Texte intégralThe principle of territoriality dominates the field of intellectual property and that of copyright. If this principle and the conflict rule it inspires, the lex loci protectionis, were real advances at the end of the 19th century, they are nowadays difficult to convince. Indeed, the principle of territoriality, which is linked to the principle of sovereignty in its dimension of regulation of the internal legal order, is undergoing multiple challenges. However, because of the intensification of transnational exchanges, the extension of markets, the rise of private economic powers, the dematerialised exploitation of works and in particular the possibility of disseminating them on global networks such as the Internet, sovereignty tends to lose significance. This forces us to question the relevance of a territorial connection to a-territorial realities. Maintaining the principle of territoriality as it stands, in terms of conflict of laws, then reaches legal security and the legitimate expectations of the parties. The approach taken in this work is that of a re-evaluation. It emerges in fact that the retreat in transnational relations of the principle of sovereignty - which underlies the principle of territoriality - should be translated in terms of conflict rule by a retreat of the said territoriality. Against the general trend which confirms the hegemony of the lex loci protectionis, the present work proposes, on the one hand, to circumscribe its competence in the fields where the principle of territoriality is not imposed as a necessity, and on the other hand to reorient the connection in such a way as to limit the competition of the applicable laws. In other words, to reserve a place for universalism understood as a bulwark against the variability of the applicable law and the legal insecurity that this variability could entail

Texte intégralDismissed the ambitious perspective of introducing harmonised rules concerning the mutual admissibility of evidence between Member States, the recent Directive 2014/41/UE regarding the European Investigation Order in criminal matters (EIO) tried to combine the instances coming from the issuing State with those concerning the executing State. The outcome is an “hybridization” between the lex fori and lex loci that inevitably has an impact at the level of assessing the evidence gathered across borders. Hence the idea to focus the attention, firstly, on the previous instruments. In this regard, the study focused, above all, on the European Convention on Mutual Assistance in Criminal Matters of 20 April 1959 of which Article 3 stated the locus regit actum principle. Later, the analysis regarded the Convention on Mutual Assistance in Criminal Matters between the Member States of the European Union of 29 May 2000 that claims the opposite forum regit actum principle. Finally, the scenario outlined by the Conclusions of Tampere European Council has required to examine the compatibility of these principles with the mutual recognition (Chapter I). Analysed these aspects, the attention shifted to the provisions of the Directive as implemented in Italy by Legislative Decree n. 108 of 2017 which represent the expression of prerogatives of the two States involved in the cooperation procedure. First of all, particular emphasis has been placed on the rule according to which the executing authority shall comply with the formalities and procedures expressly indicated by the issuing authority (i.e. lex fori) unless otherwise provided that such formalities and procedures are not contrary to the “fundamental principles of law of the executing State”, with all the problems that arise from the vagueness of this expression. Then the study has focused on the provisions that establish the conditions for issuing and the conditions for executing by referring, respectively, to the lex fori and to lex loci. From this point of view, the interpretations that jurisprudence has offered of the provisions of Legislative Decree n. 108 of 2017, reducing them to mere "formalities" cause for concern. Lastly, was taken into account the part of the Directive concerning the “Specific Provisions for certain investigative measures”; context within which emerges the greatest reluctance to abandon the lex loci actus principle (Chapter II). In conclusion, the study concentrated on the insertion of the evidence collected ultra fines in the Italian criminal proceedings. In this sense, the screening of the rules provided for in Legislative Decree n. 108 of 2017 showed the inadequacy of to make use of the provisions governing letters rogatory. With regard, instead, to the norms not expressly mentioned, it seems appropriate to extend the rules, such as the Art. 729 par. 2 of the Italian Criminal Procedure Code, based on the logic of forum regit actum principle. Furthermore, some procedural sanctions seem to emerge directly from the text of the Directive (Chapter III).

Texte intégralThe European criminal investigation order, introduced by Directive 2014/41/EU, is an instrument of judicial cooperation in the field of evidence, which has become necessary, given the growing transnational dimension of crime as a result of the sublimation of geographical boundaries in the European Union's Area of Freedom, Security and Justice. The supranational directive, implemented by Italian Legislative Decree no. 108 of 2017, has given rise to a construct of hybrid nature, inspired by the principle of mutual recognition, which maintains, at the same time, certain features typical of traditional mutual legal assistance, in an attempt to combine investigative efficiency and protection of fundamental guarantees. In an underlying backdrop still characterized by the absence of harmonization of national procedural and evidentiary rules, the mechanism for adducing evidence in a foreign country revolves around the principle of proportionality, which in turn takes shape in the context of a balancing judgement - to be conducted in the actual case and taking into consideration the specificities of such case - between the needs related to the detection of crime and the sacrifices imposed on the rights of the persons involved, for various reasons, in the procedures aimed at issuing and executing the relevant order. This doctoral thesis intends to provide a comprehensive analysis of the European Investigation Order, beginning with its legal framework, for the purposes of highlighting the main problems that have emerged in its early-stage enforcement and of identifying solutions capable of shorten the gap between theory and practice. To this end, a large space is firstly dedicated to the analysis of the early case-law rendered by the Court of Justice and by the Italian Court of Cassation on this theme, which reveals the overall tendency to prefer purposes of investigatory efficiency to the detriment of defense rights; secondly, this thesis critically evaluates some practical cases selected at the Public Prosecutor's Office of Milan and Monza.

Texte intégralThe restoration of the Republic led by Octavian marked a new start of legislative activity, said to be "flourishing" by Ovid (Met.,2.141), "under the leadership of the righteous" Augustus (Met.,2.141). As part of his funeral honours, Augustus being so closely related to his legislative work was made clear when it was suggested that the name of each law were to be inscribed on the banners for the funeral procession. The lex accompanied Augustus to his tomb. Little by little his successors no longer resorted to the lex and a few decades after Augustus decease, the unique function of the law was to acknowledge the powers and honours decided by the Senate and conferred to the Emperor at the beginning of his reign. That law was the last formal expression of the will of the populus Romanus: because it originated from the people and established the basis between the Prince and his status, his power and the activities that rose from it, it particularly caught the attention of the Prudentes. Though they may have noted the general disruption of the sources of the Law, resulting from the normative interventions of the emperor, it was only the part of jurisprudence that the prince had associated with his justice and therefore the production of norms,, that enhanced the normativity of the forms expressing the imperial will. The identity of the imperial constitution formed on the lex was the beginning of a new legal order, coherently based upon the consensus between the emperor and the Prudentes rather than upon the various organs of the Republic. Their resorting to the authority of the Law to characterize the imperial constitutions and their ability to assess change, ensured that an activity that started at the beginning of the civitas could continue

Texte intégralThe present Phd Thesis sets to shed light on the topic of the “nightmare”, considered not as a bad dream as it is commonly conceptualized, but instead as a demon of medieval origin. This spirit, said to intrude a room during the night hours, usually sits and exercises pressure on the chest of the alleged victim. This particular act, causing paralysis, drowning, and at times even death to the asleep, is a constant and common narrative motive in the folk stories of Europe. In the Greco-Roman tradition, the “ephialtes” and the “incubus” seem to function in a similar fashion. During the Middle Ages (the period which this study focuses on), an abundance of texts -ecclesiastical, literary, and even medical- suggests a close connection between the nightmare's actions and various super-natural beings, such as revenants, fairies, witches, elves, and dwarves. Drawing from this evidence, this study seeks to examine these texts' relation to the traditions of antiquity, along with the relevant traditions arising later across Europe. The Phd thesis is divided into three main sub-sections: the first part focuses on the relation between different variations of the appearance of an archetypal demon, as revealed by common etymological origins and similar actions. Furthermore, descriptions of the nightmare as a genius loci of two-fold nature, both benevolent and malevolent, are explored. Along with its depiction as a demonic being, the nightmare, is frequently presented as an entity offering treasures to the household and its inhabitants. The second part brings to the forefront nightmare's relation to certain nocturnal deities of dual nature, as well as to the holy season of the Twelve Days of Christmas. During the third and last part of the thesis, I scrutinize the relationship between the nightmare and the horse, the carnival, the witchcraft, and particularly the doppelgänger and the ecstatic-shamanistic practices of Europe

Texte intégralConsidering the diversity of theories on drug addiction and the clinical diversity of drug addicts, we have tried to understand underlying reasons. This variation being linked to the question of the psychopathological structure, we have begun an epistemological reflection with regard to the diagnosis, leading to us reconsidering relations between what is normal, and what is pathological within the pathoanalytical paradigm. We propose to view the theoretical-clinical articulation as the construction of a relation based on contrasted relations. Starting with the underlying principles of the phenomena, we have made a distinction between an axiological determinism and a sociological determinism. Such a problematic concept operates within the law and desire. We have articulated and validated the dissociation of the above determinisms through a double theoretical-clinical separation allowing substitution of the truth with an equivalence, being the perception thereof, as an internal coherence

Texte intégralStrikes in the vosgien textile industry between 1848 and 1921 were a lot less frequent than in other regions. These strikes were essentially defensive when compared to her strikes in France. This sort of weakened combatively can be explained by a certain outlook on life which favors social peace and rejects the class struggle. Employers and workers have powerful common interests which are stronger than individual interests. Both social groups usually come from the same region which used to be poor before industrialization. Mountain farming was not enough to provide for their needs. Other activities such as spinning and weaving of linen and hemp then proved to be necessary. Thus industry was seen as a way to avoid poverty. Lots of small family firms, scattered in the valley, were set up, responding to the hopes and expectations of everyone. An agreement was reached to ensure the development of these firms, each social group was trying to avoid conflict which might be detrimental to the companies. However the dissatisfaction of the workers which can end up in a conflict arises when the terms of the contract cease to be respected, when the workers feel that the employer is more concerned by his personal interests. The typical vosgien strike is not a way for the working class to climb up the social hierarchy, to change or overthrow the political system. It’s indeed a means to draw the attention of the state and make it enforce the social laws. As the workers consider conflicts as not being really. Necessary in working life, they don't try to join a union. However their actions aren't without strategy and outcome

Texte intégralThe thesis aims at an examination of the relationship between justice, rights and laws. To do that, first part of the thesis wishes to investigate Thomas Hobbes, namely the chief representative of positivist jurisprudence, who considers justice to be a naturel law the enforcement of which is to be guaranteed alone by the sovereign. Thus, that leads justice to a circular relation between positive laws, power and violence. In so far as it is the notion of sovereignty that brings justice into the circular relation constituted by positive laws, power and violence. Rather than criticizing the notion of sovereignty, this work, taking another approach, wishes to focus on Jacques Derrida who tries to deconstruct sovereignty. Accordingly, the second part concerns the influential proposition "the deconstruction is justice" stated by Derrida against Hobbes, on behalf of defending a justice beyond the law. While developing a notion of justice that is beyond the law, Derrida has no intention to deny the necessity of the law as such. So we are confronted with a paradox consisting of fact that we must both deconstruct the law and remain within its boundaries. It is exactly where we begin to pose the question of how this paradox is could be taken into account in the juridical domains of application. Texte intégralThe objective of French collective insolvency proceedings is to help companies avoid financial difficulties or, should that fail, to allow them to benefit from court-supervised reorganization or compulsory liquidation procedures. In order to achieve this goal, insolvency laws prevent creditors from bringing proceedings against a company after the opening judgment has been pronounced. Paradoxically, however, creditors enter into security and guarantee agreements precisely because they want to shield themselves from any potential losses arising from insolvency and financial difficulties. In principle, the onset of financial troubles automatically triggers those agreements. In essence, the right to insolvency protection for the debtor and a creditor's right to rely on its security and guarantee agreements exist concurrently and are, as such, tightly related. In order to prevent any abuse, the insolvency regime overrules all the provisions of the law relating to security. As a result creditors must bring any court proceedings to a halt and debtors are prevented from paying any outstanding debt. It can be said, therefore, that collective insolvency procedures supersede the rights of creditors contained in any debt security instrument. Despite their weakened status, however, the effectiveness of personal and real property collateral devices ultimately depend on the opening judgment. Their effectiveness therefore changes depending on the facts of each case. Their strength and intensity primarily vary with the type of proceeding in which they are used. Where a conflict arises between collective insolvency proceeding provisions and the law of security interest, the former generally prevails. The changes introduced by the 2006 Act have profoundly altered the operation of the provisions of the law on debt security and guarantee instruments

Texte intégralThis thesis focuses on how the government uses the laws as tools of communication. The demonstration is based on the analysis of the agenda building and the media coverage of two highly mediatized laws. The purpose is to study the law as a government means for solving public problems and at the same time as a political communication tool. It's a way of articulating political sociology of the public action, sociology of professions and media studies. The double sided face of law, government and advertising tools, is thus shown with the tensions inherent to the functioning of the pluralistic constitutional democracies. If political actors choose the law as tool of government, it is first because this is the evidence they address an ill structured problem. Moreover it is especially because the law can represent government action in the media. However the media being not only channels of transmission but very independent actors in the process of communication of the law, can influence the wording of the law, even thwart the processes of communication thought as strategic by the government, by opposing the law. Thus the profesionnalization of communication does not empower politicians with the "control" communication. They are even less empowered as journalists deal with their own professional practises and constraints. This research is based on a media corpus analysis and interviews with journalists, communication professionals, politicians, legal professionals and trade union leaders involved in the communication process of the French law in 2004 on secularity and conspicuous religious symbols in school, as well as the law of orientation and programming for the Justice reforming the juvenile justice and establishing new proximity judges in 2002

Texte intégralThe lawyer on the occasion of the reform of the indemnification for victims of traffic accidents has grabbed this opportunity to clarify the issue raised by the compensation from insurance companies for the expenses spent by social security debtors on the account of victims of accidents caused by third parties. The july 5 1985 law respects the principle according to which the bodies wich have brought financial or sanitary indemnity to the victims have a right to take proceedings against the tortfeasor to obtain full repayement of indemnity for wich this third party is liable. The fundamental originality of this text is to remedy the situation of anarchy originating from the great number of social debtors and the wide gamut of benefits by building up a general system of appeals on the part of the social security debtors as regards bodily injury. However the law has not realized fully that construction. Efforts will have to be endeavored to resolve the problems raised by the coordination of indemnities payable by the third party in compensation for bodily injury with the benefits coming from other sources. As far as this problem issue is concerned the development of agreements between public insurances and liability insurances is the best solution ever for the time being

Texte intégralRelation between two notions can be possible only if they are envisaged in the same field. Concerning local authorities whose aim is social organizing they can only be apprehended with a juridical approach as far as law is concerned. So as to be analysed this relation has to follow a dynamic proceeding when the law appears as an active principle. It generates and determines local authorities to turn into real juridical elements. Consequently only the study of this relation with the dialectic between the unity and the multiplicity can reveal the true nature of this relationship. Local authorities have to obey the law as they are produced by the unitary state. The law shapes local authorities thus changing them from law elements into juridical ones. They enter a juridical system and are considered as factors that create and possess the law at the same time. The evolution of the elements defining the law along with the existence of a competition are as many factors thaht justify to challenge this obedience. The pluralism factor pervades the legal norm more and more and the variety of territories is taken into account by the unitary state. The 2003 constitutional revision along with the goals of the reform of December 16, 2010 lead to ponder over the qualification of the state organization and also over the new dimension between the relation of these two notions

Texte intégralThis doctoral thesis suggests that the organization of controls for performance-enhancing drugs should be studied as the result of historical interactions involving sportsmen and women, representatives of public authority and doctors. More precisely, in respect of different policy paradigm, performance-enhancing drugs and their controls should be grasped as the result of confrontation between several representations, standards systems and various actions. From this perspective, the main story behind the 1998 Tour de France concerns a reconfiguring of the system for controlling the use of such drugs. In fact, the doctors who now dominate professional practice and the cognitive frameworks governing the treatment of this question have taken over from the representatives of sporting organisations who previously held power in this issue area. Indeed, the legislative process which subsequently took place in 1999 around the issue of protecting the health of athletes and the ban on use of drugs in sport illustrates the emergence of this new configuration. It even marks the beginning of a new era of regulation strongly influenced by a health and medical approach to drugs in sport

Texte intégralEvery public sector strike brings up the question of a need for a skeleton service. In this area French law is extremely fragmentary and vague. In spite of numerous attempts to introduce legislation no law has been voted. The main reason has been the considerable technical difficulty in reconciling the two basic constitutional principles of the right to strike and the continuity of public services. This study brings into focus the problems and questions arising from the idea of a skeleton service and attempt to identify the most practical solution in the context of French law. To give clearer definition to the study, the Quebec legislation in this field was used as a model. It has been in force for twenty years and this offers many practical lessons. Setting up a skeleton service in the public sector has to be based on an accurate definition of the notion itself as well as its concrete application. Its underlying principles and field of application have to be defined. Qualitative and quantitative aspects, bargain procedures and partners, necessary resources, all have to be identified

Texte intégralOne of the most considerable evolutions of the right contemporary was the emergence of two actors of the business, the expert and the layman. The second was the object of the care of the legislator, which multiplied the laws defenders. The first one, on the contrary, saw itself subdued to a rigorous regime, especially of case law origin. His competence, the information which he arranges, and often his financial dimension, allow him to dictate its law to the layman. It does not mean that the experts are by hypothesis of dishonest people, trying to exploit the situation. It is because they are, by the nature of things, in position of superiority, and that to the layman risk to be the victims

Texte intégralAt the beginning of the Roman Empire era Women enjoyed a certain degree of autonomy. We wondered how it evolved when Roman civilisation had to face the durable installation of Germanic populations on its lands. We undertook to study the turning-point during the 5th to the 7th century. How did legal provisions regarding women, which were derived from the Codex Theodosianus, evolve when Barbarian kings decided in turn to enact written laws? To evaluate the impact of legislative measures on society, we have drawn upon the comments of contemporary authors and compared the text of legal dispositions with practitioners' forms. In order to measure Christian influence on imperial constitutions and on Germanic texts, we read the Fathers of the Church and conciliar decisions. We tried to grasp the reasons for the adoption of particular measures. We have attempted to examine whether it is possible to refer to "women's rights", from the Roman Empire to the Burgundian, Frankish, Visigoth and Ostrogoth kingdoms. Roman law appears to be the common thread which links the Empire to the Barbarian kingdoms, without breaking. It shaped the way women were considered in societies which had become Romano-Germanic. Law and societies' permeation by Roman mores contributed to the merging of peoples. Some Germanic customs obviously survived. Legislation sometimes drew on the fertile ground of Christian thought.
