguese colony of Brazil was also harassed in the south during the eighteenth century –here due to problems in a diplomatic and military dispute with Spain, related with the global frontiers’ design of the Iberian colonies. The Treaty of Madrid (1750) had specifically abrogated the Treaty of Tordesillas (1494) between Portugal and Spain, and the limits of Brazil began to be defined on the field. Macapá is situated in the western branch of Amazonas delta, in the singular cross-point of the Equator with Tordesillas Meridian, and the construction of a big fortress began in the year of 1764 under direction of Enrico Antonio Galluzzi, an Italian engineer contracted by Portuguese administration to the Commission of Delimitation, which arrived in Brazil in 1753. In consequence of the political panorama in Europe after the Seven Years War (1756-1763), a new agreement between Portugal and Spain was negotiated (after the regional conflict in South America), achieved to the Treaty of San Idefonso (1777), which warranted the integration of the Amazonas basin. It was strategic the decision to build, one year before, the huge fortress of Príncipe da Beira, arduously realized in the most interior of the sub-continent, 2000 km from the sea throughout the only possible connection by rivers navigation. Domingos Sambucetti, another Italian engineer, was the designer and conductor of the jobs held on the right bank of Guaporé River, future frontier’s line with Bolivia. São José de Macapá and Príncipe da Beira are two big fortresses Vauban’ style, built under very similar projects by two Italian engineers (each one dead with malaria in the course of building), with the observance of the most exigent rules of the treaties of military architecture.

<p>Our sense of balance is often taken for granted, but there are hundreds of medical conditions which can disrupt it. Balance disorders can be severe in their impact, but there is little published guidance on how to design the built environment to be more accommodating to those who are affected.</p><p>This paper treats balance disorders within the wider context of inclusive design. It identifies specific features of footbridges which may reduce inclusivity. Relevant literature and guidance are reviewed.</p><p>Simple and positive choices can be made without adverse cost or aesthetic impact, while substantially improving the quality of life for people with balance problems, and enhancing accessibility of bridges for everyone. The wider challenge is to better understand the diversity of all bridge users, and engage imagination and creativity to address their varying needs.</p>
