This sixth edition of Redfern and Hunter on International Arbitration takes a fresh look at the law and practice of international arbitration in today’s world, against a background of constant change and evolution. Since the fifth edition of this book was published in 2009, there have been major changes in many national laws governing international arbitrations, as states seek to become ‘arbitration friendly’ by introducing new laws based on the United Nations Commission on International Trade Law (UNCITRAL) Model Law. There have been changes too in some of the best-known rules of arbitration, including new UNCITRAL Rules of Arbitration (2010), new International Chamber of Commerce (ICC) Rules of Arbitration (2012), and, in October 2014, new Rules from the London Court of International Arbitration (LCIA). There have also been important developments in the so-called soft law of international arbitration. In 2010, the International Bar Association (IBA) published a revised version of its Rules on the Taking of Evidence in International Arbitration, and followed this up in 2014 by publishing new and important Guidelines on Conflicts of Interest in International Arbitration. John Hughlings Jackson (1835–1911) was a preeminent British neurologist in the nineteenth and early twentieth centuries. He began to establish that standing in the 1860s, when he incorporated the evolutionary association psychology of Herbert Spencer into his early analyses of aphasia. Jackson also benefitted from his early connection with the National Hospital, Queen Square, London. His nuanced theory of cerebral localization was derived from (1) his clinical observations of (what Charcot later called) Jacksonian epilepsy, in combination with (2) his innovation to think about neurophysiological events at the cellular level, as well as from (3) David Ferrier’s primate localization data. The result was our modern conception of the seizure focus, which was crucial to the beginnings of modern ‘brain surgery’, especially at the hands of Victor Horsley. Jackson’s influence on the neurophysiology of Charles Sherrington is widely acknowledged but poorly defined. In the larger Victorian culture, Jackson was a friend of George Henry Lewes, who was George Eliot’s companion. Lewes attributed ‘sensibility’ to everything in the nervous system, thus maintaining a monist position on the mind-body relation, whereas Jackson maintained a form of psycho-physical parallelism that was actually dualist (‘Concomitance’). Throughout his life Jackson had an interest in insanity, which he viewed from the point of view of Spencerian evolution and dissolution. The latter was an important component of Freud’s psychoanalysis, which Freud took from Jackson. Late in his life Jackson defined the ‘uncinate group of fits’, which was his version of temporal lobe epilepsy.

In 1960–62, a large number of white autochthonous parents in Southall became very concerned that the sudden influx of largely non-Anglophone Indian immigrant children in local schools would hold back their children’s education. It was primarily to placate such fears that ‘dispersal’ (or ‘bussing’) was introduced in areas such as Southall and Bradford, as well as to promote the integration of mostly Asian children. It consisted in sending busloads of immigrant children to predominantly white suburban schools, in an effort to ‘spread the burden’. This form of social engineering went on until the early 1980s. This book, by mobilising local and national archival material as well as interviews with formerly bussed pupils in the 1960s and 1970s, reveals the extent to which dispersal was a flawed policy, mostly because thousands of Asian pupils were faced with racist bullying on the playgrounds of Ealing, Bradford, etc. It also investigates the debate around dispersal and the integration of immigrant children, e.g. by analysing the way some Local Education Authorities (Birmingham, London) refused to introduce bussing. It studies the various forms that dispersal took in the dozen or so LEAs where it operated. Finally, it studies local mobilisations against dispersal by ethnic associations and individuals. It provides an analysis of debates around ‘ghetto schools’, ‘integration’, ‘separation’, ‘segregation’ where quite often the US serves as a cognitive map to make sense of the English situation.
