Purpose – This paper aims to describe the state of the art of the Italian Archivio Licenze Periodici Elettronici (ALPE) project which aims to improve the understanding of the issues raised by licence agreements of electronic resources in the Inter-Library Loan Service and to support librarians in the implementation of the right policies. Design/methodology/approach – ALPE – (E-Journals Licenses Archive) is a national archive of interlibrary loan (ILL) clauses, extracted from standard and negotiated licences, to manage, to publicly share and to check the permitted uses of e-resources for ILL and document delivery. Findings – The ALPE archive facilitates public and free access to a remarkable amount of information and data about ILL conditions granted by the most important commercial and academic publishers, and responds to the practical problems of managing and understanding ILL clauses in e-licences. Originality/value – The solutions adopted by ALPE effectively solve many of the problems reported in the literature. These should help ILL librarians in dealing with the problems associated with ILL and licensing.

Residents’ groups are becoming more organized and vocal in expressing their concerns regarding the negative effects of poorly operated liquor licensed premises. Using the “public interest” measures in the Liquor Licence Act, the residents have successfully had liquor licenses revoked and new license applications denied. This paper examines some of the types of problems suffered by residents and the efforts they have made to alleviate those problems. These efforts include proactive consultation with licensed-premises operators, lobbying of politicians, adversarial license hearings, and legislative amendments.

A no-challenge clause prevents a patent licensee from challenging the validity of a licensed patent. In the 2014 Guidelines on Technology Transfer Block Exemption Regulation, the European Commission discouraged parties from including a no-challenge clause in a settlement and license agreement concerning standard-essential patents (SEPs).The Commission said that eliminating invalid patents serves the public interest because it promotes competition. For similar reasons, in 2014, the Advocate General of the Court of Justice of the European Union opined in Huawei Technologies Co. v. ZTE Corp. that EU competition law should allow a licensee to retain the right to challenge a licensed SEP’s validity notwithstanding that the licensee has entered into a settlement and license agreement with the SEP holder. I analyze the Commission’s and the Advocate General’s assumption that a licensee’s challenging the validity of SEPs unambiguously benefits consumers. I assess the merits of that legal proposition within the well-established economic framework of cost-benefit analysis. I particularly focus on the marginal benefits and the marginal costs that eliminating no-challenge provisions would generate for consumers. I explain that the Commission and the Advocate General exaggerated the marginal benefits and understated the marginal costs of validity challenges to licensed SEPs, particularly when the typical SEP holder repeatedly licenses its SEPs in a large portfolio to a sophisticated licensee. The discovery that several SEPs in a licensed portfolio of hundreds are invalid would neither surprise the parties nor justify reducing the portfolio royalty. The Commission and the Advocate General ignored that encouraging a licensee to challenge the validity of individual licensed SEPs invites opportunistic litigation by the licensee so as to delay paying the SEP holder the agreed-upon royalty for the use of the many more valid patents in its licensed portfolio. Thwarting the SEP holder’s ability to receive prompt compensation for its innovative contribution lessens the SEP holder’s incentive to invest in innovation and thus decreases quality of collective standard setting. Those effects in turn impose significant marginal harm on consumers. Consequently, the Commission and Advocate General erred to assume that consumers derive a net marginal benefit from the announced policy encouraging a licensee to challenge to the validity of licensed SEPs.

License is a contract between the licensor (Licencor) with the licensee (License) in which the licensor with a payment and in certain circumstances gives permission to the licensee to use an intellectual property rights (intellectual property rights). Regarding the types of licenses according Lee and Davidson, differentiate into 2 (two) types of licenses, namely Exclusive and Non Exclusive licenses. Patent license agreements are basically subject to and refer to the provisions of the agreement adopted by the Indonesian State in the Indonesian Civil Code. In this day and age the licenses as outlined in the agreement have the form of standard agreements or standard contracts, in a licensing agreement because it uses a standard contract, it has the potential to cause an imbalance of the parties because some licensing agreements (Lisensor) use clauses that can harm the licensee (License). Refressive legal protection is used, if a license agreement with a standard contract or standard contract used by the licensor of the patent (Licencor) to the recipient of a patent license (License), if it violates a subjective condition in making a patent license agreement then it will cause legal consequences can be canceled (Vernietigbaarheid) whereas if it violates an objective condition it will have legal consequences null and void (Neitigbaarheid).

Dentro desta produção é possível encontrar as “licenças” (licenze), breves adendos ao drama principal nos quais se comenta diretamente a respectiva ocasião. O que se pretende aqui é apresentar estas licenças no contexto do repertório luso-brasileiro. Veremos que, apesar de bastante esquecido hoje em dia, este repertório é peça relevante no intricado mecanismo de produção operática. Será possível também demonstrar que estas peças musicais se constituem em momento privilegiado da representação do eu por parte dos monarcas.

Over the last few years, multiple media reports have commented on compulsory licensing of pharmaceutical patents in India. A majority of these reports painted a doomsday scenario and were devoid of facts. The grant of India’s sole compulsory licence in March 2012 (to Natco for Bayer’s patented drug – Sorafenib) spawned a series of media reports theorising that the grant of this compulsory license was ‘… a major blow to global pharmaceutical firms’ and speculating a beginning of compulsory licensing era for pharmaceuticals patents. However, this simply has happened and India till date has rejected all subsequent compulsory licence applications filed after the Natco/Sorafenib compulsory license application. The purpose of the present article is to collate the present information around the various compulsory licences in India and provide some historical background at a time when even developed countries are beginning to issue compulsory licences for pharmaceutical products.

Abstract Thirty years ago, in February 1989, the first ‘free licence’ was created: the GNU-GPL licence. Since then the number of free and open licences has grown exponentially with both private and public actors publishing their own legal document. In plain language, a licence is a document that grants a permission to do something, to perform an action. When it comes to licences covering a creation (eg a software), such a document is a contract listing the permissions and prohibitions, ie the rights and obligations of both the licensor and the licensee with regard to the creation. Usually, such licences include an extensive list of permissions and some prohibitions. However, this list of authorizations and prohibitions might defer from one licence to another, creating thus compatibility issues among them. Moreover, some licences might contradict the licensee’s domestic law. As a result, the reliance on open/free licences covered content for Big Data analysis is in a legal jeopardy. This article will review those difficulties and critically analyse the legal and technical remedies to it.

IN principle, the law relating to the termination of bare (or gratuitous) licences should be relatively simple. Bare licences do not enjoy statutory protection and a bare licence cannot impose contractual obligations on the licensor. There are, however, four elements which complicate the law. First, through the operation of the doctrine of proprietary estoppel, the licensor may be estopped from revoking a bare licence. Second, a licence which has been acted upon is not revocable. Third, on revocation of a bare licence, the licensee must be given a reasonable “period of grace” or “packing-up period”. Fourth, it is sometimes said that a bare licence may be revoked only “on reasonable notice.” These four elements overlap (in part) and, in the case law and academic literature, there is some degree of confusion. The difficulties which exist can be resolved by more rigorous analysis.

This article discusses the Commission's review of exclusive broadcasting licences under EC competition law. It concludes that the Commission's practice suffers from a number of inconsistencies both as concerns market definition and substantive analysis. The authors submit that exclusive licensing is a legitimate and recognised practice for the commercial exploitation of broadcasting rights. There should therefore be a presumption in favour of the validity of such licences. Market definition and substantive analysis should be consistent with the competitive issue under examination. If the competitive issue is foreclosure, then competition authorities need to acknowledge the existence of alternative content that serves the needs of competing broadcasters equally well, regardless of the existence of dedicated viewer groups. A particular content's share of the relevant content market should serve primarily as a filter to eliminate licences involving low market shares from further scrutiny. Such licences a priori cannot raise competition issues, irrespective of their duration or scope. High market shares, on the other hand, do not automatically translate into an appreciable restriction of competition. Even in the case of high market shares, right-holders retain the right to grant licences on an exclusive basis. However, in such cases the duration and scope of the licence may need to be assessed in more detail, taking into account the full economic and legal context of the licence. An obligation for right-holders to license their content or to grant licences on a non-exclusive basis can only be contemplated in exceptional cases. Refusal to license, as such, even by a dominant undertaking cannot warrant such an obligation. The assessment of licences for new media rights should follow the same principles as the assessment of licences for traditional broadcasting rights. EC competition law should not be used as an instrument to make media policy. Competition law is platform neutral and does not provide a legal basis to favour or promote certain media platforms over other platforms. Indeed, using competition law as a media policy instrument would distort free competition and create serious legal uncertainties.

BACKGROUND: Psychiatric disorders are not compatible with carrying firearms or with driving a car. Persons with such disorders are often not employed and are persistent in demanding invalidity pensions, but some of them also insist on holding on to the mentioned licenses. In such cases, where persons are already in possession of firearms and driving licences, it never occurs to them, that they should surrender their permits back. AIM Pointing to the importance of OM controlling firearm/car driving licenses. CASE REPORTS: This paper discusses the problem of three cases that should be widely recognised as it is potentially life-threatening to other people. The first is the case of a war veteran in retirement with PTSD that had his application for firearms licence rejected by the authorities. The second is the case of a labourer who suffers from a depressive disorder, temporarily incapable of work. The third is the case of a war veteran, a chronic alcoholic with toxic epilepsy, who is applying for invalidity retirement but wants to keep his driving license. CONCLUSION: Occupational medicine assess every single worker by applying advanced methods and psycho tests that enable a thorough assessment of work capacity and fitness for carriage of firearms, driving as well as the assessment of psychiatric disorders, which are the most delicate to assess.

As policies, good practices and mandates on research data management evolve, more emphasis has been put on the licencing of data, which allows potential re-users to quickly identify what they can do with the data in question. In this paper I analyse a pre-existing collection of 840 Horizon 2020 public data management plans (DMPs) to determine which ones mention creative commons licences and among those who do, which licences are being used. I find that 36% of DMPs mention creative commons and among those a number of different approaches towards licencing exist (overall policy per project, licencing decisions per dataset, licencing decisions per partner, licensing decision per data format, licensing decision per perceived stakeholder interest), often clad in rather vague language with CC licences being “recommended” or “suggested”. Some DMPs also “kick the can further down the road” by mentioning that “a” CC licence will be used, but not which one. However, among those DMPs that do mention specific CC licences, a clear favourite emerges: the CC-BY licence, which accounts for half of the total mentioning of a specific licence. The fact that 64% of DMPs did not mention creative commons at all is an indication for the need for further training and awareness raising on data management in general and licencing in particular in Horizon Europe. For those DMPs that do mention specific licences, 60% would be compliant with Horizon Europe requirements (CC-BY or CC0). However, it should be carefully monitored whether content similar to the 40% that is currently licenced with non- Horizon Europe compliant licences will in the future move to CC-BY or CC0 or whether such content will simply be kept fully closed by projects (by invoking the “as open as possible, as close as necessary” principle), which would be an unintended and potentially damaging consequence of the policy.

The rise of female physicians has provided care to the growing and evolving United States population. According to the 2014 FSMB Census of Licensed Physicians, 32% of actively licensed physicians are female. Less attention, however, has been given to the location of medical school graduation and its association with the growing population of female physicians. This study examines physicians who were issued their first license in the United States by gender and by where they graduated from medical school. Using data from the Federation of State Medical Boards' (FSMB) Physician Data Center, the authors measured the percentage of first-time licenses issued between 1990 and 2014 to females and by where they graduated from medical school — that is, either a United States medical graduate (USMG) or an international medical graduate (IMG). Key findings indicate that between 1990 and 2014, first-time licenses issued to IMG females have increased from 25% to 45% (31% to 47% for USMG females). Furthermore, the percentage of first-time licenses issued to female IMGs increased among international regions with the highest number of licensed physicians in the U.S. The findings support that a greater percentage of first-time licenses issued to IMGs have been to females over the past two and half decades. Analyzing the trend of first-time licenses issued to physicians by gender and location of medical school graduation adds to better understanding the physician pipeline and physicians' transition from medical school to the practicing medical community in the United States.

The aim of the paper is to give an overview of the qualification requirements for future pilots in Canada and to discuss trends in such professionals training modernization. The methodological framework of the research is comprised of general scientific methods (analysis, synthesis, comparison, generalization – to study the works of foreign scientists, official and legal documents); specific-scientific methods (categorial analysis – to reveal the essence and clarify the definitions of the basic concepts of the study), and the structural and functional analysis – to determine the organizational, content and procedural features of pilot training in Canada. The analysis of the normative and legislative documents showed that the most professionally important licenses giving a pilot a professional right to work in the aviation industry and civil aviation are the Commercial Pilot’s License – CPL and the Airline Transport Pilot’s License – ATPL. The paper concentrates on the analysis of the requirements for knowledge and skills that a pilot has to possess and develop as well as a number of important steps to be completed to get the CPL and ATPL as specified in the corresponding sections of the Canadian Aviation Regulations. In order to obtain a license, a future pilot has to comply with the requirements for age, health status, a number of written examinations and flight training – flight hours, flight conditions and the level of skills. The qualification of a pilot can be attained at Flight Training Units or following the completion of university and college programs. The paper describes the specifics of integrated courses offered by the former – the Commercial Pilot Licence – Aeroplane (CPL(A)) integrated course, Commercial Pilot Licence – Aeroplane/Instrument Rating (CPL(A)/IR) Integrated Course, and Airline Transport Pilot Licence – ATP(A) Integrated Course. The conclusion is made that the types of flights and pilot activities in terms of CPL (A), CPL (A) / IR and ATP (A) licenses are largely the same. The difference lies in the number of hours provided for certain activity types and several specific requirements such as flying in difficult weather conditions or interaction between crew members. Among pilots’ training modernization trends we single out the following: its organization based on the competence approach, a reduction in the cost of training a new generation of pilots and increasing its efficiency through the introduction of new technologies in the training process.

<p>This research aims to design and create media applications that will be used to train the speed and accuracy of typing in the classroom. Lack of instructional media typing speed appropriate to the circumstances in the classroom was the background of this research. The study began with the observation phase, then followed by system design and coding. An application as the research results has main features: the study materials, practice typing, and data management, which each function is executed by the user level use. Implementation of the user level is intended to secure the data from unauthorized third parties so that only students and teachers can see the results of learning. Furthermore, the application also gives teachers the opportunity to participate in learning, a way to create and change the questions used for the exercise. Abstract While Negative Polarity Items are generally ungrammatical in veridical environments (*I said anything), they are known to be found in factive environments that involve veridicality (I regret you said anything). There is however disagreement in the literature about the types of factive environments in which any is found. This paper proposes the first systematic large-scale survey of the use of any with factive predicates. Based on corpora totaling nearly 5 billion words, the paper establishes the relative frequency of any licensed by the different factive predicates (epistemic factives, as well positive, negative and counterexpectative emotives). Negative emotive factives (e.g. regret) were found to license any 1.8 times more frequently than counterexpectative factives (be amazed), which license any 25.8 times more than do positive emotives (be glad). Emotive factives are associated with counterfactual preferences and expectations that make available a negative reading that licenses any. The examination of the data does not support a rescuing analysis that separates these occurrences of any from other licensed uses. Abstract In the last few decades, standardised cellular technology has experienced an impressive (r)evolution. This is mainly due to the success of open standardisation marked by the commitment of some companies to contribute their best innovative technologies to standards and to make them accessible to all on Fair, Reasonable and Non-Discriminatory (FRAND) terms and conditions. Recently, a discussion has emerged on whether such commitment implies that the patent holder has an obligation to license everyone across the supply chain (‘license to all’) or whether he is only obliged to offer everyone access to its standard essential patents through licences with end user devices (‘access to all’). Also discussed is whether a requirement to grant a licence at all levels of the supply chain is legally and practically possible. This paper will analyse the commercial licensing practice in the Information and Communication Technology field, the economic efficiencies of such licensing approaches, as well as the legal and practical implications of each of them.

In the United States, 48 states have recognized the educational importance of the early years by awarding stand-alone early childhood education (ECE) licenses that require specialized training in teaching young children. Yet, at the same time, teachers with elementary education (ELED) licenses are allowed to teach kindergarten in 34 states and 1st through 3 rd grade in more than 45 states. This means that teachers may be licensed to teach young children without receiving specialized early childhood training. R. Clarke Fowler explores the extent of the licensure overlap, the reasons for it, and the effects it has on early childhood education. He recommends moving toward a preK-3 license that requires teachers to learn developmentally appropriate practices for the education of young children.

<p>The changes in learning management typically involve the introduction of various alternative learning methods. The development of an effective learning experience requires the modification of conventional learning. Teaching and learning constructively synchronize instructions and assessment toward the desired learning outcomes. Notwithstanding the vast literature on the creation of effective learning, the lack of explanation on how the relationship between effective teaching and effective classroom would likely leave practitioners and academia without a clear guidance on how to operationalize the creation of effective learning in real life. A systematic literature review procedure was conducted upon published papers between 2007 and 2015 in outstanding education journals. This paper contributes to the literature by amassing the knowledge on pedagogical practices in effective learning creation. In addition, to obtain a granular elaboration about the matter, a framework to operationalize the creation of effective learning is suggested. Three aspects compose the framework namely teachers' intrinsic capabilities, educational institution support, and student’s participative involvement. The article analyzes the conditions for issuing a compulsory license in favor of the patent holders of dependent pharmaceutical inventions on the basis of Paragraph 2, Article 1362 of the Russian Civil Code. The criteria for the relevance of a dependent invention to important technical advancements with significant economic advantages are disclosed. An analysis of the emerging Russian court practice on the issuance of compulsory licenses in the pharmaceutical market, meanwhile, showed that Russian courts lack a clear understanding of when a patent holder can and cannot apply for a compulsory license. The author proves that compulsory licensing is an effective mechanism to prevent abuse of the right (first of all, to standard-essential patent) in the markets of complex innovations (IT, electronics and telecommunications). At the same time, its implementation on the pharmaceutical market can lead to negative consequences: discourage pharmaceutical companies to invest in the development of new drugs, register breakthrough drugs in Russia; reduce foreign investment in the pharmaceutical sector. In this case, the provision of compulsory licenses should be interpreted as an exceptional tool. The issuance of a compulsory license in favor of the owner of the dependent invention can be justified only if such an invention represents a genuine innovation, an important step in the development of pharmaceuticals. The licensee must offer the market a new drug with improved characteristics: increased therapeutic efficacy and (or) safety, which has no available alternatives.

Copyright is considered as a moving and intangible object; therefore, a copyright devolution cannot be done verbally but must be with an authentic deed or Underhand deed. Problem Identification: 1. How does the song copyright devolution mechanism make economic interest for a composer or Copyright Holder? 2. What is the system of song copyright royalty payment in Indonesia? and 3. What should be done by the parties to resolve the royalty payment execution dispute? It is a normative juridical method that must be used. Research Result: It is true that copyright license mechanism, fee retaining or royalty payment is considered as logic consequences that must be done by a licensee over a licenser (Copyright holder). It is because the licensee gets material profits due to the economic rights exploitation over the copyright itself. There are many varieties or different ways of compensation payment system or indemnification from the licensee to the licenser over one copyright object to another, for instance in song/music is known two different ways such as royalty and flat systems, while in music or song is known several ways, namely by percentage system, period system, profit sharing system, compensation or copyright selling system. Royalty payment dispute resolving may come in many ways, and, generally, the dispute resolving forums are available into two forms, such as litigation forum through courts and non-litigation forum out of court.

The article considers the issue of sailing licences which include: a sailor licence, a steersman licence and a captain licence. The legal character of sailing licences and the procedure in which they are issued is analysed. The judicial control of sailing licences is also considered. The granting of a sailing licence is an act confi rming that a person indicated therein has certain qualifi cations required for sailing. The legal character of the licence is similar to an administrative certifi cate. Granting the sailing licence can be conditional upon passing a formal examination by a person requesting the licence to be issued. The examination itself is regarded as an administrative act in law. The study proves that the Polish Sailing Association performs a function of a public administration unit issuing sailing licences. This means that it acts as a an administrative body in a functional dimension.The sailing licence is granted in the form of a declarative decision issued by the Polish Sailing Association. The proceeding for issuing such a decision is an administrative proceedings governed by the Code of Administrative Proceedings. The actions of the Polish Sailing Association as well as its failure to act are controlled by administrative courts.

Many governments assign use licenses for natural resources, such as radio spectrum, fishing rights, and mineral extraction rights, through auctions or other market-like mechanisms. License design affects resource users’ investment incentives as well as the efficiency of asset allocation. No existing license design achieves first-best outcomes on both dimensions. Long-term licenses give owners high investment incentives but impede reallocation to high-valued entrants. Short-term licenses improve allocative efficiency but discourage investment. We propose a simple new mechanism, the depreciating license, and we argue that it navigates this trade-off more effectively than existing license designs. (JEL D44, D45, H82, K11, Q28, Q38, Q58)
