Texte intégralIl lavoro di ricerca ha ad oggetto lo studio delle molteplici istanze di riforma che da sempre investono il settore dei "Delitti contro la pubblica amministrazione", con precipua attenzione a quella da ultimo varata con la legge 6 novembre 2012, n. 190. L'esame concerne in particolare il pacchetto normativo dei delitti di corruzione ex artt. 318 e 319 c.p., concussione ex art. 317 c.p. ed oggi induzione indebita a dare o promettere utilità ex art. 319 quater c.p. Le fattispecie richiamate costituiscono un promettere un 'tridente spuntato' nel panorama della strategia complessiva della prevenzione e repressione del pactum sceleris, variamente atteggiato, pubblico-privato. Texte intégralThe aim of the research is to study interaction between different levels of governance in the anti-corruption sector. Firstly, the domestic law, especially in the anti-corruption field is strongly influenced by international instruments. The Italian system, for example, starts out from the Anti-Corruption Law, Law No. 190 (the so called "Severino Law", approved by Parliament on 6 November 2012, entering into force on 28 November 2012, and implemented by several regulations). This Law was adopted to implement the UN Convention against Corruption. Secondly, the research aims to study interaction between public and private sector: fundamental concepts for corruption prevention, such as risk management, have been borrowed from one sector to another. Finally, there many players in the anti-corruption sector who are able to create rules (lawmakers, stakeholders, Authorities): the question is if they are part of a virtuous circle in which regulation and enforcement are closely linked. In order to prevent corruption, the law-making process must be based on specific criteria such as flexibility, stakeholder participation and ongoing evaluation of its effectiveness.

Texte intégralOne of the crucial challenges of Criminal Law in the new millennium is to deal with the complexity of contemporary society. The traditional approach based on the State monopoly on criminal matters keeps abreast no longer with the scientific-technological sophistication and the rate of changes in criminal behavior in the era of globalization. In this scenario, we witness the rise of Self-Regulation as an auxiliary tool of crime prevention, whose main goal is to fill the vacuum and to compensate for the rapid obsolescence of state legislation. Compliance Programs, Anti-Bribery Plans, Clinical Guidelines are some of the elements of a diverse constellation of cases in which preventive measures, behavioral rules, surveillance, and sanctions are issued and enforced by a legislator who coincides with the recipient, and which is often a private actor. Nevertheless, the ambivalence of Self-Regulation lies in the fact that – in the face of some positive externalities promised – this paradigm could jeopardize some of the fundamental principles of Criminal Law. The aim of this work is to provide a critical analysis of such phenomenon in order to verify the compatibility of Self-Regulation with the Rule of Law and to assess its efficacy in deterring and detecting misconducts.
